Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
0:05
One of the biggest issues when we're talking about travesties
0:08
of justice within the world of Jeffrey Epstein is most
0:12
certainly the Plea Deal. How he was able to acquire
0:17
that Plea deal has been the source of much debate
0:22
and of much contention. But the fact is he received
0:26
that Plea deal, and that deal, well, there is no
0:29
other deal like it. Nobody else ever has gotten a
0:34
deal like Jeffrey Epstein. So ask yourselves, how is it
0:38
that he is worthy of getting such a deal? What
0:41
makes him so special? Well, when you're hanging out with
0:46
the people he was hanging out with, and you're breaking
0:50
bread with some of the most powerful and influential people
0:54
in the world, you end up getting a deal that
1:00
nobody else would ever ever get. And that's certainly what
1:05
happened when Epstein scored this sweetheart deal down in Florida. Today,
1:12
we're going to read an article from Noreen Marcus over
1:15
at the Florida Bulldog dot org talking about how this
1:19
is a cushy deal and how it's the only one
1:22
of its kind in South Florida. Ever, So let's get
1:27
into this article and let's see what Noreen Marcus has
1:32
to say. Headline, Jeffrey Epstein's cushy federal deal was the
1:37
only one of its kind in South Florida for at
1:40
least three decades, and ever right when you look at it,
1:45
there was no one who ever got a deal like this.
1:48
But somehow this disgusting, gross child molesting son of a
1:54
bitch comes out with the sweetest deal in the history
1:59
of sweet deals. Now, remember how many larger than life
2:03
criminals have been down in Florida, got all kinds of
2:06
mob guys, drug narco professionals, you name it, and none
2:11
of them caught deals like this. What makes Epstein so special?
2:16
The sickly sweet deal that lawyers for serial sex offender
2:19
Jeffrey Epstein worked out with South Florida federal prosecutors veered
2:24
so far off the beaten path it blazed a path
2:28
of its own. There is no doubt about that this
2:32
is going to be studied in law classes and in
2:35
the law profession for years to come. It's going to
2:38
be a case study in not how to handle yourself.
2:43
This is a deal that should have never been signed
2:45
off on, and say it was Acosta right, Oh, it
2:48
was all Acosta's fault. Then where was his boss to
2:51
come in and say, look, you can't do this. This
2:53
deal's terrible, my friend. There was nobody to step in
2:57
and do that. You know why, because those on high
3:00
Acosta's bosses, they wanted this deal to get done. Over
3:05
the last twenty nine years, three non prosecution agreements npa
3:10
NPAs the kind of deal Epstein got, went to big
3:13
companies in the Southern District of Florida, according to a
3:17
list compiled by the University of Virginia and Duke Law Schools.
3:22
So only to a company, only to companies, not to
3:26
personal individuals, and certainly not to unnamed individuals. How the
3:31
hell do you even get that part that provision put
3:34
in to a contract like this, To a non prosecution agreement,
3:40
you would literally have to be using the Jedi mind
3:42
trick like ben Kenobi. But since no company executive was
3:49
accused of anything close to Epstein's level of depravity, his
3:53
deal appears to be one of a kind. His informal
3:57
criminal enterprise that preyed upon teenage girls had no name
4:01
to include in the law school's corporate prosecution registry. Oh
4:05
that's easy. Jeffrey Epstein's criminal enterprise. We can just call
4:09
it that, right, or if you want, we can go
4:11
a step further. The Epstein crime family. How about that.
4:15
We love to slap monikers on people and call them
4:17
crime families, right, Well, why not call these guys the
4:20
same thing, because that's what they were. They were facilitating
4:25
all sorts of crimes, money laundering, human trafficking, wire fraud, threats, solicitation,
4:35
you name it, these people were into it. Out of
4:39
one hundred and ninety Southern District federal cases that were
4:43
resolved before trial from nineteen ninety two to this year,
4:48
the list shows eighty six percent resulted in pleas, not
4:52
including the Epstein affair, Only three of the cases, or
4:56
one point six percent, ended with non prosecution agreements. Now, look,
5:02
very rarely does the federal government give out a non
5:05
prosecution agreement when they have you bent over a barrel.
5:10
They love to get their convictions, don't they in federal court?
