Latest / Beyond The Horizon / Mega Edition: The Chad Daybell Trial (Part 13-14) (10/21/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to get right back to the
- 0:05Speaker 1: Chad Daybell trial, and we're going to see what went
- 0:08Speaker 1: down on day number 13. To do that, once again,
- 0:12Speaker 1: we're going to use eastidahonews.com, and the author is Nate Eaton.
- 0:17Speaker 1: And hopefully, Nate had a nice little vacation. My man
- 0:20Speaker 1: certainly earned it. 8.32 a.m. Fremont County Prosecutor Attorney Lindsey Blake,
- 0:26Speaker 1: Madison County Prosecuting Attorney Rob Wood, Special Prosecutor Ingrid Beatty
- 0:31Speaker 1: and Fremont County Deputy Prosecuting Attorney Rocky Wixom are at
- 0:35Speaker 1: the prosecution table. John Pryor and Chad Daybell are at
- 0:40Speaker 1: the defense table. On Friday, Blake said that this morning's
- 0:43Speaker 1: witness would be lengthy. They have not said who will
- 0:46Speaker 1: be taking the stand. 8.37 a.m. Judge Boyce is on
- 0:50Speaker 1: the bench. 8.42 a.m. Jurors are in their seats. The
- 0:54Speaker 1: next witness is Nick Balance. He's an FBI special agent.
- 0:58Speaker 1: This witness will not be shown on video, but audio
- 1:01Speaker 1: of his testimony will be streamed. 8.45 a.m. Other camera
- 1:06Speaker 1: angles inside the courtroom will be shown, but the witness
- 1:08Speaker 1: will not appear on the live stream. 8.48 a.m. Balance
- 1:14Speaker 1: has been a special agent since June of 2016. He
- 1:18Speaker 1: works in Washington, D.C. He worked as a U.S. deputy
- 1:22Speaker 1: marshal for nine years before joining the FBI. He is
- 1:25Speaker 1: currently a member of the Cellular Analyst Survey Team, CAST,
- 1:29Speaker 1: and CAST is a group of 70 to 80 special
- 1:32Speaker 1: agents and task force operators who specialize in using cell
- 1:36Speaker 1: phone records to determine the general location of a phone
- 1:40Speaker 1: that might be of interest in an investigation. 8.51 a.m.
- 1:44Speaker 1: Rob Wood is questioning Balance. He asks about the training
- 1:47Speaker 1: involved to become a member of CAST. 8.54 a.m. Wood
- 1:52Speaker 1: asks Balance to explain what a cell tower does. And
- 1:55Speaker 1: Balance says a cell tower is constantly emitting radio frequency
- 1:59Speaker 1: in a given area. He explains that cell phone towers
- 2:02Speaker 1: connect with each other to enable calls to be made.
- 2:05Speaker 1: The range of a cell phone tower depends on the area.
- 2:08Speaker 1: Higher populated areas have more cell phone towers. And this
- 2:12Speaker 1: is all pretty basic stuff. When you follow along with
- 2:15Speaker 1: these kinds of cases, this is what they talk about, right?
- 2:18Speaker 1: The digital footprint. And that's why somebody like Brian Koberger
- 2:22Speaker 1: is going to end up in a whole lot of trouble.
- 2:25Speaker 1: because there's a lot of there there. And when you
- 2:28Speaker 1: look at Chad Daybell's information, and the information for those
- 2:32Speaker 1: involved in this conspiracy, it doesn't paint a pretty picture
- 2:36Speaker 1: of what they were up to either. 8.56 a.m. Balance
- 2:40Speaker 1: says towers are divided into three different sectors. He compares
- 2:43Speaker 1: it to cutting a pie into three different pieces. A
- 2:46Speaker 1: cell phone is constantly scanning the environment to look for
- 2:49Speaker 1: the strongest tower and sector. 8.58 a.m. The phone makes
- 2:54Speaker 1: the decision of which tower and sector to connect to,
- 2:57Speaker 1: but the phone will choose the strongest tower it can find,
- 3:00Speaker 1: Balance says. Cell companies keep records of their users' phone activities,
- 3:05Speaker 1: and you'll see a bunch of digital warrants get pulled
- 3:08Speaker 1: so that they can rebuild a whole timeline using whatever
- 3:12Speaker 1: your cell phone activity was. And we've seen it time
- 3:16Speaker 1: and time again, and we'll continue to see it. And
- 3:19Speaker 1: with as far as technology has come, you have to
- 3:22Speaker 1: be one... moronic mofo to think you're going to get
- 3:25Speaker 1: away with anything if you're using your own cell phone.
- 3:28Speaker 1: And even if you're using burners, if you don't know
- 3:31Speaker 1: what you're doing, you're going to leave a trail. And
- 3:34Speaker 1: if you ever get caught, they're going to be able
- 3:36Speaker 1: to rebuild that whole entire timeline like they did with
- 3:39Speaker 1: Chad Daybell. 9 a.m. Most cell providers capture the majority
- 3:43Speaker 1: of user data, but Verizon does not capture the location
- 3:46Speaker 1: detail of text messages. Cell companies also keep lists of
- 3:51Speaker 1: all of their towers. 9.02 a.m. Balance says in populated
- 3:55Speaker 1: cities like Boise, cell phone companies providing overlapping coverage from
- 3:59Speaker 1: tower to tower so calls don't drop. He compares it
- 4:03Speaker 1: to sprinklers on grass. If some spots don't get watered,
- 4:06Speaker 1: they will die, whereas sometimes sprinkler water overlaps to make
- 4:10Speaker 1: sure the grass is watered. 9.04 a.m. Balance was contacted
- 4:14Speaker 1: by law enforcement in June 2020 after the bodies of
- 4:18Speaker 1: JJ and Tylee were found. Balance gathered up equipment, and
- 4:22Speaker 1: did a drive test to measure cell towers in the
- 4:24Speaker 1: Rexburg and St. Anthony area. 9.06 a.m. He used specialized
- 4:30Speaker 1: pieces of equipment that had sensors, antennas, scanners, a computer,
- 4:35Speaker 1: and software to get raw measurements that map out cell
- 4:38Speaker 1: phone towers. The equipment is called GAR, Gladiator Autonomous Receiver. 9.09 a.m.
- 4:46Speaker 1: Wood asked Balance about Google location services. He says Google
- 4:50Speaker 1: provides a service where users can opt in to have
- 4:53Speaker 1: their locations recorded. These are tracked using Wi-Fi and cellular signals,
- 4:58Speaker 1: 9-11 a.m. Balance says you can pinpoint the exact location
- 5:03Speaker 1: of a phone with Google location services, but you can
- 5:06Speaker 1: find the general location. Balance says he looks for devices, phones,
- 5:10Speaker 1: not a specific person. The phone could be in the
- 5:13Speaker 1: pocket of a person, but he's locating devices. 9.13 a.m.
- 5:17Speaker 1: In this case, Balance examined numerous call detail records from
- 5:21Speaker 1: multiple phones, as well as Google location history. He says
- 5:25Speaker 1: the records were voluminous. He has prepared a report with
- 5:29Speaker 1: his findings and would move to have the report submitted.
- 5:32Speaker 1: And again, remember, just keep in mind that all of
- 5:34Speaker 1: these exhibits are going to be the foundation that ends
- 5:37Speaker 1: up building the house that convicts Chad Daybell. It is
- 5:41Speaker 1: all of this stuff that they're talking about, all these exhibits,
- 5:45Speaker 1: all of this forensic work that they did, all of
- 5:47Speaker 1: this is going to lead the jury, at least in
- 5:50Speaker 1: my opinion, to a conviction. Because there is just a
- 5:53Speaker 1: ton of evidence here. And we're not just talking about
- 5:56Speaker 1: one little bit of evidence, we're talking about a whole
- 5:59Speaker 1: lot of evidence that is very damaging and devastating to
- 6:03Speaker 1: Chad Daybell. 9.16am. Pryor doesn't object to the exhibit, but
- 6:10Speaker 1: asks for a sidebar. The attorneys leave the courtroom with Boyce. 9.21 a.m.
- 6:15Speaker 1: Attorneys are back and the exhibit is being displayed. One
- 6:18Speaker 1: of the slides shows the locations of cell phone towers
- 6:21Speaker 1: in the Rexburg area. There is also a slide showing
- 6:24Speaker 1: what cell phone towers look like and how they are
- 6:27Speaker 1: split up into sectors. And all of that, as well,
- 6:31Speaker 1: is to help the jury understand what they're looking at.
- 6:34Speaker 1: And then, of course, Chad Daybell will have his own
- 6:36Speaker 1: experts get up there and try and throw some cold
- 6:39Speaker 1: water on what the state's trying to say. And when
- 6:42Speaker 1: we talk about the battle of experts, that's what I mean. 9.28 a.m.
- 6:47Speaker 1: A slide shows the phone number's balance investigated in the case.
- 6:51Speaker 1: There are seven phone numbers on the screen. We now
- 6:53Speaker 1: see a slide showing geographical area where he did the
- 6:56Speaker 1: drive test. 9.30 a.m. A list of locations of interest
- 7:01Speaker 1: appears on the screen. It includes Burn Pit and Chad's yard,
- 7:05Speaker 1: Tylee and JJ's body location, Chad's residence, Lori's residence, Alex's residence,
- 7:10Speaker 1: the Salem LDS Church, Holiday Inn Express in Springville, Evergreen
- 7:15Speaker 1: Cemetery in Springville, Wireless Revolution in Rexburg, Walmart in Rexburg, BYU,
- 7:22Speaker 1: Idaho Library, Sportsman's Warehouse in Idaho Falls, and Marriott Residence
- 7:27Speaker 1: Inn in Kansas. 9.32 a.m. The next slide shows Google
- 7:32Speaker 1: location history between midnight, 5 a.m. on September 9th, 2019,
- 7:37Speaker 1: From the HomerJMaximus at gmail.com account. Alex's account. Tylee was
- 7:43Speaker 1: last photographed alive the day before. Imagine that stupid ass name.
- 7:48Speaker 1: Homer J Maximus. How about Homer J Stupid Ass. Or
- 7:53Speaker 1: Homer J Child Killer. I mean that would be more fitting.
- 7:56Speaker 1: Considering what this disgusting animal did. 9.35 a.m. Alex Cox
- 8:01Speaker 1: device was at Lori's apartment at 2.42 a.m. on September 9th.
- 8:06Speaker 1: And at 4.37 a.m., his device was at Alex's apartment. 9.38 a.m.
- 8:11Speaker 1: The next slide shows activity on Chad Daybell's phone between 7.20 a.m.
- 8:16Speaker 1: and 8.04 a.m. on September 9th. There were multiple text
- 8:20Speaker 1: messages with Lori and a call at 8.03 a.m. 9.39 a.m.
- 8:25Speaker 1: Wood asks how often Chad and Lori communicated with each other.
- 8:29Speaker 1: Pretty regularly, Balance responds. 9.40 a.m. A call was made
- 8:34Speaker 1: from Chad to Alex that morning at 8.11 a.m. The
- 8:37Speaker 1: call was 180 seconds. 9.41 a.m. At 8.58 a.m. that morning,
- 8:44Speaker 1: a text was sent from Chad to Lori. There were
- 8:46Speaker 1: also texts at 8.15 a.m. and 8.39 a.m. 9.44 a.m.
- 8:52Speaker 1: The next slide shows Google location history with Alex's device
- 8:56Speaker 1: between 8.49 a.m. to 9.15 a.m. He is in the
- 9:00Speaker 1: area of his apartment at 8.49 a.m. and by 9.15 a.m.
- 9:04Speaker 1: he's just south of Chad's house. 9.45 a.m. We see
- 9:09Speaker 1: another slide showing Alex's device on Chad's property between 9.21 a.m.
- 9:15Speaker 1: and 10.57 a.m. That morning, multiple spots were picked up
- 9:19Speaker 1: on the property, including areas close to where Tylee was found.
- 9:22Speaker 1: Balance went to the Daybell property and he noted that
- 9:26Speaker 1: there is a gate that allows access. 9.48 a.m. Morning recess,
- 9:30Speaker 1: be back in 30 minutes. 10.20 a.m. The morning break
- 9:34Speaker 1: is over and Boyce is on the bench. Jurors are
- 9:36Speaker 1: being brought in. Balance remains on the witness stand. 10.22 a.m.
- 9:42Speaker 1: The next slide shows Chad's phone was being used between 10.30 a.m.
- 9:46Speaker 1: and 12.20 p.m. on September 9th. There were multiple text
- 9:50Speaker 1: messages and one call with Lori Vallow, The activity was
- 9:54Speaker 1: during the same time frame that Alex's device was on
- 9:57Speaker 1: the property. 1024 AM Alex Cox's device was at Chad's
- 10:02Speaker 1: property at 11.42 a.m. The device was then traveling southbound
- 10:07Speaker 1: away from the property around 11.46 to 11.47 a.m. And
- 10:12Speaker 1: they're building that conspiracy, right? What were you doing talking
- 10:15Speaker 1: to him? What were all of you talking about? Oh,
- 10:18Speaker 1: you don't want to tell us? That's cool. We'll just
- 10:20Speaker 1: yank all of your digital records and we'll rebuild everything
- 10:24Speaker 1: that you did. And that's exactly what we see here.
- 10:28Speaker 1: And we saw this same exact strategy being used by
- 10:30Speaker 1: the prosecution against Lori Vallow, and it worked well. And
- 10:35Speaker 1: I have no doubt that it's going to continue to
- 10:36Speaker 1: work well here. And we're going to see Chad Daybell's
- 10:39Speaker 1: ass get convicted. There are very few cases where I
- 10:43Speaker 1: look at all of the facts and say to myself, man,
- 10:45Speaker 1: I don't see any way out for this guy or gal.
- 10:49Speaker 1: And when you look at Chad Daybell and Lori Vallow,
- 10:53Speaker 1: there is no doubt in my mind that they're guilty.
- 10:55Speaker 1: And I think that the prosecution is doing a very
- 10:58Speaker 1: good job of showing that. 1025 a.m. At 1145 a.m.,
- 11:03Speaker 1: Chad's device called Lori. An outgoing call was also made
- 11:06Speaker 1: from Alex to Lori around this time. 1028 a.m. The
- 11:11Speaker 1: new slide shows Chad's device received a text from Lori
- 11:14Speaker 1: and her device on September 9th between 1232 and 1234 p.m.
- 11:19Speaker 1: At 12.39 p.m., a text message was received on Chad's
- 11:23Speaker 1: device from Lori's device. Sure sounds like a bunch of
- 11:26Speaker 1: people who were in cahoots. 10.31 a.m. The next few
- 11:32Speaker 1: slides show the cell phone towers that were utilized by
- 11:34Speaker 1: devices belonging to Chad, Lori, and Alex on September 9th. 10.34 a.m.
- 11:40Speaker 1: The exhibit now moves to September 23rd, the day after
- 11:43Speaker 1: JJ was last seen alive. The slide shows multiple outbound
- 11:47Speaker 1: text messages and one inbound text message between Chad's device
- 11:52Speaker 1: and Lori's device were made between 3.59 a.m. and 8.35 a.m.
