- 0:00Speaker 1: What's up, everyone, and welcome to another episode of the
- 0:02Epstein Chronicles. In this episode, we're going to pick up
- 0:06where he left off with the unnamed Captain from the
- 0:09MCC and his interview with the OIG investigators. Question, all right, inmates,
- 0:15cell mates, and are typically the people that are assigned
- 0:18to the Shoe are they in those three shifts? Or
- 0:21would you have hit the people that are assigned between
- 0:24that time period? So point being, maybe you don't remember
- 0:27specifically I had a conversation with that person or that
- 0:30person or that person. But if they're assigned to the Shoe,
- 0:34not a temporary duty assignment like an OT type of assignment,
- 0:38but the people that were assigned there, that was their
- 0:41duty too. He cuts them off and answers, so, like,
- 0:46I remember specifically I hit daywatch redacted, I remember redacted,
- 0:51whatever his name. I remember these guys. I know I
- 0:55spoke or redacted. I know I spoke to different guys
- 0:58the shoe staff that was always up there. Question, but
- 1:01you just don't specifically remember talking to Noel. Answer? No question, okay, answer.
- 1:07She might have been in the background somewhere. Question right, answer,
- 1:10she could have been there. I don't know. Question, But
- 1:14redacted should have spoken with her answer of course, question okay, answer,
- 1:21because that's part of that's part of the expectations of
- 1:24the unit. If I give you guidance, your guidance should
- 1:26have been disseminated down to the officers.
- 1:30Speaker 2: Question. Okay, how about the people?
- 1:33Speaker 1: So we were going to get into this later, but
- 1:35since we're conversing about it now, it looks like Reyes
- 1:38was moved. I think his appointment with court was at
- 1:41like eight thirty and he was gone from the institution
- 1:45by like one p fifty Does that sound right? Answer
- 1:49something like that. It could have been question, so who
- 1:52was in the show at that time? If he's gone
- 1:54from the institution by like one fifty PM.
- 1:57Speaker 2: Who would have he gets cut off? Answer?
- 2:02Speaker 1: So that would have been all of your six to
- 2:05two and your eight to four staff question. Okay, So
- 2:08I guess let's go from the top. Who would have
- 2:11been the person in charge at the top level? Answer
- 2:15that I mean as far as that would have been
- 2:17chew one because he would have gotten the notice that
- 2:20he was supposed to move the guys question and who
- 2:24was at answer? And move the inmate question? And who
- 2:27was at answer? It was redacted? Question? And what time
- 2:31was he working from. Answer he was working from eight
- 2:34to four. Question, So he was eight to four and
- 2:39those times are accurate on there. And if some lieutenant said, oh,
- 2:42we you know, it says zero to eight, but we're
- 2:45actually ten pm gets cut off. Answer and that's true.
- 2:50But the officers work those prescribed shifts. Question okay answer.
- 2:55The lieutenant was given those shifts because of their commutes.
- 2:59Question okay answer. Some of them were commuting two hours out,
- 3:03so for them to come from various parts of Jersey
- 3:06or Long Island, you know, as a consensus, we said, hey,
- 3:10I will continue because that was the previous administration. The
- 3:14previous captain put that in for those guys. So you know,
- 3:17with those conversations, you know, with the lieutenants, I said,
- 3:20I'll keep that. I said, youano, you try to do
- 3:23things where I come from, where we didn't do those things,
- 3:27you know, as far as that. You know, the captain
- 3:29ran his shifts, whatever the shift was, you did it.
- 3:33But when I came to Brooklyn, that was a common
- 3:35practice in Brooklyn. You know, the captain would allow them.
- 3:38When I was a lieutenant, would allow for us, you know,
- 3:40to work those shifts and due to We've got a
- 3:43staff that commute far out, so that was just an
- 3:47incentive to get these guys to come to work, you know.
- 3:50Question sure answer, So yes, question, But the times for
- 3:54these the shoe staff, that's the actual hours that listed
- 3:57on that answer. But for the line staff, the line
- 4:01staff that roster correctly imitates their schedule. Question perfect. So
- 4:06who then, I guess you said they would be working
- 4:09until four pm? Answer right question, so they would have
- 4:13at least two hours to be able to do something.
- 4:15Answer right question? And who was it that was on
- 4:19that day? Answer? So I had redacted, I had redacted,
- 4:23I had redacted, and I had redacted. Question and did
- 4:27you speak with all of those individuals about the need
- 4:29for a cellmate?
- 4:30Speaker 2: Answer? I believe I did because they were daywatch.
- 4:33Speaker 1: But like I said, it wouldn't have been on August ninth,
- 4:37question right answer, It would have been on the unit
- 4:43question okay, answer for that quarter. So once I got
- 4:46the guidance from redacted of what he wanted me to do,
- 4:49I moved on and did it. So I can't tell you,
- 4:52but I know I spoke the day watched you staff
- 4:56question sure answer. They was the first ones spoke to question,
- 5:01So who then ated there? Who would have the shoe
- 5:04staff reported the matter to answer the what now question?
- 5:10So the shoe staff that's in there, they know that
- 5:12he doesn't have a cell mate and the cell mate
- 5:15is not coming back. Answer okay, so they would have
- 5:18known that he wasn't coming back until probably evening. Watch question. Okay,
- 5:22so you don't think that those guys would have known? Answer? No,
- 5:25they wouldn't have known because I don't know when the
- 5:28inmate left the institution. But what happens is when the
- 5:31court line comes out. I believe that the inmates leave
- 5:33the institution supposed to between six and eight or seven,
- 5:38you know, let's say seven to nine. So between that
- 5:41time those inmates are they're picked up, and then they're
- 5:44transported to a court.
