Alan Dershowitz Backs Out of Epstein Congressional Interview (7/20/26) · The Vault: The Epstein Files

• 0:00
Speaker 1: What's up, everyone, and welcome to another episode of the
• 0:02
Speaker 1: Epstein Chronicles. So Alan Dershowitz, who has done nothing but
• 0:09
Speaker 1: run his yap about how he would be more than
• 0:11
Speaker 1: happy to go under oath and talk about Jeffrey Epstein,
• 0:15
Speaker 1: has now canceled his appearance before Congress. And this appearance
• 0:19
Speaker 1: was supposed to take place on Monday, this coming Monday.
• 0:24
Speaker 1: But now, of course, Nah, I don't want to do it.
• 0:28
Speaker 1: I want it to be live, I want it to
• 0:30
Speaker 1: be this, I want it to be that. But he's
• 0:32
Speaker 1: just gonna walk away in the middle of a Friday
• 0:34
Speaker 1: news dump. So in this episode, as you can imagine,
• 0:39
Speaker 1: I might have a couple of things to say. There
• 0:43
Speaker 1: are few creatures in American public life more reliably loud
• 0:47
Speaker 1: than Alan Dershowitz. When the microphone is warm, the questions
• 0:50
Speaker 1: are friendly, and there's absolutely no danger that he'll be
• 0:54
Speaker 1: forced to answer anything under oath. For years, this man
• 0:58
Speaker 1: has galloped from television studient, a podcast booth to newspaper
• 1:02
Speaker 1: column yapping endlessly about Jeffrey Epstein, attacking the credibility of survivors,
• 1:07
Speaker 1: sneering at journalists, rewriting the history of the Florida investigation,
• 1:12
Speaker 1: and presenting himself as the one fearless truth teller in
• 1:15
Speaker 1: a world supposedly consumed by lies. Nobody has ever had
• 1:19
Speaker 1: to beg Alan Dershowitz to speak. Getting him to stop
• 1:22
Speaker 1: has traditionally been the challenge. But now Congress has questions.
• 1:28
Speaker 1: Now there could be a transcript, Now there could be
• 1:30
Speaker 1: follow ups, Now there could be documents placed in front
• 1:33
Speaker 1: of him, names read into the record, timelines compared, contradictions identified,
• 1:39
Speaker 1: and answers preserved somewhere other than the consequence free wilderness
• 1:43
Speaker 1: of cable television. And suddenly, the great constitutional warrior has
• 1:48
Speaker 1: discovered the strategic value of shutting the fluck up. This
• 1:52
Speaker 1: is Alan Dershowitz, Ladies and gentlemen, Alan, I kept my
• 1:55
Speaker 1: underwear on. Dershowitz, the only man arrogant enough to transform
• 1:59
Speaker 1: his underpants into an alibi and then repeat that shit
• 2:03
Speaker 1: on national television as though he just delivered the closing
• 2:06
Speaker 1: arguments at Nuremberg. Bro has spent years telling everybody who
• 2:10
Speaker 1: would listen that the accusations surrounding him were false, that
• 2:13
Speaker 1: the reporting was dishonest, that the survivors were unreliable, that
• 2:19
Speaker 1: the entire Epstein scandal has been warped by exaggeration, hysteria,
• 2:24
Speaker 1: and fabrication. He practically begged for the opportunity to clear
• 2:28
Speaker 1: his name before Congress. He said he welcomed it. He
• 2:32
Speaker 1: said he wanted the truth exposed. Cuz was strutting around
• 2:35
Speaker 1: like a rooster who believed the hearing room had been
• 2:37
Speaker 1: built specifically to showcase his magnificence. Then the date approached
• 2:42
Speaker 1: and the rooster turned into a church mouse. What happened, Alan?
• 2:47
Speaker 1: Did the famous appetite for public debate disappear the moment
• 2:50
Speaker 1: debate came with congressional investigators? Did all that enthusiasm evaporate
• 2:55
Speaker 1: when you realize this would not be another television hit
• 2:58
Speaker 1: where you could filibuster the host and interrupt every question,
• 3:01
Speaker 1: shout false accusation, and run out the clock. Did you
• 3:04
Speaker 1: suddenly remember that congressional testimony is not a podcast appearance,
• 3:08
Speaker 1: and the people ask him the questions might possess the
• 3:10
Speaker 1: documents needed to test your answers. Because this is the
• 3:14
Speaker 1: difference between performance and accountability. Dershowitz adores the performance. He
• 3:20
Speaker 1: loves the cameras, the theatrical outrage, the finger wagging, the
• 3:24
Speaker 1: wounded indignation, and the endless invocation of his own legal brilliance.
