- 0:00I am Samuel Trap. Hello, good morning
- 0:03and welcome. I am Samuel Trap. This is
- 0:06International Flavor. You happen to be
- 0:09listening to DAMR Radio. Uh
- 0:13damradio.comlive
- 0:15is where you are.
- 0:18And if you're listening later, not
- 0:20between 7:30 a.m. and 9:00 a.m., uh,
- 0:24Central Standard Time, seems like you're
- 0:28probably
- 0:30on my website, internationalflavor.com,
- 0:33and listening to me there, which I'm
- 0:36also not against, but I prefer it when
- 0:38people listen live just because I do.
- 0:41Uh, so there's been a lot of um, you
- 0:44know, I'm not alone in my trashing of
- 0:47the uh, moves in uh, Venezuela.
- 0:51I don't want to spend a lot of time on
- 0:52that today or this week, but I I did
- 0:54want to share something. I I watched an
- 0:56interesting one last night, and I don't
- 0:58usually watch very often because uh, you
- 1:01know, most of the uh, e even the what do
- 1:05you call it? the
- 1:08right leaning um media is unbelievable
- 1:12these days. You can't believe it. You
- 1:14got to get your your news from elsewhere
- 1:16because the national news I I I suppose
- 1:20I could be taught something or someone
- 1:22could push me in the right direction of
- 1:24a national news program that isn't
- 1:27completely full of crap uh that I might
- 1:29be willing to listen to. But uh I've
- 1:33started going to just independent shows
- 1:35and stuff and and I just
- 1:38I used to be a pretty big fan of
- 1:41O'Reilly long ago. I'd listen to the
- 1:44O'Reilly factor and every once in a
- 1:46while I'll watch him on his Independent
- 1:48on um whatever that is YouTube or
- 1:51however he puts it out. I am not a fan.
- 1:55And many many years ago, I was a fan of
- 1:57the other guy that uh was on Fox News at
- 2:01nights, Hannity. And uh I just now he's
- 2:05he's just a neocon cheerleader, you
- 2:08know, that's that's all he is. And so I
- 2:11quit watching him long ago. Maybe he's
- 2:13changed his tune these days, but I don't
- 2:15think so. But I still like to go out and
- 2:18find people in America that actually
- 2:20will speak the truth, that'll speak
- 2:23things that uh that matter, that won't
- 2:26just blanket, "God bless you, Donald
- 2:29Trump, you're saving the country." And I
- 2:31don't like that because uh I think he's
- 2:33saving the country, but I also think one
- 2:36of his big goals and I found somebody
- 2:38who said something similar and I've been
- 2:40talking about this maybe not in as as uh
- 2:45maybe not as well or with some sort of
- 2:48thesis as I should have been doing. Um
- 2:51but I know I know what I meant. He used
- 2:54to have a guy tell me something. I was
- 2:56like, "What the hell are you talking
- 2:57about?" He'd go, "Well, I know what I
- 2:58meant." I like, well, that's good cuz
- 3:00nobody else does. So, I I just want to
- 3:03make sure that everybody knows uh what I
- 3:05meant and what I mean. And uh you know,
- 3:08I never want it to be cuz I take the
- 3:11point of view from uh traveling
- 3:15from being outside of the country. And
- 3:17if you've gone around in as uh um many
- 3:22places as I have, and I'm only at 57.
- 3:24I'm trying to figure out the next place
- 3:27to go. And uh I I'm thinking uh uh you
- 3:32know, I I I said something the other day
- 3:34about uh going through Qatar to uh St.
- 3:39Petersburg. I really want to get to
- 3:42Russia in a winter month and and I
- 3:44really wanted to do the the uh Christmas
- 3:47holidays. You do realize that tomorrow
- 3:50in the praise of Yanske
- 3:53uh
- 3:54uh Russian Orthodox Church
- 3:59uh Christmas is celebrated tomorrow the
- 4:027th and uh so that's a holiday for them.
- 4:04They're a bit the opposite. So, I wanted
- 4:06to be over there for uh this season in
- 4:10particular, and it looks like I'm going
- 4:13to have to figure that out for next
- 4:15year. Um, yesterday I I spoke with uh
- 4:19Anna Cherasiva. She's from Ukraina.
- 4:24Oo, it's uh the news uh agency that
- 4:27publishes my my uh papers, my my
- 4:33articles and uh we we uh only through
- 4:37telegram we had a discussion. We didn't
- 4:39do anything formally, but we did a a
- 4:41telegram um sort of following and she
- 4:44put my comments out there. And I'm
- 4:46telling you, uh I I truly am not alone
- 4:49in what uh in what I believe. um
- 4:56uh regarding this uh Venezuela deal. And
- 4:59I wanted to share with you because I
- 5:00watched uh uh anyway, she she put some
- 5:03of my questions. She basically answered
- 5:05questions uh and I answered them. Asked
- 5:09questions and I answered them. And uh
- 5:11you know, we we I I got a little little
- 5:14article published out there again uh
- 5:16yesterday about this Venezuela
- 5:19travesty, this nonsensical. Now, I heard
- 5:21somebody yesterday I watched a little
- 5:23bit more of the news because, you know,
- 5:26it's really troubling to me to watch uh
- 5:29the decline and uh and I haven't put it
- 5:33the way that it needs to be put.
- 5:35Obviously, uh I haven't done so and I
- 5:38really kind of need to because I talk a
- 5:41lot about the end of the uh global
- 5:45order, the end of uh US dominance.
- 5:49Multipolarity
- 5:51is something I've spoken about and I
- 5:54recognized it
- 5:56long ago and kind of culminated in my
- 5:59desire to go to that bricks conference
- 6:01in Kazan in October 2024.
- 6:04And it was an eyeopener for me. It was a
- 6:07big one. And and it's stuff like this
- 6:10that just kicks you right in the nuts,
- 6:13right in the dads, if you want to call
- 6:15them that, that she's going, you know,
- 6:18we we speak about America as, you know,
- 6:22oh gee, you know, let's pull some Bill
- 6:24Clinton or some Hillary out of the
- 6:26shining city on the hill or something
- 6:29like that, you know. But we all love
- 6:31America and we all love what it's doing.
- 6:33And what I love is the fact that we're
- 6:37supposedly the good guys. Well, we
- 6:39aren't the good guys. We're the bad guys
- 6:42for the last 30 years. Easy. And it's
- 6:46because of the reality, the world
- 6:51reality of multipolarity. And and I saw
- 6:55somebody agree with me yesterday and say
- 6:58something uh much much better
- 7:03formulated than the way I do it.
- 7:06America, we're not declining. We're
- 7:08still powerful. We're still whatever.
- 7:10And I don't want anybody to say that
- 7:12we're declining, but everybody else is
- 7:16coming up to our level. You know, a
- 7:18rising tide raises all ships and all
- 7:21that. and uh the rest of the world are
- 7:24rising. Okay? And and and I don't mean
- 7:27anything bad about America. We we
- 7:30started it, if you want to put it that
- 7:32way. We we're supposed to be the good
- 7:35guys, but now we're making no bones
- 7:38about it. We're stealing people's
- 7:41resources and we are I I don't know
- 7:44what. We're we're we're threatening.
- 7:47Well, I mean, if watch that Trump thing
- 7:50again, the guy's becoming a neocon
- 7:53blowhard. And he threw he threw Lindsey
- 7:56Graham in there. And Lindsey Graham is a
- 7:58freaking nightmare. And that guy makes
- 8:01no bones about it. Oh yeah, we're
- 8:03coming. We're taking everything. You
- 8:05know, we're we're
- 8:07screw everybody. We got war, America.
- 8:10And he ain't losing anything. That guy's
- 8:12not losing a damn thing, and he never
- 8:15will. And uh uh it's it's it's it's
- 8:18nonsense because this is who's running
- 8:22our foreign policy now. It is the neocon
- 8:28and always Marco Rubio has been a
- 8:31neocon. I mean he's hidden it some. I
- 8:33thought he hid it for the first year but
- 8:35oh no he is deep involved in this. Him
- 8:39and Lindsay they're joined at the
- 8:40freaking hip. And uh you know having
- 8:43Lindsey Graham on Air Force One was like
- 8:45uh it just made me want to throw up
- 8:48knowing that that a-hole is there and
- 8:53guiding our foreign policy. And who's
- 8:56Trump listening to? I think he's finally
- 8:58figured out that the only way to
- 9:03prolong the decline, if you want to call
- 9:06it that, but it's not a decline.
- 9:08Everybody else is coming up. but to
- 9:10force the issue and maybe keep all the
- 9:12subjugated
- 9:14uh you know masses in Venezuela or
- 9:16anywhere else keep them in their proper
- 9:19places is to go on the offensive and
- 9:22attack people and get into and go go
- 9:24into stealing Greenland, you know, I
- 9:27mean he was pretty blunt about that.
- 9:29Yeah, Greenland's coming. We'll talk
- 9:31about that in a couple of months. You
- 9:33know, Cuba, you know, maybe we'll take
- 9:35them, too. It's this is nonsense. This
- 9:39is why people
- 9:41don't like Americans. And when you
- 9:42travel, you got to be careful about, you
- 9:45know, broadcasting the fact that you're
- 9:47an American. And that's terrible. And
- 9:50and and you know, it's terrible that we
- 9:52can't be proud who we are. And being
- 9:55proud doesn't mean that, oh, gee, we get
- 9:58to go be condescending to the rest of
- 10:01the world. The rest of the world are
- 10:02people, too. We're all people on a
- 10:05common planet. And just because we
- 10:08happen to be born in what I believe to
- 10:10be the greatest country on earth,
- 10:12although my my conviction of that, you
- 10:16know, with these terrible people like
- 10:19Lindsey Graham, he's not even a good
- 10:21person. It's it's nonsense. He wants to
- 10:25destroy other people. The fact that
- 10:27nearly 100 people got killed in in and
- 10:31seizing a a criminal and bringing him to
- 10:34justice in New York is is beside the
- 10:36point that you know the hundred people
- 10:38dead, the Venezuelans dead or the Cuban
- 10:41guards dead. That means nothing. We're
- 10:44supposed to jump for joy for that. We're
- 10:46supposed to go, "Oh yeah, we got the
- 10:48greatest armed forces on the planet."
- 10:50Which we do. But so what? Walk softly.
- 10:53Carry a big stick. don't go killing
- 10:56people needlessly. And this was
- 10:58needless. And so now what are we doing?