- 11:54Speaker 1: Chad sent Lori a text at 3.59 a.m. 10.36 a.m.
- 11:56Speaker 1: At 9.25 a.m. on September 23rd, Chad's device called Alex's device.
- 11:59Speaker 1: The call was 38 seconds. 10.38 a.m. On the same
- 12:00Speaker 1: day between 9.27 a.m. and 9.57 a.m., three cell phone
- 12:16Speaker 1: towers near the Daybell residence picked up activity on the devices.
- 12:21Speaker 1: A tower near Lori's Rexburg house was also utilized for
- 12:24Speaker 1: her device. 10.39 a.m. The next slide shows Alex's device
- 12:29Speaker 1: traveled north from his home in Rexburg towards Chad's home
- 12:33Speaker 1: the morning of September 23rd. His device was in and
- 12:36Speaker 1: around Chad's property between 9.55 a.m. and 10.12 a.m. The
- 12:41Speaker 1: device was tracked near the area where JJ's body was found. 10.40 a.m.
- 12:46Speaker 1: The next slide shows activity on Chad's phone the morning
- 12:49Speaker 1: of September 23rd. Between 9.30 a.m. and 10.27 a.m., there
- 12:51Speaker 1: were multiple calls and texts between his devices and Lori's device. 10.42 a.m.
- 12:54Speaker 1: On September 23rd, between 10.13 and 10.17 a.m., Chad's device
- 12:56Speaker 1: texted Lori. It also called Alex's device. 10.44 a.m. Wood
- 13:12Speaker 1: asked Balance if he looked at other times where the
- 13:15Speaker 1: Homer J. Maxx account showed up in and around Chad's property.
- 13:19Speaker 1: There are some times. August 7th, August 24th, September 6th,
- 13:24Speaker 1: September 25th, and October 15th. 10.46 a.m. Wood tells Balance
- 13:29Speaker 1: he wants to review a few of the slides again
- 13:31Speaker 1: with focus on the timeline. 10.49 a.m. Several of the
- 13:36Speaker 1: jurors are taking notes during the presentation. Others look at
- 13:39Speaker 1: the screens in front of them. Chad Daybell doesn't show
- 13:42Speaker 1: much emotion, looks at the computer screen in front of him,
- 13:45Speaker 1: and will glance up at the projector screen in the courtroom. 10.50 a.m.
- 13:50Speaker 1: Wood has no further questions. Pryor will now cross-examine. 10.52 a.m.
- 13:55Speaker 1: Pryor asks Balance the significance of including October 9th in
- 13:59Speaker 1: his report. Balance says that that's the day that Tammy
- 14:02Speaker 1: Daybell reported an assault attempt on that day. 10.55 a.m.
- 14:07Speaker 1: Pryor shows a slide displaying Alex's device. On October 9th,
- 14:11Speaker 1: between 5.16 p.m. and 11.53 p.m., Wood asked for a
- 14:16Speaker 1: brief sidebar. Attorneys and the judge leave the room. 11 a.m.
- 14:21Speaker 1: Attorneys are back and Pryor continues questioning. He asks about
- 14:24Speaker 1: the other visits Alex's device recorded in or around Chad's property. 11.01 a.m.
- 14:31Speaker 1: Pryor asked Balance to explain the difference between a tower
- 14:35Speaker 1: and a cell site. Balance says the cell site includes
- 14:38Speaker 1: the tower and the sector. The tower is just the
- 14:41Speaker 1: tower itself. 11.03 a.m. Pryor asks Balance when he did
- 14:45Speaker 1: the drive test. Balance says it was done the week
- 14:47Speaker 1: of June 16, 2020, and was over multiple days. Balance
- 14:52Speaker 1: says drive tests are done to show where a phone
- 14:54Speaker 1: could be, not exactly where it is. 11.05 a.m. Pryor
- 14:59Speaker 1: asks about Gladiator Forensics. It's a company used by the FBI.
- 15:03Speaker 1: They will only sell their equipment to law enforcement, according
- 15:06Speaker 1: to Balance. Pryor says only the government has access to
- 15:10Speaker 1: the gladiator tools, not the public at large. Balance says
- 15:14Speaker 1: that is correct. 11.07 a.m. Pryor brings up the slide
- 15:18Speaker 1: showing Chad's property with a focus on the irrigation pond
- 15:21Speaker 1: where the Homer J. Maximus device was recorded. Pryor asks
- 15:25Speaker 1: Balance to point out the fire pit. 11.12 a.m. Pryor
- 15:29Speaker 1: shows another slide from the Homer J. Maximus account between
- 15:32Speaker 1: midnight and 5 a.m. on September 9th, 2019. Alex was
- 15:37Speaker 1: inside or very close to Lori's apartment that morning. Prior
- 15:41Speaker 1: asks why Balance didn't put any cell phone data with
- 15:44Speaker 1: Melanie Gibb and David Warwick. Balance says he was not
- 15:47Speaker 1: asked to examine their phone records. 11.14 a.m. Prior asks
- 15:52Speaker 1: Balance who provided him the phone data. Balance doesn't recall specifically,
- 15:56Speaker 1: but says data was sent to him numerous times from
- 15:59Speaker 1: numerous law enforcement agencies. 11.16. Prior asks Balance if we
- 16:04Speaker 1: know the content of all the text messages. Balance says
- 16:07Speaker 1: that we do not. He confirms that there was a
- 16:09Speaker 1: significant amount of communication between Chad and Lori. Pryor asks
- 16:13Speaker 1: Balance if he's aware Chad and Lori were having an affair.
- 16:17Speaker 1: Balance is aware. 1118 a.m. Pryor has no further questions.
- 16:22Speaker 1: Wood has some brief redirect. 1119 a.m. Wood asks Balance
- 16:27Speaker 1: to describe why he uses 100 meters as a margin
- 16:30Speaker 1: of error. Balance says his research can be more precise
- 16:33Speaker 1: using 100 meters or less. 11.21 a.m. Balance looked at
- 16:38Speaker 1: the cell tower list of the providers from September 2019
- 16:41Speaker 1: and June 2020. There were no major changes between the
- 16:45Speaker 1: time frame. Wood asked about the GAR system. Balance says
- 16:50Speaker 1: it's made up of components and anyone can purchase the
- 16:53Speaker 1: primary components. They are civilian companies that do drive testing,
- 16:57Speaker 1: Balance says, not just the government. Balance says a civilian
- 17:01Speaker 1: could take his raw data file and compare it with
- 17:03Speaker 1: their own testing. 11.24 a.m. Wood asks if geolocation settings
- 17:08Speaker 1: can be altered on cell phone device. Balance says a
- 17:11Speaker 1: user can make changes about what is stored on a device.
- 17:15Speaker 1: Users can opt out of certain services. 11.25 a.m. Balance
- 17:20Speaker 1: has been involved in multiple criminal investigations. Wood asks if
- 17:24Speaker 1: it's common for people engaged in criminal activity to opt
- 17:27Speaker 1: out of geolocation services on their devices. Balance says he
- 17:32Speaker 1: has seen that numerous times. Wood has no further questions
- 17:35Speaker 1: but intends to bring balance back. 11.26 a.m. Pryor wants
- 17:41Speaker 1: to recross, but Boyce says no. Wood did not get
- 17:44Speaker 1: outside the scope. He tells Pryor he can ask his
- 17:47Speaker 1: questions when the agent is recalled. The witness is dismissed. 11.27 a.m.
- 17:53Speaker 1: Prosecution asks for a brief sidebar. White noise is played
- 17:57Speaker 1: in the courtroom. 11.29 a.m. Judge Boyce calls for a
- 18:02Speaker 1: lunch break. And like usual, that's where we're going to
- 18:05Speaker 1: break as well. And in the next episode, we'll pick
- 18:08Speaker 1: up where we left off. All of the information that
- 18:11Speaker 1: goes with this episode can be found in the description box.
- 18:16Speaker 1: What's up everyone and welcome back to the program. In
- 18:19Speaker 1: this episode, we're diving right back into day number 13
- 18:23Speaker 1: of the Chad Daybell trial. And we're going to pick
- 18:26Speaker 1: up with the afternoon session. However, the afternoon session was
- 18:30Speaker 1: very short. Usually courts in session till about 3.30 p.m.
- 18:35Speaker 1: Day 13 ended at about 1.30 p.m. And not only that,
- 18:39Speaker 1: but there's not going to be any court today, Tuesday,
- 18:43Speaker 1: April 30th, because the witness won't be here until Wednesday.
- 18:48Speaker 1: So that gives everybody a day to catch their breath
- 18:51Speaker 1: up in Idaho when it comes to Chad Daybell. But
- 18:54Speaker 1: I have to tell you, there hasn't been anything so
- 18:56Speaker 1: far that I've seen that would make me think that
- 18:59Speaker 1: Chad Daybell is going to get off here. Or that
- 19:02Speaker 1: he's going to find a way to pin this all
- 19:05Speaker 1: on Lori Vallow. It's just not likely. It's not going
- 19:09Speaker 1: to happen. At least not in my opinion. And I
- 19:11Speaker 1: haven't seen anything so far that helps Chad Daybell as
- 19:15Speaker 1: far as testimony. And all of the evidence that we've
- 19:18Speaker 1: seen from the Lori Vallow trial and this one all
- 19:21Speaker 1: point me at least in the direction of Chad Daybell.
- 19:25Speaker 1: And not just as some kind of passenger along for
- 19:28Speaker 1: the ride. but somebody involved in the planning stages, all
- 19:31Speaker 1: the way through the heinous act being carried out. And
- 19:34Speaker 1: I think that the evidence has shown us that time
- 19:37Speaker 1: and time again. This isn't a situation like we have, say,
- 19:41Speaker 1: down in Delphi, where there's a lot of real questions.
- 19:44Speaker 1: Whereas here, I think things are just perfunctory at this point.
- 19:48Speaker 1: But even the scummiest, most smartest, disgusting pieces of garbage
- 19:52Speaker 1: amongst us deserve a fair trial. And that's exactly what
- 19:55Speaker 1: Chad Daybell's getting as we speak. So with all of
- 19:59Speaker 1: that in mind, let's dive into this article from East
- 20:02Speaker 1: Idaho News, and let's get caught up on what happened
- 20:05Speaker 1: during the afternoon session. Headline. Cousins testify about Tammy Daybell's
- 20:11Speaker 1: relationship and encounters with Chad Daybell at the funeral. This
- 20:16Speaker 1: article was authored by Nate Eaton. 12.45 p.m. We're back
- 20:22Speaker 1: in the courtroom. Voices on the bench and the jurors
- 20:25Speaker 1: will be brought in. 12.47 p.m. Prosecutors call Hannah Parker
- 20:30Speaker 1: to the stand as her next witness. She prefers to
- 20:33Speaker 1: go by Hannah Munoz. She lives near Springville, Utah. 12.48 p.m.
- 20:38Speaker 1: Hannah is a freelance photographer and Tammy is her mom's cousin.
- 20:43Speaker 1: Hannah was with her mom on October 19th when she
- 20:46Speaker 1: heard Tammy passed away. I was very saddened by the
- 20:49Speaker 1: news and very confused, Hannah says. Yeah, that's because she
- 20:52Speaker 1: wasn't sick. All this talk about Tammy Daybell having all
- 20:56Speaker 1: these ailments and all these maladies. Yeah, right. She wasn't sick.
- 21:02Speaker 1: I mean, unless you're talking about the usual aches and
- 21:05Speaker 1: pains that somebody her age gets. You're not going to
- 21:08Speaker 1: be going to one of those high intensity clogging classes
- 21:12Speaker 1: or one of those other workout classes and keep up
- 21:16Speaker 1: with everybody else. If you're sick, you're going to be
- 21:19Speaker 1: falling behind, right? You're going to be lacking. You're not
- 21:21Speaker 1: going to have the energy. You're going to be fatigued,
- 21:23Speaker 1: whatever it might be. And according to everything we've heard,
- 21:27Speaker 1: Tammy Daybell was none of that. 12.51 p.m. Hannah attended
- 21:33Speaker 1: Tammy's funeral and viewing. She went through the viewing line
- 21:36Speaker 1: twice with different people. Chad was first in the viewing line.
- 21:40Speaker 1: Tammy and Chad's children were also in the viewing line.
- 21:43Speaker 1: Hannah and her dad had a conversation with Chad. She
- 21:46Speaker 1: says Chad said Tammy had been sick that day and
- 21:50Speaker 1: that she had been vomiting and coughing, and around 10 p.m.
- 21:54Speaker 1: she threw up again. Chad said Tammy then went to bed,
- 21:57Speaker 1: but Chad stayed in his office working, and around 1 a.m.
- 22:01Speaker 1: he went upstairs and found Tammy on the floor, and
- 22:04Speaker 1: she had rolled out of the bed. Chad said he
- 22:07Speaker 1: found her cold, And as Hannah testifies, Chad smiles. I
- 22:11Speaker 1: don't know what you're smiling about, you stew nod. You're
- 22:13Speaker 1: not going to have much to smile about soon, I'll
- 22:15Speaker 1: tell you that much. Unless, of course, smiling about bologna
- 22:18Speaker 1: sandwiches and the rest of your life behind bars is
- 22:22Speaker 1: something you're into. Because that is what your fate holds
- 22:25Speaker 1: for you, pal. A whole bunch of sitting behind bars.
- 22:29Speaker 1: And hopefully, when all is said and done, you get
- 22:31Speaker 1: the death penalty. But if not, well, it's bologna sandwiches
- 22:35Speaker 1: and concrete walls. 12.55. Hannah says Chad appeared calmer than
- 22:41Speaker 1: she would have expected. He would only get emotional when
- 22:43Speaker 1: Hannah's dad got emotional and then would stop when her
- 22:46Speaker 1: dad stopped crying. It stood out to me because I
- 22:49Speaker 1: would have expected someone who just lost their partner to
- 22:52Speaker 1: be a little more distraught. And yeah, you would think, right?
- 22:55Speaker 1: You lose your wife, your lover, somebody you've been with
- 22:59Speaker 1: for all these years, you have kids with. I would
- 23:01Speaker 1: be inconsolable. Never mind talking about going to Hawaii to
- 23:06Speaker 1: have a little walk on the beach with a skafooza.
- 23:09Speaker 1: But that's what Chad Daybell was up to. That's where
- 23:12Speaker 1: his mind went. Because guess what? That was the motivation, right?
- 23:17Speaker 1: That was the endgame. Let's get rid of these kids.
- 23:21Speaker 1: Let's get rid of Tammy. And let's make sure that
- 23:24Speaker 1: we can be together. Oh, don't forget, we gotta get
- 23:27Speaker 1: rid of Charles Vallow, too. We can't have Ned Schneider
- 23:30Speaker 1: running around, can we? And this is the absurdity that
- 23:34Speaker 1: these people were pitching within their little group. And they
- 23:37Speaker 1: could say whatever they want, but all of those people,
- 23:40Speaker 1: from Mr. Warwick to Melanie Gibb to the rest of them,
- 23:43Speaker 1: they were all sucking it up. 12.55 p.m. Around two
- 23:47Speaker 1: hours later, Hannah went through the funeral line with her mother.
