Speaker 1: What's up, everyone, and welcome to another episode of the
• 0:03
Epstein Chronicles. In this episode, we're gonna pick up where
• 0:06
he left off with the Tovin Oell interview with Congress
• 0:13
question thank you and the ten PM count slip I
• 0:16
think said seventy three plus one. Do you have any
• 0:19
knowledge of why it said that? Answer? So, to the
• 0:21
best of my recollection, Just like I said earlier, I
• 0:24
wasn't aware that Reyes was coming back. I know, like
• 0:27
when somebody leaves, they're supposed to be on an out count,
• 0:30
and I guess that's how they documented on the count slip.
• 0:34
So if you're on the count and you're putting plus
• 0:36
one indicating that there's an out count. But for some
• 0:39
reason that night, I think at some point in time,
• 0:41
the count couldn't clear because he didn't come back, so
• 0:44
they had to Control had to call me to tell
• 0:46
me the count to have the count clear. Question do
• 0:49
you recall whether or not it was actually you who
• 0:52
wrote the plus one because there's a question that it
• 0:56
might have been down in control. Answer, yeah, I'm not,
• 1:00
I can't remember. Question Okay, a quick note on the
• 1:03
CPAP machine, Am I saying that right? Answer? Yeah, Question
• 1:07
I think I heard you mention, but I just wanted
• 1:09
to confirm the best that you can. Recall, Epstein could
• 1:12
have grabbed that chord which was out in the hallway
• 1:15
and snaked it into his own cell. Is that right? Answer? Correct? Question? Okay,
• 1:20
I've got one more before we break for this round,
• 1:23
and I'm going to introduce minority Exhibit B. This is
• 1:27
an article. You do not have to read the whole article.
• 1:30
Maybe just scanning the second page and the third page
• 1:32
might be helpful for the court reporter. This is the
• 1:35
CBS News article titled who entered Epstein's gel tier the
• 1:39
Night of his death? And the article is dated February sixth,
• 1:43
twenty twenty six. And I'm just going to, whenever you're ready,
• 1:47
bring your attention to the second and third pages of
• 1:50
the article. Answer. Okay, question. So there's a chart here
• 1:54
you can see on the second page. It's called FBI
• 1:56
Analysis of Video Footage. That's the FBI trying to figure
• 2:00
out based on that one recording shoe camera kind of
• 2:04
what happened when and who was going where. You can
• 2:07
see a ten thirty nine. It's highlighted here that quote
• 2:10
a flash of orange. I think that's probably supposed to
• 2:13
be of orange, looks to be going up the yel
• 2:15
Tier stairs, could possibly be an inmate escorted up that tier.
• 2:19
And then if you flip to the next page, there's
• 2:22
another chart and this is where the IG did their
• 2:25
best to figure it out. And again for ten thirty nine,
• 2:28
here it says, quote, a flash of orange can be
• 2:30
seen going up the stairs of El Tier in makes
• 2:33
are currently on lockdown. It's possible someone's carrying in maate
• 2:36
linen or betting up the stairs. Both agencies agree that
• 2:40
the two minutes before two minutes after it seems like
• 2:43
somebody is moving around the shoe. We took a look
• 2:46
at the video ourselves. It's hard to make out. It's blurry,
• 2:50
but from our point of view, it seems likely that
• 2:52
this was part of your movements around the time of
• 2:55
ten pm count. It seems possible to us that the
• 2:58
orange may be you carrying something up the stairs to
• 3:01
El Tier. From your point of view, do you know
• 3:04
whether that was you at the ten thirty nine marker
• 3:07
going up to Eltier? Answer? So after I would have
• 3:10
conducted the ten pm count where I started on that
• 3:13
first tier. Like if you watch the video, I'm going
• 3:15
the opposite way, and I ended at the leftier. I
• 3:18
never went back up to el tier after that. Again,
• 3:21
I never distributed anything orange, whether linen or clothing. Everything
• 3:26
in the shoe also is orange, like linen closed shoes,
• 3:29
everything's orange. I never distributed linen the entire time I
• 3:33
worked at MCC to any inmate at all. And I
• 3:36
never went back up the tier, nor did I carry
• 3:39
anything up the tier, nor did I enter the tier
• 3:41
after the time that I did the count. Question Is
• 3:45
it possible that that ten thirty nine movement is part
• 3:47
of you doing the count? Answer? But I started there
• 3:50
first question? And what do you mean by started where? Answer?
