- 0:01Speaker 1: Hey, it's Ron Burb, and I'm taking on the stories
- 0:03Speaker 1: that actually matter. After Guardians Baseball on 570 WKBN. 1-1 game,
- 0:08Speaker 1: ninth inning.
- 0:09Speaker 2: Ryan Jeffers fouling it upstairs, strike one. 3-4-5 in the
- 0:14Speaker 2: Twins lineup against closer Cade Smith. And Smith made ten
- 0:18Speaker 2: pitches last inning. And now he starts the ninth.
- 0:24Speaker 1: The 0-1.
- 0:25Speaker 2: Swing and a pop foul into the seats behind the plate.
- 0:28Speaker 3: 0-2.
- 0:35Speaker 2: Boy, and Cleveland selling out to win this game. When
- 0:39Speaker 2: you bring your closer into the eighth inning with one out,
- 0:45Speaker 2: you need for it to work out because Chance Cade
- 0:49Speaker 2: Smith won't be available tomorrow night for the opener in St. Pete,
- 0:52Speaker 2: depending on how many pitches he has to make here
- 0:55Speaker 2: in the ninth. He delivers up and in and a
- 0:58Speaker 2: check swing, and he did not go around. Jeffers trying
- 1:02Speaker 2: to get out of the way. It looked like he
- 1:04Speaker 2: may have swung, but not so on the appeal at
- 1:07Speaker 2: first with crew chief David Rackley. Now the one-two pitch.
- 1:15Speaker 2: Swung and grounded by the diving Manzardo at first into right,
- 1:18Speaker 2: a base hit. Manzardo diving towards second, couldn't get it,
- 1:23Speaker 2: and Jeffers aboard with a leadoff single. Second hit off
- 1:27Speaker 2: Kate Smith. That'll bring up Josh Bell, who has struck
- 1:32Speaker 2: out three times today. Four for 15 in the series.
- 1:37Speaker 2: Go ahead, run at first. Nobody out in the Twins' ninth.
- 1:44Speaker 2: The set and delivery. A swing and a miss. Good splitter.
- 1:51Speaker 2: Gavin Williams struck out 11 in seven shutout innings. Twins
- 1:57Speaker 2: tied it in the eighth. Off Gattison-Smith. Split her down.
- 2:02Speaker 2: He almost chased. And the count one and one. Now
- 2:06Speaker 2: Twins trying to take the lead in the ninth. Outfield deep.
- 2:11Speaker 2: Toward right for Josh Bell.
- 2:14Speaker 1: The one-one.
- 2:16Speaker 2: Swung on a double play ball to second. Basana to second.
- 2:19Speaker 4: One.
- 2:20Speaker 5: Rocio throws low. Dugout by Manzardo.
- 2:24Speaker 2: Double play. oh it's that huge bell hits into the
- 2:31Speaker 2: twin killer two down here in the night bases now
- 2:35Speaker 2: empty game still tied at one that'll bring to the
- 2:43Speaker 2: plate cody clemens dangerous man with 18 bombs one for
- 2:47Speaker 2: three for the left-handed hitter he takes down and in
- 2:51Speaker 2: ball one The next pitch. And he sends it into
- 3:06Speaker 2: the seats behind the plate foul. One and one to count.
- 3:20Speaker 2: Smith fires. The pitch fouled at the plate. Boy, he's
- 3:24Speaker 2: had a good split finger. One ball, two strikes. In
- 3:29Speaker 2: the bottom of the ninth for Cleveland, Delauder, Rocio, Bazzana.
- 3:35Speaker 2: And it looks like the Twins will go to their closer,
- 3:38Speaker 2: Yoendris Gomez. Now the pitch, a little bit high. Ball two,
- 3:43Speaker 2: two and two. 1-1 game in the ninth. Twins batting,
- 3:47Speaker 2: two outs, nobody on. Biggest crowd of the series here today, 27,354.
- 3:54Speaker 2: The pitch hit high. Deep to right. Down the line
- 3:58Speaker 2: it is going.
- 3:59Speaker 1: Toward the wall.
- 4:00Speaker 5: Caught in the corner by De Lauder in foul ground.
- 4:07Speaker 2: Oh, a towering drive that had Guardians fans on the
- 4:12Speaker 2: edge of their seat or out of their seat. Clemens
- 4:16Speaker 2: just missed. We are tied at one. Bottom of the
- 4:19Speaker 2: ninth next.

- 5:21Speaker 1: Hon, is your new pinball machine in our budget?
- 5:23Speaker 9: KeyBank will meet you in that our money is now
- 5:26Speaker 9: our money moment.
- 5:27Speaker 3: Actually, our banker Steve recommended we start a joint checking
- 5:31Speaker 3: account for bills and keep our individual accounts for things
- 5:34Speaker 3: like pinball machines.
- 5:36Speaker 1: Did someone say banker Steve?
- 5:37Speaker 10: I was in the neighborhood in case you had any
- 5:39Speaker 10: checking account questions.
- 5:40Speaker 4: Steve, you're always there for us. Now, how quickly can
- 5:43Speaker 4: we open that account?
- 5:44Speaker 11: Stop.
- 5:45Speaker 9: For every financial need, we'll meet you in the moment.
- 5:48Speaker 9: KeyBank opens doors. KeyBank member FDIC.
- 5:51Speaker 2: Hey, Guardians fans, are you thinking of consolidating your debt
- 5:54Speaker 2: with a home equity loan? With the average homeowner having
- 5:56Speaker 2: over $ 200, 000 of home equity, hit it out of the
- 5:59Speaker 2: park with Union Home Mortgage, the official mortgage partner of
- 6:02Speaker 2: the Cleveland Guardians.
- 6:03Speaker 12: Union Home Mortgage Corp is an equal housing opportunity lender.
- 6:05Speaker 12: NMLS number 2229.
- 6:07Speaker 1: Hey, it's Ron Verb. I'm saying what everyone else won't
- 6:10Speaker 1: after Guardians Baseball on 570 WKBN. Well, we saw this.
- 6:19Speaker 2: Right-handed thrower, Yohandres Gomez, last night. He worked the ninth inning,
- 6:24Speaker 2: gave up a run in the Twins' 10-6 victory. Mid-90s
- 6:29Speaker 2: fastball for the right-hander, Yohandres Gomez.
- 6:32Speaker 1: Fastball, sinker, cutter, slider, change.
- 6:36Speaker 2: Gomez, 12 saves for the Twins, 3.55 ERA. 1-1 game,
- 6:42Speaker 2: Chase DeLauder, bottom of the ninth.
- 6:44Speaker 1: The pitch.
- 6:46Speaker 2: And a backdoor breaking ball for a called strike. Well,
- 6:51Speaker 2: Cleveland has had four walk-off wins this year. Three of
- 6:56Speaker 2: them in the month of July. The 0-1 pitch. And
- 7:02Speaker 2: he just missed outside. Challenged by the catcher, Ryan Jeffers.
- 7:08Speaker 2: De Lauder today 0-2 with a walk. Seven hits in
- 7:13Speaker 2: the series. And the challenge... Was a good one by Jeffers.
- 7:17Speaker 2: Call overturned. That's a strike. And now De Lauder down
- 7:21Speaker 2: in the count 0-2. Now the set. Now the pitch.
- 7:33Speaker 2: And De Lauder checks on a pitch low 1-2. Cleveland
- 7:40Speaker 2: has had two walk-off game-winning homers this month. One by
- 7:44Speaker 2: Brian Rocchio against the White Sox. One by Travis Bozzana
- 7:49Speaker 2: against Pittsburgh.
- 7:50Speaker 1: The pitch.
- 7:52Speaker 2: And he got him swinging. Good change-up down. And DeLauder
- 7:57Speaker 2: strikes out. Andrew Morris worked a scoreless inning. And now
- 8:03Speaker 2: Brian Rocchio will face Gomez.
- 8:08Speaker 13: Rocchio.
- 8:09Speaker 2: 0 for 3. Switch hitting shortstop batting. Left handed again
- 8:14Speaker 2: in the cleanup spot.
- 8:15Speaker 1: 1-1 game. We're in the ninth.
- 8:20Speaker 2: Here's the pitch. And a check swing tapper at third.
- 8:26Speaker 2: Charged by Lewis from near the mound. He grabbed it
- 8:29Speaker 2: throughout Rokio. Two down. Can Travis Pisano walk off two
- 8:35Speaker 2: games in this homestamp? If we have extra innings, Colin
- 8:42Speaker 2: Holderman will be pitching the 10th for Cleveland. Patrick Bailey,
- 8:49Speaker 2: a solo homer to right in the fifth Cleveland's run.
- 8:52Speaker 2: Minnesota's run on a pinch hit RBI single in the
- 8:55Speaker 2: eighth by Allen Roden. The pitch to Bozana. And he
- 9:00Speaker 2: fouled it back. Oh, did he want that, baby. He
- 9:03Speaker 2: spun out of the batter's box. And you know he
- 9:08Speaker 2: thought he had a fastball that he could do damage to.
- 9:13Speaker 1: Bazana.
- 9:15Speaker 2: Four for 13 in the series.
- 9:18Speaker 1: The 0-1.
- 9:20Speaker 2: And it's a touch low. One ball, one strike. One run,
- 9:25Speaker 2: four hits Minnesota. One run, three hits Cleveland. Two down,
- 9:33Speaker 2: bases empty in the ninth. The next offering. Cut and missed. Changeup.
- 9:41Speaker 2: That's a hard changeup. That was a 93-mile-an-hour changeup, and
- 9:45Speaker 2: the bottom falls on him. Lasada stepping out, and he'll
- 9:52Speaker 2: climb back in. Now the one-two delivery. Here it comes.
- 10:07Speaker 2: Fouled off left side. Well, Cleveland now will have some regrets, obviously.
- 10:16Speaker 2: You look back at the fourth inning. They had a
- 10:21Speaker 2: runner at third.
- 10:22Speaker 1: With one out.
- 10:22Speaker 2: Didn't score.
- 10:24Speaker 1: How big is that?
- 10:25Speaker 2: 1-1 game. Ninth inning, two down. The 1-2 delivery. And
- 10:31Speaker 2: Bozana takes high. The hard stuff evens the count. That
- 10:36Speaker 2: was 97 miles per hour. Hard to believe Gomez was
- 10:41Speaker 2: weighed three times by three different organizations a year ago.
- 10:48Speaker 2: Now the 2-2. And it's down low, and there's that
- 10:53Speaker 2: hard changeup again. Almost acts like a splitter. So good
- 11:01Speaker 2: a bat for Bozana, three and two the count. Two outs,
- 11:05Speaker 2: nobody on. 1-1 game, ninth inning. Here's the payoff. And
- 11:17Speaker 2: strike three called, Bozana challenges.
- 11:22Speaker 1: Is the inning over?
- 11:24Speaker 2: Or does Bozana get the call overturned and draws a walk?
- 11:29Speaker 2: He got it overturned. So it becomes a two-out walk,
- 11:36Speaker 2: and the winning run heads to first with Reese Hoskins.
- 11:39Speaker 1: Striding to home plate.
- 11:41Speaker 2: And Bozana, a base stealer, with 15 and 18 tries.
- 11:48Speaker 2: Reese Hoskins 0 for 3 today. And two home runs
- 11:53Speaker 2: in the win over Minnesota Monday when Cleveland hit seven
- 11:56Speaker 2: home runs.
- 11:58Speaker 1: That seems like a decade ago.
- 12:01Speaker 2: Now the Twins will gather on the mound with Reese
- 12:04Speaker 2: Hoskins the batter. Travis Buzana the base runner at first.
- 12:09Speaker 2: A 1-1 game here in the ninth. Boy, what incredible
- 12:21Speaker 2: pitching on both sides here today. Conference breaks up. Right-hander
- 12:27Speaker 2: against right-hander. And the outfielders, they're basically a no-doubles defense.
- 12:43Speaker 2: They're not to the warning track, but they're not far
- 12:45Speaker 2: from it and really spread out. They can't afford to
- 12:48Speaker 2: have a ball hit over their head or the game
- 12:49Speaker 2: could be over. The pitch to Hoskins. And it's outside
- 12:57Speaker 2: a slider for ball one. Bozana and Sandy Alomar talk
- 13:03Speaker 2: briefly at first. Sandy Alomar. The best first base coach
- 13:09Speaker 2: in the game. Nobody knows the run game or pitchers
- 13:12Speaker 2: and catchers better than Sandy.
- 13:16Speaker 1: The 1-0.
- 13:17Speaker 2: Inside corner strike. Hoskins backs away. Looks at home plate up.
- 13:23Speaker 2: Charlie Ramos. Charlie says, no, I will not change my mind.
- 13:28Speaker 1: 1-1 the count. Two down. Runner on.
- 13:31Speaker 2: 1-1 game. Bottom of the ninth. Gomez is ready. Here
- 13:35Speaker 2: it comes. And he went with a changeup and it
- 13:41Speaker 2: just missed downstairs.
- 13:43Speaker 1: All two, two and one.
- 13:46Speaker 2: Boy, what a find this guy has been for the Twins.
- 13:53Speaker 2: The 2-1 delivery. Outside, missed with a cutter it looked like.
- 14:02Speaker 2: And now a 3-1 count on the Hoskins. And this
- 14:07Speaker 2: is where Bassano might be able to get a really
- 14:10Speaker 2: good jump if he wants to take off. You know
- 14:13Speaker 2: Gomez is focused on Hoskins. The 3-1 delivery. Down low,
- 14:20Speaker 2: he walked him. So back-to-back, two out walks. And now
- 14:26Speaker 2: the winning run. at second in Travis Buzana. Reese Hoskins
- 14:32Speaker 2: heads to first. Pete Mackey, the pitching coach, to the mound.
- 14:36Speaker 2: And Kyle Manzardo will be the batter. He is 0-3
- 14:40Speaker 2: in this ballgame. Manzardo had an RBI single off Gomez
- 14:49Speaker 2: last night in the ninth inning.
- 14:54Speaker 1: Well, the two walks..
- 14:59Speaker 2: That Cleveland issued in the eighth inning proved to be
- 15:03Speaker 2: costly and the Twins scoring their only run. Will the
- 15:07Speaker 2: two walks here in the ninth inning with two down
- 15:10Speaker 2: by Gomez cost Minnesota? Base hit here, Winton. And again,
- 15:17Speaker 2: the Twins play everybody so deep in the outfield, they
- 15:23Speaker 2: just wouldn't have a chance with two down to throw
- 15:25Speaker 2: the guy out at the plate on.
- 15:27Speaker 1: A base hit. to the outfielder.
- 15:29Speaker 2: At least you wouldn't think so. And Bazana runs well.
- 15:33Speaker 2: The set. The pitch to Manzardo. And he backdoored him
- 15:40Speaker 2: for a called strike on the slider.
- 15:54Speaker 1: Now the 0-1. Down low, changeup, one and one.
- 16:03Speaker 2: But there aren't many guys that throw a 93-mile-an-hour changeup.
- 16:10Speaker 2: The late, great Doug Jones wished his fastball was 93.
- 16:13Speaker 2: What a terrific closer he was for the Indians. Now
- 16:19Speaker 2: the 1-1. Swung on, ripped foul upstairs, third base side.
- 16:28Speaker 2: And a one-two count on Manzardo. Hosanna and second. Hoskins
- 16:34Speaker 2: at first. Two down in the ninth. Game deadlocked at
- 16:38Speaker 2: a run apiece. Gomez is ready. Here it comes. And
- 16:49Speaker 2: Manzardo takes down and in. Now everybody gets a full
- 16:53Speaker 2: sprint on the pitch to the plate.
- 16:57Speaker 1: Beg your pardon to count two and two. I thought
- 16:59Speaker 1: it was three and two. Excuse me. Two and two.
- 17:02Speaker 2: This is also pitch 22 in the inning for Gomez.
- 17:07Speaker 2: Here it comes. And Manzardo cuts and misses. We've got
- 17:14Speaker 2: extra innings tied at one on the Cleveland Clinic Radio Network.
- 17:18Speaker 1: Looking to upgrade your home? And my show is all
- 17:20Speaker 1: about the Valley after Guardians Baseball on 570 WKBN.
- 17:29Speaker 2: We've got ourselves a 1-1 game, and we head to
- 17:33Speaker 2: the 10th inning. Collin Holderman on the pitch. Cade Smith
- 17:40Speaker 2: went an inning and two-thirds of scoreless relief, gave up
- 17:43Speaker 2: two hits, struck out a batter. Cody Clements starts the
- 17:47Speaker 2: 10th as the runner at second base. In extra innings,
- 17:52Speaker 2: Minnesota's only played five extra inning games.
- 17:56Speaker 1: They are 3-2.
- 17:58Speaker 2: Cleveland is 4-3. Holderman, upper 90, sinker and slider. Royce Lewis,
- 18:05Speaker 2: the batter, 0-2 with the walk. The pitch, and he
- 18:09Speaker 2: cuts and misses the strike. Pretty much every manager in
- 18:13Speaker 2: the major leagues will agree, when you're on the road,
- 18:17Speaker 2: you have to play for multiple runs in the 10th inning.
- 18:22Speaker 2: The 0-1 pitch... Outside and low 1-1. You'll hear people
- 18:27Speaker 2: sometimes say, why didn't he buy it? Well, he only
- 18:31Speaker 2: get one run in the top of the inning. Pretty
- 18:33Speaker 2: good chance the home team's going to do that and
- 18:36Speaker 2: maybe more in the bottom of the inning.
- 18:38Speaker 1: The 1-1.
- 18:40Speaker 2: Way outside of slider.
- 18:42Speaker 1: 2-1.
- 18:43Speaker 2: Olderman's 39th appearance. Five wins to save. ERA 191.
- 18:55Speaker 1: The set, the.
- 18:55Speaker 2: Look back, and the pitch. And Royce Lewis pops it up.
- 19:01Speaker 1: Playable.
- 19:02Speaker 2: Near home plate. Foul ground. The catcher, Patrick Bailey, gets it. Oh,
- 19:06Speaker 2: it's not a mighty big out for Holderman. It keeps
- 19:09Speaker 2: Clemens at second.
- 19:11Speaker 1: One down.
- 19:13Speaker 2: And the batter will be Trevor Larnik. So far today,
- 19:17Speaker 2: with men in scoring position, Minnesota's 1-4-7.
- 19:22Speaker 1: Cleveland 0-4-8.
- 19:23Speaker 2: Trevor Larnik, the batter, pinched it, stayed into play left,
- 19:31Speaker 2: struck out back in the eighth when Minnesota tied it
- 19:35Speaker 2: on a pinch hit RBI single by Alan Roden. The
- 19:39Speaker 2: pitch and a slider and a beauty. Cleveland's run came
- 19:43Speaker 2: on a 420-foot homer to right way back in the
- 19:47Speaker 2: fifth inning by catcher Patrick Bailey. 1-1 game. Now the 0-1.
- 19:55Speaker 2: Down and away, a sinker.
- 19:57Speaker 14: 1-1.
- 19:58Speaker 2: Go ahead and run at second. One down in the Twins' tenth. Boy,
- 20:05Speaker 2: what a job Taj Bailey did for Minnesota today. On
- 20:09Speaker 2: this road trip to Wrigley in Cleveland, the Twins have
- 20:12Speaker 2: been giving up seven runs a game. The pitch in
- 20:17Speaker 2: their strike, one and two. And today, Taj Bradley went
- 20:22Speaker 2: seven innings and held Cleveland to one run. Minnesota the
- 20:26Speaker 2: best offensive club in the American League. And Gavin Williams
- 20:30Speaker 2: shot out the Twins on two hits in seven innings
- 20:34Speaker 2: and struck out 11. So Williams and Bradley... Gave us
- 20:42Speaker 2: a clinic here today. Now the one-two delivery. Swing and
- 20:48Speaker 2: a foul at the plate. Breaking ball. We'll do it
- 20:52Speaker 2: again at one and two. Tenth inning, one-one game. Clements
- 20:57Speaker 2: the runner at second with one down. Outfield deep and
- 21:03Speaker 2: toward right. The exception being Larnik's former collegiate teammate, Stephen Kwan.
- 21:11Speaker 2: Not that deep. Straight up and left. Now the 1-2.
- 21:16Speaker 2: Fouled it back. Larnik stays alive on a 98-mile-an-hour sinker.
- 21:27Speaker 2: Only five games on the Major League schedule today. Braves
- 21:32Speaker 2: beat San Diego today 6-5. The next delivery, way high
- 21:41Speaker 2: and outside 2-2. Third inning, Toronto leads Tampa 1-0. Starting
- 21:48Speaker 2: to wonder, will the Blue Jays ever put it together?
- 21:52Speaker 2: Or will the American League champions of a year ago
- 21:56Speaker 2: become a seller before August 3rd? Now the 2-2. Swung on,
- 22:01Speaker 2: grounded in the hole right side. Bazana, a long way
- 22:04Speaker 2: toward first. Glove spins and throws from right field. To
- 22:09Speaker 2: get Larnik at first. Oh, a nice play by Travis
- 22:13Speaker 2: Bazzata ranging far to his left and shallow right toward first.
- 22:19Speaker 2: Did a 360 spin and throw. Larnik out number two.
- 22:23Speaker 2: Cody Clemons now to third. 1-1 game for Luke Kieschel.
- 22:29Speaker 2: 0-2 with a walk. The set. The pitch. Way outside.
- 22:37Speaker 2: A slider from all one. Game deadlocked at a run apiece.
- 22:47Speaker 2: Twins with a runner at third. Two down in the tenth.
- 22:49Speaker 1: The pitch.
- 22:50Speaker 2: Bullseye. And the count of one and one. Collin Holderman's ready.
- 23:04Speaker 2: Here it comes. Swung and drilled up the middle.
- 23:08Speaker 1: Off Holderman.
- 23:09Speaker 5: Cairns to second. Bazana throws him out. Game stays tied
- 23:14Speaker 5: at one. Holderman got knocked off his feet. But he
- 23:19Speaker 5: gets up and walks back to the third base dugout. Oh,
- 23:23Speaker 5: a zap ball blister. It must have missed him and
- 23:27Speaker 5: hit the mound and ricocheted to Bazana at second. We've
- 23:32Speaker 5: got a 1-1 game. We go to the bottom of
- 23:34Speaker 5: the 10th.
- 23:35Speaker 15: 2026 will be a banner year as we celebrate 50
- 23:40Speaker 15: years of the Greater Cleveland Sports Hall of Fame. Our

