Latest / Beyond The Horizon / Mega Edition: Chad Daybell Trial (Part 15) (10/21/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to head back out to Idaho,
- 0:06Speaker 1: and we're going to get a recap of what went
- 0:08Speaker 1: down on the 15th day of the Chad Daybell trial.
- 0:12Speaker 1: And to do that, once again, we're going to be
- 0:15Speaker 1: using EastIdahoNews.com and an article authored by Nate Eaton. 8.28 a.m.
- 0:21Speaker 1: We are in the courtroom. Sheila Daybell, Chad Daybell's mother,
- 0:24Speaker 1: was escorted into the courthouse this morning. We also saw
- 0:28Speaker 1: Heather and Matt Daybell, Chad's brother... In the lobby of
- 0:30Speaker 1: the courthouse. Matt is in the courthouse. Heather is not.
- 0:35Speaker 1: She and Sheila may be testifying today. 8.32 a.m. Chad
- 0:40Speaker 1: Daybell is sitting alone at the defense table wearing a
- 0:42Speaker 1: blue dress shirt and a red tie. Matt Daybell is
- 0:45Speaker 1: sitting next to Kay Woodcock and Vicki Hoban, Tammy Daybell's aunt.
- 0:50Speaker 1: Larry Woodcock is also sitting with them. 8.36 a.m. The
- 0:54Speaker 1: attorneys are not in the courtroom yet. They are likely
- 0:56Speaker 1: meeting with Judge Boyce. 8.42 a.m. Boyce is on the
- 1:00Speaker 1: bench and the jurors have entered the courtroom. Around 30
- 1:03Speaker 1: to 40 people are in the gallery today. 8.43 a.m.
- 1:08Speaker 1: A juror was unable to attend today due to illness.
- 1:11Speaker 1: Boyce says he has been dismissed from the trial. Boyce
- 1:14Speaker 1: and the attorneys had a sidebar this morning about the issue.
- 1:18Speaker 1: And that's why they have those alternate jurors, right? Somebody
- 1:21Speaker 1: gets sick. Somebody can't attend. Then one of these alternate
- 1:24Speaker 1: jurors steps up and they take the place of the
- 1:26Speaker 1: juror who is no longer able to attend. And then
- 1:30Speaker 1: that obviously is where the backup jurors come into play. 8.44 a.m.
- 1:35Speaker 1: Kay Woodcock takes the stand as the state's first witness today.
- 1:38Speaker 1: Madison County Prosecuting Attorney Rob Wood will question Kay. 8.45 a.m.
- 1:44Speaker 1: Wood displays a photo of J.J. He asks Kay who
- 1:47Speaker 1: it is. My grandson, J.J. Vallow. Kay explains that her
- 1:51Speaker 1: son had a girlfriend and they had a baby. They
- 1:54Speaker 1: named him Kanan Trahan. They were unable to care for him,
- 1:58Speaker 1: so he came to live with Kay and Larry. 8.46 a.m.
- 2:02Speaker 1: JJ was born 10 weeks premature and weighed around 2.5 pounds.
- 2:06Speaker 1: He was born with drugs in his system and spent
- 2:09Speaker 1: some time in the hospital. After JJ was out of
- 2:12Speaker 1: the hospital, he lived with Larry and Kay. Charles Vallow
- 2:16Speaker 1: and Kay's older brother. Charles was married to Lori Vallow.
- 2:20Speaker 1: So this kid had no chance right from the jump, right?
- 2:23Speaker 1: Born with drugs in his system, his parents obviously were
- 2:26Speaker 1: drug addicts, so right from the very jump this poor
- 2:29Speaker 1: little boy had no chance. 8.48 a.m. Charles and Lori
- 2:33Speaker 1: approached Kay and Larry early on and asked if they
- 2:36Speaker 1: would consider letting them adopt J.J. Larry and Kay agreed
- 2:40Speaker 1: but wanted to maintain the role of grandparents in J.J.
- 2:42Speaker 1: 's life. When Charles and Lori adopted J.J., they changed
- 2:46Speaker 1: his name to Joshua Jackson Vallow. 8.49 a.m. Kay says
- 2:52Speaker 1: she and Larry had a really hard time letting JJ go.
- 2:55Speaker 1: They would see him every two to three months. Charles
- 2:58Speaker 1: and Lori moved to Hawaii in 2014. Kay would go
- 3:02Speaker 1: and visit JJ in Hawaii. Kay says she was very
- 3:05Speaker 1: close with Charles. He was the proud dad. He would
- 3:08Speaker 1: send pictures and videos of JJ all the time. We
- 3:11Speaker 1: were very close. 8.52 a.m. Wood shows a photo of
- 3:15Speaker 1: Tylee on the screen and asks Kay who it is.
- 3:17Speaker 1: Tylee Ryan, Kay responds. Would ask Kay if she ever
- 3:20Speaker 1: met Alex Cox. Kay did meet him in passing a
- 3:23Speaker 1: handful of times, but never really sat down and had
- 3:26Speaker 1: a conversation with him. 8.54 a.m. Would ask Kay if
- 3:30Speaker 1: she saw JJ in January of 2019. She says Lori
- 3:34Speaker 1: and Charles separated at the end of January. Kay flew
- 3:37Speaker 1: out to Arizona at the end of January to help
- 3:39Speaker 1: Charles with JJ because Charles was very distraught. Nobody would
- 3:43Speaker 1: tell Charles where Lori went. And if you haven't watched
- 3:46Speaker 1: that documentary on Netflix yet about Lori Vallow, and you're
- 3:50Speaker 1: interested in learning a little bit more about the Charles
- 3:52Speaker 1: Vallow situation, that documentary really does a good job of
- 3:57Speaker 1: framing everything for you. And it shows you that obviously
- 4:00Speaker 1: Charles was murdered. There was no dispute. There was no
- 4:04Speaker 1: issues where he grabbed the baseball bat or something like that.
- 4:07Speaker 1: In fact, Alex Cox was flown into Arizona to assassinate
- 4:12Speaker 1: Charles Vallow. That's really what it comes down to. 8.55 a.m.
- 4:16Speaker 1: Kay would sometimes bring JJ home with her to Louisiana,
- 4:19Speaker 1: or she would stay with him in Chandler if Charles
- 4:21Speaker 1: was working. Toward the end of March, Kay helped Charles
- 4:25Speaker 1: pack up his house in Arizona and help them move
- 4:27Speaker 1: to Houston so he would be closer to Louisiana, where
- 4:30Speaker 1: Kay and Larry live. Houston is 150 miles from Lake Charles. 8.57 a.m.
- 4:37Speaker 1: Kay says in mid-April 2019, Lori visited Houston. Charles really
- 4:42Speaker 1: wanted to reconcile with Lori, but Lori refused. Wasn't interested.
- 4:46Speaker 1: Charles was a financial planner and asked Kay to help
- 4:48Speaker 1: him with his business. She did payroll, accounts payable, Excel spreadsheets, etc. 8.59 a.m.
- 4:57Speaker 1: Kay had access to her brother's email accounts. After Lori
- 5:00Speaker 1: came to Houston, Kay continued to see JJ. In May,
- 5:04Speaker 1: Charles visiting Kay and Lori on weekends so JJ could
- 5:08Speaker 1: visit with him. Charles rented Lori a house in Chandler
- 5:11Speaker 1: in June. 9 a.m. Kay says Charles was headed for divorce.
- 5:16Speaker 1: The day he was murdered, on July 11th, he had
- 5:19Speaker 1: multiple arrangements to meet with a friend who was going
- 5:22Speaker 1: to show him a house to lease not far from Lori's,
- 5:24Speaker 1: Kay says. Would ask Kay how Charles died. Two gunshot
- 5:28Speaker 1: wounds to the chest. Yeah, and it wasn't self-defense. Absolute garbage.
- 5:35Speaker 1: This man was murdered by Lori Vallow and her brother. 9.01 a.m.
- 5:39Speaker 1: Would ask if Kay ever had a conversation with her brother.
- 5:42Speaker 1: about being her beneficiary on his life insurance policy. Kay
- 5:46Speaker 1: says yes. He had a $ 1 million life insurance policy,
- 5:50Speaker 1: and Kay committed to give Charles two adult sons, $ 250, 000 each,
- 5:55Speaker 1: which she did, in January of 2020, and Charles said
- 5:58Speaker 1: the other 50% was for Kay and Larry because they
- 6:01Speaker 1: would end up raising JJ if anything happened to Charles.
- 6:05Speaker 1: Kay says it was a very short conversation, and she
- 6:08Speaker 1: never knew if he followed through and changed the policy. 9.03 a.m.
- 6:13Speaker 1: Kay says she never spoke with Charles again about the policy.
