• 0:00
Speaker 1: What's up everyone and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to spin back up to Moscow
• 0:06
Speaker 1: and we're going to check in on the newest development
• 0:09
Speaker 1: when it comes to Brian Kohlberger and his bid to
• 0:12
Speaker 1: overturn his plea deal. And previously, he had a court
• 0:15
Speaker 1: date scheduled for next year. Well now, he has a
• 0:18
Speaker 1: court date scheduled for October 15th. And if you recall,
• 0:22
Speaker 1: he's trying to get Judge Hippler thrown off the case.
• 0:25
Speaker 1: because he says that Judge Hippler is not an impartial person,
• 0:28
Speaker 1: and that the commentary that Judge Hippler made should be
• 0:31
Speaker 1: more than enough to get him removed. So today we
• 0:34
Speaker 1: have an article from the New York Post, and the headline.
• 0:38
Speaker 1: Brian Kohlberger gets new court date in pushed overturn plea
• 0:41
Speaker 1: deal in University of Idaho murders. This article was authored
• 0:45
Speaker 1: by Zoe Hussain. Convicted killer Brian Kohlberger and his attorneys
• 0:50
Speaker 1: have been granted a new court date amid his bid
• 0:52
Speaker 1: to to overturn his plea deal and stand trial in
• 0:55
Speaker 1: the University of Idaho slayings. Well, Brian Kohlberger should just
• 1:00
Speaker 1: say that he's crazy. That's what I would do. Look,
• 1:03
Speaker 1: I was suffering from a psychiatric break, and I had
• 1:06
Speaker 1: no idea what I was doing. I mean, it worked
• 1:09
Speaker 1: up in Massachusetts, right? Kohlberger's defense team and prosecutors will
• 1:13
Speaker 1: return to the Ada County Courthouse on October 15th to
• 1:17
Speaker 1: discuss the former criminology student's push to disqualify Judge Stephen
• 1:21
Speaker 1: Hippler from presiding over his post-conviction case, according to court records.
• 1:26
Speaker 1: I don't think they're going to be successful here, but
• 1:29
Speaker 1: you know what? You never know. And like I've said
• 1:31
Speaker 1: from the very beginning, I'm willing to follow the evidence
• 1:34
Speaker 1: wherever it goes. If Brian Koberger has evidence that shows
• 1:38
Speaker 1: us he's innocent, I'd love to see it. But we're
• 1:41
Speaker 1: going on what? Five years now? And he hasn't produced
• 1:45
Speaker 1: a single thing that I would call evidence. Whereas on
• 1:49
Speaker 1: the other side, There's an abundance of evidence that we've
• 1:52
Speaker 1: been privy to, especially after the plea deal, that point
• 1:56
Speaker 1: directly to Brian Kohlberger. So if he has something that would,
• 2:00
Speaker 1: you know, change the scope of things, let's see it.
• 2:03
Speaker 1: Hipler sentenced Kohlberger 31 to four life sentences without parole
• 2:07
Speaker 1: for the November 2022 fatal stabbings of four University of
• 2:11
Speaker 1: Idaho students, Ethan Chapin, Madison Mogan, Zanna Kernodle, and Kaylee Gonsalves,
• 2:17
Speaker 1: after he admitted to the murders in a July 2025
• 2:19
Speaker 1: plea hearing. Imagine getting up there and admitting that you
• 2:23
Speaker 1: did this. And then a year later, you're like, hey,
• 2:26
Speaker 1: you know what? Maybe not. I'm not really digging this
• 2:28
Speaker 1: whole entire life sentence thing. So maybe, just maybe, I'll
• 2:32
Speaker 1: try to get this plea deal thrown out. And the
• 2:35
Speaker 1: fact that there is a pathway to do that is unbelievable.
• 2:38
Speaker 1: If you get up in open court and you admit
• 2:41
Speaker 1: that you killed four people, three people, whatever, I really
• 2:44
Speaker 1: don't ever want to hear from you again. Unless there
• 2:47
Speaker 1: is some kind of bombshell ass evidence you have. Short
• 2:51
Speaker 1: of that, take your sentence and enjoy it. Because you've
• 2:57
Speaker 1: earned it. If you kill four people, you're lucky that
• 3:00
Speaker 1: all you're getting is a life sentence. Because in my opinion, helicopters, volcanoes.
• 3:08
Speaker 1: The new October court hearing comes soon after Hitler scheduled
• 3:10
Speaker 1: a status conference and evidentiary hearing for Kohlberger in June
• 3:14
Speaker 1: of 2027. So that was the first hearing that we
• 3:17
Speaker 1: heard about. And now this one's on the docket too.
• 3:20
Speaker 1: And this one's next month. And I'm wondering if they're
• 3:22
Speaker 1: going to have the cameras in the courtroom for this.
