- 0:00Their playbook I I don't feel like is very defensible.
- 0:03Yeah, I, I don't think it played well in front of the jury and I
- 0:06don't think it will in future trials.
- 0:08It was the playbook we always see, right?
- 0:10It's it's blame the victim. And then when that didn't work,
- 0:13it was throw their hands up and say, hey, these experts that we
- 0:16paid to tell us we were doing everything right said we were
- 0:19doing everything right. Welcome back.
- 0:21To Tort talk. Today we are talking about the
- 0:25social media addiction trial that resolved last week.
- 0:28We finally had a verdict. We're going to be talking about
- 0:30Bard power port, hair relaxer, talc, and NEC.
- 0:34And to kick things off first, let's start with Bard Power
- 0:38port. We have the first bellwether
- 0:39trial starting April 21st. Ton of activity going on in this
- 0:43MDL. Joe, can you tell us what people
- 0:45can expect from this first bellwether trial and what's been
- 0:48happening over the past couple of months?
- 0:50Like you mentioned, John, we're a little over three weeks out
- 0:53from this initial bellwether trial.
- 0:55It's like everybody knows a crucial moment in this MDL.
- 0:59We have about 3000 cases pending.
- 1:02The litigation's been going on for a couple years.
- 1:04We just heard from the judge on the all important Dolbert
- 1:07rulings. Most of our experts were able to
- 1:10get in and they survived. We challenged one of the
- 1:13regulatory experts for the defendants and what they always
- 1:16like to try to do is say that the device was approved by the
- 1:20FDA, therefore it's safe. But really that approval from
- 1:24the FDA doesn't say it's safe. It's just saying that it it can
- 1:27be used and that it's met the FDA requirements.
- 1:30So we have the initial rather that the final pretrial
- 1:34conference coming up, that's on April 9th.
- 1:36Then we have everything teed up for the trial.
- 1:39We'll have a couple days for the jury selection.
- 1:42We'll get things started. I think we're looking at about a
- 1:44two to three-week trial here. So come mid-May we'll have a
- 1:49result. Hopefully we'll get a positive
- 1:51ruling in this case. These cases can be challenging,
- 1:54but a lot of attention obviously towards the first bellwether
- 1:58trial. Clicks and web traffic don't
- 2:00sign retainers, people do. RR Digital helps law firms get
- 2:04more signed cases through SEO, paid marketing, social media and
- 2:08more. All designed to track the right
- 2:10people and make the right impression when they land.
- 2:13Not to mention, we're a founder LED agency because we believe
- 2:16that the people setting the standard should still be in the
- 2:19room making sure the work actually delivers.
- 2:21If you want high level accountability without the high
- 2:24level distance, visit rrdigitalmediacom For more
- 2:27information. Now back to the show.
- 2:29Some more trials coming up too in NEC.
- 2:32We've got trial in Cook County with four families who had a
- 2:36necrotizing enterocolitis with their newborn children.
- 2:40What can we expect in that trial?
- 2:41Yeah, we're about a month into this trial.
- 2:43So this was a joint plaintiff trial.
- 2:45So there's four different families that all unfortunately
- 2:49have their children develop the NEC.
- 2:51We know these trials are really long, so we probably have at
- 2:54least another two weeks or another month to come in this
- 2:57trial. We started recently hearing from
- 3:00some of the mothers testifying. Obviously this is very traumatic
- 3:04for them. It talks and the defendants are
- 3:07trying to focus on blaming the mothers for some of their
- 3:10medical conditions, some of their history that led to these
- 3:14conditions. So we're getting some really
- 3:16impactful testimony. We still have to get through all
- 3:20the experts to connect that specific case causation, but
- 3:25this is in state court where we previously had a $60 million
- 3:29verdict in Illinois. So we're hoping for another
- 3:32positive result with multiple plaintiffs.
- 3:34We could see some really big numbers, not any great
- 3:38developments recently out of the MDL.
- 3:40So hopefully we can turn the tide and get momentum on our
- 3:44side with the positive ruling in this state court action.
- 3:47Are you? Still seeing people acquire NEC
- 3:50cases. People are still getting NEC
- 3:52cases, not not a huge amount of activity in the MDL.
- 3:57There's still under 800 cases pending there.
- 4:00So most of the action really is centered in state court, but not
- 4:05a huge case that people are acquiring right now.
- 4:07Let's move on to a case that has the opposite a ton of potential
- 4:12claimants that are involved in that MDL with Hair Relax there.
- 4:15We've got almost 12,000 cases currently pending in that MDLA.
