Portfolio Recovery Associates Loses Big Case
Here, Brian does a quick review of a great case that just came down smoking PRA for illegal debt collection and filing a collection lawsuit with no assignments or standing to sue. The Trial Court also heard that PRA's own Custodian of Records could not connect Ms. Green's account numbers to the proof from PRA but still found Ms. Green liable somehow. This Court of Appeals Opinion smoked the trial court, PRA and then set a "standing" precedent for other states and assignment cases.
