- 0:01Speaker 1: And now, Ron Verb on NewsRadio 570 WKBN.
- 0:06Speaker 2: I don't think I've ever seen, I'm trying to think
- 0:09Speaker 2: if I've ever seen the UN so explosive, if you will,
- 0:13Speaker 2: as I have just following the coverage the last few days.
- 0:18Speaker 2: It's usually pretty dull and pretty boring and non-eventful and
- 0:21Speaker 2: you don't pay much attention to it. Trump gave a
- 0:24Speaker 2: speech and was really pointing the fingers. It wasn't your
- 0:27Speaker 2: typical political speech that basically says nothing. Trump was pointing
- 0:33Speaker 2: fingers and telling it the way it is and upsetting
- 0:38Speaker 2: Cuba and Iran and what have you. So you had
- 0:41Speaker 2: people getting up and walking out. The guy from Iran
- 0:44Speaker 2: spoke yesterday. The president's there, and you had the U.S.
- 0:49Speaker 2: delegation get up and walk out. It's like a Jerry
- 0:52Speaker 2: Springer show at the United Nations. It's like Jerry Springer.
- 0:56Speaker 2: And then Netanyahu today, and he probably got the most.
- 1:03Speaker 2: I mean, it's really a tense situation, man. It is
- 1:07Speaker 2: a tense situation for him, to say the least, as
- 1:11Speaker 2: far as Netanyahu is concerned, and This whole situation. I mean,
- 1:17Speaker 2: these are some interesting times, to say the least, boys
- 1:20Speaker 2: and girls. Very interesting times.
- 1:24Speaker 3: Welcome. Good afternoon.
- 1:25Speaker 2: It's 3.06 in the afternoon. It's a beautiful day. 71 degrees.
- 1:29Speaker 2: Sun is shining. We don't have any rain, and that's
- 1:32Speaker 2: the good news. Been out a couple of dry days
- 1:34Speaker 2: in a row. Can you imagine that? A couple of
- 1:36Speaker 2: dry days in a row, and it's 71 degrees. Today's Thursday.
- 1:41Speaker 2: That means we conversate between 3 and 5 today.
- 1:45Speaker 3: And we'll conversate.
- 1:49Speaker 2: And then from 5 to 6, free legal advice, courtesy
- 1:51Speaker 2: of the law firm Beatrice Kopp. 6 to 7, money
- 1:54Speaker 2: talks with John Arnold's. And his hedge funds and the
- 1:59Speaker 2: economy and stocks and bonds and all that kind of stuff.
- 2:02Speaker 2: So that's what's ahead on this Thursday, as you should know.
- 2:05Speaker 3: All right.
- 2:05Speaker 2: So a conversation between three and five legal show five
- 2:09Speaker 2: to six and money talks. The financial show from six
- 2:14Speaker 2: to seven tonight here on News Radio 570. And I
- 2:18Speaker 2: think I think I covered it all right.
- 2:20Speaker 3: I think I did. So what is on your minds
- 2:24Speaker 3: here today? You're on the air. Hello.
- 2:26Speaker 4: Donald, Donald, Donald.
- 2:29Speaker 3: I mean, it's like a Springer show, is it not?
- 2:33Speaker 4: No, it sure is.
- 2:36Speaker 3: I mean, when you look at.
- 2:38Speaker 2: I mean, you got people getting up and walking out for...
- 2:42Speaker 2: For when Trump was speaking, when President of Iran was speaking,
- 2:46Speaker 2: when not. I would say the most controversy is with Netanyahu,
- 2:50Speaker 2: just based on what I happen to see today. I mean,
- 2:54Speaker 2: it's it's it's the most controversy. And obviously there's a
- 2:57Speaker 2: lot of. He goes and he attacks the New York mayor.
- 3:01Speaker 2: And I tell you that suddenly, suddenly following the U.N.
- 3:05Speaker 2: is somewhat interesting for a change. Can you imagine?
- 3:09Speaker 1: Yes.
- 3:09Speaker 4: You know, you know, you know, watching three hours or
- 3:14Speaker 4: four hours of, you know, monotone speeches, you know, that
- 3:19Speaker 4: you have to have somebody translate for you is not
- 3:23Speaker 4: my not my thing. Best Saturday, I think.
- 3:26Speaker 2: And that's usually how it's been for years.
- 3:29Speaker 3: It's J.J. the Trumpster.
- 3:31Speaker 2: It's been that way for so many years. It's just
- 3:35Speaker 2: droning on and on and on.
- 3:37Speaker 4: Well, he's picking things up. At least he's making it interesting.
- 3:40Speaker 4: So I might not agree with everything he says, but hey.
- 3:45Speaker 2: Yeah, but it is what it is, man, to say
- 3:49Speaker 2: the least. So we shall see.
- 3:52Speaker 4: Yeah, sorry, during your call there, I had to take
- 3:55Speaker 4: care of something. I actually had to go and see
- 3:57Speaker 4: the doctor. You had to go see Dr.
- 4:01Speaker 3: Vinnie Voomba?
- 4:03Speaker 4: Yeah, I had to make my payment. And he wanted
- 4:07Speaker 4: to schedule something. I was kind of reluctant, so I said,
- 4:09Speaker 4: I'll call you back the next day. I said, let
- 4:12Speaker 4: me ponder the idea whether I want to Don't twitch
- 4:15Speaker 4: and pee myself or not. So I thought it might
- 4:18Speaker 4: be a good idea. And my wife said that she
- 4:21Speaker 4: heard somebody. She couldn't tell. She said somebody called me
- 4:25Speaker 4: yesterday or something.
- 4:27Speaker 3: Oh, yeah, your buddy Nick. You've launched a battle between
- 4:30Speaker 3: you and Nick.
- 4:32Speaker 4: Oh, yeah. She said it's because she said that you've
- 4:35Speaker 4: been so nice to me. She couldn't tell you the
- 4:37Speaker 4: word the other day. And then she said coddled. So
- 4:39Speaker 4: I wanted to let Nick know, listen, I'd be more
- 4:41Speaker 4: than willing to give two days of my Ron coddling
- 4:43Speaker 4: if you'd like. I'm not giving up.
- 4:46Speaker 3: I'm not giving up my JJ coddling.
- 4:51Speaker 5: No.
- 4:52Speaker 4: You've got your dad. You've got your rich. You've got many,
- 4:58Speaker 4: many children that you have to pull to your bosom. So,
- 5:00Speaker 4: you know, I just thought you'd be a little upset
- 5:03Speaker 4: about this. I will be more than happy to give
- 5:06Speaker 4: two of my four days.
- 5:07Speaker 3: Listen, all I know is.
- 5:12Speaker 2: The community just feels so bad for you because obviously
- 5:17Speaker 2: you're now going to the laundromat every other day. And,
- 5:26Speaker 2: I mean, you're walking with, like, first of all, you're
- 5:29Speaker 2: taking this laundry.
- 5:31Speaker 4: I put it on the back of the camel.
- 5:33Speaker 3: Right.
- 5:34Speaker 2: You're carrying all of this laundry to the laundromat. And,
- 5:37Speaker 2: of course, you're carrying all these quarters for the washers
- 5:40Speaker 2: and dryers.
- 5:41Speaker 3: It's unreal. Yes, just to watch it happen. Right.
- 5:43Speaker 4: I mean, it is.
- 5:44Speaker 3: I mean, the public is just like Clinton.
- 5:47Speaker 4: Would say, the public feels your pain. Let me put
- 5:50Speaker 4: it that way. Yeah, we're going to pull it up.
- 6:06Speaker 4: We're going to consolidate, I think, with some things because
- 6:09Speaker 4: of that. Times are, it's only if we work something out.
- 6:11Speaker 2: So how are you and the girls getting along down
- 6:15Speaker 2: at the laundromat?
- 6:18Speaker 4: Oh, we're fine. We're all knitting and talking and we're
- 6:23Speaker 4: talking about Aunt May's grandson.
- 6:27Speaker 3: Do they have a television?
- 6:30Speaker 6: Jamie, I don't know.
- 6:32Speaker 2: Do they have a television on so that when you're
- 6:34Speaker 2: watching your clothes spin?
- 6:36Speaker 7: Well, no.
- 6:36Speaker 4: What I do is I just go over, I put
- 6:38Speaker 4: them in. I mean, I'm like, it's really a stone's
- 6:40Speaker 4: throw away. So I go in and put them in there.
- 6:42Speaker 4: The people know me. I put them in there and
- 6:43Speaker 4: then I leave. I come back home. I know what
- 6:44Speaker 4: time it'll be done. And I just go over as
- 6:46Speaker 4: they're finishing up and put them in the dryer and
- 6:48Speaker 4: then come back again. And so I just do a
- 6:51Speaker 4: little rotating and sitting, just standing there because I got
- 6:53Speaker 4: stuff I could do here. And I'll just finish up
- 6:55Speaker 4: the grass today. So I can't drop everything because I'm
- 6:59Speaker 4: breathing problems or something. I got to do a lot
- 7:00Speaker 4: for the good. So, but other than that, I can
- 7:04Speaker 4: still get some blankets done and I should be cool.
- 7:06Speaker 2: Well, my goal now, you know, my goal is, uh,
- 7:10Speaker 2: to bring, uh, to bring, uh, uh, Nick, uh, uh,
- 7:14Speaker 2: Closer to J.J.
- 7:15Speaker 3: The Trumpster.
- 7:16Speaker 2: You know, you've made this monumental change to say you're
- 7:18Speaker 2: going to vote Republican if you can get $ 5, 000 because
- 7:22Speaker 2: you need a new washer and dryer. And so you're
- 7:25Speaker 2: willing to vote Republican. And I would think Nick would
- 7:28Speaker 2: embrace that, your change, your stance.