- 24:12Speaker 1: for the game.
- 24:12Speaker 4: Wow, they must be pretty high up here. I think
- 24:15Speaker 4: my ears just popped.

- 25:20Speaker 12: NMLS number 2229.
- 25:20Speaker 1: It's Ron Ferb, and I've got opinions you'll want to hear.
- 25:24Speaker 1: After Guardians Baseball on 570 WKBN.
- 25:33Speaker 2: Gabriel Arias is going to pinch run for Kyle Manzardo.
- 25:38Speaker 1: As we go to the bottom of the 10th inning.
- 25:40Speaker 2: That means Gabriel Arias will be at second base to
- 25:45Speaker 2: start the bottom of the 10th in what is a
- 25:48Speaker 2: 1-1 ballgame. Patrick Bailey will be the batter. Bailey, Cleveland's
- 25:54Speaker 2: offense today, a solo bomb to right the fifth. Tommy Nance,
- 25:58Speaker 2: who pitched Monday night, gave up a run in one inning.
- 26:02Speaker 2: Makes his second appearance. He's a big right hander. Throws
- 26:05Speaker 2: in the mid 90's. Sinker curve slider. Nance 6'6.
- 26:11Speaker 1: 245. Nance.
- 26:14Speaker 2: Now 35 years of age. Pinching in at the corners.
- 26:21Speaker 2: Licking for the bunt are the twins. Bailey batting left handed.
- 26:26Speaker 2: He squares. And he bunts it back foul. Strike one.
- 26:31Speaker 2: Patrick Bailey.
- 26:32Speaker 14: Bailey.
- 26:32Speaker 2: With two sack punts this season, both with Cleveland. He
- 26:40Speaker 2: looks down to third base coach Ruggio Doerr. Winning runs
- 26:44Speaker 2: at second in Gabriel Arias. Again, he squares the pitch,
- 26:52Speaker 2: and he punts it back foul again.
- 26:54Speaker 4: 0-2.
- 27:00Speaker 2: Now today, Cleveland with men in scoring position. It's been
- 27:05Speaker 2: a season-long issue.
- 27:06Speaker 1: They're 0 for 8. Now Bailey.
- 27:11Speaker 2: He'll be swinging away with two strikes. Outfield now has
- 27:19Speaker 2: shortened up. Medium deep at best. Straight away for Bailey.
- 27:26Speaker 2: Bailey batting left-handed. Nance with the 0-2 pitch. And he
- 27:32Speaker 2: grounds it foul, that hit off his foot. So still
- 27:39Speaker 2: a no-two count. Well this is tailor-made for Cleveland to
- 27:50Speaker 2: walk it off with Minnesota not scoring. In the top
- 27:55Speaker 2: of the inning, Cleveland looking for its fourth walk-off win
- 27:59Speaker 2: in the month of July. Now the 0-2 pitch. And
- 28:07Speaker 2: strike three called back toward him with the curveball. Huge
- 28:12Speaker 2: strikeout for Nance. Keeps the winning run at second. Here's
- 28:16Speaker 2: Petey helping. One down. Helping 0 for 3. Now Petey helping.
- 28:25Speaker 2: And a couple of home runs Monday night. Can he
- 28:32Speaker 2: be a hero on this sunny Thursday afternoon?
- 28:36Speaker 1: The pitch. And he waves at it.
- 28:40Speaker 2: That fastball running away at 96 miles an hour. Nothing
- 28:44Speaker 2: and one to count. Tommy Nance came from Toronto a
- 28:53Speaker 2: couple of weeks ago.
- 28:55Speaker 1: The 0-1.
- 28:58Speaker 2: Fouled it at the plate. And the count on two. Arias,
- 29:05Speaker 2: the pinch runner at second. One down, bottom of the 10th,
- 29:08Speaker 2: 1-1 game. Nance is ready. High hold and pitch. And again,
- 29:20Speaker 2: fouled at the plate, threw him another curveball. Still a
- 29:23Speaker 2: no-two count of Petey helping. Again, the outfield, not real deep,
- 29:39Speaker 2: straight away. away, they want to have a shot at
- 29:42Speaker 2: throwing Arias out at the plate on a base hit.
- 29:53Speaker 2: Now the set and the 0-2. Swung on, ripped foul
- 30:00Speaker 2: outside of first. Petey helping, stays alive and no balls,
- 30:05Speaker 2: two strikes. Winning run at second. One down, tenth inning.
- 30:21Speaker 2: Nance lets it rip. And it's hit back up the middle.
- 30:25Speaker 2: Knocked down at the mound by Nance. He'll throw to first.
- 30:29Speaker 2: That's out number two. Arias to third. Now it'll take
- 30:32Speaker 2: a clutch two-out hit to win it. Stephen Kwan to
- 30:35Speaker 2: the plate. Stephen Kwan. Two for three, two singles, and
- 30:40Speaker 2: a walk. Well, nobody that you'd rather have at the
- 30:46Speaker 2: plate in the month of July than Stephen Kwan. Two
- 30:50Speaker 2: for three today, this month batting 420 when the day started.
- 30:57Speaker 2: Two down the pitch, and he looks breaking ball low.
- 31:02Speaker 2: Jose Ramirez waits on deck, so it's pick your poison
- 31:06Speaker 2: for Tommy Nance. Winning run at third, two down in
- 31:09Speaker 2: the tenth, game tied at one. The set, the 1-0.
- 31:16Speaker 2: And it's in there, a strike. Juan, did he challenge?
- 31:20Speaker 2: He went to the helmet, but that might have been
- 31:22Speaker 2: just a reactionary move, touching the helmet, but not challenging.
- 31:30Speaker 2: Now the set and the 1-1. Way outside. Ball two,
- 31:37Speaker 2: two and one. I know this sounds almost sacrilegious, but
- 31:41Speaker 2: if you're Tommy Nance, are you better off facing Jose Ramirez,
- 31:45Speaker 2: who has been out almost six weeks, rather than the
- 31:50Speaker 2: red-hot Kwon. The 2-1 pitch. Swung and grounded up the middle.
- 31:56Speaker 2: The second baseman, Kiesel, throws to first. We have another
- 32:00Speaker 2: extra inning coming. Game tied at one. Ten in the
- 32:04Speaker 2: books on the Cleveland Clinic Radio Network.
- 32:08Speaker 18: Recently, our company's softball team lost the big game by

- 33:29Speaker 22: Ew.

- 33:32Speaker 9: KeyBank opens doors. Equal housing lender. NMLS number 399797.
- 33:37Speaker 2: Bybee into the motion. And the right-hander with the one-two delivery.
- 33:41Speaker 1: Swing and a miss!
- 33:43Speaker 2: Back foot slider ate him up. What a job by
- 33:47Speaker 2: Tanner Bybee.
- 33:48Speaker 1: This is Tanner Bybee.
- 33:49Speaker 23: You're listening to the Cleveland Clinic Guardians Radio Network.
- 33:52Speaker 1: Hey, it's Ron Furb. I'm not holding back.
- 33:55Speaker 24: Ever.
- 33:56Speaker 1: After Guardians Baseball on 570 WKBN.
- 34:00Speaker 2: Gabriel Arias takes over at first. Colin Holderman, second inning
- 34:04Speaker 2: of relief work. 1-1 in the eleventh. Luke Kieschel, the
- 34:08Speaker 2: runner at second. Allen Roden, the batter. Roden swings and
- 34:12Speaker 2: sends one in the air. Shallow right. DeLauder coming in
- 34:16Speaker 2: to grab it. And that's another big out. And it
- 34:19Speaker 2: keeps that runner at second. Roden, of course, came off
- 34:23Speaker 2: the bench. Got a pinch hit RBI single off Kate
- 34:25Speaker 2: Smith in the eighth inning. That tied the game. And
- 34:28Speaker 2: that's where we're at right now. One to one in
- 34:32Speaker 2: the eleventh.
- 34:32Speaker 15: 62, Eric Cebrowski warming in the Cleveland bullpen.
- 34:36Speaker 2: Here is the top of the order in Brooks Lee,
- 34:39Speaker 2: switch hitter, batting 11th.
- 34:41Speaker 1: 55, Rogers.
- 34:43Speaker 2: Left-handers Eric Cebrowski and Taylor Rogers warming in the Cleveland
- 34:49Speaker 2: and Minnesota bullpens. Lee batting left-handed today, 0 for 4.
- 34:57Speaker 2: Started the game at third, now it's short. One run
- 35:01Speaker 2: four hits Minnesota. One run three hits Cleveland. Ending number 11.
- 35:07Speaker 2: Holderman's pitch. Down low. Ball one. Minnesota the best team
- 35:19Speaker 2: in baseball. Hitting with men in scoring position.
- 35:22Speaker 1: Today they're one for ten. The 1-0. Waved at.
- 35:28Speaker 2: Back foot slider. And they count one and one. Outfield
- 35:36Speaker 2: deep toward right. Boulderman's ready. Checks the runner. The pitch.
- 35:46Speaker 2: And he missed down and away with a sinker.
- 35:49Speaker 1: Two and one.
- 35:51Speaker 2: If you're just joining us, Patrick Bailey hit a 420-foot
- 35:55Speaker 2: homer down the right field line in the fifth. Allen Roden,
- 35:59Speaker 2: a pinch hit RBI single in the eighth. That's our game.
- 36:03Speaker 2: Pitch swing on, bounced up the middle. Rocchio to the
- 36:06Speaker 2: second base, side of second, gloves and throws out. Lee
- 36:10Speaker 2: for the second out. Kieschel advancing to third. Good range
- 36:16Speaker 2: and a lot of it to the other side of
- 36:18Speaker 2: the diamond by shortstop Ryan Rocchio. So two down, runner
- 36:23Speaker 2: at third. Game still tied at one in the 11th.
- 36:26Speaker 2: And Byron Buxton to the plate. One for four, a single.
- 36:31Speaker 2: Buxton will be intentionally walked. Ryan Jeffers will be the batter.
- 36:38Speaker 2: He's one for four. So Jeffers will try to foil
- 36:49Speaker 2: the Cleveland strategy. Buxton at first. Kieschel at third. Two down.
- 36:56Speaker 1: 11th inning. 1-1 game.
- 37:04Speaker 2: Jeffers having a heck of a year for Minnesota. A
- 37:09Speaker 2: 9.50 OPS. The pitch to him. And it's a slider
- 37:15Speaker 2: down and away.
- 37:15Speaker 1: Ball one.
- 37:23Speaker 2: Outfield, straight up, medium deep.
- 37:25Speaker 1: 1-1, 11th inning.
- 37:30Speaker 2: The pitch, swung on, a weak ground ball to short.
- 37:34Speaker 2: Rocio gloves, he'll fire to first, and another great job
- 37:37Speaker 2: by Holderman with a go-ahead run, never crossing home plate.
- 37:42Speaker 2: Another opportunity for Cleveland to walk it off. Tied at
- 37:47Speaker 2: one in the middle of the 11th.
- 37:50Speaker 20: Since day one of your child's life, you've been all