• 3:26
Speaker 1: Probably not, but they should. In a handwritten affidavit filed
• 3:30
Speaker 1: by Kohlberger this summer, the admitted murderer claimed his former
• 3:33
Speaker 1: legal team misled him and his family about the damning
• 3:36
Speaker 1: evidence before he pleaded to the heinous quadruple homicide. Oh yeah,
• 3:41
Speaker 1: they totally misled him. There wasn't a bunch of evidence
• 3:45
Speaker 1: that pointed directly to Brian Kohlberger. This dumb fuck didn't
• 3:48
Speaker 1: leave the sheath there or nothing. Nah, that didn't happen.
• 3:51
Speaker 1: They had nothing to go on. And Brian Kohlberger just,
• 3:54
Speaker 1: you know, decided to plead guilty because his legal team
• 3:57
Speaker 1: didn't know what they were doing. Does that sound logical
• 4:00
Speaker 1: to anybody? Especially when you know who his legal team was?
• 4:04
Speaker 1: And the lengths they went to get him off? But
• 4:06
Speaker 1: all of a sudden, Brian Kohlberger didn't get a fair deal?
• 4:09
Speaker 1: He didn't get a fair shake? Have you ever heard
• 4:11
Speaker 1: about Kalief Browder? You want to talk about people not
• 4:14
Speaker 1: getting a fair shake? Boy, it's Mr. Kalief Browder. Kohlberger
• 4:19
Speaker 1: alleged that coercion, disinformation, false promises, and the withholding of
• 4:23
Speaker 1: exculpatory discovery bullied him into entering a bogus plea deal
• 4:28
Speaker 1: on July 2, 2025, according to a legal petition obtained
• 4:32
Speaker 1: by the New York Times. And look, as somebody that
• 4:35
Speaker 1: followed this case from literally the day it happened, I
• 4:39
Speaker 1: don't believe that for a minute. Kohlberger and his team
• 4:42
Speaker 1: were given everything they asked for. Venue change, more money,
• 4:46
Speaker 1: more experts, you name it. And Brian Kohlberger had some
• 4:50
Speaker 1: of the best legal counsel in the whole state. But
• 4:53
Speaker 1: all of a sudden, that's not good enough? All of
• 4:55
Speaker 1: a sudden, Brian Kohlberger was coerced? Brian Kohlberger didn't know
• 4:59
Speaker 1: what he was getting into? I have no idea how
• 5:02
Speaker 1: he thinks he's going to convince the court that that happened,
• 5:04
Speaker 1: unless he has the evidence to back it up. And
• 5:08
Speaker 1: as of now, well, we have not seen that evidence.
• 5:13
Speaker 1: The killer's defense team has been moving to disqualify Hippler,
• 5:16
Speaker 1: citing remarks he made during Kohlberger's sentencing that signal He
• 5:20
Speaker 1: may not have impartiality. And move the case from Ada
• 5:22
Speaker 1: County back to Latah County, KTVB reported. And remember, it
• 5:27
Speaker 1: was reversed last time. Oh, we can't get a fair
• 5:29
Speaker 1: shake in Latah County. We have to move it to
• 5:32
Speaker 1: Ada County. I mean, give me a break. And now it's, oh, well,
• 5:36
Speaker 1: Ada County don't work. Let's go back to Latah County.
• 5:39
Speaker 1: All on the dime of the taxpayer. I'm sure that's
• 5:42
Speaker 1: exactly what people in Idaho want to do. Spend more
• 5:45
Speaker 1: money on bitch-ass Brian Kohlberger. Kohlberger's counsel claims that moving
• 5:50
Speaker 1: the case to a different county could stave off the
• 5:52
Speaker 1: media frenzy surrounding the brutal stabbings, which has made it
• 5:55
Speaker 1: difficult to find an unbiased venue, the outlet said. Oh yeah,
• 6:00
Speaker 1: everybody's biased against my client. Oh no, Brian Kohlberger, everybody
• 6:04
Speaker 1: heard the story. No shit, it's the year 2026. Everybody
• 6:08
Speaker 1: has the internet, everybody has a cell phone, everybody's on the,
• 6:12
Speaker 1: you know, doom scroll on a regular basis. You're not
• 6:15
Speaker 1: going to find people that don't know about the case.
• 6:17
Speaker 1: And that's why selecting a jury is so important. Because
• 6:20
Speaker 1: the days of finding jurors who have not been exposed
• 6:23
Speaker 1: to the information, those days are long over. And it
• 6:26
Speaker 1: really doesn't matter the case. Like, everybody's connected. And if
• 6:31
Speaker 1: there's any kind of case with any kind of publicity,
• 6:33
Speaker 1: you have to expect that people are going to be
• 6:35
Speaker 1: following along. And some of those people might be in
• 6:39
Speaker 1: your jury pool. Prosecutors already filed a motion to dismiss
• 6:43
Speaker 1: the case, stating that Koberger's own admissions in a written
• 6:47
Speaker 1: factual basis document may pose a hurdle, people reported. In
• 6:51
Speaker 1: the document, Koberger stated that he's willing to hereby admit
• 6:54
Speaker 1: responsibility for the killing of the four University of Idaho
• 6:58
Speaker 1: students in their off-campus Moscow home, the outlet said. He
• 7:02
Speaker 1: also admitted that the killing and murder of his victims
• 7:04
Speaker 1: was willful, unlawful, deliberate, with premeditation, and with malice aforethought.
