Transcript
- 0:00I am against the largest social media company in the world and
- 0:06in the history of civilization. And the judge looked at me and I
- 0:08said, your honor, look, Facebook's done you a dirty,
- 0:12Instagram's done you a dirty, and Meta's done you a dirty.
- 0:15They don't want people to know that it's 11:27 in the morning
- 0:31on Thursday April 16th. We filmed our first episode
- 0:35actually 8 months ago. At the.
- 0:37Linear at. The Linear Trial Academy.
- 0:39How applicable. We're waiting for Mark Lanier to
- 0:42come upstairs. Jen's walking him over to make
- 0:46sure that he's not just getting crowded with everybody who wants
- 0:49to talk to him, which happens every time he speaks.
- 0:51VP of Client Services and bodyguard.
- 0:54Yes, a phenomenal human. And then we're going to sit down
- 0:57and we're going to talk to Mark. And I don't know what we're
- 1:01going to talk to him about, but it's going to be amazing.
- 1:03We're on our way to go get Mark Lanier.
- 1:07He's going to be on the podcast, so we got to rush you over.
- 1:10We don't have a lot of time, but we're going to make it work.
- 1:13Exciting. All right, now I'm getting a
- 1:17little nervous. It's like I'm meeting Santa
- 1:21Claus fix. Your hair.
- 1:23John and Mark are ready to talk a lot about a lot of stuff, but
- 1:28we got 10 minutes. We're not.
- 1:29Going to have that much time, but we are still getting time
- 1:31with Mark and then he's going to be whisked away and get on a
- 1:34plane and back to Houston he goes so.
- 1:36Can't wait, I'm so scared now. Do you know how hard it is right
- 1:41to ask the right question when you only get 10 minutes?
- 1:45Hello. Hello.
- 1:48Hey, Mark, I'm Alec. Alec.
- 1:49Good to see you. Glad to have you on the podcast.
- 1:52Hey, glad to be on the podcast. Let's be fun, yeah?
- 1:57Here we. Are in Vegas getting ready for
- 1:58the podcast to end all podcast. The number one legal marketing
- 2:03podcast as they. Said yeah, and then second is so
- 2:07far distant you can't see them. All right.
- 2:11The number one legal podcast in the universe in the history of
- 2:19humanity. Let's go.
- 2:21Welcome to the John and Mark podcast today.
- 2:24It's the John and Mark and Mark podcast with the one and only
- 2:28Mark Lanier, which is remarkable that we would both be here.
- 2:32So Mark just got ushered off stage where he spoke about the
- 2:36social media addiction trial. He spoke about the upcoming
- 2:39litigation that they are pursuing in the AI space and he
- 2:44is here to talk to us for a few minutes before he has to go rush
- 2:47back. We had a laundry list of
- 2:48questions to ask you, and then we made it very short, you know?
- 2:52You didn't need to because we're filming this on a Thursday and
- 2:55that's laundry day for me, so the laundry list would have been
- 2:58fine. No, I'm ecstatic to be here.
- 3:01I thank you guys for having me on.
- 3:03You really do have one of the most compelling podcasts out
- 3:06there for legal marketing issues and legal issues, what's going
- 3:09on in the world. We really appreciate.
- 3:11It well done. Thank you very much.
- 3:12And I will say like you guys aside from your trial work, you
- 3:17run a top notch operation. Your people are amazing from
- 3:20Dara to Dwana to Rebecca, you guys do a great job.
- 3:24Yeah, and and Kevin overseas so. Much of this.
- 3:27And these folks have been with me for so long that they're,
- 3:32they're just, it's, it's a very tight knit circle and it's, it's
- 3:37been a blessing to get to work with them.
- 3:38We did have a whole bunch of questions to go through, but I'm
- 3:40going to ask you the one without the warm up.
- 3:43I want to know how you feel about the fact that Facebook
- 3:47came out publicly and said we're not going to allow lawyers to
- 3:51pursue more claims against them by advertising on their
- 3:55platform. Yeah, that's kind of, I guess
- 3:59that kind of tells you that they have their tail between their
- 4:02legs and they feel like they've been kicked pretty hard, which I
- 4:07guess they did, but they had it coming from for them.