- 5:46Speaker 2: Question.
- 5:46Speaker 1: Okay, so what time did redacted work?
- 5:49Speaker 2: What was his shift? Answer? Redacted was eight to four? Question?
- 5:54Speaker 1: So if we can, let's assume for this instance that
- 5:57redacted knows that he needs a cell mate? Answer right, question,
- 6:01what should he have done? Answer? Probably wouldn't have known question.
- 6:07But let's just say for this instance that he did
- 6:09know answer, So if he knew question, he knew that
- 6:12he needed a cell mate and he knew that the
- 6:14cell mate wasn't coming back.
- 6:16Speaker 2: Question.
- 6:17Speaker 1: He probably wouldn't. But what I'm trying to tell you, sir,
- 6:20he probably wouldn't have known.
- 6:23Speaker 2: Question.
- 6:23Speaker 1: I know, but in this instance, I'm just saying, let's
- 6:27just say that he did answer.
- 6:29Speaker 2: Okay.
- 6:29Speaker 1: So the instance of that would have happened. What would
- 6:32have happened was he should have Okay, this guy is
- 6:35not coming He should have notified me question okay answer,
- 6:40and should have been like, hey, cat, hey reyes Epstein's
- 6:43cell mat Hey, he went to court. He's not coming back.
- 6:47Question and he did not answer.
- 6:49Speaker 2: No question, okay answer.
- 6:52Speaker 1: No. One later informed me that the inmate had even
- 6:54went to court. I didn't even know he went to
- 6:56the court because guess what, during the time this inmate
- 7:00is in court, Epstein is in attorney visiting all day.
- 7:04Question sure answer. So nobody would have even thought about
- 7:08it because, oh, Epstein is in the attorney visiting, his
- 7:11cell mate is not in there. Okay, his cell mate
- 7:13went to court, nobody would have been made aware that
- 7:16he didn't have selly until they went to put him
- 7:19in physically inside of the cell. Question okay, So when
- 7:23do you think it would have been in this instance,
- 7:26when do you think it would have come up?
- 7:27Speaker 2: Answer?
- 7:28Speaker 1: As far as knowing he didn't have a CELLI question
- 7:31correct answer, somebody should have known when he didn't come.
- 7:35That should have been on evening watch. Question so he
- 7:39was on evening watch. Answer so evening watch. Well let's
- 7:43see here, you're talking about the OIC question in the shoe. Answer, yeah,
- 7:50that would have been redacted. Question okay, so redacted? And
- 7:54who should have he reported the matter to?
- 7:58Speaker 2: Answer?
- 7:59Speaker 1: He should have reported it to the operations lieutenant. Question
- 8:02and who was the operations lieutenant at the time? Answer?
- 8:05I believe the lieutenant would have been. That would have
- 8:07been redacted? Question all right? And redacted? Again, you no
- 8:12one told you so obviously redacted didn't tell you?
- 8:15Speaker 2: So okay?
- 8:16Speaker 1: And would redacted gone directly to redacted?
- 8:19Speaker 2: Answer?
- 8:20Speaker 1: Yeah, he would have called redacted. But guess what I
- 8:22was there. I didn't leave that night until like eight something.
- 8:26I was there until eight that night. Question right, And
- 8:29you did not visit the shoe that night though? Correct answer?
- 8:33I can't remember. Question all right. Answer, I'm not going
- 8:37to say I did, or I did make that rounds
- 8:39that day, or I didn't.
- 8:41Speaker 2: I don't know.
- 8:42Speaker 1: Question Yeah, answer, But I know I didn't leave that
- 8:45institution until late that night.
- 8:48Speaker 2: Question.
- 8:48Speaker 1: And you know though that Reys you were never aware
- 8:51on that day August ninth, that Reys you didn't even
- 8:55know he went to court let alone, he wasn't coming
- 8:57back answer correct question all right? And redacted is somebody
- 9:04that you did have a conversation with with regard to
- 9:07the need for a cell mate? Correct answer. I don't
- 9:11know if I again talking to people in all three shifts,
- 9:14do I remember redacted working in the unit? Yeah, but
- 9:17as you're talking to people, I don't remember that. Hey,
- 9:20I talked. There are certain people that I can't remember
- 9:23that I spoke specifically to question right answer, as opposed
- 9:27to some people you know could have been in the area.
- 9:30That's why I can't I know. I talked to the
- 9:32day watch shoe staff for sure. Question okay, answer, and
- 9:37I mentioned those names. I talked to those guys. Question So,
- 9:41but redacted should have certainly have told them answer yes,
- 9:45question so he's in the office in charge.
- 9:48Speaker 2: Who else was on that day? Answer?
- 9:51Speaker 1: You had toven O Well and she was the number two,
- 9:53and then you had redacted.
- 9:56Speaker 2: Toven O Well.
- 9:57Speaker 1: Correct answer, Yeah, question okay, answer Noel, And then you
- 10:01had redacted with shoe three that day, and then you
- 10:04had shoe four was not assigned? Question okay, So those
- 10:08three people were in the shoe. So was it ultimately
- 10:12the officer in charge responsibility? Or should have these other
- 10:16two redacted? Noel have taken any action? Should have contacted anyone?