- 6:16Speaker 1: She didn't know she was a beneficiary until the life
- 6:18Speaker 1: insurance company called after Charles was killed. She received the
- 6:22Speaker 1: money months after Charles died. Wood asks if Lori ever
- 6:26Speaker 1: contacted Kay about the insurance. Kay says towards the end
- 6:29Speaker 1: of July 2019, Lori texted and said something like, is
- 6:34Speaker 1: this why you want JJ? I've got five kids and
- 6:37Speaker 1: no money and you get everything. Imagine if Having that
- 6:41Speaker 1: kind of outlook on life? You're out here talking about me, me, me,
- 6:45Speaker 1: Charles Vallow's laying there dead in the grave, and you're
- 6:48Speaker 1: talking about money, huh? I don't know about you folks,
- 6:50Speaker 1: but the last thing I'd be concerned about after my
- 6:52Speaker 1: husband died would be the life insurance, the money. I'd
- 6:56Speaker 1: be more worried about how I'm going to get on
- 6:58Speaker 1: with my life. 9.05 a.m. Kay recalls having a 7th
- 7:03Speaker 1: birthday party for JJ in May of 2019 at a
- 7:06Speaker 1: pizza place with friends and cousins. It was the last
- 7:09Speaker 1: birthday we'd ever have him. The last time Kay saw
- 7:12Speaker 1: JJ was on August 10th, 2019 on FaceTime. Kay says
- 7:17Speaker 1: after Charles was killed, they had a very hard time
- 7:20Speaker 1: getting in touch with Lori. Yeah, I don't doubt it.
- 7:23Speaker 1: Why would she want to talk to Charles' family at
- 7:25Speaker 1: that point? Especially considering there wasn't any money coming her way.
- 7:29Speaker 1: We all know that was the most important thing for
- 7:31Speaker 1: Lori Vallow. 9.06am. Kay says from the time Charles was
- 7:36Speaker 1: murdered to August 10th, one month, They were only able
- 7:39Speaker 1: to see J.J. on FaceTime twice. Any contact with us,
- 7:43Speaker 1: she was limiting it. After August 10th, Kay emailed, texted,
- 7:47Speaker 1: left voicemails for Lori. She would never respond. Not one
- 7:50Speaker 1: time did she respond. 9.07 a.m. Kay tried to make
- 7:54Speaker 1: arrangements with Lori for J.J. to attend his dad's memorial service.
- 7:59Speaker 1: Kay bought a plane ticket for J.J. and everything was set,
- 8:02Speaker 1: but after Lori found out about the insurance, Lori said
- 8:05Speaker 1: they were too busy and moving to Hawaii. and it
- 8:08Speaker 1: would be too much for JJ to attend. 9.08 a.m.
- 8:12Speaker 1: Kay says she didn't know Charles had died until July 12th.
- 8:15Speaker 1: Lori texted Charles' two oldest sons and said their father
- 8:19Speaker 1: was dead. One of the sons contacted Kay and said
- 8:22Speaker 1: Charles was dead. Kay thought it was a joke because
- 8:24Speaker 1: Charles was healthy. Larry then googled Charles Vallow's name and
- 8:28Speaker 1: read that he had been killed the day before. 9.10 a.m.
- 8:32Speaker 1: Kay says once she knew Charles was dead, she knew J.J.
- 8:35Speaker 1: was in trouble because Lori didn't want J.J., Tylee, or
- 8:38Speaker 1: Charles anymore. She was done. Kay reached out to Detective
- 8:42Speaker 1: Nate Moffitt at Chandler Police to share her concerns. After
- 8:46Speaker 1: the last FaceTime with J.J. on August 10th, Kay said
- 8:50Speaker 1: she spoke often with law enforcement to express her concerns
- 8:53Speaker 1: about J.J. 9-11 a.m. After Brandon Boudreaux's attempted murder, Kay
- 8:58Speaker 1: and Brandon began talking. They hired a private investigator. and
- 9:02Speaker 1: they split the cost. 9.13 a.m. Kay had access to
- 9:06Speaker 1: Charles' email account, passwords, and bank accounts. On November 8, 2019,
- 9:10Speaker 1: Kay was trying to hook up a printer to Kay's computer.
- 9:14Speaker 1: It was 4.30 a.m., with a compulsion to go finish
- 9:17Speaker 1: hooking up my computer to his printer. Kay noticed Charles'
- 9:21Speaker 1: Gmail account login page was open on her screen. Kay
- 9:24Speaker 1: logged in and found an email from Amazon. 9.15 a.m.
- 9:28Speaker 1: The Amazon email said, on the account belonging to Charles,
- 9:33Speaker 1: was about a delivery. The address was an apartment at
- 9:37Speaker 1: Pioneer Road in Rexburg, apartment number 175. Kay opened the
- 9:42Speaker 1: Amazon account browsing history. It was jaw-dropping. I saw a
- 9:45Speaker 1: search for Malachite wedding rings. There was one purchased for
- 9:49Speaker 1: $ 35 or $ 36. 99. I saw searches for women's beach wedding dresses.
- 9:54Speaker 1: I saw what looked at or purchased a yellow one-piece
- 9:57Speaker 1: bathing suit and another search for men's linen beach clothes
- 10:02Speaker 1: size large. 918 a.m. The search had been done on
- 10:06Speaker 1: October 2nd, 2019. Kay knew Tammy died on October 19th.
- 10:11Speaker 1: It was mind-blowing that they were looking at wedding rings
- 10:14Speaker 1: before Tammy's death. Prior objects Boyce sustains. 919 a.m. Kay
- 10:19Speaker 1: and Larry went to Rexburg in early January 2020. They
- 10:23Speaker 1: offered a reward for help in finding JJ and Tylee.
- 10:27Speaker 1: They met with Rexburg police. Kay became aware of the
- 10:30Speaker 1: kids being found on June 9, 2020. Wood has nothing further.
- 10:35Speaker 1: Pryor will now cross-examine. 9.24 a.m. Pryor asks Kay about
- 10:41Speaker 1: Lori and Charles moving to a different place at different times. Hawaii, Houston, Arizona. 9.26 a.m.
- 10:48Speaker 1: Pryor asked Kay if she knew Lori spent 60 days
- 10:51Speaker 1: in Hawaii. Kay says she learned that Lori made several
- 10:55Speaker 1: trips to Hawaii during the 70 days that she was
- 10:58Speaker 1: not talking to JJ. JJ ended up with Charles from
- 11:01Speaker 1: the 1st of February into the 1st part of April, 9.27 a.m.
- 11:07Speaker 1: Kay says Lori was back and forth to Hawaii. Kay
- 11:09Speaker 1: later learned Tylee made a few trips to Hawaii with her,
- 11:13Speaker 1: but Kay didn't know where Tylee was or who she
- 11:15Speaker 1: was staying with, 9.29 a.m. Pryor asked Kay if she
- 11:19Speaker 1: is aware that on April 16th, Charles Vallow changed his
- 11:23Speaker 1: beneficiary back to Lori Vallow on his life insurance. Kay
- 11:27Speaker 1: was aware he had changed it and assumed it was
- 11:29Speaker 1: to Lori. Pryor asked Kay when the beneficiary was changed
- 11:32Speaker 1: back to her. Kay says she isn't sure. There were
- 11:35Speaker 1: issues with the insurance company. 9.31 a.m. Pryor asks about
- 11:40Speaker 1: Amazon search. He asked when Lori started looking at the items.
- 11:44Speaker 1: On November 8th, I saw she was searching for items
- 11:47Speaker 1: on October 2nd. Prior asks Kay if Chad had access
- 11:51Speaker 1: to Lori's Amazon account. Kay says she has no idea. 9.33 a.m.
- 11:56Speaker 1: Kay says Lori was buying wedding stuff on Charles' credit card.
- 12:00Speaker 1: Prior has nothing further. Wood will now redirect. 9.34 a.m.
- 12:05Speaker 1: Wood follows up and asks Kay to clarify the dates
- 12:07Speaker 1: for the Amazon searches. Wood has nothing further. 9.35 a.m.
- 12:13Speaker 1: Next witness is Angela Yancey. Fremont County Deputy Prosecuting Attorney
- 12:18Speaker 1: Rocky Wixom will question Yancey. 9.36 a.m. Yancey lives in
- 12:23Speaker 1: Idaho Falls and previously worked in payroll and benefits for
- 12:27Speaker 1: Sugar Salem School District. She didn't have a lot of
- 12:30Speaker 1: interaction with Tammy as Yancey worked in the district office.
- 12:33Speaker 1: Once a year, Yancey did a benefits meeting for employees.
- 12:36Speaker 1: Benefits included medical, dental, vision, and life insurance. 9.39 a.m.
- 12:43Speaker 1: Yancey says when Tammy was first hired, she elected for
- 12:46Speaker 1: the minimum amount of life insurance, about $ 10, 000. A $ 50, 000
- 12:51Speaker 1: policy was also offered by the district for all employees.
