- 0:00Speaker 1: Always a step ahead of the news.
- 0:02Speaker 2: Here's more marked imone on seven to ten. WOI, Well,
- 0:07Speaker 2: let's turn down to the greatest legal analyst of all,
- 0:10Speaker 2: Greg Jarrett. You can read his latest column foxnews dot Com.
- 0:14Speaker 2: Also Greg Jarrett's books highly recommended Trial of the Century
- 0:18Speaker 2: and the Riveting Legal Trial Book You'll Ever Read. And
- 0:22Speaker 2: his latest book, The Constitution and Other Patriotic Documents, very
- 0:26Speaker 2: important book you should have in your library. Highly recommended,
- 0:30Speaker 2: Greg Jarrett.
- 0:31Speaker 1: How you doing, Mark, I'm fine, Thanks for having me on.
- 0:34Speaker 2: No, let's get to this Maduro stuff. It's violates international law,
- 0:40Speaker 2: it's illegal, it's against the Constitution. Is it any of
- 0:43Speaker 2: those things?
- 0:44Speaker 1: No, it's none of those things. And the people who
- 0:47Speaker 1: were saying it are either profoundly stupid or they know
- 0:50Speaker 1: it and they're lying. You know, every president since World
- 0:55Speaker 1: War Two has ordered military action without congression consent because
- 1:01Speaker 1: short of declaring war, presidents don't need prior approval from Congress.
- 1:07Speaker 1: It's written in the Constitution, Article two, Section two grants
- 1:12Speaker 1: presidents who's commander in chief inherent power to direct military
- 1:17Speaker 1: strikes unilaterally. And you know, I hear some people violated
- 1:22Speaker 1: the War Powers Act. Well, read the War Powers Act.
- 1:26Speaker 1: It's not a prohibition. It is a reporting requirement, you know,
- 1:31Speaker 1: notify Congress within forty eight hours of taking military action,
- 1:36Speaker 1: and the resolution itself admits that the president has that right.
- 1:42Speaker 1: The president also, as I point out in my most
- 1:45Speaker 1: recent column, has another authority. It's called the take Care Clause.
- 1:49Speaker 1: It's in the Constitution, Section two, section three, actually the Constitution.
- 1:58Speaker 1: Under that document, the president is duty bound to faithfully
- 2:02Speaker 1: execute all laws. And so what does that mean. Well,
- 2:06Speaker 1: effatuating the arrest of a wanted fugitive is enforcing all laws,
- 2:12Speaker 1: capturing that person, bringing him to court to face justice,
- 2:16Speaker 1: seeking a prosecution, and punishment upon conviction. All of those
- 2:20Speaker 1: things the president is obligated to do. And look, if
- 2:26Speaker 1: Joe Biden had done it, these same Trump critics would
- 2:30Speaker 1: be cheering instead of denouncing President Trump. They only condemned
- 2:36Speaker 1: Trump because it's Trump, and that's all they stand for, really,
- 2:41Speaker 1: is just opposing everything he does. If the guy cured cancer,
- 2:45Speaker 1: they depose it for some invented reason.
- 2:48Speaker 2: Now he's in federal court, federal charges, federal custody. If
- 2:53Speaker 2: it were local, if it were Alvin Bragg with local charges,
- 2:56Speaker 2: he would be out already right with the no cash,
- 2:58Speaker 2: no base.
- 3:00Speaker 1: What look take a look at the subsdiing indictment. It
- 3:07Speaker 1: is one scary document. If you're the defendant, they have
- 3:11Speaker 1: the goods on him. The document trail alone that they've
- 3:16Speaker 1: accumulated is enough to convict. And then you've got cooperating witnesses,
- 3:22Speaker 1: some of whom have already pled guilty as Maduro's co
- 3:27Speaker 1: conspirators in US courts, and you have highly incriminating tape recordings.
- 3:34Speaker 1: You put all of that together and it spells conviction.
