- 8:36three point thirty a m at the home of Josh

- 9:51Morgan County Sheriff's office in the Kentucky State Police. Our
- 9:57next article is Pardon Me. County attorney confronts fiscal courts
- 10:04after magistrate's pay rais motion to approve twenty twenty seven
- 10:08compensation rates for magistrates County Attorney Corner Jailer carries in
- 10:16three to two vote at April thirtieth meeting by Miranda
- 10:20in Cantrill. A confrontation erupted among county officials following a
- 10:26vote to significantly increase the salaries of magistrates during a
- 10:31special April thirtieth meeting of the Morgan County Fiscal Court.
- 10:36For the background information. County Attorney Miles Holbrook had initially
- 10:41requested a salary increase during the court's regular January twenty
- 10:45second meeting, during which he noted he is currently paid
- 10:49a little over fifteen thousand dollars for his services to
- 10:53the county. Additionally, Attorney Holbrook noted on January twenty second
- 10:58that the county attorney's salary for three terms of those
- 11:03of his predecessors, Joline Frederick Steve O'Connor, had remained at
- 11:08the same at approximately fifteen thousand per year. Attorney Holbrook
- 11:13also indicated that This amount could have possibly dated back
- 11:17to the O'Connor predecessor Eddie Keaton, whose salary he was
- 11:22unable to verify. I currently make fifteen thousand, four hundred dollars,
- 11:27Holbrook said at the time, so I think it's time
- 11:31to kind of modernize what we paid the county attorney's position.
- 11:35I do spend approximately six sixty percent of my time
- 11:41as an attorney, so I think it's fair for me
- 11:44to ask for fifty thousand dollars a year plus consumer
- 11:49pricing index each year. Court members took no action on
- 11:54Attorney Holbrook's requests during the January twenty second gathering, nor
- 12:00at their April twenty third meeting, when he again broached
- 12:04the subject. Attorney Holbrook on April twenty third reiterated his
- 12:09case to the court and presented documents showing salary rate
- 12:12changes for county employees during his eleven tenure. Eleven year
- 12:17tenure as county attorney, He'll notice that every position makes double,
- 12:22in some cases triple, almost what they made back then,
- 12:27Holbrook said on April twenty third. He'll notice that Miles
- 12:30Holbrook has stayed the very exact same the whole time.
- 12:34Multiple Court members described the budget for the upcoming fiscal
- 12:38year as tight during the January twenty second meeting, but
- 12:42all concurred that they would take Attorney Holdbrook's request into
- 12:46consideration during the budgeting process. Judge Executive Jim Gayzey asked
- 12:52magistrates during the April twenty third meeting if they wish
- 12:55to further discuss Attorney Holbrook's request, though there there or
- 13:00no additional comments from the court, members agreed to hold
- 13:04a meeting with County Treasurer Sheena Easterling on April twenty
- 13:09ninth to discuss budgetary issues. Judge Gaizy announced before German
- 13:15that the budgetary meeting would precede a special April thirtieth
- 13:20Fiscal Court meeting, which he said would largely pertain to
- 13:24financial matters events of the special April thirtieth Fiscal Court meeting.
- 13:31During the April thirtieth meeting, Judge Gaisy announced an agenda
- 13:34item listed it as twenty twenty seven compensation. Treasurer Easterling
- 13:41told the Court that as per Kentucky Revised Statute sixty
- 13:45four thousand, five hundred and thirty, the Fiscal Court is
- 13:49required to fix compensation for eligible elected officials no later
- 13:55than the first Monday in May of the year in
- 13:59which they are elected. Those annual compensation rates included the
- 14:04following county corner eighteen thousand dollars, County magistricts eighteen thousand
- 14:11dollars for each of the five county attorney twenty five
- 14:16thousand dollars, County jailer forty five thousand dollars. On a
- 14:22motion made by magistript Eric Palfrey and secondtate by Magistrate
- 14:27Tyler Keaton, the Court approved the above listed rates in
- 14:31a three to two vote Yes Tommy Fannon, Tyler Keaton,
- 14:36and Eric Palfrey, No Brandon Evans and Leroard Phipps. Following
- 14:41the vote, Attorney Holbrook stated that he wished to ask
- 14:45a question of the court. Attorney Holbrook read the compensation
- 14:49rates allowed as they were not aired prior to the vote,
- 14:52including the magistriates listing of eighteen thousand dollars. Does that
- 14:58mean all magistrates are each getting three thousand, six hundred
- 15:03dollars more or are they going to eighteen thousand per year?
- 15:09Holbrook asked, and the treasure Easternly responded that the amount
- 15:14was an annual rate, so they are going from seven thousand,
- 15:19two hundred dollars a year minus their training initiative pay,
- 15:24which is another four thousand dollars. Holbrook asked, They're going
- 15:29to eighteen thousand dollars a year, all five of them. So,
- 15:33the people who said the budget was tight when I
- 15:37asked for a raise in January and I asked them
- 15:39again last month, you didn't really mean the budget was tight.