- 12:54Speaker 1: So the first year of Tammy's employment, she had $ 60, 000
- 12:58Speaker 1: of life insurance. The second year of Tammy's employment, she
- 13:01Speaker 1: did not increase that amount. 9.44 a.m. Wixom asks Yancey
- 13:06Speaker 1: to explain the process an employee follows to increase their
- 13:09Speaker 1: life insurance. She says employees fill out a form. and
- 13:12Speaker 1: can increase up to five times their salary. Once the
- 13:15Speaker 1: employee fills out the form, it's submitted to Yancey and
- 13:19Speaker 1: sent to the insurance company. 9.45 a.m. Wixom displays Tammy
- 13:24Speaker 1: Daybell's change-of-life insurance form on the screen. Tammy asked to
- 13:28Speaker 1: have her insurance increased an additional $ 80, 000, the maximum amount
- 13:32Speaker 1: she could ask for. The next exhibit shows the signatures
- 13:35Speaker 1: of Tammy and Chad Daybell on the form. Tammy elected
- 13:39Speaker 1: spouse coverage for Chad. 9.47 a.m. Tammy elected $ 20, 000 of
- 13:45Speaker 1: life insurance for Chad. She had $ 10, 000 on Chad before
- 13:48Speaker 1: she increased it to $ 20, 000. 9.50 a.m. Wixom asks if
- 13:53Speaker 1: there is an open enrollment period. Yancey says it starts
- 13:56Speaker 1: in August and goes into September. The due date is
- 13:59Speaker 1: September 15th but becomes effective September 1st. Tammy filled out
- 14:03Speaker 1: the form on September 8th. 9.51 a.m. On Monday morning,
- 14:08Speaker 1: October 21st, Chad went into the district office to inquire
- 14:12Speaker 1: about filling the life insurance claim. Yancey told him that
- 14:15Speaker 1: they had received a death certificate. Chad said, that's okay.
- 14:19Speaker 1: I've ordered eight of them. Yancey says eight is not
- 14:21Speaker 1: a normal number of death certificates to request. 9.52 a.m.
- 14:27Speaker 1: Yancey gave Chad a claim form and explained the process.
- 14:30Speaker 1: Yancey says it was unusual that Chad came in so quickly.
- 14:34Speaker 1: Tammy had passed away on Saturday and was in the
- 14:37Speaker 1: office Monday morning. He had already ordered the death certificates. 9.54 a.m.
- 14:42Speaker 1: Wixom shows the beneficiary statement on the screen. Chad filled
- 14:45Speaker 1: it out. The first question on the form is, when
- 14:48Speaker 1: did health of deceased first person become impaired? Chad wrote
- 14:52Speaker 1: October 18th, 2019. 9.55 a.m. The next exhibit is the
- 14:58Speaker 1: employer statement portion of the claim. This is where the
- 15:01Speaker 1: employer fills out information concerning the employee. Yancey completed this form. 9.57 a.m.
- 15:08Speaker 1: The next exhibit is a life insurance payout of $ 130, 000
- 15:11Speaker 1: to Chad Daybell from LifeMap. The check was dated November 8, 2019. 9.58 a.m.
- 15:20Speaker 1: Chad was the primary beneficiary of the policy at 100%.
- 15:24Speaker 1: No other beneficiaries were included on the plan. 9.59 a.m.
- 15:29Speaker 1: Yancey says most of the time she would need a
- 15:31Speaker 1: search out employee families after deaths to remind them they
- 15:34Speaker 1: had life insurance. It was rare that Chad came in
- 15:37Speaker 1: so quickly. and wanted the insurance money. Well, that was
- 15:40Speaker 1: all part of the plan, right? Kill them, get the money,
- 15:43Speaker 1: so we can run away to Hawaii. Bunch of boneheads. 10.01 a.m.
- 15:49Speaker 1: Chad returned to file the claim on October 25th. Yancey
- 15:52Speaker 1: was out of town until October 30th, and Chad returned
- 15:55Speaker 1: first thing on that date to get the claim filed.
- 15:58Speaker 1: Wixom has no other questions. 10.02 a.m. Pryor asks if
- 16:03Speaker 1: the number of death certificates would pertain to how many
- 16:06Speaker 1: entities needed copies for other policies. If he were to
- 16:09Speaker 1: have another life insurance policy or two, he would need
- 16:12Speaker 1: death certificates for that, correct? Yancy says yes. 10.04 a.m.
- 16:17Speaker 1: Pryor asks if there are a number of factors people
- 16:19Speaker 1: look at when getting life insurance. Yancy agrees. 10.05 a.m.
- 16:24Speaker 1: Pryor asks if Yancy was aware of Chad's employment and
- 16:27Speaker 1: the fact he didn't have life insurance. She was not.
- 16:30Speaker 1: Pryor asks Yancey what Tammy's salary was. Pryor suggests she
- 16:34Speaker 1: made around $ 16, 000 a year, working 35 hours a week.
- 16:38Speaker 1: Pryor displays the form on the screen and asks Yancey
- 16:40Speaker 1: some follow-up questions about Chad's life insurance as part of
- 16:44Speaker 1: the plan. 10.10 a.m. Pryor asks if the insurance is
- 16:48Speaker 1: very reasonable. Yancey says yes. Yancey oversaw 200 employees. Pryor
- 16:53Speaker 1: asks Yancey why she specifically remembers her encounters with Chad.
- 16:57Speaker 1: I believe any incident that is traumatic... Sticks in your memory,
- 17:00Speaker 1: Yancey responded. 10.13 a.m. Pryor asks if the insurance company
- 17:05Speaker 1: gets more money if people increase their life insurance. Yancey
- 17:08Speaker 1: says they got a commission on the number of people enrolled,
- 17:11Speaker 1: but not if premiums go up. 10.15 a.m. Pryor has
- 17:15Speaker 1: no further questions. Wixom has some redirect. 10.16 a.m. Wixom
- 17:20Speaker 1: asks why the situation was traumatic. Yancey says the death
- 17:23Speaker 1: of an employee is traumatic, and the subsequent information was
- 17:26Speaker 1: traumatic as well. The involvement of Lori... and the missing children. 10.17am.
- 17:33Speaker 1: Wixom has nothing further. Yancey is released from the stand.
- 17:36Speaker 1: It's now time for our morning break. We will be
- 17:39Speaker 1: back in around 20 minutes. Alright, so like usual, we're
- 17:42Speaker 1: going to break here as well, and in the next episode,
- 17:45Speaker 1: we'll pick up where we left off. All of the
- 17:47Speaker 1: information that goes with this episode can be found in
- 17:51Speaker 1: the description box. What's up everyone, and welcome back to
- 17:55Speaker 1: the program. In this episode, we're picking up where we
- 17:57Speaker 1: left off with the Chad Daybell trial, and the article
- 18:00Speaker 1: we're using was published by EastIdahoNews.com, and the author is
- 18:05Speaker 1: Nate Eaton. 10.44 a.m. We are back in the courtroom.
- 18:10Speaker 1: Voices on the bench and the jurors are being brought in. 10.46 a.m.
- 18:14Speaker 1: Sheila Daybell, Chad Daybell's mother, is called to the stand.
- 18:18Speaker 1: Special Prosecutor Ingrid Beatty will question Sheila. Chad nods to
- 18:22Speaker 1: his mom as she takes the stand. Imagine being the
- 18:25Speaker 1: mother of this serpent. The shame, the embarrassment, all your
- 18:29Speaker 1: friends looking at you sideways. Doesn't sound like a very
- 18:32Speaker 1: fun time. 10.48 a.m. Sheila is married to Jack Daybell.
- 18:37Speaker 1: They had five children, Chad, Paul, Matt, Brad, and Becky. 10.49 a.m.
- 18:43Speaker 1: Sheila says the last time she saw Tammy Daybell was
- 18:45Speaker 1: on October 13th, 2019, at Tammy's home in Idaho. Sheila
- 18:50Speaker 1: and Jack traveled for a baby blessing. Sheila says Tammy
- 18:54Speaker 1: seemed fine when she visited. 10.50 a.m. Chad called Sheila
- 18:58Speaker 1: on October 19th to say Tammy had died. Sheila and
- 19:02Speaker 1: Jack immediately drove to Idaho. She says Chad was upset
- 19:05Speaker 1: and Chad's children were upset. Sheila attended Tammy's memorial service. 10.51 a.m.
- 19:12Speaker 1: Betty asked Sheila about the middle of November 2019. Sheila
- 19:16Speaker 1: and Jack met Chad for dinner at Texas Roadhouse in
- 19:19Speaker 1: Idaho Falls. Lori Vallow was also there. Sheila had never
- 19:24Speaker 1: met Lori. Sheila noticed Chad and Lori had rings on.
- 19:27Speaker 1: Jack asked if they were engaged and they said no,
- 19:30Speaker 1: we're married. This was a month after Tammy's death. Didn't
- 19:33Speaker 1: tell his parents. Didn't bother to mention it to his
- 19:36Speaker 1: mom or dad, right? Ah, you know, I'm gonna get married,
- 19:38Speaker 1: but I won't tell my family. I won't tell my
- 19:41Speaker 1: mom and dad. Well, the reason is because he knew
- 19:43Speaker 1: they would think it's weird. Who goes and gets married
- 19:47Speaker 1: a month after their wife dies? 1052 AM. Lori told
- 19:51Speaker 1: Sheila her husband had recently died of a heart attack.
