- 2:22appeals for new trial following last week's guilty verdict by
- 2:26Peter W. Zabatti Paston Media Group June eleventh, twenty twenty five.
- 2:32Stephen Lawson was found guilty May thirtieth for his role
- 2:35in the twenty fifteen disappearance and presumed death of Crystal Rodgers. However,
- 2:40it didn't end altogether when a jury recommended a seventeen
- 2:44year sentence. On Wednesday, Attorneys Darren Wolf and Zach Buckler,
- 2:49who represented Lawson in the four day trial in Bowling Green,
- 2:52filed a motion in Nelson's Circuit Court requesting a new
- 2:57trial or an acquittal, claiming Lawson was denied a fair trial.
- 3:01Lawson was sound guilty in Warren's Circuit Court, where the
- 3:04trial was moved in order to secure a jury pool
- 3:07untainted by extreme media coverage of the case of conspiracy
- 3:11to murder and complicity to tampering with physical evidence. In
- 3:15the motion, lawson attorney's claimed the court did not provide
- 3:20proper jury instructions in accordance with Kentucky wall with the
- 3:24charge of conspiracy to murder, leading confusion by the jury.
- 3:29The court quote aired by prohibiting the descendant from testing
- 3:33two hairs found in Crystal Rogers car in twenty fifteen,
- 3:37and to quote, attorneys argued during the case that by
- 3:40testing the hairs, another suspect in her disappearance could have
- 3:43been identified through national DNA databases, that quote proper decorum
- 3:49and to quote was not observed during the trial, and
- 3:53that jurors were potentially influenced.
- 3:55Speaker 2: The rule against Lawson.
- 3:56Speaker 1: Noting the number of pink shirts worn by family and
- 3:59friends of Rogers and how that tied into the quote,
- 4:03team crystal ended quote movement, but the defense team wasn't
- 4:08provided enough time to review all the evidence in advance
- 4:11of the trial, and that Nelson's circuit Judge, Charles Simms
- 4:14the Third did not accede to their request to delay
- 4:18the trial. The evidence provided by the prosecution exceeded four
- 4:22hundred thousand pages of written documents and hundreds and hundreds
- 4:27of hours of audio and video recording. Wolf and Buckler
- 4:30were brought on to the case last summer after Lawson
- 4:34fired his original attorney, Ted Babbitt, that Elizabeth Chesser, a
- 4:38witness for the prosecution, spoke with Roger's mother, Sherry Ballard
- 4:42during a court recess while she was under oath. They
- 4:45also alleged that statements made during Chester's testimony proved prejudicial
- 4:50to Lawson.
- 4:51Speaker 2: Chester had a child by.
- 4:53Speaker 1: Lawson's son, Joseph, who goes on trial later this month,
- 4:56and Chesster's mother had been dating Stephen Lawson. In the
- 5:00asked that when text messages between Stephen and Joseph Lawson
- 5:04were read and viewed during the trial, Simms did not
- 5:08properly instruct the jury to consider Joseph Lawson's text as hairsay,
- 5:13that the trial schedule was quote problematic, and that quote
- 5:17it appeared to be descendant that there was urgency to
- 5:20have the trial concluded by Friday so as to prevent
- 5:23the jury from having to return on Monday, end of quote.
- 5:27Wilson Butler stated in the motion that the jury, during
- 5:30its three hour deliberation time quote failed to deliberate the
- 5:34nuances of this case, end of quotes, that the Commonwealth,
- 5:38led by Special Prosecutor Shane Young, did not provide direct
- 5:41evidence that Stephen Lawson entered into an agreement with accused
- 5:45murderer Brooks Howck to kill Rogers, and that it did
- 5:48not prove beyond a reasonable doubt that Lawson participated in
- 5:52the conspiracy.
- 5:53Speaker 2: Because of these.
- 5:54Speaker 1: Reasons, Wilson Buckler claimed that Lawson's rights were denied in
- 5:58accordance with Section two of the Kentucky Constitution. And the
- 6:01due process clause of the fourteenth Amendment to the US Constitution.
- 6:05They are asking for a new trial for Lawson on
- 6:08it or a judgment notwithstanding the verdict. Brooks Houck, Roger's
- 6:12ex boyfriend, is charged with murder and tampering with evidence,
- 6:16and Joseph Lawson, like his father, is charged with conspiracy
- 6:19to murder and complicity to tampering with physical evidence. Their

- 21:37haven't seen him since high school graduation in nineteen seventy five, which,
- 21:41using that edcumation I got, is fifty years ago. Man,
- 21:46how often can you say I haven't seen you.
- 21:48Speaker 2: In half a century? That there you go.
- 21:51Speaker 1: One day I was seventeen, and the next day I
- 21:53was sixty seven. I changed from a nerdy, little stooped over,
- 21:56snotty nosed boy into a nerdy, little stooped over say knows,
- 22:00old man, All things being equal, I think I like's
- 22:03being the little boy better.
- 22:05Speaker 2: But be that as it may.
- 22:07Speaker 1: We were talking about Bruce. I saw Bruce at a
- 22:09checkout line and immediately ran over to greet him. I
- 22:13looked at him and said, hey, Bruce, is me How
- 22:15are you doing? I haven't seen you since graduation. How's
- 22:18that beautiful.
- 22:18Speaker 2: Wife Sharon doing.
- 22:20Speaker 1: Bruce looked a bit puzzled at first, and said, I'm sorry, sir.
- 22:23Speaker 2: Do I know you?
- 22:25Speaker 1: Yeah? We went to school together at WCHS. You look
- 22:28to be quite a few years older than me. You
- 22:30sure you're not thinking about my dad, old timer? What
- 22:33the heck? It's me, Bruce, Kenny Begley, Remember, good grief, Kenny.
- 22:38What happened to you? Were you sick or in a

- 22:43used to just be a nerdy little souped Yeah, yeah, yeah,
- 22:46I've already gotten over that part. But thank the good Lord,
- 22:48I ran into you. I've got big news for you.
- 22:51I've already heard about the nineteen seventy five class reunion.
- 22:55This September. We're having a reunion. Yeah, what were you
- 22:59going to tell me about? I've got fifty years worth
- 23:02of stories for you. Shouldn't take more than five or
- 23:05six hours to vomit them all out on you. Don't
- 23:08worry about adding to the conversation. I can handle both ends.
- 23:11Oh my gosh, now I remember you. You can talk
- 23:14up to ninety miles per hour with dust, but to
- 23:16one hundred. What have I done to deserve this? It's
- 23:20just a lucky day, I guess, by the way, I
- 23:22can get up to one hundred and ten now with
- 23:24half a century of practice. I don't think I've got
- 23:27that much stamina. Kenny, Well, did you say Sharon is
- 23:30in the car? Maybe I could go talk to her.
- 23:32Wait a minute, I don't see her.
- 23:33Speaker 2: Now. Where did she go?
- 23:35Speaker 1: Probably stooped down looking for a lost contact. She's always
- 23:39losing them. Better get back to the house so we
- 23:41can help her find it. Hey, I didn't think Sharon
- 23:44wore glasses. Say, are you trying to get rid of me?
- 23:47But it was too late. Bruce had already gnawed his
- 23:50foot off where I was holding him and stumped back
- 23:53to the car in a flash, then whirled away down
- 23:55the road. Well, shoot, I used to be better at
- 23:58holding an audience's leg if not their attention, Maybe Bruce
- 24:02and Shearing will sit with me and Cindy at the reunion.
- 24:04Speaker 2: I have lots of stories to tell them. Cindy likes to.