• 3:30
Speaker 1: What he appears far less enthusiastic about is accountability, especially
• 3:34
Speaker 1: when accountability means sitting down, losing control of the conversation,
• 3:39
Speaker 1: and explaining his role in one of the most morally
• 3:41
Speaker 1: grotesque prosecutorial outcomes in modern American history. YO, let us
• 3:46
Speaker 1: be precise about that role. Alan Dershowitz has never been
• 3:50
Speaker 1: convicted of participating in Jeffrey Epstein's sexual crimes, and he
• 3:54
Speaker 1: fiercely denies allegations that he did. That is not the
• 3:58
Speaker 1: accusation being made here. The accusation is that Dershowitz was
• 4:03
Speaker 1: part of the elite legal machinery that helped Epstein secure
• 4:07
Speaker 1: an extraordinary federal non prosecution agreement in Florida, a deal
• 4:12
Speaker 1: that protected Epstein from federal prosecution, extended immunity to potential
• 4:17
Speaker 1: co conspirators, and was negotiated without informing the victims, whose
• 4:21
Speaker 1: rights were supposedly protected by federal law. Dershowitz was not
• 4:26
Speaker 1: some bewildered passer by who wandered into that process by accident.
• 4:31
Speaker 1: He was a key part of Epstein's defense team, and
• 4:34
Speaker 1: that team helped manufacture a result that ordinary defendants could
• 4:38
Speaker 1: scarcely dream of ever receiving, and that agreement remains a
• 4:43
Speaker 1: monument to institutional cowardice. It was a legal escape tunnel
• 4:47
Speaker 1: dug for a wealthy predator while victims were left outside
• 4:50
Speaker 1: the room. It didn't merely spare Epstein from the full
• 4:53
Speaker 1: force of federal prosecution. It helped preserve the infrastructure surrounding them,
• 4:58
Speaker 1: protected unnamed potent co conspirators, and allowed a serial abuser
• 5:03
Speaker 1: to emerge from the process with his fortune, his properties,
• 5:07
Speaker 1: his contacts, and much of his social standing intact. Dershowitz
• 5:11
Speaker 1: may insist that he was simply performing his professional duty
• 5:15
Speaker 1: as a defense lawyer, but professional duty does not place
• 5:19
Speaker 1: a moral force field around the consequences of your work.
• 5:23
Speaker 1: Lawyers are entitled to defend even the worse defendants. The
• 5:26
Speaker 1: public is equally entitled to examine how that defense was conducted,
• 5:31
Speaker 1: what pressure was applied, what representations were made, and how
• 5:36
Speaker 1: a deal this repulsive was ever permitted to even exist.
• 5:41
Speaker 1: And that's why Congress wanted to speak with him. Not
• 5:44
Speaker 1: because appearing before the committee would automatically establish criminal guilt,
• 5:48
Speaker 1: not because questioning him would erase his legal rights. Congress
• 5:52
Speaker 1: wanted answers because Alan Dershowitz was there. He was inside
• 5:56
Speaker 1: the defense effort. He communicated with the people negotiating the
• 5:59
Speaker 1: use agreement. He knows what Epstein's attorney's demanded, what prosecutors resisted,
• 6:04
Speaker 1: what they eventually surrendered, and how the final agreement all
• 6:08
Speaker 1: came together. He has spent years insisting that everyone else
• 6:12
Speaker 1: has the story wrong. So this was his opportunity to
• 6:15
Speaker 1: explain exactly what happened before a body capable of asking
• 6:18
Speaker 1: questions beyond professor, where can people buy your latest book? Instead,
• 6:23
Speaker 1: his bitch ass canceled. After all the noise, all the swagger,
• 6:27
Speaker 1: all the grand standing and chest beating, Alan Dershowitz finally
• 6:31
Speaker 1: reached the doorway of genuine scrutiny, and he apparently decided
• 6:35
Speaker 1: he had somewhere else to be. Now, look, that doesn't
• 6:38
Speaker 1: prove that he committed Epstein's crimes. It does, however, exposes
• 6:42
Speaker 1: the staggering hypocrisy of a man who demands that the
• 6:46
Speaker 1: world here is side while refusing one of the most
• 6:48
Speaker 1: consequential opportunities to give it. You can't spend years shouting
• 6:52
Speaker 1: that you're desperate to testify and then slither away when
• 6:55
Speaker 1: the chair is pulled out for you. You can't accuse survivor, reporters, attorneys, investigators,
• 7:02
Speaker 1: and people like me of dishonesty, then retreat when those
• 7:06
Speaker 1: claims might be examined in a structured setting. You can't
• 7:09
Speaker 1: market yourself as the patron saint of due process while
• 7:13
Speaker 1: treating congressional oversight like an optional dentist appointment, and spare
• 7:17
Speaker 1: us the inevitable parade of procedural excuses. Dershowitz is one
• 7:21
Speaker 1: of the most experienced attorneys in this country. He understands scheduling,
• 7:26
Speaker 1: He understands representation, He understands privilege. He understands how to
• 7:30
Speaker 1: negotiate conditions for testimony. He understands that witnesses may decline
• 7:35
Speaker 1: to answer particular questions when legitimate legal protections apply. There
• 7:40
Speaker 1: were countless ways to appear while preserving every right available
• 7:44
Speaker 1: to him. Canceling the entire appearance at the last minute
• 7:47
Speaker 1: does not resemble courage, transparency, or eagerness to correct the record.