- 19:53Speaker 1: Lori said that her daughter who had died but didn't
- 19:57Speaker 1: say how old the child was. Lori didn't say anything
- 20:00Speaker 1: about having a young son. Chad didn't say anything when
- 20:03Speaker 1: Lori mentioned these things. 10.54 a.m. Sheila didn't know where
- 20:08Speaker 1: Chad and Lori were living. She assumed they were living
- 20:10Speaker 1: in Idaho, but a few weeks later, she learned that
- 20:13Speaker 1: they had moved to Hawaii. Sheila would sometimes talk to
- 20:16Speaker 1: them on the phone, and they never mentioned Lori having
- 20:18Speaker 1: young children in Hawaii. Pryor will now cross-examine. Well, that's because, unfortunately,
- 20:24Speaker 1: we know that those kids weren't in Hawaii. Instead, they
- 20:28Speaker 1: were buried at Chad Daybell's house, 10.55 a.m. Pryor asked
- 20:33Speaker 1: Sheila to say the names of her children and in-laws.
- 20:35Speaker 1: He notes that Matt Daybell is in the courtroom wearing
- 20:38Speaker 1: a green shirt. 10.56 a.m. Pryor asked Sheila about Emily,
- 20:43Speaker 1: her daughter-in-law, providing her with information about Lori having a daughter.
- 20:48Speaker 1: Sheila met with Lieutenant Ron Ball in December of 2019. 10.58 a.m.
- 20:54Speaker 1: Sheila says Lori was very friendly and upbeat. Pryor asks
- 20:58Speaker 1: if she would use the term charming, convincing, persuasive. Sheila
- 21:03Speaker 1: says yes. Pryor asks Sheila if her son Chad is shy.
- 21:06Speaker 1: He can be. You see what he's doing here, right?
- 21:09Speaker 1: trying to set it up once again that this is
- 21:11Speaker 1: all Lori Vallow. Chad Daybell, nothing to do with it,
- 21:14Speaker 1: just a shy boy. Easily manipulated, easily coerced, and easily
- 21:19Speaker 1: used as a tool by Lori Vallow. That's what Pryor
- 21:23Speaker 1: is getting at here, and that is the defense that
- 21:26Speaker 1: continues to evolve here for Chad Daybell. And while I
- 21:29Speaker 1: don't think it's going to be successful, I don't see
- 21:32Speaker 1: any other way that they could go. 10.59 a.m. Would
- 21:36Speaker 1: it be fair to say your son Chad is an introvert?
- 21:39Speaker 1: Sheila says yes. Pryor, he's not a gregarious personality, is he?
- 21:43Speaker 1: Sheila says no. Pryor says your son Chad is not
- 21:46Speaker 1: necessarily the man of the world. He didn't have a
- 21:49Speaker 1: lot of experience dealing with relationships. Sheila says that's correct. 11.01 a.m.
- 21:54Speaker 1: Pryor asks if it was a shock when her son
- 21:57Speaker 1: went from someone like Tammy to someone like Lori. Pryor
- 22:00Speaker 1: asks if in the LDS faith, it's not uncommon to
- 22:03Speaker 1: get married quickly. Sheila thinks for a moment and says
- 22:06Speaker 1: not uncommon. Pryor says when young men return from missions,
- 22:10Speaker 1: they get married quickly. I mean, for real? Are you
- 22:12Speaker 1: really going to try and equate somebody who gets back
- 22:15Speaker 1: from his mission marrying quickly to somebody who just lost
- 22:18Speaker 1: their wife doing the same? Talk about comparing apples to
- 22:21Speaker 1: elephant balls. 11.02 a.m. Pryor says Chad and Lori got
- 22:26Speaker 1: married quickly. He asked about Chad being visibly upset on
- 22:30Speaker 1: the day that Tammy died. Sheila says several people came
- 22:33Speaker 1: over while she and Jack were at Chad's house for
- 22:35Speaker 1: around four to five hours. Pryor asks if Chad was
- 22:38Speaker 1: being businesslike. Sheila says he was acting like someone whose
- 22:42Speaker 1: partner had just passed away. 11.04 a.m. Pryor has nothing further.
- 22:47Speaker 1: Beatty will redirect. She asks Sheila if it's common in
- 22:50Speaker 1: the LDS faith to get married after your spouse dies.
- 22:54Speaker 1: Not common, she responds. There are no further questions and
- 22:57Speaker 1: Sheila is dismissed from her subpoena. 11.05 a.m. The next
- 23:01Speaker 1: witness is Heather Daybell. 11.06 a.m. Wixom will question Heather
- 23:05Speaker 1: who is married to Matt. Pryor asks for a quick
- 23:08Speaker 1: sidebar with the judge and prosecution. 11.11 a.m. The court
- 23:13Speaker 1: exclusionary rule is not applicable to Heather, likely because she
- 23:16Speaker 1: is the sister-in-law of a victim, Tammy Daybell. 11.12 a.m.
- 23:21Speaker 1: Heather recently had surgery and may need to take some
- 23:23Speaker 1: breaks during her testimony. Heather and Matt have been married
- 23:26Speaker 1: for 30 years and started dating 35 years ago. Heather
- 23:30Speaker 1: has known Chad for more than 30 years. 11.14 a.m.
- 23:35Speaker 1: Heather says there was a normal amount of contact over
- 23:38Speaker 1: the years with Chad and Tammy. Wixom asks Heather to
- 23:40Speaker 1: describe the nature of her relationship with Chad. In the beginning,
- 23:44Speaker 1: it was normal, as any in-law relationship would be. We
- 23:48Speaker 1: moved away, but when we'd get together, we would talk,
- 23:51Speaker 1: mainly about his books, Heather says. She says things were
- 23:54Speaker 1: cordial and nothing out of the ordinary. 11.15 a.m. In 2014,
- 23:59Speaker 1: the relationship changed when Chad started talking about The End
- 24:03Speaker 1: of Times and was publishing The Julie Rowe's Books Heather
- 24:06Speaker 1: was not comfortable with Chad and what he was saying.
- 24:10Speaker 1: Chad indicated an earthquake would be happening in 2015 and
- 24:14Speaker 1: he was preparing them for these end-of-time events and what
- 24:17Speaker 1: caused a lot of destruction in the Salt Lake area. 11.16am
- 24:22Speaker 1: Chad said he was seeing these things in visions and
- 24:24Speaker 1: Julie Rowe was also teaching these prophecies according to Heather.
- 24:28Speaker 1: In 2014, Chad told his family he was planning to
- 24:31Speaker 1: move to Rexburg with his wife and kids. Heather had
- 24:34Speaker 1: a detailed conversation about the move when Chad came to
- 24:37Speaker 1: look for homes in Rexburg. 11.17 a.m. Heather and Matt
- 24:43Speaker 1: asked Chad point-blank why he felt that he needed to move.
- 24:47Speaker 1: Chad told Heather and Matt they would become great leaders
- 24:50Speaker 1: in his gathering of people because of destruction in Utah,
- 24:54Speaker 1: that their land would help with that, and Heather's home
- 24:56Speaker 1: would become like a church or a temple. Chad felt
- 24:59Speaker 1: like he needed to be in Rexburg with his family
- 25:02Speaker 1: because the LDS church headquarters would have to move to
- 25:05Speaker 1: Rexburg because of the destruction. Yeah, in a vision he
- 25:08Speaker 1: saw all of this. Talk about LARPing, talk about role-playing,
- 25:12Speaker 1: and the fact that anyone believed this shit is just
- 25:15Speaker 1: bananas to me. 1119 AM. Heather did not believe the
- 25:19Speaker 1: teachings and was concerned. Chad said he was going to
- 25:22Speaker 1: be telling people about the destruction and visions. Heather said
- 25:25Speaker 1: in the belief system she had at the time, the
- 25:27Speaker 1: LDS church, some average person doesn't get information like Chad
- 25:31Speaker 1: was getting. It wouldn't come through to someone like Chad.
- 25:35Speaker 1: About time somebody takes the stand and calls it like
- 25:38Speaker 1: it is, right? Heather absolutely dropping truth bombs on these fools. 11.20am.
- 25:44Speaker 1: Chad was spreading his visions to other church members and
- 25:46Speaker 1: Heather was concerned. Heather told Chad she wasn't feeling good
- 25:50Speaker 1: about what he was saying and I was very blunt.