- 4:10And and realistically this gives you a glimpse into who they are
- 4:16because you know, if the litigation is as poor as they
- 4:21say it is, they should not fear lawyers advertising, they should
- 4:26not fear jurors deciding. But they know internally that
- 4:30this litigation illustrates there many of their flaws and
- 4:36many of their calculated works to take advantage of people.
- 4:41And so they don't want that word out there and they don't want
- 4:44lawyers freely telling people that, look, Facebook's done you
- 4:49a dirty and Instagram's done you a dirty and Meta's done you a
- 4:54dirty. They don't want people to know
- 4:56that. Peculiar timing on that one.
- 4:59We started doing marketing for this for Matt Bergman from the
- 5:02beginning. Four years ago when you started,
- 5:04I remember sitting down with John.
- 5:05I was like, there's no way in heck they're going to let us run
- 5:08these ads four or five years later.
- 5:10They finally after right after the decision came down, they
- 5:13decided maybe this isn't a good idea.
- 5:16Yeah, they didn't think they were going to lose.
- 5:18They thought they thought they had this in the bag.
- 5:21Their strategy, Remember, they've targeted young kids from
- 5:25the beginning in the trial. They were still targeting.
- 5:29They were just targeting her in the courtroom instead of to get
- 5:33her on the media. And they tried to attack her and
- 5:37they thought they could win by attacking the plaintiff.
- 5:40And the problem is the jury understood the truth and the
- 5:45truth was damning for them. A lot of people in the public
- 5:52sphere know about you and about the firm from this trial.
- 5:56But the firm itself has so much going on.
- 6:00It's such a large operation and while that one case that you won
- 6:05is going to be a huge game changer for that specific
- 6:08litigation, you've now set the framework for this is how these
- 6:10trials are going to go. You also have a miso operation
- 6:14that you've been operating for a very long time.
- 6:16The work that you guys are doing in Libby, Montana is incredible.
- 6:21The work that you have are are pursuing on behalf of the states
- 6:24in the Google antitrust litigation.
- 6:26There's just so much going on. How do you look at your firm and
- 6:30balance your trial work with the day-to-day operations and the
- 6:34other cases that you are continuing to pursue?
- 6:36Well, we have 65 or 70 remarkable lawyers and we've got
- 6:41support staff of 100 plus. And they do an incredible job at
- 6:46not only preparing and shepherding these cases into the
- 6:51posture where I can try them, but they also do a wonderful job
- 6:55themselves of trying some of the cases.
- 6:58They do a wonderful job of interacting with all of the
- 7:00courts and all of the lawyers that are out there.
- 7:03You know, I referring lawyers or people that some want to just
- 7:07refer it and get the mailbox money, but many others want to
- 7:11refer it and also keep involved. And so they're really good at
- 7:16trying to make sure that the referring lawyers have a level
- 7:19of involvement that they're happy with.
- 7:22And so they do a great job working it up.
- 7:24And you're right, we've got different teams.
- 7:27So we have a business litigation team that's pursuing not just
- 7:31the Google antitrust case, but a number of different business
- 7:34type cases, insurance fraud cases, all sorts of cases like
- 7:39that. And then we've got another unit
- 7:41that just does general torts. I mean, we've got people we
- 7:44handle car wrecks, we handle trucking accidents, we handle.
- 7:49Slip and falls, we handle Uber cases, ladders that break.
- 7:54Then we've got maritime work where we represent you.
- 7:57We've just settled out one of the defendants in the bridge
- 8:00case in in Maryland. We represented the state of
- 8:02Maryland against the shipping company that collided into the
- 8:06bridge and just settled that for a couple of billion dollars.
- 8:09We have different units that do all of this work.
- 8:13We have an asbestos unit that that is just incredible at
- 8:18handling those cases, whether it's mesothelioma or, or the
- 8:22talcum powder cases with the ovarian cancer and, and so many
- 8:27others. And then we've got the social
- 8:28media team and then we've got the, the, the general pharma
- 8:32team. So we, we love it.
- 8:34We're we're diverse. It's I'm just saying you've like
- 8:37jumped the cultural. My wife knew that we worked
- 8:41together for a long time and then but when the trial started,
- 8:44she was like bugging me for updates like inside scoop of
- 8:47like how things were going. She's like, when's the verdict
- 8:50going to come down? Are they going to win?