• 3:54
So like el the double tiers and then going to
• 3:57
the next one in the middle and then going to
• 3:59
the other one. I started on L working my way
• 4:02
this way. So I think, to the best of my recollection,
• 4:05
this would have been after because on the video I
• 4:08
was walking like towards the door. It looked like I
• 4:11
walked towards off camera, and then you see whatever that
• 4:14
orange is. There was nobody out in the shoe, there
• 4:17
was nobody carrying anything, and I never went back after
• 4:21
I would have did that ten o'clock where you saw me.
• 4:24
I never went back to the tier until the morning
• 4:26
when it was time for breakfast. Question, it sounds like
• 4:30
and we also it sounds like you've seen that video
• 4:32
as well. Is that right answer? Correct question? Are you
• 4:36
as close to one hundred percent confident as you can
• 4:38
be that the ten thirty nine flash of orange is
• 4:41
not you? Answer? Yeah, I don't know what it is,
• 4:44
to be honest, to be very honest, I don't know
• 4:46
what it is who it is, because I never went
• 4:49
back to the tier, and I was never carrying anything
• 4:52
orange at all, and I never issued anything orange to
• 4:55
anyone in the shoe, not just only Epstein, just anyone question,
• 5:01
is it right? And I think you had said at
• 5:03
this point in the night, all the inmates and the
• 5:05
shoe were locked in. Is that correct answer? Correct question?
• 5:09
And do you have any memory of anybody somehow leaving
• 5:11
their cell for any reason in terms of inmates? Answer? Yeah, no,
• 5:16
they can't get out. Question. And from our understanding from
• 5:20
the IG report and testimony of not just you, but
• 5:23
also your colleagues, was that at this point in the
• 5:26
night your two colleagues would have been sleeping. Is that
• 5:29
right answer? It would have been just one question, just
• 5:33
one answer. It would have been because this was ten thirty,
• 5:37
so it would have been just me and bon HAMI question,
• 5:40
got it and BONHAMI, I think has been established in
• 5:42
the reports. Was asleep? Answer correct? So is it from
• 5:46
your point of view? Is there anybody left that could
• 5:49
have been other than you? No, it wasn't me. Question, Well,
• 5:53
that leaves a little bit of a conundrum. Is it
• 5:55
possible that it was you? Answer? No, because I didn't
• 5:58
go back up the stairs. You see me, You see
• 6:01
me walking off and going this way, and then you
• 6:04
see that. But I don't know what that is. And
• 6:07
like I said before, I never carried I didn't go
• 6:10
back up the stairs, and you can in that video
• 6:12
it's hard to tell. It's very hard to tell it
• 6:15
because you really see like remember his his is up,
• 6:19
you just like see a shadow. I don't know what
• 6:22
the shadow could have been. In fact, I want to
• 6:24
say that I don't know what it is because I
• 6:27
never issued linen or anything at all. Question is it right?
• 6:31
It sounds like I hear from you that the person
• 6:33
moving around at ten thirty eight, the minute before and
• 6:36
like two minutes after ten forty one, that is you.
• 6:38
Is that right? Answer correct? Question Okay, is it right
• 6:42
then that as you sit here today, some other person
• 6:45
going up Beltier basically at the exact same time you're
• 6:48
moving around, you would have noticed that, I would think,
• 6:50
answer correct question, and you did not see anyone go
• 6:54
up Eltier. Answer no question. So it kind of feels
• 6:57
like either it's you or nobody at all. It's some
• 7:01
kind of weird image illusion. Answer. I don't know what
• 7:04
the image illusion. And Epstein's cell the cell block was
• 7:08
never opened after I closed that gate. That when I
• 7:12
went after ten doing that count, nobody went up there,
• 7:14
nor was his door open or the slot or anything.