- 10:22Speaker 2: Answer?
- 10:22Speaker 1: Well, if you're walking and you're doing rounds in the unit,
- 10:25you would see especially at the fore count, because you
- 10:28need to know where all your inmates are. So at
- 10:31the fore count, and where is Epstein. Epstein is at
- 10:35He's in the attorney visiting, because I'm going to get
- 10:37a count slip from the attorney visiting right Where's Reyes?
- 10:41Reyes is out the court? Then somebody should have called
- 10:44R and D indiscernible where is this guy at? Somebody
- 10:47should have called R and D. That means the lieutenant
- 10:50would have been notified because you can't clear the count.
- 10:53Where's the inmate at?
- 10:55Speaker 2: Question? Right?
- 10:56Speaker 1: Answer, So, if you can't clear the count, where is
- 10:58the inmate? The inmate went out? But it's now four o'clock.
- 11:02But I did say that sometimes inmates come back on
- 11:05the four o'clock, so they call that ghosting. So supposedly
- 11:08he's supposed to be at court. But did you get
- 11:11account slip from court? No, when he leaves out of
- 11:13the institution, that's on them. So that means the institution
- 11:17number should have came down minus one.
- 11:21Speaker 2: Question.
- 11:21Speaker 1: So you believe that the shoe should have known by
- 11:24four pm during the four pm count? Answer? Yeah, question
- 11:29all right, And let's in this case, if they didn't
- 11:31do account at four pm, should they have somehow known
- 11:34otherwise after that? So would someone have contacted them and said,
- 11:38by the way, this guy is not coming back? Answer right.
- 11:43So that means that the four o'clock count, when you're
- 11:46going through the unit, he gets cut off. Question But
- 11:49if you didn't do a four pm count, So let's
- 11:52just say in this instance that they didn't do a
- 11:54four pm count. Answer, nobody would know. So unless they
- 11:59do the count, they don't even know that the guy
- 12:01is not coming back.
- 12:02Speaker 2: Question.
- 12:03Speaker 1: Answer that's right. Question, So no one is calling them
- 12:06and saying, by the way, your guy that went to court,
- 12:08he's not coming back.
- 12:11Speaker 2: Answer right.
- 12:12Speaker 1: Question Okay, answer, because you have told you before, sometimes
- 12:16inmates go to court and they don't come back. The
- 12:19only time you're going to know is when these guys
- 12:21always come back from the court line by four question? Okay, answer,
- 12:27but sometimes they don't come back at four. All right, folks,
- 12:30we're gonna wrap up right here and in the next
- 12:32episode dealing with the topic, we're gonna pick up where
- 12:34we left off. All the information that goes with this
- 12:37episode can be found in the description box. What's up, everyone,
- 12:41and welcome to another episode of the Epstein Chronicles. In
- 12:45this episode, we're gonna pick up where we left off
- 12:48with the unnamed Captain in his interview with the OIG Inspectors. Question, now,
- 12:54what was their time shift? Was it four pm to midnight?
- 12:57Speaker 2: Answer? Who? Question?
- 12:59Speaker 1: The people we were talking about the evening watch? Answer
- 13:02yeah there, yes, Ford to midnight. Question so four pm
- 13:07to midnight At that point, if it was recognized that
- 13:10there was no cell mate and he needed a cell mate,
- 13:13could have if they did contact the Opsoleutenant Oppsoleutenant did
- 13:18contact you, could have an inmate been assigned at that
- 13:22time or would that have to wait till the next day?
- 13:25Speaker 2: Answer?
- 13:26Speaker 1: Well, I would have done if I would have known
- 13:28right then and there that he didn't have a cell mate.
- 13:30He's already an attorney visiting. Right question, yep answer. So
- 13:35I would have went on ahead, all right, keep him
- 13:37an attorney visiting. I would have called guess who I
- 13:40would have called. I would have called the aw to
- 13:44let him know well redacted, and I would have called
- 13:47the warden. I would have said, hey, look this guy
- 13:49went out the WAB today or Reyes didn't come back
- 13:53from court. We got to bet another guy. Question, okay answer,
- 13:58and that's what would happen. And plus I was there
- 14:00at eight. So let's say he got released from attorney
- 14:03visiting and he didn't go back, and when they went
- 14:06to let's say, hey, this dude, he don't have a
- 14:08cell mate.
- 14:09Speaker 2: I would have been like holed up.
- 14:10Speaker 1: I would have said, because I got R and D
- 14:12staff down there, right, because I can't put him on
- 14:16suicide watch. I can't put him on close supervision. So
- 14:19I would have said, hey, quarterer, this guy right now
- 14:22an R and D. Put a staff member on it,
- 14:24which would have been Fox one. Put him on Fox one,
- 14:27put a staff member down there. Let me call the warden.
- 14:31Question what does fox one mean? Answer? That means that's
- 14:34R and D question, okay answer, that's the cell assignment.
- 14:38I believe it would have been Fox one. Just I
- 14:41can't put him on suicide watch question right and then
- 14:45Fox one people monitor at all times. Answer no, But
- 14:49I would have had somebody monitor him. I would have
- 14:51had hey, put a staff member down there and watch
- 14:54this guy until we get him a cell mate.
- 14:57Speaker 2: Question.
- 14:57Speaker 1: Okay, and you think that the same day, August ninth,
- 15:00he would have had a cell mate if you were
- 15:02made aware. Answer yeah, if I was made aware he
- 15:06would he would have got a cell mate. Question Okay.