- 8:52She was like every day following online like asking me for
- 8:54updates. I was like, I don't know
- 8:56anything and I'm not making that phone call, but she was like
- 9:01invested. She.
- 9:02Should have been asking me Mark, but like you shouldn't have said
- 9:04hey. Here's her girlfriends.
- 9:06We're all like texting updates because they're like they want
- 9:08they wanted to see be the result of this.
- 9:10Yeah, well, it was interesting that the media, the judge had to
- 9:13limit media passage because there was too many people wanted
- 9:16in and not enough room. And so the court limited how
- 9:20many of the lawyers could bring in the parties, how many of the
- 9:23media could bring in and how many visitors could come in.
- 9:25And then there was press set outside the whole time.
- 9:28And, and you, it was, it was quite a press circus.
- 9:33Interesting note that nobody knows about the second or third
- 9:37day. I had gone outside and they
- 9:41press wanted to talk to me. So I did a quick press
- 9:44conference and I made some statements about this, that and
- 9:48the other that I thought the lawyers had cherry picked
- 9:50evidence and I was going to look forward to showing it and some
- 9:53things like that. The next morning I come in and
- 9:57one of the legal teams on the other side met a lawyer, gets up
- 10:01and tells the judge, I can't believe Mr. Lanier has done
- 10:04this. He's talked to the media about
- 10:06this case. That's outrageous.
- 10:08And, and da, da, da, da, da. And the judge looked at me and I
- 10:11said, your Honor, I am against the largest social media company
- 10:18in the world and in the history of civilization.
- 10:21If you don't think for a minute that their PR department has put
- 10:25out statements that they are carrying information on their
- 10:29own social media that is available and going out to a
- 10:32billion plus people compared to me talking down on the sidewalk
- 10:37with a reporter. I said this is not the pot
- 10:41calling the kettle black, this is the ocean complaining about a
- 10:45thimble of salt water robbing it of its glory.
- 10:48I said this is this is absurd. And the judge said, Ed said,
- 10:53what are you suggesting? I said, if they are upset about
- 10:56this, then let me do discovery on them.
- 10:58Let me do discovery to find out what they're putting out in
- 11:02their press reports. And at that point they were kind
- 11:04of like, well, this isn't that big a deal and they never talked
- 11:08about it again. What do you think is eventually
- 11:10going to happen? Let's Fast forward like 2-3
- 11:12years to potential resolution. They've got the documents are
- 11:16too bad. Now, they may try and win a
- 11:18couple of cases first to try to drive down the dollars, but
- 11:22they're going to have to come to grips with this.
- 11:24They purposefully addicted a lot of people, in my opinion.
- 11:27And that's what the jury found. And the jury found they did it
- 11:29maliciously. But So what, aside from the
- 11:32legal side, what are they going to do?
- 11:34What do you think is going to happen or what should they do to
- 11:37protect children to death? Jonathan, Because I'm, I'm
- 11:40worried that they're going to put a Band-Aid on a bullet
- 11:42wound. They're really good at
- 11:44pretending. To fix something to fix.
- 11:47Something while internally as, as one of their own employees
- 11:52said publicly, our PR is saying we're fixing this, but
- 11:57internally we're doing cartwheels to avoid fixing this,
- 12:02even though we know we could fix it if they would just let us.
- 12:06Yeah. So I hope they'll cross that
- 12:08threshold. Also, not only your statement,
- 12:11we're talking about Facebook, you know, as it's been, you're
- 12:13also against Facebook and Google because it was YouTube.
- 12:16Not like one giant, but two giants that control.
- 12:19Snapchat and TikTok if you didn't want to show face against
- 12:22you. Yeah, yeah, all.
- 12:23The entire media that controls all the information in the world
- 12:26versus the linear firm and the rest of the trial team.
- 12:28Yeah, it was. It was, it was somebody said,
- 12:31was it like David versus Goliath?
- 12:33And I said, I don't think so. I don't think that we were even
- 12:37David. I mean, we that's a step up.
- 12:41You know, this was the the fly buzzing around David's head
- 12:46versus Goliath. You know, they had us
- 12:48outnumbered, outmanned, outspent out a eyed out, everything but
- 12:55truth came out. Thank God.