- 11:00We're broadcasting to the world that we
- 11:02are a bunch of and that we are
- 11:04a bunch of of doineering colonializing
- 11:09imperialists. That's what we are. And uh
- 11:12that is disgusting to me that we have to
- 11:15admit that to people. I don't want to.
- 11:18So but I did want to share with you if
- 11:19you haven't seen it yourself.
- 11:22So, uh, McGregor, Ritter, and Johnson
- 11:24were, uh, uh, all on, um, I think it was
- 11:29Judge Npalitano was there, and I think
- 11:32there there's a group of people there.
- 11:34And, uh, uh, and I, and, and
- 11:36unfortunately, when you, uh, transcribe
- 11:40these shows, they only say speaker this,
- 11:42speaker that. It doesn't tell you which
- 11:45one's which. So, I'm not positive which
- 11:47one said that. And uh here's here's the
- 11:50very first question that they that he
- 11:51gave. He said, "How can President Trump
- 11:54possibly justify the invasion and
- 11:57takeover of the government in Venezuela
- 12:00in terms of American national security
- 12:03cuz we all know that's That is
- 12:06that is not remotely what he's doing
- 12:09here. This isn't narco terrorism. This
- 12:11is nothing but a resource grab and a
- 12:15doineering stuff." And here's how he put
- 12:16it. He said, "Well, judge, that's a
- 12:19question that I think is irrelevant
- 12:22because he's already done it, and we
- 12:24have to accept the fact that he's now
- 12:26committed the United States armed forces
- 12:29and the wealth and power of the United
- 12:31States to intervention in Venezuela. I
- 12:34mean, we could sit here and pick apart
- 12:36the drug allegations or the presence of
- 12:38Hamas and Hezbollah and all this other
- 12:41nonsense, but it doesn't make any
- 12:42difference. He's already acted. That's
- 12:44why he didn't That's why he had to get
- 12:46Lindsey Graham in on it, right? And
- 12:48Marco Rubio had to be in on it. This is
- 12:51This is the neocon strategy. This is the
- 12:54people destroying Donald Trump. Trump is
- 12:57no Trump can no longer claim to be an
- 12:59outsider. He is hip deep in the and
- 13:03getting deeper. And uh uh and and right
- 13:06now, as far as I can tell, the Senate
- 13:08Armed Service Committee has signed on
- 13:10for the operation character
- 13:12characterizing it as law enforcement,
- 13:15which is horseshit because you can't
- 13:17engage in law enforcement outside of the
- 13:20country. And that is presumably because
- 13:22the DEA was part of the team that went
- 13:24in with Delta force to seize Maduro and
- 13:28his wife. And uh so the question
- 13:30continues, so I guess the neocons have
- 13:33triumphed notwithstanding everything
- 13:36Donald Trump and his accolades said
- 13:38during the campaign. And the guy says,
- 13:42and this is the important part that I
- 13:43wanted to get to you.
- 13:46I think that what we're learning here is
- 13:48that Washington, led by President Trump,
- 13:52is ready to use whatever means it has at
- 13:55its disposal, including military power,
- 14:00to stop the diminishment
- 14:03of US national influence in its bid to
- 14:07manage the sort of decline and
- 14:10dissolution of the socalled postwar
- 14:14liberal order. That's what it all seems
- 14:17to be about. Remember, the rules-based
- 14:21order is effectively gone. And
- 14:24rules-based meaning whatever Washington
- 14:27wants to impose. And President Trump
- 14:30simply stated very very categorically,
- 14:34we can do it again because nobody can
- 14:38stop us. There's nothing with the
- 14:41capability that we have. You know,
- 14:43somebody said, "Well, Team America is
- 14:45back." If you ever saw the funny puppet
- 14:48show, I think that's where we are right
- 14:50now. And lots of people are saying,
- 14:52"Fine, this is great." The question is,
- 14:56what happens now? That's, you know,
- 14:59difficult to answer, but we need to talk
- 15:02about that. And, uh, you know,
- 15:08uh, here you go. Um he says and and and
- 15:11you got to see this. He said uh and
- 15:13because they were showing some of the
- 15:14things that I'm complaining about and
- 15:16I'm on the radio so I'm I'm not even
- 15:18going to play it for you. But before we
- 15:20get into what happens now, I just can't
- 15:23resist showing you RFK Jr. and President
- 15:28Trump together at the Republican
- 15:31National Convention two summers ago.
- 15:35Watch the look of glee on President
- 15:37Trump's face when Bobby, whom you and I
- 15:40both know, says Trump will end the grip
- 15:44of the neocons on the government. Uhhuh.
- 15:49And he said, "Play play this cut." Then
- 15:51he said he also told me he wanted to end
- 15:54the grip of the neocons on US foreign
- 15:57policy. and don't you want a president
- 16:00who's going to get us out of wars and
- 16:03who's going to rebuild the middle class
- 16:06in this country? He said, "We don't have
- 16:09that. We have a president who wants to
- 16:12start wars." So the question is, who's
- 16:16really in charge? I'm not convinced that
- 16:19President Trump is because remember
- 16:22during the convention you had this giant
- 16:24Israeli flag suddenly appear in the
- 16:27middle of the Republican convention and
- 16:30certainly in my lifetime perhaps you can
- 16:32remember an example but I don't know of
- 16:35a single instance where either the
- 16:37Democrat or Republican parties held a
- 16:39convention and hoisted a giant foreign
- 16:42flag at the convention talking about
- 16:45quote unquote Israel. first. I've never
- 16:49heard of that before. And uh I tell you
- 16:52what,
- 16:54these are frightening times, people.
- 16:56This is I mean, if we are going to be
- 16:59starting wars, there's some people are
- 17:01going to have some things to say about
- 17:02that. There really are. And I told you
- 17:05yesterday in my rant that people are
- 17:08certainly
- 17:10watching us. And for all those of you
- 17:14who think that Trump is the answer, you
- 17:16know, he's he's the uh you know, the
- 17:19greatest thing since sliced bread,
- 17:22uh I tell you what, I I have always
- 17:25thought positively of this guy, always.
- 17:28But he is certainly in the pocket of the
- 17:31Lindsey Grahams of the world right now.
- 17:34And if that Air Force One
- 17:37didn't show that
- 17:40to you, you better look again because
- 17:43who's running that show? It ain't Trump.
- 17:45And Trump has bought on to this whole
- 17:48thing. And if this is how he thinks. So
- 17:51So and and I've thought about this. It's
- 17:53been a couple of days now. know I I
- 17:55similarly I don't believe there's crap
- 17:57you can do about it except about
- 17:59it you know which I you know I'm doing
- 18:02now and because that's what I'm good at
- 18:04but there's not much you can do about it
- 18:07you know who who are we you know we're
- 18:09nobody and and and frankly we're the
- 18:12people that Lindsey Graham will send off
- 18:14to slaughter without thinking twice of
- 18:17it you don't care we're nothing but
- 18:19little red uh risk pieces in
- 18:22denominations of 1 five or 10. That's
- 18:25it. And uh uh that's all we are to that
- 18:28guy. And uh he cares about money. He
- 18:31cares about power. And he cares about
- 18:34whether he gets reelected. That is it.
- 18:37And he don't care about a damn thing
- 18:39else. He cares about destroying Ukraine.
- 18:42Why? Because that might weaken Russia.
- 18:46But in the meantime, we'll just destroy
- 18:48Ukraine and it doesn't matter cuz
- 18:50they're dying for it. He was pretty
- 18:52upfront about that. Well, none of our
- 18:53guys are dying. That's not true either.
- 18:55We've had some people dying over there,
- 18:58but our guys aren't dying. What do we
- 18:59care? We'll just keep funding it. We'll
- 19:01keep funding it until Ukraine is gone.
- 19:03And hopefully we can come in and make a
- 19:04deal with Russia and get half of the
- 19:06resources. But they lost that resource
- 19:09battle. Russia took the Dawnbass, which
- 19:11is in the eastern side. Why do you think
- 19:13Ukraine doesn't want to give it up? We
- 19:14can't give up our territorial integrity.
- 19:16They're all talking about territorial
- 19:18integrity. It's talking about uh the UN
- 19:21charter and how that works and
- 19:23territorial integrity and no other
- 19:25country can do it. And what does the US
- 19:27do? We go replace leaders. You can't.
- 19:30Everything in the UN charter, we ignore
- 19:33it. But by God, we want to enforce it
- 19:35against everybody else. What's wrong
- 19:37with Xi Jinping wandering into Taiwan
- 19:39now? Anything? What's wrong with North
- 19:42Korea taking over South Korea? No.
- 19:44Anything at all? You know, and what is
- 19:47wrong with wandering into Greenland and
- 19:49saying, "Jesus, if you guys really
- 19:51wanted this, you'd put more than 70,000
- 19:53people here and we need this." Like
- 19:55Trump said on Air Force One the other
- 19:57day, we need this cuz strategically we
- 19:59need it. Denmark and you know, I think
- 20:01most of Europe wants it anyway. So screw
- 20:04it. Me and Lindsay, we're we're just
- 20:06going to put a fleet up there. We'll put
- 20:09a fleet up there. And uh you know if if
- 20:12if Fisceland had anything to offer, we'd
- 20:14have taken that long ago.
- 20:17They don't have anything to offer. So
- 20:19we'll just stick with taking all of
- 20:20Greenland so we have a a seat in the
- 20:23Arctic. Well, Jesus Christ, why don't
- 20:24you take over uh uh Sorry, I shouldn't
- 20:26talk like that. Why don't you take over
- 20:28Canada, too? I mean, Canada's run
- 20:31poorly. We could knock them over. The
- 20:33only reason they don't have an army or
- 20:34military is cuz we do. And they know
- 20:37we'll get their back. They don't have to
- 20:39have defense. a huge chunk of their
- 20:41money doesn't have to go to defense.