- 23:50Speaker 1: She says Chad told them what happened. Tammy had been
- 23:53Speaker 1: coughing violently, and he was worried about her. Between 9
- 23:57Speaker 1: and 10 p.m., she came down to his office and
- 23:59Speaker 1: said she was going to bed. Chad said he was
- 24:02Speaker 1: worried about her and went to bed with her but
- 24:05Speaker 1: around midnight. Tammy rolled out of bed. Hannah was confused
- 24:09Speaker 1: because the stories were inconsistent. Well, that's what happens when
- 24:12Speaker 1: you're telling a bunch of bullshit lies. It's going to
- 24:15Speaker 1: be inconsistent, right? But the best liars know you sprinkle
- 24:18Speaker 1: a little bit of truth in with that and it
- 24:21Speaker 1: makes the lie go a lot further. 12.57 p.m. Hannah
- 24:25Speaker 1: didn't ask any questions to Chad but felt confused and uncomfortable.
- 24:29Speaker 1: That night, Hannah spoke to her mom about the inconsistencies
- 24:33Speaker 1: and then later mentioned it to Samantha Gwilliam, Tammy's sister.
- 24:37Speaker 1: Rocky Wixom has no further questions. For Hannah, Pryor will
- 24:40Speaker 1: now cross-examine. 12.58 p.m. Pryor asks if Hannah ever gave
- 24:45Speaker 1: a report to law enforcement. She said she did in
- 24:48Speaker 1: August of 2020. She has met with investigators twice. 1 p.m.
- 24:53Speaker 1: Pryor asks Hannah if she's aware the home is one story.
- 24:57Speaker 1: Hannah says she has never been to the house. Wixom
- 25:00Speaker 1: has one follow-up question. Wixom asks Hannah if she or
- 25:04Speaker 1: her dad asked Chad any questions about the layout of
- 25:08Speaker 1: the home. Hannah says no. There is no doubt in
- 25:11Speaker 1: her mind that Chad talks about going downstairs. 1.03 p.m.
- 25:16Speaker 1: The next witness is Patricia Lader. She is Tammy's first cousin.
- 25:20Speaker 1: Wixom asks if they had a strong relationship when they
- 25:23Speaker 1: were younger, and Patricia starts to cry. She says they
- 25:27Speaker 1: are seven months apart, and they were like sisters. They
- 25:29Speaker 1: grew up together. 1.05 p.m. Patricia would spend weeks during
- 25:34Speaker 1: the summer with Tammy and they wrote letters back and forth.
- 25:38Speaker 1: Tammy and Patricia were best friends and drove to school
- 25:40Speaker 1: together every day. Tammy encouraged Patricia to join the school
- 25:45Speaker 1: band and take classes with her. 1.07 p.m. Patricia taught
- 25:49Speaker 1: school and so did Tammy. Tammy would leave little notes
- 25:52Speaker 1: for her in the classroom. I still have one, Patricia
- 25:55Speaker 1: says through tears. And there's been a lot of focus
- 25:58Speaker 1: on the kids, and rightly so. But we can't forget
- 26:01Speaker 1: that Tammy was murdered, or at least allegedly murdered. And,
- 26:05Speaker 1: of course, Charles Vallow, too. So we're talking about four
- 26:09Speaker 1: people who were murdered by Lori Vallow and Chad Daybell,
- 26:13Speaker 1: according to the state. So we're talking about some straight-up
- 26:16Speaker 1: serial killers here, right? But I think that Tammy Daybell's
- 26:19Speaker 1: death sometimes gets lost in the sauce a bit, considering
- 26:23Speaker 1: we have children who were murdered. 109 p.m. Wixom asks
- 26:26Speaker 1: how often Patricia spoke with Tammy after the Daybells moved
- 26:30Speaker 1: to Idaho. At first, they spoke every few weeks, and
- 26:33Speaker 1: then it went down to a month. 1.10 p.m. Wixom
- 26:37Speaker 1: asks about October 19, 2019, the day Tammy died. Patricia
- 26:42Speaker 1: says her mom called her and was crying hysterically. She
- 26:46Speaker 1: told Patricia that Tammy passed. It didn't register, who she
- 26:50Speaker 1: said because it didn't make sense that my cousin Tammy
- 26:52Speaker 1: had passed. Patricia says it didn't make sense. 1.11 p.m.
- 26:57Speaker 1: Patricia says it was confusing because Tammy was so young
- 27:00Speaker 1: and healthy. She went to the viewing on the Monday
- 27:03Speaker 1: following the death and the viewing before the funeral the
- 27:06Speaker 1: next day. On Monday, Patricia went alone to the viewing.
- 27:10Speaker 1: When she walked in, she said she was really upset.
- 27:13Speaker 1: She and Hannah went through the viewing line. 1.13 p.m.
- 27:17Speaker 1: Patricia says when she was going through the line, she
- 27:20Speaker 1: noticed Chad talking with people. When someone would cry, he
- 27:24Speaker 1: would cry. but he was mostly just visiting. I felt
- 27:27Speaker 1: like he should have been more sad, Patricia says. And look,
- 27:30Speaker 1: I get that. As a family member of someone who
- 27:33Speaker 1: was allegedly murdered, you're going to look back and you're
- 27:35Speaker 1: going to have a whole lot of hindsight. But we
- 27:38Speaker 1: can't really judge somebody on how they were acting in
- 27:42Speaker 1: the aftermath of the death of their wife, right? Everybody
- 27:45Speaker 1: is different. So for me, I prefer to focus on
- 27:48Speaker 1: the bullshit he was up to, you know, like running
- 27:51Speaker 1: away with Lori Vallow and murdering kids. 1.14 p.m. Patricia
- 27:57Speaker 1: and Hannah, her daughter, went to talk with Chad. Patricia
- 28:00Speaker 1: said she was sorry for his loss and they hugged.
- 28:03Speaker 1: She asked him what happened. He said that Tammy wasn't
- 28:05Speaker 1: feeling well and she was coughing a lot. He asked
- 28:08Speaker 1: if she was okay and she threw up. She said
- 28:12Speaker 1: she was going to bed and he asked her if
- 28:14Speaker 1: she was okay and she said yes. She was feeling
- 28:16Speaker 1: better after she threw up and then she went to bed.
- 28:20Speaker 1: Patricia recalls Chad telling her. Chad told Patricia, Tammy loved
- 28:24Speaker 1: you so much. 1.15 p.m. Chad told Patricia that Tammy
- 28:29Speaker 1: went to bed around 10 p.m. and he stayed up working.
- 28:33Speaker 1: He went to bed later and he woke up the
- 28:35Speaker 1: next morning to the sound of Tammy rolling, falling off
- 28:38Speaker 1: the bed. He told Patricia that Tammy was half on,
- 28:42Speaker 1: half off the bed. 1.16 p.m. Patricia went to the
- 28:46Speaker 1: funeral the next day. There was a couple of things
- 28:48Speaker 1: he said that I thought weren't very nice, she says,
- 28:51Speaker 1: referring to Chad. The first thing he said was she
- 28:55Speaker 1: wasn't easy to live with. She was lazy and she
- 28:58Speaker 1: had depression, which she did, but to say it out
- 29:00Speaker 1: in front of the whole congregation was embarrassing for her. Well, yeah,
- 29:04Speaker 1: why are you going to talk trash about your wife
- 29:06Speaker 1: who just died? Just keep all of that stuff stowed
- 29:09Speaker 1: and keep it moving, stupid. 1.17 p.m. Patricia says after
- 29:14Speaker 1: Emma told the story about Tammy wanting more pets, Patricia
- 29:17Speaker 1: looked at Chad and he looked a little concerned but
- 29:20Speaker 1: then laughed. Garth told a story about Tammy playing video games,
- 29:25Speaker 1: and she would be the lookout for when Chad got home.
- 29:28Speaker 1: Chad looked concerned for a split second, but then started
- 29:31Speaker 1: to laugh, Patricia says. 1.19 p.m. Patricia says she felt
- 29:35Speaker 1: Tammy had to hide what she was doing so she
- 29:38Speaker 1: wouldn't get in trouble with Chad. When Patricia and Tammy
- 29:41Speaker 1: both lived in Springville from 1995 to 2015, Patricia would
- 29:46Speaker 1: visit Tammy at least once a month. 1.21 p.m. Patricia
- 29:51Speaker 1: would stop by for a quick visit but would end
- 29:54Speaker 1: up staying for hours. They'd chat about their kids and life.
- 29:58Speaker 1: Chad would eventually get home and sit down to chat
- 30:00Speaker 1: with him, but she was always getting a feeling that
- 30:03Speaker 1: she needed to go home when Chad showed up. 121
- 30:07Speaker 1: PM Wixom has no further questions. Pryor will now cross-examine.
- 30:12Speaker 1: He asked Patricia if it would surprise her to learn
- 30:15Speaker 1: that in the last year of Tammy's life, phone records
- 30:18Speaker 1: show there was no communication between Patricia and Tammy. Patricia
- 30:22Speaker 1: says that's not correct. They would message on Facebook and text.
- 30:27Speaker 1: Patricia says Tammy would call her. So what Pryor's saying is, look,
- 30:31Speaker 1: you haven't even been friends with her basically for the
- 30:33Speaker 1: last year of her life, so how do you know
- 30:36Speaker 1: what was going on with her? 1.23 p.m. Pryor asks
- 30:40Speaker 1: if Patricia recalls any discussion at the viewing about Tammy
- 30:43Speaker 1: or Chad going upstairs or downstairs in the house. Patricia
- 30:47Speaker 1: doesn't recall. Pryor has no further questions. The state may
- 30:51Speaker 1: recall Patricia later. She is dismissed for now. 1.25 p.m.
- 30:56Speaker 1: As Patricia left the witness stand, she looked over at Chad.
- 31:00Speaker 1: He was focused on his laptop and did not look
- 31:02Speaker 1: up at her. 1.27 p.m. Defense and prosecution, having a
- 31:06Speaker 1: sidebar with Boyce, wanted to point out that while the
- 31:09Speaker 1: Daybell home may not technically be two stories, there are
- 31:13Speaker 1: stairs up to a second-story loft above the garage. 1.30 p.m.
- 31:17Speaker 1: Blake says their next witness will not be here until Wednesday.
- 31:21Speaker 1: She requests that court dismiss for the day and reconvene
- 31:24Speaker 1: on Wednesday. Boyce says it's complicated and complex to schedule
- 31:28Speaker 1: for a trial of this length. He says they will
- 31:31Speaker 1: break early for the day. Alright, so there it is,
- 31:33Speaker 1: day number 13 at the Chad Daybell trial. And like
- 31:37Speaker 1: I said in the opening, nothing has changed in my
- 31:39Speaker 1: opinion for Chad Daybell. Dude still looks as guilty as
- 31:43Speaker 1: the day is long, and I think the evidence is
- 31:46Speaker 1: proving that. Now we still have a little bit ways
- 31:48Speaker 1: to go, and things can always pop up, but if
- 31:51Speaker 1: things keep on the course that they're on now... It's
- 31:54Speaker 1: a wrap for Chad Daybell, and we'll be here the
- 31:57Speaker 1: whole entire time covering it every step of the way.
- 31:59Speaker 1: All right, folks, that's going to do it for this one.
- 32:02Speaker 1: All of the information that goes with this episode can
- 32:05Speaker 1: be found in the description box. What's up, everyone, and
- 32:09Speaker 1: welcome back to the program. In this episode, we're getting
- 32:12Speaker 1: right back to the Chad Daybell trial as we recap
- 32:15Speaker 1: what went down on day number 14 of testimony. And
- 32:19Speaker 1: to help guide us, once again, we'll be using eastidahonews.com.
- 32:23Speaker 1: And the author of this article is Nate Eaton. 828 AM.
- 32:28Speaker 1: Back at the courthouse for day 14 of Chad Daybell's trial.
- 32:31Speaker 1: We are waiting to get into the courtroom. Matt Daybell,
- 32:34Speaker 1: Chad's brother, is here, chatting with Larry and Kay Woodcock.
- 32:38Speaker 1: He is not here to support his brother and will
- 32:40Speaker 1: be sitting with Woodcocks. Matt has not seen Chad since
- 32:44Speaker 1: Tammy's memorial service. Sounds like someone with good sense to me.
- 32:48Speaker 1: I don't know why you would support Chad Daybell, considering
- 32:51Speaker 1: the evidence that's been presented. I mean, if we were
- 32:54Speaker 1: talking about something that was in dispute, right? Something where
- 32:58Speaker 1: you could look at what went down and say, you
- 33:00Speaker 1: know what? I don't know if Chad Daybell was involved
- 33:03Speaker 1: in all of this. But I don't think anyone who's
- 33:05Speaker 1: looking at this reasonably can come to that conclusion. 8.32 a.m.
- 33:10Speaker 1: We are now in the courtroom. When Matt walked in,
- 33:13Speaker 1: Chad said to John Pryor, that's my brother. Matt is
- 33:16Speaker 1: seated between Kay Woodcock and Vicky Hoban, Tammy Daybell's aunt. 8.33 a.m.
- 33:22Speaker 1: Madison County Prosecutor Rob Wood, Fremont County Prosecutor Lindsay Blake,
- 33:26Speaker 1: Fremont County Deputy Prosecutor Rocky Wixom, and Special Prosecutor Ingrid
- 33:31Speaker 1: Beatty are at the state's table. Chad Daybell is wearing
- 33:34Speaker 1: a checkered dress shirt with a dark tie. Around 30
- 33:37Speaker 1: to 40 people are in the courtroom gallery. 8.41 a.m.
- 33:42Speaker 1: All attorneys have left the courtroom and are back meeting
- 33:45Speaker 1: with Judge Stephen Boyce in his chambers. 8.44 a.m. Boyce
- 33:49Speaker 1: is on the bench. Jurors are being brought in. 8.46 a.m.
- 33:53Speaker 1: Lindsay Blake will question the first witness, Dr. Eric Christensen. 8.47 a.m.
- 33:59Speaker 1: Christensen was the chief medical examiner for the state of
- 34:02Speaker 1: Utah before retiring. 8.51 a.m. Christensen says he has undergone
- 34:07Speaker 1: training in autopsies and forensic autopsies. Blake asks who determines
- 34:11Speaker 1: cause and manner of death in Utah. Christensen says 80%
- 34:15Speaker 1: of death certificates in Utah are assigned by physicians. The
- 34:19Speaker 1: other 20% fall under jurisdiction of medical examiners. 8.53 a.m.
- 34:25Speaker 1: There is not a lot of national uniformity to death
- 34:28Speaker 1: investigation systems, Christensen said. Historically, most states have had elected
- 34:32Speaker 1: county coroners. Over time, things have changed. In Utah, it
- 34:36Speaker 1: is entirely a medical examiner system and there are no coroners. 8.54 a.m.