- 4:18Bunch of crucial developments going on.
- 4:20What's happening in the Hair? Relax litigation, Joe.
- 4:22Yeah. So the first thing is the
- 4:24Dahlberg hearing. So like everybody knows besides
- 4:27the bellwether trial, this is the most important part of the
- 4:31any litigation. So we're going to have the
- 4:34Dahlberg hearings coming up and then we should expect a ruling
- 4:37from the judge, I'd probably say 60 to 90 days.
- 4:40So what's unique about this litigation is we have three
- 4:44different injuries, 3 different cancers that we're trying to
- 4:47proceed. We have ovarian, uterine and
- 4:50endometer metrial. So we want to make sure that the
- 4:53experts get through in each one of those.
- 4:55So that's going to be huge for the outcome.
- 4:57We have about 80 to 85% of the inventory involves uterine and
- 5:02endometrial, 15% ovarian. So we're going to hear from our
- 5:07experts. Hopefully we come through,
- 5:09survive that. As long as all the cancers are
- 5:11intact, we're looking in a good place.
- 5:14And what's going on simultaneously, as initially we
- 5:17had a group of 32 bellwether plaintiffs that's getting
- 5:21chopped down to 10. So how the judge is doing it in
- 5:23this case is 2 plaintiff picks, 2 defense picks, and then 6
- 5:28picks from the court. So we'll have those 10 cases get
- 5:31worked up. Depositions, expert testimony,
- 5:35Dr. Deposition all the way through, hopefully get us to the
- 5:39first trial, this time in 2027. And then one that's even bigger
- 5:43than hair relaxer. We have talc.
- 5:45Which has, I believe currently the largest mass tort in the
- 5:49country, correct? Yeah, that's correct.
- 5:52Over 65,000 cases. A ton and people are still
- 5:56acquiring talc cases. There's been a flurry of
- 5:58activity over the past month. What can you tell us about talc?
- 6:01Yeah. So talc, it hasn't been great
- 6:03for the plaintiffs, to be honest with you.
- 6:05We we had a huge punitive damages award that was struck
- 6:09down. The compensatory damages still
- 6:12stood in that case about 16,000,000.
- 6:14And then also there's been the fighting between Beasley, Allen
- 6:18and J&J in this litigation. Initially, they got stripped of
- 6:22their leadership position in New Jersey State court, and then
- 6:26more recently, the MDL judge as well stripped them as their
- 6:30leadership position in the MDL. So it's unfortunate we're having
- 6:34this fighting between law firms, really not focused on the
- 6:38plaintiffs as much and those injured.
- 6:40But what we do have is a positive development.
- 6:44There's supposed to be a settlement meeting going on on
- 6:47April 13th. So settlement negotiations and
- 6:50mediation have been ongoing for a while.
- 6:52But anytime we have a date scheduled for that, we're
- 6:55excited about it. Hopefully we can get some more
- 6:58momentum going. I don't think we're going to get
- 7:00a global right now, but if we can start making some steps
- 7:04towards that, that would be great for everybody involved.
- 7:06Yeah, what a coincidence. The day before the start of
- 7:09MTMP. Yeah, I bet people will be
- 7:11talking about it. Yeah, I'm sure.
- 7:13I'm sure one of the other items that people are going to be
- 7:15talking about at MTNP is definitely this huge verdict
- 7:18that we had last week in the social media addiction trial.
- 7:21We had a $6 million verdict after about a week of
- 7:23deliberations by the jury, 3 million in punitive.
- 7:26It was I, I think, a win for the plaintiffs.
- 7:29What's your take on it? Oh, definitely a win for us and
- 7:32we got both, like you said, compensatory and punitive
- 7:35damages. Obviously we would have liked
- 7:38the higher number for the plaintiffs.
- 7:40She's been through so much. But what I think this showed us
- 7:43is that we can win these cases. The 230 immunity that's done,
- 7:48that's not an issue and the jury agrees with us the conduct of
- 7:52their defendants was willful. It's it is going to result in
- 7:56punitive damages. So I think there's going to be a
- 7:59lot of momentum building here. I also think that the number was
- 8:03what I'll call reasonable from the defendant's perspective.
- 8:06It's not a nuclear verdict like they like to say of $950
- 8:11million. It's going to stand up on
- 8:13appeal. So this is a number and a jury
- 8:16verdict that's going to stand. And this is what a case of a
- 8:19similar situation. We know we can get that number
- 8:22at trial. So a lot of people are acquiring
- 8:25these cases. Everybody's going to be talking
- 8:27about it. There's more and more pressure
- 8:29coming on these, you know, big tech companies.
