- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robinson prelim hearing from day one.
- 0:10Speaker 1: Judge Graff, all right. Given my previous rulings on exhibits,
- 0:14Speaker 1: I apply the same analysis and find that state exhibit 12.2,
- 0:17Speaker 1: I believe, is admitted over the objection and may be
- 0:20Speaker 1: published in the courtroom and by the media if so chosen. Prosecution. Okay,
- 0:25Speaker 1: so before we play the video again, what is it
- 0:27Speaker 1: that leads you to believe that That, this is Mr. Robinson. Answer.
- 0:32Speaker 1: The shape of the vehicle can clearly be seen as
- 0:34Speaker 1: it pulls up, and the distinctive wheels on the vehicle also. Question.
- 0:39Speaker 1: We'll go ahead and play it. Judge Graff, is there
- 0:41Speaker 1: any sound associated with this? Answer. There is, Judge, but
- 0:44Speaker 1: it's night sounds. It's crickets chirping. Judge Graff. Okay, I
- 0:48Speaker 1: just wanted to see if there was. I just wanted
- 0:50Speaker 1: to see if there was sound or not. Prosecution. Okay. Judge,
- 0:54Speaker 1: all right, you may play the video. Prosecutor. So, on
- 0:58Speaker 1: the first part of that video, what do you see? Answer,
- 1:00Speaker 1: the vehicle, we believe to be driven by Mr. Robinson,
- 1:04Speaker 1: pulling up to the parking in front of, across the street,
- 1:07Speaker 1: but in front of the residence. Question okay. And the
- 1:10Speaker 1: next video, what do you believe, is displayed in that video? Answer,
- 1:15Speaker 1: there's an individual who gets out of the vehicle, you
- 1:17Speaker 1: can hear the door close, and then that individual moves
- 1:20Speaker 1: away from the front of the vehicle. There's actually two
- 1:22Speaker 1: reflective panels on a dumpster, and you can see the
- 1:25Speaker 1: individual moving Pass those reflective panels. Question. And the last
- 1:31Speaker 1: of those series of videos? Answer. The second to last one,
- 1:34Speaker 1: the individual comes back across those reflective panels to the vehicle,
- 1:38Speaker 1: unlocks the vehicle, and gets into it. And then, in
- 1:41Speaker 1: the last video, the vehicle is started and the individual
- 1:44Speaker 1: drives away. Prosecution. Just one moment, Judge. Judge Graff, yes. Prosecution. Judge,
- 1:52Speaker 1: could we approach? Judge Graff, you may. Now the judge announces,
- 1:57Speaker 1: ladies and gentlemen, we're going to take a 10-minute break
- 1:59Speaker 1: for the attorneys to confer and come back at, well,
- 2:02Speaker 1: roughly 4.30. So court is in recess. Now they come back.
- 2:07Speaker 1: Judge Graff seats them. And the prosecutor has some more questions. Judge,
- 2:12Speaker 1: I think I just have a couple of questions for
- 2:14Speaker 1: Sergeant Hull to finish out the day. I think we're
- 2:16Speaker 1: in agreement that once we've sorted out these few questions,
- 2:20Speaker 1: we're all in agreement. We want a break for the day.
- 2:22Speaker 1: Is that right, Ms. Nestor? Kathy Nestor? Me and you. Prosecutor. Well, sure.
- 2:29Speaker 1: Judge Graff, you may proceed with your questions and we'll
- 2:32Speaker 1: take it from there. Question. All right. Agent Hall, I
- 2:36Speaker 1: asked you earlier after you had testified about all the
- 2:39Speaker 1: video that you've watched and video that you believe depicts Mr.
- 2:43Speaker 1: Robinson from the UV surveillance and that combined with the
- 2:46Speaker 1: driver's license and the DMV records. whether or not you
- 2:50Speaker 1: believe that the person that you have seen in the
- 2:52Speaker 1: video and on the driver's license record is in the
- 2:55Speaker 1: courtroom today, and I believe your answer was yes. Answer, yes,
- 3:00Speaker 1: that's correct. Question, and then I asked if you wouldn't
- 3:03Speaker 1: mind pointing him out and describing something that he's wearing,
- 3:06Speaker 1: and I don't believe that I allowed you to do that. Answer, okay. Question,
- 3:11Speaker 1: would you do that right now? Kathy Nestor jumps in,
- 3:13Speaker 1: Your Honor, just for the record, we would impose an
- 3:16Speaker 1: objection based on the 14th Amendment. for a due process
- 3:19Speaker 1: due to an unduly suggestive in-court ID. Also, we believe
- 3:24Speaker 1: there's a lack of foundation establishing his ability to interpret
- 3:27Speaker 1: the surveillance video, and based on that, we would object.