- 15:09Now let's go back and say if redacted did know
- 15:12and didn't tell anybody, he didn't tell you. He didn't
- 15:14tell redacted? Is he the one he gets cut off
- 15:19by the captain? He dropped the ball? Answer or question?
- 15:24Speaker 2: Right?
- 15:24Speaker 1: Answer? Because again, like I told you about count and
- 15:28made a good statement, then how did you clear the count?
- 15:32Speaker 2: Question?
- 15:32Speaker 1: Uh huh? So the two people that So if redacted
- 15:35knew and he didn't tell anybody, he dropped the ball.
- 15:38But at the same time, if the four PM count
- 15:41was conducted, they would have then raised the issue with
- 15:43redacted answer right question, So there would have been two
- 15:48checks there answer right question and if not, it would
- 15:52have also happened at the ten pm count as well.
- 15:55Speaker 2: Answer right. Question.
- 15:56Speaker 1: So if the four pm count the ten pm count
- 15:59were both, there would have been noticed. Hey, no cell mate,
- 16:03bring it up to redacted? Answer correct. Question all right.
- 16:07So if redacted didn't know, Redacted didn't tell him. So
- 16:11Redacted dropped the ball, the shoe staff dropped the ball,
- 16:14it looks like answer right. Question okay? Before we move
- 16:17on from that, do you want to talk about anything
- 16:19specific to that notion?
- 16:22Speaker 2: Answer?
- 16:22Speaker 1: No, question okay? Answer can we take a break? Question
- 16:28absolutely all right, So they take their break, then they
- 16:32come back. Question all right, So what we are talking
- 16:36about before? Before we move on, I just want to
- 16:39go back to so you said if redacted knew he
- 16:41dropped the ball, if the shoe staff didn't do their
- 16:44accounts at four pm and at ten pm, that's when
- 16:47they would have next found out that Epstein was without
- 16:51a cell mate, and they would have then reported it up.
- 16:54Answer m hmmm. Question correct. What did we want to
- 16:58follow up with on that one? Answer? If a notification
- 17:02came from the court that Reyus wasn't coming back, who
- 17:05would have got the notification? Answer? That notification would have
- 17:08came through R and D and through the control Center,
- 17:11which the Control Center would have updated the count in
- 17:14century to reflect if the inmate was physically in the
- 17:17institution or was still out in the court. So it
- 17:20would be contingent to look at the century roster, which
- 17:24would be the e one that the Control Center had
- 17:26created for those counts, to find out if Rays was
- 17:30still on the count as physically being in the institution.
- 17:33Speaker 2: Or out to court.
- 17:36Speaker 1: Question Okay, and to Forig and d in control did
- 17:39get that notification, did they have to notify the shoe? Answer?
- 17:42Speaker 2: Yeah, because then the count would be off. Question.
- 17:46Speaker 1: If let's just say that the notification came between one
- 17:49and three, who in the shoe would have been notified?
- 17:53Answer the OIC which would have been for the day watch.
- 17:57It would have been either redacted or redacted. And what
- 18:00should they have done?
- 18:02Speaker 2: Answer?
- 18:02Speaker 1: And with that one time, they would have reflected on
- 18:05inside of century. And also they would have known that
- 18:08the inmate was not physically there and they would have
- 18:11had notified the operations lieutenant that this guy didn't come back.
- 18:15So that means somebody would have had to make sure
- 18:17that the institutional count was right or wrong.
- 18:21Speaker 2: Question.
- 18:22Speaker 1: So in this instance, if redacted new who would have
- 18:24been the one that would have been informed. Answer, that
- 18:27would have been the one that have been either redacted
- 18:30or redacted would have notified them. But then I also
- 18:33said that redacted worked in the capacity of OIC because
- 18:37a lot of those officers would say, oh, I don't
- 18:39have the ability to log on into the program, so
- 18:43he would do double duties.
- 18:46Speaker 2: Question.
- 18:46Speaker 1: Okay, So let's say that the Shoe staff that time
- 18:49did notify redacted. Let's say that redacted now didn't take
- 18:53any action.
- 18:53Speaker 2: Okay.
- 18:54Speaker 1: Now, let's say that the next Shoe staff comes on board,
- 18:57should they continue to report the matter up the chain?
- 19:00Speaker 2: Answer?
- 19:00Speaker 1: Yeah, question even though the Shoe that replaced them already
- 19:03made the notification that Epstein was without a cell mate
- 19:07and needed a new one. Answer, because their account would
- 19:10have been off. And then they wouldn't have known that,
- 19:14you know, when they brought him back from attorney visiting
- 19:16that the cell was empty.
- 19:18Speaker 2: Question.
- 19:19Speaker 1: Right, And I'm not specifically talking about the count right now.
- 19:22What I'm saying is like, if the Shoe did notify redacted, Hey,
- 19:26Epstein is required to have a cell mate, and the
- 19:28cell mate is gone, we need to get him a
- 19:30new one. Redacted now never takes any action. Should the
- 19:34Shoe later that day made the same notification too in
- 19:38this case to redacted, Hey, Ebstein still hasn't been reassigned
- 19:42to cell mate? Answer correct question. Okay, So the Shoe
- 19:46may have done it right at day watch and redacted
- 19:48got the notification, but the Shoe on the night watch
- 19:51gets cut off by the captain. Didn't do it? Answer,
- 19:55didn't do it, and they should have answer because he
- 19:59was an attorney visiting. So they said, oh, it was
- 20:01an empty cell. We said, okay, yeah, Epstein is still
- 20:04at attorney visiting. Nobody would have cared about the Selli
- 20:07because they would have thought that he was still out
- 20:09at court. Question okay, answer, But if he did come
- 20:13back by eight that night, somebody would have said something.
