Latest / Beyond The Horizon / Mega Edition: Chad Daybell Trial (Part 19-20) (10/23/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. This episode,
- 0:03Speaker 1: we're getting right back to the Chad Daybell trial, and
- 0:06Speaker 1: we're going to see what went down during day number
- 0:10Speaker 1: 19 of testimony. To do that, once again, we're using EastIdahoNews.com,
- 0:15Speaker 1: and the author of this article is Nate Eaton. 8.20 a.m.
- 0:21Speaker 1: We are back in the courtroom, and it's day 19
- 0:23Speaker 1: of Chad Daybell's murder trial. Dr. Garth Warren, the forensic
- 0:27Speaker 1: pathologist who did the autopsies on JJ and Tylee, will
- 0:31Speaker 1: be back on the stand this morning. 8.41 a.m. Chad
- 0:35Speaker 1: Daybell is at his table, wearing a blue dress shirt
- 0:37Speaker 1: and tie. He's seated next to John Pryor. Fremont County
- 0:41Speaker 1: Prosecuting Attorney Lindsey Blake, Deputy Prosecutor Rocky Wixom, Madison County
- 0:46Speaker 1: Prosecuting Attorney Rob Wood, and Special Prosecutor Ingrid Beatty are
- 0:50Speaker 1: at the other table. Judge Stephen Boyce is on the bench. 8.44 a.m.
- 0:55Speaker 1: Warren takes the stand. Wood is questioning him from the lectern.
- 1:00Speaker 1: He begins by asking about Tylee Ryan's remains. Warren says
- 1:04Speaker 1: he received her remains in multiple bags. Two were body
- 1:08Speaker 1: bags that were sealed. There was also a brown paper
- 1:11Speaker 1: bag with multiple bags inside of it. All of the
- 1:14Speaker 1: bags were x-rayed, 28 x-rays in total. They were looking
- 1:18Speaker 1: for projectiles, weapon fragments. They saw multiple bones and a
- 1:22Speaker 1: fair amount of debris, mud, dirt, rocks. 8.46am. It took
- 1:28Speaker 1: about a week to separate all the debris in the mud.
- 1:30Speaker 1: Warren's team were able to find several bones, organs, and
- 1:34Speaker 1: soft tissues. Warren identified the heart, the right and left lung,
- 1:38Speaker 1: a portion of the liver, one of the kidneys, small
- 1:41Speaker 1: fragments of brain tissue, and a few small segments of bowel. 8.47am.
- 1:47Speaker 1: All of the tissues were charred and shriveled. Warren says
- 1:50Speaker 1: there were pieces of her skull and skull fragments, foot bones,
- 1:54Speaker 1: the sternum, hip bones, and other bones were also identified.
- 1:58Speaker 1: They were all blackened and had been burned. And this
- 2:01Speaker 1: is all the same evidence that we saw during the
- 2:03Speaker 1: Lori Vallow trial. Like I said previously, this is just
- 2:07Speaker 1: a rehash of all of that, basically, except that it's
- 2:10Speaker 1: from the perspective of Chad Daybell this time and what
- 2:14Speaker 1: his involvement was. But the facts about how the kids
- 2:17Speaker 1: were killed and who did it, they remain the same. 8.49 a.m.
- 2:21Speaker 1: Warren sent... A sample of the skeletal muscle for toxicology testing.
- 2:27Speaker 1: The test came back positive for ibuprofen, caffeine, low levels
- 2:31Speaker 1: of carbon monoxide. There was nothing in her toxicology report
- 2:35Speaker 1: that Warren felt could explain her death. 8.50 a.m. Larry
- 2:39Speaker 1: and Kay Woodcock are not in the courtroom today. 8.53 a.m.
- 2:43Speaker 1: Wood moves to admit photos taken during JJ's autopsy. 8.54 a.m.
- 2:48Speaker 1: The photos are being shown to the jurors, Daybell, and prosecution.
- 2:52Speaker 1: We will not see them on the live stream or
- 2:54Speaker 1: in the gallery of the courtroom. 8.56 a.m. Warren describes
- 2:59Speaker 1: the first photo. It shows how J.J. was received at
- 3:01Speaker 1: the coroner's office. He is in a body bag and
- 3:04Speaker 1: there is a red seal indicating the case number. The
- 3:07Speaker 1: next picture is a close-up photo of the seal body
- 3:10Speaker 1: lock number 506559 after it had been cut out and removed. 8.58 a.m.
- 3:17Speaker 1: The next photo shows J.J. enclosed in the black body bag.
- 3:20Speaker 1: He is wrapped in a black tarp with multiple strips
- 3:23Speaker 1: of duct tape. The next image shows what it looks
- 3:25Speaker 1: like after they open the black tarp. This was the
- 3:28Speaker 1: first time I actually saw J.J. 's body, Warren says.
- 3:32Speaker 1: Near the top of the head, you can see a
- 3:33Speaker 1: white plastic bag that is covering his head, and then
- 3:37Speaker 1: his face is wrapped with duct tape all the way
- 3:39Speaker 1: from his eyes to his neck. You can also see
- 3:42Speaker 1: his forearms, wrists, and hands are bound with duct tape.
- 3:46Speaker 1: A blue and white blanket was resting on J.J., and
- 3:49Speaker 1: he was wearing a red pajama top and bottom. The
- 3:52Speaker 1: only part of the skin is the upper arms. They
- 3:55Speaker 1: show evidence of decomposition in the form of green, tan,
- 3:59Speaker 1: leathery appearance with skin slippage. 9 a.m. Several jurors look
- 4:03Speaker 1: at the screens in front of them. I notice one
- 4:05Speaker 1: juror glances at the screen in front of him quickly
- 4:08Speaker 1: and then looks up. He's not spending a lot of
- 4:11Speaker 1: time looking at the photos. I don't blame him. Doesn't
- 4:14Speaker 1: take much, right? One look at that and that's probably
- 4:17Speaker 1: all you need. 9.01 a.m. The next photo is a
- 4:20Speaker 1: close-up of the lower half of the body. JJ's ankles
- 4:24Speaker 1: are bound with duct tape he has on black socks.
- 4:26Speaker 1: The following photo shows the blanket and pajama top. Warren
- 4:31Speaker 1: says the pajama top is soaked with decomposition fluid and
- 4:34Speaker 1: there is a mold on the t-shirt. There's a lot
- 4:37Speaker 1: of dirt and debris on the duct tape around his face. 9.02 a.m.
- 4:41Speaker 1: The next photo shows the hands duct taped together. Pictures
- 4:44Speaker 1: are taken at multiple angles to make sure everything is captured,
- 4:48Speaker 1: Warren says. He describes the following photo that shows the
- 4:51Speaker 1: pajama pants that are soaked in decomposition fluid with a
- 4:55Speaker 1: moldy substance right near the knee. 9.04 a.m. Another photo
- 4:59Speaker 1: is shown of the ankles bound with duct tape. Warren
- 5:02Speaker 1: says one single cut was made along the side of
- 5:04Speaker 1: the face to remove the duct tape. A portion of
- 5:07Speaker 1: JJ's face is shown in this photo. A strip of
- 5:11Speaker 1: duct tape covers his mouth from jawline to jawline. 9.05 a.m.
- 5:15Speaker 1: The next photo shows the strip of duct tape that
- 5:18Speaker 1: was covering JJ's mouth. Another photo shows the tape after
- 5:21Speaker 1: it was removed from JJ's mouth. Warren says all the
- 5:25Speaker 1: duct tape was sealed and submitted to law enforcement. The
- 5:28Speaker 1: next photo shows JJ's forearms, wrists, and hands bound with
- 5:32Speaker 1: multiple layers of duct tape. 9.07 a.m. A single cut
- 5:36Speaker 1: was made along the tape on the wrists. Warren and
- 5:39Speaker 1: his team found additional duct tape around JJ's wrists. One juror,
- 5:43Speaker 1: a young woman, appears to be crying. She's wiping her
- 5:47Speaker 1: nose and eyes with the tissue. I can't blame the lady.
- 5:51Speaker 1: Imagine sitting through all of this evidence actually in the
- 5:53Speaker 1: courtroom and getting a look at all these pictures. It's
- 5:56Speaker 1: bad enough we get the explanation. But these folks are,
- 5:59Speaker 1: you know, forced to look at these pictures to try
- 6:02Speaker 1: and render a decision about Chad Daybell's fate. 9.09 a.m.
- 6:07Speaker 1: Warren describes more photos showing duct tape around JJ's wrists,
- 6:11Speaker 1: body decomposition, etc. Another juror, a woman on the back row,
- 6:15Speaker 1: is wiping her eyes and is visibly upset. She's biting
- 6:18Speaker 1: her lips and appears to be fighting back tears. 9.11 a.m.
- 6:21Speaker 1: The next image shows the disposable diaper JJ was wearing. 9.12 a.m.
- 6:26Speaker 1: The next photo shows JJ's face. After all, tape and
- 6:29Speaker 1: everything had been removed. Another juror on the front row
- 6:33Speaker 1: is crying and has her head down. She reaches for
- 6:36Speaker 1: a tissue and is holding it over her face. 9.14 a.m.
- 6:41Speaker 1: Warren continues to describe the photos of JJ's body. His
- 6:44Speaker 1: skin is green, tan, brown. and there is a skin slippage.
- 6:48Speaker 1: A photo is shown of JJ's back and neck that
- 6:51Speaker 1: shows decomposition changes. And if you're wondering where my hatred
- 6:54Speaker 1: of Chad Daybell comes from, look no further. The way
- 6:58Speaker 1: that these children were treated, what happened to these kids, helicopters, volcanoes,
- 7:04Speaker 1: for everybody involved. 9.16am. Chad Daybell sits stone-faced and shakes
- 7:09Speaker 1: his head no, as some of these photographs are displayed.
- 7:13Speaker 1: He can see them on the monitor at his table. 9.17 a.m.
- 7:17Speaker 1: Warren was looking for any sign of trauma that would
- 7:20Speaker 1: have helped explain how JJ died. There was bruising on
- 7:23Speaker 1: his right upper arm. Warren took sections of the area
- 7:26Speaker 1: and looked at them under the microscope. There was hemorrhage
- 7:29Speaker 1: in the body tissue, meaning it was true bruising. 9.20 a.m.
- 7:34Speaker 1: Warren describes the next photo of JJ. He is face
- 7:37Speaker 1: down and it shows an area of concern for bruising
- 7:40Speaker 1: on his upper left arm. Warren made an incision in
- 7:43Speaker 1: that area of the arm to inspect if there was
- 7:45Speaker 1: true bruising. He determined it was. 9.22 a.m. A photo
- 7:50Speaker 1: is shown of JJ's thumb. There was hemorrhage and Warren
- 7:53Speaker 1: says there would have to have been some sort of
- 7:56Speaker 1: impact to cause it. The next photo shows JJ's ankles
- 7:59Speaker 1: and Warren did some testing on the areas that look
- 8:02Speaker 1: like they might have bruising. He did some testing on
- 8:05Speaker 1: the spots and determined there were not bruises. 9.25 a.m.
- 8:09Speaker 1: The next picture shows JJ's left ear. There were scratch-like abrasions.