- 12:57One of the things that you spoke about at the Trial Academy last
- 13:00year was your use of AI in your processes.
- 13:04And you're a big proponent of this.
- 13:05You're very vocal about it. I know for those of you who are
- 13:08going to watch this, you wanna go to the Trial Academy and you
- 13:10wanna see Mark talk about how he uses AI and also.
- 13:14Is about June 22nd. Through the 25th Houston, TX
- 13:18laniertrialacademy.com In addition to talking about your
- 13:24use of AI, it's very interesting that now there are cases that
- 13:27you are developing against the AI platforms.
- 13:30Can you talk about how you can safely use it, but also have
- 13:34these ongoing lawsuits against an an open AI or looking at
- 13:37things that Gemini is doing? Yeah.
- 13:39So there are ways you can create shells and you can use layers.
- 13:44So there is a company called, it's got a weird name, Boodle
- 13:49box, BWB, double ODLEBOX, Boodle box.
- 13:56Boodle box is a conglomerate of 20 plus different AI.
- 14:01And so you've got we, we're able to set up an account with them
- 14:04where everything that we send and everything we get back
- 14:08doesn't have an address. So it's not traceable.
- 14:11So we're siloed, We're protected, our knowledge is
- 14:15protected, what we upload is protected.
- 14:17And then we're able to use Gemini Perplexity clawed all of
- 14:24the different AI engines that are out there with full
- 14:27protection. Very interesting.
- 14:29I know you're in a rush. You have to get to the airport.
- 14:31Very want to be very respectful of your time.
- 14:33Yeah, no, we're we're good for another 2 minutes.
- 14:37I'll take it. Let's hit a home run for the
- 14:39end. Let me think about this one.
- 14:42With two minutes left, what is the one question that I want to
- 14:44ask Mark Lanier? We have one minute left.
- 14:46The cases that that you are now pursuing the future of the
- 14:49linear law firm. You, you guys have historically
- 14:52targeted companies that are either medical devices or
- 14:57environmental exposure. You're continuing to pursue
- 15:00those litigations, but now you have these platform based
- 15:02litigations. Where do you see mass torts
- 15:04continuing to evolve as technology becomes essentially
- 15:09the target in mass tort litigation?
- 15:11I think you're going to see more litigation in areas that have
- 15:14previously been cloaked in secrecy because AI can Pierce
- 15:19some of that cloak of secrecy. So you're going to see a lot of
- 15:22litigation against insurance companies because they've been
- 15:25cheating everybody forever in a day, but most people can't
- 15:28figure out how. Yep.
- 15:29Court of public opinion. No one likes them anyway, no.
- 15:33Nobody likes them. Absolutely everybody knows you
- 15:35get cheated by the insurance company.
- 15:37And so I think you're going to see those areas that that have
- 15:40historically been able to do wrong, but do it in secrecy
- 15:46because people don't know enough to know how they're doing it.
- 15:50And I think AI is going to help open that up.
- 15:53Very interesting. Very interesting.
- 15:55Hey guys, Thank you for letting me be on your show.
- 15:58Thank you for coming. Thank you.
- 15:59Thank you so much Mark. This is the John Mark podcast
- 16:02with the one and only Mark Lanier.
- 16:04Head to the trial Academy, hear Mark speak and follow him.
- 16:09Interestingly enough, Mark's personal social media is super
- 16:12interesting. Go find the chess video where he
- 16:15went and talked about Magnus and and the chess scandal.
- 16:19Yes, cheating, yeah, or not cheating.
- 16:22A very, very well educated, well travelled person as as well as
- 16:26the best trial lawyer in the world.
- 16:28Thank you for joining us, Mark. Thanks for having me.
- 16:30That was a whirlwind. He's he's the past two hours of
- 16:35like my emotional roller coaster.
- 16:39It started off with Gents or Kevin saying it's not happening.
- 16:42Yes. And then us pivoting, saying
- 16:46we'll interview him in the car ride to the airport.
- 16:49As soon. As I got that text, I was like,
- 16:51I listen. Like I said, sometimes you got
- 16:53to shoot your shot. We talked to me so.
- 16:56Yeah, a little bit probably. And he's always going to
- 16:59remember because we gave him some chips.
- 17:01Thank. God.