- 7:31Speaker 4: If that was going to happen, he was going to
- 7:33Speaker 4: vote for Kamala. So he was going to put his
- 7:35Speaker 4: vote toward Thomas. So I said to myself, in my
- 7:38Speaker 4: head that I have him wandering around in, I have
- 7:41Speaker 4: him in my head and I'm going, that's it. This
- 7:43Speaker 4: is the way to do it. I have to let
- 7:45Speaker 4: him get into my head. And then he'll say, I
- 7:47Speaker 4: can't have him become a Trumpster.
- 7:49Speaker 8: I'll become.
- 7:51Speaker 4: Whatever. He'll side with the Democrats. Maybe my devious way
- 7:56Speaker 4: I'm thinking here is going to work out. But remember,
- 7:59Speaker 4: it's slow with Savant.
- 8:03Speaker 9: Okay?
- 8:04Speaker 4: And highly functioning ignoramus. So he's instead of the moron stuff,
- 8:09Speaker 4: he's got to be PC. So I prefer my insults
- 8:13Speaker 4: the way they're supposed to be said. So let him
- 8:16Speaker 4: know to relax a little bit. He's got grandchildren.
- 8:19Speaker 2: Yes. Okay.
- 8:20Speaker 4: Tell him to chill, man.
- 8:21Speaker 3: Tell him to chill. There it is.
- 8:23Speaker 2: J.J.
- 8:23Speaker 3: The Trumpster from the laundromats. News Radio 5. Tell Nick
- 8:26Speaker 3: to chill. Yes, indeed.
- 8:32Speaker 2: Well, let's take a look at the stock market. It's
- 8:34Speaker 2: all in the red today. S & P 500 is
- 8:36Speaker 2: a little changed as traders weigh rising yields against optimism
- 8:41Speaker 2: over a straight of Hormuz. I don't know.
- 8:47Speaker 3: Why do they have optimism over that? We shall see.
- 8:50Speaker 3: We shall see.
- 8:53Speaker 2: Senate narrowly votes down resolution calling for end to Iran war.
- 8:58Speaker 3: How about that?
- 9:00Speaker 2: Oil prices pull back from session highs after report of
- 9:05Speaker 2: talks for phased reopening of straight. Big business warns Trump
- 9:13Speaker 2: against diesel export ban in joint letter. We've got a
- 9:17Speaker 2: big problem as far as refining is concerned.
- 9:20Speaker 3: You're on the air. Hello.
- 9:23Speaker 9: JJ, he's finally found out. how to approach your program
- 9:28Speaker 9: and get his point across. He finally figured it out.
- 9:32Speaker 3: Yes, and hopefully you're taking notes and lessons.
- 9:35Speaker 9: Yeah.
- 9:38Speaker 4: Oh, I am.
- 9:39Speaker 9: Believe me. Believe me.
- 9:42Speaker 3: I mean, JJ's a man. He has changed his approach 100%, and.
- 9:44Speaker 9: He's getting his point across. And I applaud him for it.
- 9:55Speaker 3: Yes.
- 9:56Speaker 2: Maybe you should adopt it yourself and you'll be able
- 9:59Speaker 2: to get your point across. Of course, you're the type
- 10:01Speaker 2: of guy, I mean, you know, all people need to
- 10:03Speaker 2: know is when we look at these people that go
- 10:05Speaker 2: to the No Kings rally and we say, who are
- 10:07Speaker 2: these kooks?
- 10:08Speaker 3: That would be you.
- 10:11Speaker 9: When you were talking about the Jerry Springer show, though,
- 10:14Speaker 9: is that the U.N.? Yes. That's how 70% of the nation...
- 10:19Speaker 9: views the whole administration from day one. He's the Jerry
- 10:23Speaker 9: Springer on steroids, and he happens to be sitting in
- 10:26Speaker 9: the Oval Office.
- 10:28Speaker 2: So you're upset because he tells it like it is
- 10:31Speaker 2: at the U.N. I mean, it's not a bunch of
- 10:33Speaker 2: boring soliloquies that mean absolutely nothing like we've seen over
- 10:37Speaker 2: the years.
- 10:38Speaker 3: From Republicans and Democrats.
- 10:39Speaker 9: I want to remind you of one thing.
- 10:40Speaker 3: Yes.
- 10:41Speaker 9: And that is, the other day, yesterday or the day before,
- 10:44Speaker 9: there was a caller that called in And he said
- 10:48Speaker 9: that we should kill them all. And you got very
- 10:52Speaker 9: angry at him, and you cut him off. Now, at
- 10:56Speaker 9: the UN, Trump was at the UN. One of his
- 11:02Speaker 9: wonderful speeches was how he was going to annihilate the
- 11:06Speaker 9: whole nation. And I find that, but I didn't hear
- 11:10Speaker 9: one word come out of you as far as saying
- 11:15Speaker 9: that that was totally wrong. totally wrong to want to
- 11:19Speaker 9: say I'm going to annihilate a whole country. When is
- 11:25Speaker 9: the killing going to stop?
- 11:27Speaker 3: Well, listen, you hear from me on a regular.
- 11:30Speaker 4: What he.
- 11:30Speaker 9: Said at the U.N. is most of it, listen, when
- 11:34Speaker 9: Donald Trump opens his mouth, he's lying.
- 11:37Speaker 1: Okay.
- 11:40Speaker 9: That's the way I feel. I can't help it. I
- 11:45Speaker 9: can't help it. He opens his mouth, he's lying.
- 11:51Speaker 3: So what do you want to do now? I mean.
- 11:55Speaker 9: I want to vote him out of office. Well, he's leaving.
- 11:58Speaker 9: Hopefully he's leaving.
- 11:59Speaker 3: Well, not for two years.
- 12:01Speaker 9: I know. Well, let's hope come November we turn everything
- 12:06Speaker 9: around and we have it so that he is basically
- 12:10Speaker 9: hostage in that Oval Office.
- 12:14Speaker 3: So you'll be voting, hoping the Democrats win?
- 12:16Speaker 9: I have no other way to put it.
- 12:25Speaker 2: And so you want to go back to those Democrat.
- 12:27Speaker 3: Oh, no, no, no. That's what you're voting for.
- 12:31Speaker 4: I'll start with this.
- 12:33Speaker 9: There's just children and their operations, and that is just clickbait.
- 12:38Speaker 9: That's all. That's all that is.
- 12:40Speaker 3: That's done.
- 12:40Speaker 9: That's over. Everybody knows that that's not happening. We're not
- 12:45Speaker 9: going back to anything. We're going to go forward. We're
- 12:48Speaker 9: going to get this country to go forward.
- 12:49Speaker 2: Have you seen all the Democrat socialists that the party
- 12:53Speaker 2: is going in the far left direction of?
- 12:57Speaker 9: We're going to go in another direction.
- 13:00Speaker 3: It doesn't appear.
- 13:01Speaker 9: If it's socialism, that's what it's going to be. Now,
- 13:04Speaker 9: I never thought like this my whole life. My whole life,
- 13:07Speaker 9: I never thought like this. Okay? But you're at a
- 13:11Speaker 9: point in history now where you have to make a change.
- 13:16Speaker 9: So we're going to make a change. I was a
- 13:19Speaker 9: Republican before. I voted for the other person. I never
- 13:24Speaker 9: ever voted straight Democrat, straight whatever, never in my whole life.
- 13:29Speaker 5: Never?
- 13:31Speaker 2: Yeah.
- 13:32Speaker 9: The best man should have that position, and that best
- 13:35Speaker 9: man is not in that White House right now.
- 13:40Speaker 3: Well, he's there. He won. He's going to be there.
- 13:42Speaker 8: Yeah, I know.
- 13:43Speaker 9: I know he won't.
- 13:44Speaker 4: I know. I know.
- 13:45Speaker 9: And it baffles me to no end as to how
- 13:49Speaker 9: that happened. It really does. I just can't believe that
- 13:52Speaker 9: there are that many people in this country that are
- 13:55Speaker 9: going to be bamboozled by a con man. And then
- 14:00Speaker 9: what's it got going on with his son-in-law over there?
- 14:04Speaker 9: He's not even looking for the government, but yet he's
- 14:08Speaker 9: making deals with these people overseas. I mean, come on.
- 14:11Speaker 9: And who's he got, another real estate executive with him?
- 14:15Speaker 9: They're setting policy. You don't ever hear about Rubio. Where's Rubio?
- 14:20Speaker 9: You don't ever hear anything about the guy. This is
- 14:23Speaker 9: beyond laughable. It's crazy. It's insane.
- 14:26Speaker 4: It really is.
- 14:34Speaker 9: And how can you sit there day after day after
- 14:39Speaker 9: day and say how great this guy is?
- 14:44Speaker 2: Well, quite frankly, I'm a little disappointed in you in
- 14:47Speaker 2: the following sense. Listen, I've been critical of President Trump
- 14:54Speaker 2: with the war in Iran. I've been critical of President
- 14:57Speaker 2: Trump with the Kennedy Center and the naming nonsense. See,
- 15:02Speaker 2: I'm not a cheerleader for Trump. I've been critical of
- 15:05Speaker 2: those two situations and the Epstein files. I apologize.
- 15:10Speaker 9: I apologize. Yes, you have.
- 15:14Speaker 2: And all the Trump mega nation gets upset with me
- 15:18Speaker 2: because I dare criticize the leader. But guess what? Doesn't
- 15:23Speaker 2: matter to me if they're Republican or Democrat, it's an American.
- 15:26Speaker 2: I'm going to tell you if I see things differently,
- 15:28Speaker 2: and I do. I think he created a mess in Iran.
- 15:31Speaker 2: I don't think he knows how to get out of it.
- 15:33Speaker 2: I think we got a giant economic mess as a.
- 15:36Speaker 3: Result of it.
- 15:37Speaker 2: And I think it's getting, I'll be the first to say,
- 15:40Speaker 2: I think it's getting worse in the Ukraine, not better.
- 15:43Speaker 2: And I think the mess in Iran is a disaster.