- 8:13Speaker 1: There were also scratch-like abrasions on JJ's neck and jaw,
- 8:18Speaker 1: Warren says. 9.26 a.m. Warren says the abrasions could have
- 8:22Speaker 1: been from someone putting the bag over JJ's head or
- 8:25Speaker 1: JJ trying to get the bag off his head. I
- 8:28Speaker 1: wasn't there, I don't know, but these are the possibilities,
- 8:31Speaker 1: he explains. 9.27 a.m. Warren reminds the jury that the
- 8:35Speaker 1: cause of death was asphyxia by plastic bag over the
- 8:38Speaker 1: head and duct tape covering the mouth. How evil must
- 8:41Speaker 1: you be to be involved in any sort of plot
- 8:44Speaker 1: to kill anyone, never mind this poor little baby, and
- 8:47Speaker 1: then to do it the way they did it? Fuck
- 8:50Speaker 1: all of them. In fact, fuck anyone who even looks
- 8:53Speaker 1: like them. 9.30 a.m. Wood moves to admit another set
- 8:57Speaker 1: of photographs that were taken during Tylee's autopsy. 9.31 a.m.
- 9:02Speaker 1: Boyce says we're taking a break back in 15 or
- 9:05Speaker 1: 20 minutes. We're just going to keep it rolling. 10.04 a.m.
- 9:09Speaker 1: Back in the courtroom. Wood publishes the photos. Again, we
- 9:13Speaker 1: don't see them in the gallery or the live stream,
- 9:15Speaker 1: but the jury will see them. Victims are allowed to
- 9:18Speaker 1: see the photos if they wish, and arrangements can be
- 9:21Speaker 1: made for them to be viewed. 10.05 a.m. Warren describes
- 9:24Speaker 1: the body bags that contain Tylee's remains. They were sealed
- 9:27Speaker 1: with body locks. Warren opened the black body bag. Two
- 9:31Speaker 1: additional brown paper bags were inside. One was not labeled.
- 9:34Speaker 1: The other was labeled with burial site. Within the same
- 9:37Speaker 1: body bag, there were two paper bags containing multiple collections
- 9:41Speaker 1: of soft tissue bone and debris. 10.08 a.m. Warren explains
- 9:46Speaker 1: three distinct large pieces of bone, right pelvis, with attached
- 9:50Speaker 1: portion of the right femur. One is the left pelvis
- 9:53Speaker 1: attached to left femur and the sacrum, a bone at
- 9:56Speaker 1: the end of your lower back that is part of
- 9:58Speaker 1: your pelvis. 10.10am. Warren describes the next photo. It has dirt, mud,
- 10:04Speaker 1: and rocks that are left after all the bone and
- 10:06Speaker 1: body parts were collected. Warren says there's multiple charred bones
- 10:10Speaker 1: and debris in another bag. 10.12am. The next photo shows
- 10:15Speaker 1: the second black body bag, how it has been labeled,
- 10:18Speaker 1: and what was inside. One thing that stood out to
- 10:21Speaker 1: Warren is there was a green plastic material. After it
- 10:25Speaker 1: was pulled out and cleaned, they determined it was a
- 10:27Speaker 1: melted green bucket. The rest of the content contains human remains,
- 10:31Speaker 1: soft tissue, and organs. 10.15 a.m. Two additional bags in
- 10:36Speaker 1: the body bag contained, Warren explained a photo showing the
- 10:40Speaker 1: largest portion of Tylee's skull. He describes parts of the
- 10:43Speaker 1: skull that are charred. There are teeth that have been charred.
- 10:46Speaker 1: Tylee was identified through dental records. comparing her teeth to
- 10:50Speaker 1: previous x-rays when she was alive. 10.17 a.m. The next
- 10:55Speaker 1: photo shows Tylee's heart and lungs. Warren says this isn't
- 10:59Speaker 1: what heart and lungs typically look like. They are charred
- 11:02Speaker 1: and significantly shrunken. Wood points out the lungs and the
- 11:06Speaker 1: heart on the image for Warren to identify. They were
- 11:09Speaker 1: very small. Best estimate is they were probably a quarter
- 11:12Speaker 1: of the size that they typically are, Warren says. 10.19 a.m.
- 11:17Speaker 1: The next photo shows sections of the heart and lungs
- 11:19Speaker 1: that have been laid out. Warren describes one kidney that
- 11:22Speaker 1: is blackened and some of it is burned away. 10.20 a.m.
- 11:27Speaker 1: Skull bones, portions of ribs, the clavicles, multiple long bones
- 11:31Speaker 1: and foot bones were in one of the bags. They
- 11:33Speaker 1: were crumbling, blackened, and not intact. 10.22 a.m. A third
- 11:38Speaker 1: paper bag was labeled remains of suspected female. There were
- 11:42Speaker 1: five additional bags in one large paper bag. Inside each
- 11:45Speaker 1: of the small bags was fragments of charred bone. One
- 11:48Speaker 1: bag was labeled Fire Pit B-69-2020. Inside the bag was
- 11:53Speaker 1: a small crumbly charred bone. 10.24 a.m. The fourth bag
- 11:58Speaker 1: consisted of multiple small charred crumbly bone. The fifth bag
- 12:01Speaker 1: contained soft tissue and charred crumbly bone. 10.25 a.m. After
- 12:07Speaker 1: the autopsy, Warren and his lab collected and cleaned the remains.
- 12:11Speaker 1: All the bones were sent to the FBI for a
- 12:13Speaker 1: detailed forensic anthropology report. Wood asked if the report contributed
- 12:18Speaker 1: to Warren's decision on Tylee's cause of death. Warren says
- 12:22Speaker 1: he took everything into account. Warren says the FBI noted
- 12:25Speaker 1: that there were sharp force markings on the sacrum and
- 12:29Speaker 1: the left and right pelvic bones. Tylee's cause of death
- 12:31Speaker 1: was homicide by unspecific means. 10.27 a.m. To have homicide
- 12:37Speaker 1: by unspecified means, the death has to be very suspicious,
- 12:40Speaker 1: Warren says. Another factor would be the evidence was concealed.
- 12:44Speaker 1: Another factor would be the autopsy not showing an obvious
- 12:47Speaker 1: cause or a better explanation for cause of death. A
- 12:51Speaker 1: third factor is there isn't enough of the body to
- 12:54Speaker 1: do a full examination. 10.30 a.m. Wood has no further questions.
- 12:59Speaker 1: Boyce has some questions on exhibit numbering. He and Wood
- 13:02Speaker 1: are making sure the exhibit letters match the actual exhibits
- 13:06Speaker 1: that are shown to the jury. The prosecution did not
- 13:09Speaker 1: show all the autopsy photos. 10.34 a.m. Defense attorney John
- 13:14Speaker 1: Pryor will now conduct cross-examination. He asked Warren if he
- 13:17Speaker 1: noted there were canine bites on any of Tylee's remains.
- 13:21Speaker 1: Warren says he did not notice any, but left that
- 13:25Speaker 1: up to the anthropologist. 10.36 a.m. Pryor asks Warren if
- 13:29Speaker 1: he can determine when bruises were caused on a body.
- 13:32Speaker 1: Warren says he can get a rough idea based on
- 13:34Speaker 1: the hemorrhaging. 10.38 a.m. Pryor asks Warren how tall Tylee was.
- 13:40Speaker 1: He says he was not able to get her height
- 13:42Speaker 1: based on the remains. Warren doesn't remember how tall she
- 13:45Speaker 1: was based on Tylee's medical records. Pryor asks Warren if
- 13:48Speaker 1: he can determine whether there were animal or human remains
- 13:52Speaker 1: in the fire pit. He says he isn't a forensic anthropologist,
- 13:56Speaker 1: so he can't answer that. 10.40 a.m. The autopsies were
- 14:00Speaker 1: done on June 11, 2020. Pryor asks about the term
- 14:04Speaker 1: heavy lungs. Warren says this is used when there is
- 14:07Speaker 1: pulmonary edema. This happens when there's a lot of fluid
- 14:10Speaker 1: in the lungs. Pryor continues questioning and Wood objects saying
- 14:15Speaker 1: that this is beyond the scope. Boyce sustains the objection. 10.42 a.m.
- 14:20Speaker 1: Pryor asks if the remains were significantly smaller than had
- 14:24Speaker 1: Tylee been alive at the time. Warren says... That's a
- 14:27Speaker 1: question for the forensic anthropologist. Warren says it's very uncommon
- 14:31Speaker 1: in a fire-related death. When the organs are charred, they
- 14:35Speaker 1: shrink and lose weight. Pryor has no further questions. 10.44 a.m.
- 14:40Speaker 1: Wood follows up by asking about bruises. He asks if
- 14:43Speaker 1: bruising could be considered a form of trauma. Warren says yes.
- 14:46Speaker 1: Wood asks if given the condition of J.J. Vallow, Warren
- 14:49Speaker 1: would be surprised to see bruising on J.J. 's body.
- 14:52Speaker 1: Warren says in a case like this, bruising would be significant. 10.45 a.m.
- 14:58Speaker 1: Defense and State call for a sidebar before the next witness. 10.53 a.m.
- 15:03Speaker 1: Boyce says there is an exhibit with the next witness
- 15:06Speaker 1: that is an electronic format and it needs to be reviewed.
- 15:10Speaker 1: We are taking a break and we'll be back when
- 15:12Speaker 1: it's ready. 11.14 a.m. Back in the courtroom, jurors are
- 15:17Speaker 1: in their seats. Boyce says courthouse renovations are taking place tomorrow,
- 15:21Speaker 1: so the court will dismiss at 2 p.m. Next witness
- 15:24Speaker 1: is Chandler Police Detective Ariel Werther. 11.19 a.m. Lindsay Blake
- 15:29Speaker 1: is questioning Werther. He's assigned to the Robbery Homicide Unit. 11.21 a.m.
- 15:34Speaker 1: Werther explains his training, including experience in working with cell
- 15:39Speaker 1: phone evidence. Blake asks what a call detail record is.
- 15:42Speaker 1: Werther says there are records kept by your cell phone company,
- 15:46Speaker 1: voice calls, how long incoming or outgoing text messages, etc.
- 15:51Speaker 1: Law enforcement obtains cell records through a warrant. 11.24 a.m.
- 15:56Speaker 1: Werther was working the day Charles Vallow was shot. Werther
- 15:59Speaker 1: wasn't on the robbery homicide team at that point. He
- 16:02Speaker 1: joined a few months later, but he was invited to
- 16:05Speaker 1: go out on the call as a training opportunity. Much
- 16:08Speaker 1: of the time at the scene was observing but not
- 16:10Speaker 1: handling a specific responsibility. 11.25 a.m. Werther looked at cell
- 16:15Speaker 1: phone records belonging to Charles Vallow. He inspected records from T-Mobile, Verizon,
- 16:20Speaker 1: and AT & T. Each provider has their own way
- 16:23Speaker 1: of keeping records. Werther analyzed GPS location data extracted from
- 16:28Speaker 1: Charles' phone. Werther used a data analysis tool to analyze
- 16:32Speaker 1: the records. 11.28 a.m. Werther says the call detail records
- 16:37Speaker 1: will usually indicate the cell tower and sector of the
- 16:40Speaker 1: tower used during the call or text. The name of
- 16:43Speaker 1: the program Werther used was previously called ZX, but now
- 16:48Speaker 1: called TRAX. 11.31 a.m. Werther analyzed phone records from four devices.