• 7:11
Speaker 1: So in other words, I put thought into it. I
• 7:13
Speaker 1: premeditated it. I knew what I was doing. And then
• 7:16
Speaker 1: I murdered these four kids. That's what that means. And now,
• 7:21
Speaker 1: all of a sudden, miraculously, that's not what happened. Woke
• 7:27
Speaker 1: up one day and you decided, oh, I have a
• 7:28
Speaker 1: better idea. It wasn't me. It was Colonel Mustard with
• 7:34
Speaker 1: the candlestick. I mean, what are we doing here? Like
• 7:38
Speaker 1: he never put forward an alternate perpetrator. There was never
• 7:42
Speaker 1: any cogent argument that somebody else did this. And all
• 7:46
Speaker 1: roads pointed to Brian Kohlberger. So I don't understand what
• 7:49
Speaker 1: they think they're going to magically come up with this
• 7:53
Speaker 1: time around. Because remember, we have access to all the work.
• 7:58
Speaker 1: We've been looking at documents. We've been reading unsealed information
• 8:03
Speaker 1: from the case. And none of it looks good for
• 8:05
Speaker 1: Brian Kohlberger. And every single time that his defense... attempted
• 8:09
Speaker 1: to challenge the evidence that was provided against him, it
• 8:12
Speaker 1: literally ended up going nowhere. And I think that moving forward,
• 8:17
Speaker 1: with all of that in hindsight, the court's going to
• 8:20
Speaker 1: be very, very, very hesitant to give Brian Kohlberger what
• 8:24
Speaker 1: he wants. Now, that said, if new evidence is presented
• 8:28
Speaker 1: and he has something to show us, yo, I am
• 8:31
Speaker 1: willing to look at it. Because at the end of
• 8:34
Speaker 1: the day, it's not about Brian Kohlberger, is it? It's
• 8:37
Speaker 1: about justice for those four kids. And if Brian Kohlberger
• 8:40
Speaker 1: is not the guy who did it, then who did it?
• 8:44
Speaker 1: Who's responsible? Who should be in prison instead of you?
• 8:47
Speaker 1: I mean, look at what Karen Reid did. And at
• 8:50
Speaker 1: the very least, she had a viable, even if you
• 8:54
Speaker 1: hardly believed it, alternate perpetrator theory. Meanwhile, Brian Kohlberger, his
• 9:00
Speaker 1: alibi was that he was out staring at stars. You know,
• 9:03
Speaker 1: I like the night sky. So I was out on
• 9:05
Speaker 1: a cloudy night looking at stars. Yeah, that's a solid-ass alibi.
• 9:10
Speaker 1: That's really selling me. If I'm on the jury, buddy.
• 9:14
Speaker 1: I got bad news for you. You're about to have
• 9:15
Speaker 1: a date with the firing squad. Koberger then pleaded guilty
• 9:20
Speaker 1: in court as part of a plea deal that spared
• 9:22
Speaker 1: him the death penalty, but stipulated that he agree never
• 9:25
Speaker 1: to appeal his case, only giving him the chance of
• 9:28
Speaker 1: a new trial through a petition for post-conviction relief. If
• 9:32
Speaker 1: granted a new trial and convicted, Kohlberger will likely face
• 9:36
Speaker 1: the death penalty, the outlet said. And look, if he
• 9:40
Speaker 1: makes that stupid mistake and really tries to push this
• 9:43
Speaker 1: point home, he should be facing the death penalty. And
• 9:46
Speaker 1: I think that if they prosecute the case and it
• 9:48
Speaker 1: gets to a jury, that's exactly what we're going to see.
• 9:52
Speaker 1: Because in my opinion, and look, again, just my opinion,
• 9:56
Speaker 1: everything that we've seen so far points directly to Brian Kohlberger.
• 10:02
Speaker 1: And when something looks like a duck, walks like a duck,
• 10:05
Speaker 1: and quacks like a duck, well, chances are it's not
• 10:08
Speaker 1: a fucking tiger, right? So unless Brian Kohlberger has something
• 10:12
Speaker 1: new to share, some sort of revelation that none of
• 10:16
Speaker 1: us are aware of, then I think that he's just
• 10:18
Speaker 1: spinning his wheels in neutral. But in a month from now,
• 10:21
Speaker 1: when we have this hearing, we should learn a little
• 10:24
Speaker 1: bit more. And like usual, once we have that information,
• 10:28
Speaker 1: we'll get it updated in the catalog. All the information
• 10:32
Speaker 1: that goes with this episode can be found in the
• 10:34
  Speaker 1: description box.