- 15:47Speaker 2: And I think one of the huge problem is in
- 15:50Speaker 2: the Ukraine, they're, They're flying these drones and destroying inside
- 15:55Speaker 2: Russia against what Trump's wishes, incidentally. The refining capacity for
- 16:01Speaker 2: diesel fuel, we're very dependent to a certain extent on
- 16:05Speaker 2: Russia for diesel. So they're flying these drones and destroying
- 16:09Speaker 2: the refining capacity.
- 16:11Speaker 9: What do you expect the Ukrainians to do? What do
- 16:15Speaker 9: you want them to do? They have the capability to
- 16:17Speaker 9: defend themselves.
- 16:19Speaker 3: Well, I'll tell you.
- 16:20Speaker 9: You're saying that because they're bombing these things in Russia
- 16:24Speaker 9: that we should go and tell Ukraine, no, you can't
- 16:28Speaker 9: do that?
- 16:29Speaker 3: Yeah, that's exactly.
- 16:30Speaker 9: Russia has started a war that should have never happened.
- 16:32Speaker 3: Well, that's exactly what Trump did.
- 16:34Speaker 9: It's not just what's going on against the Ukrainians. They're
- 16:37Speaker 9: doing what they can do to survive. That's nonsense about
- 16:43Speaker 9: you saying that you're telling Putin or Ukraine that you
- 16:48Speaker 9: shouldn't do that because you're making the– it's not Putin that–
- 16:52Speaker 9: it's not them that are making the price of that
- 16:54Speaker 9: oil go up.
- 16:54Speaker 3: Yes, it is. Yes, it is. I'll explain that when
- 16:57Speaker 3: I come back. Thank you. That's Fifth Avenue. I'll be
- 17:00Speaker 3: right back.
- 17:04Speaker 2: Casual Carpets is veteran-owned and celebrating over 40 pounds. News, weather,
- 17:08Speaker 2: and talk station, 570 WKBN. And Ron Verb from the
- 17:12Speaker 2: Kingdom of Mahoning, 324. Here's the problem. When Zelensky isn't
- 17:17Speaker 2: listening to Trump, when Trump says, we don't want you
- 17:20Speaker 2: to be destroying the refining capacity in Russia for diesel
- 17:27Speaker 2: because it creates a big shortage and increased prices for
- 17:32Speaker 2: the globe, for the globe. And Zelensky totally disregards what
- 17:37Speaker 2: Trump said. And as a result of it, you take
- 17:40Speaker 2: a look at what's happening to diesel prices. Because I
- 17:44Speaker 2: tried to explain this to folks before. Basically, in a nutshell,
- 17:48Speaker 2: we haven't built any refineries in the United States since
- 17:52Speaker 2: the 70s. So we don't have any new refineries. Our
- 17:57Speaker 2: refineries all, as I've said to you in the past,
- 18:01Speaker 2: need heavy crude oil. They were built and designed for
- 18:04Speaker 2: what's heavy crude. When you hear about our energy independence
- 18:08Speaker 2: and the oil that we get here, that we drill
- 18:10Speaker 2: in our country, it's light crude. It's light crude oil.
- 18:16Speaker 2: And our refineries... don't use light crude oil. It needs
- 18:22Speaker 2: heavy crude oil, which you get from Venezuela, Canada, the
- 18:25Speaker 2: Middle East. They were designed and built for that back
- 18:30Speaker 2: in the 70s. We have a builder refinery for the
- 18:33Speaker 2: longest period of time. So consequently, the light crude doesn't
- 18:35Speaker 2: do us much good. That's why we import a lot
- 18:38Speaker 2: of oil and export a lot.
- 18:40Speaker 3: Of our oil. Because, I mean, oil is oil, but.
- 18:45Speaker 2: A barrel of oil, you just got to refine it
- 18:47Speaker 2: to get gasoline and to get the chemicals and the
- 18:51Speaker 2: products out of it. You don't go put a barrel
- 18:53Speaker 2: of oil in your car as far as the gas
- 18:56Speaker 2: tank is concerned or the diesel tank is concerned. So
- 19:01Speaker 2: what Trump is arguing is we have our refining capacity,
- 19:05Speaker 2: Trump is arguing, in this country is about 98, 99 percent.
- 19:09Speaker 2: We are at maximum capacity as far as our ability
- 19:12Speaker 2: to refine. We don't have any area, any cushion there
- 19:18Speaker 2: at all. We are at full capacity. And you know
- 19:22Speaker 2: as well as I do, there's times when you've got
- 19:23Speaker 2: to go from winter fuel to summer fuel and vice versa,
- 19:27Speaker 2: when they have to shut down for cleaning processes and
- 19:29Speaker 2: that kind of stuff. But we haven't built a new
- 19:31Speaker 2: refinery for such a long period of time. What would
- 19:34Speaker 2: that be, 50-plus years? And so– Our refineries are for
- 19:40Speaker 2: heavy crude. We drill and we get sweet crude. Therein
- 19:44Speaker 2: lies the problem. And you need heavy crude for diesel.
- 19:47Speaker 2: So consequently, that's what they have. in Russia and these places.
- 19:51Speaker 2: And that's why Trump said to Zelensky, don't bomb the refineries.
- 19:57Speaker 2: And Zelensky did it anyway. And keeping in mind that
- 20:01Speaker 2: that goes right against Trump's wishes, saying it's going to
- 20:04Speaker 2: create an economic problem in the world and in the
- 20:08Speaker 2: United States. Because it's in short supply now. Then you
- 20:13Speaker 2: go to the Iran situation, and you got some of
- 20:19Speaker 2: the refining capabilities there being destroyed because of the war. Now,
- 20:25Speaker 2: these aren't things that can be repaired in a week
- 20:28Speaker 2: or two or a month. They say, the people in
- 20:31Speaker 2: the know say this takes a considerable amount of time
- 20:33Speaker 2: to fix this stuff that they're blowing up. So since
- 20:38Speaker 2: we don't have any more refining capabilities to expand, since
- 20:43Speaker 2: we need heavy crude to do that, since you see
- 20:45Speaker 2: these other refinery in places like Russia and in the
- 20:50Speaker 2: Middle East getting hit, guess what happens to your gas prices,
- 20:54Speaker 2: your diesel price or your gasoline price? What do you
- 20:58Speaker 2: think is going to happen? Now, the oil experts say, well,
- 21:04Speaker 2: guess what? Guess the only country, according to the oil experts,
- 21:07Speaker 2: that have additional refining capacity, according to the oil experts,
- 21:14Speaker 2: is China. That's the only country that has a big
- 21:17Speaker 2: cushion where they could refine more.
- 21:21Speaker 3: So it's really a mess.
- 21:24Speaker 2: So when Fifth Avenue is talking about how upset he
- 21:28Speaker 2: is with Trump that he told Zelensky not to hit China,
- 21:31Speaker 2: those refineries that are doing diesel.
- 21:33Speaker 3: That's why.
- 21:34Speaker 2: Because it's a global problem as far as diesel and
- 21:39Speaker 2: as far as the cost. And it makes the problem worse.
- 21:43Speaker 2: And Zelensky didn't listen. And Trump's got every right to say,
- 21:46Speaker 2: we've spent a lot of money and provided you with
- 21:49Speaker 2: a lot of weapons. And without us, you're nothing. So
- 21:55Speaker 2: he's got every right to say, who are you to
- 21:59Speaker 2: escalate this situation, make it worse.
- 22:02Speaker 3: That's all. That's all Fifth Avenue. Don't you get it?
- 22:04Speaker 3: You need diesel. I mean, good Lord, you're talking in
- 22:08Speaker 3: some cases you're getting.
- 22:09Speaker 2: Close to $ 7 a gallon for diesel. A truck gets
- 22:13Speaker 2: five to seven miles per gallon. It's getting ridiculous. We'll
- 22:18Speaker 2: be right back. News Radio 570 WKVN.
- 22:25Speaker 7: A man who intentionally set fire to a Toledo homeless
- 22:27Speaker 7: shelter earlier this year is being sentenced to serve 280
- 22:31Speaker 7: days in jail. Edward Belcher pleaded guilty to charges of
- 22:34Speaker 7: attempted aggravated arson for the April 27th blaze at the St.
- 22:38Speaker 8: Paul Community Center. No one was hurt in the fire.
- 22:42Speaker 7: Three people were left injured after a Tuesday night duplex
- 22:44Speaker 7: fire in Akron. A police officer is among the injured
- 22:47Speaker 7: and their condition has not been reported. The cause of
- 22:50Speaker 7: the Arch Street fire is not yet known. State lawmakers
- 22:54Speaker 7: in Ohio are being called back into session to vote
- 22:56Speaker 7: on an emergency fuel tax holiday. Both gubernatorial candidates Vivek
- 23:00Speaker 7: Ramaswamy and Amy Acton have suggested a pause on Ohio
- 23:04Speaker 7: fuel taxes in order to make prices at the pump
- 23:07Speaker 7: lower for residents. The Legislative Services Commission is drafting a
- 23:11Speaker 7: measure that would put those charges on hold for 90 days.

- 23:24Speaker 3: Never sounded so good. A to Z dependable services. Plumbing, septic, heating, cooling,
- 23:29Speaker 3: and one-day baths.
- 23:31Speaker 5: Dealing with your typical construction delay?
- 23:34Speaker 8: I have a problem right now that I'm dealing with
- 23:36Speaker 8: an insurance company on a personal level. And I've had
- 23:40Speaker 8: the fifth person now say, we need X, Y, and Z.
- 23:44Speaker 8: And I wrote a really stinging, nasty email, and I said,
- 23:47Speaker 8: I don't like how this sounds. It sounds like I'm
- 23:51Speaker 8: really mad. So I put it into the AI. I said,
- 23:56Speaker 8: say this how Dave Beatrice would say it. Be acerbic,
- 23:59Speaker 8: be direct, and tell them I'm going to sue them.
- 24:03Speaker 5: It came out meaner than the one you drafted. It did.