- 16:54Speaker 1: He has prepared an exhibit showing his findings. Blake moves
- 16:57Speaker 1: to admit the exhibit. And remember, it's these exhibits that
- 17:01Speaker 1: are the most damning for Chad Daybell. They put all
- 17:04Speaker 1: of the findings of the experts in a nice little
- 17:07Speaker 1: presentation for the jurors to consume. 11.33 a.m. The exhibit
- 17:12Speaker 1: has around 120 slides and embedded media, Blake says. The
- 17:16Speaker 1: first slide shows the four phone numbers associated to Charles. 11.34 a.m.
- 17:22Speaker 1: The first slide shows the Chandler Police Department summary report
- 17:25Speaker 1: of a shooting. The report said shot brother-in-law. The call
- 17:29Speaker 1: was 8.36 a.m. on July 11, 2019. 11.35 a.m. The
- 17:35Speaker 1: first number that was a T-Mobile phone used by Lori Vallow.
- 17:38Speaker 1: No logs of text messages were received from the phone
- 17:41Speaker 1: company on this line. The next slide is a Verizon
- 17:44Speaker 1: phone attributed to Alex Cox. The next slide shows an
- 17:48Speaker 1: AT & T number attributed to Chad Daybell. The phone
- 17:51Speaker 1: attributed to Chad had communication to Lori on July 11th.
- 17:57Speaker 1: 1139 a.m. Werther also looked at locations extracted from Charles' phone.
- 18:02Speaker 1: The data can be produced onto a spreadsheet. 1141 a.m.
- 18:06Speaker 1: Werther used different colors on his presentation to indicate which
- 18:09Speaker 1: device was being used or in communication. 1143 a.m. The
- 18:15Speaker 1: next slide shows us the analysis of the cell phone records.
- 18:18Speaker 1: The first slide is a synopsis of the events. the
- 18:21Speaker 1: morning Charles was killed. Another slide. Claims made the morning
- 18:26Speaker 1: of the shooting that could be testable with cell phone
- 18:28Speaker 1: and GPS data. 11.47 a.m. Werther sought instances where the
- 18:34Speaker 1: location data could be corroborated, invalidated, or rendered questionable. This
- 18:38Speaker 1: was to evaluate the reliability of the data. 11.48 a.m.
- 18:43Speaker 1: Werther put the data into a program. They would lay
- 18:46Speaker 1: the locations of the cell phone activity on a Google map.
- 18:49Speaker 1: Blake now shows a map animation Werther created that shows
- 18:53Speaker 1: the general areas that were involved in the analysis. Phoenix
- 18:58Speaker 1: and Chandler. 11.51 a.m. A new screen shows the distance
- 19:02Speaker 1: from the home where Charles was shot to the Burger
- 19:05Speaker 1: King where Lori stopped for breakfast. It's 1.69 miles away.
- 19:10Speaker 1: There is also a measurement to JJ's school. 7.2 miles.
- 19:14Speaker 1: The 911 call was received at 8.36 a.m. 11.54 a.m.
- 19:21Speaker 1: Laurie went to Burger King, stopped at Walgreens, and took
- 19:24Speaker 1: JJ to school the morning Charles was shot. Charles was
- 19:27Speaker 1: staying at a true, by Hilton, hotel the night before
- 19:30Speaker 1: the shooting. 11.56 a.m. We now see a slide showing
- 19:35Speaker 1: that Laurie's device texted Chad's device at 6.12 a.m. At 7.01 a.m.,
- 19:40Speaker 1: Chad's device texted the Laurie device. At 7.16 a.m., Charles
- 19:44Speaker 1: Vallow's device was traveling from the Hilton to the area
- 19:48Speaker 1: of the Four Peaks home. He arrived. at 7.32 a.m. 11.58 a.m.
- 19:54Speaker 1: At 7.33 a.m., Charles' device texted Lori's device. Werther does
- 19:58Speaker 1: not have the contents of the messages. Until 7.50 a.m.,
- 20:02Speaker 1: the data from Charles' device was around the Four Peaks home.
- 20:05Speaker 1: It was then in transit for about 46 minutes. before
- 20:08Speaker 1: the 911 call occurred. Lori had Charles' phone, and police
- 20:13Speaker 1: recovered it from her. And this is where they take
- 20:15Speaker 1: their lunch break, but we're just going to keep going,
- 20:17Speaker 1: and we're going to complete this all in one episode today. 1.01 p.m.
- 20:22Speaker 1: We are back. Larry and Kay Woodcock are in the
- 20:24Speaker 1: courtroom this afternoon. So is Vicki Hoban, Tammy Daybell's aunt.
- 20:28Speaker 1: Rex Conner, Lori Vallow's uncle, is also here with his daughter. 1.03 p.m.
- 20:33Speaker 1: Jurors are back in their seats. Blake will continue questioning Werther. 1.05 p.m.
- 20:38Speaker 1: Werther discusses a slide on the screen that shows where
- 20:41Speaker 1: the device was at the time an event happened. At 7.52 a.m.,
- 20:46Speaker 1: there was a voice call between Lori and Alex's phone.
- 20:49Speaker 1: After the shooting, Alex and Lori communicated via phone, and
- 20:53Speaker 1: this was one of the few calls the two had.
- 20:55Speaker 1: This was before the 911 call. 1.07 p.m. At around 7.55 a.m.,
- 21:01Speaker 1: Charles' device was at Burger King. You can watch surveillance
- 21:04Speaker 1: video of Lori visiting the fast food restaurant here. And
- 21:07Speaker 1: like usual, the link is in the description box. 1.09 p.m.
- 21:11Speaker 1: Werther went to Burger King and compared timestamps versus the
- 21:15Speaker 1: cell phone data. We see a red Kia Sorento in
- 21:18Speaker 1: the drive-thru at Burger King that Lori was driving. Lori
- 21:21Speaker 1: was at Burger King at 7.54 a.m. 1.12 p.m. We
- 21:26Speaker 1: now see a different outside angle of the vehicle leaving
- 21:28Speaker 1: Burger King. The claim Lori had Charles' phone is supported
- 21:32Speaker 1: by the GPS tracking evidence. 1.14 p.m. Werther talks about
- 21:37Speaker 1: Lori stopped at a drugstore to buy flip-flops. Charles' device
- 21:40Speaker 1: arrived at 8.08 a.m. and wasn't there very long. At 8.16 a.m.,
- 21:45Speaker 1: the device was at Walgreens. Werther reminds the jury a
- 21:49Speaker 1: 911 call has not yet been made to report that
- 21:52Speaker 1: Charles has been shot. We now see surveillance video of
- 21:55Speaker 1: Lori walking into Walgreens and buying two pairs of sandals.
- 21:59Speaker 1: She pays cash. 1.16 p.m. Lori leaves Walgreens at 8.20 a.m.,
- 22:04Speaker 1: The next slide shows Lauren's Life Academy, the school JJ attended.
- 22:09Speaker 1: The device was at the school at 8.32 a.m. The
- 22:12Speaker 1: call from Alex Cox's device was made about 63 minutes
- 22:16Speaker 1: after Charles' device first arrived in the Four Peaks area. 1.18 p.m.
- 22:21Speaker 1: Charles' device arrived back at the Four Peaks area around 8.49 a.m.,
- 22:26Speaker 1: around the time Lori returned to the house. we see
- 22:28Speaker 1: an image from police body camera footage showing Kylie and
- 22:31Speaker 1: Lori in flip-flops that were just purchased at Walgreens. And
- 22:35Speaker 1: this is where that documentary on Netflix really comes in handy.
- 22:39Speaker 1: I know I've mentioned it before, but if you want
- 22:41Speaker 1: more context about what went down with Charles and Alex
- 22:45Speaker 1: and this situation, that documentary certainly provides it. 1.20 p.m.
- 22:50Speaker 1: Charles Device received an incoming call from Melanie Boudreau at 10.25 a.m.
- 22:55Speaker 1: The phone was at the police station where Lori was
- 22:58Speaker 1: being questioned. Alex missed a call from Summer Shifflett, Lori
- 23:01Speaker 1: and Alex's sister, while he was at the police station. 1.23 p.m.
- 23:06Speaker 1: We now see a map showing that Chad's device was
- 23:09Speaker 1: in the Salt Lake City area at 12.39 p.m. that day.
- 23:12Speaker 1: He texted Lori's device, but the contents are not available. 1.24 p.m.
- 23:18Speaker 1: The computer appears to have frozen. Werther says that's less
- 23:21Speaker 1: than ideal. Blake is going to restart the computer. 1.33 p.m.
- 23:26Speaker 1: The computer is working again. Werther begins to talk. Looks
- 23:29Speaker 1: like the computer might not be working again. 1.37 p.m.
- 23:33Speaker 1: There are technical difficulties with an exhibit, and Blake asks
- 23:37Speaker 1: to approach. 1.40 p.m. The state is requesting that Werther
- 23:41Speaker 1: leave the stand while the technical difficulties are figured out.
- 23:45Speaker 1: Another witness will now be called to the stand. 1.41 p.m.
- 23:49Speaker 1: Tara Martinez is the next witness. She's an Idaho State
- 23:52Speaker 1: Police forensic scientist. 1.42 p.m. Martinez processes items of evidence
- 23:58Speaker 1: to compare fingerprints, and she responds to crime scenes. She's
- 24:02Speaker 1: worked for the State Lab for eight years. 1.44 p.m.
- 24:05Speaker 1: Martinez processes latent prints, prints that are left unintentionally, they
- 24:10Speaker 1: normally are not easy to see, and have to be processed.
- 24:13Speaker 1: She uses different processes to analyze prints. Latent prints are
- 24:17Speaker 1: not always left everywhere. 1.45 p.m. Wood is questioning Martinez.
- 24:22Speaker 1: He asked how she would collect a latent print if
- 24:25Speaker 1: it's left behind. If the print was on plastic, she
- 24:28Speaker 1: would first do a visual examination. She looks for hair,
- 24:31Speaker 1: other factors. She then uses different colors of light to
- 24:35Speaker 1: see if there are prints. Next, she uses superglue fuming,
- 24:38Speaker 1: similar to what you see on CSI. The superglue attaches
- 24:42Speaker 1: to any moisture on the items. The glue makes the
- 24:45Speaker 1: prints more visible. Next step would be using dye stain
- 24:48Speaker 1: followed by powder. 1.48 p.m. If Martinez sees any prints
- 24:53Speaker 1: during her processing, she preserves them. She follows Ace V
- 24:56Speaker 1: when it comes to prints, analysis, comparison, evaluation, verification. During
- 25:02Speaker 1: the verification phase, another analyst does the process over again. 1.50 p.m.
- 25:08Speaker 1: Martinez says there's a database of known prints where she
- 25:11Speaker 1: pulls cards and compares against the prints she has collected.
- 25:15Speaker 1: Wood asks if she's familiar with the Lori Vallow-Chad Daybell case.