- 25:53Speaker 1: Chad doesn't show a lot of reaction. Heather says he
- 25:56Speaker 1: didn't argue or anything. Matt and Heather decided years ago
- 25:59Speaker 1: that they wanted to live apart from family. and made
- 26:01Speaker 1: a home for themselves in Rexburg. They told Chad if
- 26:04Speaker 1: they moved to Rexburg, that's fine, but please don't move
- 26:07Speaker 1: into their neighborhood or their ward. I knew why he
- 26:10Speaker 1: was coming, and I didn't want him trying to draw
- 26:12Speaker 1: in people from my ward and having people think we
- 26:15Speaker 1: were involved or believed in him. Yo, this is damning
- 26:18Speaker 1: testimony from his sister-in-law. Not some rando, not somebody that
- 26:23Speaker 1: met him out at the bar. His sister-in-law, calling him
- 26:26Speaker 1: a batshit crazy lunatic. 11.22 a.m. Chad and Tammy went
- 26:32Speaker 1: to look at homes and told Heather and Matt they
- 26:34Speaker 1: didn't find a home that they liked. They asked if
- 26:36Speaker 1: they could store some stuff in a shed. Heather and
- 26:38Speaker 1: Matt agreed to let them have their stuff and were
- 26:40Speaker 1: under the impression they wouldn't be moving soon. 11.23am Heather
- 26:46Speaker 1: was concerned that Chad was trying to convince his family
- 26:48Speaker 1: and others that the earthquake and other events were going
- 26:51Speaker 1: to happen in 2015. A week or two after Chad
- 26:55Speaker 1: and Tammy left, they called Heather and Matt to say
- 26:58Speaker 1: they put an offer on a home near them and
- 27:01Speaker 1: would be moving to Rexburg. Heather says that she cried.
- 27:04Speaker 1: She was very upset. She asked her husband to talk
- 27:07Speaker 1: him out of it, but the home was already in
- 27:09Speaker 1: the process of being purchased. Boy, you thought you hated
- 27:12Speaker 1: your in-laws. Imagine Chad Daybell's dumbass shows up, and he's
- 27:16Speaker 1: talking all this nonsense. 11.25 a.m. Heather tried to help
- 27:20Speaker 1: Tammy when they moved to Rexburg, but the relationship with
- 27:23Speaker 1: her and Chad became strange. Heather says Chad told her
- 27:27Speaker 1: he would come home with visions and Tammy would look
- 27:29Speaker 1: at him, roll her eyes, and then go pray about it. 11.27
- 27:34Speaker 1: AM Wixom asks Heather if she feels Chad's children believed
- 27:37Speaker 1: his father's visions. She says she believes all the children did.
- 27:41Speaker 1: Heather says her oldest son came to her and Matt
- 27:45Speaker 1: in 2014. Their son said Chad had approached them and
- 27:48Speaker 1: said he was going to be a great leader in
- 27:49Speaker 1: the gathering. Heather went to Chad and told him not
- 27:52Speaker 1: to discuss these issues with her children. Heather is the
- 27:55Speaker 1: superstar here, right? The hero. There aren't many heroes in
- 27:59Speaker 1: this tale, but Heather is one of them. Told this
- 28:01Speaker 1: dude right away, look, you better leave my kids alone
- 28:04Speaker 1: with your stupid ass nonsense. 11.29 a.m. Heather was becoming
- 28:08Speaker 1: concerned with how Tammy was doing. Heather and Matt invited
- 28:12Speaker 1: Chad and Tammy over to their home. Chad told Heather
- 28:15Speaker 1: that if she has any questions, they all need to
- 28:17Speaker 1: be directed to Chad, not Tammy. I did not follow
- 28:21Speaker 1: that instruction, and Tammy was a grown woman, so I
- 28:23Speaker 1: directed my questions to her. 11.31 a.m. Heather's intent of
- 28:29Speaker 1: the conversation was to ask Tammy... if she was doing
- 28:32Speaker 1: okay with the move. Tammy said she had prayed about
- 28:34Speaker 1: it and felt like it was a good thing for
- 28:36Speaker 1: their family. Tammy told Heather she didn't have any confirmation
- 28:40Speaker 1: that Chad's visions were going to happen. 11.32 a.m. Chad's
- 28:45Speaker 1: home was about a half mile from Heather's and Matt's.
- 28:48Speaker 1: When Chad and Tammy moved in, Heather took some bread over,
- 28:51Speaker 1: gave suggestions on doctors, visited the house, etc. 11.34 a.m.
- 28:56Speaker 1: Wixom moves to admit some photos showing Chad's home. 11.36 a.m.
- 29:01Speaker 1: Pryor objects to some of the photos and asks if
- 29:03Speaker 1: Heather if she has seen particular items in the photos
- 29:06Speaker 1: or the pictures themselves. 11.38 a.m. Boyce sustains the objection
- 29:11Speaker 1: for some of the photos but will allow part of
- 29:14Speaker 1: the exhibit in. 11.39 a.m. Wixom displays a photo on
- 29:19Speaker 1: the screen showing the back portion of the home and
- 29:21Speaker 1: an area of the day bells called the Cozy Cone.
- 29:24Speaker 1: Wixom asks Heather to describe it. She says you enter
- 29:27Speaker 1: the house and go up some stairs to get into
- 29:29Speaker 1: the Cozy Cone and Mark kept his instruments up there.
- 29:32Speaker 1: Heather understood when Garth moved to Rexburg, his room was
- 29:35Speaker 1: in the cozy cone. 11 41 a.m heather says chad
- 29:39Speaker 1: and tammy's bedroom was down in the main part of
- 29:41Speaker 1: the home to get to the cozy cone from the
- 29:44Speaker 1: daybell's bedroom you'd have to go up or down some
- 29:47Speaker 1: stairs heather says 11 42 a.m heather and matt were
- 29:52Speaker 1: in the same lds ward as chad and tammy they
- 29:55Speaker 1: saw each other at church Heather says she tried not
- 29:58Speaker 1: to have interactions with Chad at church, but would try
- 30:00Speaker 1: to chat with Tammy and the kids. 11.43 a.m. Matt
- 30:03Speaker 1: and Heather were at a work conference in Las Vegas
- 30:06Speaker 1: on the morning of October 19th when Matt got a
- 30:09Speaker 1: call from his parents saying Tammy had died. They didn't
- 30:12Speaker 1: know much about it, but they said they would call
- 30:14Speaker 1: back when they learned more. I was very upset, Heather said. 11.44 a.m.
- 30:20Speaker 1: Matt left for his conference and Heather called Chad. She
- 30:23Speaker 1: expressed her condolences in shock and asked what had happened
- 30:25Speaker 1: to Tammy. Chad said Tammy had not been feeling well,
- 30:29Speaker 1: started coughing around 10 p.m., and went to sleep. Around midnight,
- 30:33Speaker 1: she started coughing and vomited. Tammy went back to bed.
- 30:36Speaker 1: Chad slept from midnight to 6 a.m. because the sheet
- 30:40Speaker 1: that was on him came off and he heard a thud.
- 30:43Speaker 1: He found Tammy had fallen off the bed. Chad said
- 30:46Speaker 1: Tammy had been gone for a little while because she
- 30:48Speaker 1: was hard. 11.46 a.m. Heather said Chad felt scripted and
- 30:53Speaker 1: it made her feel very uneasy. She asked if they
- 30:56Speaker 1: were going to do an autopsy and Chad said no.
- 30:59Speaker 1: A coroner had come and looked at Tammy and found
- 31:01Speaker 1: matter in her throat that caused her to die. 11.47 a.m.
- 31:06Speaker 1: Chad told Heather the funeral would be in two days.
- 31:09Speaker 1: Heather told Chad they weren't even home and another brother
- 31:12Speaker 1: was out of town. Heather asked if they could wait
- 31:15Speaker 1: until everyone got home so they could attend. Chad said no.
- 31:18Speaker 1: They just wanted to get it done. Heather and Matt
- 31:21Speaker 1: left Las Vegas to get to Springville. 11.48 a.m. Heather
- 31:25Speaker 1: said the opening song of the funeral was Put Your
- 31:27Speaker 1: Shoulders to the Wheel. Chad and all his kids spoke
- 31:30Speaker 1: and the bishop concluded the service. Heather was the Stake
- 31:33Speaker 1: Relief Society president at the time and planned, helped with
- 31:37Speaker 1: a lot of the funerals. 11.49 a.m. Put Your Shoulder
- 31:41Speaker 1: on the Wheel is a song about work and pushing along,
- 31:44Speaker 1: not a funeral song. Heather thought Chad was being disingenuous
- 31:48Speaker 1: at the funeral. Heather observed Chad and his kids at
- 31:51Speaker 1: the viewing. She thought it was strange Chad was smiling
- 31:53Speaker 1: and then suddenly crying. His demeanor seemed strange to me. Well,
- 31:57Speaker 1: if it wasn't for him leaving and going to marry
- 31:59Speaker 1: Lori Vallow a week later, I think people would be
- 32:02Speaker 1: more willing to give the guy a little bit of
- 32:04Speaker 1: the benefit of the doubt, right? But that's not the case.
- 32:07Speaker 1: All of this was planned. All of this was staged.
- 32:11Speaker 1: All of this was conspired to. 11.50 a.m. Heather says
- 32:15Speaker 1: Chad was late to his own wife's funeral luncheon. I
- 32:18Speaker 1: assumed he would be there with everyone else. Heather remembers Jason,
- 32:21Speaker 1: Chad's brother-in-law, announcing they would just get started without Chad.
- 32:25Speaker 1: Heather says everything seemed like a normal day to Chad.