- 20:43Meanwhile, we're a trillion bucks in and
- 20:45we're 38 million on the world debt or a
- 20:49trillion, I'm sorry, million. Yeah. Gez,
- 20:51God, that'd be awesome. But 38 trillion
- 20:56and counting and rising every day and
- 20:59the crap ain't going down. Anyway, I've
- 21:01ranted on that long enough and I said I
- 21:03wasn't going to do that, but I have. Um,
- 21:07I was playing for you a little bit of uh
- 21:10uh that that song when I just happened
- 21:12to hear it on the car coming in and it
- 21:14was uh the Stonebridge radio edit of a
- 21:18song called The Fear and uh and I like
- 21:22it now. Where is it? How come we're not
- 21:24hearing it? Um I don't know. We're gonna
- 21:27we're gonna maybe play it some more, but
- 21:29I doubt it. uh cuz I don't want to go
- 21:31through and cut it and when I upload it
- 21:33to my to my uh podcast site, I got to
- 21:37take it out so they don't about
- 21:40having a license. And we have a license
- 21:42on the radio show, but somehow I paid
- 21:46for a license ages ago, but I can't
- 21:48figure out how to transfer it over
- 21:50there. So anyway, I'm bitching about
- 21:52nothing. I wanted to continue uh with
- 21:55the uh with the uh uh the latest news
- 22:00regarding Venezuela
- 22:02and uh I heard yesterday uh on uh let's
- 22:07see who was I watching I can't remember
- 22:09Christophoru um one of the two Alex's I
- 22:13listened to in uh in in in English and
- 22:19they were saying that this turns out uh
- 22:22that uh there's further information.
- 22:24They're saying that the New York Times
- 22:25was reporting that this was a coup, that
- 22:29uh they were supported on the way in.
- 22:31Well, if it was a coup, why in the world
- 22:32are they killing a 100 people? Why is
- 22:35it? And I saw something very interesting
- 22:37on uh uh Telegram last night in in
- 22:40Russian and uh I needed to translate it
- 22:43to English and I wonder and it's hard. I
- 22:47see if I can do it on the fly. I think I
- 22:49can cuz it wasn't that difficult. If I
- 22:52can just provide it to you on the fly
- 22:56cuz they were showing
- 22:58um
- 23:00Apache helicopters attacking
- 23:04inside of uh
- 23:07inside of
- 23:10uh what do you call it?
- 23:12Um Venezuela. And I forgot my glasses.
- 23:16No, I didn't. They're here hanging on my
- 23:18shirt. and uh hard to read my phone in
- 23:20my old age, but I'm going to save this
- 23:24or tell this for you. This is something
- 23:26I saved. And this was uh from Venezuela
- 23:29sent to Russian uh on my Telegram
- 23:32channel and it shows a video and the
- 23:34video is this uh patchy helicopter
- 23:37bombing the crap out of uh places inside
- 23:41of Venezuela. And it says a team of
- 23:46attack helicopter Apaches with uh
- 23:49appeared over targets in the region of
- 23:52Caracus.
- 23:53If these pictures can be supported, this
- 23:58is a serious escalation.
- 24:02strikes
- 24:04uh not from drones and not one-time
- 24:09drones and not diver uh what do you call
- 24:12it? Diveranti are um protesters. They're
- 24:16not really protesters but uh rebels.
- 24:18rebels. A uh a fullscale
- 24:23strike of uh but but a full scale strike
- 24:28of a machine of American aviation. The
- 24:32Apache is not a the um weapon of
- 24:37Venezuela. It's a symbol of the direct
- 24:40participation of the US and its allies.
- 24:46All lat of Latin American history of the
- 24:49last decades was
- 24:52uh
- 24:54was built on a simple proposition.
- 24:58Whoever talks the loudest about uh
- 25:01sovereignty and independent politics,
- 25:05that person sooner or later will receive
- 25:09a colorful resolution, a color
- 25:12resolution or a serious pressure.
- 25:16Venezuela is in the list is was on that
- 25:20list uh long ago and quite seriously.
- 25:23And now judging from everything that has
- 25:26happened, the pressure has uh the
- 25:30pressure and the revolution or the
- 25:34change to a military uh sphere is
- 25:40uh is a is a is a great pinch uh that
- 25:43shows how far
- 25:45uh you can go without formal formally
- 25:48declaring war. How far can the US go
- 25:51without formally declaring war? Um
- 25:55on the whole we see a very similar a
- 26:00very familiar uh underline uh well a
- 26:04podor is um uh emphasis we see this
- 26:07emphasis strikes on infrastructure work
- 26:10on uh uh capital objects in the capital
- 26:14and maximum
- 26:16um
- 26:18maximum bringing up of chaos. The logic
- 26:21is simple. Show everyone around that any
- 26:25country deciding to play to not play by
- 26:30the rules of Washington risks sooner or
- 26:33later seeing in their own territory
- 26:37above their heads the
- 26:41uh helicopter of democracy and and uh I
- 26:45didn't that's not a that was a on the-ly
- 26:48not a great interpretation but uh that
- 26:51that That I thought was very telling and
- 26:54I'm sitting there reading it and going
- 26:56you know I get the feeling complet you
- 26:58know completely. So now we're we're
- 27:01bringing so so uh Venezuela was working
- 27:04with very seriously with China like I
- 27:07told you yesterday 100 billion committed
- 27:10paying off loans funding their
- 27:12governments giving a lot of things and
- 27:14uh they made no bones about it the oil
- 27:16is coming to the US it's not going to be
- 27:19uh uh developed and infrastructure
- 27:22developed by China. Nope. We're not
- 27:25doing it. Now,
- 27:27you can agree with that, but why in the
- 27:29world freaking lie to me about it? And
- 27:32now, see, I'm much more likely to be on
- 27:35your side if you don't freaking lie and
- 27:38and and and do what's called fraud in
- 27:41the inducement. Fraud in the inducement
- 27:43is a mil is a legal term that means
- 27:46somebody's trying to get you to to go
- 27:48into a contract. And if you lie to get
- 27:51him into this contract, it's called
- 27:53fraud in the inducement. And it's a way
- 27:55to avoid the contract. If you say,
- 27:57"Geez, I need to get a loan so that I
- 27:59can uh get a loan to, you know, build a
- 28:02house and then your nephew can live in
- 28:05that house with me." And then you get
- 28:07the loan, they give you the loan to
- 28:09build the house and instead of building
- 28:11the house so the nephew can live in it,
- 28:13you go on a world trip and you take a
- 28:15cruise around the planet for 365 days
- 28:18with the money. So the loan was a valid
- 28:21loan. It's a valid contract, but it was
- 28:23fraud in the inducement. You induced him
- 28:26with a fake thing. Well, that's exactly
- 28:28what they've done to us. They sell it to
- 28:31us and then slap the truth upon us at
- 28:34the end, which is And and they
- 28:37take this and they say, you know, oh,
- 28:39it's narco terrorism. We're we're we're
- 28:42they're they're killing us in the
- 28:43homeland, which is anyway. It's
- 28:46it's nonsense. It's not Venezuela doing
- 28:49that. If they are, it's very minimal.
- 28:53And he certainly isn't the narco
- 28:55terrorist Jesus. They're they're they're
- 28:56charging him with uh having machine
- 28:58guns. This is nonsense. And then we find
- 29:01out what the real deal is. Oh, you know
- 29:04what? This is anti-China. We're taking
- 29:06over the oil so China don't get it. And
- 29:09now they're coming out of the closet and
- 29:11telling us this. Why didn't you say that
- 29:14before? You know why? Cuz then you can't
- 29:16go and use the use of force. And and and
- 29:19by the way, that's another topic
- 29:21altogether is the use of force be
- 29:24declaring war basically. They've just
- 29:27done it and Lindsey Graham helped get
- 29:30away with it. They structured how we did
- 29:32this in Iraq. It's been going on ever
- 29:34since. We don't declare war in
- 29:36Afghanistan. We don't declare war in
- 29:39Iraq. We don't declare war in Venezuela.
- 29:42We certainly don't talk about the
- 29:43buildup that we did inside of Ukraine.
- 29:46But in the end, it's all the same.
- 29:49Congress Lindsey Graham is funding it,
- 29:51and he's making sure that your dollars
- 29:54are going to pay for the continued
- 29:57dominance of the elite oil company
- 30:00owners. We're certainly not doing this
- 30:02to protect Venezuela. This has nothing
- 30:06to do with dem democracy, nothing to do
- 30:09with taking care of or fixing Venezuela.
- 30:13All it is is a satellite.
- 30:19That's it. And we're go. But Trump, oh,
- 30:21not we. This sure as hell ain't me. We
- 30:24are going to force them. Who is the guy
- 30:25that moved out of the country with his
- 30:27wife and everybody's going, "Oh, good
- 30:28riddance." You know, try to fix it from
- 30:30within. I think it's too far gone to fix
- 30:33from within. It's too far gone. What's
- 30:36going to happen the next time? Some
- 30:37Democrat's going to come in and his
- 30:39favorite place is going to be France and
- 30:40he'll just go take over France. declare
- 30:43war without declaring war, by the way.
- 30:46You don't have to. Who needs
- 30:47congressional approval for that? This is
- 30:49a slight military. This is a law
- 30:51enforcement action. Oh, really? Why
- 30:53don't you send in 10 cops then? Why you
- 30:55send in the military?
- 30:59Small coffee break whilst I yell at
- 31:02people. Anyway, that really isn't what I
- 31:04wanted to talk about today, but I'm glad
- 31:06I have. And so, that is my thought on
- 31:08that. And I think you should uh follow
- 31:11along and I think that was a Judge
- 31:14Npalitano show that uh they were talking
- 31:17uh on the one that I told you about with
- 31:19these various speakers. Um
- 31:23you know
- 31:26I think we have to understand we had all
- 31:29these allegations about Hamas Hezbollah
- 31:33training camps. Not that anybody in the
- 31:35intelligence business believes that, but
- 31:38because that's how we sell it to the
- 31:40American people. I don't think anybody
- 31:42in the intelligence business believes
- 31:44the bit about Maduro is a drug kingpin
- 31:47either. We're interested in the most
- 31:50significant exporter of cocaine in
- 31:53modern history. Well, let's set aside
- 31:55for a moment that and chalk it up to one
- 31:57of many justifications for what's going
- 32:00on. But none of them are the correct,
- 32:04you know, they are, you know, only in
- 32:07the top five. But what you do have in
- 32:09Venezuela, oil reserves, natural gas,
- 32:13nickel, rare earth, and massive endowed
- 32:17gold, lots of gold, and one of the
- 32:20largest iron ore deposits in the Western
- 32:24Hemisphere. So all of those things are
- 32:27what's wrapped up in this. And now he's
- 32:29telling everybody, "We're going to
- 32:31rebuild everything. We're going to
- 32:34restore the health of oil structure,
- 32:37infrastructure." And he admits it's
- 32:40going to take a long time and American
- 32:43corporations are going to march into the
- 32:45country and everybody's going to get
- 32:48rich. No.