- 39:37Speaker 1: big opinions, after Guardians baseball on 570 WKBN.
- 39:47Speaker 2: Taylor Rodgers working for the second time in the series.
- 39:50Speaker 2: Tuesday night, Cleveland got a runoff of him in an
- 39:53Speaker 2: inning and a third. One time Minnesota Twins closer.
- 39:57Speaker 1: A left-hander.
- 39:59Speaker 2: And he'll take over in the bottom of the 11th
- 40:02Speaker 2: in a 1-1 game. Stephen Kwan will be the runner
- 40:05Speaker 2: and second the winning run. Rodgers, not a hard thrower. Sinker, cutter,
- 40:11Speaker 2: breaking ball. Jose Ramirez will be intentionally walked. So runners
- 40:18Speaker 2: now at first and second for Cleveland.
- 40:22Speaker 1: With nobody out.
- 40:24Speaker 2: Bottom of the 11th, Cleveland with another golden opportunity to
- 40:28Speaker 2: walk it off. Left on left, Chase DeLauder 0 for 3.
- 40:32Speaker 2: But a much better hitter this year against lefty pitching.
- 40:38Speaker 2: Stunning that against left-handers, Chase DeLauder, This year batting.
- 40:45Speaker 1: 366.
- 40:45Speaker 2: That's 115 points higher than when he faces a right hand.
- 40:51Speaker 1: The pitch.
- 40:53Speaker 2: And a breaking ball on the outside corner. Curve ball
- 40:56Speaker 2: for strike one.
- 41:00Speaker 1: De Lauder.
- 41:01Speaker 2: Seven hits in the series. Two on, nobody out. Eleventh
- 41:06Speaker 2: inning tied at one. The next offering. Another breaking ball
- 41:13Speaker 2: down and away, one and one. De Lauder maintains his
- 41:18Speaker 2: success against lefties. He said he really just tries to
- 41:22Speaker 2: make sure he keeps that front shoulder tucked in and
- 41:26Speaker 2: stay up the middle or the other way against lefties.
- 41:29Speaker 2: The pitch, and it just missed low and away, challenged
- 41:33Speaker 2: by the Twins.
- 41:36Speaker 1: We'll see.
- 41:40Speaker 2: And it is a strike. Good challenge by Minnesota. So
- 41:44Speaker 2: the count now one and two on DeLauder.
- 41:57Speaker 1: Rodgers.
- 41:58Speaker 2: He's ready. Here it comes. Down and away. Taylor Rodgers.
- 42:07Speaker 27: Has averaged 60 appearances a year.
- 42:12Speaker 2: In his first 10 years in the big leagues. That's
- 42:18Speaker 2: a lot of games. Now the 2-2. Down and away,
- 42:25Speaker 2: a breaking ball. Rodgers this year, not nearly the success
- 42:29Speaker 2: we've seen in the past.
- 42:32Speaker 1: 560 ERA.
- 42:33Speaker 2: This is appearance number 43. Full count now on DeLauder.
- 42:39Speaker 2: Here's the payoff pitch. And strike three called on the
- 42:44Speaker 2: outside corner. DeLauder challenges the call. That looked like a
- 42:48Speaker 2: pretty good pitch. We'll see.
- 42:54Speaker 1: It was.
- 42:55Speaker 2: Strike three called.
- 42:58Speaker 1: I mean, that's a perfect pitch.
- 43:01Speaker 5: So..
- 43:02Speaker 2: Runners had first and second, one down. Game tied at
- 43:06Speaker 2: one in the 11th. Brian Rocchio, switch hitter, will bat right-handed.
- 43:11Speaker 2: 0 for 4 today. Rocchio has two walk-off game-winning hits
- 43:18Speaker 2: this year. Cleveland has four walk-off wins.
- 43:25Speaker 1: The set.
- 43:30Speaker 2: The look back, the pitch, and a curve down and in.
- 43:33Speaker 1: Ball one.
- 43:34Speaker 2: Kwon dancing off to a mammoth lead at second. Really
- 43:38Speaker 2: distracting Taylor Rodgers.
- 43:50Speaker 1: Now the 1-0.
- 43:51Speaker 2: Swung on, lifted in the air. Medium deep right. Routine
- 43:55Speaker 2: for Roden. He'll grab it for out number two. Now
- 43:59Speaker 2: it's up to Travis Bazzana. Well, Travis Bazzana got his
- 44:04Speaker 2: first major league walk-off game-winning hit on a walk-off game-winning
- 44:10Speaker 2: homer against Pittsburgh over the weekend. He doesn't need to
- 44:14Speaker 2: homer tonight, or I should say this afternoon. They said
- 44:20Speaker 2: here is all Cleveland needs. Two out, two on, 1-1 game,
- 44:25Speaker 2: bottom of the 11th. The set. The pitch. High ball one.
- 44:40Speaker 2: Cleveland now today with men in scoring position 0 for 13.
- 44:46Speaker 2: Now Bozana struggled against lefties batting 184 against Southpaws this year.
- 44:54Speaker 2: The 1-0 and he pops it up foul third base side.
- 44:58Speaker 2: Wind is going to push it into the seats. That
- 45:02Speaker 2: breeze has picked up blowing in from right. One ball,
- 45:07Speaker 2: one strike. Two outs, two on.
- 45:09Speaker 1: 1-1 in the 11th.
- 45:18Speaker 2: Cleveland heads to Florida and St. Petersburg. Minnesota heads home.
- 45:24Speaker 2: Now the 1-1. Outside and low. Ball two, two and one.
- 45:40Speaker 2: Rodgers just trying to be perfect. The left-hander's ready. Delivers.
- 45:47Speaker 2: And it's a touch high, or is it? No, it's
- 45:50Speaker 2: a called strike.
- 45:51Speaker 1: Boy, I mean.
- 45:53Speaker 2: He is absolutely nicking the corners. He hasn't left anything
- 45:59Speaker 2: over the plate. Two and two to count. The lefties
- 46:05Speaker 2: next pitch. And Bozzana hits it back up the middle
- 46:10Speaker 2: to the shortstop Lee. He'll step on the bag at second.
- 46:13Speaker 2: We'll go to the 12th. Tied at one on the
- 46:16Speaker 2: Cleveland Clinic Radio Network.

- 48:05Speaker 1: Hey, it's Ron Verb, and I'll be bringing the heat
- 48:07Speaker 1: every afternoon at 3 on 570 WKBN.
- 48:16Speaker 2: Eric Sabrowski on to pitch for Cleveland. Sabrowski worked an
- 48:24Speaker 2: inning and a third of scoreless relief last night. Fastball, curve, slider.
- 48:30Speaker 2: Twelfth inning, tied at one. The runner at second, Ryan Jeffers.
- 48:35Speaker 2: Josh Bell batting right-handed, digs in. And time called as
- 48:39Speaker 2: Cebrowski was about to deliver the pitch. Eric Cebrowski's 38th appearance.
- 48:47Speaker 2: He's 3-1, 20 holds, a. 338 ERA. 49 strikeouts in
- 48:53Speaker 2: 29 innings. The pitch and a check swing. He chased
- 48:59Speaker 2: one in the dirt, strike one. The teams haven't.
- 49:04Speaker 27: Done much when it comes to swinging the bat against
- 49:07Speaker 27: Eric Sabrowski.
- 49:09Speaker 1: Batting 167.
- 49:13Speaker 2: What a job by Colin Holderman. Two shutout hitless innings
- 49:17Speaker 2: in relief. The pitch. And it's cute foul to the right.
- 49:23Speaker 2: Josh Bell has more funky swings and has more cue shots.
- 49:29Speaker 2: For as big and strong as he is. Sabrowski needs
- 49:34Speaker 2: the strikeout right here and that's been his forte. Down
- 49:41Speaker 2: the 0-2. Hit foul outside of third. So far in
- 49:51Speaker 2: extra innings. Neither Cleveland nor Minnesota has been able to
- 49:59Speaker 2: get that runner from second to third with the first
- 50:04Speaker 2: batter in the inning. And that's been pivotal. That's why
- 50:07Speaker 2: we're still tied at one here in the 12th.
- 50:10Speaker 1: The pitch.
- 50:11Speaker 2: And it's swung on, fouled at the plate. The bat
- 50:15Speaker 2: goes flying out beyond Jose Ramirez at third. Brian Montse
- 50:22Speaker 2: tells us the last time Cleveland played an extra inning
- 50:25Speaker 2: game that got to the 12th inning was two years ago.
- 50:31Speaker 2: August of 2024. And that's with the new rules. with
- 50:37Speaker 2: a ghost runner to start the inning in second, at
- 50:40Speaker 2: least until postseason play. You don't see many games go
- 50:44Speaker 2: much more than one or two extra innings, but this
- 50:48Speaker 2: is our third extra inning today. 1-1 game. Inning number 12.
- 50:57Speaker 2: Nothing in two that count on Josh Bell. Jeffers, a
- 51:02Speaker 2: modest lead at second. Sabrowski lets it fly. Got him
- 51:08Speaker 2: swinging a mammoth strikeout on the curveball. Cleveland pitchers have
- 51:14Speaker 2: now struck out 14. 11 by Gavin Williams. So that
- 51:19Speaker 2: runner has still not been advanced to third by the
- 51:22Speaker 2: first batter for the Twins in three extra innings. Cody
- 51:28Speaker 2: Clemons the batter. One for four with a single. Left
- 51:32Speaker 2: on left. Clemons open stance. The pitch to him. Inside
- 51:39Speaker 2: a ball. Outfield deep toward right. Clemens does have 18
- 51:49Speaker 2: home runs. The pitch. Checked on a pitch in tight 2-0.
- 51:57Speaker 2: Roger Clemens and his wife Debbie, the parents of four boys.
- 52:03Speaker 2: All four boys' first name begins with the letter K.
- 52:10Speaker 2: The 2-0 pitch. I guess it was high.
- 52:16Speaker 1: 3-0.
- 52:27Speaker 2: Sabrowski's ready. Here it comes. Holes high.
- 52:33Speaker 1: 3-1.
- 52:35Speaker 2: I guess when your dad... Struck out 4,672 Major League hitters.
- 52:46Speaker 2: You can accept your first name beginning with the letter K.
- 52:49Speaker 2: The pitch swung out, a bouncing ball to second. Lozano
- 52:52Speaker 2: feels it, throws it, two down. Jeffers to third. 1-1 game,
- 52:58Speaker 2: two down in the Twins' 12th inning. And Royce Lewis,
- 53:02Speaker 2: the batter, 0-3 with a walk. Does Cleveland put him
- 53:06Speaker 2: on to face a left-on-left matchup? On deck is Trevor Larnik.
- 53:16Speaker 2: Matt Festa and Sean Armstrong are warming in the Cleveland pen.
- 53:21Speaker 2: Out to the mound is catcher Patrick Bailey. Game tied
- 53:25Speaker 2: at one here in the 12th. Runner at third, two down.
- 53:32Speaker 2: When you look at the numbers Roger Clements put up
- 53:34Speaker 2: in his career.
- 53:35Speaker 27: 354 wins, 184 losses, career ERA of 312, almost 4,700 strikeouts.
- 53:48Speaker 2: Obviously, we know why he's not in the Hall of Fame,
- 53:53Speaker 2: as Lewis will be intentionally walked. But we're never going
- 53:59Speaker 2: to see a pitcher in the history of the game
- 54:01Speaker 2: ever remotely come close to those numbers.
- 54:05Speaker 27: Durability and starters just don't get that opportunity anymore. And
- 54:10Speaker 27: as hard as he threw, you still feel like he
- 54:13Speaker 27: kind of got it when he needed it at times
- 54:15Speaker 27: and also put it on cruise control to get deep
- 54:18Speaker 27: in the game.
- 54:18Speaker 2: Left on left, Trevor Larnik is the batter. Runners at
- 54:21Speaker 2: the corners, two down in the 12th, tied at one.
- 54:25Speaker 2: And a pitch outside challenged by Kenzer Patrick Bailey. Challenge accepted.
- 54:38Speaker 2: Call over turn. Nothing and one to count on Larnik.
- 54:45Speaker 2: Twins at the corners. Two down in the 12th. A
- 54:47Speaker 2: 1-1 game. Larnik 0 for 2 since coming on. Zebrowski's ready.
- 54:56Speaker 2: Here it comes. Swung on line to left. He hung
- 55:00Speaker 2: a breaking ball and Larnik bangs an RBI single the
- 55:04Speaker 2: other way. Twins take the lead as Jeffers scores. 2-1 Minnesota.
- 55:12Speaker 2: And runners at first and second with two down now.
- 55:21Speaker 2: And now the Twins trying to get that much needed
- 55:25Speaker 2: insurance run. Luke Kieschel the batter. 0 for 3. Right-handed batter.
- 55:33Speaker 2: The pitch. And it's in there, a called strike. 2-1 Minnesota.
- 55:43Speaker 2: We're in the 12th inning. 2 out, 2 on. In
- 55:46Speaker 2: the bottom of the 12th for Cleveland, Hoskins, Arias, Bailey.
- 55:51Speaker 2: The pitch in tight. 1-1 the count. Sabrowski checks second.
- 56:08Speaker 2: He fires. And it's swung on. Banged in the hole.
- 56:11Speaker 2: Base hit into left. Around third is Lewis. There's the
- 56:14Speaker 2: critical insurance run scoring. Ball is thrown to the plate.
- 56:18Speaker 2: Wide of the mark. Knocked down by Bailey. But going
- 56:22Speaker 2: to third on the throwing here is Trevor Larnik. So
- 56:28Speaker 2: Lewis scores from second. Larnik goes to third. And Kiesel
- 56:36Speaker 2: with an RBI single. And pitching coach Carl Willis to
- 56:41Speaker 2: the mound. And it's a huge insurance run on back-to-back
- 56:46Speaker 2: RBI singles. Here by Minnesota in the 12th inning. We've
- 56:55Speaker 2: gotten to the point of redundancy in this four-game series
- 56:58Speaker 2: talking about Minnesota.
- 57:01Speaker 1: Having an incredible.
- 57:02Speaker 2: 287 batting average with men in scoring position this year.
- 57:07Speaker 2: Far and away the best in baseball. And the Twins
- 57:12Speaker 2: were one for 14 today with men in scoring position
- 57:17Speaker 2: until the back-to-back two-out RBI singles by Trevor Larnik and
- 57:22Speaker 2: Luke Kieschel. And now Twins at the corners for Allen Roden.
- 57:29Speaker 2: Roden tied this game with a pinch hit RBI single
- 57:32Speaker 2: in the eighth. He takes downstairs. Ball one. So Minnesota
- 57:42Speaker 2: on top three to one here in the twelfth. The set.
- 57:47Speaker 2: The pitch.
- 57:49Speaker 1: And it's hit.
- 57:50Speaker 2: High in the air. Shallow left center. Left fielder Stephen
- 57:54Speaker 2: Kwan puts it away. Minnesota 3, Cleveland 1. Middle of
- 57:59Speaker 2: the 12th on the Cleveland Clinic Radio Network.

- 59:49Speaker 1: Hey, it's Ron Burb, and I'm taking on the stories
- 59:51Speaker 1: that actually matter. After Guardians Baseball on 570 WKBN. Jack
- 1:00:00Speaker 1: Anderson's on to pitch for Minnesota. This is a guy
- 1:00:04Speaker 1: they just claimed off of waivers from Boston two weeks ago.
- 1:00:10Speaker 1: Anderson worked an inning and a third of scoreless relief
- 1:00:14Speaker 1: in the ballgame Tuesday night. Anderson, fastball curve, slider split.
- 1:00:20Speaker 1: 3-1 Minnesota, bottom of the 12th. Travis Bozzano, the runner
- 1:00:24Speaker 1: at second. Reese Hoskins, the batter, 0-3 with a walk.
- 1:00:28Speaker 1: The pitch..
- 1:00:30Speaker 2: Up and in, ball one on a breaking ball. Anderson
- 1:00:33Speaker 2: and Parker Messick, college teammates at Florida State back in
- 1:00:38Speaker 2: the day. Three to one, Minnesota. We're in the 12th.
- 1:00:46Speaker 1: The pitch.
- 1:00:48Speaker 2: A swing and a miss.
- 1:00:50Speaker 13: One and one.
- 1:00:51Speaker 2: Anderson between Boston and Minnesota. He's only worked in four games.
- 1:00:59Speaker 2: Giving up three runs and nine in the third innings.
- 1:01:02Speaker 1: He delivers.
- 1:01:04Speaker 2: And Hoskins swings.
- 1:01:07Speaker 1: Over the top.
- 1:01:10Speaker 2: And they count one ball, two strikes. The next offering.
- 1:01:26Speaker 2: Checked on a high heater.
- 1:01:27Speaker 1: Did he go?
- 1:01:27Speaker 9: No.
- 1:01:29Speaker 2: Throwing 94 miles per hour. And at least here to Hoskins,
- 1:01:35Speaker 2: he's thrown a couple of really good split fingers. Down
- 1:01:43Speaker 2: to 2-2. There's another splitter in the dirt. Full count. Well,
- 1:01:50Speaker 2: if Cleveland doesn't win this game, obviously... When you're the
- 1:01:57Speaker 2: home team and the visitor doesn't score in the 10th
- 1:01:59Speaker 2: and 11th, those are games you have to win. Minnesota
- 1:02:04Speaker 2: got a third chance. They got two here in the 12th.
- 1:02:07Speaker 2: The payoff got them swinging.
- 1:02:10Speaker 1: One down.
- 1:02:11Speaker 2: That'll bring to the plate Gabriel Arias.
- 1:02:15Speaker 1: His first at-bat.
- 1:02:18Speaker 2: Cleveland now in this game 0 for 15 with minutes
- 1:02:23Speaker 2: scoring position. Right-hander against right-hander. The pitch to Arias. And
- 1:02:38Speaker 2: he cuts and misses at the breaking ball.
- 1:02:41Speaker 27: A lot of nights the Twins have been searching for
- 1:02:44Speaker 27: good work out of that bullpen, but they've gotten it
- 1:02:46Speaker 27: here today from the eighth inning on.
- 1:02:50Speaker 2: Now the one-strike pitch. Swing and a ground ball back
- 1:02:56Speaker 2: up the middle. Kiesel at second. Gloves it. Throws out Arias.
- 1:03:00Speaker 2: Hosanna to third, but now two down. Patrick Bailey's been
- 1:03:04Speaker 2: Cleveland's only offense today. A 420-foot homer to right field
- 1:03:11Speaker 2: back in the fifth inning. Cleveland's had three hits. So
- 1:03:24Speaker 2: the Twins are out away from getting a split in
- 1:03:27Speaker 2: the four-game series. That pitch down low. And that's a
- 1:03:31Speaker 2: split for Minnesota if they win, despite Cleveland winning the
- 1:03:36Speaker 2: first two games Monday and Tuesday. Anderson's ready. The 1-0
- 1:03:45Speaker 2: pitch to Bailey.
- 1:03:51Speaker 1: Waved at.
- 1:03:52Speaker 2: And the count of one and one. Anderson fires, and
- 1:04:12Speaker 2: he hit Bailey in the foot. Bailey says it hit me.
- 1:04:16Speaker 2: Cleveland's going to check. It was not ruled a hit
- 1:04:22Speaker 2: by pitch. Bailey said he was clipped by it. Cleveland
- 1:04:25Speaker 2: wants to challenge the golf. Might as well. You're in
- 1:04:32Speaker 2: the 12th inning. You're down to your last out. You're
- 1:04:34Speaker 2: down two runs. Toronto leads Tampa Bay 2-1. They're in
- 1:04:40Speaker 2: the 5th inning. Atlanta beats San Diego today 6-5. Braves
- 1:04:47Speaker 2: a 4.5 game lead in the NL East over Philly.
- 1:04:52Speaker 2: Two games tonight, including Kansas City at Detroit. Just a
- 1:04:57Speaker 2: five-game slate. Normally we have 15 games in the major leagues,
- 1:05:02Speaker 2: but only five today and tonight. 12th inning, Minnesota up 3-1,
- 1:05:08Speaker 2: two down, runner at third. And we'll see what New
- 1:05:11Speaker 2: York says on this challenge of whether or not Bailey
- 1:05:15Speaker 2: was hit by the pitch. On deck, Petey Halpin. Well,
- 1:05:30Speaker 2: with such a light schedule, they've had to go to
- 1:05:32Speaker 2: a local deli in New York to find the replay crew.
- 1:05:37Speaker 1: This guy's something to add a day off. I don't
- 1:05:39Speaker 1: blame him.
- 1:05:41Speaker 2: Won't get a better deli than the delis in Manhattan.
- 1:05:51Speaker 1: Still a 3-1 ballgame.
- 1:05:56Speaker 2: I think we're getting the call from New York right now.
- 1:05:59Speaker 1: Patrick Bailey climbs back in there with a 2-1 count.
- 1:06:02Speaker 4: Runner at third.
- 1:06:02Speaker 14: Two down.
- 1:06:05Speaker 1: In the 12th. 3-1.
- 1:06:08Speaker 7: Twins on top.
- 1:06:34Speaker 2: Jack Anderson.
- 1:06:38Speaker 1: He's ready.
- 1:06:39Speaker 2: The right-hander lets it fly. And Patrick Bailey takes just
- 1:06:45Speaker 2: a bit outside.
- 1:06:46Speaker 14: 3-1.
- 1:07:00Speaker 2: Anderson's ready. Here it comes. Ball four outside. Winning run
- 1:07:07Speaker 2: comes to the plate. Impedi helping. And now helping will
- 1:07:14Speaker 2: be called back. Daniel Schneeman's going to pinch in. Helping
- 1:07:21Speaker 2: 0 for 4 today. Daniel Schneeman. 3-4-10 is a pinch hitter.
- 1:07:28Speaker 1: Out to the mound.
- 1:07:31Speaker 27: Is the pitching coach Pete Mackey.
- 1:07:38Speaker 2: It's a 3-1 ball game. Minnesota leads 12th inning. Guardians
- 1:07:43Speaker 2: at the corners.
- 1:07:45Speaker 1: Two down.
- 1:08:09Speaker 2: Outfield spread out fairly deep for Schneeman. Again, a significant
- 1:08:14Speaker 2: breeze blowing in today. I mean, it's absolutely gorgeous. Now
- 1:08:19Speaker 2: 76 degrees, but it doesn't help a hitter trying to
- 1:08:23Speaker 2: hit one out of here to right and right center.
- 1:08:26Speaker 2: The pitch to Schneeman, and it's in there, a called
- 1:08:30Speaker 2: strike on a slider. Anderson from the set. He lets
- 1:08:43Speaker 2: it fly. And Schneeman takes down low. And they count
- 1:08:49Speaker 2: one and one. Two out, two on. Cleveland down two
- 1:08:59Speaker 2: in the 12. Anderson's ready. Here it comes. A swing
- 1:09:07Speaker 2: and a foul tip. Oh, he was out in front
- 1:09:08Speaker 2: of a splitter. And Cleveland's down to its last strike,
- 1:09:13Speaker 2: a one-two count. Anderson's ready. Here it comes. Down low,
- 1:09:28Speaker 2: a splitter. Two balls, two strikes. Two out, two on.
- 1:09:33Speaker 2: Two-run Minnesota lead, 12th inning. Anderson's ready. He lets it fly.
- 1:09:46Speaker 2: And Daniel Schneemann. swings and pops it up shallow left
- 1:09:52Speaker 2: charging in his larnik he's under it and minnesota with
- 1:09:56Speaker 2: a three to one win in 12 innings.