- 3:31Speaker 1: Judge Graff, all right, well, to the state, do you
- 3:33Speaker 1: wish to be heard on what was just stated? Answer, well, Judge,
- 3:37Speaker 1: I think we had this discussion, and I think you
- 3:39Speaker 1: ruled on that specific objection. And then after you ruled,
- 3:43Speaker 1: I just neglected to come back and follow through with
- 3:45Speaker 1: the question and the answer. That's my recollection of the
- 3:48Speaker 1: bench meeting. Judge Graff, I believe I stated for the
- 3:51Speaker 1: purpose of this hearing that identification by Agent Hull of Mr.
- 3:54Speaker 1: Robinson was made. Prosecution, well, I just wanted to clarify that, Judge,
- 3:59Speaker 1: because there was some question about whether that, in fact,
- 4:02Speaker 1: did happen. And so if that's your recollection of what happened,
- 4:05Speaker 1: and if you're willing to put on the record that
- 4:07Speaker 1: Agent Hull was identified the defendant, I think we're done.
- 4:11Speaker 1: Judge Graff, does the defendant want to be heard? No,
- 4:15Speaker 1: Your Honor. Judge Graff, well, for the benefit of the
- 4:17Speaker 1: record and for thoroughness, if you wish to re-ask the question,
- 4:20Speaker 1: you certainly, well, we can see what happens. Prosecution, if
- 4:25Speaker 1: you could hold, Judge, I'd like to. Would you please
- 4:27Speaker 1: point him out and identify something that he's wearing? Answer, yeah.
- 4:31Speaker 1: I believe that Mr. Robinson is between Ms. Nestor and
- 4:34Speaker 1: the other counsel wearing a gray suit, a jacket with
- 4:37Speaker 1: a dark tie, and a light-colored shirt. Question, Judge, I
- 4:42Speaker 1: would like to ask for the record to reflect that
- 4:44Speaker 1: Agent Hull has identified the defendant. Prosecution, I mean, I
- 4:49Speaker 1: made my objection already. Judge Graff, okay, I just wanted
- 4:52Speaker 1: to check. Defense, no, thank you, Your Honor. Judge Graff,
- 4:56Speaker 1: all right, for the purposes of this hearing, I find
- 4:59Speaker 1: that Agent Hull has identified Mr. Robinson. Again, this is
- 5:03Speaker 1: only for the prelim hearing. You may proceed. Prosecution, Judge,
- 5:07Speaker 1: I think for today with Agent Hull, we're done for today.
- 5:10Speaker 1: We'd ask at this point, we take a break until tomorrow.
- 5:13Speaker 1: Judge Graff, all right, so are you saying that you're
- 5:16Speaker 1: going to recall Agent? Well, we're going to resume with Mr.
- 5:19Speaker 1: Hull tomorrow morning. Answer, tomorrow morning. And I was going
- 5:22Speaker 1: to explain this, but let me explain why. Judge, our
- 5:25Speaker 1: intent is to prepare an original version of the video
- 5:28Speaker 1: that's been in dispute today without the circles, without the blur,
- 5:32Speaker 1: and without the zooming in. And our intent is to
- 5:35Speaker 1: introduce that tomorrow as a different exhibit, and we just
- 5:38Speaker 1: can't prepare that in the next hour or so. So
- 5:40Speaker 1: we're just going to need the evening to prepare the
- 5:43Speaker 1: exhibit And we'd like to return with that. Judge, I
- 5:46Speaker 1: would also suggest... Well, I guess let me get your
- 5:48Speaker 1: take on that, Judge. Judge Graff, all right. Does the
- 5:51Speaker 1: defense wish to be heard about the ending for today?
- 5:54Speaker 1: We have about 19 minutes until 5. What's the defense?
- 5:58Speaker 1: The defense jumps in. Your Honor, we're happy to accommodate
- 6:01Speaker 1: the state on that. Judge Graff, all right. So for today,
- 6:04Speaker 1: Agent Hull, you may step down and we'll resume with
- 6:07Speaker 1: your testimony tomorrow morning. Anything further? Prosecution? Well, Judge... Just
- 6:13Speaker 1: one other thing, and it's a suggestion. Kathy Nestor, Agent Hull,
- 6:17Speaker 1: can you wait just one second? I'm sorry, go ahead. Prosecution,
- 6:21Speaker 1: I'm sure Ms. Nestor may have a position with regards
- 6:24Speaker 1: to this, but Judge, we would invite you to review
- 6:26Speaker 1: the exhibit that we've been talking about today. It is 12.1.