- 32:51No. No. No. No. Will Washington provide
- 32:55an economic package to lift Venezuela
- 32:58out of poverty? No. I don't think
- 33:01they're going to do crap about that. And
- 33:04and uh you know, they've taken it over.
- 33:06Now what? So, we just bought Venezuela
- 33:10or stole Venezuela. And I just want to
- 33:14go on the record of being against how
- 33:16this happened. If you wanted to fix it,
- 33:20then you support some kind of other
- 33:23person. And not through our shady CIA BS
- 33:27either. People have to I mean, who
- 33:30supported us on the way up?
- 33:33I mean, seriously, what what what
- 33:35happened when we wanted to depart from
- 33:37England? And I know it was 250 years
- 33:39ago. It's a different world. Now it's
- 33:41OG. America just comes in and bombs the
- 33:44crap out of people using Apache
- 33:46helicopters. and then uh uh takes a
- 33:49leader under false pretenses. We all
- 33:51know that's not what this is about. And
- 33:54they're saying it. They keep saying it.
- 33:56Well, just take the package we gave you
- 33:58and we'll send you off to uh uh you know
- 34:00a uh a uh an island somewhere where you
- 34:04and your wife can retire. That's why
- 34:05they brought the wife along. They don't
- 34:07believe the wife was a narco terrorist.
- 34:10They want them to be together. Take them
- 34:12out of the picture, pay them off, make a
- 34:14display. They perp they drove the guy in
- 34:17a van through the streets of New York so
- 34:19everybody could have a look at him. They
- 34:22did that. They did that on purpose. This
- 34:24was a victory lap. And it's
- 34:28That's not how you treat even an
- 34:30arrested head of a foreign state. These
- 34:33people have no idea what they're doing.
- 34:35And they're all they are is selling crap
- 34:38to the masses who will clap loudly and
- 34:42go, "Yeah, yeah, this is a guy at a
- 34:44football team cheering his team. That's
- 34:46it."
- 34:48And I think it's nonsense. The a real
- 34:50thinking population would be thinking
- 34:54far ahead of this. What do we look like
- 34:56to the rest of the world? We look like a
- 34:58bunch of clowns. We, you know, you try
- 35:00to try and I know most of you don't care
- 35:02because you don't travel, but if you go
- 35:04to other countries and you find out, you
- 35:06know, it's pretty funny because you meet
- 35:08people and then you're sitting there,
- 35:10you're having a good conversation with
- 35:11them and they go, "Where are you from?"
- 35:13And you go, "America." And you know how
- 35:15many times I get the you don't seem like
- 35:17the typical American to me. Even in
- 35:19Europe, I get that. It's you're not the
- 35:23typical American. Well, it's because,
- 35:24you know, a lot of Americans have no
- 35:27perspective other than the tiny bit of
- 35:32news they get from America. It doesn't
- 35:35make me a better person. I I not claim
- 35:37that at all. I'm a piece of crap in a
- 35:39lot of regards. You know what I mean?
- 35:41But but at least I have a different
- 35:43perspective. You know, I've gone through
- 35:45some crap in my life. And that number
- 35:47one has given me a little bit of a
- 35:49different perspective. But I've also
- 35:51been other places and seen other things
- 35:54and tried to learn how other people live
- 35:56and how they think. Our government
- 36:00doesn't do that at all. They didn't do
- 36:02this for Venezuela. Not remotely. This
- 36:05was not for Venezuela. Will they have a
- 36:08few a few that that will go, "Oh, yeah,
- 36:11great." Same thing, cheering their
- 36:13football team, waving the flag. Sure
- 36:15they will. Well, they have a whole bunch
- 36:17that are plunged into poverty that
- 36:19you'll never hear anything about. People
- 36:21that are killed on the sidelines, you'll
- 36:24never hear anything about that. The 100
- 36:26or so that were killed uh uh in this in
- 36:29this uh quest to uh advertise that we
- 36:34are doing the right thing and we're
- 36:36taking we're we're stealing your oil.
- 36:38That's that's not the right thing, by
- 36:40the way. you know, taking things that
- 36:43don't belong to you are never the right
- 36:46thing and they don't belong to us, but
- 36:48we've just stolen them. And Trump is
- 36:50proud of it. And they're very proud of
- 36:52the fact that we're we're we're thieves.
- 36:54We're criminals. We're robbers. We're
- 36:56imperialist
- 36:58bandits. That's what we are. And that's
- 37:01what this represents. We could have done
- 37:03something with diplomacy, but nope. All
- 37:06we have is force and the threat of force
- 37:09and parking our navy outside of there
- 37:11blowing up ships with zero and and you
- 37:14know what we watched them do that for
- 37:16two three months blow up ships and the
- 37:19uproar uh you know they were watching
- 37:21they're going oh well there's not much
- 37:23uproar about that there's some people
- 37:25bitching about it but not very many you
- 37:27know nobody's bitching about that what
- 37:29if we go in and kill a hundred people
- 37:31and steal a guy and claim it claim it's
- 37:33you can imagine him sitting in you know
- 37:35the back office of the White House with
- 37:37Lindsey Graham and Marco Rubio and
- 37:39Donald Trump all rubbing their hands
- 37:41together and uh uh you know like Dudley
- 37:45was Snidly whip Snidly whiplash or
- 37:48whatever sitting back there and going
- 37:49yeah yeah they won't you know we've
- 37:51convinced and nobody said anything we'll
- 37:53just go a step further and that's
- 37:55incrementalism going further and further
- 37:57and further and then you pull the rug
- 37:59out from underneath and you go oh by the
- 38:01way everything we told you the last
- 38:02three months was a complete lie this
- 38:05isn't about um narot terrorism. It's
- 38:08about nothing but stealing resources and
- 38:11keeping China out. Well, why didn't you
- 38:13tell me that in the first place? I might
- 38:15have been able to help you, you know,
- 38:17figure or at least support you in your
- 38:19effort to do it. I don't support this
- 38:22type of behavior and I think it's just
- 38:24wrong. And so, anyway, that's my rant on
- 38:26that topic. I really got to get off of
- 38:28it because I said I wasn't going to. I
- 38:30wanted to get back to the craziness
- 38:32that's going on here in Missouri
- 38:36and there's plenty of that going on. All
- 38:38of you know that uh uh well I only meant
- 38:41to spend uh 20 minutes on that and I
- 38:43doubled it. I spent 40. So So sorry
- 38:47about that. But we're going to continue
- 38:49on because there's there's something
- 38:51I've been working on for a little while.
- 38:53I've been involved with the group and uh
- 38:55I put a little ping and hopefully you
- 38:57know uh how you can get on case and you
- 38:59can uh tell it to uh
- 39:03what do you call it ping you when
- 39:05activity occurs on a particular case
- 39:09that's what I have done and I'm watching
- 39:11this case and I want to know where it is
- 39:16and uh uh so I'm
- 39:20um waiting for for this judgment and uh
- 39:24the hearing was December 3rd. the uh
- 39:28parties, the attorneys had to submit
- 39:31their proposed judgments by December.
- 39:34Turned out to be December 17th, I think
- 39:37is when they were all submitted. A
- 39:38couple weeks later
- 39:41and uh now, you know, with the holidays
- 39:43and stuff, no ruling's going to be made,
- 39:45but I've been waiting for a ruling. And
- 39:47it's on the or we have been waiting for
- 39:50a ruling. And uh we're very interested
- 39:52in in where we go from here. And this
- 39:55has to do with alcohol and tobacco
- 39:58control. Last week I walked you through
- 40:01the Chevron doctrine, what it meant, the
- 40:05overturning of that doctrine by a
- 40:08Supreme Court of the United States case
- 40:10called Loper Brightite. And and Loper
- 40:13Brightite overturned the Chevron
- 40:16deference. And deference was when a
- 40:20court
- 40:23was
- 40:25or had a case before it
- 40:28predicated upon agency action against
- 40:33you know somebody license holder agency
- 40:35action and I don't know what pick one um
- 40:40and people fighting a term of either a
- 40:44regulation a uh uh a an interpretation
- 40:49of a regulation, an action on a
- 40:52regulation, anything regarded to a
- 40:55regulation or a statute that was
- 40:57interpreted by an agency. The Chevron
- 41:01doctrine said that the court should
- 41:07defer to the professional bureaucrat,
- 41:11right? that well the professional
- 41:13bureaucrats been doing this for you know
- 41:1530 years. The agencies are usually built
- 41:19with people who know what they're doing
- 41:23which is totally wrong by the way.
- 41:26Thinking that agencies are built with
- 41:28people that know what they're doing or
- 41:30taking that as a presumed fact is not a
- 41:33good idea because it's not a you know a
- 41:36good fact. I have a lot of respect for a
- 41:38lot of government workers, but I got a
- 41:41lot of lack of respect for plenty more
- 41:45that uh clearly love their position more
- 41:48than they love uh uh you know the law
- 41:51and they truly love the fact that they
- 41:54were the ones interpreting the agency
- 41:58uh action, right? And so they would
- 42:01interpret the agency action and and and
- 42:03under the Chevron doctrine which was in
- 42:05place for I can't remember when Chevron
- 42:07came out 7172
- 42:09I really don't remember and I could be
- 42:11off decades in that I don't remember but
- 42:14I think it was in the 70s when the
- 42:15Chevron doctrine came about
- 42:18and uh from 19 40 50 years let's call it
- 42:22maybe it's long maybe it's less than
- 42:23that who who knows but some a decent
- 42:26period of time I could look it up but I
- 42:27I'm not going to cuz it's it it It's for
- 42:30for that period of time, courts would
- 42:32defer to the professional bureaucrat
- 42:35interpretation of whatever this um
- 42:39whatever they were interpreting. If
- 42:41they're interpreting a regulation, a
- 42:42statute, a uh a guide, a handbook, you
- 42:47know, whatever, an action against an
- 42:49individual, a business, or anything. And
- 42:52uh the court would say, "Well, these
- 42:54guys are the experts. I'm not the
- 42:55expert. I'm a judge. you know, I'm not
- 42:57the expert in uh in this case alcohol
- 43:00and tobacco rules. They are, you know,
- 43:03they're they're experts on alcohol and
- 43:05tobacco rules, not me. So, I will defer
- 43:08to their interpretation because they've
- 43:10been doing it a long time. And
- 43:12presumably they won't use the
- 43:14interpretation one way for one person
- 43:17and another way for another. What that
- 43:19allowed was exactly that to happen
- 43:22though. uh agencies could pick and
- 43:25choose who they targeted and who they
- 43:27and that's my biggest beef with
- 43:29administrative action. It it isn't given
- 43:32in a blanket manner to everyone. It is
- 43:36selective. These guys selectively go out
- 43:39and choose who to go after. They
- 43:41selectively pick and choose what issues
- 43:44they like and don't like. target. Target
- 43:47targeting is prevalent and in fact the
- 43:50preferred method of destroying people in
- 43:54Missouri and many other places. And so
- 43:57the Chevron doctrine
- 43:59kind of allowed that to happen, right?