- 25:19Speaker 1: She is. Martinez' first contact with the case was taking
- 25:23Speaker 1: prints at the coroner's office. She took prints from JJ.
- 25:26Speaker 1: She processed different items submitted in the case and took
- 25:29Speaker 1: known prints of Lori and Chad, 1.52 p.m. Martinez collected
- 25:34Speaker 1: two samples from Alex Cox. One was a fingerprint card
- 25:38Speaker 1: of all 10 figures from a federal database. She also
- 25:41Speaker 1: got a card from the Gilbert Police Department. Gilbert had
- 25:44Speaker 1: his prints from Alex's autopsy. 1.53 p.m. Martinez checked a
- 25:49Speaker 1: white drawstring bag with duct tape. She was not able
- 25:52Speaker 1: to collect any prints from the bag. She then showed
- 25:55Speaker 1: a collection of a bunch of duct tape. She was
- 25:58Speaker 1: able to develop prints. She tested another piece of duct
- 26:00Speaker 1: tape from JJ's mouth and was not able to get
- 26:03Speaker 1: any prints. She was able to process prints from other
- 26:06Speaker 1: pieces of tape or in the green bucket. 1.55 p.m.
- 26:11Speaker 1: Martinez was able to collect some hairs from the item
- 26:13Speaker 1: she collected. Woods asked Wood about item 11, black colored
- 26:18Speaker 1: plastic and gray duct tape. There are multiple pieces, so
- 26:22Speaker 1: she labeled them separate. 11.1 through 11.11 is the tape numbers. 11.12
- 26:28Speaker 1: through 11.15, the plastic pieces. 1.59 p.m. Wood admits a
- 26:33Speaker 1: PowerPoint put together by Martinez. The first slide shows the
- 26:37Speaker 1: black colored plastic that she processed for prints. A yellow
- 26:41Speaker 1: indicator shows where the latent print was on the items.
- 26:44Speaker 1: The next image shows where the print located on the item. 2.01 p.m.
- 26:49Speaker 1: The next image shows a photo she developed when she
- 26:51Speaker 1: collected the print. The following image is an enhanced version
- 26:55Speaker 1: of the last print. We now see an analysis of
- 26:58Speaker 1: the latent print. The next image is a comparison to
- 27:00Speaker 1: Alex Cox's fingerprint. 2.03 p.m. The print matched Alex Cox.
- 27:06Speaker 1: His right little finger. This was on the black plastic
- 27:08Speaker 1: where JJ's body was found. So there's no doubt, right?
- 27:12Speaker 1: Who killed these kids? Lori Vallow and Chad Daybell might
- 27:15Speaker 1: have ordered it, but the person who carried it out
- 27:18Speaker 1: most certainly was Alex Cox. 2.06 p.m. No other fingerprints
- 27:22Speaker 1: were able to be identified on the item she collected.
- 27:25Speaker 1: She gathered the hairs and saved them for another person,
- 27:28Speaker 1: as she doesn't do hair analysis. Wood has no further questions. 2.07 p.m.
- 27:33Speaker 1: Pryor asks Martinez if plastic is a good conduit for fingerprints.
- 27:37Speaker 1: She says yes. It's a very good surface for latent
- 27:40Speaker 1: prints because it's non-porous. She was able to find Alec's
- 27:43Speaker 1: fingerprint and part of his handprint. Pryor asks how many
- 27:47Speaker 1: hairs Martinez collected. She doesn't recall how many, but they're
- 27:50Speaker 1: in her notes. Boyce allows her to look at her
- 27:53Speaker 1: notes as a memory refresher. 2.12 p.m. Martinez looks at
- 27:58Speaker 1: her notes and believes around 50 different adhesive notes were
- 28:01Speaker 1: used to collect the hairs from the plastic at the scene.
- 28:04Speaker 1: Some of the hairs were found right away. Others were
- 28:07Speaker 1: seen after multiple processes. 2.13 p.m. Martinez does not do
- 28:11Speaker 1: anything with DNA. Pryor asks if Martinez was asked by
- 28:16Speaker 1: law enforcement to compare Prince to anybody else other than
- 28:19Speaker 1: Alex Cox, Chad, and Lori. She says no. Pryor has
- 28:22Speaker 1: no further questions. The state has no redirect, and Martinez
- 28:26Speaker 1: is dismissed from her subpoena. Mid-afternoon recess right now, back
- 28:31Speaker 1: in 20. 2.39 p.m. Detective Werther is back on the stand,
- 28:35Speaker 1: and Blake will continue her examination. She pulls up the presentation.
- 28:39Speaker 1: And Boyce says fingers crossed. Where their statement about being
- 28:43Speaker 1: less than ideal was in reference to the tech issues. 2.41 p.m.
- 28:48Speaker 1: The slideshow shows the mapping of the voice call from
- 28:51Speaker 1: Lori's phone to Chad's phone. It was 1 minute 45 seconds.
- 28:55Speaker 1: The next slide shows Alex Cox's device was in the
- 28:57Speaker 1: same area as Charles Vallow's device as 12.57 through 12.59 p.m.
- 29:03Speaker 1: Chad's device texted Lori's device at 1.11 p.m. Charles' device
- 29:07Speaker 1: went to Alex's home at 1.26 p.m. 2.44 p.m. Werther
- 29:12Speaker 1: shows text going back and forth between Chad and Lori's devices.
- 29:15Speaker 1: Melanie B. called Lori Vallow in a call that lasted
- 29:18Speaker 1: five minutes. 2.46 p.m. Lori called Detective Yunklin's desk that afternoon.
- 29:24Speaker 1: Yunklin interviewed Lori. Lori's device missed a call from Kobe
- 29:28Speaker 1: Ryan and called the Valley of the Sun mortuary. That
- 29:32Speaker 1: call lasted nine minutes, 39 seconds. There was ongoing text
- 29:35Speaker 1: communications between Lori and Chad's devices. 2.48 p.m. At 2.24 p.m.,
- 29:41Speaker 1: Chad's device texted Lori's device. The contents of the text
- 29:45Speaker 1: were not preserved. Lori's device then texted Chad's device back. 2.49 p.m.
- 29:50Speaker 1: Werther lays out several slides showing Alex Cox's device calling
- 29:54Speaker 1: Detective Inklund's desk. Melanie B. 's device called Lori's device.
- 29:58Speaker 1: And there is other communications between Charles' device, Lori's device,
- 30:02Speaker 1: and Alex's device. 2.52 p.m. Detectives ended up taking possession
- 30:07Speaker 1: of Charles' device. It remains with Chandler Police property and evidence. 2.53 p.m.
- 30:13Speaker 1: At 4.02 p.m., there is a call from Alex's device
- 30:16Speaker 1: to Lori's device. More texts and calls between Lori's device
- 30:19Speaker 1: and Chad's device. 2.56 p.m. Chad Daybelt's device called the
- 30:24Speaker 1: Valley of Sun Mortuary at 7.34 p.m. that evening. The
- 30:27Speaker 1: call lasted... 7 minutes, 14 seconds. It was the only
- 30:31Speaker 1: call from his device that day to someone who was
- 30:34Speaker 1: not Lori Vallow. 2.58 p.m. Werther continues to detail the
- 30:38Speaker 1: text and call activity for the rest of the day.
- 30:41Speaker 1: Several messages between Lori and Chad's devices. 3 p.m. Exhibits over.
- 30:46Speaker 1: Blake has nothing further. Pryor will now cross-examine. 3.01 p.m.
- 30:50Speaker 1: Pryor asks about the history of the phone correspondence between
- 30:54Speaker 1: Chad and Lori's devices. Werther says he did not look
- 30:57Speaker 1: at the history, just focused on that day. Pryor asks
- 31:00Speaker 1: Werther if he reviewed the call Chad made to the
- 31:02Speaker 1: funeral home. Werther has not. 3.02 p.m. Pryor asks Werther
- 31:07Speaker 1: if he's aware Chad and Lori were engaged in an affair.
- 31:10Speaker 1: Werther says that's what he has been told. Pryor asks
- 31:14Speaker 1: if cell tower coverage is the least effective way to
- 31:16Speaker 1: obtain data from a cell phone. Werther says he's not sure.
- 31:20Speaker 1: It's the least effective, but it's not as accurate as
- 31:22Speaker 1: GPS data. 3.03 p.m. Pryor points out that Chad was
- 31:26Speaker 1: in Utah the day of the texts and calls. Pryor
- 31:29Speaker 1: says because of that, there's a possibility Werther's data is
- 31:32Speaker 1: not accurate. Pryor suggests phone reception could be poor because
- 31:36Speaker 1: Chad was in Springville. 3.05 p.m. Pryor asks about the
- 31:39Speaker 1: Burger King video. He says there appeared to be three
- 31:42Speaker 1: people in the vehicle. Werther says it's possible and indeed
- 31:46Speaker 1: likely that three people were inside the car. 3.06 p.m.
- 31:50Speaker 1: Pryor has no further questions. Blake has some questions on redirect.
- 31:54Speaker 1: She follows up. On prior suggesting some of the calls
- 31:57Speaker 1: may not have gone through due to poor reception, Werther
- 32:00Speaker 1: says the calls, with their duration and text with Chad
- 32:04Speaker 1: and Lori's devices, were noted on his presentation. Blake, nothing further. 3.08 p.m.
- 32:10Speaker 1: Werther is released from his subpoena. Boyce reads a limiting
- 32:13Speaker 1: instruction to the jury about the Arizona case involving Charles
- 32:17Speaker 1: and tells the jury they shouldn't consider it when deliberating. 3.11 p.m.
- 32:22Speaker 1: Wood requests a brief sidebar. and we're going to dismiss
- 32:24Speaker 1: for the day. Well, folks, things are not looking good
- 32:27Speaker 1: for Chad Daybell, and they just continue to get worse
- 32:30Speaker 1: every single time we get together and talk about what
- 32:32Speaker 1: went down in the courtroom. And I think it's relatively
- 32:35Speaker 1: apparent to anyone who's paying attention and following along what
- 32:39Speaker 1: the outcome is about to be. But either way, we're
- 32:42Speaker 1: going to continue to follow along, and we'll see where
- 32:44Speaker 1: it all ends up when the jury renders their verdict.
- 32:48Speaker 1: All of the information that goes with this episode can
- 32:51Speaker 1: be found in the description box. What's up, everyone, and
- 32:54Speaker 1: welcome back to the program. In this episode, we're gonna
- 32:58Speaker 1: get right back to the Chad Daybell trial, and we're
- 33:00Speaker 1: gonna pick up with what went down on day number
- 33:03Speaker 1: 20 inside of the courtroom. And to do that, once again,
- 33:07Speaker 1: we're using eastidahonews.com, and the author of this article is
- 33:11Speaker 1: Nate Eaton. 8.27 a.m., back in the courtroom, prosecutors Lindsey Blake,
- 33:16Speaker 1: Rob Wood, Ingrid Beatty, and Rocky Wixom are at the
- 33:19Speaker 1: prosecution's table. John Pryor is at the defense. Attorneys are
- 33:24Speaker 1: headed back to meet with Judge Boyce. I spotted FBI
- 33:27Speaker 1: evidence analyst Benjamin Dean walking into the courtroom this morning. 8.31 a.m.