- 15:44You meant that you wanted to stick your hands in
- 15:46the money part. I just want to say that I
- 15:49am appreciative of my raise, but I don't know how
- 15:51to feel about getting half of what I asked for
- 15:55when in the meeting multiple magistrates said what I asked for?
- 15:59What us fair? You all knew you were going to
- 16:02ask for a raise. You said, we can't give Miles
- 16:06a raise. We need to do that sixty thousand dollars
- 16:09for us, and you need to do it. On the
- 16:12last day, during a special meeting where you didn't even
- 16:14ask for raises, Magistrip Palfrey told Attorney Holbrook that he
- 16:21had received a sixty percent raise, and a disagreement ensued
- 16:26regarding the exact percentage. Attorney Holbrook later acknowledged in a
- 16:31May first Facebook post that Magistrip Palfrey's calculation was correct. However,
- 16:37why did you tell me you didn't have the money
- 16:39when you had it? Attorney Holbrook then asked Magiristrip Palfrey,
- 16:44who stated that the Attorney Holbrook had initially requested thirty
- 16:49five thousand dollars raise. Instead, you gave yourself fifty five
- 16:55thousand dollars after you told me you didn't have the money,
- 17:00Oldbrook replied, before pointing to Magistrate Brandon Evans. He sat
- 17:05there and told me he didn't have the money, and
- 17:08he told me you didn't have the money, and you
- 17:11knew the whole time that you were going to give
- 17:14yourselves huge raises. Mandistrip Palfrey disputed Attorney Holbrook's statement before
- 17:21indicating that the court members had reviewed the prem preliminary
- 17:26budget for the twenty twenty six twenty seven fiscal year twice.
- 17:32What does that mean, Holebrook cast, I always thought these
- 17:36meetings were supposed to be in front of the people.
- 17:39I always thought the Freedom of Information and Open Meetings
- 17:42I Act said that when you all talk about the
- 17:46business of the county, it should be in front of
- 17:49the county. So you're holding separate like secret meetings. Did
- 17:53you ask for a raise at any of these meetings?
- 17:57Have you ever asked for a raise? Magistrate Pelfrey stated
- 18:02that he had not before. Attorney Holbrook asked Magistrate Brandon
- 18:06Evans if he had ever asked for a raise. I
- 18:10never asked for a raise, Evan said, I didn't vote
- 18:13for this. Attorney Holbrook stated again, Magistrate Palfrey had agreed
- 18:19that his initial request of fifty thousand dollars was fair.
- 18:24Yet it's a yes or no, Holbrook said, Are you
- 18:27telling me you were wrong? Magristrip Palfrey responded, I was wrong.
- 18:33Do you want me to dig deep into this? Yes?
- 18:37I do. Attorney Holbrook counter, I want you to explain
- 18:41to the county why you basically gave every magistrate the
- 18:44same raise as a guy who works thirty days a month,
- 18:48and you show up and have a meeting. We show
- 18:51up and have a meeting. Palfrey asked, in regards to magistrates,
- 18:55you say that all we do all months, that's all
- 19:00we do, Almah. Do you want me to go into
- 19:03deep about everything the county pays for your office? Do
- 19:06you want to talk about how much the state pays you?
- 19:09Attorney Holbrook acknowledged that the county pays his secretary's salaries
- 19:14and a third of the utility bills for his office building,
- 19:17but expressed umbraage about Magistrip Palfrey's comment regarding state compensation.
- 19:24Are you going to talk about how much Lion pays you,
- 19:29Holbrook said, in reference to Palfrey's primary job. How much
- 19:33does Lion pay you? What does that have to do
- 19:36with anything? Eric said, I paid fifteen thousand, four hundred
- 19:41dollars to represent this county. You don't have anything to
- 19:44do with my prosecutal duties. I don't ask you about
- 19:50what made you with lyone, what you make with Lyon
- 19:54Mandristrip Palfrey reiterated that the Attorney Holbrook have received a
- 20:00nine thousand, six hundred dollar raise, prompting Attorney Holbrook to
- 20:04note that magistrates, in addition to their salaries, receive a
- 20:09four thousand, five hundred dollars in training incentif pay, which
- 20:14Treasurer Eastern League said totaled approximately five thousand, two hundred
- 20:20dollars annually. Following an inquiry from the attorney, I was
- 20:26wrong five thousand, two hundred dollars, Holbrook said, that's twenty
- 20:31three thousand, two hundred dollars that you want for two
- 20:35hours worth of work a month. That's ridiculous. To not
- 20:40even ask the public forays to do it on the
- 20:43final day that you do, and do it at six
- 20:47thirty pm, six hours before it can't change is ridiculous.
- 20:52You're greeting you all, Magistrate Palfrey asked, eliciting further Claire
- 21:00occasion from Attorney Holbrook. Well, not all of you, Holbrook said,
- 21:04as he pointed to a magistrate Tyler Keaton. Not you.
- 21:07You're not greedy. I think of you as a good person.
- 21:11Everything you've told me has turned out to be the truth.