- 44:01The Chevron doctrine would go cuz when
- 44:03you sued them, you'd get into court and
- 44:05the judge would go, "Well, you know, the
- 44:06the agency gets the uh you know, ties go
- 44:10in their favor, you know, if there's a
- 44:12tie." And so, uh, you know, we're going
- 44:14to go with their, uh, we're going to
- 44:16defer to their understanding. And, uh,
- 44:18you know, sorry, but your understanding
- 44:21doesn't count. You know, how what the
- 44:23statute says doesn't count. How they've
- 44:26interpreted it does count. Even if the
- 44:28interpretation is BS, you know, we we
- 44:31defer to what they decide. So, Loper
- 44:34Bright came along in 2024
- 44:37and uh
- 44:39changed all of that. Loper Bright on the
- 44:42Supreme Court of the United States
- 44:44overturned the Chevron doctrine and said
- 44:47what should have been said in my view
- 44:49all along. It said listen this is
- 44:54nonsense. The interpretation of the law
- 44:59is a legal matter and judges determine
- 45:04what the law is, not some bureaucrat in
- 45:08an agency. Even if they've been there 30
- 45:11years, doesn't matter. Law
- 45:15judgments should be interpreted by the
- 45:18court. the meaning of a statute
- 45:21shouldn't be interpreted by some, you
- 45:24know, I don't know, non- lawyer, you
- 45:27know, not mo, you know, all judges are
- 45:30lawyers and well, actually that's not
- 45:31true in Texas, but in most places all
- 45:34judges are lawyers and uh uh so when
- 45:38they make an interpretation, presumably
- 45:41they were listening in uh uh
- 45:43administrative law class in law school.
- 45:47I enjoyed administrative law class. I
- 45:49enjoyed going through all this stuff. I
- 45:51liked it, you know, talking about all
- 45:53those things and uh uh I I took a even a
- 45:56couple of years some advanced courses in
- 45:58it. I liked it, you know. Not that I
- 46:00ever wanted to be in an agency. Well, I
- 46:02thought it'd be fun to run the planet,
- 46:04you know, but I'm done with that, you
- 46:06know, let the idiots uh you know, uh
- 46:08like Lindsey Graham do that. I I can't
- 46:11kiss ass that much. I just I can't do
- 46:13it. Makes me wish I could. But uh look,
- 46:17look at me. I went straight back to
- 46:18Lindsey Grahams cuz he's such an easy
- 46:20target. Jeez, what a Oh, you know, I
- 46:25forgot to mention yesterday when I was
- 46:26going on about all the five things that
- 46:28he did. I forgot Afghanistan for that
- 46:32a-hole. You know what about Afghanistan?
- 46:34You know, he he Well, he was involved in
- 46:37that nonsense, too. You know, another
- 46:40big knife in the back to the American
- 46:42public. Another big stealing money for a
- 46:46failed mission by Lindsey Graham and
- 46:49company. And there were six, not five.
- 46:51Yesterday I went through uh uh five of
- 46:54them. And there were actually a sixth
- 46:56one cuz I I can't believe I forgot all
- 46:58about Afghanistan. He was out there
- 47:00talking about that too. 20 freaking
- 47:03years we were over there. Lost all kinds
- 47:06of stuff. And don't go acting like
- 47:08that's all Joe Biden and we can blame it
- 47:10on him. you know, Lindsey Graham, if he
- 47:13was the genius uh uh that that he
- 47:16pretends to be riding around in Air
- 47:18Force One, then that wouldn't have
- 47:21happened. Nor would any of the other
- 47:24wrong
- 47:26results, the absolute opposite of what
- 47:29he said on every single instance. And
- 47:32here's Trump listening to him. Anyway,
- 47:35sorry to get sucked back into that.
- 47:37We're going to go right back to our uh
- 47:39regularly scheduled programming and not
- 47:42rail about the federal government cuz I
- 47:44have no power against Missouri
- 47:46government, let alone the federal
- 47:47a-holes. You know, this is nonsense. And
- 47:50we just need to understand as Americans,
- 47:53they are not your friend. They are not
- 47:56your friend. Why do we have the right to
- 47:58bear arms? Because the government is not
- 48:00your friend. I don't even own any
- 48:03weapons right now. But but I tell you
- 48:04what, I feel like I need to go buy a
- 48:06bunch. You know, I I wouldn't pull the,
- 48:09you know, the actor thing and move to
- 48:10another country. Although I would do
- 48:12that just cuz I like other countries. I
- 48:14wouldn't do it to avoid the US. You know
- 48:17what I mean? That it's not that bad.
- 48:19Well, it's a great I don't mean it's not
- 48:21that bad. It's a fantastic. But, you
- 48:23know, I'm so tired of of of these
- 48:26negative things that do nothing for us
- 48:29and only line the pockets of a-holes
- 48:32like Lindsey Graham. Anyway, back to the
- 48:35other stuff. When you look, sorry, I
- 48:38sidetracked myself like a numbnuts and
- 48:40uh I I shouldn't do that. But but here
- 48:43we go. The so with Chevron being
- 48:46overturned by Loperbrite and then the US
- 48:50or here in Missouri the the statute or
- 48:53the Congress in its uh legislature in
- 48:57its wisdom which is rare too they
- 49:02codified it in 536.140
- 49:06which I shared with you last week and
- 49:08basically 536.140
- 49:11says
- 49:13that in the event there's a dispute,
- 49:16there's a question, there's an
- 49:18interpretation that needs to be ha uh
- 49:21reviewed that that interpretation
- 49:25is the realm of the judiciary of a
- 49:28judge. A judge when a dispute is brought
- 49:31before him, he will not defer to an
- 49:35agency. He will not he shall not defer
- 49:39to the agency and he shall interpret it
- 49:43denovo brand new you know as as if new.
- 49:47He will interpret it
- 49:49himself
- 49:51and say what it means based on what he
- 49:54knows of the law and he will do so. they
- 49:57added this key phrase and and and I'm
- 50:00paraphrasing the phrase, but the key
- 50:02phrase is and he will do it in a way
- 50:05that maximizes individual liberty
- 50:10and minimizes government overreach.
- 50:13That's basically the last line of this
- 50:16interpretation. And so what the what the
- 50:19legislature have done and I've got my my
- 50:21problems with the legislature and the
- 50:23idiot rules they put into place in a lot
- 50:25of respects but not that everyone you
- 50:29know what they used to say in the
- 50:31military you do something right and the
- 50:33sergeant look at you go well trap even a
- 50:36blind squirrel finds a nut every once in
- 50:38a while right well that's how I feel
- 50:40about the uh legislature even a blind
- 50:43squirrel finds a nut sometimes and
- 50:46there's the legisl E having done the
- 50:48right thing. Uh, wow. What a surprise.
- 50:51Uh, curious. They've done the right
- 50:54thing. We ought to write that down
- 50:56somewhere and go, "Look, they've done
- 50:58it. They've pulled their collective
- 51:01heads out of their, you know, each
- 51:02other's asses and uh, look where we've
- 51:05gotten. We've gotten somewhere
- 51:06positive." Uh, so this is positive.
- 51:09Okay. And I believe that we are the
- 51:12first to uh have this this this this law
- 51:16went into effect August 28th of this uh
- 51:202025. I'm sorry, it's 2026 now of 2025.
- 51:23And nobody that I'm aware of and and I
- 51:26did some looking has has asked a court
- 51:29to uh rule or or to make a ruling based
- 51:34upon 536.140.
- 51:36I think we are the first. And so I think
- 51:38that the the judge in this case is going
- 51:40to be particularly careful with what he
- 51:43does. I mean, why not? He's gonna have
- 51:46to be particularly careful because
- 51:48somebody's appealing. Either way, it's
- 51:49going to be appealed. And I told you a
- 51:51little bit about the case last week and
- 51:53a little bit about what we're doing.
- 51:55Well,
- 51:57turning this Okay, so the alcohol and
- 51:59tobacco control, they have taken taken
- 52:04it upon themselves
- 52:07to say that uh and now did you know and
- 52:10and if you go out to civicwarriors or
- 52:13civicoutlaws.com,
- 52:15you'll see the start of a web page that
- 52:17we have going on. It's not finished yet.
- 52:19We have uh you know, we have a sample
- 52:21out there, but it's not done. Um, we're
- 52:24testing out the donation links and we're
- 52:26testing out a couple of other things for
- 52:29people to help us go after government
- 52:31overreach and uh to fund us going after
- 52:36government overreach which is rampant in
- 52:39America. Um it's it and and we believe
- 52:43that with the changes in the Loperbrite
- 52:45decision and with the
- 52:48uh 53640
- 52:51in Missouri that the the path is clear
- 52:55and it uh allows people to revisit
- 53:00issues where they're getting screwed by
- 53:04administrative
- 53:06governmental overreach everywhere.
- 53:09people taking authority that doesn't
- 53:11belong to them. The Department of Public
- 53:13Safety putting up cameras somewhere and
- 53:17spying on people now needs to be
- 53:20reviewed. They don't have the abil they
- 53:22don't have the right to do that. They
- 53:24they put up these traffic cams, but they
- 53:26don't use them for that. They don't put
- 53:27up traffic cams to uh I don't know to uh
- 53:31see what happened when an accident
- 53:33occurred. That's not why they're put up.
- 53:35That's one tiny reason. But what they're
- 53:38doing is tracking people. What they're
- 53:40doing is selling the information.
- 53:42Private companies are holding this
- 53:44information. We spent a lot of time on
- 53:46this when I got arrested for for being a
- 53:49forwardlooking and a and a and a good
- 53:52man and and took down that damn camera
- 53:55because uh the uh county has a rule that
- 53:58says you can't put them up. Uh you can't
- 54:00put him up. And yet the sheriff signed
- 54:02something that said that he could and
- 54:04then the prosecutor helped go after him.