- 32:28Speaker 1: He didn't seem upset. 11.52 a.m. Around three to four
- 32:31Speaker 1: weeks later, Heather had learned he was remarried and his
- 32:34Speaker 1: children were struggling and upset. Heather reached out in a
- 32:37Speaker 1: group text to his kids to let them know that
- 32:40Speaker 1: she was there to help them. Chad called Heather and
- 32:42Speaker 1: was upset. He said that Heather had been a problem
- 32:45Speaker 1: for him his whole life. Heather asked who he had married.
- 32:49Speaker 1: Chad said it was Lori. And would Heather like to
- 32:51Speaker 1: meet her? Heather said no and asked what happened to Tammy.
- 32:54Speaker 1: Chad said she died of a pulmonary embolism because Tammy
- 32:58Speaker 1: had gained 40 pounds. Heather had not noticed a big
- 33:01Speaker 1: weight gain on Tammy. So Tammy gained all this weight,
- 33:04Speaker 1: but she was still able to do all of that
- 33:06Speaker 1: high action aerobics and the rest of it. Sorry, Chad.
- 33:09Speaker 1: Nobody buys it, buddy. 1154 a.m. Chad told Heather he
- 33:14Speaker 1: was going to be living in Hawaii so she wouldn't
- 33:16Speaker 1: have to worry about him anymore. Heather doesn't remember challenging
- 33:20Speaker 1: Chad because she was so shocked by what he had said.
- 33:23Speaker 1: Heather asked how he could get married so quickly after
- 33:25Speaker 1: Tammy died. Chad said he had met Lori about a
- 33:28Speaker 1: year before and her husband had died of a heart attack. 11.55 a.m.
- 33:33Speaker 1: Heather didn't understand what she had done to Chad her
- 33:35Speaker 1: whole life that created a problem. Chad didn't explain. Heather
- 33:39Speaker 1: didn't want to meet Lori because she was upset he
- 33:41Speaker 1: had remarried weeks after Tammy had passed. It seemed almost
- 33:45Speaker 1: cruel to his children. 11.56 a.m. Chad called Heather a
- 33:50Speaker 1: pot stirrer. Wixom suggests we take a lunch break now
- 33:53Speaker 1: and questioning of Heather will continue after lunch. All right,
- 33:56Speaker 1: so we're going to break here as well. In the
- 33:58Speaker 1: next episode, we'll pick up where we left off. All
- 34:01Speaker 1: of the information that goes with this episode can be
- 34:04Speaker 1: found in the description box. What's up, everyone, and welcome
- 34:08Speaker 1: back to the program. In this episode, we're picking up
- 34:10Speaker 1: where we left off with the Chad Daybell trial. And
- 34:14Speaker 1: to do that, we're using eastidahonews.com, and the author of
- 34:18Speaker 1: this article is Nate Eaton. 1 p.m. We are back
- 34:22Speaker 1: in court, and Heather Daybell remains on the stand. Prosecutors
- 34:25Speaker 1: are at their table, and Chad Daybell is at the
- 34:28Speaker 1: defense table with John Pryor. 1.04 p.m. Heather says she
- 34:33Speaker 1: has not spoken to Chad's children since JJ and Tylee
- 34:36Speaker 1: were found buried on the property. Wixom asks Heather about
- 34:39Speaker 1: the trip Tammy made to Utah a few weeks before
- 34:42Speaker 1: she died. Heather says Tammy didn't like to travel alone,
- 34:46Speaker 1: so it was abnormal. 106 p.m. Heather doesn't recall hearing
- 34:50Speaker 1: anything from Chad about visions he had about Tammy. Wixom
- 34:54Speaker 1: asked to admit some exhibits prior, asked for a sidebar.
- 34:56Speaker 1: 110 p.m. Wixom shows a photo on the screen. We
- 35:01Speaker 1: see a staircase going up to the cozy cone area
- 35:03Speaker 1: of the house. The next photo is a piano and
- 35:06Speaker 1: a little drum set. Heather believes they were in the
- 35:08Speaker 1: cozy cone loft where the music instruments were kept. 1.11 p.m.
- 35:13Speaker 1: We see another photo displaying more musical instruments in the room.
- 35:16Speaker 1: Wixom asks Heather if he knows who David Hope is.
- 35:20Speaker 1: He is her daughter's father-in-law. Hope is also a retired
- 35:23Speaker 1: police detective with the Rexburg Police. 1.13 p.m. Heather rarely
- 35:29Speaker 1: had contact with Hope. They attended a baby blessing together
- 35:32Speaker 1: a few years ago and went on a family camping
- 35:34Speaker 1: trip with a bunch of other families. Heather has never
- 35:37Speaker 1: spoken to Hope about the case. 1.14 p.m. Heather sent
- 35:42Speaker 1: a letter to the 10 Relief Society presidents in her
- 35:45Speaker 1: LDS stake. She was in charge of keeping track of
- 35:48Speaker 1: the presidents, giving them support, etc. Heather believes the letter
- 35:52Speaker 1: was sent during the time period JJ and Tylee were
- 35:54Speaker 1: missing and Chad was in Hawaii, beginning of 2020. Imagine
- 36:00Speaker 1: being part of the congregation. And knowing that this do
- 36:03Speaker 1: not is out there in Hawaii, dancing his life away,
- 36:06Speaker 1: having fun on the beach. Meanwhile, these kids are missing
- 36:09Speaker 1: and there's this gigantic search that everybody else in the
- 36:12Speaker 1: whole world is involved in. Yeah, you're not suspicious or
- 36:15Speaker 1: anything stupid. 1.15 p.m. Because Chad was a relative, Heather
- 36:19Speaker 1: wrote the letter about the importance of sticking to the
- 36:22Speaker 1: basic principles of the gospel. She said Chad appeared to
- 36:25Speaker 1: be doing everything he appeared to be doing and Heather
- 36:28Speaker 1: was trying to make things hard for him. Heather said
- 36:31Speaker 1: some of the Relief Society presidents in the stake reached
- 36:34Speaker 1: out because there were women in their congregation that were
- 36:37Speaker 1: following Chad's teachings. This dude thought he was like some
- 36:40Speaker 1: kind of guru. You notice it was just a bunch
- 36:42Speaker 1: of women for the most part that were buying into
- 36:45Speaker 1: this guy's nonsense? And I'm sure he went after people
- 36:47Speaker 1: that he felt were spiritually vulnerable. 1.17pm Heather said she
- 36:53Speaker 1: tried to raise awareness that Chad was involved in inappropriate activities.
- 36:57Speaker 1: In the beginning, she shared this information with church leaders
- 37:00Speaker 1: once or twice with her stake president. As things progressed,
- 37:03Speaker 1: she became more concerned. There were people in the ward
- 37:06Speaker 1: I would talk to to try and stop what was happening.
- 37:09Speaker 1: And like I said before, there's not many heroes in
- 37:11Speaker 1: this story, but Heather certainly is one of them. She
- 37:13Speaker 1: wasn't buying this BS at all. And she wasn't scared
- 37:17Speaker 1: to let Chad know that he was out here pitching
- 37:20Speaker 1: a bunch of BS. 1.20pm. Wixom, as if sending the
- 37:23Speaker 1: letter out, has come at a cost to Heather and
- 37:26Speaker 1: the Daybell family. She says there was a cost because
- 37:29Speaker 1: in the beginning, people thought Heather was just trying to
- 37:31Speaker 1: cause problems with Chad. This caused damage with the relationship
- 37:35Speaker 1: with Heather and Chad's kids. Wixom has nothing further. 1.21 p.m.
- 37:41Speaker 1: Pryor now questioning Heather. He asked her about speaking to
- 37:44Speaker 1: Detective Mattingly. In February of 2020, Heather expressed concerns that
- 37:49Speaker 1: Chad was doing his writings inside the LDS church building.
- 37:53Speaker 1: Heather noticed his car often at the church. 1.23 p.m.
- 37:58Speaker 1: Pryor asks about Chad having these unusual teachings, but he
- 38:01Speaker 1: was able to maintain his LDS membership. Heather says that's correct.
- 38:05Speaker 1: Heather says Chad was the executive secretary in his ward. 1.25 p.m.
- 38:11Speaker 1: Heather says the bishop is the priesthood leader of the ward.
- 38:14Speaker 1: A ward is a specific geographic area, and each ward
- 38:17Speaker 1: has a bishop. Heather says in 2014, Julie Rose became
- 38:22Speaker 1: an issue. Chad was publishing Rose's book. 1.27 p.m. Roe
- 38:27Speaker 1: spoke primarily to LDS members. Pryor asked if Roe was
- 38:32Speaker 1: looked down upon because she was doing this. Heather said
- 38:35Speaker 1: Roe filled the tabernacle in Rexburg when she spoke. Chad
- 38:38Speaker 1: told Heather he reached out to Roe on a website
- 38:41Speaker 1: called AVOW. Heather was never on AVOW. It's a website
- 38:46Speaker 1: with like-minded people who have visions and dreams. It's like
- 38:50Speaker 1: a prepping website. So a bunch of people who have
- 38:53Speaker 1: decided to congregate and get together, and express their crazy
- 38:57Speaker 1: to one another. Because I'm telling you right now, they're
- 39:00Speaker 1: not having any visions. Unless they're all suffering from schizophrenia,
- 39:03Speaker 1: or something like that. There's no visions. Nobody's showing up
- 39:07Speaker 1: to say what's up to you. The angel Moroni's not
- 39:10Speaker 1: showing up to guide you. None of it's real. 1.29pm.