- 33:32Speaker 1: Larry Woodcock, Vicki Hoban, Tammy Daybell's aunt are in the
- 33:36Speaker 1: gallery this morning. There are around 25 members of the
- 33:39Speaker 1: public here. 8.44 a.m. Chad Daybell is walked into the
- 33:44Speaker 1: courtroom wearing a checkered dress shirt and a yellow tie.
- 33:47Speaker 1: Judge Boyce is on the bench and the jurors are
- 33:50Speaker 1: being brought in. 8.47 a.m. First witness today is Catherine Dacey,
- 33:55Speaker 1: a forensic biologist and supervisor with the Idaho State Police.
- 33:59Speaker 1: She will be questioned by Rob Wood. 8.50 a.m. Dacey
- 34:03Speaker 1: explains her experience in training. As part of her job,
- 34:06Speaker 1: she examines items of evidence and generates DNA profiles from
- 34:10Speaker 1: the items. M2020-2233 is the case number for J.J. Vallow
- 34:18Speaker 1: and Tylee Ryan. Dacey received autopsy samples from J.J., tape
- 34:23Speaker 1: from around his hands, ankles, mouth, along with the tape
- 34:26Speaker 1: and plastic from around his head and body. She also
- 34:30Speaker 1: received two swabs from an apartment in Rexburg and tools
- 34:33Speaker 1: and a necklace from the Daybell property. She received samples
- 34:37Speaker 1: from J.J. Vallow, Tylee Ryan, Lori Vallow, Chad Daybell, Melanie Gibb,
- 34:42Speaker 1: and others. 8.53 a.m. Wood moves to submit a lab
- 34:46Speaker 1: report written by Riley Noland Dacey supervisor. The first page
- 34:51Speaker 1: shows that molars from Tylee were tested. A reference sample
- 34:55Speaker 1: from Lori Vallow and Dennis Trahan, JJ's biological father. There
- 35:00Speaker 1: was also a reference profile from JJ Vallow. 8.55 a.m.
- 35:04Speaker 1: Dace explains you get half of your DNA from your
- 35:07Speaker 1: mom and half from your dad. She explains that their
- 35:10Speaker 1: testing shows Lori is Tylee's biological mom and Dennis is
- 35:14Speaker 1: JJ's biological dad. 8.58 a.m. Dace says her lab received
- 35:19Speaker 1: the tape and plastic wrapped around JJ's body for testing.
- 35:23Speaker 1: No DNA testing was done on the bag, but testing
- 35:26Speaker 1: was done on the tape. When examining the tape, I
- 35:29Speaker 1: was looking for irregular edges that indicated someone may have
- 35:33Speaker 1: torn the tape with their teeth and left behind saliva.
- 35:37Speaker 1: Dacey also swabbed areas of unidentifiable fingerprints. 8.59am. There was
- 35:44Speaker 1: blood on all of the tape and plastic. DNA testing
- 35:47Speaker 1: was not done. as it was presumed to be JJ's.
- 35:51Speaker 1: A lot of the tape had small hairs and skin
- 35:53Speaker 1: attached to it, and a swab from a knife blade
- 35:55Speaker 1: in the Rexburg apartment was negative for blood. There was
- 35:59Speaker 1: a swab from the wall with a small amount of blood,
- 36:01Speaker 1: but DNA analysis was not performed. Dacey received 18 tools
- 36:06Speaker 1: from a garage barn on Daybell's property, 901 AM. Dacey
- 36:11Speaker 1: found areas on handles of the shovels with small amounts
- 36:14Speaker 1: of blood. On four of the tools, she found matter
- 36:17Speaker 1: that could have been human DNA. She photographed the tools
- 36:20Speaker 1: and tested them. She collected hairs and fiber if she
- 36:23Speaker 1: saw them. Some of the tools were quite dirty, so
- 36:26Speaker 1: she needed to remove the dirt and the ashes. 9.04 a.m.
- 36:31Speaker 1: Wood moves to admit an exhibit showing photos Daisy took
- 36:35Speaker 1: of the tools along with hairs and fibers on tape. 9.07 a.m.
- 36:39Speaker 1: The first photo is of a shovel. Daisy examined it
- 36:42Speaker 1: for blood and swabbed it. She collected some possible human
- 36:45Speaker 1: remains from the shovel too. The next picture shows possible
- 36:49Speaker 1: charred flesh that Daisy collected and photographed. She ran a
- 36:53Speaker 1: portion of it for DNA. The next picture is a
- 36:56Speaker 1: close-up of what she collected and ran for DNA. She
- 37:00Speaker 1: was not able to generate a DNA profile from the material.
- 37:04Speaker 1: And usually when you're looking at a trial like this,
- 37:07Speaker 1: the defense has something tangible to offer. But they haven't
- 37:11Speaker 1: had anything tangible to offer throughout this whole thing. and
- 37:13Speaker 1: I doubt they're going to have anything tangible to offer
- 37:16Speaker 1: as we make our way forward. And that's because there's
- 37:19Speaker 1: nothing there for them to even sink their teeth into.
- 37:21Speaker 1: Just like with Lori Vallow, we saw what her lame-ass
- 37:24Speaker 1: defense was, and it's pretty much the same thing here.
- 37:27Speaker 1: Except Chad Daybell's saying that Lori Vallow's the one that's responsible, basically. Oh,
- 37:32Speaker 1: I was just some dumbass who was led around by
- 37:34Speaker 1: my ding-ding. That's basically what he's telling us. 9.07am. The
- 37:39Speaker 1: first photo is of a shovel. Daisy examined it for
- 37:42Speaker 1: blood and swabbed it. She collected some possible human remains
- 37:45Speaker 1: from the shovel too. The next picture shows possible charred
- 37:48Speaker 1: flesh that Daisy collected and photographed. She ran a portion
- 37:52Speaker 1: of it for DNA. The next picture is a close-up
- 37:56Speaker 1: of what she collected and ran for DNA. She was
- 37:58Speaker 1: not able to generate a DNA profile from the material. 9.09 a.m.
- 38:03Speaker 1: We now see a photo of another shovel. Daisy tested
- 38:06Speaker 1: it for blood and examined the toolhead for blood or
- 38:09Speaker 1: human remains. Another photo is material she collected from the shovel.
- 38:14Speaker 1: The material on the left was very, very small, but
- 38:17Speaker 1: there was more on the right that was selected for DNA. 9.10 a.m.
- 38:22Speaker 1: The next picture is a close-up of what was on
- 38:24Speaker 1: the right of the shovel. Wood asks for the shovels
- 38:27Speaker 1: to be brought out for the jury to see. The
- 38:29Speaker 1: bailiff brings the tools to the table in front of
- 38:32Speaker 1: the jurors. 9.12 a.m. Daisy takes a handheld microphone and
- 38:36Speaker 1: approaches the table wearing black rubber gloves. Wood refers to
- 38:40Speaker 1: a shovel on the table. Daisy points out it was
- 38:43Speaker 1: very dirty and she observed a lip on the back
- 38:46Speaker 1: edge of the shovel that she believed was human remains.
- 38:49Speaker 1: Daisy performed DNA testing on the material. 9.14 a.m. Daisy
- 38:54Speaker 1: returns to the witness stand and a picture of the
- 38:57Speaker 1: shovel is shown on the screen. She confirms it's the
- 39:00Speaker 1: same shovel that is on the table. Another photo shows
- 39:03Speaker 1: a close-up of the substance that was on the back
- 39:06Speaker 1: lip of the shovel. 9.16 a.m. The next picture shows
- 39:10Speaker 1: Daisy took photos of possible DNA with a stereoscope, a
- 39:14Speaker 1: special type of microscope. 9.18 a.m. Which shows another photo?
- 39:20Speaker 1: Daisy says a green substance was found on part of
- 39:22Speaker 1: the shovel. She was able to obtain a DNA profile
- 39:26Speaker 1: on the spot. The DNA profile matched Tylee Ryan. 604 octillion.
- 39:31Speaker 1: That's 27 zeros. That's the DNA is hers. So pretty
- 39:36Speaker 1: much no way to wiggle out of that, huh? What
- 39:39Speaker 1: are you going to say? It wasn't me. It was
- 39:41Speaker 1: one of the other 604 octillion people out there that
- 39:44Speaker 1: share my DNA. Good luck with that. So obviously there's
- 39:48Speaker 1: no doubt that these remains belong to Tylee Ryan. 921 AM.
- 39:53Speaker 1: Daisy leaves the stand again and goes to the table
- 39:56Speaker 1: to retrieve the pickaxe. There was blood on the axe
- 39:59Speaker 1: and it was dirty. She removed the dirt and found
- 40:01Speaker 1: ashes and human remains embedded in the eye of the pickaxe.
- 40:05Speaker 1: She collected, photographed, and ran the samples for DNA. 922 AM.
- 40:11Speaker 1: Daisy made circles on the handle of the pickaxe and
- 40:14Speaker 1: swabbed the head of the tool. There did appear to
- 40:16Speaker 1: be some possible burn marks in the item as well
- 40:19Speaker 1: as addition to the burn material that was in the eye,
- 40:22Speaker 1: Dacey says. There was also two stains on the pickaxe
- 40:26Speaker 1: that she ran for DNA. 9.23 a.m. Wood shows a
- 40:31Speaker 1: photo of the pickaxe on the screen and a close-up
- 40:33Speaker 1: of the pickaxe blade area. Dacey found material she could
- 40:36Speaker 1: run for DNA. Wood shows a close-up photo of stains
- 40:40Speaker 1: on the handle of on the pickaxe that tested positive
- 40:43Speaker 1: for blood. 9.25 a.m. Wood shows a photo of dark
- 40:46Speaker 1: material that was removed from the eye of the pickaxe.
- 40:50Speaker 1: Wood shows a photo of the largest piece of material
- 40:52Speaker 1: that Daisy found. She ran part of it for DNA.
- 40:56Speaker 1: She obtained a partial DNA profile on the sample. That's
- 41:00Speaker 1: common on some samples that are degraded. Heat and fire
- 41:03Speaker 1: cause degradation. Daisy was still able to do a comparative
- 41:07Speaker 1: analysis with the partial profile. She compared the profile against
- 41:11Speaker 1: the known reference samples J.J. Vallow, Tylee Ryan, Lori Vallow,
- 41:16Speaker 1: and Chad Daybell. Tylee Ryan was a possible contributor to
- 41:19Speaker 1: the possible DNA profile 159 trillion times that it was
- 41:24Speaker 1: her versus a random person from the general population. 9.29 a.m.
- 41:29Speaker 1: The two spots on the pickaxe handle tested positive for blood.
- 41:32Speaker 1: Daisy performed DNA testing on the blood. She was able
- 41:36Speaker 1: to obtain a profile. The profile matched Tylee Ryan. 604
- 41:41Speaker 1: octillion times that means it was her versus an unrelated,
- 41:45Speaker 1: randomly selected person. 9.31 a.m. Hairs and fibers were collected.