- 54:07nonsense. And uh uh well, somebody needs
- 54:10to get that interpreted and do it do do
- 54:12it correctly. And somebody needs to file
- 54:14another suit like the one going on in
- 54:16Richmond, Virginia against Flock Cameras
- 54:19who now with u with gusto uh you know
- 54:23with with
- 54:27Sorry, excuse me.
- 54:31Maybe put on a song for you for a minute
- 54:33whilst I clear my throat. Oh,
- 54:37no song, just a sip of coffee. How about
- 54:40that? But anyway, the reason to to that
- 54:44the overturning of Chevron is so
- 54:47important and the reason that the um the
- 54:52cotification of that overturning to at a
- 54:55state level in Missouri is so important.
- 55:00still not out of the woods is that uh
- 55:04now courts have to determine you know
- 55:07what's the right activity in a case. The
- 55:11courts get to determine why uh a statute
- 55:15was written in this manner. They will
- 55:19look at the because one thing an ad a u
- 55:22ad administrative person a a a
- 55:24bureaucrat does not do has zero interest
- 55:28in
- 55:30is why they don't care that to them
- 55:33everything is black and white you know
- 55:35the true or or everything is according
- 55:38to what they think is right doesn't
- 55:40matter what the rules say this is how I
- 55:42run my ship this is what I do you know
- 55:45and uh so Now
- 55:49we see the path
- 55:52and the path allows us to go places for
- 55:55anybody and our start was I mean we wish
- 55:59to get into the cameras. We wish to get
- 56:01into things like HOAs and the overreach
- 56:04of HOAs that are approved by the
- 56:06government or uh sort of funding of
- 56:11housing by the you know the the the
- 56:13government. uh child care nonsense with
- 56:17money that is uh appropriated by the
- 56:21state. um
- 56:23name it anything administrative and and
- 56:26uh I'm I I'm interested in digging in
- 56:29and one of the greatest tools of that is
- 56:32sunshine law foya freedom of information
- 56:36act uh on the on the um federal side
- 56:42and those tools unfortunately are
- 56:45somewhat expensive. Um we have spent a
- 56:48great deal of money trying to get 36
- 56:52well what we've received so far is like
- 56:544,000 pages of uh of records from the
- 56:59alcohol and tobacco control which um you
- 57:04know we have reviewed we have gone
- 57:05through we have combed through pretty
- 57:08deeply uh using some proprietary tools
- 57:12that that we have for that purpose and
- 57:15we're we're developing our methods to uh
- 57:18gather information. And we're going
- 57:20through it and and it's it's it's paying
- 57:22off big time because what we're finding
- 57:26and and what we're seeing is their own
- 57:28words are hanging them. Uh you know, at
- 57:31least in our view, and we don't know
- 57:33what the judge is going to say, but we
- 57:35think the path is pretty clear for what
- 57:36he has to do. But ATC has created their
- 57:40own definitions that don't exist in the
- 57:43statute. They have taken on power that
- 57:46was never given to them in an enabling
- 57:48statute. I went through a little bit
- 57:50last week of section uh uh chapter 311
- 57:56of the revised statutes of Missouri and
- 57:58chapter 407 of the revised statute of
- 58:00Missouri which is gives the enabling
- 58:03language to alcohol and tobacco control.
- 58:06And so alcohol and tobacco control, the
- 58:08only the only power you can take as an
- 58:12administrator is the power that is given
- 58:16to you. Let me equate this to you like
- 58:18somebody's power of attorney. Okay. Um
- 58:23when I'm old and feeble,
- 58:26I it's possible that I need to have a
- 58:29power of attorney because simply for the
- 58:31fact that I can't get around as fast as
- 58:34I used to. Okay? And so I can say
- 58:37something to somebody like, "Listen, I'm
- 58:40going to give you this piece of paper
- 58:43that gives it's a grocery list. All I
- 58:45want you to do is go down to the grocery
- 58:47store. Here's my credit card. I want you
- 58:49to use my credit card to buy this thing.
- 58:51Here's a grocery store. I'm going to
- 58:53write a thing on the bottom that says, I
- 58:55give this person the authority to use my
- 58:57credit card, but only to buy these 10
- 58:59items. You can't put on candy bars for
- 59:01himself." And I sign the bottom.
- 59:04Arguably, that's an enforcable power of
- 59:06attorney. I've authorized someone to act
- 59:09on my behalf.
- 59:11So, when you authorize an agency to act
- 59:16on behalf of the king, you know, the
- 59:18governor is the king in this scenario.
- 59:21And when the the governor has to be
- 59:23given that power, first of all, any
- 59:25power he gets is derived from the
- 59:28legislature giving him the power and
- 59:32he's kept in check by the the judicial
- 59:35branch, right? But the power comes
- 59:38through the law, through the statutes,
- 59:40through the things that are written,
- 59:42right? And then he can go through and
- 59:44and uh he appoints it gets even worse
- 59:47because now he appoints the head of the
- 59:50department of public safety and the head
- 59:52of the department of public safety has
- 59:54all of the rules that he has to abide by
- 59:57for the highway patrol, for the water
- 59:59patrol, for whatever, name it. One of
- 1:00:02those other ones is the alcohol and
- 1:00:05tobacco control folks, right? So the
- 1:00:07department of public safety, ATC is
- 1:00:10underneath them. So now you've got a
- 1:00:12power of attorney.
- 1:00:14Well, an authorizing statute. Now, we're
- 1:00:17not going to call it a power of
- 1:00:18attorney, but it's basically what it is.
- 1:00:20It's an authorization to act. And that
- 1:00:23authorization to act and to enforce or
- 1:00:26to uh carry out the law is given to the
- 1:00:31governor to carry out the law. The
- 1:00:34legislature created it. The governor has
- 1:00:36to carry it out. He does that through
- 1:00:38the Department of Public Safety head and
- 1:00:41that guy appoints somebody to run
- 1:00:43alcohol tobacco control. That person has
- 1:00:47500 others. I don't know the number.
- 1:00:49That could be a BS number. God knows how
- 1:00:51many there are that that that work for
- 1:00:54her in this case. And each one of those
- 1:00:57things has a level of authority of
- 1:00:59interpretation and of things like that.
- 1:01:02Well, at the core of it though, the only
- 1:01:07authority because what's what's happened
- 1:01:10is the legislature created the alcohol
- 1:01:15and tobacco control back in the ' 40s. I
- 1:01:18think it was back during right after
- 1:01:20prohibition or maybe even during. So,
- 1:01:23it's been around for a long time and
- 1:01:25they created it and over the years
- 1:01:27they've narrowed it down, but they've
- 1:01:29never the only authority they ever gave
- 1:01:31them is to enforce things under
- 1:01:36alcohol and tobacco controls enabling
- 1:01:39language inside chapter 311 and 407.
- 1:01:43What that means is they can't, we call
- 1:01:46it bootstrapping. You can't bootstrap
- 1:01:49and steal power from somewhere else that
- 1:01:52you don't have. Or you can't suck in
- 1:01:57uh I don't know um law from somewhere
- 1:02:01else that you cannot enforce. And we
- 1:02:04allege that's what they've been doing.
- 1:02:07And so over the years, ATC has gotten,
- 1:02:10you know, pretty proud of themselves and
- 1:02:12they've created circulars to send around
- 1:02:15and tell people that, "Oh, gee, you
- 1:02:17better watch out Hooters, and you better
- 1:02:19not have girls running around with the
- 1:02:21bottom with their butt cheek." You know,
- 1:02:23they call it, you know, the butt cheek.
- 1:02:25And oh, you people at uh Twin Peaks, the
- 1:02:29one with the girls where they all got
- 1:02:30big boobs, you know, cleavage is okay,
- 1:02:33but you better make sure that the
- 1:02:35underboob, you know, that the underboob
- 1:02:38isn't hanging. You know, tube tops
- 1:02:40aren't going to be okay. We don't want
- 1:02:42to see any underboob.
- 1:02:45Well, who gave them that authority?
- 1:02:49Who said that? I mean, what does your
- 1:02:52alcohol license, what does alcohol or
- 1:02:56tobacco have to do with whether a girl
- 1:03:00because they happen to be serving
- 1:03:02alcohol and she's got big boobs or a big
- 1:03:06ass and she can't have the the the the
- 1:03:10under, you know, your under part of your
- 1:03:13butt or your or your uh under boob can't
- 1:03:18be visible. And certainly a nipple can't
- 1:03:20be visible. You know, that's nudity.
- 1:03:22It's not allowed. But usually nudity was
- 1:03:25more of a local thing. I don't know to
- 1:03:27be I haven't done any serious research
- 1:03:30on that. But I remember the free the
- 1:03:31nipple thing that was going on in um
- 1:03:34Colombia several years ago and uh I made
- 1:03:37sure to go to this place cuz the women
- 1:03:39were all wandered down street topless.
- 1:03:41And I was like, well, you know what? I'm
- 1:03:42for this. Suddenly I'm for it. No, I'm
- 1:03:46kidding. I I I honestly don't even think
- 1:03:48I went to that, but I remember hearing
- 1:03:50about it. But um it it uh that's humor
- 1:03:52from a Sam side, and sometimes my humor
- 1:03:55kicks me in the butt. But uh uh at any
- 1:03:57rate, the whole point of saying that is
- 1:04:01who in the world gives you alcohol
- 1:04:05licensing people the authority to go
- 1:04:09into Hooters and say, "Gee, don't hire
- 1:04:13girls with big boobs." you know, um
- 1:04:16because you know, or make sure that when
- 1:04:19you do, boy, they better have them
- 1:04:22propped up correctly and you know,
- 1:04:24nothing is hanging out below the top or
- 1:04:27if they happen to have a big butt in
- 1:04:28their uh uh butt cheek, you can see the
- 1:04:31bottom of the butt cheek. What the
- 1:04:33hell's a difference in the bottom of a
- 1:04:35butt cheek? Is everybody supposed to
- 1:04:36wear underalls? You know, you know,
- 1:04:38instead women don't do that. that you
- 1:04:41can go to any swim up bar in this place
- 1:04:44and the girls that are serving alcohol,
- 1:04:46the waitresses or the the the servers
- 1:04:49that are running around uh providing
- 1:04:51stuff uh are are wearing bikinis and the
- 1:04:54bikinis are bikinis. Women don't wear
- 1:04:58the ones that, you know, they don't wear
- 1:05:00shorts for for uh uh
- 1:05:04I don't know, bikini bottoms. They don't
- 1:05:05do it. They they it doesn't cover the
- 1:05:08the under cheek of the butt. It doesn't
- 1:05:11do it. And but but that is what you know
- 1:05:14there's a story going around and this is
- 1:05:16true. We can get an affidavit for this.