- 3:38Speaker 1: And you know, you have to understand the Department of
- 3:40Speaker 1: Justice spent the better part of a decade meticulously gathering
- 3:45Speaker 1: the evidence against Maduro and his wife and all of
- 3:48Speaker 1: his cronies. They looted the Venezuelan government. They did a
- 3:53Speaker 1: lot of it through drug trafficking, murders, torture of women
- 3:57Speaker 1: and children, a whole host of crimes that falls under
- 4:01Speaker 1: the category of narco terrorism. So, you know, I'm always
- 4:06Speaker 1: reluctant to say it's a slam dunk case, But you know,
- 4:10Speaker 1: if I were you Maduro's defense attorney, I'd say, what
- 4:14Speaker 1: do you got to help the United States so that
- 4:18Speaker 1: we can play Let's make a deal.
- 4:20Speaker 2: Huh. So he does have attorneys now that are working
- 4:23Speaker 2: on this. Is that their only hope make a deal.
- 4:25Speaker 2: There's no actual defense.
- 4:27Speaker 1: Look, I mean they're they're going to pull the usual
- 4:31Speaker 1: stuff that norie get pulled. Is you know, he has
- 4:37Speaker 1: a very good lawyer, Barry Pollock, and you know he'll
- 4:42Speaker 1: do what Noriega's lawyers to challenge the capture and arrest
- 4:46Speaker 1: and the status of Maduro, claiming a violation of due process. Oh,
- 4:52Speaker 1: it's a violation of international law, whatever that means. And
- 4:57Speaker 1: you know they'll argue the US has not jery stiction
- 5:00Speaker 1: to prosecute him, the assert you know, head of state
- 5:03Speaker 1: immunity can't do it. Well, norie tried to pull that
- 5:08Speaker 1: nonsense and it didn't work. It failed miserably. He was convicted,
- 5:12Speaker 1: mostly because the Supreme Court has said, we don't care
- 5:16Speaker 1: who you are or how you got here into this courtroom.
- 5:20Speaker 1: You know, we treat paupers and potentates alike.
- 5:26Speaker 2: Well, that's not good for him. Hey, if you watch
- 5:29Speaker 2: fake news, all you keep here it's a violation of
- 5:31Speaker 2: international law, international law. Where exactly does this international law
- 5:34Speaker 2: come from.
- 5:36Speaker 1: Well, it's pretty much imaginary. One of the things they
- 5:40Speaker 1: point to. As you know I noted in my column,
- 5:46Speaker 1: is that, well, there is this United Nations Charter, Section two.
- 5:53Speaker 1: Parenthesis for that says, oh, you can't violate another country's verganty.
- 6:02Speaker 1: But read on and you see there are exceptions to it.
- 6:05Speaker 1: One of them's you know, active defense on behalf of
- 6:10Speaker 1: another nation. And you know here, when you know you're
- 6:14Speaker 1: flooding metric tons of cocaine in the United States, poisonous drugs,
- 6:21Speaker 1: you know, the US has a right to defend itself.
- 6:23Speaker 1: And you know, this guy Maduro was the head of
- 6:27Speaker 1: a narco terrorism cartel that was doing all of this.
- 6:31Speaker 1: So you know, look, as I said on the air
- 6:35Speaker 1: over the weekend, the United Nations is a feckless organization
- 6:40Speaker 1: and the UN Charter has only one valid use to
- 6:45Speaker 1: line the bottom of a bird cage.
- 6:47Speaker 2: Yeah, the UN is that organization over there on First
- 6:50Speaker 2: Avenue and forty fifth. They have no actual authority over.