- 41:50Speaker 1: Wood shows an image showing three yellow sticky notes. Each
- 41:54Speaker 1: one of the sticky notes contains hairs of fiber that
- 41:56Speaker 1: were collected. These hairs were collected from tape and plastic
- 42:00Speaker 1: wrapped around JJ. Several hairs were tested for DNA. No
- 42:04Speaker 1: profiles were able to be generated. 9.33 a.m. Some of
- 42:09Speaker 1: the hairs collected were sent to private labs, including Bodhi
- 42:12Speaker 1: Technology in Virginia. Wood moves to admit a report from
- 42:17Speaker 1: Bodhi Technology. 9.35 a.m. The report says DNA profiles were
- 42:22Speaker 1: provided for Tylee Ryan, Lori Vallow, and Melanie Gibb. The
- 42:26Speaker 1: partial DNA profile on hair obtained from tape on the
- 42:30Speaker 1: black bags matched Lori Vallow. Probability was Lori is 1
- 42:35Speaker 1: in 71 billion. Wood asks for a brief sidebar. 9.40 a.m.
- 42:41Speaker 1: Wood has no further questions. Pryor will now cross-examine. 9.45 a.m.
- 42:46Speaker 1: Pryor asks Daisy how many tools were provided to her.
- 42:49Speaker 1: There were 18. She tested all of them. Pryor asks
- 42:52Speaker 1: how many tools tested positive for blood. She needs to
- 42:55Speaker 1: review her notes and responds that out of the first
- 42:58Speaker 1: 10 tools she looked at, 9 were positive for blood. 9.47 a.m.
- 43:04Speaker 1: Daisy was unable to test all the blood because the
- 43:07Speaker 1: spots were very small and and would have been consumed.
- 43:11Speaker 1: Pryor asks how she collects DNA. Daisy says there are
- 43:14Speaker 1: different ways to test blood, semen, saliva, sweat, skin cells,
- 43:19Speaker 1: in gloves, on clothing, etc. So in other words, they
- 43:22Speaker 1: have many different ways to skin that cat. And there's
- 43:26Speaker 1: plenty of ways to track down the DNA. If there's
- 43:29Speaker 1: any DNA there to be tracked down. 9.49 a.m. Pryor
- 43:32Speaker 1: says if he sets down his pen, he could leave
- 43:35Speaker 1: DNA on it by sweat, skin cells, saliva, etc., Daisy
- 43:38Speaker 1: says yes. She found potential blood on 9 of the
- 43:41Speaker 1: 10 tools. The remaining 8 tools had no blood or DNA. 9.50 a.m.
- 43:48Speaker 1: All the tools were obtained by the lab on July 30, 2020.
- 43:52Speaker 1: JJ and Tylee were buried in September of 2019, 10
- 43:57Speaker 1: months earlier. Prior asks if we know who had contact
- 44:00Speaker 1: with the tools in the 10 months. Daisy says we don't.
- 44:04Speaker 1: Daisy says none of the stains or materials tested had
- 44:07Speaker 1: Chad's DNA on it. The handles of the tools were
- 44:09Speaker 1: not swabbed for DNA. Daisy says if they had been
- 44:13Speaker 1: at the property for years, you would expect to find
- 44:15Speaker 1: the owner's DNA on it. And that's a good point.
- 44:18Speaker 1: If these were tools that Chad was using all the time,
- 44:21Speaker 1: then his DNA would be all over it, right? But
- 44:23Speaker 1: they didn't find that, did they? 9.54 a.m. Pryor asked
- 44:27Speaker 1: if there was DNA on the necklace found on the property.
- 44:29Speaker 1: She found some possible material that she could have run
- 44:32Speaker 1: for DNA, but it was consumptive. 9.55 a.m. Pryor shows
- 44:37Speaker 1: a photo of the tools in Chad's shed. Daisy recognizes them.
- 44:41Speaker 1: Another photo is shown with the tools lying on the ground.
- 44:44Speaker 1: She said some of them appear to be the tools
- 44:46Speaker 1: she received. Pryor zooms into a long shovel and asks
- 44:50Speaker 1: Daisy to closely look at it. She believes it is
- 44:53Speaker 1: one of the tools that she received. He points out
- 44:56Speaker 1: an off-white substance on the handle. 9.59 a.m. Pryor shows
- 45:01Speaker 1: the photo from earlier that shows the same shovel. He
- 45:04Speaker 1: asks if she removed things from the tools. Daisy says
- 45:07Speaker 1: she swabs and collects items from the handles and other
- 45:10Speaker 1: parts of the tools. 10.01 a.m. Pryor asks about the
- 45:14Speaker 1: investigation of the plastic and the tape. Pryor asks whose
- 45:18Speaker 1: DNA was found on the tape. She says J.J. Vallow's.
- 45:21Speaker 1: That was the only DNA sample that she obtained. The
- 45:24Speaker 1: hair samples came from the adhesive side of the tape
- 45:27Speaker 1: on the plastic. Daisy says she collected a lot of
- 45:30Speaker 1: hair samples. 10.03 a.m. Dacey says the majority of the
- 45:34Speaker 1: hairs were collected prior to latent print processing. When she
- 45:38Speaker 1: went back and swabbed the unidentifiable prints on the tape,
- 45:42Speaker 1: she found more hair. 10.05 a.m., morning recess, back in 20.
- 45:47Speaker 1: All right, we're going to break here, and in the
- 45:49Speaker 1: next episode, talking about the topic, we'll pick up where
- 45:52Speaker 1: we left off. All of the information that goes with
- 45:55Speaker 1: this episode can be found in the description box. What's up, everyone,
- 45:59Speaker 1: and welcome back to the program. In this episode, we're
- 46:02Speaker 1: going to pick up where we left off with day
- 46:05Speaker 1: number 20 of the Chad Daybell trial. And once again,
- 46:09Speaker 1: we're using EastIdahoNews.com to guide us. And the author of
- 46:12Speaker 1: this article is Nate Eaton. 10.35 a.m. Back in the courtroom,
- 46:18Speaker 1: Pryor continues to question Dacey about the hair collection. There
- 46:21Speaker 1: were 15 total collected hairs and each collection had one
- 46:25Speaker 1: or more fibers inside. Dacey is not in the position
- 46:28Speaker 1: to talk about who all the hair belonged to. The
- 46:31Speaker 1: Bodhi test hair was linked to Lori Vallow. 10.37 a.m.
- 46:36Speaker 1: The first set of hairs was tested in June 2020.
- 46:39Speaker 1: The second set was tested in December of 2022. Dacey
- 46:44Speaker 1: says for that type of DNA testing that she does,
- 46:47Speaker 1: you need a root present. A latent print of J.J.
- 46:49Speaker 1: Vallow's hand was found on the tape. 10.40 a.m. Dacey
- 46:53Speaker 1: says the police department requested her department do the testing.
- 46:57Speaker 1: Dacey was under guidelines not to consume evidence during testing.
- 47:01Speaker 1: So some stuff was not tested. The handles of the
- 47:04Speaker 1: tools were not tested for DNA or latent prints. 10.43 a.m.
- 47:10Speaker 1: Pryor says he wants to ask about soil and DNA.
- 47:13Speaker 1: Daisy smiles and he says, do you know where I'm going?
- 47:16Speaker 1: She says, no. He says, that's why you're smiling. 10.44 a.m.
- 47:21Speaker 1: Pryor asks the date and time the DNA was put
- 47:24Speaker 1: on the tools. She says she doesn't know. She can't
- 47:27Speaker 1: ascertain when the DNA was on there. She says there
- 47:30Speaker 1: was no DNA associated to Chad Daybell. So a guy
- 47:34Speaker 1: owns all this property, has all of these tools for
- 47:37Speaker 1: farming and other uses, and he doesn't have DNA on
- 47:40Speaker 1: any of them? So what, he was a rich man,
- 47:43Speaker 1: and he employed a team of gardeners to come around
- 47:46Speaker 1: and fix his property up? Give me a break. The
- 47:49Speaker 1: reason that his DNA isn't found on that stuff is
- 47:51Speaker 1: pretty simple, because he never used it. It was all
- 47:54Speaker 1: purchased for this purpose. 10.46 a.m. Pryor has no further questions.
- 47:59Speaker 1: Wood will now redirect. 10.46 a.m. Wood asks what consumptive
- 48:04Speaker 1: testing is. Gacy says in order to do a DNA
- 48:07Speaker 1: consumptive test, you would need to use the entire sample
- 48:10Speaker 1: and it would be destroyed. Wood asks if she has
- 48:13Speaker 1: ever been on a case where she has tested every
- 48:15Speaker 1: single possible DNA sample. She says no, not in a
- 48:18Speaker 1: large case. They test to answer questions and do their
- 48:22Speaker 1: best not to overly consume evidence. just to test more
- 48:25Speaker 1: of the same thing. 10.48 a.m. Wood has no further questions.
- 48:30Speaker 1: Pryor says he wants some follow-up. Wood says he didn't
- 48:33Speaker 1: go anywhere Pryor did not. The judge agrees, and Pryor
- 48:36Speaker 1: isn't allowed to ask anything more. Dacey remains under subpoena. 10.49 a.m.
- 48:43Speaker 1: The next witness is Detective Colin Nesbitt. He works for
- 48:46Speaker 1: the Kauai Police Department. Ingrid Beatty is questioning him. 10.51 a.m.
- 48:51Speaker 1: Nesbitt was a detective. in 2020 assigned to the Major
- 48:55Speaker 1: Crimes Unit. Nesbitt and his team was assisting Rexburg police
- 48:59Speaker 1: in serving a legal document to Lori Vallow and Chad
- 49:02Speaker 1: Daybell on January 25, 2020. The document ordered Lori to
- 49:07Speaker 1: bring JJ and Tylee to the Department of Health in Rexburg. 10.53 a.m.
- 49:13Speaker 1: Nesbitt served Chad and Lori papers at 2.29 p.m. in
- 49:17Speaker 1: the swimming pool area of the condo where they were staying. 10.56 a.m.
- 49:22Speaker 1: Beatty shows a video. On January 26, police obtained a
- 49:26Speaker 1: search warrant for their condo and vehicle. They served it
- 49:30Speaker 1: on Chad and Lori. They cooperated with police and a
- 49:33Speaker 1: search of the vehicle was performed. Photos were taken of
- 49:36Speaker 1: the SUV. Beatty moves to admit the pictures as evidence. 10.59am.
- 49:43Speaker 1: The search of the vehicle took place two days after
- 49:45Speaker 1: Chad and Lori were served the warrant. The first photo
- 49:48Speaker 1: shows the front of the rental vehicle that was seized.
- 49:51Speaker 1: The second photo shows inside the SUV from the front
- 49:54Speaker 1: door driver's side. Lori's purse is on the seat. The
- 49:57Speaker 1: next photo is a close-up of the seat. 11.02am. Police
- 50:02Speaker 1: found Tylee Ryan's debit card in Lori's purse. Photos of
- 50:05Speaker 1: the card are shown on the screen. A cell phone
- 50:08Speaker 1: was also found in the side pocket of Lori's purse.
- 50:11Speaker 1: The phone and other items were shipped to the Rexburg
- 50:13Speaker 1: Police Department. The next photo shows the rear view of
- 50:17Speaker 1: the SUV. Two adult bikes were found in the cargo
- 50:20Speaker 1: area of the car. 11.04 a.m. Beatty shows more photos
- 50:24Speaker 1: of the vehicle's interior. We see the bikes and backpack.