• 7:17
No one went up there. Question. Okay, we can go
• 7:20
off the record, and that'll do it for this round.
• 7:22
Thank you. Questions Back now to Miss fayer Bend question.
• 7:27
I'd like to start by asking you a few follow
• 7:29
ups from topics that we covered in the last two hours.
• 7:32
You mentioned that you had a personal engagement and it
• 7:35
was that came up on August ninth, and it was
• 7:37
because of that that you had a shift on August tenth.
• 7:40
Is that correct? Answer? Correct question? So you typically did
• 7:44
not have shifts from twelve am midnight until eight am?
• 7:48
Answer correct question. Why was it it was because of
• 7:52
a personal engagement answer right, that I couldn't do the
• 7:55
eight to four and then the four to twelve question. So,
• 7:58
just to be clear, you weren't originally assigned a shift
• 8:01
on the morning of August tenth. Answer, I wasn't assigned
• 8:04
the shift from the midnight to eight pm in the
• 8:07
morning question yes, answer I was question originally? Answer oh
• 8:12
originally No, I got called in and I was mandated
• 8:15
on the ninth question okay, And we also mentioned the
• 8:19
mandated overtime hours that you had to work. Was there
• 8:22
a special overtime pay that was included in that? Answer?
• 8:26
So it was I don't remember if it was time
• 8:28
and a half or it was just sixteen hours, but
• 8:31
the pay would be more because there's overtime. Question okay,
• 8:35
And you don't remember if it was time and a half.
• 8:37
Answer no, I don't remember how they do it. Question okay?
• 8:41
Were you paid a salary or was it an hourly rate? Answer? Salary?
• 8:45
Question okay? And you said I think the first hour
• 8:48
that you don't remember what your salary was? Answer yeah, no,
• 8:51
so I was GS five. So like if I google
• 8:54
what GS five would have the base pay been? But
• 8:57
I don't remember question okay, thank you. You also mentioned,
• 9:01
I think in the last hour that Officer Thomas was
• 9:03
quote materials handler. Answer correct question. What does that mean? Answer? So,
• 9:09
he's not like a regular correctional officer. He works like
• 9:12
downstairs I don't know, handling for example, when the inmates
• 9:15
go down to do laundry, like he oversees like stuff
• 9:18
like that. But as far as like what his main
• 9:21
duties are, I don't know. Question, So he would be
• 9:24
responsible for laundry. Answer like overseeing the inmates that's doing
• 9:28
like laundry and other stuff. I'm not sure, like exactly
• 9:32
what question? Okay? And you weren't a materials handler. Answer
• 9:36
no question, So I think you mentioned that you were
• 9:39
never responsible for overseeing laundry. Is that correct? Answer? Correct question? Okay.
• 9:45
I know the minority touched on it as well, the
• 9:47
flash of orange that was seen in the video, but
• 9:49
I'd like to ask you some follow ups about that question,
• 9:53
just to be clear. Have you seen the video that
• 9:55
we're referencing? Answer yes, question okay, And you said that
• 10:01
what you saw was moving about the shoe station at
• 10:03
ten thirty eight answer correct. Question was at the time
• 10:07
that you conducted the ten PM institutional count. Answer, so,
• 10:11
as far as I remember from the video, I conducted
• 10:14
the count, I was done, and I went back to
• 10:16
the desk, like maybe I don't know how many minutes
• 10:19
in between? Then you see me walking off going this way,
• 10:22
But the video you can't see it cuts off. Question okay, answer,
• 10:27
so it should have been like minutes apart. Question okay,
• 10:29
do you remember where you were walking to? Answer? So
• 10:33
the only direct, the only thing that's that way is
• 10:35
the door in the bathroom. Question do you remember going
• 10:38
to the bathroom at ten thirty? Answer? I don't recall.
• 10:42
Question do you think that would have been something that
• 10:45
you would have done? Answer? I don't recall. It could
• 10:47
have been when I was done, you stick the count
• 10:49
slip in the sally port. I could have walked there
• 10:52
to stick the count slip. So I'm not sure exactly.