5:13
And that you see it here. Eighty six percent resulted
5:17
in plead deals. Eighty six percent. Eight out of ten
5:20
people said, I can't beat the federal government at trial,
5:23
so I'm just gonna plead out, not Epstein, he gets
5:27
himself a nice non prosecution agreement that covers him, his
5:32
co conspirators, the Core four, and any unnamed co conspirators
5:36
as well. Now, however the hell they whipped that one up,
5:41
I'll need it explain to me how the federal government
5:44
and the state government signed off on it. They are
5:50
rarer than Hen's teeth, and Hens have no teeth, said
5:53
criminal defense lawyer Joel Hershorn. During a fifty three year career,
5:58
he has yet to negotiate us single one. Think about that, folks, Okay,
6:03
do you really think mister Hirshorn here is not a
6:06
good lawyer? That he can't you know, he doesn't know
6:09
his way around a courtroom. And on the flip side,
6:13
you think Dershowitz is that good in the courtroom or
6:16
left court or left Kowitz. Of course they aren't. You
6:20
think it's just happened to be a coincidence that they
6:23
had all these guys from Kirkland and Ellis working on
6:26
that law team, guys like ken Starr with extreme political reach,
6:31
because that's what you're paying for if you have the
6:34
right amount of money, you're paying for influence. Whereas me
6:38
or you, we're just looking to get a lawyer, and
6:40
we hope we get a plea deal that doesn't send
6:42
us to prison for the rest of our lives. A
6:46
special deal for Jeffrey Epstein alone. The three companies on
6:50
the Southern District's NPA list are Jakova now Wells Fargo
6:55
accused of anti trust, Republic Metals Corporation accused of money laundering,
7:00
and but Tom Holdings accused of securities fraud. The deals
7:04
all followed some combination of hefty fines, long prison sentences
7:08
for company executives, or cooperation with other probes. And that
7:14
is the rub right. We know that Epstein was an informer.
7:17
We know he was working for the government, and all
7:19
these people that want to act like he wasn't explain
7:22
to me how he always got off whenever he got
7:25
caught doing something wrong. I call it the Whitey Bulger effect,
7:29
and we see it with Epstein time and time again.
7:35
But a cushy deal like the late Epstein's is virtually
7:39
unheard of. The Use of an MPa against an individual
7:43
is very rare, said Miami trial lawyer Marcos Yemenez, who
7:47
was the US Attorney in South Florida from two thousand
7:50
and two to two thousand and five. Sounds like a
7:53
guy who would know what he's talking about. But nah,
7:56
this is just this is your everyday behavior. And that's
8:00
why it's laughable that the appeals court would look at
8:04
this and just be like shrug their shoulders and be like, nah,
8:07
you know, we're just gonna let this stand. It's an abomination.
8:15
Yemenez told The Florida Bulldog he doesn't remember authorizing any
8:19
kind of NPA. The law school's list in media reports
8:23
confirm his recollection. I can't think of a baring of
8:27
a bar to doing it. It's just that I've never
8:30
seen it done in any other instance than for Epstein,
8:34
said former Miami prosecutor Richard Gregory, who retired in twenty
8:38
eighteen after forty two years with the Justice Department. He
8:43
also worked in Massachusetts, Rhode Island, New Jersey, and Connecticut.
8:50
So who's the one that's bullshitting you, folks? The people
8:54
that want you to believe that this is just a
8:56
common everyday occurrence that criminals get deals like this, or
9:01
are you going to believe the actual facts that are
9:03
in front of your face because the official narrative that
9:06
they want you to suck down is just filled and
9:10
riddled with holes protecting mystery co conspirators. Jeffrey Epstein's off
9:17
the charts packed let him avoid federal charges that carry
9:21
serious prison time. Prosecutors prepared but never filed, a fifty
9:26
three page indictment describing his criminal activities with underage girls
9:31
that could have put Epstein away for life, and we
9:34
all know how that ended up. Ah, we'll punt it
9:36
down to state they he'll get the he'll get the easier,
9:39
softer charges. Unlike standard NPAs, his carefully crafted version even
9:45
protected any potential co conspirators, prompting speculation about former Presidents
9:51
Bill Clinton and Donald Trump, Britain's Prince Andrew, and other
9:55
powerful men in Epstein's social circle. Well, we see that
10:01
Andrew tried to use this clause and it didn't work
10:04
out for him in New York. He got sued anyway.
10:07
But criminally speaking, this is a big roadblock from justice
10:12
being served in this case. None of them has been
10:16
charged in connection with Epstein. Only his ex girlfriend, co conspirator,
10:20
fellow child abuser, general all around scusbag and bipedal serpent
10:24
Glene Maxwell is being prosecuted in New York for allegedly
10:28
procuring young girls for him to abuse. Now we all
10:31
know that it's not prosecuted anymore. She has been convicted.