- 1:11:31Speaker 2: Swung on line toward the gap and left center. Kwon
- 1:11:33Speaker 2: dives and made the catch!
- 1:11:36Speaker 1: What a play by Kwon!
- 1:11:39Speaker 5: Stephen Kwon just keeps on delivering.
- 1:11:42Speaker 1: This is Stephen Kwon. You're listening to the Cleveland Clinic
- 1:11:44Speaker 1: Guardians Radio Network. Hey, it's Ron Verb. I'm saying what
- 1:11:48Speaker 1: everyone else won't after Guardians Baseball on 570 WKBN.
- 1:11:56Speaker 2: Well, it's going to be tough to win a ball game.
- 1:11:59Speaker 2: When you go 0-4-17 with men in scoring position, and
- 1:12:04Speaker 2: that was the case here today, it cost Cleveland big time.
- 1:12:09Speaker 2: And some incredible pitching is not taken advantage of, but
- 1:12:14Speaker 2: also give Minnesota credit. They got it done when they
- 1:12:16Speaker 2: had to, and they, too, pitched extremely well. And, boy,
- 1:12:21Speaker 2: after Cleveland jumped on the Twins for seven home runs
- 1:12:25Speaker 2: on Monday night, won the first two games of this season,
- 1:12:29Speaker 2: This ends up being a very deflating final two games,
- 1:12:32Speaker 2: and Minnesota walks out of here with a 3-1 win
- 1:12:36Speaker 2: in 12 innings today. Cleveland goes 0-4, 17 with men
- 1:12:41Speaker 2: in scoring position. Twins weren't a whole lot better, but
- 1:12:45Speaker 2: they got two two-out RBI hits in the top of
- 1:12:49Speaker 2: the 12th. That proved to be the difference in this game. Minnesota,
- 1:12:53Speaker 2: three runs, six hits, no errors, nine left. Cleveland in
- 1:12:57Speaker 2: 12 innings had one run on three hits at an
- 1:13:01Speaker 2: error and stranded 11. Taylor Rodgers, the win to go
- 1:13:04Speaker 2: to 5-3. First save for Jack Anderson. Eric Cebrowski, the loser, 3-2.
- 1:13:10Speaker 2: Time of the game, three hours, 23 minutes. The attendance, 27,354.
- 1:13:13Speaker 2: Cleveland now 54-50 as they head to Tampa, St.

- 1:17:19Speaker 27: Tampa Bay's on the road wrapping up their road swing

- 1:17:26Speaker 27: in the bottom half of the sixth inning. at the

- 1:17:33Speaker 27: and the Tigers are playing host to Kansas City this
- 1:17:36Speaker 27: evening as well. Right here, it took 12 innings, and
- 1:17:40Speaker 27: the Twins win it by a score of 3-1.
- 1:17:43Speaker 1: Stay with us.
- 1:17:43Speaker 27: We'll have more to come after this.

- 1:18:40Speaker 1: Absolutely. Rheem, the new degree of comforts. And Bob Dieter,
- 1:18:44Speaker 1: Dieter Heating and Cooling. Don't let a small roofing problem..
- 1:18:47Speaker 27: Rap up following a 3-1 Twins win in 12 innings.
- 1:18:52Speaker 27: Tremendous pitching really throughout the day today, but both starters
- 1:18:56Speaker 27: were absolutely terrific. Gavin Williams for the Guardians, seven innings,
- 1:19:00Speaker 27: another 11-strikeout performance, his third in a row with no
- 1:19:04Speaker 27: walks this time around, and only two hits allowed. And
- 1:19:07Speaker 27: Taj Bradley... with seven strong innings as well, and the
- 1:19:11Speaker 27: game was scoreless into the bottom half of the fifth inning.
- 1:19:14Speaker 27: That's when Patrick Bailey provided the power for Cleveland. Here's
- 1:19:18Speaker 27: the 2-0 pitch. Swung on, and that's lifted high, deep
- 1:19:23Speaker 27: to right field. Home run, Bailey. Way on out of here.
- 1:19:31Speaker 2: And the offensive resurgence for Patrick Bailey continues as he
- 1:19:36Speaker 2: puts the Guardians.
- 1:19:39Speaker 5: In front.
- 1:19:42Speaker 1: 1-0.
- 1:19:42Speaker 2: 420 feet on the distance of that home run for
- 1:19:46Speaker 2: Patrick Bailey. And on a day where runs are going
- 1:19:49Speaker 2: to be hard to come by, Bailey puts Cleveland on top.
- 1:19:55Speaker 2: And that one-run lead held up into the eighth inning.
- 1:19:58Speaker 2: That's when the Twins..
- 1:20:00Speaker 27: Off of Guardians closer Cade Smith, who had come on
- 1:20:02Speaker 27: with a couple of men on base, put there by
- 1:20:04Speaker 27: Hunter Gattis via the walk. He allowed an RBI single
- 1:20:09Speaker 27: to pinch hitter Alan Roden, and that tied the game
- 1:20:12Speaker 27: at one, and it stayed that way until the 12th inning.
- 1:20:15Speaker 27: That's when Minnesota came through against Guardians reliever Eric Cebrowski
- 1:20:20Speaker 27: on back-to-back RBI singles, the first by Trevor Larnik to
- 1:20:24Speaker 27: put Minnesota in front, and then Luke Kieschel with an
- 1:20:27Speaker 27: RBI base hit, providing... The insurance run, and that was
- 1:20:31Speaker 27: your final 3-1. The Twins a winner today. Three runs
- 1:20:35Speaker 27: on six hits, no errors for Minnesota. Nine men left
- 1:20:39Speaker 27: on base for the Guardians. One run on just three hits,
- 1:20:42Speaker 27: one error, and 11 men left stranded. The winning pitcher,
- 1:20:48Speaker 27: in relief, Taylor Rodgers, now 5-3. And the save, his
- 1:20:54Speaker 27: first in the major leagues, went to Jack Anderson. And
- 1:20:57Speaker 27: on the short side for the Guardians, Eric Zebrowski takes
- 1:20:59Speaker 27: the loss, falling to 3-2. Time of the game, 3
- 1:21:03Speaker 27: hours and 23 minutes. Paid crowd here at Progressive Field, 27,354.
- 1:21:07Speaker 27: That is your Honda Drive at Home game summary.
- 1:21:13Speaker 1: Stay with us.

- 1:23:18Speaker 27: Welcome back to Guardians Wrap-Up. Guardians come up short in
- 1:23:21Speaker 27: 12 today, 3-1. Let's head downstairs and hear from manager
- 1:23:25Speaker 27: Stephen Vogt.
- 1:23:26Speaker 10: You guys are over 17. Runners in scoring positions, just
- 1:23:31Speaker 10: how do you explain that?
- 1:23:32Speaker 4: I mean, good pitching.
- 1:23:34Speaker 25: Obviously, extra innings was really tough for us. We had
- 1:23:39Speaker 25: two opportunities to get the winning run to third base
- 1:23:43Speaker 25: with nobody out and just weren't.
- 1:23:45Speaker 1: Able to do it.
- 1:23:46Speaker 25: Paddy's a very good runner. Got a couple tough pitches
- 1:23:49Speaker 25: to bunt, and then, you know, Chase took a close
- 1:23:52Speaker 25: 3-2 pitch there. But, you know, it was a frustrating
- 1:23:56Speaker 25: day offensively. Taj Bradley was outstanding. Their pitching was just
- 1:23:59Speaker 25: like ours was. I mean, this was a well-pitched game
- 1:24:01Speaker 25: on both sides, and Gavin was unbelievable. That was about
- 1:24:06Speaker 25: as good as we've seen from him. Wish he had
- 1:24:08Speaker 25: 20 more pitches at the time, but, you know, that's
- 1:24:13Speaker 25: the way it goes.
- 1:24:14Speaker 21: What do you say about Alderman, just the job that
- 1:24:18Speaker 21: he did.
- 1:24:21Speaker 25: When you can put up a scoreless inning and extra innings,
- 1:24:23Speaker 25: you're doing something. And Holdy did it twice. And Cade
- 1:24:26Speaker 25: was equally as outstanding coming in. So, again, our bullpen
- 1:24:30Speaker 25: has been phenomenal all year. They're throwing the ball really well.
- 1:24:34Speaker 25: We just weren't able to get that big hit, and
- 1:24:35Speaker 25: we had a lot of opportunities.
- 1:24:36Speaker 1: To do it.
- 1:24:39Speaker 4: We knew he had really good stuff.
- 1:24:44Speaker 25: You know, I remember him in the Pittsburgh bullpen, really
- 1:24:46Speaker 25: good stuff. When we signed him, we were all really
- 1:24:49Speaker 25: excited to get him with our pitching group and get
- 1:24:51Speaker 25: a no-call. And he's a tireless worker and wants to
- 1:24:54Speaker 25: be great. And really, he's just been a blessing for us.
- 1:24:58Speaker 1: Did you know Williams threw an immaculate inning like immediately?
- 1:25:01Speaker 4: Were you aware of that?
- 1:25:01Speaker 11: Oh, yeah.
- 1:25:02Speaker 22: Oh, yeah.
- 1:25:03Speaker 25: Yeah, it was a pretty special moment.
- 1:25:05Speaker 4: You know, it doesn't happen often.
- 1:25:09Speaker 25: Very rarely do you get close. So as the tension's mounting,
- 1:25:13Speaker 25: you get strike seven, strike eight, and then strike nine
- 1:25:16Speaker 25: was pretty cool.
- 1:25:17Speaker 1: Catch one in your play group? I don't think so, no.
- 1:25:21Speaker 4: I know Arias is.
- 1:25:25Speaker 27: Like, when did he become an option at first base
- 1:25:27Speaker 27: again for you guys?
- 1:25:28Speaker 1: When did that come?
- 1:25:29Speaker 4: A couple weeks ago, we had him start taking ground balls.
- 1:25:31Speaker 25: We just kind of foresaw, you know, if the games
- 1:25:33Speaker 25: where Manzo and Hoskins are both in the lineup, you know,
- 1:25:37Speaker 25: one's DH-ing, one's playing first. We wanted to have David
- 1:25:41Speaker 25: and another utility option, and so he's been taking ground
- 1:25:45Speaker 25: balls over there for a couple weeks now.
- 1:25:48Speaker 27: With the loss today, the Guardians fall to 54-50 on
- 1:25:52Speaker 27: the season. They'll be a game and a half back
- 1:25:54Speaker 27: of the front-running White Sox now in the AL Central,
- 1:25:57Speaker 27: while the Twins improve to 51-53, four and a half
- 1:26:01Speaker 27: back of the front-running White Sox. Guardians hit the road now.
- 1:26:05Speaker 27: They take on the Tampa Bay Rays in St. Pete
- 1:26:07Speaker 27: tomorrow night. 7-10 first pitch. We'll have it for you
- 1:26:11Speaker 27: starting with the warm-up show. at 635. Until then, for
- 1:26:14Speaker 27: Brian Motze at Command Center and, of course, Tom Hamilton,
- 1:26:18Speaker 27: this is Jim Rosenhouse reminding you the final score in
- 1:26:22Speaker 27: 12 at Progressive Field in downtown Cleveland, the Minnesota Twins 3,
- 1:26:26Speaker 27: the Cleveland Guardians 1.
- 1:26:29Speaker 1: Have a good night, everyone.
- 1:26:30Speaker 35: Don't let us down. News, weather, and talk station. 570 WKBN.
- 1:26:36Speaker 1: And back to it. News Radio 570 WKBN. And Ron
- 1:26:39Speaker 1: Furb with you until 7 o'clock tonight. We've got the
- 1:26:42Speaker 1: legal show at 5, John Arnold at 6, and you're
- 1:26:44Speaker 1: on the air. Hello.
- 1:26:45Speaker 36: Yeah, I thought I could squeak in. It's all about timing, Ron. Yeah,
- 1:26:51Speaker 36: these extra innings just drive you nuts.
- 1:26:53Speaker 1: What a game, though. I mean, what a game. What
- 1:26:56Speaker 1: a great game, but a loss? I mean, jeez. I mean,
- 1:27:00Speaker 1: it was painful.
- 1:27:01Speaker 5: Well, it's just a battle.
- 1:27:04Speaker 36: The Indians haven't won the Revolution yet, but we are.
- 1:27:09Speaker 36: Those Minnesota Vicanist liberals up there, they won one battle,
- 1:27:15Speaker 36: but Us Cleveland Indians are going for their revolution.
- 1:27:23Speaker 1: It was interesting. It was an exciting game. Let's just
- 1:27:25Speaker 1: put it that way.
- 1:27:26Speaker 36: Hey, how about the IRGC and what they want to control?
- 1:27:31Speaker 1: They want to.
- 1:27:32Speaker 36: Control energy, oil, heat, production, and power.
- 1:27:38Speaker 27: They want to be the top dog.
- 1:27:40Speaker 36: That's what they want to be. They don't care about
- 1:27:42Speaker 36: the people. They're a mafia. They're a mafia.
- 1:27:45Speaker 1: I got the legal show coming on at 5. It's
- 1:27:47Speaker 1: something I'll get into tomorrow because the Dow is down
- 1:27:50Speaker 1: big time, 500 points today, and Brett Crude surges above $ 100.
- 1:27:55Speaker 1: So this mess that Trump created is creating a huge
- 1:27:59Speaker 1: mess when it comes to energy, oil. And ultimately, inflation.
- 1:28:04Speaker 1: We shall see. Thank you, my friends.
- 1:28:05Speaker 36: I'm collecting pennies.
- 1:28:07Speaker 1: All right. Thank you. Appreciate it. Let me see if
- 1:28:09Speaker 1: I can squeeze this in. You're on here.
- 1:28:13Speaker 24: Hello.
- 1:28:15Speaker 1: Apparently not. I tell you what. Callers, you're going to
- 1:28:19Speaker 1: have to call back unless you have a legal question,
- 1:28:22Speaker 1: because we're going to pause for the legal show, courtesy
- 1:28:23Speaker 1: of Beatrice Kopp. That'll be coming up next after the
- 1:28:26Speaker 1: break at five on NewsRadio 570. So stand by for that.
- 1:28:31Speaker 1: The legal show, courtesy of Beatrice Kopp on News Radio
- 1:28:35Speaker 1: 570 WKBN. Let me see here. This should be doing this,
- 1:28:40Speaker 1: I think. Let me make sure here for just a
- 1:28:42Speaker 1: second here. I think this should be happening. All right.
- 1:28:45Speaker 1: We got all that coming up next on News Radio
- 1:28:48Speaker 1: 570 WKBN. So stay tuned. Then John Arnold of Money
- 1:28:52Speaker 1: Talks after that.
- 1:28:52Speaker 4: If you're talking to me.
- 1:29:00Speaker 37: We all want our kids to grow up safe and healthy,
- 1:29:03Speaker 37: so we show them how. And we tell them with
- 1:29:06Speaker 37: honest conversations that let them know what we expect. Not
- 1:29:10Speaker 37: just one time, but every chance we get. That's especially
- 1:29:14Speaker 37: important when it comes to alcohol and other drugs. Kids
- 1:29:17Speaker 37: not only need to know the dangers and how to
- 1:29:19Speaker 37: avoid them, they need to hear it often from you.
- 1:29:23Speaker 37: And when it comes to pain medications, opioids, they need
- 1:29:27Speaker 37: to know that they should never be taken without a
- 1:29:29Speaker 37: prescription and never shared with friends or family. It's dangerous
- 1:29:33Speaker 37: and illegal. So talk with your kids and guide them
- 1:29:36Speaker 37: through the challenges of growing up safe and healthy. Because
- 1:29:40Speaker 37: when you talk, they hear you. For more information about
- 1:29:43Speaker 37: talking with your kids about underage use of alcohol and
- 1:29:46Speaker 37: other drugs, visit underagedrinking.samhsa.gov.