- 34:43Speaker 1: As a medical examiner, you need a medical degree and
- 34:46Speaker 1: go through specialty training. They perform autopsies. Coroners do not
- 34:50Speaker 1: perform autopsies but can request them from the medical examiners.
- 34:55Speaker 1: The medical examiner will then determine if one needs to
- 34:58Speaker 1: be done. A 56 a.m. Christensen has performed around 7,200
- 35:03Speaker 1: to 7,300 autopsies over the course of his career. He
- 35:07Speaker 1: performed the autopsy on Tammy Daybell. Christensen's office was contacted
- 35:12Speaker 1: in November of 2019 by someone in Fremont County. An
- 35:16Speaker 1: order was then received by the court to exhume Tammy's body. 8.57 a.m.
- 35:22Speaker 1: Christensen was present when Tammy's body was exhumed and transported
- 35:26Speaker 1: to the medical examiner's office. Someone from his office always
- 35:29Speaker 1: attends when bodies are exhumed so that they can observe
- 35:32Speaker 1: the condition of the grave. 9 a.m. Blake asked if
- 35:37Speaker 1: there were any concerns about Tammy's exhumation that would affect
- 35:40Speaker 1: the autopsy. Christensen says no. He goes on to explain
- 35:45Speaker 1: that a forensic autopsy is different from a regular hospital-type autopsy.
- 35:49Speaker 1: In a forensic autopsy, they are looking for evidence and
- 35:52Speaker 1: focus on what is present on the outside of the
- 35:54Speaker 1: body before delving into the internal parts. 902 AM Christensen
- 36:00Speaker 1: reviewed information from the coroner's office and sheriff's office before
- 36:03Speaker 1: Tammy's body was exhumed. Blake asks if exhumations are common.
- 36:08Speaker 1: Christensen says no. The first exhumation case he was involved
- 36:11Speaker 1: in was in 1998. 9.05 a.m. Christensen says he conducted
- 36:17Speaker 1: the autopsy with Dr. Lily Marsden, who was a trainee
- 36:21Speaker 1: at the time. Christensen says they discussed their findings as
- 36:24Speaker 1: they did the autopsy and after it was over. 9.06 a.m.
- 36:28Speaker 1: Blake asks how an autopsy is conducted. It begins with
- 36:31Speaker 1: a detailed external examination. The body is photographed and documented
- 36:36Speaker 1: in its original condition. They look for any damage to clothing,
- 36:39Speaker 1: the body, etc. Clothes are then removed and photographed separately.
- 36:44Speaker 1: The body is then photographed, unclothed, before being cleaned. Pictures
- 36:48Speaker 1: are taken again. Fibers and hairs found on the body
- 36:51Speaker 1: are collected. So it's a whole process, right? They go
- 36:54Speaker 1: through the whole entire thing, and they're checking the whole
- 36:57Speaker 1: body for any signs of trauma, any signs of, you know, injury,
- 37:03Speaker 1: or anything else that might lead them to believe that
- 37:05Speaker 1: this was not a natural death. 9.08 a.m. The body
- 37:09Speaker 1: is then opened up, and everything is examined. the brain,
- 37:12Speaker 1: internal organs, the rectum, the spine, the neck, etc. X-rays
- 37:17Speaker 1: are also performed in many cases to evaluate the presence
- 37:20Speaker 1: or absence of skeletal trauma. 9-10 a.m. Christensen says it's
- 37:25Speaker 1: hard to tell the age of many blunt injuries or bruises.
- 37:29Speaker 1: The colors don't tell you the age of the bruise
- 37:32Speaker 1: until you start seeing yellow, green, or brown. It's harder
- 37:35Speaker 1: to tell the age of a red, blue, or purple bruise.
- 37:38Speaker 1: 9-11 a.m. Blake asks the cause of death. Christensen says asphyxia.
- 37:45Speaker 1: Matter of death, homicide. To the medical examiner, homicide means
- 37:49Speaker 1: another person was involved in the victim's death. Asphyxia means
- 37:53Speaker 1: the person was unable to get enough oxygen. 9.13 a.m.
- 37:57Speaker 1: Asphyxia can result from anything that blocks the airway. Smothering, choking, drowning, chemicals,
- 38:02Speaker 1: carbon monoxide, cyanide. And they don't know, right, how this
- 38:07Speaker 1: all went down. Was Tammy given something? How did she
- 38:11Speaker 1: end up getting sick like this and just dying? We
- 38:14Speaker 1: know it wasn't natural causes. So what was the root
- 38:17Speaker 1: cause of her being ill? Was she being poisoned over
- 38:20Speaker 1: a period of time? Or maybe she was given something
- 38:23Speaker 1: that acted quickly. But either way, something went down, at
- 38:27Speaker 1: least according to the official narrative. 9.14 a.m. Christensen says
- 38:32Speaker 1: he saw no external injuries or traumatic event that could
- 38:35Speaker 1: have been the cause of Tammy's death. Tammy's heart, lungs, liver,
- 38:38Speaker 1: kidneys were normal. There were no pathological explanations for her death.
- 38:42Speaker 1: There was some bruising on her arms and one bruise
- 38:45Speaker 1: on her chest. 9.16am. Blake asks what a negative autopsy is.
- 38:51Speaker 1: He says it means there are no findings that explain
- 38:53Speaker 1: the death. Basically, a person with normal anatomy has died.
- 38:57Speaker 1: Not exactly what I would call a common occurrence, right?
- 39:00Speaker 1: People who aren't ill don't just drop dead. There has
- 39:03Speaker 1: to be a root cause for why you drop dead,
- 39:05Speaker 1: for why you're sick. And according to everything we know
- 39:09Speaker 1: about Tammy, there was no issue. And I think that
- 39:12Speaker 1: fact is slammed home by the autopsy results and the
- 39:15Speaker 1: fact that all of her organs were in good shape.
- 39:18Speaker 1: And there was no issues with anything going on with
- 39:20Speaker 1: her internally. So there has to be an explanation for
- 39:24Speaker 1: why she died. And that explanation is Chad Daybell killed her.
- 39:28Speaker 1: At least according to the prosecutors. 9.19 a.m. Blake asks
- 39:33Speaker 1: what a seizure is. Christensen says they are abnormal electrical
- 39:36Speaker 1: charges in the brain that result in abnormal external behavior.
- 39:40Speaker 1: He has conducted autopsies on people who have had seizures.
- 39:44Speaker 1: Usually there is trauma to the person's tongue and evidence
- 39:47Speaker 1: of incontinence. 9.20 a.m. Christensen says there was no signs
- 39:52Speaker 1: of seizure activity during Tammy's autopsy. Christensen reviewed her medical records.
- 39:57Speaker 1: No mention of seizures. Christensen said it would be very
- 40:01Speaker 1: uncommon for someone of Tammy's age to start developing seizures. Yeah,
- 40:05Speaker 1: unless you have some kind of issue, right? You're not
- 40:07Speaker 1: just going to wake up one day and have seizures.
- 40:09Speaker 1: There's an underlying cause. So if there's no underlying cause here, Well,
- 40:15Speaker 1: we have to assume that Chad Daybell is pitching us
- 40:18Speaker 1: more BS, or maybe she was having seizures because you
- 40:21Speaker 1: were poisoning her over a long period of time. How
- 40:24Speaker 1: about that, Chad Daybell? The world's biggest do-nod. 9.21 a.m.
- 40:29Speaker 1: Christensen found nothing in Tammy's health history that would support
- 40:32Speaker 1: her having seizures. Blake asks about heart arrhythmia. He says
- 40:37Speaker 1: there was nothing in Tammy's heart that showed irregularities, and
- 40:40Speaker 1: normally heart arrhythmia would not exhibit itself in someone who
- 40:45Speaker 1: is 49. 9.25 a.m. Blake asks about intoxicants. Christensen says
- 40:50Speaker 1: tissue testing samples was done to look for intoxicants. The
- 40:54Speaker 1: liver provides the best specimen. Samples were taken on Tammy's
- 40:58Speaker 1: liver and sent to the lab to see if there
- 41:00Speaker 1: were pesticides, heavy metals, drugs, biologic toxins, etc. Nothing was found.
- 41:07Speaker 1: So who the hell knows what's going on here and
- 41:09Speaker 1: who knows what was introduced to Tammy's life to make
- 41:12Speaker 1: her sick. But the fact is, something made her sick,
- 41:15Speaker 1: and it wasn't natural causes. 9.28 a.m. Christensen says extensive
- 41:20Speaker 1: toxicology testing was done on Tammy's body because of the
- 41:23Speaker 1: circumstances surrounding her death. The fact that Tammy had been
- 41:27Speaker 1: embalmed didn't inhibit the ability to do the toxicology test,
- 41:32Speaker 1: which is crazy to think about. They had a whole
- 41:34Speaker 1: ass body embalmed already, buried, and they're able to exhume
- 41:39Speaker 1: that body and still... do an autopsy on it, and
- 41:42Speaker 1: get information from that body. It's truly amazing how far
- 41:45Speaker 1: technology has come. 9.30 a.m. Fluoxetine was found in Tammy's system,
- 41:52Speaker 1: but at a non-toxic level. There was also selenium at
- 41:56Speaker 1: a non-toxic level. 9.31 a.m. Blake asked to publish an exhibit.
- 42:00Speaker 1: Boyce asked for a sidebar. 9.34 a.m. It appears they
- 42:05Speaker 1: are going to show graphic images to the jury. The
- 42:08Speaker 1: people sitting on the right side of the courtroom... are
- 42:10Speaker 1: being asked to move. The jurors have monitors in front
- 42:13Speaker 1: of them, and some people on the right side may
- 42:16Speaker 1: be able to get a glimpse at the images. 9.36am.
- 42:20Speaker 1: Chad has repeatedly looked over at his brother Matt during
- 42:23Speaker 1: the past few minutes. Boyce is back on the bench.
- 42:26Speaker 1: Apparently there are problems with the jurors' monitors. We are
- 42:29Speaker 1: taking a morning break to get them fixed. Alright, so
- 42:32Speaker 1: like usual, this is where we're going to break as well,
- 42:34Speaker 1: and in the next episode we'll pick up with the
- 42:37Speaker 1: rest of the morning testimony of day number 14 at
- 42:40Speaker 1: the Chad Daybell trial. All the information that goes with
- 42:44Speaker 1: this episode can be found in the description box. What's
- 42:48Speaker 1: up everyone and welcome back to the program. In this episode,
- 42:52Speaker 1: we're diving right back into the Chad Daybell trial and
- 42:55Speaker 1: we're going to pick up where we left off on
- 42:57Speaker 1: day number 14. 10.01 a.m. We are in the courtroom.
- 43:03Speaker 1: Boyce is on the bench. Matt Daybell is back in
- 43:06Speaker 1: the courtroom, sitting in a different spot with a clearer
- 43:08Speaker 1: view of his big brother about 10 feet in front
- 43:11Speaker 1: of him. 10.05 a.m. A photo is displayed showing foam
- 43:15Speaker 1: coming out of Tammy's mouth. We cannot see the photograph,
- 43:18Speaker 1: but the jurors can. So can Chad, prosecutors, and the judge.
- 43:23Speaker 1: So all the folks who need to see the picture
- 43:24Speaker 1: can see it. As far as the public goes, probably
- 43:27Speaker 1: a good idea, right? We don't need to see all
- 43:30Speaker 1: of that. 10.06 a.m. The foam's a sign of pulmonary edema,
- 43:34Speaker 1: according to Christensen. 10.07 a.m. Christensen says if he had
- 43:38Speaker 1: responded to the scene, he would have done an autopsy.
- 43:41Speaker 1: Tammy was young, and there was no medical explanation as
- 43:44Speaker 1: to why she died. Yeah, that would seem like the
- 43:47Speaker 1: logical step, right? Somebody dies young, no medical reasoning behind it. Yeah,
- 43:53Speaker 1: let's get an autopsy done and see what's wrong here.
- 43:55Speaker 1: Let's make sure that the kids aren't in jeopardy of
- 43:58Speaker 1: inheriting something that's congenial. But no, let's just bury Tammy
- 44:03Speaker 1: and forget about it and act like the whole thing
- 44:05Speaker 1: didn't happen. I don't have time for an autopsy. I
- 44:08Speaker 1: have to go to the beach. I have to meet Scafusa.
- 44:10Speaker 1: It's basically what Chad Daybell said. 10.08am. Tammy's lungs were
- 44:16Speaker 1: a little on the heavy side, according to Christensen. There
- 44:19Speaker 1: was some fluid in them. Nothing else was abnormal. 10.09am.
- 44:24Speaker 1: Pulmonary edema itself is not a cause of death. Lots
- 44:27Speaker 1: of things can result in pulmonary edema, including asphyxiation. 10.10 a.m.
- 44:33Speaker 1: Blake asks for Christensen to be handed a diagram of
- 44:35Speaker 1: Tammy's body. She asks him to mark where the bruises
- 44:38Speaker 1: were on the body. The exhibit is now taken to
- 44:41Speaker 1: Pryor for him to see those markings. Chad leans over
- 44:45Speaker 1: to look at the diagram. And on that diagram, you
- 44:48Speaker 1: see that there are markings on Tammy's right arm, front
- 44:51Speaker 1: and back, one bruise on her left arm, and a
- 44:54Speaker 1: bruise above her left breast. 10.16 a.m. There were no
- 44:59Speaker 1: bruises on the lower part of Tammy's body or her head.
- 45:02Speaker 1: 1018 a.m. Photos were taken during the autopsy to document
- 45:06Speaker 1: the injuries. Blake moves to admit the series of pictures.
- 45:10Speaker 1: 1020 a.m. Blake says the photos are graphic. We will
- 45:14Speaker 1: not see them in the courtroom or on the live stream.
- 45:16Speaker 1: The jurors will see them on their monitors. 1021 a.m.
- 45:21Speaker 1: Christensen describes the first photo, the bruise on Tammy's left chest.
- 45:25Speaker 1: The next image is a close-up of the bruise That
- 45:27Speaker 1: shows the hemorrhage in the tissue. The next picture shows
- 45:30Speaker 1: tissue that was removed. They looked at the tissue under
- 45:33Speaker 1: a microscope that showed the hemorrhage. And that's what they'll
- 45:37Speaker 1: do a lot of times forensically. They'll take a sample
- 45:40Speaker 1: from the tissue, the skin, and then they'll run their
- 45:43Speaker 1: tests on that sample and hope it leads them to
- 45:46Speaker 1: a clue as to how the person died. 10.24 a.m.
- 45:50Speaker 1: The next image shows the bruise on the left bicep.
- 45:53Speaker 1: There was a hemorrhage in the bruise. The following photo
- 45:56Speaker 1: shows two bruises on the back of Tammy's right upper arm.