• 7:52
Speaker 1: It resembles a man who loves the sound of his
• 7:54
Speaker 1: own defense but fears the sound of the next question.
• 7:59
Speaker 1: For years, at sea, survivors have been required to prove
• 8:02
Speaker 1: themselves repeatedly. Their memories have been dissected. Their motives have
• 8:06
Speaker 1: been attacked, Their private lives have been dragged in the
• 8:09
Speaker 1: public view. Their trauma has been converted into evidence, challenged
• 8:14
Speaker 1: by armies of lawyers, and scrutinized by people who extended
• 8:17
Speaker 1: far more generosity to Jeffrey Epstein and his powerful associates
• 8:21
Speaker 1: than they ever extended to the girls he exploited. Alan
• 8:26
Speaker 1: Dershowitz participated in that broader culture of attack. He has
• 8:31
Speaker 1: publicly assailed accusers and reporting he considered false, presenting himself
• 8:35
Speaker 1: as a victim of an enormous campaign of defamation. Yet
• 8:40
Speaker 1: when given the chance to sit before Congress and submit
• 8:43
Speaker 1: his own claims to a sustained examination, the man who
• 8:46
Speaker 1: demanded scrutiny for everyone else apparently decided that scrutiny had
• 8:50
Speaker 1: become terribly inconvenient. YO. That is the cowardice at the
• 8:55
Speaker 1: center of this spectacle. It's easy to bully survivors through
• 8:59
Speaker 1: a camera lens. It's easy to dismiss an entire scandal
• 9:03
Speaker 1: from the safety of a studio. It's easy to turn
• 9:06
Speaker 1: every accusation into a conspiracy and every contradiction into persecution.
• 9:12
Speaker 1: What is difficult is sitting still while somebody else controls
• 9:15
Speaker 1: the questions. What's difficult is being unable to change the subject.
• 9:20
Speaker 1: What's difficult is knowing that every answer may be measured
• 9:24
Speaker 1: against emails, letters, court filings, calendars, testimony, and the recollections
• 9:29
Speaker 1: of people who are actually there. Dershowitz has made a
• 9:33
Speaker 1: career out of insisting that due process requires hearing both sides. Fine,
• 9:38
Speaker 1: Congress offered him the room, the chair, the stenographer, and
• 9:41
Speaker 1: the opportunity. He wasn't being dragged into a basement. He
• 9:45
Speaker 1: was being invited to place his version of events into
• 9:47
Speaker 1: the official record. He had the chance to explain the
• 9:50
Speaker 1: non prosecution agreement, address his conduct, answer the survivor's concerns,
• 9:55
Speaker 1: and defend every public statement he has made about the
• 9:58
Speaker 1: Epstein scandal. Yet, when the moment arrived, Alan Dershowitz did
• 10:03
Speaker 1: what so many powerful men connected to this case have done.
• 10:06
Speaker 1: When the temperature rises, his bitch ass found an exit.
• 10:12
Speaker 1: So the next time Dershowitz appears on television barking about transparency, fairness,
• 10:16
Speaker 1: false accusations, and his burning desire to reveal the truth, YO,
• 10:21
Speaker 1: remember this moment. Remember that when the cameras belonged to him,
• 10:25
Speaker 1: he couldn't stop talking. When the questions belonged to Congress.
• 10:29
Speaker 1: He couldn't get away fast enough. Remember that the man
• 10:33
Speaker 1: who has demanded answers from survivors, journalists, prosecutors, and political
• 10:37
Speaker 1: enemies was presented with a chance to provide his own
• 10:41
Speaker 1: and instead backed out at the last minute. Look. Alan
• 10:44
Speaker 1: Dershowitz may never be found guilty of any of Jeffrey
• 10:47
Speaker 1: Epstein's sexual crimes, but in my judgment, he bears a
• 10:51
Speaker 1: profound moral responsibility for helping construct the legal fortress that
• 10:55
Speaker 1: shield Jeffrey Epstein in Florida. He helped create the machinery
• 10:59
Speaker 1: through which which wealth, influence, and elite lawyering overwhelmed the
• 11:03
Speaker 1: interest of abused girls. He spent the years since attempting
• 11:07
Speaker 1: to lecture the rest of us about truth, justice, and fairness.
• 11:11
Speaker 1: Now Congress has called his bluff. The microphone is ready,
• 11:15
Speaker 1: the record's open, the survivors are watching, and Alan Dershowitz,
• 11:19
Speaker 1: the loudest man in every room he controls, has apparently
• 11:23
Speaker 1: decided that this is the one room where silence serves
• 11:27
Speaker 1: them better. All of the information that goes with this
• 11:31
Speaker 1: episode can be found in the description box