- 1:30:28Speaker 38: Barrel of Brent crude now tops $ 100. In Minnesota, Vance
- 1:30:31Speaker 38: Belter was sentenced to two life terms plus 40 years
- 1:30:35Speaker 38: in prison for killing Democratic state lawmaker Melissa Hortman and
- 1:30:38Speaker 38: her husband last year and targeting another lawmaker and his
- 1:30:40Speaker 38: wife the same day. ABC's Peter Haralambos says Belter pleaded
- 1:30:45Speaker 38: guilty last month, taking the death penalty off the table.
- 1:30:47Speaker 31: He admitted to carrying out what prosecutors called a night
- 1:30:50Speaker 31: of terror that shook Minnesota to its core when he
- 1:30:52Speaker 31: disguised himself as a member of law enforcement, assassinated a
- 1:30:55Speaker 31: top Democrat in the Minnesota House and her husband, and
- 1:30:58Speaker 31: severely injured a state senator and his wife.
- 1:31:00Speaker 38: Protests broke out in Madison, Wisconsin following a deadly encounter
- 1:31:03Speaker 38: between police and a black man yesterday in broad daylight.
- 1:31:06Speaker 38: Officers responded to reports of a person trying to open
- 1:31:09Speaker 38: car doors. Police say the man was armed with a
- 1:31:11Speaker 38: knife and fled on a bike. Officers caught up with
- 1:31:14Speaker 38: him and video circulating online appears to show the man
- 1:31:16Speaker 38: wrestled to the ground before three shots are fired. At
- 1:31:19Speaker 38: a briefing today, Common Council President Sabrina Madison questioned the escalation.
- 1:31:23Speaker 4: Corey has a family.

- 1:31:35Speaker 38: full review. At least two people are unaccounted for following
- 1:31:38Speaker 38: severe flooding in West Virginia. The governor says water rescues
- 1:31:41Speaker 38: continue and severe storms are also inundating North Carolina and Virginia.
- 1:31:46Speaker 38: Flood alerts could stretch into the weekend. You're listening to

- 1:32:05Speaker 40: Police have a man in custody following a deadly shooting
- 1:32:07Speaker 40: early Thursday on Puddin' Bay.
- 1:32:10Speaker 10: Police and other first responders arrived to a call of
- 1:32:12Speaker 10: a shooting just after midnight at Mr. Ed's Bar and
- 1:32:14Speaker 10: Grill on Delaware Avenue, and that's where they discovered a
- 1:32:17Speaker 10: 39-year-old man with multiple gunshot wounds. Officers immediately began life-saving
- 1:32:23Speaker 10: techniques on the victim, but to no avail. Put-In-Bay Police,
- 1:32:26Speaker 10: troopers from the State Patrol, and members of the Ottawa
- 1:32:29Speaker 10: County Sheriff's Department quickly conducted a search and arrested the
- 1:32:32Speaker 10: suspected gunman about 3.40 Thursday morning. I'm Carmen Angelo.
- 1:32:36Speaker 40: Anytime a federal judge in Cincinnati says immigration agents are
- 1:32:39Speaker 40: illegally arresting people across Ohio, but she can't stop it.
- 1:32:42Speaker 4: Travis Laird with the details.
- 1:32:44Speaker 23: Judge Sarah Morrison ruled that Immigrations and Customs Enforcement agents
- 1:32:49Speaker 23: are conducting unlawful, warrantless arrests without probable cause. Despite testimony
- 1:32:55Speaker 23: from an ICE supervisor admitting that almost all agency arrests
- 1:33:00Speaker 23: lack warrants, Morrison dismissed a civil rights lawsuit seeking to
- 1:33:04Speaker 23: halt the tactics. The judge claimed the plaintiffs could not
- 1:33:07Speaker 23: prove they would be targeted again or that federal immigration agencies...
- 1:33:12Speaker 23: have a written policy to break the law. I'm Travis Laird.
- 1:33:16Speaker 40: 15 people have been arrested in connection with what federal
- 1:33:18Speaker 40: prosecutors say was a drug trafficking ring operating out of
- 1:33:21Speaker 40: a Mansfield car wash. Investigators say the group got part
- 1:33:24Speaker 40: of their drug supply from sellers in Detroit, Cleveland, and
- 1:33:26Speaker 40: Toledo and would store the drugs at the new Millennium
- 1:33:29Speaker 40: Car Wash on Johns Avenue. The suspects have each been
- 1:33:31Speaker 40: charged with conspiracy to distribute and possession with intent to
- 1:33:34Speaker 40: distribute cocaine, crack, and oxycodone. and a suspect is in
- 1:33:38Speaker 40: custody after the fatal shooting of a man in Mason
- 1:33:40Speaker 40: Wednesday afternoon. Reports say that just after 1 p.m., 34-year-old

- 1:34:49Speaker 1: result of the storm or an issue with your insurance company.