- 8:33I think we could get a settlement sooner rather than
- 8:36later. Still probably a year out
- 8:38because of the complexity of these cases and how many plans
- 8:41there could be. But it was a great day after the
- 8:44trial, the year we've been hyping up for months and months
- 8:46and months to to see that plan of.
- 8:48Verdict. You were.
- 8:49Talking earlier about how we could use this as a way to
- 8:53understand what the defenses playbook is going to be in
- 8:55upcoming trials. We've talked about that in Uber
- 8:58and now we're talking about it in social media addiction and
- 9:00their playbook. I, I don't feel like is very
- 9:02defensible, right? If you, you breakdown, but well,
- 9:05let's take a step back here, right?
- 9:07There were actually 4 defendants.
- 9:08We had two that settled out right before trial snap and
- 9:11TikTok settled out. So we don't know how they would
- 9:13have handled it, but we know that YouTube's claim was, hey,
- 9:15we're not a social media network right now.
- 9:19Maybe that helped get them the, the 3070 split that wound up
- 9:22resolving in the split of the damages.
- 9:25But the reality is that YouTube Shorts is you're really similar
- 9:30to TikTok, very similar to Reels on Instagram.
- 9:34And YouTube, being a part of Google, actually has a ton more
- 9:38data about people than the other social media networks do.
- 9:43And I think we heard from the jury that defense doesn't make
- 9:46sense. It doesn't make sense that
- 9:48YouTube isn't a social media company.
- 9:50It is maybe it's a little less, but but it definitely is.
- 9:54So I I think that defense is out and really all we have left is
- 9:57what matter was trying to do at the trial.
- 10:00How do you think that defense stands up like their their
- 10:03claims are that we did what we could do to protect.
- 10:05And you know, we we follow the guidelines of the experts that
- 10:09we brought in to help us protect people.
- 10:12And they they really didn't have anything to push back against
- 10:15when Mark Lanier was you're putting papers in front of
- 10:19Zuckerberg's face. Saying look here.
- 10:20Here is the proof. Yeah, I, I don't think it played
- 10:24well in front of the jury and I don't think it will in future
- 10:26trials. It was the playbook we always
- 10:29see, right. If it's it's blame the victim.
- 10:32It was blaming the the young girl who was using the platform
- 10:35at six. It was blaming her mother.
- 10:37It was blaming her family. And then when that didn't work,
- 10:40it was throw their hands up and say, hey, these experts that we
- 10:43paid to tell us we were doing everything right, said we were
- 10:46doing everything right. Don't mind this study that we
- 10:49could have done 15 years ago, Don't mind this alert, don't
- 10:53mind this internal e-mail saying that this was a problem.
- 10:56So it's a playbook we see time and time again in these mass
- 10:59torts and it just doesn't play well because they could have
- 11:03done something back then. They could do something right
- 11:05now. They could do something tomorrow
- 11:07to end this and change it. But they won't because they're
- 11:10making so much money. So they're going to need any
- 11:12time to implement these changes and make business decisions
- 11:16before they ultimately and come to the table and settle.
- 11:20I don't want to throw out a number right now for how much
- 11:23it's going to cost them, but we're looking at billions of
- 11:25dollars, probably 10 plus billion to get out of this at
- 11:28the end of the day. More or less than the market cap
- 11:31that was wiped out last week after the verdict.
- 11:34Well, much less because they lost 200 billion in about a day.
- 11:37So, you know where plaintiffs are only going to walk away with
- 11:41what, 10 billion. So that's nothing to them
- 11:44unfortunately. But it's, it's more about
- 11:47getting the money and then making the changes to these
- 11:49platforms. And we're really going to hold
- 11:51our line on that and see that both of them are done.
- 11:54But it's it's going to take a little bit of a while to get
- 11:57there. For those of you who don't know
- 11:58what I'm talking about, last week, the day after the the
- 12:01verdict came out, Joe was on LinkedIn talking about the meta.
- 12:05Stock drop. And the financial impact of the
- 12:08decisions that Zuckerberg and his team have made over the past
- 12:11decade about how the platform is evolving.
- 12:14How much of that do you think is is directly correlative to the
- 12:17verdict and how much is related to just the broader market that
- 12:20we're seeing right now due to the political climate?
- 12:23Oh, I would say at least half, right.
- 12:25It came, it came out the very next day and you didn't see
- 12:28those similar type drops from the other ones TikTok snapshot.