- 21:14Lee Roy Phipps. When you talk to me, you tell
- 21:17me the truth. Jim Gazey, when you talk to me,
- 21:20you tell me the truth. And I'm going to leave
- 21:22it at that. So you coming in here and asking
- 21:26for a thirty five thousand dollars pay raise is not greedy,
- 21:30Magistrate at Palfrey asked Attorney Holbrook, who reoriterated that he
- 21:37had reviewed pay rates of other county attorneys before again
- 21:41asking the magistrates if he had not agreed fifty thousand
- 21:45dollars was a fair amount. Madristrip Palfrey told Attorney Holbrook
- 21:51that his raise was based on funding that the County
- 21:55Attorney's office currently receives from the Fiscal Court. As Attorney
- 21:59whole Brook outline the services his office provised to the county,
- 22:05the fact that you looked at me and told me
- 22:07the budget was tight and that you couldn't hardly do
- 22:11anything the whole time you you were going to grab
- 22:16a whole bunch of money and a head for the hills.
- 22:19It's ridiculous, Holbrook said. You should be ashamed of yourself.
- 22:24Magistrip Palfrey further elaborated on the magistrate's pay increase. We
- 22:28are still lower, way lower than magoffin County, Pelfrey said,
- 22:33stating that he had researched the matter. We've based it
- 22:36on everything. Morgan County magistrates have received a rage since
- 22:41the nineteen eighties, haven't received a race since the nineteen eighties.
- 22:46I think you based it on your pocketbook, Attorney Holbrook retorted.
- 22:51Magistrate Tommy Fannon responded to Attorney Holbrook, statement, I think
- 22:55you're wrong. Fannin said, we've studied that budget for a
- 22:59line long time. Madristrip Halfrey further addressed Attorney Holbrook. If
- 23:05we gave you the fifty thousand dollars you asked for,
- 23:08you would have blown up tonight. Pelfrey inquired, probably because
- 23:12I was lied to. Attorney Holbrook reresponded, You told me
- 23:17we had a budget problem. You told me there was
- 23:20no money for raises for anyone, and the whole time
- 23:23you were wanting it. No, I did not say that, Magristrip.
- 23:28Palfrey counter, I did not say that, and you know it,
- 23:33and you know I didn't say that. The only time
- 23:37that I have talked is the night you called me
- 23:40and through text message, and I have those text messages,
- 23:44and you told me, do not put you below thirty
- 23:48five thousand dollars. Attorney Holbrook further commented on current compensation
- 23:54for magistrates and stated that their pay would increase from
- 23:58seven two hundred dollars to eighteen thousand dollars annually. It's
- 24:04more than seven thousand, two hundred dollars. Mandristrip. Helfree clarified,
- 24:10it is an eight thousand, three hundred and forty dollars.
- 24:14If you want to be exact, The magistrip's raise is
- 24:17the same raise you got. That's what you're not getting.
- 24:21It's nine thousand and six hundred. Attorney Hoboro continued to
- 24:25cite percentages of both increases. You more than doubled your pay.
- 24:31Attorney Hobrook said, how can you sit there and explain
- 24:35that to your voters. I thought you were going to
- 24:38use my raise to get something for your salves, but
- 24:41to give me half of what I asked for and
- 24:44to just grab money for yourselves is outrageous. That's all
- 24:48I have to say. Magistrip Healfrey maintained that it was
- 24:53the same amount, nine thousand, six hundred dollars. It doesn't
- 24:58It don't matter how you look at it. We looked
- 25:01at all surrounding counties. Morgan County magistrates haven't had a
- 25:05raise since the nineteen eighties. I'm done with this, Attorney
- 25:10Holbrook declare good, Magistrip Palfrey said, as the discussion concluded
- 25:16with no additional comments from the court. Other compensation information,
- 25:22as documented in the preceding report, Magistrip Palfrey during the
- 25:26April thirtieth meeting, referenced compensation that Attorney Holbrook receives from
- 25:33the state government. According to the state government website Transparency
- 25:39Ky of Attorney Holbrook's state compensation totals ninety four thousand,
- 25:45two hundred and seventy seven dollars and four cents. Attorney
- 25:49Holbrook clarify the nature of this compensation during the May
- 25:53first interview with the Courier. What people don't understand is
- 25:58this has absolutely nothing to do with county business, representing
- 26:03the county, or what the county pays me. Holbrook says,
- 26:07it's a separate job that I do for a separate
- 26:10government entity, the State of Kentucky, and they pay me separately.
- 26:16This is for prosecuting state crimes. I'm paid by the
- 26:20state to do that. This concludes excerpts from the recent
- 26:24editions of The Licking Valley Courier. Your reader has been
- 26:27janics On behalf of everyone here at RADIOI thank you
- 26:31for listening, keep on listening, and I hope you have
- 26:33a very good day. Fiscal Court budget of appropriations for
- 26:39the County's Attorney's office include the following. County Attorneys Secretary

- 27:24the Fiscal Court pays one third of the utility calls
- 27:27for the County's Attorney's office. The other two thirds are
- 27:31paid by his law practice, Wholebrook Bass and the Kentucky

- 27:41on May fourth that Attorney Holbrook and his secretary receive

- 27:51compensation for magistrates includes the annual training incentive pay cited