- 20:17Answer or question. Now, let's go even further from now,
- 20:21we go from evening watch to now morning watch. We're
- 20:24on August tenth, where Noel and Thomas are now in there.
- 20:28Answer correct question. Should they have made the notification to redacted?
- 20:33Answer they wouldn't have known. Question all right, so they
- 20:35should have gets cut off by the captain. They would
- 20:39have been in the unit with the assumption that all
- 20:42of the inmates have been accounted for by the previous
- 20:44shift because the count didn't go wasn't bad question? So
- 20:48that's the twelve am, three am, and five am answer correct.
- 20:52Speaker 2: Question.
- 20:52Speaker 1: Are you saying they don't really need to do those counts? Answer? No, no, no,
- 20:57I'm not saying that. What I'm saying is they wouldn't
- 20:59have not have known that the inmate didn't come back
- 21:02from court if it wasn't addressed on either at day
- 21:05watch or evening watch. Question okay, answer, they wouldn't know.
- 21:09They would just can't be responsible for counting what inmates
- 21:13was housed in that unit between the hours of twelve
- 21:15to five, because those are the three counts. So yeah,
- 21:19let's see, these are the three counts. Let's look question
- 21:22So the five o'clock one answer? All right, so I
- 21:25got the five o'clock. It looks like we got the five,
- 21:28the ten, the midnight, the three, the five, and then
- 21:32is this the rounds?
- 21:33Speaker 2: Answer?
- 21:34Speaker 1: Yeah, that's the control question the control answer. Yeah, we
- 21:38don't want this. I'll take this question. Okay, So here
- 21:41are the counts from August ninth, from four pm through
- 21:44August tenth through five am. Answer okay, question, Now we
- 21:49have reason to believe that the four pm, the ten pm,
- 21:53the twelve am, and the three am and the five
- 21:55pm none of them were conducted.
- 21:57Speaker 2: Answer?
- 21:59Speaker 1: Okay, So what you're saying that the four pm count
- 22:02for August ninth was not done and the ten wasn't done?
- 22:05Speaker 2: Answer?
- 22:05Speaker 1: And the ten, nor was the twelve, the three or
- 22:09the five am. Now is there a way to look
- 22:12at that if there is someone, let's say, because at
- 22:14this twelve am count, you'll notice there's a discrepancy, there
- 22:18is one inmate, they're off by control says, hey, you're
- 22:21off by one. Is there a way to kind of
- 22:24look at these counts and notice, all right, this would
- 22:27have been picked up then, or a way to kind
- 22:29of just tell that these weren't conducted by just looking
- 22:31at the documents or noticing if you know, if Reyes
- 22:34is gone by one point fifty, you know he's released.
- 22:37Speaker 2: Is there a way to tell that? Because you've got
- 22:39it right here? Answer?
- 22:41Speaker 1: Okay, question, this is the forum right there. This will
- 22:44tell you who the inmates are out of count question okay, answer,
- 22:51and that's from small. He was one of the receiving
- 22:53and discharged employees that was probably working on August ninth,
- 22:57question okay. Answer, so she would know who was still
- 23:00out at count, so that means Operations lieutenant didn't even
- 23:03sign it. That's a violation.
- 23:06Speaker 2: Question.
- 23:06Speaker 1: So this document that you're looking at, it looks like
- 23:09what is it like the third page on there?
- 23:11Speaker 2: Answer?
- 23:11Speaker 1: Yeah, that that should have been because you've got it
- 23:15right there, Clark unassigned work assignments. So this inmate Clark
- 23:19that's saying he's out at court. Question okay, answer, so
- 23:26now our account is minus one, but we know where he.
- 23:28Speaker 2: Is because he's still out at court.
- 23:30Speaker 1: So ray is that count? So if he went out
- 23:33to court, let's say we was at eighty eight. Let's
- 23:36just say when he went out to court, him and
- 23:39Clark went out, he would have went down to eighty six.
- 23:42But guess what Reyes drops off the count? How he
- 23:45got released?
- 23:46Speaker 2: Question?
- 23:47Speaker 1: So if he was released gets caught off by the captain,
- 23:50form that should have come from the marshals back to
- 23:53us saying that he got released. Question So between ten
- 23:57am and the four pm count, would there have been
- 23:59a in there showing that he was released? Answer?
- 24:04Speaker 2: There should have been.
- 24:05Speaker 1: Question Okay, answer that should have been generated from the
- 24:09marshals because it's a transfer order. You heard of a
- 24:11transfer order every time an inmate goes off. If you've
- 24:14got ten that went out to court that day, that's
- 24:17the transfer order. Whatever the disposition of those inmates are, Okay, boom,
- 24:21ten went out to count eight coming back? Okay, where
- 24:24are the other two?
- 24:25Speaker 2: Okay?
- 24:26Speaker 1: I got this guy that's still out of counted and
- 24:29he's at court. He's still at whatever at this time frame.