10:36
Gregory had nothing to do with the Epstein case and
10:39
wouldn't speculate about a possible accomplices, but said he's amazed
10:43
and astounded by the NPA clause granting immunity to hypothetical
10:48
co conspirators. Again, you really think that Acosta has the
10:52
power to sign off on something like this when Epstein
10:55
from mansion to jail suicide. I have never heard of
10:58
a case where an NPA extent did the people who
11:01
haven't been investigated or charged yet, Gregory said, it just
11:04
doesn't make sense if you were getting cooperation from someone
11:08
who would provide you with leads to take a case
11:10
to a much higher or significant person, or was opening
11:14
up the case to a much broader range of criminal
11:17
activity that might lead to this kind of agreement. He said, well,
11:21
we know it didn't. This all happened because Epstein and
11:25
his lawyers had friends on high. The Justice Department was
11:29
littered with creatures who were friendly with Dershowitz and ken
11:33
Starr and the rest of these guys. But how could
11:38
an unknown co conspirator, barter for immunity from prosecution. Yet
11:44
in exchange for extra extraordinary largess from the Feds, Epstein
11:48
pleaded guilty to too low level state prostitution offenses and
11:54
funded a victim's compensation pool. The government shut down a
11:58
grand jury that might have outed others in his sex ring.
12:02
Jeffrey Epstein got an eighteen month sentence, but served a
12:06
little over a year, mostly working on work release near
12:10
his Palm Beach estate. Ten years later, the wealthy financier
12:14
Pedophile died in a Manhattan jail cell in an apparent
12:18
suicide while awaiting trial for sex trafficking in New York.
12:22
Acosta's poor judgment cost him. Look for me again, don't
12:26
even I don't buy that for a second. His cowardice
12:29
cost him. If my boss ever came to me with
12:32
this kind of proposal and I had all of these
12:34
girls that I had been investigating to see if their
12:38
claims were true, and I had this evidence that it
12:40
was zero chance that I'd be okay with this, I'd
12:43
raise such a stink that I'd end up getting fired
12:46
and all of it. Because there are some things you can,
12:49
you know, look the other way. Not something like this.
12:54
Signing off on the notorious two thousand and seven Epstein
12:57
deal came to haunt Alex Acosta, the US attorney after Yemenez.
13:02
Following publication of a Miami Herald series about the Epstein
13:06
case that threw renewed light on his NPA, then Labor Secretary,
13:10
Acosta resigned in two thy nineteen. Very convenient fall guy. Huh,
13:16
they love their low hanging fruit. Yemenez said he agrees
13:20
completely with a finding by DOJ regulators that the NPA
13:24
was a flawed mechanism for satisfying the federal interest that
13:28
caused the government to open up the Epstein investigation in
13:31
the first place. The finding appeared in a November twenty
13:35
twenty report by the Department's Office of Professional Responsibility. It
13:40
concluded Acosta showed poor judgment when he approved the Epstein NPA,
13:45
but didn't violate professional norms, largely because none apply. And
13:50
you know, it's convenient, right that the emails during this
13:53
whole entire time of Acosta to his superiors, Oh, they
13:56
just went missing, right, Just a very convenient fact for
14:00
the other people who were involved in the decision making.
14:03
Here fall Guy Acosta. Right next to his name pencil.
14:08
In fall, Guy Yemenez expressed reluctance to criticize his successor. Still,
14:17
he said he agrees that Acosta exercised faulty judgment NPA's
14:22
rob's victims of rights. Earlier this month, the discredited deal
14:27
resurfaced when a federal appeals court ruled against Courtney Wilde,
14:31
who says Jeffrey Epstein began molesting her when she was fifteen.
14:36
The US Crime Victims' Rights Act says survivors must be
14:40
notified about about and participate in negotiations between prosecutors and defendants.
14:47
But prosecutors hid the Epstein NPA document for several months
14:52
until he pleaded guilty, avoiding any objections to its lenient terms. Imagine,
14:58
these guys hid this document when they're not allowed to
15:02
do that by law, and still no repercussions. Nobody held responsible,
15:07
and the deal is allowed to stand. Now, you tell
15:10
me where the equitable justice is. But the Eleventh Circuit
15:16
Court said the law supports victims only after charges are filed.
15:20
Since Acosta agreed to the NPA and no charges were
15:24
ever filed in that case against Epstein, Unfortunately, that was
15:28
that allowing judges to protect victims rights earlier in the
15:31
process would intrude on the prosecutor's discretion. The majority ruled
15:36
in an opinion published on April fifteenth, the courts would
15:40
be empowered to issue injunctions requiring consultation with victims. To
15:44
name just a few examples before law enforcement raids, warrant applications, arrests,
15:51
witness interviews, lineups, and interrogations. Judge Kevin Newsom wrote for
15:55
the majority, I'll give me a break, Judge Kevin Newsom,
16:00
wasn't he the same guy that was hanging out with
16:02
Christian Everdell? Yeah? I believe so. Two dudes, just two
16:06
guys hanging out. No conflict of interest. Wait what they
16:11
both want to Harvard together? Come on, still no conflict
16:13
of interest? Right right? Dissenters call the deal travesty. The
16:20
seven or four decision from the full US Court of
16:23
Appeals for the Eleventh Circuit may end Wild's thirteen thirteen
16:27
year pursuit of justice, though her lawyers planned to an
16:30
appeal to the US Supreme Court, we know that failed. Unfortunately,
16:36
four Eleventh Circuit Court judges dissented. Those judges, all women,
16:40
skewered the Epstein NPA and assailed the dramatic increase in
16:45
all kinds of pre indictment agreements over the last fifteen years.