- 6:30Speaker 1: We suggest that you look at it between today and
- 6:33Speaker 1: tomorrow because our intent is to seek to admit the
- 6:36Speaker 1: version where it doesn't have the circle or the blur
- 6:39Speaker 1: or the zoom-in. And if that's admitted, we do intend
- 6:42Speaker 1: to introduce that exhibit 12.1 as well. And I think
- 6:45Speaker 1: it would be helpful if you saw that in advance,
- 6:48Speaker 1: and you could compare that to the version that doesn't
- 6:50Speaker 1: have the circle, the blur, and the zooming in. I
- 6:53Speaker 1: would ask that you do that. I don't know if Ms.
- 6:55Speaker 1: Nestor has a different opinion about that, but I think
- 6:58Speaker 1: it would be helpful in determining whether or not that
- 7:00Speaker 1: particular exhibit 12.1 is admissible. Judge Graff, Ms. Nestor, Kathy Nestor,
- 7:07Speaker 1: I don't have anything to add to that. I defer
- 7:09Speaker 1: to what the court prefers to do on that. I
- 7:11Speaker 1: do have another matter before Agent Hull is released that
- 7:14Speaker 1: I do want to address with the court, but I
- 7:16Speaker 1: don't have any concern if the court wants to look
- 7:18Speaker 1: at it in advance. It's kind of a long bit
- 7:21Speaker 1: of a long video. I think it's just about five minutes, maybe.
- 7:24Speaker 1: It's not very long, so if you want to wait
- 7:26Speaker 1: until tomorrow, it's not going to slow the matter down
- 7:29Speaker 1: very much, but it's up to the court on that.
- 7:31Speaker 1: Judge Graff, all right, I appreciate the party's What I'm
- 7:35Speaker 1: going to do is I'm going to wait until it's
- 7:37Speaker 1: properly before me and a motion has been made for
- 7:39Speaker 1: either of the videos and I'm happy to entertain the
- 7:42Speaker 1: motion to review both of them or however the parties.
- 7:45Speaker 1: I don't want to issue a pre-ruling, so I'll wait
- 7:48Speaker 1: till it's properly before me and I can take it
- 7:51Speaker 1: from there. Being that it's about five minutes, I'm not
- 7:54Speaker 1: too concerned about how much time is needed. I also
- 7:57Speaker 1: want to be thorough, so I'll wait till it's brought
- 7:59Speaker 1: before me and we can address it from there. and
- 8:03Speaker 1: turning to Ms. Nestor as it relates to your request.
- 8:06Speaker 1: Kathy Nestor. Thank you, Your Honor. Your Honor, I recognize
- 8:09Speaker 1: that Agent Hull is a case agent and is working
- 8:12Speaker 1: with the state preparing for this, but he's still on
- 8:15Speaker 1: the stand, and I would ask that he be instructed
- 8:17Speaker 1: that he can't discuss his testimony. Even though he's a
- 8:20Speaker 1: case agent, I don't think it's proper for him to
- 8:22Speaker 1: discuss his testimony while he's excused for the night. Judge Graff. Agent.
- 8:29Speaker 1: Reply by the agent. It's not a problem, Judge. Judge Graff,
- 8:32Speaker 1: all right, so agent, from this moment on until we
- 8:34Speaker 1: come back in court, you're instructed not to discuss your
- 8:37Speaker 1: testimony with anyone as you are still on the stand
- 8:40Speaker 1: for all intents and purposes. And if the state recalls
- 8:43Speaker 1: you this tomorrow morning, then we'll proceed, okay? Agent, okay,
- 8:48Speaker 1: Your Honor. Judge Graff, all right. May this witness be excused?
- 8:53Speaker 1: Kathy Nestor, for now, Your Honor. Judge Graff, for today,
- 8:56Speaker 1: all right. Thank you, Agent Hull. Anything further from the parties,
- 9:00Speaker 1: or do either party need the benefit of the record
- 9:02Speaker 1: before we adjourn? Kathy Nestor, no, Your Honor. Prosecution, not
- 9:07Speaker 1: from the state judge. Judge Graff, all right. Noting that
- 9:12Speaker 1: neither party wishes the benefit of the record, court is
- 9:14Speaker 1: in recess until 9 a.m. tomorrow morning. All rise. Okay,
- 9:19Speaker 1: so we're going to cut it short here, a little
- 9:21Speaker 1: bit shorter than our usual 10, 12, 15 minutes, but
- 9:25Speaker 1: I want to try and keep it uniformed. And we'll
- 9:26Speaker 1: start day two. in the next episode dealing with the
- 9:30Speaker 1: topic nice and fresh. All the information that goes with
- 9:34Speaker 1: this episode can be found in the description box.