- 24:32Where's reyes? There should have been a transfer re seat
- 24:35signed by the marshals, by the staff that was at
- 24:38the New York Court over there, the people that handle
- 24:41the inmates. That transfer order should have been sent back
- 24:44with whoever was transporting the inmates and brought back to
- 24:46the institution to say that this guy never came back.
- 24:51Question So the third page that you're saying, though, that
- 24:55was a violation that the operations lieutenant didn't sign? Answer right?
- 25:01Question Would that have been redacted or redacted at the time? Answer?
- 25:05Because all the staff it's called the thirty day file.
- 25:09Speaker 2: Answer.
- 25:09Speaker 1: So, what the lieutenants are supposed to do on their
- 25:11shift is supposed to when they make grounds in control,
- 25:14they're supposed to because we're supposed to take count on
- 25:17every shift, especially in the off hours. So before Epstein,
- 25:21that was a responsibility. On the off hours, you'll be
- 25:25responsible for taking count, so that evening watch guy would
- 25:28take the ten count, right or somebody somebody would take
- 25:31the four o'clock count. So the operations lieutenant or the
- 25:34activities would normally go down and take the four. They
- 25:37would go through the paperwork for that day up to
- 25:40four o'clock and you would sign all the forms, like
- 25:42if somebody checked out keys restricted key forms, Operations is
- 25:46supposed to sign it?
- 25:48Speaker 2: Question mm hmm.
- 25:50Speaker 1: Answer, if the transfer order receipts come back, you're supposed
- 25:53to sign it. Whatever happens on that shift, you're supposed
- 25:56to sign the count slips that form right here that
- 25:59should have been signed by the lieutenant.
- 26:02Speaker 2: Question.
- 26:02Speaker 1: Okay, so these forms that we're looking at four pm,
- 26:05there is a number of signatures that are missing. Answer, yeah,
- 26:08question and should have that been the lieutenant as in
- 26:12it looks like redacted answer official preparing count, official taking count?
- 26:18Those are going to be so the person that was
- 26:20taking the count would have been the OIC. Then the
- 26:22person who actually was there as a lieutenant that was
- 26:25taking the count. Normally we would sign it in the
- 26:28end or in red question, Now the lieutenant, when you
- 26:31say that they're there, aren't they in the control center?
- 26:34Speaker 2: Answer?
- 26:35Speaker 1: They're in the control center while the officers are doing count.
- 26:40Question Okay, so the shoe calls in says, we got
- 26:42count seventy two, seventy three, seventy four, whatever it is.
- 26:46And in this case, when you look at the four
- 26:48PM though, you're seeing that there was no lieutenant that
- 26:51signed off on that answer no question, So on the
- 26:55first page as well as the third page, was there
- 26:59they should have signed answer right?
- 27:02Speaker 2: Question? All right?
- 27:03Speaker 1: And then gets cut off. Yeah, because I got to look,
- 27:07I got a signature for this one that was approved
- 27:10by the operations lieutenant right here. Question and to a
- 27:13Z answer that's I don't know who that signature is.
- 27:18Question all right. It looks like redacted would have been
- 27:20on duty. Is that the time? Question or answer that's
- 27:24going to be four pm? Whoever took the four PM
- 27:27that lieutenant would have been redacted? All right, folks, We're
- 27:31going to stop right here, and in the next episode
- 27:33we're going to pick up where we left off. All
- 27:36the information that goes with this episode can be found
- 27:39in the description box. What's up, everyone, and welcome to
- 27:42another episode of the Epstein Chronicles. In this episode, we're
- 27:46going to pick up where he left off with the
- 27:48unnamed captain from the MCC and his interview with the
- 27:53olig investigators. Question, Okay, can we go to the shoe
- 27:59count slip themselves and that should be the last like
- 28:02page or two answer? See, yep, those are the inmates
- 28:06that went to the attorney visiting. So those three would
- 28:09have been on the count slip. Now you said where
- 28:12question the very last page, it's like the actual slip
- 28:17answer by the captain these question yep, So these are
- 28:22the slips that the actual shoe for the ones that
- 28:24are in the shoe. Can you just put an initial
- 28:26buy it or circle it or whatever which one it
- 28:30is that would have been conducted at the shoe answer Okay,
- 28:35I think it's Zulu Zulu bravo Zulu alpha. Question so
- 28:41z A and zb are the two shoes. Answer yes,
- 28:45question are there any more than that? Answer you have
- 28:50so that you've got food service gs, indiscernible attorney visit.
- 28:55That's Kilo India, that's court Kilo Zulu. Yeah, so Zulu
- 29:00alpha would have been that and then that would have
- 29:02been ten South question. All right, so ten South answer
- 29:07Charlie Alpha, Charlie Alpha question, but no, just specific to
- 29:12the shoe like where not. I don't know if ten
- 29:14South is considered chee, but I'm just talking specifics to
- 29:18like where Epstein was in the shoe, like who you
- 29:23know that? I'm assuming the seventy two to seventy three
- 29:25count answer? Yeah, right here. That would have been the
- 29:29Zulu Bravo and Zulu alpha question. All right, great, and
- 29:34are you able to tell me who all are on
- 29:36those slips? Answer? It says redacted and toven no wel
- 29:41and redacted question okay answer. And that would have been
- 29:45for the four o'clock question. All right, answer for redacted
- 29:50in Tovin no wel for the four o'clock count question.
- 29:53Speaker 2: Okay.
- 29:53Speaker 1: And now what is the difference between the ZB and
- 29:56the ZA.