- 45:59Speaker 1: The next image is three bruises on the right bicep
- 46:02Speaker 1: and two on the right forearm. 10.25 a.m. Many jurors
- 46:07Speaker 1: looking closely at their screens as more photos of the
- 46:10Speaker 1: injuries are shown. Christensen explains what dark coloration means on
- 46:14Speaker 1: the bruises. So this is where the battle of the
- 46:17Speaker 1: experts is taking place, right? And this is what these
- 46:20Speaker 1: trials always come down to. You have an expert that
- 46:24Speaker 1: gets up there. and explains what this, this, this, and
- 46:27Speaker 1: this means to the jury. And then the defense, if
- 46:30Speaker 1: they can, they're going to have their own expert get
- 46:32Speaker 1: up there and pitch a different narrative. And then when
- 46:35Speaker 1: all is said and done, the jury will make their
- 46:37Speaker 1: decision on all of the evidence that's been presented. 10.27 a.m.
- 46:42Speaker 1: Chad and Pryor are looking closely at the images on
- 46:44Speaker 1: the screen in front of them. 10.29 a.m. Blake displays
- 46:48Speaker 1: more images of the bruises for the jurors. Christensen describes
- 46:51Speaker 1: the different aspects of each photo. 10.29 a.m. Blake asks
- 46:55Speaker 1: when the bruises would have occurred. He says they all
- 46:59Speaker 1: showed evidence of hemorrhage in the tissue without any inflammation,
- 47:03Speaker 1: so they would have occurred sometime from minutes to hours
- 47:06Speaker 1: prior to Tammy's death. 10.31 a.m. Christensen says the bruises
- 47:11Speaker 1: should be consistent with someone being restrained. Blake asks if
- 47:14Speaker 1: Christensen noticed any signs of lividity. He says yes. Lividity
- 47:18Speaker 1: is pooling of the blood to the part closest to
- 47:20Speaker 1: the ground. 10.33 a.m. All of the lividity was on
- 47:25Speaker 1: Tammy's back, Christensen says. Blake asks about rigor mortis, stiffening
- 47:30Speaker 1: of the joints and muscles a few hours after death.
- 47:33Speaker 1: The body becomes solid and very difficult to move. Once
- 47:37Speaker 1: it's fully developed, around 12 hours, it will stay that
- 47:39Speaker 1: way until the body starts to decompose. 10.36 a.m. Rigor
- 47:44Speaker 1: mortis can help determine time of death, but it's imprecise,
- 47:47Speaker 1: Christensen says. As a forensic pathologist, he generally does not
- 47:51Speaker 1: determine a time of death. Christensen recalls Tammy was reported
- 47:55Speaker 1: dead before 6 a.m. She was described as being cold
- 47:59Speaker 1: and stiff. Based on that description, it would indicate to
- 48:02Speaker 1: Christensen that rigor mortis would have set in. 10.41 a.m.
- 48:07Speaker 1: Blake asks Christensen if it's likely Tammy died of a seizure.
- 48:10Speaker 1: He says no. Likely she died of arrhythmia? No. Intoxicant? No.
- 48:15Speaker 1: Christensen reaffirms cause of death was asphyxia. Blake has no
- 48:20Speaker 1: further questions. Pryor will now cross-examine. 10.43 a.m. Pryor asks
- 48:25Speaker 1: about the initial cause of death for Tammy Daybell. It
- 48:28Speaker 1: was pulmonary edema. Christensen says pulmonary edema was present, but
- 48:32Speaker 1: not the cause of death. 10.44 a.m. Christensen says the
- 48:38Speaker 1: reason Tammy was exhumed was to determine the cause of death.
- 48:41Speaker 1: Pryor pushes him for the exact reason that was given
- 48:44Speaker 1: in the court hearing. Christensen doesn't recall the exact reason. 10.47 a.m.
- 48:49Speaker 1: Pryor asks if there was a discussion about Charles Vallow
- 48:52Speaker 1: or Brandon Boudreau at the exhumation hearing. Christensen doesn't recall. 10.48 a.m.
- 48:58Speaker 1: Pryor asks about the order that was obtained to exhume
- 49:01Speaker 1: Tammy's body. Blake has objected over 10 times to Pryor's
- 49:04Speaker 1: questioning over the past few minutes as questions being asked
- 49:08Speaker 1: and answered. Boyce has sustained most of the objections. 10.50 a.m.
- 49:13Speaker 1: Pryor asks Christensen if he can determine the cause of
- 49:16Speaker 1: bruises on someone's body. Christensen says he cannot. but he
- 49:20Speaker 1: can offer opinions on how they might have been inflicted
- 49:23Speaker 1: upon the person. 10.51 a.m. Pryor asked Christensen if he
- 49:28Speaker 1: spoke to any of the immediate family members about the bruises.
- 49:31Speaker 1: He did not. Christensen says he did not talk to
- 49:34Speaker 1: any family members about what she used to treat the bruises.
- 49:37Speaker 1: He says there were ointments and other creams photographed at
- 49:40Speaker 1: the house that Tammy used to treat bruises. 10.52 a.m.
- 49:45Speaker 1: Pryor tries to ask repeatedly why Tammy Daybell was dug
- 49:49Speaker 1: out of the ground. Blake objects each time, saying the
- 49:52Speaker 1: question has been asked and answered. Boyce grants the objections. 10.54 a.m.
- 49:58Speaker 1: Pryor shows the bruise diagram on the screen. He asks
- 50:01Speaker 1: Christensen how many bruises were on Tammy's right arm. Eight.
- 50:04Speaker 1: Four on the front, four on the back. On the
- 50:07Speaker 1: left arm, there is one bruise. On the chest, there
- 50:10Speaker 1: is one bruise. 10.56 a.m. Pryor asks if Christensen is
- 50:14Speaker 1: suggesting someone stop Tammy from breathing. He says yes. Pryor
- 50:18Speaker 1: asks if someone was holding her arms down, how did
- 50:21Speaker 1: bruises get on the front of her arm and on
- 50:23Speaker 1: the back of her right arm? Christensen says you can
- 50:26Speaker 1: have bruises from a grab. 10.57 a.m. Pryor asks if
- 50:30Speaker 1: Christensen is firm on the idea that the death is
- 50:33Speaker 1: from asphyxiation. He says yes. 10.58 a.m. Pryor asked Christensen
- 50:39Speaker 1: to list the five options for manner of death, natural, accident, suicide, homicide,
- 50:44Speaker 1: or undetermined. Pryor asked Christensen about undetermined. He says it's
- 50:49Speaker 1: used when you don't have enough information to decide between
- 50:52Speaker 1: two different manners of death. 11 a.m. Pryor says in
- 50:57Speaker 1: this situation, if there was insufficient evidence to determine a
- 51:00Speaker 1: cause of death, it would be listed as undetermined. Christensen
- 51:04Speaker 1: says yes. It doesn't necessarily mean there isn't foul play involved. No,
- 51:08Speaker 1: it just means at that point, they're not really sure
- 51:11Speaker 1: what went down. And later on, when they continue their investigation,
- 51:15Speaker 1: if they exhume the body or they go over, you know,
- 51:18Speaker 1: autopsy results, things might change. You can only tell so
- 51:22Speaker 1: much as a medical examiner before you get inside of
- 51:25Speaker 1: a body, right? 11 a.m. Pryor says in this situation,
- 51:30Speaker 1: if there was insufficient evidence to determine a cause of death,
- 51:34Speaker 1: It could be listed as undetermined. Christensen says yes. It
- 51:38Speaker 1: doesn't necessarily mean there isn't foul play involved. 11.01 a.m.
- 51:42Speaker 1: Pryor says there are situations where people pass away and
- 51:45Speaker 1: there is no way to determine how they died. Christensen
- 51:48Speaker 1: says that's correct. He reviewed Tammy's medical records from Rexburg
- 51:52Speaker 1: in Utah. There were not a lot of records. Now look,
- 51:56Speaker 1: if Tammy would have just passed away and there was
- 51:58Speaker 1: none of these other circumstances surrounding what went down, then
- 52:01Speaker 1: maybe you could get away with it But you have
- 52:04Speaker 1: a whole ass plot here, buddy. Two kids have been killed.
- 52:06Speaker 1: Charles Vallow's been killed. There's a whole thing going on.
- 52:10Speaker 1: And guess what? You're smack dab in the middle of
- 52:13Speaker 1: that conspiracy. 11.03 a.m. Prior asks about Tammy taking fluoxetine,
- 52:19Speaker 1: a form of Prozac. Prior asks if fluoxetine is mixed
- 52:22Speaker 1: with the wrong medicine, if there could be significant consequences.
- 52:26Speaker 1: Christensen says there could be. 11.04 a.m. Prior asks if
- 52:30Speaker 1: the heavy lungs could have had an impact on the
- 52:32Speaker 1: cause of death. Christensen says yes. Pryor asks if that
- 52:36Speaker 1: was taken into account before determining asphyxia. Christensen says absolutely.
- 52:41Speaker 1: And again, trying to cause a little bit of reasonable
- 52:44Speaker 1: doubt here. Trying to give the jury something else to
- 52:46Speaker 1: gnaw on. Is it going to work? No. But that's
- 52:50Speaker 1: what Pryor is attempting to do here. 11.06 a.m. Pryor
- 52:55Speaker 1: asks about seizures. He asks Christensen if he can exclude
- 52:58Speaker 1: the fact that Tammy didn't have a seizure. He says
- 53:01Speaker 1: he can't 100% rule it out. but it's very unlikely. 11.07 a.m.
- 53:06Speaker 1: Pryor says arrhythmia could happen to anyone at any time.
- 53:10Speaker 1: Christensen says that's very unlikely. He says based on Tammy's heart,
- 53:13Speaker 1: it's very unlikely she suffered from arrhythmia. 11.09 a.m. Pryor
- 53:19Speaker 1: is asking if anemia goes undiagnosed for five years and
- 53:23Speaker 1: Tammy isn't getting treatment and there is insufficient oxygen to
- 53:26Speaker 1: reach her heavy lungs, could we get the same results?
- 53:30Speaker 1: Christensen says he doesn't think so. Tammy was active and exercising.
- 53:35Speaker 1: And that's the rub, right? If she's out here doing
- 53:37Speaker 1: all these clog classes and the rest of it, I
- 53:39Speaker 1: have a hard time believing that she's going to just
- 53:42Speaker 1: drop dead. There would have been some issues. Shortness of breath,
- 53:46Speaker 1: you know, coughing up some phlegm, whatever it might be.
- 53:49Speaker 1: People don't just drop dead like this. 1110 AM. Pryor
- 53:53Speaker 1: has no further questions. Blake will now redirect. She asks
- 53:56Speaker 1: about the exhumation order. Christensen says he was not the
- 53:59Speaker 1: one who requested it. Blake asks if any of Chad's
- 54:02Speaker 1: kids ever reached out to the medical examiner's office. He
- 54:06Speaker 1: says not to his knowledge. None of them ever passed
- 54:09Speaker 1: along information to the office either. Seems to me that
- 54:12Speaker 1: the Hills Have Eyes, aka the Daybell children, are way
- 54:16Speaker 1: more concerned about protecting their dad than they are about
- 54:20Speaker 1: finding out what happened to their mom. And if they
- 54:22Speaker 1: were looking for an entrance into the scumbag Olympics, that's
- 54:25Speaker 1: a surefire way to get there. How are you going
- 54:28Speaker 1: to sit here and defend your pops when there's all
- 54:31Speaker 1: this evidence against them? Now, it's one thing to just
- 54:34Speaker 1: sit it out and be silent. It's a whole ass
- 54:37Speaker 1: other thing to show up and support your dad in
- 54:39Speaker 1: the middle of all of this. Yo, my dad's my
- 54:41Speaker 1: best friend. But if there was this much evidence about
- 54:44Speaker 1: my dad killing my mom and this other stuff, forget it.
- 54:47Speaker 1: Zero chance I'm showing up in court to support him.
- 54:51Speaker 1: Zero chance I'm not passing off information if I have
- 54:54Speaker 1: it to the authorities. 11, 12 a.m. Christensen doesn't know
- 54:58Speaker 1: if the kids ever agreed to speak to law enforcement.
- 55:01Speaker 1: Had the kids made statements about Tammy's health, Christensen would
- 55:04Speaker 1: have wanted to review them. 11.14 a.m. Blake asks Christensen
- 55:09Speaker 1: to explain what anemia is. It's a problem of not
- 55:12Speaker 1: having enough healthy red blood cells and can happen for
- 55:15Speaker 1: a variety of reasons. 11.16 a.m. Blake asks if anemia
- 55:20Speaker 1: is treatable. Christensen says yes most times. Tammy started having
- 55:25Speaker 1: anemia five years before her death. Pryor objects and asks
- 55:28Speaker 1: to approach. Boyce overrules the objection and denies a request
- 55:32Speaker 1: to approach. Blake asks if there were any signs in
- 55:34Speaker 1: medical records that Tammy had blood pressure, seizure problems. Christensen
- 55:39Speaker 1: says they did not. He did not find any indication
- 55:43Speaker 1: that Tammy had negative interactions with her drugs and herbal remedies. 11.20 a.m.
- 55:49Speaker 1: Blake asks if it was possible someone restrained Tammy while
- 55:52Speaker 1: someone else suffocated her. Christian says it's possible. Blake asks
- 55:56Speaker 1: Christensen if it's likely Tammy died of a seizure. He
- 55:59Speaker 1: says no. So that whole entire exchange there is very interesting.
- 56:04Speaker 1: Because I've always had questions about what happened to Tammy
- 56:08Speaker 1: and if it was just Chad Daybell who was involved.
- 56:10Speaker 1: Because if I was investigating this, I'd have a lot
- 56:13Speaker 1: of questions for Garth as well. Now to be clear,
- 56:16Speaker 1: I'm not saying Garth was involved in killing his mom.
- 56:19Speaker 1: But when you're investigating something like this, every stone has
- 56:22Speaker 1: to be unturned. Even when the questions are uncomfortable. So
- 56:26Speaker 1: I'm guessing that the investigators probably looked into that too,
- 56:30Speaker 1: but his whole entire reaction, his demeanor, everything about him,
- 56:34Speaker 1: just rings alarm bells for me. 11.21 a.m. Blake is
- 56:39Speaker 1: done questioning and Pryor asks for a sidebar. Boyce grants
- 56:42Speaker 1: the request and attorneys huddle in the corner of the
- 56:44Speaker 1: courtroom while white noise is being played. 11.22 a.m. Boyce
- 56:50Speaker 1: will allow Pryor a brief recross. Pryor asks about the
- 56:54Speaker 1: medical records, one from 2017 and one from 2019. There
- 56:59Speaker 1: were also records from 2015 and 2016 that Christensen also reviewed.
- 57:05Speaker 1: He says he also looked at records from 2014. Pryor
- 57:09Speaker 1: asks about Tammy going into the doctor for a wrist injury.
- 57:12Speaker 1: Testimony is over for Christensen. He remains under subpoena. 11.25 a.m.