• 10:55
Like what's the reason that I walked that way? Question
• 10:58
so it seems like you were not let me back up.
• 11:00
Were you at your station at ten thirty nine pm
• 11:02
when the flash of orange could be seen going up
• 11:04
the stairs? Answer? No, I was off the camera that way.
• 11:08
Question could you have seen the el tiers from where
• 11:10
you were at? Answer? From the door if I'm like
• 11:13
like I said, I don't remember what I'm doing. If
• 11:16
I'm in the bathroom and I'm closed, I can't see it.
• 11:18
If I just walked to the door like where we
• 11:21
stick the slip, then I can see the Eltier. Question
• 11:24
So the best of your recollection, you don't recall whether
• 11:27
you could see El Tier stairs or not. Answer? I
• 11:30
could see the el Tier stairs if I'm standing by
• 11:32
the door, but because I don't know where I went. Okay.
• 11:36
Question So you didn't see in person any sort of
• 11:39
flash of orange going up the el stairs? Answer no question,
• 11:44
And you said that you never distributed any linen. Is
• 11:48
that correct? Answer? Correct question? And it's also your testimony
• 11:53
that it was not you going up the el Tier stairs.
• 11:55
Answer correct question. Okay. Do you have any thoughts or
• 11:59
opinions as to what or who could have been in
• 12:02
the video? Answer? No, I watched it numerous times and
• 12:07
I don't know what it could have been. Only thing
• 12:09
I could tell you rest assured it wasn't me. Question
• 12:13
do you think that somebody that was not you or
• 12:15
the other OC could have been in the shoe at
• 12:17
that time? Answer? It would have been BONHAMI at that
• 12:20
time me and BONHAMI question, could it have been Officer
• 12:24
bon Ham that was walking up the stairs? Answer? He
• 12:27
was sleeping. Question is it possible it could have been
• 12:30
one of your supervisors from downstairs going up to the shoe. Answer.
• 12:34
I would have had to let them in, so I
• 12:36
would have known if that was a supervisor coming in.
• 12:39
Question Okay, so let me back up. It seems like
• 12:42
in the video it looks like a person carrying something
• 12:45
or walking someone up. Answer, I don't know what it
• 12:48
looks like. It looks like literally, the quality's poor. It
• 12:52
just looks like a shadow of orange. I never set
• 12:55
a person nor somebody carrying. You can't see anything other
• 12:58
than the shadow of orange. And you've said that you've
• 13:01
seen this video numerous times. Answer yes, Question what do
• 13:04
you think it is? Answer? I don't have a clue.
• 13:07
  I think it's a poor video and I don't know
• 13:09
what it is. Question Okay, was the orange that you
• 13:13
saw in the video that we've all seen in the video,
• 13:16
is that a similar shade of orange to the inmate
• 13:18
bedding or linens. Answer? I can't. The quality is poor,
• 13:22
Like it looks like the light like there's some type
• 13:24
of like light within the orange. Question was there anyone
• 13:28
else that could have or was in charge of issuing
• 13:30
linens that was not Officer bon Ham? Answer? I mean
• 13:35
every correctional officer can issue linens, Emmer. But for the record,
• 13:39
any individual that would have been transporting the linen to
• 13:42
Epstein's cell would have been in the shoe correct. Answer correct.
• 13:46
And to get into the shoe, I would have had
• 13:48
to let them in. Question. When you say let them in,
• 13:53
do you physically open the door? Answer? So the first door,
• 13:56
control pops, the first door, the second door. Somebody on
• 13:59
the inside would have let them in. Question, Okay, and
• 14:02
you don't recall letting anybody in. Answer No, I did
• 14:05
not let anybody in. All right, everybody. We're gonna wrap
• 14:08
this episode up right here, and then in the next
• 14:10
episode dealing with the topic, we're gonna pick up where
• 14:13
we left off. All the information that goes with this
• 14:15
episode can be found in the description box.