- 29:58Speaker 2: Answer?
- 29:59Speaker 1: I believe the Z is total shoe question okay answer.
- 30:03And then then you had the inmates that were up
- 30:06on ten South question. Okay, so the ZB is that
- 30:10ten South? Then answer yes question, So we're focused on ZA.
- 30:15Answer yes question. All right, So ZA, and that one
- 30:20was signed by who answer? It looks like Noel and
- 30:23redacted and redacted. Question, Now, if that count wasn't actually conducted,
- 30:28are they the only two that are responsible for falsifying that?
- 30:32Or would other people he gets cut off by the captain,
- 30:36This would be the whole unit, the OIC, everybody that
- 30:41was in the unit. Question Okay, answer, because that means
- 30:45on evening watch. I believe you have one, two, three,
- 30:48four staff and they all have a different range that
- 30:51they have a responsibility of. Question okay, answer, you know
- 30:56what I'm saying. So they feed us, they feed the ranges,
- 31:00They monitor the ranges by doing the thirty minute rounds.
- 31:03So the OIC has the key. So those other three staff,
- 31:06the number two, the three, and the four, I believe
- 31:09they're supposed to do rounds, feed, do issue cosmetics, do
- 31:13whatever they need to as far as the normal operations
- 31:16inside the unit. So if nobody counted, that means who count?
- 31:20Who helps assist in counting? Intent south for the five guys?
- 31:25Question right, answer, Because I believe the lieutenant is supposed
- 31:29to come up normally the activities will go up, I
- 31:32believe and do the count in Zulu bravo. So that
- 31:35means that one of the lieutenants would be up in
- 31:38the unit when the count was going on. Question So
- 31:41in this case a lieutenant should have actually been present?
- 31:45Answer yes, question which lieutenant on that date? Would that
- 31:50have been? Answer?
- 31:53Speaker 2: So that would have been that would have been.
- 31:58Speaker 1: Probably redacted took the count and then redacted or misredacted
- 32:03would have been in ten South doing the count in
- 32:05ten South, I believe if I could remember, it's been
- 32:08a while because it's only per there's only one staff
- 32:12member inside of ten South. Question so redacted should have
- 32:17been present for the count at four pm? Answer yeah,
- 32:21because I'm looking and you have ten South number one
- 32:24was redacted, and then you had ten South number two
- 32:27was g redacted, So G redacted probably was up there
- 32:30doing property. Question Now is this the only for the
- 32:35four or should there have been a lieutenant as well
- 32:38as in the ten pm, twelve pm or twelve am,
- 32:42three am, and five am. Answer so redacted? Question so
- 32:48who was redacted? Answer redacted is one of the officers?
- 32:52Question what's the first dam on that? Answer redacted? And
- 32:56then I'm looking here, so ten South number two is redacted,
- 32:59which is the property officer. So during that time I
- 33:03was hiring redacted to go up here and get the
- 33:05property situated on the evening watch. Question, so is redacted
- 33:10even working in the shoe at that point? I think
- 33:12he would have had the first he gets cut off
- 33:16by the captain, because you know that, because that would
- 33:18have been redacted. Let me look at the day because
- 33:21I don't think he would work that because it said
- 33:23redacted is the number one question, And that's where I'm
- 33:27confused by looking at some of these counts. Why would
- 33:30they even have he gets cut off by the captain?
- 33:34Redacted was on overtime, so redacted was day watch. So
- 33:37that means redacted probably came in late. Question okay, answer,
- 33:42So redacted probably did the count because redacted didn't get
- 33:46there and now he was notorious for that question okay answer,
- 33:52Redacted is a good guy, but he had some health
- 33:54problems and maybe he didn't get there on time. So
- 33:57redacted went on ahead and since the count started at four,
- 34:01he probably went ahead and did the count. Question all right,
- 34:05and are you able to tell on that does this
- 34:08have a time for when the count was supposedly conducted? Answer?
- 34:13It's all of them going to reflect four. Question just four.
- 34:17Answer four. It's not going to say four five four
- 34:20h four. The count is four PM question. Okay, So
- 34:24in this case, though, the one for the overall shoe
- 34:28that would have been you said, is that a indiscernible
- 34:32or are you just telling that's four tense? Self answer?
- 34:36Overall shoe would have been Zulu alpha question. Yeah, and
- 34:42who was on that? That's where he gets cut off
- 34:46by the captain Noel and redacted questions. So redacted, redacted
- 34:51and Noel would have been the ones that did the overall.
- 34:54But what you're saying is everyone if the overall count
- 34:57was not conducted, everyone was responsible. Answer yes, question for
- 35:03falsifying that answer yep. Question because everyone would have known answer,
- 35:09They would have known question that it was conducted. Answer
- 35:13that it was conducted, that it wasn't conducted. Question, Now,
- 35:16is there any kind of like, hey, we fed them,
- 35:19that's how we did our count? Answer, no count. Because
- 35:23I put this guidance out the difference between doing rounds
- 35:26and accurate rounds. You know, we talked about the timeframe
- 35:29that goes between the thirty minute rounds. So like let's
- 35:32say it's eleven o'clock, you should do a round somewhere
- 35:35between eleven and eleven thirty You understand question?
- 35:39Speaker 2: Yep?