- 39:14Speaker 1: AVOW stands for Another Voice of Warning. Pryor asks Heather
- 39:18Speaker 1: if her husband and Chad had a close relationship. She
- 39:21Speaker 1: says before 2014, they had a good relationship. 1.30 p.m.
- 39:26Speaker 1: Heather was concerned that Chad had chosen to buy a
- 39:28Speaker 1: home so close to Heather's home and Chad had talked
- 39:31Speaker 1: about Heather's land being part of whatever was coming in
- 39:34Speaker 1: his visions. 1.32 p.m. Heather was the president of the
- 39:39Speaker 1: Relief Society in the Henry's Fork Stake. There were 10
- 39:42Speaker 1: wards and around 200 to 300 people in each ward.
- 39:46Speaker 1: Heather was over the 10 Ward Relief Society presidents. 1.33 p.m.
- 39:52Speaker 1: Heather had access to everyone's email addresses. Prior asked if
- 39:55Speaker 1: she had a recollection about what was in the letter.
- 39:58Speaker 1: Heather hasn't read it for several years. Prior asked if
- 40:01Speaker 1: he can provide a copy to Heather. 1.46 p.m. Heather
- 40:05Speaker 1: has her glasses and read the letter. The letter has
- 40:08Speaker 1: not been admitted into evidence, so Heather can use the
- 40:10Speaker 1: letter to refresh her memory, but can't read from it.
- 40:14Speaker 1: Prior asked what the first sentence is. Heather wrote that
- 40:17Speaker 1: she was forwarding an email at the request of President Dolling,
- 40:20Speaker 1: the stake president. 1.48 p.m. Heather says Dolling asked her
- 40:25Speaker 1: to forward on the top portion of the email, but
- 40:27Speaker 1: then Heather added her own thoughts. Dolling sent Heather a
- 40:31Speaker 1: talk that he asked her to forward to the Ward
- 40:33Speaker 1: Relief Society presidents. 1.50 p.m. Pryor asked Heather about another
- 40:38Speaker 1: paragraph in the letter. She wrote that she had first-hand
- 40:41Speaker 1: knowledge about Chad and his beliefs for some time. Pryor
- 40:45Speaker 1: asks if her first-hand knowledge came from Dave Hope. Heather
- 40:48Speaker 1: isn't referencing the investigation. She says she's referencing the beliefs
- 40:51Speaker 1: of Chad. 1.52 p.m. Pryor asks if Heather knows the
- 40:55Speaker 1: person who forwarded the email. Heather does. It was Ward
- 40:58Speaker 1: Relief Society president. Heather says she sent the email to
- 41:01Speaker 1: the 10 presidents and left it up to their discretion
- 41:05Speaker 1: if they shared it with their awards. 1.55 p.m. Boyce
- 41:09Speaker 1: tells Pryor he's cutting Heather off on almost every question.
- 41:12Speaker 1: and to wait for her to finish before asking another question. Oh,
- 41:16Speaker 1: I'm sure he's getting fired up, considering Heather is absolutely
- 41:20Speaker 1: destroying Chad Daybell right now. 1.56 p.m. Heather says she
- 41:26Speaker 1: injected her own personal opinion in the email because this
- 41:29Speaker 1: was her community. Heather says she wasn't happy with Chad
- 41:32Speaker 1: moving to Rexburg. Had they moved in and been somewhere
- 41:36Speaker 1: further away, or they just wanted to move to Rexburg
- 41:39Speaker 1: for a new start? No problem with that, Heather says. 1.58 p.m.
- 41:44Speaker 1: Heather was concerned that Chad was using the church building
- 41:46Speaker 1: to write his books. Chad's father referred to Heather as
- 41:50Speaker 1: a pot stirrer when Heather and Matt approached them about
- 41:52Speaker 1: Chad's teachings and books, Heather says. So basically everybody just
- 41:57Speaker 1: ignored what Heather had to say. This lady's out here
- 42:00Speaker 1: bringing every alarm bell, screaming from 19 mountaintops, and nobody
- 42:04Speaker 1: wants to listen to what she has to say. 2 p.m.
- 42:07Speaker 1: Pryor has no further questions. Wixom will now read direct.
- 42:11Speaker 1: He asked Heather if it's fair to say someone having
- 42:13Speaker 1: an adulterous relationship and Pryor objects. Boyce asked for a sidebar. 2.03 p.m.
- 42:19Speaker 1: Wixom asks if it's consistent for an executive secretary to
- 42:23Speaker 1: be engaging in an adulterous relationship. Heather says having an
- 42:27Speaker 1: affair is not conducive to having the calling. If the
- 42:30Speaker 1: church became aware of that, the person would be subject
- 42:33Speaker 1: to church discipline. 2.04 p.m. Heather is unsure if Chad
- 42:37Speaker 1: was still serving as the executive secretary when the kids
- 42:40Speaker 1: were found on the property. He was serving in that
- 42:43Speaker 1: capacity when he married Lori Vallow. Wixom asked if Julie
- 42:46Speaker 1: Rowe has been excommunicated from the LDS church. Pryor objects.
- 42:51Speaker 1: Boyce sustains the objection. Heather says when she observed Chad
- 42:54Speaker 1: and Julie together, she was concerned about their personal relationship.
- 42:58Speaker 1: They seem particularly close. He brought her to my home
- 43:02Speaker 1: on one occasion, and it made me real uncomfortable, Heather says.
- 43:05Speaker 1: Chad brought Julie to Heather's home to show him the property.
- 43:08Speaker 1: They walked along the land and the river. What I
- 43:11Speaker 1: observed was Chad and Julie were communicating very close to
- 43:14Speaker 1: each other and Tammy and the children were following behind.
- 43:18Speaker 1: It made me feel bad for Tammy that Chad appeared
- 43:20Speaker 1: so close to Julie. 2.06 p.m. At the time Heather
- 43:24Speaker 1: wrote the letter, she felt there was very misguided person
- 43:27Speaker 1: and that Chad had gotten himself involved in relationships with
- 43:30Speaker 1: other people that hurt others. 2.07 p.m. As far as
- 43:35Speaker 1: Chad using the church building, Heather knew Chad, knew his vehicle,
- 43:38Speaker 1: and knew what he was doing inside the building. Heather
- 43:41Speaker 1: said she and Matt both went to Matt's dad with
- 43:43Speaker 1: concerns about what Chad was participating in. Most of the
- 43:47Speaker 1: time the response was just don't worry about it. Jack
- 43:50Speaker 1: Daybell said, Heather said one time they were talking on
- 43:53Speaker 1: her driveway and Jack said don't be a pot stir.
- 43:56Speaker 1: This was in 2015, 2016, to 10 p.m. Heather's hope
- 44:02Speaker 1: was that if his dad said something to Chad about
- 44:05Speaker 1: his teachings, getting off track from mainstream LDS teachings, Chad
- 44:08Speaker 1: would listen. 2.11 p.m. Heather doesn't exactly recall when she
- 44:13Speaker 1: sent the email to the stake, but believes it was
- 44:15Speaker 1: after the children were found. Wixom has nothing else. Heather
- 44:19Speaker 1: is excused and Pryor does not intend to call her.
- 44:22Speaker 1: Heather is released from the subpoena. 2.13 p.m. Afternoon recess
- 44:27Speaker 1: back in 20. 2.36 p.m. We are back in the courtroom.
- 44:31Speaker 1: Next witness is retired Rexburg police officer David Stubbs. Rob
- 44:35Speaker 1: Wood will question him. 2.39 p.m. Stubbs retired from law
- 44:39Speaker 1: enforcement about three months ago. He is now a specialty mechanic.
- 44:43Speaker 1: Before his retirement, Stubbs was a sergeant supervisor in the
- 44:47Speaker 1: detective division. He was a detective since 2010. 2.42 p.m.
- 44:52Speaker 1: Stubbs was over digital forensics with the department. He had
- 44:56Speaker 1: training on Cellbrite, a program used to find information on
- 44:59Speaker 1: cell phones, tablets, and computers. 2.45 p.m. Stubbs' first involvement
- 45:04Speaker 1: was November 1, 2019. Arizona authorities were investigating the attempted
- 45:09Speaker 1: shooting of Brandon Boudreau and contacted Rexburg police to see
- 45:14Speaker 1: if they could find a gray Jeep on Pioneer Road.
- 45:16Speaker 1: Stubbs and other officers went to do surveillance on the Jeep. 2.47 p.m.
- 45:22Speaker 1: While Stubbs was doing surveillance, he saw Chad and Lori
- 45:25Speaker 1: Vallow Leave her apartment and get into a blue Subaru
- 45:28Speaker 1: with Arizona license plates. Stubbs followed the car to see
- 45:32Speaker 1: if Chad and Lori would lead officers to the Jeep.