- 1:35:58Speaker 1: going on in your life. Let's go to the law
- 1:36:01Speaker 1: firm of Beatrice Kopp and see who joins us tonight
- 1:36:06Speaker 1: on NewsRadio 570 WKBN. Tally is usually the most dependable
- 1:36:11Speaker 1: one to be on the broadcast with us, folks. Are
- 1:36:15Speaker 1: you there?
- 1:36:18Speaker 10: Nope.
- 1:36:20Speaker 1: Tally is not there. Attorney David Beatrice, are you there?
- 1:36:24Speaker 4: Ron, the kingmaker is in the building and not yet.
- 1:36:29Speaker 1: Then you've got to just say no. So Beatrice isn't there.
- 1:36:33Speaker 1: Tally isn't there. Brian Kopp isn't there. But who is Mr.
- 1:36:37Speaker 1: Dependable that is there, that shows up? That's right, the
- 1:36:41Speaker 1: one and only Attorney Melfi. Welcome, James. Good to have
- 1:36:44Speaker 1: you with us, as always.
- 1:36:45Speaker 4: Thank you, Ron. But you forgot Frank.
- 1:36:48Speaker 1: Is Frank with us tonight?
- 1:36:50Speaker 4: No, Frank is coaching... his boys' football team. He's an
- 1:36:55Speaker 4: assistant coach, so I've been calling him Woody Hayes all week.
- 1:36:58Speaker 1: Absolutely.
- 1:36:59Speaker 4: Three yards in a cloud of dust, Frank Cassis is
- 1:37:01Speaker 4: coaching football.
- 1:37:03Speaker 1: And I'm happy for him. He's doing the right thing.
- 1:37:04Speaker 4: And here's the kingmaker.
- 1:37:06Speaker 1: Ah, the kingmaker.
- 1:37:07Speaker 21: I had a rough week.
- 1:37:11Speaker 1: You know what? I happened to catch some of that
- 1:37:13Speaker 1: rough week that you had. Attorney Melfi, did you happen
- 1:37:16Speaker 1: to see that Attorney Beatrice in that girl-like Mercedes car
- 1:37:20Speaker 1: that he drives had a flat tire?
- 1:37:22Speaker 4: Wait, we're on. So Yesterday.
- 1:37:24Speaker 1: Close to the mic, James.
- 1:37:26Speaker 4: We're having dinner yesterday. And you know what his best
- 1:37:32Speaker 4: explanation was?
- 1:37:33Speaker 1: What?
- 1:37:35Speaker 4: It was something phantom in the road came up and
- 1:37:39Speaker 4: slashed his tire.
- 1:37:41Speaker 1: It's not that he hit a pothole or hit something
- 1:37:43Speaker 1: in the road.
- 1:37:43Speaker 4: Not that he hit a pothole or maybe struck some
- 1:37:47Speaker 4: debris on the highway. He said something must have just
- 1:37:50Speaker 4: popped up i didn't hit anything it had to be
- 1:37:52Speaker 4: a nail just just a phantom nail came and slashed
- 1:37:55Speaker 4: my tire on the highway.
- 1:37:57Speaker 1: Right and then and then he had to hitchhike to
- 1:38:00Speaker 1: get to court on time did you know that well.
- 1:38:02Speaker 4: He he almost hitchhiked but what he did was and
- 1:38:06Speaker 4: uh connor one of our clerks is aces david calls
- 1:38:11Speaker 4: him connor connor come get me come get me tow
- 1:38:14Speaker 4: trucks two hours away connor goes David gets in the
- 1:38:18Speaker 4: tow truck and goes to court, and Connor's like, where's Waldo?
- 1:38:22Speaker 4: Where are you? Doesn't call him back.
- 1:38:25Speaker 1: So Connor's out running around looking for attorney Beatrice. who
- 1:38:30Speaker 1: doesn't call him back, who said the tow truck took
- 1:38:31Speaker 1: me to court or whatever.
- 1:38:33Speaker 4: Connor's helping me get ready for a trial, and he
- 1:38:36Speaker 4: drives to Newton Falls, and all of a sudden David's
- 1:38:38Speaker 4: not there.
- 1:38:39Speaker 1: It's unbelievable. Absolutely unbelievable. All right.
- 1:38:43Speaker 4: He does have new specs that look pretty good.
- 1:38:44Speaker 21: All I know is I was on my way to
- 1:38:47Speaker 21: the Newton Falls Municipal Court. As I was driving, I
- 1:38:51Speaker 21: hear pop. I look on my dashboard. It says left
- 1:38:56Speaker 21: rear tire. So I pulled over. Now, when you're on
- 1:39:00Speaker 21: 76 and you get off at 534 to go to
- 1:39:03Speaker 21: the Newton Falls Court, on parts of those roads, there's
- 1:39:08Speaker 21: not a lot of berm. So I pulled it over
- 1:39:11Speaker 21: as much as possible without going into a culvert.
- 1:39:14Speaker 11: Okay.
- 1:39:14Speaker 21: Okay. at which time I immediately put on my flashers
- 1:39:18Speaker 21: and exited my car because I realized I was in
- 1:39:22Speaker 21: a very precarious situation because a car could have not
- 1:39:26Speaker 21: seen me and hit me. And I stood about 50
- 1:39:29Speaker 21: yards away from my automobile. And so I called someone
- 1:39:33Speaker 21: from my office. I said, can you come down here
- 1:39:36Speaker 21: and park behind me so I don't get clipped?
- 1:39:40Speaker 1: And he says, okay, let me get this straight. So
- 1:39:42Speaker 1: you called someone from your office. You're out of your
- 1:39:44Speaker 1: car worried about getting hit. But let's send someone from
- 1:39:47Speaker 1: the office that can park behind you and let them
- 1:39:49Speaker 1: get hit.
- 1:39:50Speaker 21: Well, he has a big, huge truck. Doesn't matter. It's
- 1:39:54Speaker 21: a lot easier to see than by a little blue car.
- 1:39:57Speaker 35: Anyhow.
- 1:39:57Speaker 1: Your girly car.
- 1:39:59Speaker 21: Connor said, give me a landmark. And I said, well...
- 1:40:04Speaker 21: cornfields and a red barn. He goes, no, seriously, give
- 1:40:09Speaker 21: me a landmark. I said, I'm looking at cornfields and
- 1:40:12Speaker 21: there's a red barn behind me. What else do you
- 1:40:15Speaker 21: want me to say to you? Because I wasn't in
- 1:40:17Speaker 21: a real good sell area, so my drop pin wasn't
- 1:40:19Speaker 21: going through. The tow truck company said that they wouldn't
- 1:40:24Speaker 21: be there for about an hour. So I waited there
- 1:40:27Speaker 21: and the court continued my case. I then got towed
- 1:40:32Speaker 21: to Haas Auto Group, who are excellent people. If you're
- 1:40:36Speaker 21: going to buy a car, that's where you got to go.
- 1:40:38Speaker 21: And they took my car. I grabbed everything out of it.
- 1:40:42Speaker 21: And I said, Ron, I don't have time to rent
- 1:40:44Speaker 21: a car. Is there a car I can use? He said, sure.
- 1:40:47Speaker 21: They said, bring him over a car. So they brought
- 1:40:51Speaker 21: me over a car. I had to be in Beaver County, Pennsylvania,
- 1:40:56Speaker 21: before the Beaver County Common Pleas Judge at 1.30. And
- 1:41:00Speaker 21: I'm up against the times. So I got in the
- 1:41:03Speaker 21: car and I said, everything here, he goes, keys in it,
- 1:41:05Speaker 21: everything's in it. I said, good. I drove to Beaver
- 1:41:08Speaker 21: County a little faster than I should have. When I
- 1:41:14Speaker 21: got to Beaver County, I did my hearing. I came out.
- 1:41:19Speaker 21: I pressed the start and the dashboard lit up and said,
- 1:41:23Speaker 21: no key. At which point I called them and they said, well,
- 1:41:27Speaker 21: check underneath the seat. See if it fell down there.
- 1:41:30Speaker 21: So there I am looking underneath the seats and in
- 1:41:32Speaker 21: between the seats, and then they said, the key's in
- 1:41:35Speaker 21: the key holder. I said, there's no key in the
- 1:41:38Speaker 21: key holder. So they had to bring me out a key.
- 1:41:41Speaker 21: So I was there for another two hours. The next day,
- 1:41:45Speaker 21: I had to drive to Monroe County.
- 1:41:49Speaker 1: But wait a minute. You waited there two hours, and
- 1:41:51Speaker 1: they brought you a key so you could start the car.
- 1:41:54Speaker 21: Not two hours. However long, it takes about an hour
- 1:41:56Speaker 21: to get from here to where I was at.
- 1:41:58Speaker 1: Okay.
- 1:41:59Speaker 4: Hey, Ron, I just got back here. I had to
- 1:42:01Speaker 4: see a client real quick. Did David get to the
- 1:42:03Speaker 4: point of the story where he said there was no
- 1:42:06Speaker 4: key in the car?
- 1:42:06Speaker 1: Yes.
- 1:42:07Speaker 32: All right.
- 1:42:08Speaker 4: Now, can I pose this to you?
- 1:42:10Speaker 14: Yes.
- 1:42:10Speaker 21: There was no warning given to me that there was
- 1:42:14Speaker 21: no key in the car. I don't care what you, Frank, Brian,
- 1:42:17Speaker 21: and any other guys say. They were nice enough.
- 1:42:20Speaker 4: Now, let me talk. They were nice enough. That beautiful car.
- 1:42:24Speaker 4: It's a beautiful BMW.
- 1:42:27Speaker 1: Newer.
- 1:42:28Speaker 4: And so he wants us to believe that that car,
- 1:42:33Speaker 4: when he pulled away from the office, didn't ding, make
- 1:42:38Speaker 4: any noises, show anything on any of the screens in
- 1:42:42Speaker 4: the car that there was no key. Do you want
- 1:42:44Speaker 4: my theory?
- 1:42:45Speaker 1: Yes, please.
- 1:42:47Speaker 4: That key is in the Monroe County Court of Common
- 1:42:50Speaker 4: Pleas lost and found because it fell out of his pocket,
- 1:42:53Speaker 4: fell out of his bag. There is no way he
- 1:42:57Speaker 4: drove that far in that car with no key.
- 1:43:04Speaker 1: David? David?
- 1:43:09Speaker 21: There was no indication that there was not a key
- 1:43:13Speaker 21: in the car.
- 1:43:14Speaker 1: I'm sorry.
- 1:43:16Speaker 21: Frank put you under cross-examination yesterday. I don't care what
- 1:43:20Speaker 21: Frank says. Frank and Brian think they are, you know, Mr.
- 1:43:24Speaker 1: Fix-it.
- 1:43:25Speaker 21: There was no indication that there was not a key
- 1:43:29Speaker 21: in the car.
- 1:43:30Speaker 4: You know what Frank did to you? He said... If
- 1:43:32Speaker 4: you were trying this case, David, this is exactly how
- 1:43:35Speaker 4: you would say it.
- 1:43:35Speaker 21: There was no beeping going on. The only beeping was
- 1:43:38Speaker 21: the seatbelt. There was no flashing, nothing that I didn't
- 1:43:42Speaker 21: have keys, nothing, nothing at all. As a matter of fact,
- 1:43:46Speaker 21: just to prove you wrong.
- 1:43:48Speaker 4: Are we going to call the courthouse?
- 1:43:49Speaker 1: No, no.
- 1:43:50Speaker 21: After the show, we're going to go up. I'm going
- 1:43:51Speaker 21: to start the car, and I'm going to start it,
- 1:43:54Speaker 21: let you get in and put on the seatbelt, and
- 1:43:56Speaker 21: I'm going to take the key and tell me what
- 1:43:58Speaker 21: you see. How about that?
- 1:44:00Speaker 1: Deal.
- 1:44:01Speaker 28: Deal.
- 1:44:01Speaker 11: Deal.
- 1:44:03Speaker 1: All right. All right. So you were saying, David, you
- 1:44:07Speaker 1: drove and they had to bring you another key and
- 1:44:09Speaker 1: then that was it?
- 1:44:11Speaker 21: And then I came back to the office. And by
- 1:44:14Speaker 21: that time, the day was over. Yesterday, okay, I had
- 1:44:19Speaker 21: to go down and be in front of Judge Sweeney
- 1:44:21Speaker 21: in the Mahoney County Common Police Court at 9 o'clock.
- 1:44:26Speaker 21: I had to then be in Monroe County.
- 1:44:32Speaker 1: Monroe.
- 1:44:32Speaker 21: Monroe County, Ohio, at 1 o'clock. It's a two-and-a-half-hour drive
- 1:44:41Speaker 21: by Waze. It was actually closer to 3 because of
- 1:44:46Speaker 21: some closures of roads due to some floods they had.
- 1:44:52Speaker 21: Monroe County is all the way down, and it's contiguous...
- 1:44:58Speaker 21: with the state of West Virginia. It is the bottom
- 1:45:01Speaker 21: county in the 7th Appellate District and it still sits
- 1:45:06Speaker 21: in the 6th Appellate District. So as I'm driving down
- 1:45:11Speaker 21: along the Ohio River and I'm in Monroe County, I'm going,
- 1:45:15Speaker 21: I'm trying to figure out what these people in Monroe
- 1:45:18Speaker 21: County have in common with half of Mahoning County that's
- 1:45:22Speaker 21: in the 6th Congressional District. I just couldn't figure it out.
- 1:45:26Speaker 21: And so... That was about six hours in my car yesterday,
- 1:45:31Speaker 21: followed by today, okay, where I had to be in
- 1:45:35Speaker 21: court in the eastern district of Trumbull County for Frank
- 1:45:42Speaker 21: at 9.30, and then I had to be in Lorain
- 1:45:46Speaker 21: County at 1.30, which was another two and a half
- 1:45:51Speaker 21: hour drive, okay? So, Five hours in my car today.
- 1:45:55Speaker 21: About six hours in my car yesterday. And about four
- 1:46:00Speaker 21: to five hours in my car the day before that.
- 1:46:02Speaker 21: That's how much I've been in a car.
- 1:46:04Speaker 4: Now, and I will say this. When you write your book,
- 1:46:07Speaker 4: because I hope you write down your stories, because your
- 1:46:11Speaker 4: book would outsell all of the John Grisham novels. I
- 1:46:15Speaker 4: think a chapter or two has to be about you
- 1:46:18Speaker 4: and your car.
- 1:46:18Speaker 1: He has the damnedest luck of anybody I know. I'm
- 1:46:21Speaker 1: going to just tell you right now.
- 1:46:22Speaker 4: It's... Potholes just find them.
- 1:46:25Speaker 1: I know. I mean, if he would just get more
- 1:46:27Speaker 1: of a beefy man-like car and not one where the
- 1:46:30Speaker 1: tires blow when you hit something in a girl car
- 1:46:32Speaker 1: like he drives, I mean, we'd all be better.
- 1:46:34Speaker 4: He shouldn't be in that low-profile tire. Exactly. I mean,
- 1:46:36Speaker 4: it's a beautiful car. My wife would love that car.
- 1:46:37Speaker 1: Yeah, but I mean, right, but he needs a more
- 1:46:40Speaker 1: man-like vehicle. Wait a minute. You're on the legal program. Hello, caller.
- 1:46:45Speaker 11: Is that me?
- 1:46:46Speaker 1: Yes, it is. Do you have a legal question for
- 1:46:48Speaker 1: our attorneys?
- 1:46:49Speaker 15: Yeah, I do have a legal question.
- 1:46:51Speaker 24: Thank you.
- 1:46:52Speaker 12: I live in a condominium complex where I pay my
- 1:46:56Speaker 12: HOA fee.
- 1:46:57Speaker 21: On time, and I'm not getting what.
- 1:47:00Speaker 32: I am paying for.
- 1:47:01Speaker 38: There's dead bushes, tall grass.
- 1:47:04Speaker 21: I want to put my HOA fee somewhere, pay it
- 1:47:07Speaker 21: every month like I do regularly, but they don't get it.
- 1:47:11Speaker 14: What is that called?
- 1:47:13Speaker 4: Escrow. But I don't know. You're not in a landlord-tenant
- 1:47:18Speaker 4: relationship where if your landlord wasn't fixing your property, you
- 1:47:21Speaker 4: would escrow your rent with the clerk of courts. I
- 1:47:24Speaker 4: would read your HOA's bylaws. Is there a committee in
- 1:47:28Speaker 4: your HOA? Have you voiced any complaints? Have you went
- 1:47:31Speaker 4: to a meeting? Yes, I've voiced complaints. As David says,
- 1:47:34Speaker 4: the squeaky wheel gets the grease.
- 1:47:36Speaker 21: And they refused to fix the dead plant.
- 1:47:39Speaker 32: And they..
- 1:47:40Speaker 12: Refused to mow the grass, and my friend is my realtor.
- 1:47:44Speaker 14: I call her my personal realtor. She said, you have
- 1:47:47Speaker 14: to send the HOA a letter.
- 1:47:49Speaker 12: Do I go to a lawyer to get that letter?
- 1:47:54Speaker 4: Well, you could write a letter to your HOA. You
- 1:47:56Speaker 4: can also talk to a lawyer about your rights under
- 1:47:59Speaker 4: the bylaws of the HOA if you were to ever
- 1:48:01Speaker 4: escrow your fees, but you have to look at your
- 1:48:04Speaker 4: HOA agreement first.
- 1:48:07Speaker 36: So I cannot withhold my HOA and I'm not getting
- 1:48:10Speaker 36: what I'm paying for.
- 1:48:11Speaker 4: I would check with the bylaws of your HOA because
- 1:48:15Speaker 4: you're not just renting an apartment and your landlord's not
- 1:48:18Speaker 4: fixing your air where you can escrow it with the
- 1:48:21Speaker 4: clerk of courts. You have to see what your rights
- 1:48:23Speaker 4: and remedies are under the HOA agreement.
- 1:48:27Speaker 1: Yeah, because you don't want to get fined or anything
- 1:48:30Speaker 1: from your HOA, right, James?
- 1:48:33Speaker 4: Well, maybe if they fine it from the HOA, they
- 1:48:36Speaker 4: can put that towards cutting your grass. I mean, come on.
- 1:48:38Speaker 4: That's why you pay your HOA fees. Okay.
- 1:48:43Speaker 41: All right, thank you.
- 1:48:44Speaker 1: All right, thank you. You're on air with our attorneys tonight.
- 1:48:46Speaker 1: Hello there.
- 1:48:48Speaker 24: Yes, sir.
- 1:48:50Speaker 1: Go ahead.
- 1:48:50Speaker 2: Is this Ron?
- 1:48:51Speaker 1: Yes, it is, with the attorneys.
- 1:48:54Speaker 36: Oh, hey, Dave.
- 1:48:56Speaker 14: I post a little things on your little podcast of
- 1:48:59Speaker 14: all the issues you have, and I suggested on one
- 1:49:03Speaker 14: of your things, it's not a question, but I think
- 1:49:07Speaker 14: Ron being part-time, I think he should chauffeur you around
- 1:49:11Speaker 14: and you don't have to worry about all these problems.
- 1:49:15Speaker 4: What a wonderful idea.
- 1:49:17Speaker 21: That is a good idea.
- 1:49:17Speaker 4: What a wonderful idea.
- 1:49:20Speaker 21: I would only do it if Ron wore one of
- 1:49:23Speaker 21: those outfits that, you know, those drivers wear.
- 1:49:26Speaker 4: Like a cabbie hat?
- 1:49:28Speaker 21: Yeah, a cabbie hat and a bow tie. I think
- 1:49:31Speaker 21: that would be very appropriate.
- 1:49:33Speaker 4: What was the show James Corbin did where they would
- 1:49:35Speaker 4: do the carpool karaoke? Could you imagine you and Ron
- 1:49:39Speaker 4: being recorded for three hours in the car together?
- 1:49:42Speaker 11: Oh.
- 1:49:42Speaker 4: That would be a must-watch.
- 1:49:45Speaker 21: One of us wouldn't be alive at the end of
- 1:49:46Speaker 21: three hours.
- 1:49:47Speaker 15: Right.
- 1:49:47Speaker 4: Must-watch content. Must-watch.
- 1:49:49Speaker 14: Dave, you know me, James. I've been dealing with you
- 1:49:55Speaker 14: guys for about 15 years, so I'm not going to
- 1:49:59Speaker 14: say my name, but.
- 1:50:01Speaker 24: You know me, and so..
- 1:50:04Speaker 21: Well, thank you for calling in.
- 1:50:06Speaker 14: I appreciate your business and what you guys do. And
- 1:50:11Speaker 14: it's enjoyable, and I watch your little podcast. I've seen
- 1:50:15Speaker 14: where you went through Monroe County and everything else.
- 1:50:20Speaker 21: I mean, that was a ride. I mean, that was
- 1:50:26Speaker 21: a ride and a half. Because evidently they had a
- 1:50:29Speaker 21: flood down there, and some of the roads were closed.
- 1:50:34Speaker 24: Oh, God.
- 1:50:36Speaker 1: I'll tell you my first name's Grant. So you should
- 1:50:39Speaker 1: know that.
- 1:50:40Speaker 21: I know who you are.
- 1:50:40Speaker 4: 15 years ago, still at Girard High.
- 1:50:43Speaker 11: All right.
- 1:50:44Speaker 1: Thank you for your call.
- 1:50:45Speaker 21: I mean, you go down on that Route 7 and
- 1:50:47Speaker 21: you go, this is Market Street. I can't believe I'm
- 1:50:50Speaker 21: still on Market Street. You know, Market Street here, Route 7, Ron?
- 1:50:53Speaker 1: Yeah.
- 1:50:54Speaker 21: It goes all the way down.
- 1:50:57Speaker 4: It's like Interstate 80. You take one road, you're in Chicago.
- 1:51:00Speaker 21: It never ends. I went from being contiguous to the
- 1:51:05Speaker 21: state of Pennsylvania to being contiguous to the state of
- 1:51:09Speaker 21: West Virginia.
- 1:51:10Speaker 4: I couldn't imagine you on one road for an hour
- 1:51:13Speaker 4: and a half.
- 1:51:14Speaker 21: And there was a part of the road, a part
- 1:51:18Speaker 21: of the drive. I want to say about 25 miles