- 35:40Speaker 1: Answer if it's done at eleven twenty nine, that's fine,
- 35:43but you should be doing it within that thirty minutes
- 35:45because it has to be irregular. So you can't put
- 35:49on there and said I did rounds at eleven eleven
- 35:51thirty question twelve, answer twelve twelve thirty. You know you
- 35:58can't do it like that. So let's say you know, oh,
- 36:00you're feeding up there. You're up here feeding, but the
- 36:03round is going to be because you're not monitoring, you're
- 36:06doing a service. Just because you're on the range. That
- 36:10means you did around. Around is physically stopping what you're doing.
- 36:14So if I'm feeding during the time I'm supposed to,
- 36:17I'm supposed to do around secure the slot, I go
- 36:20to the beginning of the range one, two, five, seven, nine, eleven, whatever, whatever, whatever,
- 36:26document the time I did the round, then go back
- 36:29to feeding. It's not while I'm up there, Okay, I'll
- 36:32feed the range. It took me seven minutes, seven point
- 36:35nine seconds to feed around, and so that's telling me
- 36:39that you did a regular round for an hour one
- 36:41hour because you was up there for forty five minutes.
- 36:44Did you do around? Question right?
- 36:48Speaker 2: Answer?
- 36:49Speaker 1: Did you can I physically watch you go from cell
- 36:52to cell. That's around. Question. But what about so can
- 36:56a round can't be account but can account be around?
- 37:01Speaker 2: Answer?
- 37:01Speaker 1: No question. So every thirty minutes, if you're doing account
- 37:05at four, you also have to do a round at four?
- 37:08Answer yep question Okay, answer because if I go up
- 37:12there at four, If I go, let's say I start
- 37:15at four at four, what's going to be that round?
- 37:18You understand what I'm saying because count, I'm taking accountability
- 37:21of the units. So if it takes probably two or
- 37:24three minutes to count, that would be four oh three,
- 37:27and I count in that range, I go to the
- 37:30next range. I'm done at four oh nine, four sixteen, four,
- 37:33twenty four, twenty seven. Guess what between thirty to five,
- 37:37I got to go and do another round in between
- 37:39that timeframe not to exceed forty minutes. That's the policy question. Okay,
- 37:45do you know anything about the shoe not conducting rounds?
- 37:48Speaker 2: Answer?
- 37:49Speaker 1: Do I know of the shoe not conducting rounds?
- 37:52Speaker 2: Question?
- 37:52Speaker 1: If the personnel in the shoe do you know anything
- 37:55about that?
- 37:56Speaker 2: Answer?
- 37:56Speaker 1: Do I know the shoe not conducting rounds?
- 37:59Speaker 2: Question?
- 37:59Speaker 1: If the personnel in the shoe, do you know anything
- 38:02about that?
- 38:02Speaker 2: Of them.
- 38:04Speaker 1: Answer, I would have never known that those staff were
- 38:07not because again that's not my purview. Question sure, answer
- 38:11to sit down and monitor the rounds. Question I just
- 38:17mean like, had anybody told cut them off? Answer no,
- 38:22I would have never known. Until after the Epstein thing,
- 38:24we had to monitor the camera footage of what the
- 38:26shoe staff did, and I was appalled to what they
- 38:29were doing on those off hours. Question so, now, after
- 38:34the fact, are you aware if any of these counts
- 38:36were conducted or not conducted?
- 38:39Speaker 2: Answer?
- 38:40Speaker 1: I was not made aware that no account was conducted
- 38:42because I do not monitor camera footage of the staff,
- 38:46so I wouldn't know. Question No, I'm saying after the facts.
- 38:50Speaker 2: So now.
- 38:52Speaker 1: Answer now I know, and I was. And again when
- 38:55I had to monitor the footage per the new directive
- 38:58that was put out for Central Office, and the Captain
- 39:01would have to monitor x amount of hours of shoe
- 39:03footage per week. Even after we had the situation with Epstein,
- 39:08staff still wasn't doing it right. Question But in what
- 39:13I'm asking is in those instances, do you know if
- 39:16the four, the ten, the five, on these August ninth
- 39:20and August tenth, he gets cut off by the Captain,
- 39:23I would have thought they would have been done.
- 39:26Speaker 2: Question, but do you.
- 39:28Speaker 1: Now do you know if they were or weren't? Captain answers,
- 39:33I was told that they were not conducted. Question four
- 39:36PM as well. Answer. I was told that the officers
- 39:39that were assigned to the morning watch shift did not
- 39:42do the rounds from the time they walked into the
- 39:44unit until the time they found inmate Epstein deceased in
- 39:47his cell. Question that I think what you're referring to
- 39:52is on August tenth, I'm saying August ninth. Answer August ninth.
- 39:57I would have not have known that question. No, No,
- 40:01now I'm talking about answer now. I'm aware of it
- 40:05because if the inmate didn't come back from court, how
- 40:07did you clear court?
- 40:09Speaker 2: Question?
- 40:10Speaker 1: And did you know that prior to this conversation?
- 40:13Speaker 2: Though?
- 40:13Speaker 1: Have you ever he gets cut off by the captain?
- 40:16Speaker 2: No question.
- 40:18Speaker 1: So what I'm saying is you didn't have or never
- 40:22heard up until this date that it's possible that the
- 40:25four PM and the ten PM were not conducted. Answer
- 40:29that is correct. Question all right, and no one ever
- 40:33brought this to your attention. Answer that is correct.
- 40:36Speaker 2: All right, folks.
- 40:37Speaker 1: We're going to wrap up right here, and in the