- 45:35Speaker 1: They ended up in Idaho Falls and stopped at Mountain
- 45:38Speaker 1: American Credit Union. Then they visited Hobby Lobby. 2.48 p.m.
- 45:44Speaker 1: Two deputies from the Fremont County Sheriff's Office were in
- 45:47Speaker 1: another vehicle tracking Chad and Lori's movements as well. Wood
- 45:51Speaker 1: asked to admit the photo showing Chad and Lori holding
- 45:53Speaker 1: hands outside Hobby Lobby. 2.50 p.m. Chad and Lori were smiling, laughing,
- 45:59Speaker 1: and joking with each other. As they approached the store,
- 46:02Speaker 1: Lori placed her head on Chad's shoulder. Wood displays the
- 46:04Speaker 1: Hobby Lobby photo on the screen. 2.53 p.m. After Chad
- 46:09Speaker 1: and Lori went into the store, Stubbs left and the
- 46:12Speaker 1: other Fremont deputies stayed to continue the surveillance. 2.54 p.m.
- 46:17Speaker 1: On November 26, 2019, the police department got Kay Woodcock's
- 46:21Speaker 1: request for a welfare check on J.J. Vallow. She had
- 46:24Speaker 1: not heard from him, and Stubbs and another officer went
- 46:27Speaker 1: to Lori's apartment to try to make contact with him. 2.55 p.m.
- 46:32Speaker 1: Stubbs and Lt. Ball went to the apartment to help
- 46:35Speaker 1: Hope and Hermosillo look for JJ. When the officers approached
- 46:39Speaker 1: Apartment 175, Lori's apartment, they knocked on the door. She answered.
- 46:44Speaker 1: Police told her that they were there inquiring about her
- 46:46Speaker 1: son as there was concern his grandmother has not heard
- 46:50Speaker 1: from JJ in some time. 2.58 p.m. Wood moves to
- 46:54Speaker 1: admit the body camera footage. 2.59 p.m. Lori told Stubbs
- 46:58Speaker 1: that JJ was in Arizona staying with Melanie Gibb. Lori
- 47:02Speaker 1: says Alex Cox was in the apartment. Stubbs asked if
- 47:06Speaker 1: Lori knew Chad Daybell. Lori said Chad was her brother's friend.
- 47:09Speaker 1: Wood asked to play the body camera video. 3.03 p.m.
- 47:14Speaker 1: The video is played in court. Stubbs says to Ball,
- 47:17Speaker 1: her car is out there. It's blue. They knock on
- 47:19Speaker 1: the door. Lori opens the door and Ball introduces himself.
- 47:23Speaker 1: Lori says her brother is there. 3.04 p.m. Lori says
- 47:27Speaker 1: her son is with Melanie Gibb. Ball says officers at
- 47:30Speaker 1: her house earlier got a bad vibe that something was
- 47:33Speaker 1: going on. Nobody knew anything about a child. Lori says
- 47:36Speaker 1: a lot of stuff has gone on. Lori says she's
- 47:39Speaker 1: had to move around a lot because one of her
- 47:41Speaker 1: brothers is trying to kill her. Imagine pitching this whole
- 47:44Speaker 1: ass story and thinking nobody's ever going to be the
- 47:47Speaker 1: wiser to it. 3.05 p.m. Chad is watching the monitor
- 47:50Speaker 1: as the body camera footage is played. Lori tells police
- 47:53Speaker 1: that her husband died earlier that year, and since he
- 47:57Speaker 1: passed away, Kay has been trying to fight her to
- 47:59Speaker 1: get JJ. Lori says JJ has autism and ADHD. 3.07 p.m.
- 48:05Speaker 1: Lori says she doesn't tell people the truth about where
- 48:07Speaker 1: she is or what they are doing. She says she's
- 48:10Speaker 1: a good person and done everything she's supposed to do
- 48:13Speaker 1: in life, but everyone is causing her trouble. Lori says
- 48:16Speaker 1: her daughter is going to BYU, Idaho, which was a lie. 3.08 p.m.
- 48:21Speaker 1: Kay is watching the screen as Lori is talking about
- 48:24Speaker 1: how bad Kay is. Stubbs says their only concern is
- 48:27Speaker 1: the child. Ball brings up the two guys who were outside.
- 48:30Speaker 1: One was Alex. The other was Chad. Lori says Chad
- 48:34Speaker 1: was one of her brother's friends. Ball asks if Chad's
- 48:37Speaker 1: wife recently passed away. Lori nods her head. Stubbs doesn't know. 3.10 p.m.
- 48:42Speaker 1: Lori says her brother from Kansas keeps knocking on her door.
- 48:46Speaker 1: Lori says after her husband passed, she found emails and
- 48:49Speaker 1: texts between her husband and brother saying, that they were
- 48:51Speaker 1: planning all this stuff. Lori says she was going to
- 48:54Speaker 1: stay with her friends and her friend Melanie. So she's
- 48:58Speaker 1: saying that all the emails that she was getting from
- 49:00Speaker 1: her brother, quote unquote brother, and he was going to
- 49:03Speaker 1: kill her and all this nonsense, which is BS, because
- 49:06Speaker 1: it was really Alex she was talking about. So there
- 49:09Speaker 1: was no brother that was going to kill her. And
- 49:11Speaker 1: we all know that the best lies have a little
- 49:14Speaker 1: bit of truth sprinkled in. 3.12 p.m. Stubbs says he
- 49:18Speaker 1: had several concerns after his conversation with Lori. Stubbs found
- 49:22Speaker 1: no evidence that Lori's brother had been to her apartment
- 49:25Speaker 1: or even in the area. Stubbs never found evidence that
- 49:28Speaker 1: Kay was trying to take JJ. Stubbs went to BYU-Idaho officials,
- 49:33Speaker 1: could not find evidence of her ever applying or being
- 49:36Speaker 1: enrolled at BYU-Idaho. 3.14 p.m. Stubbs says Melanie Gibb was
- 49:42Speaker 1: not in Arizona that day. She was in Utah. Stubbs
- 49:45Speaker 1: notes that Lori says Chad was her brother's friend, whereas
- 49:49Speaker 1: a month earlier he had seen the couple holding hands
- 49:52Speaker 1: and police knew Lori and Chad were married November 5th
- 49:55Speaker 1: in Hawaii. 3.16 p.m. Stubbs was concerned with Lori and
- 50:00Speaker 1: Alex's state of mind. Lori said her brother was in
- 50:02Speaker 1: the apartment, but Stubbs never saw him. Stubbs says he
- 50:05Speaker 1: noticed the staircase to the right. There was a shadow
- 50:08Speaker 1: on the wall that kept moving back and forth. It
- 50:11Speaker 1: appeared to be a person moving back and forth at
- 50:13Speaker 1: the top of the stairs. It made me nervous as
- 50:15Speaker 1: to what that person's intentions might be that we could
- 50:18Speaker 1: not see. 3.18pm Stubbs went back to the apartment because
- 50:23Speaker 1: the police could not get a hold of Melanie Gibb.
- 50:25Speaker 1: He was wearing a body camera. Wood moves to admit
- 50:28Speaker 1: that as evidence. 3.20pm Stubbs went back to the apartment
- 50:32Speaker 1: 10 minutes later. Wood shows the body camera footage on
- 50:35Speaker 1: the screen. Stubbs says, They should ask Lori if she
- 50:39Speaker 1: will call Melanie and get a certification. Melanie was not
- 50:42Speaker 1: answering the phone. 321 p.m. Ball knocks on the door
- 50:45Speaker 1: and says Lori. Lori opens the door and says Melanie
- 50:48Speaker 1: is at Frozen 2 with J.J. Stubbs tells Lori to
- 50:51Speaker 1: call Melanie and have her return the officer's call. 323 p.m.
- 50:56Speaker 1: Stubbs says police were not able to verify J.J. 's
- 50:59Speaker 1: location that day. Stubbs says Melanie did not have J.J.
- 51:03Speaker 1: A warrant was established the following morning to search the
- 51:06Speaker 1: three apartments in the complex, 107, Alex, 174, Melanie, and 175, Lori. 3.25 p.m.
- 51:15Speaker 1: Stubbs says they never saw JJ or Tylee the day
- 51:18Speaker 1: that they went to the apartment. Wood says this would
- 51:20Speaker 1: be a good stopping point for the day. Stubbs will
- 51:23Speaker 1: be back on the stand tomorrow. All right, so not
- 51:25Speaker 1: a good day for Chad Daybell. I know, breaking news,
- 51:28Speaker 1: none of them have been. But this is pretty devastating
- 51:30Speaker 1: testimony here. and it's going to go a long way
- 51:33Speaker 1: to landing a conviction. So we'll continue to follow along,
- 51:37Speaker 1: and after today's proceedings, we'll get an update added to
- 51:40Speaker 1: the catalog. But until then, all of the information that
- 51:44Speaker 1: goes with this episode can be found in the description box.