- 24:05Speaker 5: It came out meaner than the one you drafted, Ron.
- 24:07Speaker 5: It did come out meaner. His platform knows himself better
- 24:11Speaker 5: than me.
- 24:12Speaker 8: Even when it gave me that, I read it over.
- 24:14Speaker 8: I made some edits. I added some things. I still
- 24:19Speaker 8: haven't sent it out, but it's taken me a half hour,
- 24:22Speaker 8: even with the AI, to write this email. I'm upset.
- 24:32Speaker 8: I had three different people from a corporate office say,
- 24:36Speaker 8: you only have to deal with me for a week.
- 24:39Speaker 8: Then another guy. I'm the last guy you have to
- 24:41Speaker 8: deal with. Then another guy. Then an insurance adjuster who says,
- 24:45Speaker 8: I'm the last person you have to deal with. Send
- 24:47Speaker 8: me these things. I said, I've sent these twice now,
- 24:51Speaker 8: but I'll send them to you again. Then I get
- 24:53Speaker 8: now another adjuster saying, hey, I want to help out
- 24:56Speaker 8: on this. And I went, I'm done. I told Jimmy,
- 24:59Speaker 8: and Jimmy's getting copied on this email, to draft me
- 25:02Speaker 8: a lawsuit.
- 25:03Speaker 2: I'm done.
- 25:03Speaker 8: I'm finished. I'm finished. And I was dealing with, I
- 25:08Speaker 8: don't want to say the insurance company, but I was
- 25:09Speaker 8: dealing with my own insurance company on my own claim,
- 25:13Speaker 8: and I'm reading the policy. I'm reading the policy, and
- 25:17Speaker 8: I go, am I reading this wrong? And then I'm
- 25:21Speaker 8: looking at their letter, and then I'm looking at the policy,
- 25:23Speaker 8: and I go.
- 25:27Speaker 5: They're wrong.
- 25:28Speaker 6: So I write the guy an email.
- 25:30Speaker 8: I said, on this section of my policy, it says
- 25:35Speaker 8: if the claim is over $ 55, 000, you waive the deductible.
- 25:41Speaker 8: He goes, well, let me have someone from corporate look
- 25:43Speaker 8: at that. Three weeks later, I get a check for
- 25:47Speaker 8: the deductible. And I'm just thinking, how many people out
- 25:51Speaker 8: there don't take time to do what I did, to
- 25:54Speaker 8: read the policy, And look at their emails.
- 25:57Speaker 3: And understand what they're reading as you do.
- 26:01Speaker 8: And I'm just saying, how many insurance companies are doing
- 26:04Speaker 8: that to people? Because they tried to do it to me.
- 26:09Speaker 8: And I'm just like, this is amazing. Like, if I
- 26:12Speaker 8: didn't take the time to actually read my policy, like
- 26:18Speaker 8: I said, send me the policy, and then I'm looking
- 26:20Speaker 8: through it, and I'm looking at their letter, and I'm like,
- 26:22Speaker 8: something's not computing here. And they're still wrong. I mean,
- 26:27Speaker 8: they still owe me money, and I just don't have
- 26:30Speaker 8: the time to deal with them right now, but I will.
- 26:34Speaker 8: It's been a harrowing experience for me that squirrels got
- 26:39Speaker 8: into my attic. My life's not been the same.
- 26:43Speaker 6: You would have squirrels.
- 26:44Speaker 4: Squirrels?
- 26:45Speaker 8: Squirrels and mice. Got in through water damage from a storm.
- 26:51Speaker 8: That's how the insurance company wrote it up.
- 26:54Speaker 6: And then.
- 26:56Speaker 8: I had the insecticide people out, and they're going, oh,
- 27:00Speaker 8: look at all this water damage. So I had a
- 27:04Speaker 8: roofer come out. And he says, well, let me see
- 27:07Speaker 8: what the adjuster said. He said, oh, they've already said
- 27:10Speaker 8: it's from storm damage. This is all from storm damage.
- 27:13Speaker 8: I had blue tarps all over my roof.
- 27:16Speaker 6: Do you think you're a target from the insurance companies?
- 27:19Speaker 8: No, but I am not happy with... How they dealt
- 27:23Speaker 8: with me, because I'm thinking if they try to pull
- 27:26Speaker 8: that off on me, what are they doing to the
- 27:28Speaker 8: common people out there?
- 27:30Speaker 2: They're pulling it off on them, and they're going along
- 27:33Speaker 2: with it because they're not you.
- 27:35Speaker 3: You follow me? They're taking advantage of people. Would you
- 27:38Speaker 3: not agree?
- 27:39Speaker 8: Then they shouldn't. If you pay a policy. They should
- 27:43Speaker 8: deal with you in good– especially your own company.
- 27:45Speaker 6: They never do.
- 27:46Speaker 8: They should deal with you in good faith.
- 27:47Speaker 6: They never do.
- 27:49Speaker 8: Well, I'm saying, but they haven't– their legal obligation is
- 27:52Speaker 8: to do that.
- 27:52Speaker 6: They don't care about their legal obligation.
- 27:54Speaker 10: That's why we love UIM and UM Clay, because it's
- 27:57Speaker 10: a great argument in opening that you've trusted them for
- 28:00Speaker 10: 30 years on the premiums, and, oh, by the way,
- 28:04Speaker 10: the time that you get catastrophically hurt, they don't want
- 28:06Speaker 10: to pay you. But David would be the worst plaintiff
- 28:08Speaker 10: to have in that case, because if I was defending
- 28:10Speaker 10: the case, I would put up– all his posts about
- 28:13Speaker 10: insurance companies, and I'd play that.
- 28:15Speaker 2: No, but all Dave is saying is, listen, here's what
- 28:18Speaker 2: I pay for, and here's what my policy says, and
- 28:20Speaker 2: you guys are screwing me.
- 28:23Speaker 5: It's not even that. You can't get a hold of them.
- 28:26Speaker 5: That's the problem.
- 28:27Speaker 10: I have a claim on my wife's car for nine months.
- 28:34Speaker 10: And I can't even– we've been through three adjusters. I'm like,
- 28:36Speaker 10: can somebody just get this car fixed, please?
- 28:39Speaker 8: This is the fifth adjuster on this claim now.
- 28:41Speaker 5: You can't get a hold of them. That's the problem.
- 28:43Speaker 3: On your house?
- 28:44Speaker 8: And the last adjuster I dealt with, Frank, she said,
- 28:47Speaker 8: I'm the last person you have to deal with. I
- 28:48Speaker 8: get an email today. Hey, so-and-so told me to reach
- 28:52Speaker 8: out to you. I'm going, nope. No, you cannot have
- 28:54Speaker 8: a recording for my wife. No, I'm not giving you
- 28:56Speaker 8: any more documents. I've been dealing with this since May.
- 29:00Speaker 8: I've sent the documents out. You know what you're going
- 29:03Speaker 8: to get? You could take my wife's deposition in a lawsuit.
- 29:06Speaker 8: That's what you can do.
- 29:07Speaker 10: What do you tell them when they say you're on
- 29:09Speaker 10: a recorded line? Because I've now adopted a new line
- 29:12Speaker 10: in response.
- 29:12Speaker 3: What is it?
- 29:13Speaker 5: And then they freeze. They'll say, we're so-and-so calling. We're
- 29:17Speaker 5: on a recorded line. I said, thank you. I'm also
- 29:19Speaker 5: recording you on a recorded line. And they freeze. They
- 29:21Speaker 5: don't know what to say. And I'm like, honestly.
- 29:23Speaker 8: I don't care that I'm on a recorded line. I
- 29:25Speaker 8: hope they recorded some of my conversations with all of
- 29:28Speaker 8: these people. It's ridiculous. I'm dealing with this guy. Just
- 29:33Speaker 8: deal with me. Then someone else reaches out to me
- 29:35Speaker 8: from the company. No, I'm handling it now. First guy goes, no,
- 29:38Speaker 8: I'm handling it. Then a third guy comes in and says, well,
- 29:41Speaker 8: I'm over both of them.
- 29:42Speaker 6: That's what they do. I have the same thing. I
- 29:43Speaker 6: have a claim against on my roof right now, and
- 29:47Speaker 6: they denied coverage. They said that the damage, you know,
- 29:51Speaker 6: they're measuring the hail marks and the damage to my
- 29:55Speaker 6: shingles and my roof. So little do they know that
- 29:58Speaker 6: I'm just going to keep. pressing them you ever heard
- 30:01Speaker 6: of uh junk science yeah oh it's it's it's unbelievable i.
- 30:05Speaker 8: Love when they when they say when i'm adjusting a
- 30:08Speaker 8: claim well we had our medical expert look at it
- 30:11Speaker 8: and says that you know your client treated too much
- 30:14Speaker 8: and i was like oh so you had just someone
- 30:16Speaker 8: that you pay look at their bill and you made
- 30:19Speaker 8: a determination that they didn't need this treatment never saw
- 30:23Speaker 8: them never laid their hands on them and never talked
- 30:25Speaker 8: to my client so what's the.
- 30:27Speaker 10: Bottom line Honestly, I love those cases because there's nothing
- 30:30Speaker 10: better than those cross-examinations.
- 30:31Speaker 5: They are my favorite.
- 30:33Speaker 6: But what's the bottom line about insurance companies?
- 30:35Speaker 8: You've got to stay on top of them. Just like
- 30:38Speaker 8: when you're in a hospital, you've got to stay on
- 30:40Speaker 8: top of your care.
- 30:42Speaker 2: But do you think the average person does all this, Dave?
- 30:45Speaker 3: Do they know you're a lawyer?
- 30:51Speaker 5: Yes. That's what it tells me.
- 30:52Speaker 8: It's coming from my email. It says Dave Beatrice, licensed
- 30:56Speaker 8: in Ohio, Pennsylvania, Florida, soon to be New York.
- 31:01Speaker 3: And they treat you this way.