- 57:19Speaker 1: Next witness is Alice Gilbert, Chad Daybell's neighbor. 11.27 a.m.
- 57:24Speaker 1: Blake is questioning Gilbert. Gilbert says when they moved into
- 57:27Speaker 1: the neighborhood, they got to know Tammy and Chad through
- 57:30Speaker 1: their Latter-day Saint ward and community. 11.28 a.m. Gilbert moved
- 57:35Speaker 1: into the neighborhood in March of 2017. She got to
- 57:39Speaker 1: know Tammy as they served in the LDS Relief Society
- 57:42Speaker 1: presidency together. They met once a week and on Sundays. 11.30 a.m.
- 57:48Speaker 1: Gilbert says Tammy was great to work with. She was
- 57:51Speaker 1: organized and computer savvy. Tammy had a lot of empathy
- 57:54Speaker 1: for the women in the ward, and she had good wit. 11.31 a.m.
- 57:59Speaker 1: Gilbert observed Chad coming to the church and setting up chairs.
- 58:04Speaker 1: In 2019, she noticed Chad and Tammy's relationship was distant.
- 58:08Speaker 1: Tammy did mention to Gilbert that sometimes the finances were
- 58:11Speaker 1: strained in her marriage. Gilbert never observed Tammy slowing down.
- 58:15Speaker 1: She never complained about health issues. Pretty interesting that the
- 58:18Speaker 1: only people that are claiming that Tammy had all these
- 58:21Speaker 1: health issues are Chad Daybell and his family, huh? Everybody
- 58:25Speaker 1: who saw her out, everybody who's a neutral witness, they
- 58:28Speaker 1: have a different opinion. Tammy seems to be in pretty
- 58:31Speaker 1: good health. 11.33 AM. Gilbert recalls getting a phone call
- 58:36Speaker 1: from Emma Daybell on October 19th. Emma was sobbing. Chad
- 58:40Speaker 1: took the phone and told Gilbert that Tammy had died.
- 58:43Speaker 1: Chad asked Gilbert not to tell anyone for an hour
- 58:45Speaker 1: that Tammy had died. Gilbert said she needed to tell
- 58:48Speaker 1: the bishop. Chad told her not to tell the bishop.
- 58:51Speaker 1: She called the bishop because he was leaving for work.
- 58:54Speaker 1: Gilbert was surprised Tammy had died. They had just spoken
- 58:57Speaker 1: on Wednesday. 11.35 a.m. Gilbert and her husband went over
- 59:03Speaker 1: to the Daybell's home around 8.30 a.m. Chad answered the
- 59:06Speaker 1: door and hugged them. All the kids and their spouses,
- 59:09Speaker 1: except Mark, were sitting in the living room. They were stunned.
- 59:12Speaker 1: They could hardly speak and they were crying. 11.36 a.m.
- 59:17Speaker 1: When Gilbert asked Chad what happened, he said Tammy vomited
- 59:20Speaker 1: at midnight and he thinks she passed away at 2 a.m.
- 59:24Speaker 1: Her legs were hanging over the bed and she had
- 59:26Speaker 1: fallen out of bed. Chad also said he thought she
- 59:29Speaker 1: died of an embolism. Chad didn't seem devastated, Gilbert says.
- 59:36Speaker 1: She says Tammy left a church activity that previous Wednesday
- 59:39Speaker 1: at 8 p.m. to go to a clogging class. Gilbert
- 59:42Speaker 1: says Tammy wasn't coughing that night. When Gilbert arrived, they
- 59:46Speaker 1: asked if the kids had breakfast. They had not. Gilbert
- 59:50Speaker 1: and her husband stood up to go get the kids
- 59:52Speaker 1: some food. Chad told her that the funeral would be Tuesday.
- 59:55Speaker 1: Gilbert was shocked it was so soon. She asked if
- 59:58Speaker 1: Chad had planned that, and he said no. 11.40 a.m.
- 1:00:03Speaker 1: Gilbert knew the preparations and time needed for a funeral
- 1:00:06Speaker 1: and was surprised it was so soon. She was also
- 1:00:09Speaker 1: surprised because the funeral was going to be in Utah.
- 1:00:12Speaker 1: This was Saturday, and the funeral was scheduled for Tuesday.
- 1:00:15Speaker 1: Gilbert felt like the funeral had been planned. 11.41 a.m.
- 1:00:20Speaker 1: Blake asks if Gilbert went to the funeral. She responds, yes,
- 1:00:23Speaker 1: I needed to see her, and breaks down crying. Gilbert
- 1:00:26Speaker 1: says Tammy looked nice in the casket. Gilbert never spoke
- 1:00:30Speaker 1: to Chad about why he held Tammy's funeral in Springville. 11.41 a.m.
- 1:00:36Speaker 1: Gilbert says before the funeral she noticed Chad standing by
- 1:00:38Speaker 1: the casket. He didn't seem mournful. Gilbert said Tammy looked
- 1:00:42Speaker 1: good and Chad said yes she does. Gilbert recalls Chad
- 1:00:46Speaker 1: and all the kids speaking at the funeral. Gilbert was
- 1:00:49Speaker 1: impressed with the children's talks. 11.42 a.m. Gilbert was surprised
- 1:00:54Speaker 1: Chad spoke because most spouses are too devastated to talk.
- 1:00:58Speaker 1: Gilbert says Chad's speech was like a church talk. Other
- 1:01:01Speaker 1: talks at funerals or loving tributes, she says Chad's wasn't.
- 1:01:06Speaker 1: After the memorial in Idaho the next day, Gilbert took
- 1:01:09Speaker 1: a meal over to Chad's house. The kids started to eat,
- 1:01:12Speaker 1: and Chad told Gilbert he was moving to a condo
- 1:01:15Speaker 1: in Rexburg. He said his friend had a place for
- 1:01:17Speaker 1: him to stay. 11.44 a.m. Tammy is pronounced dead on Saturday.
- 1:01:23Speaker 1: And by the following Wednesday, Chad had plans to move
- 1:01:25Speaker 1: out of the house. Chad told his kids to go
- 1:01:28Speaker 1: through Tammy's items, and Gilbert was surprised things were moving
- 1:01:31Speaker 1: so fast. Well, when you have a plan, and then
- 1:01:34Speaker 1: you put that plan into motion, this is the end result.
- 1:01:38Speaker 1: He knew what he was doing, and he knew that
- 1:01:40Speaker 1: he had to have Tammy out of the way to
- 1:01:42Speaker 1: do all this other stuff. So you don't need to be,
- 1:01:46Speaker 1: you know, some kind of great investigator to figure out
- 1:01:49Speaker 1: what happened here. 11.45 a.m. The following Friday, Gilbert went
- 1:01:54Speaker 1: and saw Emma. She was sobbing, had lost a lot
- 1:01:57Speaker 1: of weight, and meals were organized to help her and
- 1:02:00Speaker 1: Garth out. Gilbert says both kids were struggling. Chad had
- 1:02:04Speaker 1: moved out by Friday. Gilbert believes he moved after the memorial, 11.47 a.m.
- 1:02:09Speaker 1: Garth was living in Chad's house at the time, and
- 1:02:12Speaker 1: Emma was staying in the home kitty corner. Gilbert called
- 1:02:15Speaker 1: Chad on October 26th to see if she and her
- 1:02:18Speaker 1: husband could come visit with him. He told them no,
- 1:02:21Speaker 1: he would come to their house that evening. Gilbert never
- 1:02:24Speaker 1: saw where Chad was living in Rexburg. Chad went over
- 1:02:30Speaker 1: that night. Gilbert had made cookies. Chad said he found
- 1:02:33Speaker 1: the woman he was going to marry. Gilbert and her
- 1:02:36Speaker 1: husband were absolutely stunned when he said that. Chad said
- 1:02:40Speaker 1: he had met the lady at a conference in St.
- 1:02:42Speaker 1: George in 2018. Chad didn't want to tell them who
- 1:02:46Speaker 1: she was at first, but then told them her name
- 1:02:48Speaker 1: was Lori Vallow. Gilbert had not heard the name but
- 1:02:51Speaker 1: then remembered that Lori had done a podcast with Melanie Gibb. 11.50 a.m.
- 1:02:56Speaker 1: Chad told the Gilberts that Lori was in town. The
- 1:02:59Speaker 1: following Tuesday, the Gilberts went to the temple. They were
- 1:03:02Speaker 1: waiting for a meeting to begin and Chad was there
- 1:03:05Speaker 1: with Lori. Melanie Boudreau was also there. Later that week,
- 1:03:09Speaker 1: Chad and Lori went over to the Gilbert's house. 11.52 a.m.
- 1:03:13Speaker 1: Chad and Lori sat on the couch and Gilbert says
- 1:03:16Speaker 1: it was awkward. They were very affectionate with each other.
- 1:03:19Speaker 1: more than she had seen Chad with Tammy. They were
- 1:03:21Speaker 1: giggling and laughing, and Gilbert says she and her husband
- 1:03:24Speaker 1: were embarrassed. Chad had never acted that way with Tammy. 11.52 a.m.
- 1:03:30Speaker 1: Lori said her husband had died of a heart attack
- 1:03:32Speaker 1: in December. Gilbert asked Lori if she had children. Chad
- 1:03:36Speaker 1: said she recently had a daughter who had passed away.
- 1:03:39Speaker 1: Lori told Gilbert she had children but didn't give a
- 1:03:41Speaker 1: definite answer as to the amount of kids. Oh, had
- 1:03:45Speaker 1: a daughter who passed away, huh? Makes sense considering, well,
- 1:03:48Speaker 1: you guys killed her. 11.53 a.m. That October was very cold,
- 1:03:54Speaker 1: and there was a hard frost in the Rexburg area.
- 1:03:57Speaker 1: Chad and Lori told the Gilberts they were going to
- 1:03:59Speaker 1: get married, but they didn't know where or when. They
- 1:04:02Speaker 1: also planned on taking Chad's kids to Disneyland at Thanksgiving.
- 1:04:06Speaker 1: Chad said he was going to Hawaii to write a book. 11.55 a.m.
- 1:04:11Speaker 1: Gilbert says Chad and Lori never mentioned taking Lori's kids
- 1:04:13Speaker 1: to Disneyland. Gilbert assumed Lori was an empty nester and
- 1:04:18Speaker 1: the daughter who died was older. Blake says now may
- 1:04:21Speaker 1: be a good time for lunch. Be back at 1pm. Alright,
- 1:04:24Speaker 1: so like usual, that's where we're going to wrap up
- 1:04:27Speaker 1: and in the next episode we'll pick up with the
- 1:04:29Speaker 1: afternoon session. All the information that goes with this episode
- 1:04:33Speaker 1: can be found in the description box. What's up everyone
- 1:04:37Speaker 1: and welcome back to the program. In this episode we're
- 1:04:40Speaker 1: picking right back up where we left off with the
- 1:04:43Speaker 1: Chad Daybell trial. And to do that, once again, we're
- 1:04:47Speaker 1: using EastIdahoNews.com, and the author of this article is Nate Eaton.
- 1:04:51Speaker 1: 103 p.m. Back in the courtroom, Blake continues to question Gilbert.
- 1:04:57Speaker 1: 105 p.m. When Gilbert learned in November that JJ and
- 1:05:01Speaker 1: Tylee were missing, she called Chad and asked if the
- 1:05:04Speaker 1: kids belonged to Lori. Chad said yes, and that it
- 1:05:07Speaker 1: was a custody issue, but would eventually all be resolved.
- 1:05:10Speaker 1: 106 p.m. Gilbert learned Chad and Lori got married in Hawaii.
- 1:05:15Speaker 1: After their marriage, Chad visited and the Gilberts showed them
- 1:05:19Speaker 1: wedding photos. He was quite excited to show us the
- 1:05:22Speaker 1: wedding pictures, Gilbert says. 107 p.m. Gilbert was surprised they
- 1:05:27Speaker 1: got married so soon. Gilbert recalls Chad visiting the home
- 1:05:30Speaker 1: again after Lori was arrested in Hawaii. Chad had moved
- 1:05:34Speaker 1: back to Idaho. He asked us if we would put
- 1:05:36Speaker 1: our house up for her bond, Gilbert says. He also
- 1:05:40Speaker 1: asked if he could live with the Gilberts. 108 p.m.
- 1:05:43Speaker 1: Gilbert was okay if Chad spent the night, but not
- 1:05:46Speaker 1: live with him. When he came in, he was quite upset,
- 1:05:49Speaker 1: and he said he had to get her out of jail.
- 1:05:51Speaker 1: He cried and said it was killing her to be
- 1:05:53Speaker 1: in jail, and could we put our house up for bond?
- 1:05:56Speaker 1: We asked him if he had family that could help him,
- 1:05:58Speaker 1: and he said no. 109 p.m. The Gilberts said they
- 1:06:02Speaker 1: would think about it. The next day, Chad texted and
- 1:06:04Speaker 1: said he was going to come over with the Bonds woman.
- 1:06:07Speaker 1: The Gilberts said no. They would not help him post Bond.
- 1:06:10Speaker 1: Gilbert confronted Chad about him saying that Lori had a
- 1:06:13Speaker 1: daughter who passed away, but then saying later it was
- 1:06:16Speaker 1: a custody battle. So yeah, dude got caught in his
- 1:06:19Speaker 1: own lies by his own friends. If your own friends
- 1:06:22Speaker 1: are suspicious of what you're up to, do you really
- 1:06:25Speaker 1: think the investigators aren't onto your bullshit? 1.11 p.m. When
- 1:06:29Speaker 1: Chad asked Gilbert about the bond, she was a little miffed.
- 1:06:32Speaker 1: I asked him, where are the children? Where's Tylee? She's
- 1:06:35Speaker 1: a teenager. Doesn't she want a life? Doesn't she want
- 1:06:38Speaker 1: a job, a life, and a boyfriend? He said she
- 1:06:40Speaker 1: didn't like people and she didn't like me, Gilbert says.
- 1:06:44Speaker 1: Gilbert noted Chad used the past tense, didn't. 1.12 p.m.
- 1:06:49Speaker 1: The previous February, Chad went over to the Gilberts and
- 1:06:52Speaker 1: mentioned that he had a vision that Tammy was going
- 1:06:55Speaker 1: to pass away before her 50th birthday. He didn't know
- 1:06:58Speaker 1: how or when. Chad told the Gilberts that Tammy liked
- 1:07:01Speaker 1: to play games on the computer and that her grandmother
- 1:07:04Speaker 1: had come to Chad. The grandmother told Chad to tell
- 1:07:07Speaker 1: Tammy that he was not happy that Tammy was wasting
- 1:07:10Speaker 1: her time on the computer. 1.13 p.m. Blake has no
- 1:07:15Speaker 1: further questions for Gilbert. Pryor will now cross-examine. 1.14 p.m.
