- Marcus: Emma, let's look at a classic exam scenario. It's one that can be confusing. Imagine a shipment is arriving. You have the U.S. company that bought the goods. And you have the customs broker they hired to handle the paperwork. If there's a problem, like an error on the documents or unpaid duties, who is ultimately responsible in the eyes of Customs? Emma: That's the core question, Marcus. It's about the difference between two critical roles. The Importer of Record, or IOR, and the Entry Filer. They work together, but the law gives them very different types of responsibility. Marcus: So, what is an Importer of Record? Emma: The Importer of Record is the party with ultimate legal and financial responsibility for the shipment. You can think of them as the owner of the problem, and the owner of the goods. The regulations, specifically 19 CFR 141.20, state this is typically the owner or purchaser of the merchandise. Marcus: So they're the one who has to make sure the goods comply with all U.S. laws and pay the final bill for duties and taxes? Emma: Exactly. It's their neck on the line. That liability can’t be fully delegated away, even when they hire an expert like a customs broker to help. Marcus: That makes sense. If the IOR has the ultimate liability, what is the role of the Entry Filer? Emma: The Entry Filer is the party who prepares and submits the customs entry documents to CBP. This is almost always a licensed customs broker. They act as an agent for the Importer of Record. Marcus: An agent. So they're acting on behalf of the IOR, not replacing them. Emma: Precisely. The broker's job is to exercise what the regulations call 'due diligence' and 'reasonable care.' They use their expertise to classify goods, determine value, and prepare the entry correctly. They do this based on information the IOR provides. The broker is the facilitator. Marcus: Can you give me an analogy for that relationship? Emma: Think of it like preparing your taxes. You are the Importer of Record, which is like being the taxpayer. You are ultimately responsible to the government for the accuracy of your return and for paying the tax. You might hire a professional accountant. That accountant is like your Entry Filer, the customs broker. Marcus: Okay, I'm following. The accountant prepares the return with professional skill, but I'm the one who has to provide them with the correct financial documents. Emma: Exactly. And you're the one who ultimately answers to the IRS if something is wrong. The accountant has a professional responsibility to do their job correctly. But they don't assume your personal tax liability. The IOR and the Entry Filer have that same principal-and-agent relationship. Marcus: So how is that agent relationship made official? I can't just call a broker and have them start filing entries for my company, can I? Emma: No, you can't. That legal connection is established through a Power of Attorney, or a POA. It’s a formal document required by 19 CFR 141.32. Without a valid POA signed by the Importer of Record, a customs broker has zero legal authority. They cannot act as an agent or file an entry. Marcus: The POA is what gives the broker the ability to act. So, who has the legal 'right to make entry' in the first place? Is it only these two parties? Emma: The regulation, 19 CFR 141.11, is very specific. It grants that right to three parties. The first one is the most obvious. Marcus: The owner or purchaser of the goods? Emma: Yes, the owner or purchaser. They can, in theory, handle the entire entry process themselves. They have the fundamental right to enter their own goods. Marcus: Okay, what's the second party? Emma: The second is a licensed customs broker. But they must meet that critical condition we just discussed. They have to be acting as an agent for the owner or purchaser, with a valid POA. Marcus: Right, they can’t just do it on their own. And the third? The source material mentions a 'consignee'. How does that fit in? Emma: A consignee is the person or entity to whom the goods are being shipped. The regulation includes the consignee as a party with the right to make entry. This is to ensure all potential scenarios are covered, as the consignee can sometimes be the owner or purchaser. Marcus: So, the owner, the purchaser, or a broker with a POA. That’s the exclusive list. Now, can you walk me through the example from the lesson? Emma: Of course. A U.S. company, 'Global Imports LLC,' buys goods from China. They hire 'Customs Solutions Inc.,' a licensed customs broker, to handle the clearance. Global Imports gives Customs Solutions all the documents and a valid Power of Attorney. Marcus: Okay, let's stop there. First, who is the Importer of Record? Emma: Global Imports LLC.. They are the U.S. purchaser and owner of the goods. They bear the ultimate liability for everything—the accuracy, the compliance, and paying the duties. Marcus: And who is the Entry Filer? Emma: That would be Customs Solutions Inc. They are the licensed broker. They're acting as the agent for Global Imports, under the authority of that POA. Marcus: So what are their distinct responsibilities in this case? Emma: Global Imports' responsibility is to provide true and accurate documents and information to their broker. Customs Solutions' responsibility is to use their professional expertise—their reasonable care. They must review those documents, prepare the entry correctly, and file it with CBP. Marcus: So if Global Imports gave them a bad invoice, the primary fault lies with the IOR. But if the invoice was good and the broker made a data entry error, the broker failed in their duty of due diligence. Emma: That's a perfect summary of the division of responsibility. Marcus: How do exam questions get tricky with this topic? What's a common trap for candidates? Emma: The most common trap is confusing the broker’s responsibility for due diligence with the IOR's ultimate liability. An exam question might describe a broker making an error. Then it might imply that the IOR is therefore off the hook. That's almost never true. The IOR is always the ultimate obligor to CBP. Marcus: So even if your broker messes up, CBP is still coming to you, the IOR, for the money. Emma: Correct. The IOR's obligation is directly to the government. Any issues between the importer and their broker are a separate matter from that government obligation. Marcus: What about other parties in the supply chain? I'm thinking of freight forwarders or the shipping line. Can an exam question trick you into thinking they can file the entry? Emma: That's another classic trap. A freight forwarder or carrier's job is transportation. They do not have the right to make entry. The only exception is if they are also a licensed customs broker and have a valid POA from the IOR. Simply moving the goods does not grant them the right to clear them through customs. Marcus: It all seems to come back to that Power of Attorney. If a question describes a broker 'helping out' but never mentions a POA, what should we assume? Emma: You should assume their actions are unauthorized. The exam is testing your knowledge of 19 CFR 141.32. No valid POA means no legal authority to act as an Entry Filer. Any entry they filed would be improper. Marcus: That explanation is incredibly helpful for a complex topic. Okay, one last scenario. A U.S. retailer buys crafts from an artisan in Mexico. They decide to clear customs themselves, without a broker. First, can they even do that? Emma: Yes. As the owner and purchaser, they have the right to make entry under 19 CFR 141.11. Marcus: But what if they declare the goods, which are for resale, as 'gifts' to try and avoid duties? Emma: Now they are in serious trouble. Even though they have the right to make entry, they are still bound by all the rules of accuracy. Declaring commercial goods as gifts is a false declaration. As the Importer of Record, that retailer is directly and solely liable. They could face penalties, seizure of the goods, and potentially even criminal charges. Marcus: So being your own IOR and Entry Filer means you hold all the responsibility and all the liability. There's no one else to point to. Emma: Exactly. It perfectly illustrates why the IOR role is one of ultimate responsibility. Marcus: Before we finish, what’s a simple way to remember the difference between these two roles during the exam? Emma: Think of it this way: The Importer of Record owns the liability. The Entry Filer manages the process. The IOR is the principal; the Filer is the agent. If you remember that ownership distinction, you’ll be able to handle any scenario the exam throws at you. Marcus: Owns the liability versus manages the process. That’s perfect. It’s clear, concise, and explains the core of the regulations. Emma: VoraPrep is a full exam-prep app — lessons, practice questions, and an AI tutor in one place. Get started at Vora Prep dot com.