- 1:51:21Speaker 21: where I was in mountains. And I had no cell reception.
- 1:51:24Speaker 21: It was SOS. That was it. No reception at all.
- 1:51:28Speaker 1: Nothing.
- 1:51:28Speaker 21: It was like you're in a plane. It was SOS.
- 1:51:32Speaker 4: You were alone with your own thoughts for an hour.
- 1:51:35Speaker 21: Not an hour, but I want to say about 20 minutes.
- 1:51:39Speaker 1: That had to be frightening alone.
- 1:51:42Speaker 21: Well, my fear was, what if this car breaks down
- 1:51:45Speaker 21: and I have no cell?
- 1:51:46Speaker 4: You can't call Connor.
- 1:51:48Speaker 21: I'm in the middle of the mountains and there's nothing
- 1:51:50Speaker 21: around me. I would have had to walk miles to
- 1:51:54Speaker 21: get to something to make a call or something.
- 1:51:58Speaker 1: Thank God you're still with us, Dave. I mean, it's frightening.
- 1:52:03Speaker 21: I don't want to do any more driving this week.
- 1:52:05Speaker 21: I can tell you that right now.
- 1:52:06Speaker 1: There you go. You're on the air with Attorney Dave
- 1:52:09Speaker 1: Beatrice and James Melfi.
- 1:52:10Speaker 24: Hello.
- 1:52:12Speaker 35: Hi, guys.
- 1:52:13Speaker 14: Hi.
- 1:52:13Speaker 1: Go ahead.
- 1:52:15Speaker 24: So this must be the night of HOA calls. I
- 1:52:17Speaker 24: belong to an HOA as well.
- 1:52:20Speaker 42: And when we..
- 1:52:22Speaker 24: Bought our piece of property here eight years ago, we
- 1:52:26Speaker 24: were told at the time that there wouldn't be any
- 1:52:29Speaker 24: other building across the road that runs up our alley.
- 1:52:34Speaker 24: There would be some on the, as you go up
- 1:52:38Speaker 24: on the left-hand side, there was a space for two,
- 1:52:41Speaker 24: but there wouldn't be anything going in there. So the
- 1:52:44Speaker 24: last lot would be, we'll say, 100 yards away from
- 1:52:47Speaker 24: our home. Well, now we're being told that those two
- 1:52:51Speaker 24: pieces of property are going to have structures on them.
- 1:52:55Speaker 24: Is there any recourse that we have to that?
- 1:53:00Speaker 4: I don't think so.
- 1:53:01Speaker 39: No.
- 1:53:05Speaker 4: You can be told a lot of things. Unless it's
- 1:53:09Speaker 4: a contract in writing. So, no. I'm sorry about that.
- 1:53:15Speaker 1: So you think he's out of luck?
- 1:53:16Speaker 4: It was a great way to get you into that
- 1:53:18Speaker 4: HOA and buy what you, you know, home or condo, but.
- 1:53:23Speaker 13: Out of luck.
- 1:53:26Speaker 1: I wish we had better news for you, but basically
- 1:53:30Speaker 1: you're telling them, hey, you're out of luck, buddy.
- 1:53:34Speaker 13: Wow.
- 1:53:35Speaker 24: I don't understand how that's, I mean, how they're able
- 1:53:39Speaker 24: to do that. I mean, because we weren't the only
- 1:53:42Speaker 24: ones that were told that. The folks that built the home,
- 1:53:45Speaker 24: and these people just built theirs within the last year.
- 1:53:48Speaker 24: They just built theirs, and they were told the same thing,
- 1:53:51Speaker 24: that there wouldn't be anybody below them.
- 1:53:54Speaker 4: I'm going to assume it makes the HOA money. Therefore,
- 1:53:58Speaker 4: they're going to allow it.
- 1:54:03Speaker 24: All right. Even if there's other lots still available in
- 1:54:06Speaker 24: the development.
- 1:54:08Speaker 5: Yeah.
- 1:54:09Speaker 28: Yeah.
- 1:54:14Speaker 4: Okay.
- 1:54:15Speaker 38: All right, guys.
- 1:54:16Speaker 24: Thanks for your help.
- 1:54:17Speaker 32: All right.
- 1:54:17Speaker 21: Thank you.
- 1:54:18Speaker 1: Thank you. You're on the air.
- 1:54:19Speaker 21: My dog's doing the show with me. I'm throwing him
- 1:54:21Speaker 21: a ball, Ron.
- 1:54:21Speaker 1: All right. You're on the air with our attorneys tonight.
- 1:54:24Speaker 1: News Radio 570 WKBN. Welcome. Hello. You're talking to me.
- 1:54:30Speaker 32: I am.
- 1:54:30Speaker 1: Go ahead, sir. Good to hear your voice. Go ahead.
- 1:54:34Speaker 36: Thank you.
- 1:54:35Speaker 41: My girlfriend received a ticket over there in the village
- 1:54:37Speaker 41: East Canton and wondering the Legal ramifications of not paying
- 1:54:43Speaker 41: that ticket or ignoring it.
- 1:54:45Speaker 21: What kind of a ticket did she get?
- 1:54:46Speaker 1: It's written on a codified code.
- 1:54:49Speaker 21: Okay.
- 1:54:50Speaker 1: I'm sorry.
- 1:54:51Speaker 21: Is it a civil or criminal ticket?
- 1:54:53Speaker 1: Civil.
- 1:54:55Speaker 41: It's a civil ticket written under a codified code.
- 1:54:59Speaker 4: Is it from a camera or did somebody pull her over?
- 1:55:03Speaker 41: No, it's a camera ticket. There's no points assessed with it.
- 1:55:07Speaker 41: They don't notify the state of it.
- 1:55:10Speaker 21: Yeah, so technically I'm supposed to tell you to follow
- 1:55:15Speaker 21: the law, but I have gotten a number of those
- 1:55:20Speaker 21: for a school that's closed down.
- 1:55:25Speaker 1: Gee, there's a shocker. Yeah, can you imagine that?
- 1:55:28Speaker 32: Okay.
- 1:55:29Speaker 1: Only him. Only him.
- 1:55:30Speaker 21: And I am not– I didn't pay them, and I
- 1:55:34Speaker 21: have not been sued yet, and it's not showed up
- 1:55:36Speaker 21: on my credit report. So that's all I can tell you.
- 1:55:38Speaker 4: Call it your owner lease.
- 1:55:42Speaker 1: Do you own or lease your car, caller?
- 1:55:45Speaker 41: Oh, no, own.
- 1:55:47Speaker 21: Yeah, okay.
- 1:55:48Speaker 41: So we don't have to worry about a leasing company
- 1:55:50Speaker 41: billing us.
- 1:55:51Speaker 4: If you had a lease, you'd dispute it. So it
- 1:55:55Speaker 4: wouldn't just be assessed to the leasing company, and then
- 1:55:58Speaker 4: you would pay it out at the end. But you
- 1:55:59Speaker 4: own your vehicle, so you go with God.
- 1:56:03Speaker 41: Okay, yes, because, yeah, it's written on a codified code.
- 1:56:08Speaker 41: There's no points assessed to it.
- 1:56:09Speaker 1: The state's not... Not notified.
- 1:56:12Speaker 41: I contacted the state attorney general, and they told me
- 1:56:15Speaker 41: it's a civil case. They can't give me any legal advice.
- 1:56:19Speaker 41: The lawyer said that lots of municipalities do this.
- 1:56:23Speaker 32: Right.
- 1:56:23Speaker 4: I have a feeling it took you longer to get
- 1:56:26Speaker 4: through to the AGs than just calling us.
- 1:56:29Speaker 1: All right. Yeah. Thank you. Well, thank you very much.
- 1:56:32Speaker 1: Thank you. Have a great night.
- 1:56:33Speaker 4: No problem.
- 1:56:33Speaker 1: All right. The legal show, you're on the air. Hello. Gentlemen. Yes. Beautiful.
- 1:56:39Speaker 42: Beautiful, almost three-year-old granddaughter, her baby daddy, got a job,
- 1:56:44Speaker 42: and finally the people downtown that arranged for his check
- 1:56:48Speaker 42: to get attached for support. The checks start coming in.
- 1:56:55Speaker 1: I love how you phrase your question, beautiful baby daddy.
- 1:56:59Speaker 1: I'm laughing at how he puts the question. Anyway. Stand by.
- 1:57:03Speaker 1: Let me do my commercial break, and I'm going to
- 1:57:04Speaker 1: come right back to you, I promise, okay?
- 1:57:06Speaker 27: Thank you.
- 1:57:07Speaker 1: That way, because... I'm intrigued by his question already.
- 1:57:11Speaker 2: Call us in line.
- 1:57:11Speaker 1: Stand by. It's The Legal Show brought to you by
- 1:57:13Speaker 1: Beatrice Cop. They're here tonight till 6. Back after this,
- 1:57:16Speaker 1: NewsRadio 570 WKBN. As we celebrate 250 years, 570 WKBN.
- 1:57:26Speaker 22: It was a tough day on Wall Street as stocks
- 1:57:29Speaker 22: closed lower. It all comes as oil prices have been
- 1:57:32Speaker 22: surging as the United States has been launching more strikes
- 1:57:34Speaker 22: against Iran. Brent crude futures gained 7% to settle at
- 1:57:38Speaker 22: over $ 100. At the closing bell, the Dow Jones Industrial
- 1:57:42Speaker 22: Average lost 506 points to 51,711. The S & P
- 1:57:43Speaker 22: 500 fell 90 points to 7408, and the Nasdaq dropped
- 1:57:45Speaker 22: 553 points to 25,137. President Trump says he's close to
- 1:57:55Speaker 22: making a decision on a massive attack against Iran. Speaking
- 1:57:58Speaker 22: to Axios, he said the strikes would be bigger than
- 1:58:01Speaker 22: the ones conducted during Operation Epic Fury. The president didn't
- 1:58:04Speaker 22: give a deadline for when he would make the decision.
- 1:58:07Speaker 22: Tropical Storm Bertha is pushing inland near the Texas-Louis border
- 1:58:10Speaker 22: with winds of up to 45 miles an hour. The
- 1:58:12Speaker 22: storm is expected to bring heavy rain, storm surge, and
- 1:58:14Speaker 22: possible flooding to parts of the Texas coast. Forecasters say
- 1:58:17Speaker 22: Bertha will continue weakening as it moves west through Texas
- 1:58:21Speaker 22: and is expected to dissipate late tonight or tomorrow.
- 1:58:23Speaker 4: I'm Chris Coraggio.
- 1:58:24Speaker 35: Listen on the free iHeartRadio app for all your music, news, talk,
- 1:58:28Speaker 35: and sports radio.
- 1:58:29Speaker 1: Podcasts, too.
- 1:58:31Speaker 4: Download the app.
- 1:58:32Speaker 1: Free never sounded so good. Looking to upgrade your home?
- 1:58:36Speaker 1: This is Ron Wood.
- 1:58:38Speaker 35: Now, Ron Verb on NewsRadio 570 WKBN.
- 1:58:43Speaker 1: Back to it. This is The Legal Show brought to
- 1:58:44Speaker 1: you by Beatrice Kopp, 535 on NewsRadio 570 WKBN. They'll
- 1:58:49Speaker 1: be here tonight until 6 o'clock, taking on your legal questions.
- 1:58:52Speaker 1: All right, Attorney Melfi and Attorney Beatrice with us tonight.
- 1:58:55Speaker 1: I go back to the caller. Start with your question again,
- 1:58:57Speaker 1: just to refresh the folks that are listening and our attorneys.
- 1:59:01Speaker 1: And phrase it the same way you did. Yeah, I
- 1:59:04Speaker 1: loved it.
- 1:59:04Speaker 4: Okay, the..
- 1:59:07Speaker 42: The baby's born. Eventually, the baby daddy gets the job.
- 1:59:14Speaker 42: His check is attached. For whatever reason, he left that job.
- 1:59:19Speaker 42: The checks discontinued because there was no income. And now
- 1:59:23Speaker 42: the beautiful baby's daddy just, he got another job.
- 1:59:28Speaker 1: He won't tell.
- 1:59:29Speaker 42: Anybody where he's working, and he won't call child support
- 1:59:34Speaker 42: to let them know he's got a job. How do
- 1:59:37Speaker 42: we go about, and we've called, but we don't get
- 1:59:40Speaker 42: a call back from that caseworker.
- 1:59:44Speaker 32: How do we go about.
- 1:59:47Speaker 42: Pushing this along? I've already got a duct tape and
- 1:59:49Speaker 42: a duffel bag picked out. I'm just looking for a
- 1:59:52Speaker 42: body of water now.
- 1:59:58Speaker 4: You must not be very serious if you're talking about
- 2:00:00Speaker 4: that on the radio, but you've got to get him back.
- 2:00:03Speaker 4: You have to serve him with papers. He's going to
- 2:00:06Speaker 4: be in arrears. Nobody knows how long he's been working.
- 2:00:10Speaker 1: Here's the scenario, though, Jim. I mean, listen to what
- 2:00:13Speaker 1: he said. I mean, can you imagine he created this child,
- 2:00:18Speaker 1: and he doesn't, as a man, want to make sure
- 2:00:21Speaker 1: there's food in that baby's mouth and provide the necessities
- 2:00:26Speaker 1: of his offspring. So he quits a job, and he
- 2:00:28Speaker 1: goes and gets another job. And I just want to
- 2:00:30Speaker 1: make sure I got this straight, caller. No one knows
- 2:00:32Speaker 1: where he went to work. You can't find out where
- 2:00:36Speaker 1: he's at?
- 2:00:38Speaker 42: No, I'd have to get off the road and follow him.
- 2:00:40Speaker 42: I really don't know where he works. And the baby's mama,
- 2:00:44Speaker 42: he won't tell her.
- 2:00:45Speaker 1: Because he really doesn't want to pay child support. He
- 2:00:48Speaker 1: doesn't want to see that taken out of his check automatically.
- 2:00:51Speaker 1: That's the reality of what's going on with this bum.
- 2:00:53Speaker 4: That's the reality. And now I don't do custody work,
- 2:00:55Speaker 4: but I'm sure they are.
- 2:00:57Speaker 1: So what's the answer for him?
- 2:00:59Speaker 4: There's a petition you can file, either with juvenile court
- 2:01:02Speaker 4: or domestic get him served with paperwork and he'll have
- 2:01:05Speaker 4: to answer to the court where he works yeah i.
- 2:01:08Speaker 21: Mean his my understanding is his child support's not being
- 2:01:11Speaker 21: taken out.
- 2:01:13Speaker 1: Well he went to another job and they don't know
- 2:01:15Speaker 1: where he went oh.
- 2:01:17Speaker 21: Yeah that yeah you have to get him served you
- 2:01:19Speaker 21: got to get him served and the child support enforcement
- 2:01:21Speaker 21: agency might do that themselves for you i would get
- 2:01:25Speaker 21: a hold of them just you know and save yourself
- 2:01:28Speaker 21: maybe some legal fees.
- 2:01:30Speaker 1: What would he do, David?
- 2:01:31Speaker 21: He's under a court order. A court order is not
- 2:01:34Speaker 21: an invitation to do something. It's not like the court going, hey,
- 2:01:38Speaker 21: I invite you to pay child support. It's not how
- 2:01:40Speaker 21: it works.
- 2:01:40Speaker 4: He's in contempt.
- 2:01:41Speaker 21: The court is ordering you to pay child support, and
- 2:01:44Speaker 21: in that order it says if you switch employment, you're
- 2:01:48Speaker 21: to notify your new employer of this court order, not
- 2:01:53Speaker 21: an invitation.
- 2:01:56Speaker 42: Okay, thank you very much.
- 2:01:58Speaker 21: All right, thank you.
- 2:02:00Speaker 1: Can you imagine? So he might be able to get
- 2:02:02Speaker 1: that done for free, you're saying, if he goes down
- 2:02:04Speaker 1: to child support and pleads a case.
- 2:02:08Speaker 21: And this guy's going to be in arrears for any
- 2:02:11Speaker 21: weeks he missed.
- 2:02:15Speaker 1: It just makes you shake your head. I don't know
- 2:02:19Speaker 1: what to say about that stuff.
- 2:02:20Speaker 21: When I hear people are divorced and I hear a
- 2:02:24Speaker 21: man or a woman saying, I'm giving her $ 16 or
- 2:02:28Speaker 21: $ 1, 000 a month child support. I go, no. If you
- 2:02:33Speaker 21: were rearing your child, that's approximately how much you'd be
- 2:02:37Speaker 21: spending on your child. You're not giving it to them.
- 2:02:41Speaker 21: This is for your child. It blows my mind.
- 2:02:45Speaker 4: A grand is light.
- 2:02:47Speaker 32: Yeah.
- 2:02:49Speaker 21: You know the only reason why Jimmy's here tonight, right?
- 2:02:52Speaker 1: Why is that?
- 2:02:54Speaker 21: His son's just not old enough to play any organized
- 2:02:57Speaker 21: sports yet. So Tally is not here because her children
- 2:03:02Speaker 21: are old enough and she's involved in organized sports. And
- 2:03:06Speaker 21: Frank's kids are like super athletes. And now Frank's decided
- 2:03:10Speaker 21: he wants to be, you know.
- 2:03:12Speaker 1: Woody Hayes.
- 2:03:13Speaker 21: Woody Hayes or Jack. Who was the guy for the
- 2:03:15Speaker 21: Green Bay Packers?
- 2:03:17Speaker 4: Vince Lombardi.
- 2:03:18Speaker 21: He wants to be, you know.
- 2:03:18Speaker 4: It fits our heritage.
- 2:03:19Speaker 21: We're going to call him Frank Vince Lombardi Casise. Because
- 2:03:23Speaker 21: he's his son's coach, okay? So I don't know when
- 2:03:29Speaker 21: we'll see Frank again. I don't know when we'll see
- 2:03:31Speaker 21: Tally again. And, Jimmy, pretty soon your son's going to
- 2:03:35Speaker 21: be old enough where you're going to be doing T-ball,
- 2:03:38Speaker 21: which is a special kind of torture.
- 2:03:41Speaker 4: He's going to school this year. And, Ron, I finally
- 2:03:44Speaker 4: broke it to my wife. You know how our final
- 2:03:46Speaker 4: pretrial in the case that got continued was. It was
- 2:03:49Speaker 4: set for August 26th in Tampa Federal Court. It was
- 2:03:53Speaker 4: my son's first day of preschool. And I've known this
- 2:03:56Speaker 4: for like three months. I finally told my wife when
- 2:03:58Speaker 4: we got continued. I said, Nina, I haven't told you
- 2:04:02Speaker 4: this before because I didn't know how to say it.
- 2:04:03Speaker 4: I was going to be gone for the first day
- 2:04:05Speaker 4: of preschool. She's like, no, you're not. You have to
- 2:04:06Speaker 4: get a move. I'm like, no, that's kind of not
- 2:04:09Speaker 4: how it works, honey. I go, well, I'll take a
- 2:04:11Speaker 4: picture with him the day before.
- 2:04:11Speaker 21: You want to know what's going to be funny, Ron?
- 2:04:13Speaker 1: What's that?
- 2:04:14Speaker 21: Jimmy and Brian are going to be in trial starting
- 2:04:17Speaker 21: January 11th. And that trial is going to last probably
- 2:04:20Speaker 21: two to three weeks. Frank and I start a jury
- 2:04:24Speaker 21: trial in Tampa, Florida, January 18th, one week later. All
- 2:04:30Speaker 21: four of us are going to be down there. Someone
- 2:04:33Speaker 21: is going to have injuries before either trial is over with.
- 2:04:37Speaker 24: Yes.
- 2:04:38Speaker 1: Jimmy and Brian will be in Tampa.
- 2:04:43Speaker 21: In federal court.
- 2:04:45Speaker 1: In Tampa.
- 2:04:46Speaker 21: In Tampa. Frank and I will be across the street.
- 2:04:49Speaker 21: In state court.
- 2:04:50Speaker 1: In Tampa.
- 2:04:51Speaker 21: A week later.
- 2:04:52Speaker 1: In Tampa.
- 2:04:52Speaker 4: Are we all going to stay at the same hotel?
- 2:04:54Speaker 21: We are getting an Airbnb is what we're doing. I'm
- 2:04:58Speaker 21: not staying at a hotel.
- 2:05:00Speaker 1: How does that all happen? I mean, just for our listeners.
- 2:05:04Speaker 1: I mean, here you are, long established in this community
- 2:05:07Speaker 1: and representing people, obviously, in Ohio and in Pennsylvania. But
- 2:05:12Speaker 1: it seems to me, obviously, you've got a Tampa office.
- 2:05:15Speaker 1: But you're doing a lot of work now with people
- 2:05:17Speaker 1: in Tampa. Are these people from Youngstown initially? Yes.
- 2:05:21Speaker 21: You'd be surprised. That was how we designed it. There
- 2:05:26Speaker 21: were a lot of people from this area that traversed
- 2:05:30Speaker 21: to Florida.
- 2:05:31Speaker 4: The west coast of Florida from Sarasota to Naples is
- 2:05:35Speaker 4: Little Youngstown.
- 2:05:36Speaker 1: It really is.
- 2:05:36Speaker 4: I mean, me personally, the Florida work that I get referred, 90%
- 2:05:42Speaker 4: are Youngstown or Youngstown Connections.
- 2:05:48Speaker 1: And they know that you have the Beatrice name in Tampa.
- 2:05:51Speaker 1: They can associate it with the one back here. Yes.
- 2:05:54Speaker 4: They know that, and they like a familiar face.
- 2:05:57Speaker 21: Yeah. Like the case Frank and I are doing, it's
- 2:06:00Speaker 21: a murder case.
- 2:06:01Speaker 1: Oh, there's a good one, huh?
- 2:06:04Speaker 21: Well, I haven't tried a criminal case in Florida, so
- 2:06:08Speaker 21: I keep telling Brian, find me a criminal case that's
- 2:06:11Speaker 21: going to trial so I can at least watch how
- 2:06:13Speaker 21: they do it. I mean, the basic concepts are the same,
- 2:06:17Speaker 21: but there might be some little nuances, procedural nuances that