- 50:27Speaker 1: There is also a handbag. Inside the handbag is a
- 50:30Speaker 1: Visions of Glory book, two iPads, a manila envelope, and
- 50:34Speaker 1: a folder. 11.06 a.m. We see a photo of an
- 50:37Speaker 1: iPad that says JJ written in red on the iPad cover.
- 50:41Speaker 1: The next photo is Charles Vallow's death certificate and there
- 50:44Speaker 1: were 17 total copies. A real estate paper for the
- 50:48Speaker 1: condo Chad and Lori were renting was also in the handbag. 11.08 a.m.
- 50:53Speaker 1: Social security cards belonging to JJ and Tylee were also
- 50:56Speaker 1: found along with the birth certificates including Tylee's. There is
- 51:00Speaker 1: also a death certificate from the state of Arizona but
- 51:03Speaker 1: it's hard for him to read the tiny print to
- 51:05Speaker 1: say who it is. 11.10 a.m. The next photo is
- 51:09Speaker 1: JJ's original birth certificate from Louisiana. Now we see a
- 51:13Speaker 1: blue sky property management document for Lori's Rexburg apartment. The
- 51:17Speaker 1: patriarchal blessing Chad gave to Alex on November 24th, 2019
- 51:23Speaker 1: was also found in the bag. The next photo is
- 51:25Speaker 1: a black Jansport backpack. 11.12 a.m. There is a page
- 51:29Speaker 1: that has several blue sticky notes attached to it. Nesbitt
- 51:32Speaker 1: says he doesn't know what any of it means. There
- 51:35Speaker 1: was also a MacBook Pro and an HP laptop in
- 51:38Speaker 1: the bag. 11.14 a.m. We now see a photo showing
- 51:42Speaker 1: an envelope full of cash that was found in the backpack.
- 51:45Speaker 1: There was $ 10, 500 in the envelope. You know, just a
- 51:49Speaker 1: little bit of walking around cash, right? Everybody walks around
- 51:52Speaker 1: with 10 racks in their pocket. 11.15 a.m. Nesbitt was
- 51:57Speaker 1: present when the condo was searched on January 26, 2020.
- 52:01Speaker 1: Around three items were taken, including rubber wedding bands. There
- 52:05Speaker 1: was no sign that children lived there or had ever
- 52:07Speaker 1: been there. Beatty has no further questions. 11.17 a.m. Prior
- 52:12Speaker 1: asks if Chad made any comments when the papers were
- 52:15Speaker 1: served at the pool. Nesbitt says no. He looked over
- 52:18Speaker 1: at the papers that were served to Lori. Prior asks
- 52:21Speaker 1: if it was a custody order for the kids to
- 52:23Speaker 1: be returned back to Idaho. Nesbitt says yes. Prior asks
- 52:27Speaker 1: about the credit card found on the driver's side of
- 52:29Speaker 1: the car Lori was driving. 11.18 a.m. Chad was sitting
- 52:34Speaker 1: in the front passenger seat. Pryor asks if anything of
- 52:37Speaker 1: evidentiary interest was found on Chad's side of the car.
- 52:40Speaker 1: Nesbitt says no. Pryor asks about a book found in
- 52:43Speaker 1: the car. He asks what faith the book comes from.
- 52:46Speaker 1: Nesbitt doesn't know. Again, trying to frame it all like
- 52:49Speaker 1: it's all Lori Vallow. Chad Daybell, just a bystander here.
- 52:53Speaker 1: Just a guy that's getting yanked around by his ding-ding. 11.20 a.m.
- 52:58Speaker 1: Pryor asks about the handbag and what was found inside.
- 53:01Speaker 1: The bag was found in the rear passenger seat behind
- 53:04Speaker 1: where Chad was sitting. Pryor asks who owned the black backpack.
- 53:07Speaker 1: Nesbitt doesn't know. Pryor asks if Lori was trying to
- 53:10Speaker 1: flee when they pulled her over. Nesbitt says no. Lori
- 53:14Speaker 1: and Chad were completely cooperative and did not try to flee. 11.22 a.m.
- 53:19Speaker 1: The currency was found in the backpack along with the
- 53:22Speaker 1: MacBook Pro, the HB laptop. A wallet with four credit
- 53:25Speaker 1: cards belonging to Chad Daybell was also found in the backpack.
- 53:29Speaker 1: A death certificate and marriage license was also found in
- 53:33Speaker 1: the bag. Pryor Has no further questions. 11.23 a.m. Beatty
- 53:38Speaker 1: will now cross-examine. Beatty asks about Chad not saying anything
- 53:42Speaker 1: during encounters with the police. He didn't say, what's this
- 53:45Speaker 1: all about? Nesbitt says he didn't say anything. Beatty asks
- 53:49Speaker 1: a few clarifying questions and is finished. Nesbitt is released
- 53:53Speaker 1: from the subpoena. The next witness is FBI intelligence analyst
- 53:57Speaker 1: Benjamin Dean. Rob Wood will question him, but needs to
- 54:02Speaker 1: run and grab his questions. 11.35 a.m. Dean has worked
- 54:06Speaker 1: for the FBI for eight years. He is currently assigned
- 54:08Speaker 1: to the Salt Lake City Field Office. His main job
- 54:11Speaker 1: is to analyze information and make assessments regarding specific threats. 11.37 a.m.
- 54:18Speaker 1: Dean began working the Daybell case in late March of 2020.
- 54:22Speaker 1: His initial assignment was to review tips submitted by members
- 54:25Speaker 1: of the public in response to a news release issued
- 54:28Speaker 1: by the FBI and Rexburg Police on March 5th, 2020.
- 54:32Speaker 1: regarding Tylee and JJ. 11.40 a.m. The FBI received 600
- 54:37Speaker 1: Day 800 tips, many of which had photos and videos.
- 54:41Speaker 1: Dean was asked to review devices that were seized from
- 54:44Speaker 1: Daybell's home in January of 2022. He completed his review
- 54:49Speaker 1: in May of 2020. He was also asked to review
- 54:52Speaker 1: the contents of two Blu-ray discs containing data extracted from
- 54:56Speaker 1: storage devices seized from Chad's property on January 3rd, 2020. 11.41 AM.
- 55:02Speaker 1: Dean used a Blu-ray player to review the two discs.
- 55:05Speaker 1: He explains how he was able to open and view
- 55:08Speaker 1: the files using Celebrite software. 11.45 AM. The Blu-ray discs
- 55:14Speaker 1: contained data from a cell phone belonging to Tammy Daybell.
- 55:18Speaker 1: They were incoming messages to Tammy and outgoing messages from Tammy.
- 55:22Speaker 1: There were group messages involving members of Daybell family, including Tammy. 11.46 AM.
- 55:29Speaker 1: All outgoing communication on the device ended on the evening
- 55:32Speaker 1: of October 18th, 2019, the day before Tammy was found dead. 11.49 a.m.
- 55:40Speaker 1: On September 9th, 2019, a text message from Chad's phone
- 55:44Speaker 1: caught Dean's attention. Wood moves to admit an exhibit and
- 55:47Speaker 1: the projector has a technical issue. Court staff working to
- 55:51Speaker 1: fix the problem. 11.51 a.m. Judge calls for a lunch break. 12.50,
- 55:56Speaker 1: back in the courtroom. Dean remains on the stand. Wood
- 56:00Speaker 1: continues to question. 12.54 p.m. Dean looks at the exhibit
- 56:04Speaker 1: and would ask to publish. It's a message Chad sent
- 56:07Speaker 1: to Tammy. I've had an interesting morning. I felt I
- 56:10Speaker 1: should burn all of the limb debris by the fire
- 56:13Speaker 1: pit before it got too soaked by the coming storm.
- 56:16Speaker 1: While I did so, I spotted a big raccoon along
- 56:18Speaker 1: the fence. I hurried and got my gun, and he
- 56:21Speaker 1: was still walking along. I got close enough that one
- 56:24Speaker 1: shot did the trick. He is now in our pet cemetery.
- 56:28Speaker 1: Fun times. 1 p.m. The message was sent on September 9th,
- 56:33Speaker 1: 2019 at 10.53 a.m. 101 p.m. Chad sent a second
- 56:38Speaker 1: message to Tammy the same day at 10.56 a.m. Gonna
- 56:42Speaker 1: shower now and then go write for a while at BYU.
- 56:45Speaker 1: Love you. 102 p.m. Tammy sent a message to Chad
- 56:49Speaker 1: at 1.47 p.m. Good for you. Chad sent a message
- 56:52Speaker 1: to Tammy at 1.48 p.m. I'm back home now. 103 p.m.
- 56:58Speaker 1: The first message stood out to Dean because it was
- 57:00Speaker 1: longer and more detailed than any other messages that were
- 57:03Speaker 1: exchanged between Tammy and Chad. Messages sent between the two
- 57:07Speaker 1: were relatively short and they dealt with routine matters, household matters,
- 57:12Speaker 1: things of that nature, Dean says. 104 p.m. Dean says
- 57:16Speaker 1: this message was the only one on the device where
- 57:19Speaker 1: Chad wrote to Tammy such a lengthy and detailed explanation
- 57:22Speaker 1: of his day's events. The date caught Dean's attention because
- 57:26Speaker 1: his first assignment in the investigation was to review tips
- 57:29Speaker 1: about JJ and Tylee. After having reviewed hundreds of photographs
- 57:33Speaker 1: and video files taken all across Yellowstone National Park on
- 57:37Speaker 1: the 8th of September 2019, I was very much aware
- 57:40Speaker 1: that date was the last day Tylee Ryan was seen alive.
- 57:44Speaker 1: 106 p.m. Chad told Tammy he started a fire, shot
- 57:49Speaker 1: a large animal, and buried that large animal. He did
- 57:52Speaker 1: those things on the day after Tylee Ryan was last
- 57:55Speaker 1: seen alive. Dean says Wood has no further questions. 107 p.m.
- 58:00Speaker 1: Pryor begins by asking Dean if he reviewed Chad's phone too.
- 58:04Speaker 1: He did not, just Tammy's. Pryor asks if there were
- 58:07Speaker 1: frequent discussions between Tammy and other members of her family.
- 58:11Speaker 1: Dean says yes, there were three people living in the
- 58:14Speaker 1: Daybell home, Tammy, Chad, and Garth. 1.08 p.m. Prior asked
- 58:18Speaker 1: Dean if the mention of animals in communication with Tammy
- 58:22Speaker 1: was unusual. Dean says it happened a few times. 1.10 p.m.
- 58:26Speaker 1: Dean says the outgoing messages on Tammy's phone ended on
- 58:30Speaker 1: October 18th, 2019. There were some ingoing messages afterward. Prior
- 58:35Speaker 1: asked Dean how long Tammy and Chad were married. Dean
- 58:39Speaker 1: doesn't know the exact amount. Prior asked if Dean evaluated
- 58:42Speaker 1: all the text messages from their entire marriage. Dean did not. 1.12 p.m.
- 58:49Speaker 1: Pryor asks Dean if he looked at other devices Tammy
- 58:51Speaker 1: Daybell may have had. Dean says no. Pryor asks if
- 58:54Speaker 1: Dean was aware Tammy communicated with her children about locating
- 58:58Speaker 1: and finding raccoons. Wood objects and says this misstates Pryor testimony.