- 1:07:20Speaker 1: Pryor asked Gilbert how often she saw Tammy. They had
- 1:07:22Speaker 1: their meetings on Wednesday mornings for one to two hours
- 1:07:25Speaker 1: and then on Sundays. Four people were present at the
- 1:07:28Speaker 1: Wednesday meetings. 1.15 p.m. Prior asked Gilbert where the daybells
- 1:07:33Speaker 1: sat in the building. She says toward the middle of
- 1:07:36Speaker 1: the chapel, but after Emma had a baby, they moved
- 1:07:39Speaker 1: toward the back. Prior asked about Chad parking his truck
- 1:07:42Speaker 1: at the Salem church every morning. Gilbert has no idea. 1.16 p.m.
- 1:07:47Speaker 1: Prior asked about the meal Gilbert and the presidency took
- 1:07:50Speaker 1: over to the house. Gilbert says she involved the bishop
- 1:07:54Speaker 1: and went over to the house with food. 1.17 p.m.
- 1:07:57Speaker 1: Pryor asked about Melanie Gibb. He asked Gilbert how she
- 1:08:00Speaker 1: knows her. Gilbert says she came upon Gibb's podcast and
- 1:08:04Speaker 1: that's where she heard about Lori. Pryor asked Gilbert if
- 1:08:07Speaker 1: she has been to Chad's house and if it's a
- 1:08:09Speaker 1: one-story house. Gilbert says there's an addition to the house.
- 1:08:12Speaker 1: You walk through a breezeway and upstairs. 1.19 p.m. Pryor
- 1:08:17Speaker 1: asked Gilbert if she's aware of the utilities on the
- 1:08:20Speaker 1: addition of the house. Blake continually objects that Pryor is
- 1:08:24Speaker 1: testifying and Boyce sustains the objections. Gilbert doesn't know specifics
- 1:08:29Speaker 1: of the living conditions in the home. 1.22 p.m. Pryor
- 1:08:33Speaker 1: asks Gilbert if Chad was trying to hide his whereabouts.
- 1:08:36Speaker 1: Gilbert says he didn't with them. Pryor is questioning Gilbert
- 1:08:40Speaker 1: about the children, and she chokes up. She says she
- 1:08:43Speaker 1: couldn't get a straight answer out of Chad about the
- 1:08:45Speaker 1: missing kids. Well, I wonder why. If you murdered some kids,
- 1:08:48Speaker 1: probably not something you want to talk about, huh? 1.23 p.m.
- 1:08:52Speaker 1: Pryor has no further questions. Blake is back up for
- 1:08:55Speaker 1: a redirect. Blake asks Gilbert if she knew where Chad
- 1:08:59Speaker 1: went every morning. Gilbert doesn't know, but sometimes saw that
- 1:09:02Speaker 1: his vehicle was gone. She once asked Chad about this,
- 1:09:05Speaker 1: and he said he could go to the college, Brigham
- 1:09:08Speaker 1: Young University, Idaho. Blake asks about the stairs. Pryor objects.
- 1:09:12Speaker 1: Boyce overrules it. Gilbert says all of the residents is
- 1:09:16Speaker 1: not one story. 1.25 p.m. Gilbert recalls about Chad telling
- 1:09:22Speaker 1: her that Lori had a daughter who had recently passed away.
- 1:09:25Speaker 1: As she testifies, Chad rolls his eyes and nods his head.
- 1:09:28Speaker 1: Blake asks Gilbert if she's aware the remains of Lori's
- 1:09:31Speaker 1: children were found on Chad's property. Gilbert says yes. Blake
- 1:09:35Speaker 1: has no further questions. Gilbert is released from her subpoena.
- 1:09:39Speaker 1: Bros over here rolling his eyes, huh? An absolute clown.
- 1:09:43Speaker 1: If you ever wondered what a clown looked like without
- 1:09:45Speaker 1: its makeup, well, here it is. Chad Daybell is one
- 1:09:48Speaker 1: of the biggest clowns going. 1.27 p.m. Next witness is
- 1:09:52Speaker 1: Todd Gilbert, Alice's husband. 1.28 p.m. Gilbert says he heard
- 1:09:56Speaker 1: of Chad Daybell in 2015, that he was an author.
- 1:10:00Speaker 1: Gilbert reads most of Chad's books before they ever met
- 1:10:02Speaker 1: in person. Todd and Alice moved to Salem in March 2017.
- 1:10:07Speaker 1: That's when he met Chad and Tammy in person. I mean, really?
- 1:10:10Speaker 1: You're reading Chad Daybell's books? There's nothing else out there
- 1:10:14Speaker 1: that catches your attention? No other great works of literature
- 1:10:18Speaker 1: out there that you want to dive into? If you're
- 1:10:20Speaker 1: looking for an end-of-the-world book, there's a few I can suggest.
- 1:10:24Speaker 1: How about Swan Song by Robert McCammon? Or how about
- 1:10:27Speaker 1: The Passage by Justin Cronin? Or how about The Stand
- 1:10:31Speaker 1: by Stephen King? We can go on and on and on.
- 1:10:34Speaker 1: but instead you're going to read books by Chad Daybell?
- 1:10:37Speaker 1: Tell me you're a jagoff without telling me you're a jagoff. 1.30 p.m.
- 1:10:42Speaker 1: Gilbert saw Chad about once a week, usually at church.
- 1:10:45Speaker 1: Gilbert would sometimes go over and help Chad with plumbing.
- 1:10:49Speaker 1: Gilbert says Chad sometimes spoke about his religious beliefs, and
- 1:10:52Speaker 1: they didn't ring true with him. 1.31 p.m. Gilbert understood
- 1:10:57Speaker 1: all of Chad's books to be fictional, based on his
- 1:10:59Speaker 1: near-death experiences. Gilbert says Chad spoke to him. about events
- 1:11:03Speaker 1: he had seen in his visions and things that would
- 1:11:06Speaker 1: happen in the future. The things Chad told him did
- 1:11:09Speaker 1: not always align with the standard LDS doctrine, Gilbert says.
- 1:11:13Speaker 1: If Bro was such a great seer, if he was
- 1:11:15Speaker 1: such a great prophet, how come he didn't prophesize any
- 1:11:18Speaker 1: of this? 1.33pm Blake asked Gilbert about Chad visiting his
- 1:11:23Speaker 1: home in February of 2019. Gilbert and his wife were
- 1:11:27Speaker 1: removing tile in the bedroom. Chad sent a text saying
- 1:11:31Speaker 1: he wanted to come over. As he was leaving, he
- 1:11:34Speaker 1: told Gilbert that Tammy's life mission was going to come
- 1:11:37Speaker 1: to an end before her 50th birthday. Gilbert didn't know
- 1:11:40Speaker 1: how old Tammy was, but figured she was around 48.
- 1:11:42Speaker 1: This dude's out here talking about Tammy dying, and then
- 1:11:46Speaker 1: it just happens. Okay, I guess we have no questions
- 1:11:49Speaker 1: for you, Chad. Just go on with your life. Oh,
- 1:11:52Speaker 1: you're gonna go marry Lori Vallow, and her two kids
- 1:11:54Speaker 1: end up missing and dead? Buried on your property? Nah,
- 1:11:57Speaker 1: no questions for you, pal. Enjoy yourself on that beach walk. 1.34 p.m.
- 1:12:03Speaker 1: On October 19th, 2019, around 7 a.m., the Gilberts received
- 1:12:07Speaker 1: a call from Emma. She was upset, and Chad took
- 1:12:10Speaker 1: the phone. Gilbert learned from the phone call that Tammy
- 1:12:13Speaker 1: had died, and the Gilberts went over around 8.15 a.m.
- 1:12:16Speaker 1: to the Daybell house. Chad didn't seem like he was
- 1:12:19Speaker 1: real sad, like I would expect somebody to be after
- 1:12:22Speaker 1: their spouse had passed on. He seemed businesslike to me.
- 1:12:25Speaker 1: I thought it was kind of strange. 1.36 p.m. Gilbert
- 1:12:30Speaker 1: told Chad it looks like it happened, meaning the prophecy
- 1:12:33Speaker 1: from February that Tammy would die. Chad turned away from
- 1:12:36Speaker 1: the kids and told Gilbert he had not told the
- 1:12:39Speaker 1: kids about the vision. Gilbert asked Chad if he had
- 1:12:41Speaker 1: any idea what happened to Tammy. Chad said Tammy got
- 1:12:45Speaker 1: up around midnight, had a big coughing spell, threw up,
- 1:12:48Speaker 1: and went back to bed. Chad figured Tammy died around
- 1:12:51Speaker 1: 2 a.m. from an embolism and around 5.30 a.m. the
- 1:12:55Speaker 1: weight of her body rolled out of the bed onto
- 1:12:57Speaker 1: the floor. 1.38 p.m. Gilbert said they had recently seen
- 1:13:02Speaker 1: Tammy shopping at Walmart. She looked fine. They saw her
- 1:13:05Speaker 1: at church at least once a week and saw her
- 1:13:07Speaker 1: in the yard. She always looked fine. 1.39 p.m. The
- 1:13:12Speaker 1: day the Gilberts visited the Daybells, they left and got
- 1:13:15Speaker 1: breakfast for everyone at McDonald's. They returned to the house
- 1:13:18Speaker 1: and Garth told them to leave the food on the table.
- 1:13:21Speaker 1: The day after the funeral, the Gilberts took dinner to
- 1:13:24Speaker 1: the Daybells around 6. Chad told Gilbert he needed to
- 1:13:27Speaker 1: move out and had a friend on Pioneer Road in
- 1:13:30Speaker 1: Rexburg he was planning to move in with. Gilbert figured
- 1:13:33Speaker 1: it was a man. 1.42 p.m. Gilbert attended Tammy's funeral.
- 1:13:39Speaker 1: He says things move fast to have a funeral for
- 1:13:42Speaker 1: your spouse when they died on Saturday and services were
- 1:13:45Speaker 1: on Tuesday. Gilbert says before the funeral started, Chad was
- 1:13:49Speaker 1: standing by the casket. Gilbert spoke with him and looked
- 1:13:52Speaker 1: at Tammy in the casket. We felt like we needed
- 1:13:55Speaker 1: closure with Tammy. He seemed like he was in a
- 1:13:58Speaker 1: hurry to get it over with. Yeah, he wanted to
- 1:14:00Speaker 1: get on with his life. Him and the old skafooza
- 1:14:02Speaker 1: had to get to Hawaii. They couldn't have something like
- 1:14:05Speaker 1: Tammy's funeral get in the way. 1.44 p.m. Gilbert and
- 1:14:10Speaker 1: his wife called Chad a few days after the funeral
- 1:14:12Speaker 1: and said they wanted to bring him a pizza. Chad
- 1:14:15Speaker 1: said he would instead come to their house. He arrived
- 1:14:17Speaker 1: at 6 p.m. Chad told the Gilberts he had a girlfriend.
- 1:14:21Speaker 1: We about fell on the floor, he says. Chad seemed
- 1:14:24Speaker 1: hesitant to tell them, but he said her name was
- 1:14:26Speaker 1: Lori Vallow. Gilbert heard that name before on the podcast.
- 1:14:30Speaker 1: They had never met in person. 1.46 p.m. Chad told
- 1:14:34Speaker 1: the Gilberts that Tammy's mission was over in this life
- 1:14:38Speaker 1: and that Lori was to fulfill her mission with Chad now.
- 1:14:41Speaker 1: Chad said Lori and her friends were going to be
- 1:14:43Speaker 1: in the area and asked the Gilberts if they would
- 1:14:45Speaker 1: like to meet her. The Gilberts work in the temple,
- 1:14:48Speaker 1: and they met Lori and Chad at the temple. 1.47 p.m.
- 1:14:52Speaker 1: Two or three days later, Chad and Lori went to
- 1:14:55Speaker 1: see the Gilberts. They were real happy, excited with each other.
- 1:14:58Speaker 1: We invited them to sit on the couch. They ended
- 1:15:01Speaker 1: up sitting real close to each other and holding hands.
- 1:15:03Speaker 1: I seen Chad rubbing her leg. I thought that was
- 1:15:06Speaker 1: kind of odd. You're carrying on like a teenager in love.
- 1:15:09Speaker 1: Tammy had only been dead a week and a half.
- 1:15:12Speaker 1: Gilbert had never seen Chad act like this before. And
- 1:15:16Speaker 1: that's another common reoccurrence, right? The way Chad was acting
- 1:15:19Speaker 1: with Lori, never the way he acted with Tammy. 1.49 p.m.
- 1:15:23Speaker 1: Chad told the Gilberts he and Lori were going to
- 1:15:25Speaker 1: move to Hawaii. Gilbert asked if Lori had ever been
- 1:15:28Speaker 1: married before. Lori says her husband had died of a
- 1:15:31Speaker 1: heart attack in December 2018. Gilbert asked Lori if she
- 1:15:35Speaker 1: had any children. She said she had several. Chad popped
- 1:15:39Speaker 1: up and said she had a daughter who had just died. Yeah,
- 1:15:42Speaker 1: that you killed. You, Lori, and beaver-ass face, Alex Cox.
- 1:15:47Speaker 1: You three scumbags, if there is a hell, there is
- 1:15:50Speaker 1: a place reserved in it for all of you to
- 1:15:53Speaker 1: roast like a rotisserie chicken forever. 1.50 p.m. Chad and
- 1:15:57Speaker 1: Lori returned to the Gilberts after they got married. They
- 1:16:00Speaker 1: wanted to show them all their wedding photos, which were
- 1:16:03Speaker 1: quite a few. They talked about a family trip that
- 1:16:06Speaker 1: Chad's kids to Disneyland and Knott's Berry Farm around Thanksgiving.
- 1:16:10Speaker 1: They never mentioned taking Lori's kids on the trip. Well,
- 1:16:13Speaker 1: because they were dead. Can't take dead kids to the park,
- 1:16:16Speaker 1: can you? No weekend at Bernie's with dead kids. Not
- 1:16:19Speaker 1: going to go over so well. For me, the evidence
- 1:16:22Speaker 1: is just clear. Chad Daybell, Lori Vallow, Alex Cox. They
- 1:16:26Speaker 1: were all involved in this conspiracy to kill these kids.
- 1:16:29Speaker 1: All this evidence and Chad Daybell basically admitting it by
- 1:16:32Speaker 1: saying Lori just had a daughter who died. This dude's
- 1:16:34Speaker 1: real lucky that I'm not on the jury. 1.51 p.m.
- 1:16:38Speaker 1: Blake asks who was in the wedding photos. Just Chad
- 1:16:41Speaker 1: and Lori. Nobody else. 1.52 p.m. Gilbert says when they
- 1:16:46Speaker 1: would see Chad, he would tell them that Tammy had
- 1:16:48Speaker 1: appeared to him in spirit at least twice and she
- 1:16:51Speaker 1: was doing fine. She understood the plan and was going
- 1:16:54Speaker 1: to move on in the spirit world. Chad's mission was
- 1:16:56Speaker 1: to be married to Lori and his children were fine
- 1:16:59Speaker 1: with it. Bro gaslit everybody. Yo, I'm the prophet. She
- 1:17:03Speaker 1: came to talk to me in my dreams, and everything's good,
- 1:17:06Speaker 1: don't worry. Doesn't matter that I killed her. Tammy's doing
- 1:17:10Speaker 1: great in the afterworld. In fact, her spirit has ascended.