- 2:06:22Speaker 21: I'm going to have to pick up on. But the
- 2:06:25Speaker 21: person's mother is from Warren, Ohio. We got charged down there,
- 2:06:30Speaker 21: and that's how we got hired on the case.
- 2:06:32Speaker 1: So it's a woman that did the murder?
- 2:06:35Speaker 21: No, no, her son.
- 2:06:36Speaker 1: Okay.
- 2:06:38Speaker 21: She's from Warren.
- 2:06:39Speaker 1: Okay.
- 2:06:40Speaker 21: And she knew we were licensed in Florida, knew I
- 2:06:43Speaker 21: was licensed in Florida, and came to see me and
- 2:06:46Speaker 21: asked whether I'd represent her son, and I said, of course.
- 2:06:48Speaker 21: And then Frank has not taken the Florida bar yet
- 2:06:52Speaker 21: because he's afraid to.
- 2:06:55Speaker 1: Who wouldn't be afraid to after what you've been through?
- 2:06:59Speaker 21: Wait a minute. What am I saying that's wrong? Did
- 2:07:01Speaker 21: you take the Florida bar, Jimmy?
- 2:07:03Speaker 5: Yeah.
- 2:07:03Speaker 21: And did you pass the Florida bar? Yeah, first time.
- 2:07:06Speaker 21: Did Frank take the Florida bar?
- 2:07:08Speaker 24: No.
- 2:07:08Speaker 1: Okay.
- 2:07:09Speaker 21: So how is he on that case with me? You
- 2:07:11Speaker 21: want to explain that to people?
- 2:07:12Speaker 4: So Frank is on that case by a mechanism called
- 2:07:16Speaker 4: pro hoc vice.
- 2:07:17Speaker 21: Pro hoc vice. How do you like that, Ron?
- 2:07:19Speaker 1: Which means..
- 2:07:20Speaker 21: For this one case only.
- 2:07:22Speaker 4: For this one case. So even if you're not licensed
- 2:07:25Speaker 4: in a state, you could make an appearance in a case,
- 2:07:29Speaker 4: act as trial counsel. But, like, for example, David is
- 2:07:32Speaker 4: licensed in Florida. So David had to sponsor... frank's admission
- 2:07:37Speaker 4: pro hoc vice so basically.
- 2:07:39Speaker 21: It's thanks going down there to help me with this
- 2:07:41Speaker 21: one case yeah.
- 2:07:42Speaker 1: It's so can frank speak in court and.
- 2:07:44Speaker 21: Oh yeah he can act as a lawyer or anything
- 2:07:46Speaker 21: he wants you.
- 2:07:47Speaker 4: Know the case we're in they're all pro hoc then
- 2:07:49Speaker 4: there's one local council that got them all yeah.
- 2:07:52Speaker 1: So basically is it fair for me to say attorney
- 2:07:54Speaker 1: melfi frank is writing on dave's coattails at this point.
- 2:07:57Speaker 21: Now frank's a really good lawyer i don't think people realize.
- 2:08:01Speaker 21: And Jimmy, let me tell you something. I took Jimmy
- 2:08:04Speaker 21: with me to Lorain County Common Police Court, okay? I
- 2:08:09Speaker 21: have these three detectives there, two prosecutors and a judge.
- 2:08:16Speaker 21: And you could have heard a pin drop when Jimmy
- 2:08:18Speaker 21: was talking about Because of the knowledge he gained from
- 2:08:21Speaker 21: this federal case, he's been working in Tampa, Florida. The
- 2:08:27Speaker 21: judge was just spellbinded. And my client leaned over to
- 2:08:31Speaker 21: me and he goes, Dave, I don't mean this bad.
- 2:08:33Speaker 1: And I go, what?
- 2:08:34Speaker 21: He goes, he sounds a lot smarter than you.
- 2:08:36Speaker 4: Well, trust me, in the nuts and bolts of the case,
- 2:08:39Speaker 4: he wants you, not me. But for this issue..
- 2:08:42Speaker 27: For the issue we were down there on, our worlds collided.
- 2:08:46Speaker 21: Yeah, our worlds collided. And Jimmy was so... Like, he
- 2:08:50Speaker 21: started throwing out words and acronyms, and I'm like, I
- 2:08:56Speaker 21: don't know what that means, and I'll bet the judge
- 2:08:58Speaker 21: doesn't know what that means, and I'll bet those detectives
- 2:09:01Speaker 21: don't know what that means, and I'm going to even
- 2:09:03Speaker 21: bet the prosecutor doesn't know what that means.
- 2:09:06Speaker 4: We did okay that day.
- 2:09:07Speaker 1: We did.
- 2:09:08Speaker 4: We did okay that day.
- 2:09:09Speaker 21: They still haven't gotten into my client's phone.
- 2:09:12Speaker 1: This is in Florida?
- 2:09:14Speaker 21: No, in Lorain County.
- 2:09:15Speaker 1: Oh, Lorain County.
- 2:09:17Speaker 21: So they... They got a search warrant to search my
- 2:09:19Speaker 21: client's house. Then they filed a search warrant to search
- 2:09:23Speaker 21: my client's phone. And then that's when I intervened and said, yeah,
- 2:09:28Speaker 21: you can have my client's phone. You can't have any
- 2:09:30Speaker 21: emails to and from my client. You have to protect
- 2:09:33Speaker 21: the privilege. So if you don't protect the attorney-client privilege,
- 2:09:37Speaker 21: there's an argument it could be waived.
- 2:09:39Speaker 4: Not only waived, but we have an ethical duty to
- 2:09:41Speaker 4: protect privilege in Ohio.
- 2:09:43Speaker 38: Yeah.
- 2:09:44Speaker 21: So on that phone are text messages between me and
- 2:09:47Speaker 21: my client. about legal matters and they they don't have
- 2:09:52Speaker 21: a right to see those nor does the court okay
- 2:09:56Speaker 21: uh they don't have a right to see he has
- 2:09:58Speaker 21: email on his phone they don't have a right to
- 2:10:00Speaker 21: see my legal emails they don't even have a right
- 2:10:03Speaker 21: to see how many times he called me or i
- 2:10:05Speaker 21: called him all of that is privileged it's protected information
- 2:10:10Speaker 21: so think of a cloak going around you and your
- 2:10:15Speaker 21: lawyer when you're discussing it, no one can invade that. Now,
- 2:10:19Speaker 21: there's exceptions to it called the crime fraud exception. So
- 2:10:24Speaker 21: if a client was to use me and lie to
- 2:10:29Speaker 21: me to do something to help him, then they could
- 2:10:33Speaker 21: probably get into that, okay? But absent that, It's very hard.
- 2:10:40Speaker 4: And the way the technology is with cell phones these days,
- 2:10:43Speaker 4: they do a forensic image. So basically they take a
- 2:10:46Speaker 4: mirror image of everything that's on a hard drive in
- 2:10:49Speaker 4: the cloud, deleted, everything. So there's certain protocols to parse
- 2:10:55Speaker 4: and protect these things.
- 2:10:57Speaker 21: So Jimmy got up and he says, well, Your Honor–
- 2:11:00Speaker 21: Here's how I suggest we handle this. Who's ever doing it?
- 2:11:03Speaker 21: And they go, well, how about if we have BCI
- 2:11:06Speaker 21: extract it and store it? And we go, how about no?
- 2:11:09Speaker 1: Yeah, no.
- 2:11:11Speaker 21: I'm not going to let a law enforcement agency download
- 2:11:15Speaker 21: my legal emails to my client, store it on their
- 2:11:19Speaker 21: hard drive, and hope they don't look at them.
- 2:11:23Speaker 4: Yeah, it was insane. At one point, you're wrong. This
- 2:11:25Speaker 4: is to get into his iPhone?
- 2:11:26Speaker 32: Yes, exactly.
- 2:11:30Speaker 21: And they said, okay, give us the code to the iPhone.
- 2:11:33Speaker 21: I said, we will as soon as you. So they
- 2:11:35Speaker 21: sent us, like what, back on July 8th, the contents
- 2:11:39Speaker 21: of the search warrant. We sent them back a red
- 2:11:42Speaker 21: line version, haven't heard from them.
- 2:11:44Speaker 4: I rewrote it.
- 2:11:46Speaker 21: Well, what they had it down wasn't protecting the privilege.
- 2:11:51Speaker 4: Yeah.
- 2:11:52Speaker 21: It's really easy. Whoever extracts the information takes my phone
- 2:11:57Speaker 21: number and my e-mails and and deletes it from the download.
- 2:12:02Speaker 4: It's totally segregated. And people don't understand the data and
- 2:12:06Speaker 4: personal information that's on your device. All your apps, your app,
- 2:12:10Speaker 4: even like, for example, your health app. You know the
- 2:12:12Speaker 4: health app on your iPhone?
- 2:12:13Speaker 21: Don't mention health app to me, please.
- 2:12:15Speaker 4: Do you understand all your protected health information? Or if
- 2:12:18Speaker 4: you have MyChart, things like that. I mean, it is
- 2:12:22Speaker 4: crazy how much data and personal information is.
- 2:12:24Speaker 21: On your device. Yeah, and people think, I love it.
- 2:12:28Speaker 21: People go, well, I deleted it off my computer. I go, oh,
- 2:12:30Speaker 21: you don't think it's on your computer?
- 2:12:32Speaker 1: No, you didn't.
- 2:12:33Speaker 21: You don't think it's on your computer? Let me know
- 2:12:35Speaker 21: how that plan works out. Oh, you deleted that text message.
- 2:12:38Speaker 21: You don't think they can get it. Okay, let me
- 2:12:41Speaker 21: know how that works.
- 2:12:41Speaker 1: Well, how would they get it if you deleted it then?
- 2:12:44Speaker 4: Because it's a forensic image.
- 2:12:45Speaker 21: It's a forensic image.
- 2:12:47Speaker 1: What does that mean when you're talking?
- 2:12:48Speaker 4: That means it's a bit-by-bit replication of everything that has
- 2:12:53Speaker 4: been on your device, on your, for example, your iCloud
- 2:12:57Speaker 4: email account. regardless if it's been deleted.
- 2:13:01Speaker 1: It's still there?
- 2:13:02Speaker 21: It's still there.
- 2:13:03Speaker 4: The data is still there. Nothing is deleted.
- 2:13:07Speaker 1: So every text message that you deleted, these people that
- 2:13:12Speaker 1: you're talking about, these experts can bring it up.
- 2:13:15Speaker 21: If you hire the right expert, they can forensically go
- 2:13:18Speaker 21: in and get it. The FBI is so good that
- 2:13:22Speaker 21: even if I've had a client get his computer scrubbed
- 2:13:27Speaker 21: and they were still able to get information. The only
- 2:13:31Speaker 21: way they're not getting information off your computer, and now
- 2:13:35Speaker 21: anymore with the cloud, it's really bad.
- 2:13:37Speaker 4: They get into your account.
- 2:13:38Speaker 32: Yeah.
- 2:13:39Speaker 21: I mean, people used to throw away their computers, but
- 2:13:43Speaker 21: now everything's going up into the cloud. There's no getting
- 2:13:46Speaker 21: rid of the cloud. That's there.
- 2:13:48Speaker 4: What they do is they subpoena Apple, Google, these providers,
- 2:13:52Speaker 4: and Apple and Google– They're not going to have a
- 2:13:54Speaker 4: lawyer review every subpoena. They just give you the information. Right.
- 2:13:58Speaker 1: Can they force you to give them your code to
- 2:14:02Speaker 1: get into your phone?
- 2:14:05Speaker 21: Look, I said to them, you're entitled to my client's phone.
- 2:14:09Speaker 21: I didn't see the affidavit, but the judge said there
- 2:14:12Speaker 21: was enough probable cause, so I can't prevent that. I'm
- 2:14:17Speaker 21: going to give them the code. You're just not getting
- 2:14:19Speaker 21: any of my confidential information because I'm representing this guy.
- 2:14:23Speaker 21: For four or five years.
- 2:14:24Speaker 1: So you have to find a private company to download
- 2:14:28Speaker 1: it so you know that information.
- 2:14:30Speaker 21: No, no, no. We have to agree on a private
- 2:14:34Speaker 21: vendor that will download it, but we are going to
- 2:14:39Speaker 21: give him my phone numbers and my e-mails, okay, and
- 2:14:45Speaker 21: those will be excluded from the forensic down. Am I
- 2:14:49Speaker 21: saying it right, Jimmy?
- 2:14:49Speaker 5: Yes.
- 2:14:50Speaker 4: Here's what they do.
- 2:14:51Speaker 1: This is fascinating.
- 2:14:53Speaker 4: There's a court order with all of these protocols on
- 2:14:56Speaker 4: how it's supposed to be done. So the private vendor,
- 2:14:58Speaker 4: and a lot of them are lawyers, they will do
- 2:15:00Speaker 4: the download. So there will be a native file of
- 2:15:04Speaker 4: the download. Now, within those downloads, you can exclude certain
- 2:15:08Speaker 4: search terms. So, like, Ron, if you searched Ron in
- 2:15:13Speaker 4: your email, somebody downloaded it, it hit everything. But you
- 2:15:18Speaker 4: can exclude certain search terms. So they can exclude phone numbers,
- 2:15:21Speaker 4: email addresses, names. What I do a lot of times
- 2:15:25Speaker 4: is exclude, you know, for example, you, David. So David
- 2:15:30Speaker 4: within 10 of Beatrice. So even if it hits David
- 2:15:33Speaker 4: or Beatrice but not David Beatrice, it still would be segregated.
- 2:15:39Speaker 21: Yeah.
- 2:15:41Speaker 1: I mean, that is just incredible.
- 2:15:43Speaker 21: And I'll tell you what else is going on so
- 2:15:44Speaker 21: people out there know. The new move by the government
- 2:15:49Speaker 21: is now they get your phone or their computer. Guess
- 2:15:53Speaker 21: what they're searching? Your chat GPT for consciousness of guilt.
- 2:15:59Speaker 21: So if you're in chat GPT saying, hey, how do
- 2:16:01Speaker 21: I do X, Y, or Z? Or I did X, Y,
- 2:16:03Speaker 21: and Z. What should I do? That now becomes evidence
- 2:16:07Speaker 21: against you.
- 2:16:08Speaker 4: In the day, they would search your Google searches.
- 2:16:10Speaker 1: Right.
- 2:16:11Speaker 4: Now, with certain AI platforms, so like if you have
- 2:16:13Speaker 4: the free chat GPT, that is an open source platform.
- 2:16:17Speaker 4: platform meaning they whatever you put in that information is
- 2:16:21Speaker 4: out in space they train their models with it it
- 2:16:23Speaker 4: can be accessed it depends on what.
- 2:16:26Speaker 21: Source even close the models they can get.
- 2:16:28Speaker 4: Are they getting well they're getting even if.
- 2:16:31Speaker 21: You if you're not a lawyer like they couldn't get
- 2:16:33Speaker 21: mine yeah but they could get um a client's uh
- 2:16:39Speaker 21: closed chat gpt to check for if they were investigating
- 2:16:45Speaker 21: even on civil cases you know that.
- 2:16:47Speaker 4: If that caller came in, that caller put in his
- 2:16:49Speaker 4: chat GPT, how do I get rid of a body?
- 2:16:51Speaker 13: Yeah.
- 2:16:51Speaker 4: The guy that just called in about the transport. Feds
- 2:16:54Speaker 4: are going to get that.
- 2:16:54Speaker 1: In a second.
- 2:16:55Speaker 21: Yeah, they're going to get that, and then they're going
- 2:16:57Speaker 21: to put in, and they're going to say, now, Mr.
- 2:17:01Speaker 21: Forensic Expert, could you explain to the ladies and gentlemen
- 2:17:04Speaker 21: here what chat GPT is?
- 2:17:05Speaker 13: Yes.
- 2:17:06Speaker 21: And when someone puts in terms, they're looking for answers, correct?
- 2:17:09Speaker 1: Yes.
- 2:17:09Speaker 21: Could you tell us what the defendant over there, Mr. Jennings,
- 2:17:13Speaker 21: put in? How do I get rid of a body?
- 2:17:17Speaker 4: And it's a statement against interest.
- 2:17:18Speaker 21: And it's a statement against interest that shows consciousness of guilt.
- 2:17:22Speaker 21: So all of you out there that think you're being
- 2:17:25Speaker 21: cute with your chat GPT when you're committing crimes, that's
- 2:17:30Speaker 21: not a good idea.
- 2:17:31Speaker 1: Do you have cases, Dave, where they take the cell
- 2:17:34Speaker 1: phone and say, we can show that your client was
- 2:17:36Speaker 1: at this location at this time?
- 2:17:39Speaker 21: Don't. Don't bring that up to me. Because you're going
- 2:17:41Speaker 21: to see a 48 Hours episode where they did just that.
- 2:17:47Speaker 21: And we proved that our clients phone was not where
- 2:17:53Speaker 21: they said it was and the prosecutor told the jury
- 2:17:57Speaker 21: to ignore that evidence so I'm interested to see what
- 2:18:01Speaker 21: the appellate court does with that yes yes they can
- 2:18:05Speaker 21: do that they can ping it off of calls or
- 2:18:10Speaker 21: stuff coming in or from apps. So your apps will
- 2:18:15Speaker 21: track you.
- 2:18:18Speaker 1: And how did it say he was there and he
- 2:18:20Speaker 1: wasn't there then? How could there be that error?
- 2:18:24Speaker 21: Well, Ron, let me put it to you this way.
- 2:18:27Speaker 1: Yes.
- 2:18:30Speaker 21: Look, I respect the work of a jury system. It's
- 2:18:34Speaker 21: not perfect. Juries are capable of making mistakes.
- 2:18:38Speaker 1: Okay?
- 2:18:39Speaker 39: Mm-hmm.
- 2:18:40Speaker 21: When they plotted my client's phone, they left out a
- 2:18:46Speaker 21: longitude and latitude on a phone from an app that
- 2:18:52Speaker 21: will only register when the phone moves. So at, I'll
- 2:18:58Speaker 21: give you an example. If a murder was committed.
- 2:19:02Speaker 1: At 5.44 p.m., okay? Mm-hmm.
- 2:19:09Speaker 21: And my client's phone was moving at 5.55 p.m., 20
- 2:19:16Speaker 21: miles from where the murder is. Now, that means my
- 2:19:19Speaker 21: client's phone moved. That doesn't mean my client wasn't with it,
- 2:19:22Speaker 21: but it means my client's phone moved. Their theory of
- 2:19:26Speaker 21: the case was that my client left the phone somewhere,
- 2:19:30Speaker 21: went and did the murder, and then came back and
- 2:19:32Speaker 21: got it, except the phone moved. The phone moved.
- 2:19:38Speaker 4: And the fact of the matter, in the 21st century,
- 2:19:40Speaker 4: your phone is in your pocket at all times.
- 2:19:44Speaker 1: Yeah.
- 2:19:45Speaker 21: So, we'll see what happens.
- 2:19:46Speaker 1: When will this be on TV?
- 2:19:49Speaker 21: They said in the September 48 hours. Are we going
- 2:19:53Speaker 21: to have a premiere at the office?
- 2:19:55Speaker 1: We are.
- 2:19:55Speaker 21: Frank and I got faced. It was my fastest conviction ever.
- 2:19:59Speaker 21: It was such a... What do you mean conviction?
- 2:20:02Speaker 1: Did you lose?
- 2:20:03Speaker 21: It was my fast. Didn't you just hear me? Did
- 2:20:05Speaker 21: I stutter? It was my fastest conviction in the history
- 2:20:09Speaker 21: of my 41 year career. They convicted my client. There
- 2:20:13Speaker 21: were hundreds, hundreds of exhibits. There was an exhibit of
- 2:20:20Speaker 21: 250 pages of text messages. OK, there were videos, pictures,
- 2:20:28Speaker 21: all kinds of stuff. We went to lunch, we ordered
- 2:20:32Speaker 21: our lunch, and the court said, we have a verdict.
- 2:20:36Speaker 21: They came in and they said guilty, and not a
- 2:20:38Speaker 21: juror would speak to us. We couldn't get a juror
- 2:20:41Speaker 21: to speak to us. They couldn't have looked at the evidence.
- 2:20:45Speaker 21: They couldn't have looked at an exhibit.
- 2:20:47Speaker 1: So can you appeal that?
- 2:20:50Speaker 21: No, my client is appealing it, but, you know, a
- 2:20:53Speaker 21: jury can return a verdict fast. You know, here's what
- 2:20:56Speaker 21: a lot of people don't realize.
- 2:20:58Speaker 1: This is going to be a great show to see.
- 2:21:00Speaker 21: One person believed beyond a reasonable doubt can convict you.
- 2:21:06Speaker 21: If a person gets on the stand and says, Jimmy
- 2:21:11Speaker 21: Melfi shot a gun at me, and they have no
- 2:21:16Speaker 21: other evidence but that, and the jury believes Jimmy beyond
- 2:21:22Speaker 21: a reasonable doubt, I could be convicted.
- 2:21:25Speaker 1: We're running out of time. You've got to let everybody
- 2:21:27Speaker 1: know when that's going to be on. That's going to
- 2:21:29Speaker 1: be on 48 hours. That's fascinating. Dave, we pray for
- 2:21:33Speaker 1: you that you have a better week, all right? You've
- 2:21:36Speaker 1: got to follow him on social media. Thank you, Jim.
- 2:21:38Speaker 1: Thank you, guys.