- 31:02Speaker 8: Yeah, that's coming. You would think that they would go,
- 31:05Speaker 8: maybe we should.
- 31:05Speaker 5: Are you going to go in the Southern District of
- 31:07Speaker 5: New York?
- 31:07Speaker 8: No, no, New York State.
- 31:09Speaker 2: Yeah.
- 31:11Speaker 3: And they're treating you this way, Frank?
- 31:12Speaker 8: No, I just.
- 31:13Speaker 6: They're squeegee. Yeah, they denied it. And I just said, okay,
- 31:18Speaker 6: that's fine. Now you're just going to get the full
- 31:20Speaker 6: court press.
- 31:21Speaker 2: Now what do you do after they deny it? Do
- 31:24Speaker 2: they just take you? Are you taking them to court then, Frank,
- 31:26Speaker 2: or what?
- 31:27Speaker 8: You know, before you answer, Frank, you know what I
- 31:30Speaker 8: say to them? Honest to God, I say, listen, I
- 31:34Speaker 8: have a license to sue, and I'm willing to use it.
- 31:39Speaker 5: Let me be clear. I love when anybody starts.
- 31:41Speaker 6: That's essentially what I said to this guy. I said,
- 31:45Speaker 6: We're going to go back and forth a little bit,
- 31:46Speaker 6: and then I'm just going to sue you. No, I'm
- 31:48Speaker 6: tired of it. You guys, it's all the same. I
- 31:51Speaker 6: can't wait to collect my checks. You can't wait. And
- 31:53Speaker 6: then anytime somebody has a claim, they don't want to
- 31:57Speaker 6: deal with it.
- 31:58Speaker 5: I say this to everybody, honestly. If they treated you fairly,
- 32:02Speaker 5: if insurance companies treated you fairly, we would be in
- 32:04Speaker 5: a different business. But they don't.
- 32:07Speaker 8: Right.
- 32:08Speaker 6: And they do not. They don't discriminate.
- 32:11Speaker 4: No.
- 32:14Speaker 6: They screw everybody.
- 32:15Speaker 8: What I'm trying to figure out is how many John Q.
- 32:19Speaker 8: Publix out there don't pick up their policy, don't read it,
- 32:24Speaker 8: and just take what the adjuster says.
- 32:26Speaker 6: It's not fair to people because what these insurance companies
- 32:29Speaker 6: know is they know.
- 32:30Speaker 3: They always do.
- 32:32Speaker 6: Because probably 8 out of 10 people just walk away. Like, well,
- 32:35Speaker 6: they denied my coverage. What am I going to do?
- 32:37Speaker 2: Hold that thought, Frank. Hold that thought. We're at our
- 32:40Speaker 2: half-hour break. We'll come back with more. The Legal Show
- 32:43Speaker 2: brought to you by Beatrice Kopp. And these guys are fascinating.
- 32:45Speaker 2: And I think we all can relate to what they're saying.
- 32:47Speaker 2: I'm Dr.
- 32:47Speaker 3: Cheryl Figliano from Centers for Disease.
- 32:49Speaker 1: September 26th, two of combat sports' most dangerous strikers collide.

- 33:20Speaker 2: can help you by the program participants.
- 33:24Speaker 3: Now, Ron Verb.
- 33:26Speaker 1: On NewsRadio 570 WKBN.
- 33:29Speaker 2: What a fascinating first half of the program on NewsRadio
- 33:32Speaker 2: 570 WKBN. This is a legal show brought to you
- 33:35Speaker 2: by Beatrice Kopp. And I think as I listen to
- 33:38Speaker 2: these guys talk, I think everybody can relate to what
- 33:40Speaker 2: they're saying. I mean, you're hearing, you know, one of, obviously,
- 33:44Speaker 2: Frank Cassis, a great attorney, that's saying, you know, his
- 33:46Speaker 2: claim is denied when it comes to his roof. And
- 33:49Speaker 2: they keep denying it. You hear Dave Beatrice, obviously a
- 33:53Speaker 2: great attorney, and the insurance companies are denying their claim.
- 33:57Speaker 2: And the point that Dave is making is just eye-opening.
- 34:01Speaker 2: I think we're all guilty of it. None of us
- 34:03Speaker 2: read our policies. We just accept what they say to us.
- 34:06Speaker 2: And I think Dave is spot on. And we just
- 34:08Speaker 2: move on and accept it. And that's not something we
- 34:12Speaker 2: should be doing, apparently. We should all be reading a policy,
- 34:15Speaker 2: as Dave did, and said, wait a minute, what you're
- 34:17Speaker 2: telling me It's nonsense.
- 34:19Speaker 3: Right, David?
- 34:19Speaker 2: Absolutely.
- 34:22Speaker 3: All right, turn his mic back on.
- 34:23Speaker 8: Turn your mic on.
- 34:24Speaker 5: Absolutely.
- 34:25Speaker 8: Thank you, Frank.
- 34:25Speaker 2: Yep.
- 34:26Speaker 8: I want to let everyone know that Frank has been
- 34:29Speaker 8: nominated as.
- 34:31Speaker 6: Okay, okay.
- 34:33Speaker 8: Never mind.
- 34:33Speaker 6: No, no.
- 34:34Speaker 8: No, never mind.
- 34:35Speaker 6: No, I don't want to get yelled at.
- 34:36Speaker 8: No, you're not getting yelled at. I'm just not going
- 34:38Speaker 8: to say anything then.
- 34:39Speaker 5: I'm just going to carry on longer.
- 34:40Speaker 6: All right, just go ahead, please.
- 34:41Speaker 8: No, I'm not going to do it now.
- 34:42Speaker 6: Please proceed.
- 34:42Speaker 8: No, absolutely not.
- 34:44Speaker 3: Hey, Frank, what did you get nominated for?
- 34:46Speaker 6: I don't even know, to be honest with you.
- 34:48Speaker 8: Well, he was nominated as Lawyer of the Year by
- 34:53Speaker 8: the Bar Association, but you knew that. And then he's
- 34:57Speaker 8: up in the Vindicator for People's Choice Awards.
- 35:00Speaker 3: Really? That's fantastic. I mean, that is absolutely fantastic.
- 35:06Speaker 2: So the bottom line is, Frank, just so our listeners understand,
- 35:09Speaker 2: you are going to be suing your insurance company, the
- 35:12Speaker 2: people you pay the premiums to, for denying your claim, correct?
- 35:15Speaker 6: Yes, that's correct.
- 35:17Speaker 2: And Attorney Beatrice has been going on for a long
- 35:19Speaker 2: time with his insurance company to say what you guys
- 35:23Speaker 2: are saying is a lie. He shows it to them,
- 35:25Speaker 2: and all of a sudden they give him his deductible back.
- 35:29Speaker 8: Yeah, and they still owe me money. And they go, well,
- 35:32Speaker 8: we'll give you the money when you replace the siding.
- 35:35Speaker 8: And I go, no, you're going to give me the money.
- 35:38Speaker 8: Whether I want to replace the siding or not now
- 35:40Speaker 8: or next year is my business.
- 35:42Speaker 6: Yeah.
- 35:43Speaker 8: I hate when they do that.
- 35:45Speaker 2: Yeah.
- 35:45Speaker 8: And now I've got to go fight with them over that.
- 35:48Speaker 3: And Melfi has the same problem with a car problem.
- 35:51Speaker 5: My wife's car.
- 35:52Speaker 10: The funny thing is I'm in trial against Liberty Mutual
- 35:55Speaker 10: in four weeks, and they're my carry. I always wonder, like,
- 35:58Speaker 10: these lawyers that we deal with all the time going against–
- 36:02Speaker 10: My wife got in an accident.
- 36:03Speaker 5: If I got sued for my wife getting.
- 36:05Speaker 10: Into a crash because I own a car, I don't
- 36:07Speaker 10: think I'd be really interested to be represented on the
- 36:10Speaker 10: other side.
- 36:11Speaker 2: Really?
- 36:12Speaker 5: Yeah.
- 36:13Speaker 3: Not good?
- 36:15Speaker 5: They probably wouldn't try too hard for me.
- 36:18Speaker 3: Oh, okay. I got you.
- 36:20Speaker 5: That makes sense.
- 36:21Speaker 3: Yeah, that does. It makes perfect sense.
- 36:23Speaker 2: But I don't think there's a person out there that
- 36:25Speaker 2: can't relate to what you guys are saying. But I
- 36:27Speaker 2: think we're all stunned by the fact that that's happening
- 36:31Speaker 2: to all of you.
- 36:32Speaker 3: And you're all lawyers.
- 36:34Speaker 6: Yep. They don't discriminate.
- 36:36Speaker 5: You can't get them on the phone. Then they call
- 36:37Speaker 5: you in the middle of the workday. They know you're working.
- 36:40Speaker 6: Well, you know that you love to. You get 9,000 recordings.
- 36:44Speaker 6: Press 1. Press 5.
- 36:46Speaker 8: Oh, I can't stand that.
- 36:49Speaker 5: You're talking to a robot.
- 36:51Speaker 6: I just keep saying customer service.
- 36:56Speaker 8: I can't stand it when you press the wrong button.
- 36:58Speaker 8: Then you've got to redial and go, that was the
- 37:00Speaker 8: wrong button to press.
- 37:01Speaker 5: I want a human. I just say that until I
- 37:05Speaker 5: get somebody.
- 37:06Speaker 8: Yeah, human, claim representative, human being.
- 37:10Speaker 2: But Dave, you are actually speaking to in-person appraisers, and
- 37:15Speaker 2: they keep shifting you to someone else. They are truly
- 37:18Speaker 2: giving you the runaround.
- 37:19Speaker 8: Here's what happened. I hired a company to do a job.
- 37:24Speaker 8: The company then subcontracted it out, someone to do part
- 37:28Speaker 8: of the job. The company they subcontracted it out really
- 37:32Speaker 8: messed up. So the main company goes, Well, we didn't
- 37:38Speaker 8: do that. They did. And I go, no, that's not
- 37:41Speaker 8: how it works. You hired them. I didn't hire them. Okay?