- 1:17:13Speaker 1: And never mind coming up with this hogwash. Imagine believing it.
- 1:17:17Speaker 1: What sort of weak-minded, bean-brained, stupid son of a bitch
- 1:17:21Speaker 1: are you to believe this kind of nonsense? 1.53 p.m.
- 1:17:25Speaker 1: After Lori was brought back to Rexburg and booked in jail,
- 1:17:28Speaker 1: Chad visited the Gilberts. When he walked in the door,
- 1:17:31Speaker 1: he said, Christ has sent me here to ask you
- 1:17:33Speaker 1: guys if you'd be willing to put your home up
- 1:17:35Speaker 1: for bond to get Lori out of jail. 1.55 p.m.
- 1:17:40Speaker 1: Gilbert did not give up his home for bond. Gilbert
- 1:17:42Speaker 1: recalls Chad saying that Tylee didn't really like him, Chad.
- 1:17:46Speaker 1: Blake asks if there are stairs in the Daybell home.
- 1:17:49Speaker 1: Gilbert says there are some in the back part of
- 1:17:51Speaker 1: the home. Pryor will now cross-examine. 1.56 p.m. Pryor begins
- 1:17:57Speaker 1: asking about the attached building on Daybell's house. Gilbert says
- 1:18:01Speaker 1: there is a mechanical room, a storage room, and a
- 1:18:04Speaker 1: room up above the area. Pryor asked who used the
- 1:18:07Speaker 1: attached building. Gilbert says the whole family used it and
- 1:18:10Speaker 1: there was a bed upstairs. 1.57 p.m. Pryor asks about
- 1:18:15Speaker 1: Melanie Gibb and if she's involved in any organization attached
- 1:18:18Speaker 1: to the LDS faith. Gilbert says not that he's aware of.
- 1:18:22Speaker 1: Pryor asks about preparing a people. Gilbert says, to his knowledge,
- 1:18:26Speaker 1: she really isn't involved with it. Chad introduced the Gilberts
- 1:18:29Speaker 1: to Melanie Gibb at the Preparing the People conference in Caldwell,
- 1:18:33Speaker 1: Idaho in 2019. Preparing the people. More like grifting from
- 1:18:39Speaker 1: the people. More like lying to the people. And more
- 1:18:42Speaker 1: like misleading the people. 2 p.m. The Gilberts attended three
- 1:18:46Speaker 1: Preparing a People conferences. Pryor asks what AVOW is. It's
- 1:18:51Speaker 1: a preparation website, Gilbert says. Gilbert says Chad was an
- 1:18:55Speaker 1: active member of the LDS church through the time that
- 1:18:58Speaker 1: they knew each other. 2.01 p.m. Pryor asks about Gilbert
- 1:19:02Speaker 1: meeting Lori and Chad at the temple. Gilbert says you
- 1:19:05Speaker 1: have to be an active member and have her recommend
- 1:19:07Speaker 1: to get into the temple. Melanie Boudreau, Lori's niece, and
- 1:19:11Speaker 1: another lady also went with Lori and Chad to the temple. 2.02 p.m.
- 1:19:15Speaker 1: Gilbert says Chad is a soft-spoken person. Pryor suggests he's
- 1:19:19Speaker 1: shy and reserved. 2.03 p.m. Pryor asks about the coughing
- 1:19:23Speaker 1: spell Tammy experienced. He asks Gilbert if Chad mentioned that
- 1:19:27Speaker 1: Tammy had eaten to make her throw up. Chad did not.
- 1:19:30Speaker 1: Pryor has nothing further. Blake will now redirect. 2.05 p.m.
- 1:19:35Speaker 1: Blake asks if some of the things Chad discussed with
- 1:19:37Speaker 1: Gilbert were beyond the standard LDS teachings. Gilbert says yes.
- 1:19:41Speaker 1: Blake asks if someone disclosed they were having an affair,
- 1:19:44Speaker 1: would they qualify for a temple recommend? Gilbert says no. 2.06 p.m.
- 1:19:50Speaker 1: Gilbert is released from his subpoena. He leaves the witness stand.
- 1:19:53Speaker 1: We will take afternoon recess and be back at 2.30 p.m. 2.30 p.m.
- 1:19:59Speaker 1: Back in the courtroom, Chad and John are smiling, laughing
- 1:20:02Speaker 1: with each other. Boyce is on the bench and the
- 1:20:04Speaker 1: jurors are in their seats. 2.35 p.m. Next witness is
- 1:20:08Speaker 1: Janice Olson. She lives in St. Anthony and teaches first grade.
- 1:20:12Speaker 1: This will be her 30th year teaching. She has always
- 1:20:15Speaker 1: taught at Central Elementary the same school where Tammy taught. 2.37 p.m.
- 1:20:21Speaker 1: Janice saw Tammy multiple times a day. They had lunch
- 1:20:24Speaker 1: together three to four times a week. Rocky Wixom is
- 1:20:28Speaker 1: questioning Janice. Janice says Tammy was a friend and a
- 1:20:31Speaker 1: good colleague. Tammy was very organized on top of things
- 1:20:35Speaker 1: and went the extra mile to get books into the
- 1:20:37Speaker 1: hands of kids. 2.38pm. Tammy attended Janice's high-fit Zumba class
- 1:20:42Speaker 1: twice a week. Each class was an hour. Janice says
- 1:20:45Speaker 1: Tammy never struggled in class and wouldn't quit early. 2.40pm.
- 1:20:50Speaker 1: Janice says she got a call about Tammy's death and
- 1:20:53Speaker 1: was shocked. She had just seen Tammy the day before
- 1:20:56Speaker 1: at school, and Tammy had been at exercise class. Tammy
- 1:20:59Speaker 1: never mentioned anything about not feeling well. She didn't have
- 1:21:03Speaker 1: any ill symptoms. 2.42 p.m. Wixom has no further questions.
- 1:21:07Speaker 1: Pryor will now cross-examine. He asked Janice about the day
- 1:21:10Speaker 1: before Tammy died. He asked Janice if Tammy was preparing
- 1:21:14Speaker 1: for a book fair. Janice doesn't recall. Pryor has nothing further.
- 1:21:18Speaker 1: Wixom asked Janice to explain where her classroom is. It's
- 1:21:21Speaker 1: right by the front door. 2.44 p.m. Janice says she
- 1:21:25Speaker 1: saw Tammy walking around school all day, every day. She'd
- 1:21:29Speaker 1: come and gather books before the students went to the library.
- 1:21:32Speaker 1: Tammy would gather books on certain subjects and bring them
- 1:21:35Speaker 1: to the classrooms, and Wixom has nothing further. 2.45 p.m.
- 1:21:40Speaker 1: Next witness is Taylor Ballard, an insurance broker from Rexburg. 2.47 p.m.
- 1:21:45Speaker 1: Ballard works at Ballard Insurance Group. She has worked in
- 1:21:49Speaker 1: the industry for 14 years. She met Chad Daybell on
- 1:21:52Speaker 1: October 31, 2019. Chad visited her office to inquire about
- 1:21:57Speaker 1: an individual health policy for him and his children. Chad
- 1:22:01Speaker 1: was losing coverage from his deceased wife's policy through her
- 1:22:04Speaker 1: employer plan. 2.49 p.m. Chad wanted health insurance for himself, Seth, Leah,
- 1:22:11Speaker 1: and Mark. They discussed his income, demographic information, and options
- 1:22:15Speaker 1: for insurance. Chad said without his wife's income, His self-employment
- 1:22:20Speaker 1: as a book publisher would operate at a loss. Ballard
- 1:22:23Speaker 1: learned from Health and Welfare that Chad was making $ 30, 000
- 1:22:27Speaker 1: a year. Ballard asked for a copy of Chad's tax
- 1:22:30Speaker 1: return to verify his income. 2.52 p.m. Ballard texted Chad
- 1:22:35Speaker 1: on November 5, 2019, asking for his 2018 tax return.
- 1:22:40Speaker 1: Chad responded that he was out of the town all week,
- 1:22:42Speaker 1: but he would be able to stop by the following week.
- 1:22:45Speaker 1: On November 21, Chad came back into Ballard's office. Based
- 1:22:49Speaker 1: on Chad's tax return, it was proven that his business
- 1:22:52Speaker 1: did operate out of profit, so he was eligible for
- 1:22:54Speaker 1: different insurance, and they discussed his options for January 2020. 2.53 p.m.
- 1:23:01Speaker 1: Chad asked if he were to get married, how hard
- 1:23:03Speaker 1: would it be to add a new wife? Chad had
- 1:23:06Speaker 1: already married at this time, but told Ballard, I'll be
- 1:23:09Speaker 1: honest with you, I'll probably be married by the end
- 1:23:11Speaker 1: of the year. Chad never mentioned the names JJ or Tylee. 2.55 p.m.
- 1:23:17Speaker 1: On December 11th, Chad picked up his health insurance plan
- 1:23:20Speaker 1: and paid for it. He did not bring up JJ, Tylee,
- 1:23:23Speaker 1: or Lori. Around this time, Ballard received five letters addressed
- 1:23:27Speaker 1: to Chad, but they had been sent to Ballard's address.
- 1:23:30Speaker 1: She said that was very weird. It never happens. 2.57 p.m.
- 1:23:35Speaker 1: Ballard was in health and welfare on December 23rd and
- 1:23:38Speaker 1: learned Chad had remarried someone who had two children that
- 1:23:42Speaker 1: were missing. Ballard was confused and wondered if they were
- 1:23:45Speaker 1: the children she had helped insure. Ballard said this information
- 1:23:49Speaker 1: made her question his deceased wife. 2.58 p.m. Ballard's office
- 1:23:53Speaker 1: handled Tammy's health, life, and disability insurance before she passed away.
- 1:23:57Speaker 1: Ballard looked at her life insurance amount and learned it
- 1:24:00Speaker 1: had been paid out. During her open enrollment in August
- 1:24:03Speaker 1: or September, she had upped it to the max. 3 p.m.
- 1:24:07Speaker 1: On March 11, 2020, Chad went to Ballard's office to
- 1:24:11Speaker 1: ask about getting health insurance for his wife. He told
- 1:24:14Speaker 1: Ballard his wife Lori Daybell... and wrote on a sticky note,
- 1:24:17Speaker 1: Lori Ryan Daybell. Chad told Ballard that they were married
- 1:24:21Speaker 1: on November 5th, 2019. He had stated to me that
- 1:24:26Speaker 1: she was incarcerated. I told him she wouldn't necessarily get
- 1:24:29Speaker 1: insurance right now, but he was worried about something happening
- 1:24:32Speaker 1: to her. Ballard told Chad she would have to be
- 1:24:35Speaker 1: covered by the state if she was incarcerated. 3.01 p.m.
- 1:24:40Speaker 1: Chad said Lori would be getting out of jail the
- 1:24:42Speaker 1: following week. Ballard was going through information. When she got
- 1:24:46Speaker 1: the income information, Chad said they confiscated my computer, so
- 1:24:50Speaker 1: he wasn't able to pay himself yet. Ballard said they,
- 1:24:53Speaker 1: and Chad said the FBI took his computer. Chad wanted
- 1:24:56Speaker 1: to make sure he, his wife, and son Mark would
- 1:24:59Speaker 1: be covered. Ballard asked about adding dependents. Chad never mentioned
- 1:25:03Speaker 1: JJ or Tylee. 3.03 p.m. Ballard was concerned they had
- 1:25:08Speaker 1: a fraudulent life insurance payout. I was worried Tammy's death
- 1:25:11Speaker 1: may not have been an accident. and the life insurance
- 1:25:14Speaker 1: money was paid out when it shouldn't have been. 3.04 p.m.
- 1:25:17Speaker 1: Ballard had a conversation on March 16th. Chad reached out
- 1:25:21Speaker 1: because he had received some information from Health and Welfare
- 1:25:24Speaker 1: that Lori's identity could not be verified. Chad provided his
- 1:25:28Speaker 1: marriage certificate and Lori's driver's license to verify her identity.
- 1:25:32Speaker 1: The issue was resolved. The last time Ballard spoke to
- 1:25:35Speaker 1: Chad was on March 26th. 3.07 p.m. Ballard had done
- 1:25:40Speaker 1: the presentation for open enrollment at Tammy School District, and
- 1:25:44Speaker 1: she gave Tammy the life insurance election form. Wixom asked
- 1:25:47Speaker 1: if she ever noticed what Chad was wearing when she
- 1:25:50Speaker 1: came in. Ballard noticed Chad was wearing a ring when
- 1:25:53Speaker 1: he came into her office. The ring was turquoise. Oh, malachite,
- 1:25:57Speaker 1: is it? 3.09 p.m. On March 11th, Chad was thinner
- 1:26:02Speaker 1: and tanner. He had on a black ring. Ballard assumed
- 1:26:05Speaker 1: that this was his new wedding ring, and the turquoise
- 1:26:07Speaker 1: ring must have been Tammy's. Wixom has no further questions.
- 1:26:11Speaker 1: Pryor will now cross-examine. 3.10 p.m. Pryor references an interview
- 1:26:16Speaker 1: Ballard did with Detective Mattingly. Ballard says the entire family
- 1:26:20Speaker 1: was losing health insurance coverage because of Tammy's death. 3.12 p.m.
- 1:26:24Speaker 1: Pryor asks when the enrollment period was in the Sugar
- 1:26:27Speaker 1: Salem School District. The forms were due back September 15th.
- 1:26:31Speaker 1: Ballard gave the presentation at the school on August 23rd.
- 1:26:35Speaker 1: Ballard says Tammy elected for $ 80, 000 of insurance. Pryor asks
- 1:26:40Speaker 1: if it would be unusual to get the maximum amount
- 1:26:42Speaker 1: of insurance. Ballard agrees. 3.14 p.m. Ballard says Lori Vallow's
- 1:26:47Speaker 1: children never came up in conversation. Pryor is done. Wixom
- 1:26:52Speaker 1: has no redirect. 3.15 p.m. Rob Wood says the next
- 1:26:56Speaker 1: witness will be longer than 14 minutes. Boyce says given
- 1:26:59Speaker 1: the time, we will dismiss for the day. All right, folks,
- 1:27:02Speaker 1: there it is. Day number 14 of Chad Daybell's trial.
- 1:27:05Speaker 1: And things are continuing to go in the same direction
- 1:27:08Speaker 1: I figured they'd go in. And I think that when
- 1:27:10Speaker 1: we get to our destination... We're going to see a
- 1:27:13Speaker 1: conviction here, and I think the only question is, is
- 1:27:16Speaker 1: he going to get the death penalty, or is he
- 1:27:18Speaker 1: going to end up spending the rest of his disgusting,
- 1:27:21Speaker 1: pathetic life behind bars? All of the information that goes
- 1:27:25Speaker 1: with this episode can be found in the description box.