- 6:53Speaker 1: Anything, do they No, they have no enforcement authority. No
- 6:57Speaker 1: serious person ever pays attention thing they do. And besides,
- 7:02Speaker 1: the United States has veto power in the UN Security Council,
- 7:09Speaker 1: and so you know, whatever they tried to do would
- 7:11Speaker 1: get vetoed. You know, I've never quite understood how the
- 7:15Speaker 1: UN has lasted as long as it has. You know,
- 7:19Speaker 1: maybe the intention was good, as it was with the
- 7:23Speaker 1: League of Nations that never got off the ground, but
- 7:26Speaker 1: in practice it's utterly worthless.
- 7:29Speaker 2: Yeah, make sure you go read Greg Jared's column. It's
- 7:32Speaker 2: up at foxnews dot com. Hey, you point out in
- 7:34Speaker 2: the column Joe Biden had offered a twenty five million
- 7:37Speaker 2: dollar reward for Maduro's arrest. Who was he thinking would
- 7:40Speaker 2: arrest him?
- 7:42Speaker 1: Yeah? Yeah, I mean, you know, and when Biden was
- 7:46Speaker 1: running in twenty twenty, he excoriated Trump for doing nothing
- 7:51Speaker 1: about Maduro. And then, of course Biden took office and
- 7:56Speaker 1: did nothing about Maduro except put a bounty on his head,
- 8:00Speaker 1: chuck him, or stood on the floor of the United
- 8:02Speaker 1: States Senate when Trump was in office the first time around,
- 8:09Speaker 1: and railed against him for not getting rid of Maduro. So,
- 8:14Speaker 1: you know, in the second term, Trump does exactly what
- 8:16Speaker 1: Schumer demanded, and Schumer then, you know, denounces Trump for
- 8:23Speaker 1: doing what Schumer insisted that Trump should do. I mean,
- 8:26Speaker 1: these these people are knuckleheads, and they're you know, the
- 8:29Speaker 1: ultimate and hypocrites.
- 8:31Speaker 2: Hey, is somebody entitled this twenty five million dollar award.
- 8:34Speaker 2: Con Pete Hexith put in a claim for it, or
- 8:36Speaker 2: Donald Trump.
- 8:37Speaker 1: I think when the military acts and law enforcement acts,
- 8:41Speaker 1: it doesn't really apply. But you know, I don't know
- 8:46Speaker 1: who knows. Trump may say, hey, I get the reward
- 8:49Speaker 1: and we're going to distribute it to members of the military. Well,
- 8:54Speaker 1: I don't object to that. Those guys are the best
- 8:57Speaker 1: in the world. You know, the Delta Force and all
- 9:00Speaker 1: of the other American forces that carried out this incredible
- 9:05Speaker 1: raid without injury to any of our military personnel. Truly remarkable.
- 9:11Speaker 2: Well, you read the column. It's a great column. It's
- 9:13Speaker 2: up at foxnews dot com. Just look for Greg Jarrett's
- 9:16Speaker 2: column and all of his columns there. Make sure you
- 9:18Speaker 2: get his books, the latest book, The Constitution and Other
- 9:22Speaker 2: Patriotic Documents. It's a book you should have in your library. Definitely,
- 9:26Speaker 2: you can go get at it.
- 9:27Speaker 1: Well, I'm going to send it to Chuck SCHUMERI might
- 9:30Speaker 1: come as a surprise to him. Apparently when he went
- 9:32Speaker 1: to law school he skipped constitutional law.
- 9:35Speaker 2: Yeah, well, it's a good idea. Somebody buy it and
- 9:39Speaker 2: send it to Chuck Schumer. It would be a good idea.
- 9:42Speaker 2: Greg Jarrett the best legal analyst of all. Thanks for
- 9:45Speaker 2: being with.
- 9:45Speaker 1: Us, my pleasure, Mark, Take care.
- 9:47Speaker 2: All right, take care. Fascinating stuff. Yeah that you'll hear
- 9:52Speaker 2: this for the next week. You'll hear it on the

- 10:05Speaker 2: don't forget. Coming up at noon, it's Buck Sexton, Clay Travis.