- 37:46Speaker 8: So then I'm dealing with someone from the main company.
- 37:50Speaker 8: Then a supervisor from the main company calls me and says,
- 37:53Speaker 8: I'm going to be handling it now. Send me X, Y,
- 37:55Speaker 8: and Z. I send him X, Y, and Z. Then
- 37:57Speaker 8: a third guy from the company calls me and says,
- 38:00Speaker 8: I'm the supervisor of this part of the United States.
- 38:03Speaker 8: I'm going to be handling it. Can you send me X, Y,
- 38:06Speaker 8: and Z? I said, I already sent you it, but
- 38:08Speaker 8: I'll send it again. Then I get an email from
- 38:11Speaker 8: an insurance adjuster. Hey, Dave, I'm sorry you've had a
- 38:16Speaker 8: hard time, but I'm the last person you have to
- 38:18Speaker 8: deal with.
- 38:19Speaker 5: They're laughing when they send you that email.
- 38:21Speaker 8: I know that. That was one insurance company. Then today
- 38:26Speaker 8: I get an email from another insurance company, so I
- 38:29Speaker 8: know what happened. They put the subcontractor on notice. The
- 38:32Speaker 8: subcontractor turned it over to his insurance company, and now
- 38:35Speaker 8: they want to deal with me. I'm like, no. I'm done.
- 38:39Speaker 8: I'm done. I should have been given an offer to
- 38:41Speaker 8: settle already. I'm done. I'm finished. You ruined my driveway.
- 38:46Speaker 8: You ruined my driveway. I've instructed. Jimmy and my lawsuits
- 38:53Speaker 8: never seem to go.
- 38:54Speaker 5: Actually, you know what?
- 38:55Speaker 10: When you first told me about it, I was brainstorming,
- 38:59Speaker 10: and I think I'm going to bring an action.
- 39:01Speaker 1: RC5101.
- 39:01Speaker 7: 60.
- 39:06Speaker 8: Consumer sales practices act?
- 39:08Speaker 10: No, that is designed to prevent and punish abuse, neglect,
- 39:11Speaker 10: and financial exploitation of adults 60 and older.
- 39:14Speaker 2: Oh, yes.
- 39:15Speaker 5: It's what we call the elder abuse statute.
- 39:17Speaker 6: Adults 60 and older with broken dinghies.
- 39:21Speaker 8: Don't get me started, Frank.
- 39:22Speaker 5: The elder abuse statute.
- 39:24Speaker 2: Now, seriously, Jimmy, Beatrice has a good case. Would you
- 39:27Speaker 2: not say on this what he's been going through here?
- 39:30Speaker 2: It's astonishing to, I think, to our listeners that this
- 39:34Speaker 2: is happening to all three of you. All three of
- 39:36Speaker 2: you are lawyers getting jerked around by insurance companies with
- 39:39Speaker 2: your own policies.
- 39:42Speaker 5: You know what the greatest thing is, though?
- 39:45Speaker 10: David has more cameras than Fort Knox, so nobody can
- 39:48Speaker 10: say it was somebody else.
- 39:50Speaker 2: No.
- 39:51Speaker 8: You know what's funny is when I had a guy
- 39:54Speaker 8: out to look at it.
- 39:55Speaker 2: Can you remind those guys David's also the only one
- 39:57Speaker 2: that had a pipe bomb?
- 39:58Speaker 3: Can we just let it go?
- 39:59Speaker 8: That's one of the great ones. Oh, really?
- 40:02Speaker 3: If you guys are going to get on Beatrice's head.
- 40:04Speaker 8: And that wasn't the first time I was threatened in
- 40:06Speaker 8: my life. Do you understand that?
- 40:07Speaker 5: That's chapter two in his memoir.
- 40:09Speaker 8: You have to ask Frank. He was a brand new lawyer.
- 40:13Speaker 8: I took him into a trap house. He didn't think
- 40:15Speaker 8: we were going to get out of there alive.
- 40:17Speaker 6: Oh, Ron.
- 40:19Speaker 5: I've never heard that story.
- 40:20Speaker 6: Oh, I'll tell you. Me and Beatrice are trying a
- 40:23Speaker 6: murder case, right? So he's like, okay, it's a Sunday.
- 40:27Speaker 6: It's in the winter. So we go.
- 40:30Speaker 8: I go, we got to track down some of these witnesses.
- 40:33Speaker 6: So we go to a couple of taverns that, you know,
- 40:38Speaker 6: these people were in throughout the night and we're talking
- 40:40Speaker 6: and going through and so he's like, we got to
- 40:43Speaker 6: find this house with auntie. And I said, okay. So,
- 40:48Speaker 6: you know, we're on the South side and we're looking
- 40:51Speaker 6: for the house and we're not sure where it is. And, um,
- 40:54Speaker 6: so we're kind of, we're, we're kind of knocking on doors.
- 40:57Speaker 3: And, Oh, that's a good idea. Yeah.
- 40:59Speaker 5: Right.
- 41:00Speaker 6: That didn't bother me all that much. I was honestly
- 41:02Speaker 6: more worried about a stray dog coming up and biting
- 41:04Speaker 6: me than anything. Cause I'm like, so we're walking and,
- 41:08Speaker 6: I'm like, I think this is the house, because what
- 41:10Speaker 6: we did is we kind of worked backwards, and they
- 41:13Speaker 6: described it. So I'm like, this looks like the house.
- 41:15Speaker 6: So we knock on the door.
- 41:17Speaker 8: And the answers.
- 41:18Speaker 6: And we're like, do you know Auntie? And she's like,
- 41:22Speaker 6: I'm Auntie. And we're like, Auntie, thank you. Can we
- 41:26Speaker 6: talk to you? Yeah, we talked to you.
- 41:28Speaker 8: Come on in.
- 41:29Speaker 6: So she says, come on in. Well, now the neighbors
- 41:33Speaker 6: are starting to kind of gather around, and And.
- 41:36Speaker 8: It's very dark inside the house.
- 41:38Speaker 3: Yeah, it was.
- 41:39Speaker 6: The house was. It was like an afternoon. I don't
- 41:43Speaker 6: think it was too gloomy outside, but it was an afternoon.
- 41:45Speaker 6: And we go in the house, and it's dark. There's
- 41:49Speaker 6: no lights on. And the TV's on, and her husband's
- 41:53Speaker 6: sitting in the chair. And we sit down on the couch,
- 41:57Speaker 6: and I'm on the edge of the couch, and I'm
- 42:00Speaker 6: looking at the door. And David, for his... Street savvy
- 42:06Speaker 6: as David is, sometimes he can be a little clueless.
- 42:08Speaker 6: And he's just, Auntie, thanks for inviting us in. And
- 42:11Speaker 6: we're sitting there, and I'm kind of looking around at
- 42:13Speaker 6: my surroundings.
- 42:15Speaker 8: We see figures moving.
- 42:16Speaker 6: No, you don't see anything. So we're sitting talking to her,
- 42:20Speaker 6: and she says, you know, baby, sit down. Make yourself comfortable.
- 42:23Speaker 6: I'm like, thank you, I am. I'm sitting on the
- 42:25Speaker 6: edge of the couch.
- 42:26Speaker 8: Baby lawyer.
- 42:27Speaker 6: Yeah, baby lawyer. And I'm looking. And in this next room,
- 42:31Speaker 6: there's like this living room, sitting room, which would be
- 42:34Speaker 6: an archway into a dining room. And there's two couches
- 42:39Speaker 6: on each side of the wall. And I see the
- 42:41Speaker 6: couches moving. And I'm like, there's like blankets on it.
- 42:45Speaker 3: I'm like, there's movement.
- 42:47Speaker 6: I'm like, oh, my God, we're in a crack house.
- 42:49Speaker 5: Yeah, he's like, Frank's thinking he's Joe Pesci.
- 42:52Speaker 6: So now I'm thinking.
- 42:53Speaker 5: It's good fellas, Joe Pesci. That's what's in Frank's head.
- 42:55Speaker 4: Right.
- 42:56Speaker 6: And I'm like.
- 42:57Speaker 8: We're really in a flop house.
- 42:58Speaker 6: Like, because, you know.
- 43:00Speaker 3: We don't work.
- 43:02Speaker 6: They don't know we're defense lawyers, right? I mean, they
- 43:04Speaker 6: don't really know what we're doing. We're not in suits.
- 43:06Speaker 6: And honestly, you don't know. I mean, I always tell
- 43:09Speaker 6: people for as many people who may like you, you know,
- 43:13Speaker 6: you may have acquitted somebody and the other side wasn't
- 43:16Speaker 6: happy about it. And David's been doing it for years.
- 43:18Speaker 6: So we're sitting there and he is just yakking it
- 43:21Speaker 6: up and it's making me insane. And so I get
- 43:24Speaker 6: out and I'm like, I'm going to, I just need
- 43:26Speaker 6: to take a phone call. So, I go outside and
- 43:29Speaker 6: I'm literally pretending I'm on the phone. Now the neighbors
- 43:32Speaker 6: are all coming around. They're yelling like, auntie, don't talk
- 43:34Speaker 6: to them men. Don't talk to them. They're yelling at
- 43:36Speaker 6: the house. So I'm sitting out there and Beatrice comes
- 43:40Speaker 6: out and goes, what are you doing? Come back in here.
- 43:43Speaker 6: We're talking to her. And I'm like, we are in
- 43:45Speaker 6: a trap house, you idiot. I'm like, we need to
- 43:50Speaker 6: get out of here because we're going to get rolled
- 43:53Speaker 6: our asses. You know, we're literally, we're sitting ducks.
- 43:57Speaker 2: Okay, now just explain to me because what do you
- 43:59Speaker 2: mean a flop house?
- 44:02Speaker 8: So it's a place where people who, you know.
- 44:04Speaker 6: They come to get high.