- 59:03Speaker 1: Boyce sustains the objection. 1.13 p.m. Pryor has no further questions.
- 59:08Speaker 1: Wood has some redirect. Wood asks if Dean was provided
- 59:12Speaker 1: with devices for the entire length of the Daybell marriage.
- 59:15Speaker 1: Dean says he was not. 1.15 p.m. Wood has nothing further.
- 59:20Speaker 1: Dean is done but will remain under subpoena just in
- 59:23Speaker 1: case he needs to be called again. 1.16 p.m. The
- 59:26Speaker 1: next witness is Janet Anderson. Rocky Wixom will question her.
- 59:30Speaker 1: Janet lives in St. Charles, Idaho by Bear Lake. She
- 59:33Speaker 1: used to live in Lehman near Rexburg. Janet was the
- 59:36Speaker 1: secretary at Central Elementary in Sugar City. 1.19 p.m. Janet
- 59:41Speaker 1: saw Tammy several times every day. Tammy would often visit
- 59:45Speaker 1: the office. She says everybody loved Tammy. She was friendly
- 59:50Speaker 1: and a nice person. 1.20 p.m. Tammy was never sick.
- 59:54Speaker 1: She never had a cough or a sniffle or a limp.
- 59:57Speaker 1: Nothing that Janice noticed. Tammy never complained about her health.
- 1:00:00Speaker 1: She was the energizer bunny. She was everywhere and did
- 1:00:03Speaker 1: everything she needed to do. She never quit and was
- 1:00:06Speaker 1: always where she needed to be. Tammy did lunchroom duty,
- 1:00:09Speaker 1: computer lab, recess duty. 1.22 p.m. I thought, how could
- 1:00:14Speaker 1: this be? I just barely saw her Friday at 3.45.
- 1:00:18Speaker 1: She was laughing. She was happy. She was talking about
- 1:00:21Speaker 1: putting up curtains in the computer lab. It was really
- 1:00:24Speaker 1: quite a shock. I didn't know how it could happen,
- 1:00:26Speaker 1: Janet says. Tammy and Emma stopped at the office on
- 1:00:29Speaker 1: the way out to tell her about the curtains in
- 1:00:32Speaker 1: the computer lab. 1.23 p.m. Janet last saw Tammy at 3.45 p.m.
- 1:00:37Speaker 1: the day before she died. Janet didn't notice anything wrong
- 1:00:41Speaker 1: with her, and she seemed like she had energy no
- 1:00:43Speaker 1: matter what time of the day it was. She was
- 1:00:46Speaker 1: just always on the go. 1.24 p.m. Wixom asks Janet
- 1:00:51Speaker 1: if she noticed if Tammy gained or lost any weight.
- 1:00:54Speaker 1: She doesn't think so. She was always on the go
- 1:00:57Speaker 1: where she needed to be. Wixom has nothing further. Pryor
- 1:01:01Speaker 1: will now cross-examine. 1.25 p.m. Pryor asks Janet if she
- 1:01:06Speaker 1: remembers speaking with Officer Mattingly. She asks who that is.
- 1:01:09Speaker 1: She explains an officer came by the office to take
- 1:01:12Speaker 1: a report. Pryor asks about Janet telling police that Tammy
- 1:01:16Speaker 1: kept to herself. She explains that she kept to herself
- 1:01:19Speaker 1: because she wanted to do her job and work. She
- 1:01:21Speaker 1: never said personal things to Janet. 1.26 p.m. Pryor asks
- 1:01:26Speaker 1: if Janet agrees that Tammy, one confidant at the school,
- 1:01:29Speaker 1: was Emma, her daughter. Janet says she doesn't agree with that.
- 1:01:33Speaker 1: She had lots of friends at the school and would
- 1:01:35Speaker 1: chat with others. Pryor asks if Tammy and Emma spent
- 1:01:38Speaker 1: a lot of time together when they had downtime. Janet
- 1:01:41Speaker 1: says she doesn't think they did. 127 p.m. Pryor asks
- 1:01:46Speaker 1: about the book fair Tammy was preparing for the day
- 1:01:48Speaker 1: before she died. He asks if it was a significant
- 1:01:51Speaker 1: endeavor to prepare for the fair. Janet says the book
- 1:01:55Speaker 1: fair wasn't until the next week, so there wasn't a
- 1:01:57Speaker 1: lot of extra work that needed to be done on
- 1:01:59Speaker 1: that Friday. 128 p.m. Pryor has nothing further, no redirect,
- 1:02:05Speaker 1: and she is released from the subpoena. 129 p.m. The
- 1:02:08Speaker 1: next witness is Tammy Gee. She works at Central Elementary
- 1:02:12Speaker 1: in Sugar City and has worked there for 14 years.
- 1:02:15Speaker 1: She teaches kindergarten. Ingrid Beatty is questioning her. 1.31 p.m.
- 1:02:20Speaker 1: G and Tammy worked together for around three years. During
- 1:02:24Speaker 1: this testimony, Chad is scrolling with his mouse on the
- 1:02:27Speaker 1: computer in front of him. 1.32 p.m. G spoke with
- 1:02:31Speaker 1: Tammy between 3.20 and 3.30 p.m. the day before Tammy died.
- 1:02:36Speaker 1: They spoke about one of G's students. Tammy was very animated, friendly,
- 1:02:40Speaker 1: and kind. I didn't see any health issues. We talked
- 1:02:43Speaker 1: just like I would on a regular day, G says,
- 1:02:46Speaker 1: describing Tammy's energy level as great. And how many people
- 1:02:50Speaker 1: have to tell us that Tammy wasn't sick? Now, I
- 1:02:52Speaker 1: know that Chad Daybell wants to tell us a different story,
- 1:02:55Speaker 1: but all these people are newer. Say she was never
- 1:02:58Speaker 1: missing work. She wasn't limping around at work. She wasn't sniffling.
- 1:03:02Speaker 1: She didn't have allergies. None of that stuff. At least
- 1:03:05Speaker 1: not at work where it was causing an issue where
- 1:03:08Speaker 1: other people would notice it. So if she's not that sick,
- 1:03:11Speaker 1: where other people are noticing it, you mean to tell
- 1:03:14Speaker 1: me that I'm supposed to buy that she died of
- 1:03:16Speaker 1: natural causes? Sorry, I don't buy it. 1.33pm G received
- 1:03:22Speaker 1: a text message from the principal the next day that
- 1:03:25Speaker 1: Tammy had died. I was shocked. Shocked. I didn't see
- 1:03:28Speaker 1: any indication that she was sick, G says. Beatty has
- 1:03:31Speaker 1: nothing further. Pryor will now cross-examine. 1.34pm Pryor asks if
- 1:03:37Speaker 1: there were preparations for the book fair next week. G
- 1:03:40Speaker 1: doesn't remember. Pryor asks if Tammy kept to herself about
- 1:03:43Speaker 1: her personal life. Not really, I wouldn't say that, G says.
- 1:03:46Speaker 1: Pryor has nothing further. No more questions from the prosecutor.
- 1:03:50Speaker 1: G is excused from her subpoena. 1.35 p.m. Pamela Peebles
- 1:03:54Speaker 1: is the next witness. Rocky Wixom is questioning her. Pam
- 1:03:58Speaker 1: lives in Rigby and works at Central Elementary in Sugar City.
- 1:04:02Speaker 1: She is a Title I teacher. She helps children, not
- 1:04:05Speaker 1: on grade level, in their reading. 1.37 p.m. Pam worked
- 1:04:09Speaker 1: with Tammy for two to three years. She saw Tammy
- 1:04:12Speaker 1: around the school every day because she was running around
- 1:04:15Speaker 1: doing her library and computer stuff with the children. Pam
- 1:04:18Speaker 1: was at recess duty twice a week with Tammy. Tammy
- 1:04:21Speaker 1: would be able to run around with them and interact
- 1:04:24Speaker 1: with them. She knew each child by name, all of
- 1:04:27Speaker 1: them in the school. She loved the children and they
- 1:04:30Speaker 1: loved her very much, Pam says through tears. 1.38 p.m.
- 1:04:34Speaker 1: She was a good friend and as well as a
- 1:04:36Speaker 1: good co-worker, Pam says. Tammy would engage with the children
- 1:04:40Speaker 1: during playtime and make sure that they were okay. She
- 1:04:43Speaker 1: was very involved with the kids. Pam learned about Tammy's
- 1:04:47Speaker 1: passing from another teacher. 1.39 p.m. Pam was with Tammy
- 1:04:52Speaker 1: on Thursday at recess duty, speaking with her and watching
- 1:04:55Speaker 1: her with the kids. I saw nothing wrong with her,
- 1:04:57Speaker 1: so I was shocked. When she learned of Tammy's death,
- 1:05:00Speaker 1: Pam thought Tammy was quite healthy. She had been training
- 1:05:04Speaker 1: for a race, according to Pam, and on the Thursday
- 1:05:06Speaker 1: before her death, they spoke about it. She had told
- 1:05:09Speaker 1: me she felt she was in the best health of
- 1:05:11Speaker 1: her life. She had been eating better and losing some
- 1:05:14Speaker 1: weight and training, and she said very good about her health. 1.41 p.m.
- 1:05:20Speaker 1: Pam says Tammy had lost some weight, and I was
- 1:05:22Speaker 1: a little jealous of that. She looked good and was happy.
- 1:05:25Speaker 1: She felt better and had changed some of her habits.
- 1:05:28Speaker 1: Wixom has nothing further. Pryor will now question the witness. 1.42 p.m.
- 1:05:34Speaker 1: Pryor has no questions. Pam is excused. 1.46 p.m. Court
- 1:05:39Speaker 1: is finished for the day, as there's some maintenance being
- 1:05:42Speaker 1: done in the courtroom tomorrow. 1.47 p.m. Boyce wants to
- 1:05:46Speaker 1: clarify something about exhibits. He raised a concern with counsel
- 1:05:49Speaker 1: about markings when the trial started. Lori Vallow Daybell was
- 1:05:52Speaker 1: mentioned on the markings, and Boyce wanted the name removed
- 1:05:56Speaker 1: so jurors would not speculate about her involvement. Boyce says
- 1:06:00Speaker 1: there doesn't appear to be any cause for speculation with
- 1:06:03Speaker 1: the exhibits, so they can now be admitted without redactions.
- 1:06:07Speaker 1: All right, folks, so there it is, day number 20
- 1:06:09Speaker 1: of the Chad Daybell trial. And I'm guessing most of
- 1:06:12Speaker 1: you who came into this with a clear idea of
- 1:06:16Speaker 1: what went on haven't been knocked off your perch. And
- 1:06:19Speaker 1: if anybody came into this thinking that Daybell might be innocent,
- 1:06:22Speaker 1: I don't know how they could believe that after the
- 1:06:24Speaker 1: evidence that we've heard for the last three weeks. But
- 1:06:27Speaker 1: we're going to continue on continuing on until the jury
- 1:06:31Speaker 1: renders a verdict. All of the information that goes with
- 1:06:34Speaker 1: this episode can be found in the description box.