- 12:32So definitely big text taking a little bit ahead in the
- 12:35environment. But it was the day after it
- 12:38happened immediately it was more significant than we seen with
- 12:42anybody else. And unfortunately, that's what
- 12:44drives these settlements is not what's happening in the
- 12:47courtroom, but what happens in the boardroom.
- 12:50So they'll start getting pressure from there.
- 12:52We'll keep going in the boardroom, boardroom, try to get
- 12:54some legislative pressure as well.
- 12:56Then ultimately we'll see a change.
- 12:58But it's, it's not going to happen tomorrow.
- 13:00We we still have a little bit while to go in this case.
- 13:03It was also interesting the day. After that verdict.
- 13:05I noticed that there were many, many lead generators who all of
- 13:09a sudden are starting to to attempt to acquire social media
- 13:12addiction cases. They were everywhere.
- 13:14They're everywhere. So just be careful if you're
- 13:17looking into that, be careful. Make sure you know where the
- 13:20cases are coming from. Make sure you're using the real
- 13:23criteria. So reach out to John, reach out
- 13:25to me if you guys have a question about it.
- 13:27We've been involved for a long time, John longer than me, so he
- 13:31knows it really well. Because what we want to do is we
- 13:34want to help the kids at the end of the day.
- 13:36So don't get taken advantage of. There's plenty of time left, but
- 13:40reach out to one of us and and we'll give you some honest
- 13:43information. Yeah, I was talking to the
- 13:46Lanier team the day after the verdict and they were just
- 13:49inundated with inquiries from people who saw it on the news,
- 13:53saw Mark Lanier, you know, read the articles in the newspaper
- 13:56and they said, wow, like now really, I can actually do
- 13:59something about this. It was kind of a pipe tune for
- 14:01people for a long time, right? Like, oh, your, your children
- 14:04may be addicted to social media. You blame social media, but now
- 14:08it's a reality, right? So there are a lot of cases that
- 14:11I think are coming out of the woodwork so to speak that are
- 14:14there. This is a nationwide, you know.
- 14:17Epidemic. So to speak.
- 14:18I definitely encourage anyone you know, you could reach out to
- 14:21me directly. I can connect you with the
- 14:23linear team. If you do have cases in your
- 14:25local market, that is who you want betting these cases.
- 14:28And then I think with any litigation like you, Joe is
- 14:31right. You want to make sure that you
- 14:32have the right partner on other litigations.
- 14:34Reach out to Joe Joe can help you get cases placed if you find
- 14:38them in your local market. And you need to know who the
- 14:40best the best firms are for cases to go to.
- 14:43No better man than the man sitting right next to me, Joe
- 14:46Fantini. Yeah, it's an important issue
- 14:48and we want to help the clients so that that's what we're trying
- 14:51to do at the end of the day. But it's important topic and
- 14:54it's been proven now, so we've got to keep wishing and and get
- 14:58it finally resolved and change is implemented.
- 15:01Yep, Yep. Absolutely, definitely prime for
- 15:03for any of the Pi attorneys out there who are watching this,
- 15:07talk to your existing client base.
- 15:09It's great for newsletter, it's great for some social media
- 15:11posts. Maybe you won't get hundreds of
- 15:13cases or dozens of cases, but you may get may be able to find
- 15:16people who have had some of these issues who are already
- 15:19past clients of yours. You can get them retained and
- 15:21then refer them over whether it's a linear or the firm of
- 15:25your choice. And you can really do that with
- 15:26many different cases types when, when things hit major news
- 15:29cycles, look to your existing client base first and you will
- 15:33find that there are people who have been affected.
- 15:34The larger firm you are obviously the larger past client
- 15:37base that you have. It's always a great marketing
- 15:39pool for you. Yeah, that that's a good tip
- 15:41because those people know, like and trust you already.
- 15:44You're sitting on a ton of cases I'm I'm sure.
- 15:47All right, Joe, anything further to add on the social media
- 15:49addiction verdict? Now looking forward to seeing
- 15:51everybody at mass toward made perfect.
- 15:53We'll we'll be there live. So we'll be bringing you guys
- 15:56the latest updates, kids, on that case and any other
- 15:59developments between then and what we're hearing on the ground
- 16:02there. I've already.
- 16:03Got some great episodes lined up for MTMP.
- 16:05You know, there's there's a couple of big announcements that
- 16:08are coming at the conference who will be sure to cover those and
- 16:10share with you all as quickly as possible.
- 16:12As always, Joe, thank you again. Normally the best 10 minutes in
- 16:15mass towards we went 7 minutes over this week.
- 16:17We will see everybody at MTMP and we'll catch you next week on
- 16:20Tortalk.