- 44:05Speaker 8: They come to get high and then they crash.
- 44:06Speaker 3: Oh, okay, okay.
- 44:08Speaker 6: Right, so we're.
- 44:09Speaker 8: It's a trap house.
- 44:10Speaker 6: Yeah, it's a trap house. So we're sitting in the
- 44:11Speaker 6: house and.
- 44:14Speaker 8: I'm not worried at all.
- 44:15Speaker 3: He's oblivious.
- 44:18Speaker 4: Right.
- 44:18Speaker 6: You weren't worried about anything. You thought we were just
- 44:20Speaker 6: talking to sweet old auntie.
- 44:21Speaker 5: You were eating cookies and drinking coffee.
- 44:23Speaker 6: The whole reason we were there is we were trying
- 44:25Speaker 6: to figure out in our case, if she gave the
- 44:29Speaker 6: defendant or not the defendant, the, the, uh, yeah, the defendant, a.
- 44:34Speaker 8: Weapon, no, the drugs that he was selling to the
- 44:38Speaker 8: other guy.
- 44:39Speaker 6: And if she saw a weapon, so we're trying to inquire.
- 44:41Speaker 6: And I mean, it was, she, you know for all
- 44:44Speaker 6: intents and purposes she was a lovely lady uh... but
- 44:47Speaker 6: we were just we had overstayed our welcome it was
- 44:49Speaker 6: very clear.
- 44:50Speaker 8: Frank as we need to get out of here i
- 44:51Speaker 8: go away we're getting some good stuff here calling her
- 44:55Speaker 8: as a witness.
- 44:58Speaker 6: We called her as a witness she took the fifth
- 45:00Speaker 6: on the stand okay a the neighbor who wanted to
- 45:04Speaker 6: scalp us brought her to court And C, we put
- 45:07Speaker 6: Kenny Katuch's life on the line when he had to
- 45:09Speaker 6: go serve around the subpoena.
- 45:12Speaker 5: I mean, Kenny's subpoena stories.
- 45:15Speaker 8: But Kenny carries. I don't even carry.
- 45:16Speaker 3: But the best part, Frank, is Dave's oblivious to all
- 45:19Speaker 3: that's going on.
- 45:20Speaker 5: Wrong completely.
- 45:21Speaker 2: He's like visiting an older person in a nursing home.
- 45:25Speaker 6: Listen, because we are on the radio, I can't even
- 45:28Speaker 6: tell you parts of this story. I mean, I'm telling
- 45:31Speaker 6: you right now.
- 45:33Speaker 8: The smell was a unique smell, too.
- 45:35Speaker 3: Unique.
- 45:36Speaker 6: One day long, when we're having a beer, we'll tell
- 45:39Speaker 6: the story.
- 45:41Speaker 8: It was a very unique smell.
- 45:42Speaker 6: No whole bars version of this story.
- 45:44Speaker 3: But Dave's oblivious to everything. It's like he's missing his grandmother.
- 45:48Speaker 3: He's sitting there.
- 45:48Speaker 6: I mean, if she would have said, do you want breakfast?
- 45:50Speaker 6: He'd have said, sure.
- 45:51Speaker 5: You got bacon in there?
- 45:53Speaker 6: We've got nowhere to be.
- 45:55Speaker 8: They're just people like me.
- 45:58Speaker 6: Dave, this is not about that. We were in a
- 46:02Speaker 6: crack house.
- 46:02Speaker 8: I understand that, but those guys were all high.
- 46:05Speaker 6: Did you want to do some crack? No.
- 46:06Speaker 8: I could smell the crack. It kind of lingered.
- 46:09Speaker 5: You were going to make Jess a widow about 15
- 46:11Speaker 5: minutes longer. Yeah.
- 46:13Speaker 6: I mean, I couldn't even. I don't even know.
- 46:15Speaker 5: Were you married?
- 46:16Speaker 6: I was married. I was married.
- 46:18Speaker 8: You were newly married.
- 46:19Speaker 4: Newly.
- 46:19Speaker 6: Thank God I didn't have kids. So if it was over.
- 46:23Speaker 8: I've gone to some of the worst places. How about
- 46:27Speaker 8: when we were inspecting that one.
- 46:29Speaker 6: When we went into the bar and you're like, oh,
- 46:32Speaker 6: everything's cool. The dude comes up and says, hey, how
- 46:35Speaker 6: are you? And you say, hey, Joe Smith, how are
- 46:38Speaker 6: you doing? And he's like, oh, yeah, I represented him.
- 46:40Speaker 6: And the guy goes, yeah, I went to jail for
- 46:42Speaker 6: 10 years. I'm like, well, there's the mic drop. I
- 46:48Speaker 6: knew this was coming.
- 46:49Speaker 8: We've gone into some of those shot and beer places.
- 46:53Speaker 6: Thank God we knew the bartender.
- 46:55Speaker 8: Yeah, we've gone in there. I mean, I remember we
- 46:57Speaker 8: had to go into the one place, Taboo, remember? We
- 47:01Speaker 8: had to go into the one bar.
- 47:02Speaker 6: That's it.
- 47:04Speaker 8: Oh, it's crazy.
- 47:05Speaker 6: There are stories.
- 47:07Speaker 2: But isn't that, Frank, part about being a good lawyer
- 47:10Speaker 2: is going and tracking stuff down?
- 47:12Speaker 8: I tell these young lawyers, you've got to go to
- 47:15Speaker 8: the crime scene. You've got to smell the smell, see
- 47:20Speaker 8: the sights, experience what your client was experiencing so you
- 47:25Speaker 8: could do effective cross-examination.
- 47:27Speaker 6: Yeah, it's true.
- 47:29Speaker 3: It really is.
- 47:30Speaker 6: And honestly, it's... You know, you get to, you learn
- 47:35Speaker 6: a lot in those moments.
- 47:38Speaker 8: You really do.
- 47:40Speaker 3: Not Dave.
- 47:42Speaker 5: You have to visualize it. You have to put eyes
- 47:45Speaker 5: on it.
- 47:45Speaker 8: You have to visualize it.
- 47:45Speaker 5: You have to put eyes on it. If you're visual,
- 47:47Speaker 5: you have to put eyes on it. You can't rely
- 47:49Speaker 5: on a description. You have to put eyes on it.
- 47:51Speaker 8: Do we have any calls, Ron?
- 47:53Speaker 3: Hold on, Ron. Frank.
- 47:54Speaker 6: Before you take a call, I got another great story.
- 47:56Speaker 3: I got to hear it.
- 47:56Speaker 6: All right. So I'm in my office. This is 10
- 48:01Speaker 6: years ago or so. you know, Beatrice loves the page system.
- 48:05Speaker 6: Frank to David's office, Frank to David's office.
- 48:07Speaker 8: I hate that.
- 48:08Speaker 6: And he, and when, when I was younger, there was
- 48:12Speaker 6: just the, come to my office, scream independent on the
- 48:17Speaker 6: mood he's in. So, um, it's a, it's a Saturday afternoon,
- 48:21Speaker 6: I think, or it was a Saturday. He had a
- 48:23Speaker 6: client coming in. It was a federal client. And he
- 48:29Speaker 6: calls me into his office and, uh, Well, you know what?
- 48:33Speaker 6: I'm going to bypass this story. That's another one we'll
- 48:35Speaker 6: tell alone. But I'll tell you the same premise, right? Yeah,
- 48:38Speaker 6: you can't tell. So Saturday, he's interviewing an intern, all right?
- 48:43Speaker 6: And she's going to come work for us. And she's
- 48:46Speaker 6: in her third year at law school. And he is
- 48:49Speaker 6: eating Taco Bell.
- 48:51Speaker 5: For a while, you're eating Taco Bell for lunch.
- 48:53Speaker 6: So he's got his Taco Bell in front of him.
- 48:56Speaker 6: And he's got his tie on. And he has on
- 48:59Speaker 6: like a blue shirt. And he's opening the packs with
- 49:02Speaker 6: his teeth, and he's just firing.
- 49:04Speaker 8: The sauce all over his face.
- 49:06Speaker 6: Well, he shoots the sauce all over his shirt. And
- 49:12Speaker 6: I look at him, and I'm like, oh, my gosh.
- 49:14Speaker 6: And he grabs his right hand, and he hits his
- 49:17Speaker 6: chest with it, and he rubs it in real quick
- 49:19Speaker 6: like he was going to. make it go away and
- 49:21Speaker 6: he smeared fire sauce all over his shirt he goes
- 49:25Speaker 6: okay go get her bring her in.
- 49:26Speaker 8: From the lobby i'm like what he goes.
- 49:29Speaker 6: Go get her i'm like you gotta be kidding me
- 49:31Speaker 6: like we're interviewing this girl for an internship she's gonna
- 49:34Speaker 6: think you're crazy you got fire sauce all over you
- 49:37Speaker 6: it's in his beard It's in his shirt.
- 49:39Speaker 5: I mean, it's in his hair.
- 49:41Speaker 8: One time Brian and I were going. I forget where
- 49:43Speaker 8: we were going. We were going either a court or
- 49:46Speaker 8: to interview a client. We're in Campbell, Ohio, and there's
- 49:50Speaker 8: a drive-thru rib place. And I go through the drive-thru
- 49:54Speaker 8: rib place. I remember I had an older Lincoln, and
- 49:57Speaker 8: I got ribs. And Brian goes, what are you doing?
- 49:59Speaker 8: I go, I'm hungry. I'm eating lunch. And the rib sauce.
- 50:03Speaker 6: All over him.
- 50:05Speaker 8: Ron, you need a poncho.
- 50:09Speaker 5: You've even been on the Maid of the Mist, Ron.
- 50:13Speaker 6: I mean, this dude, I have never seen a guy,
- 50:16Speaker 6: he'll bite a rib or a chicken wing, and he
- 50:20Speaker 6: pulls his right hand so forcefully. out of his mouth
- 50:23Speaker 6: that any of the sauce, whatever is to the right
- 50:25Speaker 6: of him, gets hit.