- 1:05:18This is this is disgusting to me. Okay.
- 1:05:21Now, personal grooming is definitely a
- 1:05:24personal matter. You know, how you
- 1:05:26choose to groom is a personal matter.
- 1:05:29And I remember being in the army years
- 1:05:32and years ago and I was on a three-man
- 1:05:34team on a on something called quick fix.
- 1:05:36And quickfix was something way back when
- 1:05:39when you could uh when it was hard to
- 1:05:42target where a radio signal was coming
- 1:05:45from. And so what you would do would be
- 1:05:47you would triangulate uh there would be
- 1:05:49three quick fix units and each one of us
- 1:05:52had a Tilki 17 alpha that would uh jam
- 1:05:56and a a collection module a 32 Victor
- 1:05:59that would uh uh collect radio signals.
- 1:06:02But these s and then later in a
- 1:06:04helicopter we did the same thing in
- 1:06:06helicopters. But in order to get it to
- 1:06:08work and today this is not the case. But
- 1:06:11uh uh way back then you had to have uh a
- 1:06:14mile apart on three different hills,
- 1:06:17three separate apparatus and I'd be in
- 1:06:19one of them and I'd have two more on on
- 1:06:22hills a mile on either side of me.
- 1:06:24Right? And when I pushed a button, I
- 1:06:26could triangulate a position and catch a
- 1:06:29radio signal from an enemy and pinpoint
- 1:06:32to within it had an arrow of
- 1:06:34probability, but to within so many feet
- 1:06:36of where that guy was standing. And I
- 1:06:39could call in artillery and go take out
- 1:06:41this guy. He's bombing the hell out of
- 1:06:43people. You know, that's triangulation.
- 1:06:47And uh so you could you could put that
- 1:06:49into place and have that. And the the uh
- 1:06:54the point of that
- 1:06:58for for this sort of thing is I came
- 1:07:01over a hill one day inspecting one of my
- 1:07:03teams and it was in the middle of the
- 1:07:05Mojave Desert. And so that part of the
- 1:07:07story was really not relevant at all.
- 1:07:09But I come over the hill. I had a girl
- 1:07:10on my team. And this is back when girls
- 1:07:13couldn't be in combat, but they could be
- 1:07:15in military intelligence. And so we were
- 1:07:17out in the field, uh, two guys and a
- 1:07:20girl. And this girl, uh, I come over the
- 1:07:22hill and she's laying out on a on a
- 1:07:26beach chair in the middle of the desert.
- 1:07:30And I'm going and she's sunning herself
- 1:07:32wearing a bikini and I'm like, you can't
- 1:07:34do that. And I was sent there by a guy
- 1:07:36named Figaro. He's like, "Sergeant Trap,
- 1:07:38you got to go over and check her." Oh,
- 1:07:40she's beautiful. I can't go see her. And
- 1:07:42she was not beautiful. But that's
- 1:07:44neither here nor there. When you went
- 1:07:46over and you saw this girl,
- 1:07:49it has to do with grooming. I'm telling
- 1:07:52you, this girl was wearing a bikini and
- 1:07:57everywhere she did not shave. She was a
- 1:08:00pubic hair heaven. You know, he it was
- 1:08:02everywhere. Some women are that way. And
- 1:08:05who are you to determine who gets to do
- 1:08:07it? Well, a story goes that here at the
- 1:08:10lake,
- 1:08:12one of the owners of a club here, an ATC
- 1:08:16guy was inspecting him on a day when
- 1:08:19there were a lot of people out. And
- 1:08:21there was a middle-aged woman eating and
- 1:08:24having a drink on the side of the pool,
- 1:08:27the swim up pool at the bar. And the
- 1:08:30woman
- 1:08:31was similar to the girl I just told you
- 1:08:33about her grooming. She wasn't one of
- 1:08:36those that shaves everything. And the
- 1:08:38ATC guy made the owner of the bar go
- 1:08:44over and tell this woman she had to
- 1:08:47either put on some shorts or leave the
- 1:08:52facility because there was pubic hair
- 1:08:56coming out the side of her
- 1:09:00um bikini.
- 1:09:04Now, let that sink in a minute. Okay, I
- 1:09:06I'm I'm I'm not for against I don't
- 1:09:08care. People's grooming is their own
- 1:09:10grooming. But who the hell made you in
- 1:09:14charge of determining what somebody gets
- 1:09:16to wear or not wear based on your arcane
- 1:09:21view of grooming for women or anything
- 1:09:24else for that matter. If you're going to
- 1:09:28target a facility because it allows
- 1:09:31middle-aged women to come and sit on the
- 1:09:34side of a pool unshaven.
- 1:09:38That is not what you were enabled to do
- 1:09:41by the legislature of the state of
- 1:09:43Missouri. That's the issue. Who in the
- 1:09:47world told you? And he and the
- 1:09:50justification is that is lewd. That's
- 1:09:53lewd to you. Who allowed you to come in
- 1:09:57and interpret that LWD is there? Where
- 1:09:59did the legislature write a definition
- 1:10:01for LWD that said if a woman is showing
- 1:10:04pubic hair and she's a middle-aged woman
- 1:10:07sitting on the side of the pool drinking
- 1:10:08a a drink, you can kick her out of a
- 1:10:11bar. That's nonsense. It's crap. And the
- 1:10:15legislature, if they're doing that, I
- 1:10:17would target that, too. But the
- 1:10:19legislature isn't doing that. This is
- 1:10:21some over the years, many years of
- 1:10:24interpretation.
- 1:10:26The ATC has created these
- 1:10:30rules that they created, they
- 1:10:33interpreted, they bootstrapped from
- 1:10:37other places and said you can't do it.
- 1:10:40You can't because all they can enforce
- 1:10:43all they can enforce is laws having to
- 1:10:47do with alcohol or tobacco. They weren't
- 1:10:52they're not the pubic hair police. What
- 1:10:55is this nonsense? This is ridiculous.
- 1:10:59And it is it is a terrible story. It's
- 1:11:02it's a shame that you have to report
- 1:11:04that the guy uh uh I won't I won't say
- 1:11:09who it is, but you know, if he ever
- 1:11:11wants to, you know, we'll let him come
- 1:11:12on and uh and chat about it. But but
- 1:11:15these are whether they're important
- 1:11:17issues to you or not, they're certainly
- 1:11:21important
- 1:11:25real issues about the overreach of
- 1:11:28government everywhere. Everybody knows
- 1:11:32that I believe I I detest
- 1:11:35government overreach. I detest
- 1:11:38government stretching
- 1:11:42their authority. And you know, the
- 1:11:45president can declare war. Well, but
- 1:11:48over the last 30 years, we've discovered
- 1:11:52that he doesn't have to do that. He can
- 1:11:54create war in many, many places and
- 1:11:57never declare it. That way you can
- 1:12:00always claim that the US hasn't lost
- 1:12:02when it's a war and we leave a place in
- 1:12:05ruins worse than we started with it. The
- 1:12:09goal should be that we leave a place
- 1:12:11better off than when we came in. That
- 1:12:14ain't going to happen in Venezuela.
- 1:12:17You know, the people that'll be better
- 1:12:19off will be the board of directors of uh
- 1:12:22you know, Chevron. Again, a new Chevron
- 1:12:24doctrine is
- 1:12:26we give you we give you Venezuela, you
- 1:12:29know, that's the new Chevron doctrine,
- 1:12:31right?
- 1:12:33Nonsense. And uh uh at any rate,
- 1:12:36government overreach is where I like to
- 1:12:40spend some time. And one of the ways to
- 1:12:42do that is through uh sending out of
- 1:12:47Sunshine Law requests.
- 1:12:50and we sent out a sunshine request
- 1:12:55and I want to share with you
- 1:13:01this comical response.
- 1:13:04Uh where is it?
- 1:13:09Let's see if I can bring this up without
- 1:13:13uh hurting myself too much.
- 1:13:17Um
- 1:13:19cuz it is downright
- 1:13:22comical what they uh responded here and
- 1:13:27and and this I target. This I do not
- 1:13:30like. This is foolish. Um
- 1:13:36did I and and I may have uh have uh
- 1:13:41shared some of it with you.
- 1:13:45Um, where is it? But I don't think I
- 1:13:49shared all of it with you.
- 1:13:52And I need that letter. And I think I'm
- 1:13:56going to have to search for it in my
- 1:13:57drive here. It'll take me just a second
- 1:13:59to get there. And uh,
- 1:14:03but it's I find it to be entertaining.
- 1:14:08You may not, but I like it. and it is
- 1:14:12the response to a request for
- 1:14:15information from alcohol and tobacco
- 1:14:18control.
- 1:14:20And we had asked for a number of
- 1:14:26uh documents, certain topic areas,
- 1:14:30and what we got in return,
- 1:14:35where is it? Come on, give us the long
- 1:14:38one. So, they sent us two on the same
- 1:14:40day, and I keep opening the the first
- 1:14:43one, and I can't find the second one.
- 1:14:47And uh where in the world is it? Hello.
- 1:14:52How is the family?
- 1:14:55Um,
- 1:14:58come on, come on, come on, come on.
- 1:15:03Let's see here.
- 1:15:06I think I have found it. Here
- 1:15:10we go.
- 1:15:12This is a long letter, okay? And so I'm
- 1:15:15not going to share all of it with you,
- 1:15:17but uh basically we had requested a
- 1:15:22number of documents and
- 1:15:25the request was uh responded to as
- 1:15:31follows.
- 1:15:34We received your December 4th and
- 1:15:36December 9th letters which include
- 1:15:38additional requests.
- 1:15:42Since August, we have in good faith made
- 1:15:45every reasonable effort, and I'm
- 1:15:47paraphrasing. I'm not reading all this
- 1:15:49to you, to fulfill your request in an
- 1:15:52organized manner.
- 1:15:55To date, more than 3600 pages of records
- 1:15:58have been provided.
- 1:16:00Our communications with you have in cons
- 1:16:03consistently included clear estimations
- 1:16:06of dates on when the records would be
- 1:16:08made available for inspection. Detailed
- 1:16:12explanations when appropriate for why
- 1:16:14access was delayed. specific statements
- 1:16:17of the provision of law under which we
- 1:16:20closed our records when applicable and
- 1:16:23clarifications regarding which of your
- 1:16:26expanded requests the documents produced
- 1:16:29pertain to. We believe our team's
- 1:16:33extraordinary efforts to fulfill your
- 1:16:35request demonstrate our respect for
- 1:16:38Missouri's policy favoring open conduct
- 1:16:41of business.
- 1:16:44Despite our good faith efforts, and
- 1:16:46remember, I'm paraphrasing because this
- 1:16:48is a long letter, but I'm not adding
- 1:16:50anything. It is plain from the
- 1:16:52increasingly hostile and argumentative
- 1:16:56tone of your communication
- 1:16:58and the overly broad unduly burdensome
- 1:17:02that's a legal term nature of your
- 1:17:05repeated demands particularly those made
- 1:17:08in October 3rd 7 10 November 10 December
- 1:17:114 and December 9 that your invocation of
- 1:17:15Missouri sunshine law is intended not as
- 1:17:18a tool to examine in public meetings and
- 1:17:22records, but as a weapon to harass the
- 1:17:25division, burden the government, and
- 1:17:28strain agency staff. It seems to the
- 1:17:33division
- 1:17:35that due to the obvious connection
- 1:17:37between the record and the nature of
- 1:17:39your pending legal action, these
- 1:17:41requests are in retaliation for
- 1:17:43administrative actions taken against
- 1:17:46your liquor license and a means to
- 1:17:50conduct improper discovery.
- 1:17:53Okay.
- 1:17:58The estimates below provi provi provided
- 1:18:02below are calculated assuming at this
- 1:18:05time that the requests are completed
- 1:18:07using currently available agency
- 1:18:10resources. Historically the division has
- 1:18:13not received sunshine requests in
- 1:18:15quantities or volume necessary to
- 1:18:18consider the assignment of additional
- 1:18:20employees or resources. Therefore, as
- 1:18:23currently staffed, ATC's capacity to
- 1:18:27process requests of the size you
- 1:18:29submitted will unresolve in a very or
- 1:18:32will unfortunately result in a very
- 1:18:34lengthy fulfillment time.
- 1:18:38When upon receipt of payment, ATC
- 1:18:42commences with processing the requests
- 1:18:45outlined below, the agency will explore
- 1:18:49avenues through which it might reduce
- 1:18:52the time and expense estimated to
- 1:18:54fulfill the request. Such possible
- 1:18:57solutions might include, but aren't
- 1:18:59limited to, outsourcing review to a
- 1:19:02private firm. Well, if you're going to
- 1:19:04do that, why don't you just let me in
- 1:19:06there? I'm a private firm. I'll go have
- 1:19:09a look at all of your records and decide
- 1:19:11what it is. If you're going to hire
- 1:19:12somebody outside anyway, why wouldn't
- 1:19:14you just let me do it? Anyway,
- 1:19:17continuing. Employing additional
- 1:19:19temporary or part-time personnel for
- 1:19:21document review or hiring a full-time
- 1:19:23employee dedicated permanently to
- 1:19:26matters related to Sunshine Law. We
- 1:19:29caution, however, that requests of this
- 1:19:32nature must be formally submitted and
- 1:19:34approved as budget items. So now, me
- 1:19:38requesting a sunshine item or anyone, we
- 1:19:41cannot guarantee either their approval
- 1:19:43or timeline within which they would be
- 1:19:45considered if submitted. Thus, the time
- 1:19:47required to fulfill your request stated
- 1:19:49below should be assumed
- 1:19:52should not be assumed to change unless
- 1:19:54indicated otherwise by authorized agency
- 1:19:58personnel.
- 1:20:00Any expenses approved will be build to
- 1:20:02you as allowed prior to completion. So
- 1:20:06the remaining records
- 1:20:09encompassed by the letters the previous
- 1:20:12letters we have processed all portions
- 1:20:15of these records sought.
- 1:20:18Okay. Communications we we asked where
- 1:20:22they get the authority to uh uh patrons
- 1:20:26are served alcohol by uh servers wearing
- 1:20:28bikinis or attire that is deemed to be
- 1:20:32lewd. Right? We want communication,
- 1:20:35email, text message enforcement,
- 1:20:37discussion or actions regarding bars,
- 1:20:39restaurants or other establishments
- 1:20:41licensed to sell alcohol where servers
- 1:20:43are wearing clothing deemed lewd by ATC.
- 1:20:48So the request is go out and tell us
- 1:20:54every instance where you have targeted
- 1:20:56somebody's license because of lewd
- 1:21:02clothing by a woman. Okay,
- 1:21:05this is what they with respect to these
- 1:21:08records.
- 1:21:09We indicated in December 7 uh November 7
- 1:21:13correspondence that the division doesn't
- 1:21:15categorize lences in this manner, but
- 1:21:19they have a piece of paper that judges
- 1:21:22people according to it. One of the check
- 1:21:24marks on the inspection sheet is
- 1:21:28lwdness.
- 1:21:30They check every less lency for whether
- 1:21:33or not they are lewdw. You can't go
- 1:21:36through and tell me how many people
- 1:21:38you've punished or questioned or or or
- 1:21:42fined for being lewd.
- 1:21:46Apparently they can because listen to
- 1:21:48what they say after this this list and
- 1:21:52they they gave all of these things,
- 1:21:54right? Keyword searches.
- 1:21:57LWD
- 1:21:59the list resulted in the retrieval of
- 1:22:01691,463
- 1:22:05email files alone.
- 1:22:08We conservatively estimate estimate the
- 1:22:12cost associated with fulfillment of this
- 1:22:14portion of these records will total
- 1:22:19$368,0007
- 1:22:22$368,783.77.
- 1:22:28And the earliest these records will be a
- 1:22:31be available for for you for your review
- 1:22:35is 44 years 3 months and 26 days from
- 1:22:42the receipt of payment.
- 1:22:4544.32
- 1:22:47years. Should fulfillment of this
- 1:22:50request result in fees lower than those
- 1:22:54estimated here, the difference will be
- 1:22:57credited to you. And they want to uh the
- 1:23:00the party requesting to pay this amount
- 1:23:04upfront, right?
- 1:23:10Yeah. Okay. No. No. Hey, this is going
- 1:23:13to cost a lot of money. No. Hey, we got
- 1:23:15personnel problems. No, you know that.
- 1:23:17No, they nothing in the sunshine law
- 1:23:20says that you know you get to do this
- 1:23:22when when the this is one of your duties
- 1:23:24and responsibilities by the way. This is
- 1:23:27one of the things you are required to do
- 1:23:30under sunshine law.
- 1:23:33And
- 1:23:35somebody would, you know, you would
- 1:23:36normally somebody would send not this
- 1:23:39accusatory letter, but something to say,
- 1:23:41hey, you know,
- 1:23:44maybe we could tailor that a little bit.
- 1:23:47Maybe we could
- 1:23:49come up with something like that. Um, we
- 1:23:53also asked for another another document.
- 1:23:56Uh there was another request in a
- 1:23:59December 9th letter requesting any
- 1:24:01documents including incident reports,
- 1:24:04investigative reports, forms, memoranda,
- 1:24:07emails in which any of the following
- 1:24:10phrases appear in the heading, title,
- 1:24:14body, footer where they define
- 1:24:17themselves because what they have done
- 1:24:18is they have taken the authority not
- 1:24:21given to them and called themselves the
- 1:24:24alcohol and tobacco control police
- 1:24:26department and we have several examples
- 1:24:29of this or the ATC police department or
- 1:24:33the alcohol tobacco control police
- 1:24:35department. We explained in an email
- 1:24:38dated October 10 that the division does
- 1:24:41not identify itself as division of
- 1:24:43alcohol tobacco control police
- 1:24:45department. They actually do. To
- 1:24:48clarify, this phrase appears only at the
- 1:24:51top of specific printed investigative
- 1:24:53reports entered into the computer
- 1:24:56assisted report entry database, the care
- 1:24:58database. The header of these port
- 1:25:01reports is autogenerated by the database
- 1:25:05which was built by the St. Louis County
- 1:25:07Police Department and is used by
- 1:25:09multiple government agencies and appears
- 1:25:12only when reports are generated
- 1:25:14generated from the database in current
- 1:25:16printable format. Several report formats
- 1:25:19accurately populate the header using the
- 1:25:22correct identifier division of alcohol
- 1:25:25tobacco control. It is a bug in the
- 1:25:28system that resulted in the alternative
- 1:25:30header for some entities and accounts
- 1:25:33for ATC's oversight of this discrepancy.
- 1:25:38In the previous 5 years, 8,428
- 1:25:42approximately reports have been entered
- 1:25:44by ATC agents. We conservatively
- 1:25:47estimate that the fee for producing
- 1:25:49every care report bearing the phrase
- 1:25:52alcohol and tobacco control police
- 1:25:54department in the associated emails in
- 1:25:57the last 5 years will be
- 1:26:01$34,000
- 1:26:03$34,83945.
- 1:26:09The earliest we estimate these records
- 1:26:11will be available to review is 4 years,
- 1:26:142 months, and 2 days from the receipt of
- 1:26:17payment.
- 1:26:19Yeah,
- 1:26:20seems odd, doesn't it? So, who is being
- 1:26:23rude to whom is the question.
- 1:26:28Who is using fees as a deterrent or
- 1:26:32responses to sunshine requests as a
- 1:26:36deterrent?
- 1:26:38And you can't just go out and maybe you
- 1:26:40should only search for the word alcohol
- 1:26:42tobacco control police department. And
- 1:26:44why deny it if you know damn well it's
- 1:26:47on your reports and has been. They knew
- 1:26:50about this and they were coming up with
- 1:26:52a reason why. This is bureaucracy.
- 1:26:55Friends and neighbors. You create you
- 1:26:58create
- 1:26:59defenses to yourselves later. And one of
- 1:27:02the defenses is to scare people off with
- 1:27:05large amounts of money. But you can run
- 1:27:08in a in a shoddy fashion and take power
- 1:27:11that doesn't belong to you and nobody
- 1:27:13can question you because you're not
- 1:27:15permitted. You're just a riff raff out
- 1:27:18there.