- 50:26Speaker 5: Yeah, and you get hit with some cartilage. Grandmas, babies, colleagues.
- 50:31Speaker 6: It doesn't matter.
- 50:32Speaker 5: Ron can't even breathe. You're going to kill Ron. You're
- 50:33Speaker 5: going to kill Ron.
- 50:34Speaker 6: I'm telling you.
- 50:35Speaker 5: Look at him. He can't even breathe. You're going to
- 50:37Speaker 5: kill Ron.
- 50:38Speaker 2: I've got to tell you, though. I've got to pay
- 50:40Speaker 2: a compliment. Melfi did a Facebook thing of an impression
- 50:44Speaker 2: of Brian Kopp.
- 50:47Speaker 5: Honestly, I could do part. I could do 50 parts.
- 50:51Speaker 3: It was great.
- 50:53Speaker 5: Ron, listen.
- 50:54Speaker 8: That is exactly how Brian is.
- 50:57Speaker 3: Read it to me with punctuation.
- 50:59Speaker 5: Don't do that.
- 51:01Speaker 8: With punctuation.
- 51:02Speaker 5: I study mannerisms.
- 51:05Speaker 10: Brian and I have been working this case now for
- 51:08Speaker 10: a long time.
- 51:08Speaker 5: I've had two kids since it started.
- 51:10Speaker 10: We did all this travel for depositions and all these
- 51:13Speaker 10: out-of-town hearings. Honestly, I If you looked at my phone history,
- 51:17Speaker 10: I probably am on the phone more with him than
- 51:19Speaker 10: my wife. I think at one point I was with
- 51:21Speaker 10: him more than my wife. But I would just pick
- 51:23Speaker 10: up Brian's little mannerisms and cues.
- 51:26Speaker 5: I have about 100 more.
- 51:29Speaker 10: That I could do, but those are some of the
- 51:31Speaker 10: ones that came to mind.
- 51:32Speaker 2: At first I thought, is he talking about Beatrice? I mean,
- 51:35Speaker 2: it was so well done. It was so well done.
- 51:40Speaker 2: And it's like the wrath.
- 51:42Speaker 6: Oh, yeah, it was.
- 51:43Speaker 8: Yeah, it was really good.
- 51:44Speaker 2: I mean, it's it was I mean, but you guys
- 51:48Speaker 2: have said, frankly, I find this fascinating. I find that
- 51:51Speaker 2: time goes by in a blink of an eye because
- 51:54Speaker 2: just to know for all of our audience that all
- 51:56Speaker 2: three of you are lawyers and all three of you
- 51:58Speaker 2: are getting jerked around by your own insurance companies. It's just,
- 52:02Speaker 2: I mean, and the lessons to learn from that, you know,
- 52:05Speaker 2: that we learned from that. But the next thing is,
- 52:08Speaker 2: why is this firm so good at what they do?
- 52:11Speaker 2: And I'm going to tell you guys, you can make
- 52:13Speaker 2: fun of them all you want, but he drags you
- 52:15Speaker 2: out to these places that no one in their right
- 52:17Speaker 2: mind would like to go and feel safe in because
- 52:20Speaker 2: this is how you research a case before you go
- 52:23Speaker 2: to court.
- 52:24Speaker 3: I mean, it's the Beatrice way.
- 52:25Speaker 8: I got to put myself. in my client's shoes. I
- 52:29Speaker 8: got to see what they saw. You know, you could
- 52:31Speaker 8: describe and look at pictures all you want. You got
- 52:33Speaker 8: to go to the scene because you learn so much valuable.
- 52:37Speaker 8: And you know who taught me that lesson was on
- 52:40Speaker 8: the very first jury trial I did with him was
- 52:43Speaker 8: Don Hanai. And he said, you look at a piece
- 52:47Speaker 8: of evidence, not once, not twice. You look at it.
- 52:50Speaker 8: You can't stand looking at it anymore. And I can't
- 52:53Speaker 8: tell you how many times that Frank, on a case
- 52:57Speaker 8: we had on a video. How many times did you
- 53:00Speaker 8: watch that video?
- 53:01Speaker 3: A hundred.
- 53:02Speaker 8: He caught something and it turned the whole case. It
- 53:05Speaker 8: was amazing that he caught it, but he caught it
- 53:08Speaker 8: because I drilled into his head. Look, look, look again,
- 53:11Speaker 8: look again, look again. I mean, and it was the
- 53:16Speaker 8: best cross-examination I've ever seen. I mean, it was Awesome cross-examination.
- 53:21Speaker 2: Now, with all ribbing aside, are you not, David, proud
- 53:25Speaker 2: of the awards.
- 53:27Speaker 3: Frank is getting?
- 53:30Speaker 8: Frank and Jimmy both. The only thing I'm a little
- 53:34Speaker 8: jealous of is I wished I had what they had
- 53:38Speaker 8: at their age. When I was their age, I didn't
- 53:41Speaker 8: have someone over me mentoring me, helping me, showing me.
- 53:45Speaker 3: Well, now wait a minute. What about he and I?
- 53:47Speaker 8: Because he did that for you. I don't know if
- 53:50Speaker 8: it was mentoring. It was more of an abusive relationship.
- 53:54Speaker 8: Getting books thrown at me. Getting called at 4.30 in
- 53:58Speaker 8: the morning. Come down to my apartment. Walking into his apartment.
- 54:02Speaker 8: He's got a bottle of Jack Daniels in one hand.
- 54:05Speaker 8: He's in his gut cheese. He's spread out, spread eagle
- 54:08Speaker 8: on the bed.
- 54:09Speaker 2: I go.
- 54:09Speaker 8: What's going on? He goes, we won this case. Okay, how?
- 54:15Speaker 8: Don't talk to me. I'm going to get a continuance.
- 54:18Speaker 8: Take the client over here and get a sperm check.
- 54:20Speaker 8: They go, what? You want me to trial lawyer? I
- 54:23Speaker 8: got to sprue feed you? Go get this client's sperm check.
- 54:28Speaker 8: They go, okay, I'll figure it out. That's how I
- 54:31Speaker 8: figure out stuff. I had to go figure out how
- 54:33Speaker 8: to get the guy's sperm checked.
- 54:35Speaker 5: I mean, I didn't know.
- 54:39Speaker 2: We were going here tonight, Ron. What was the reason
- 54:42Speaker 2: for that? I remember that years ago, wasn't it? That
- 54:46Speaker 2: he was fixed or something like that? That he couldn't
- 54:48Speaker 2: have got her pregnant?
- 54:49Speaker 8: It is the wildest story. I can't tell you the
- 54:53Speaker 8: stuff he put me through. He's abusive to me.
- 54:55Speaker 6: Well, what was the purpose of getting his sperm checked?
- 54:57Speaker 8: Because it was before DNA. DNA was just coming into fruition.
- 55:02Speaker 8: And how they would check... whether someone's, whether a bodily fluid.
- 55:08Speaker 6: Secretor.
- 55:09Speaker 8: There are people that are secretors and non-secretors. So from
- 55:12Speaker 8: bodily fluids, you could tell someone's blood type. Well, the
- 55:17Speaker 8: rapist was a non-secretor and our client was a non-secretor.
- 55:22Speaker 8: That didn't help because only 20% of the public is it.
- 55:25Speaker 8: But they're doing the rape kits. So when they do
- 55:29Speaker 8: a rape kit, they take a big Q-tip and they
- 55:32Speaker 8: do what's called a vaginal swab, and now they do
- 55:36Speaker 8: DNA testing on it or they'll look under a microscope.
- 55:39Speaker 8: In our case, they put it on a slab, and
- 55:42Speaker 8: the forensic scientist said, yeah, I saw eight heads and
- 55:45Speaker 8: pieces of spermazota under the microscope. And our guy said
- 55:50Speaker 8: he was fixed, and he couldn't have raped the girl.
- 55:53Speaker 8: That's what he said. He says, I had a vasectomy.
- 55:55Speaker 8: I couldn't have raped her. And I shouldn't say this,
- 55:58Speaker 8: but The first time I was sitting in Don's office
- 56:01Speaker 8: and he said that, Don pulled out a gun and
- 56:03Speaker 8: put it in his mouth and said, if you ever
- 56:05Speaker 8: tell me that again, I'm going to murder you. And
- 56:07Speaker 8: I'm like, okay, I'm a brand new lawyer. They didn't
- 56:10Speaker 8: teach me in law school what happens when an older
- 56:12Speaker 8: lawyer puts a gun in someone's mouth and says, if
- 56:15Speaker 8: you tell me that again, I'm going to shoot you.
- 56:17Speaker 8: God rest his soul. I'm sitting there and I'm going,
- 56:20Speaker 8: that was my mentoring.
- 56:24Speaker 6: Okay.
- 56:27Speaker 8: Five days later, I bring the guy back and he goes,
- 56:35Speaker 8: I want to know about your vasectomy.
- 56:37Speaker 2: Oh, no.
- 56:38Speaker 8: He threatened him with a gun, right? He had stuck
- 56:41Speaker 8: a gun. He goes, no, you don't understand. You couldn't
- 56:44Speaker 8: have raped her if you had a vasectomy. I've been
- 56:45Speaker 8: telling you guys that. It was like. It was like
- 56:49Speaker 8: a comment. I couldn't believe it. I could not believe it.
- 56:53Speaker 3: You know, I am smacked to heaven.
- 56:54Speaker 8: And then the guy kept the receipt from 1972.
- 56:59Speaker 3: For his vasectomy.
- 57:00Speaker 8: He had the receipt for his vasectomy. The typed-up receipt.
- 57:03Speaker 8: He said he said, hey.
- 57:06Speaker 2: One of the most enjoyable legal shows in my 35
- 57:08Speaker 2: years I've just experienced.
- 57:10Speaker 3: Thank you, guys.
- 57:11Speaker 8: Thank you.