16:50
Not one single dude, not one single man of those lawyers,
16:55
I mean judges, dissented. What an embarrassment? And you mean
17:00
to tell me not one of you guys thought what
17:02
happened here was disgusting. Maybe you need to do more research,
17:06
maybe you need better clerks. The majority's ruling leaves federal
17:12
prosecutors free to engage in the secret plea deals and
17:16
deception that resulted in the travesty here. Judge Frank mays
17:20
Holl wrote, it also exasperates disparities between wealthy defendants and
17:25
those who cannot afford to hire well connected and experienced
17:29
attorneys to negotiate favorable deals for them. She wrote, So
17:34
will there be another Epstein like travesty? I would hope
17:38
that it never happens again, and I don't think that
17:42
it will, Yeomenez said, folks, Look, how much more do
17:46
we have to explain it? This was a travesty of
17:50
epic proportions, and your courts, at every step along the way,
17:56
have sided with Epstein his friends. And this discuss ass
18:00
deal I'll leave you with that to think about for
18:05
a little while, and as for me, well, I'll be
18:08
back later on. If you'd like to contact me, you
18:11
can do that at Bobby Capucci at ProtonMail dot com.
18:15
That's Bobby cap you Cci at ProtonMail dot com. You
18:22
can also find me on Twitter at Bobby underscore cap
18:28
you Cci. The link that we discussed can be found
18:31
in the description box. And welcome back to the Epstein Chronicles.
18:36
As you're all aware, we are at the Christmas break
18:39
for the trial, so obviously there's nothing groundbreaking happening in
18:44
the mornings or even in the evenings at this point.
18:47
But that's okay because we're still going to be here
18:50
adding some context, and we're going to do that today
18:54
by talking about the Grand Jerry transcripts from Palm Beach. Now,
19:00
there was a lot of talk a few weeks ago
19:03
that this judge was going to release these grand jury transcripts,
19:08
and that would have been a huge boost in the
19:11
arm for transparency. We all know that whatever went on
19:16
in that grand jury room in two thousand and six,
19:21
it was not good, all right, Whatever was going on
19:24
in that grand jury room based on that arrest was
19:29
not up to par. And the fact that only one
19:32
of those girls was able to give their story in
19:36
front of the grand jury tells you everything you need
19:39
to know about the prosecutors and about the whole entire
19:45
scenario that unfolded this prosecution of Jeffrey Epstein. The original
19:53
prosecution was legitimately one of the biggest travesties of justice,
19:59
perhaps ups Ever, when you look at the grand scope
20:04
of it all, and you look at the disgusting nature
20:09
of his crimes and the wake of misery he left,
20:14
I mean, it's hard not to look at it like that.
20:20
And the fact that Barry Krisher and the State Prosecutor's
20:24
office in Florida worked hand in hand with Dershowitz and
20:27
Leftkowitz and the rest of Jeffrey Epstein's legal team to
20:32
not only get him off, but to destroy his own witnesses,
20:36
Barry Kirsher's own witnesses, meaning these girls, is just unbelievable
20:42
to me. And you have this judge down there in
20:46
Palm Beach, you know, one of the good old boys,
20:48
one of the been around forevers, still mucking things up,
20:54
still not interested in transparency. You would think, after all
21:00
these years and all of the scrutiny over the Jeffrey
21:03
Epstein case that some of these judges would wise up
21:06
by now. But like I always say, they think they're
21:09
feudal lords and these courtrooms are their fiefdoms and they
21:13
can do whatever they want. And these lifetime elected, lifetime
21:19
appointed judges bad news. Folks talk about people who are
21:23
power hungry. Every now and then you'll run across one
21:26
of these judges like this guy, and you just shake
21:29
your head. But there's been a lot of them when
21:33
it comes to the Jeffrey Epstein case. A lot of
21:37
these judges, a lot of these people in positions of power,
21:40
have failed these girls time and time again. And with
21:46
this latest blow, this judge not going to release these transcripts.
21:51
It's just another victory for the scumbags and just another
21:56
hurdle in the way of those who are trying to
21:59
bring those bags to justice. This morning, we have an
22:03
article from the Palm Beach Post and the author is
22:07
Jane Musgrave. Was the Jeffrey Epstein case intentionally sunk? Judge
22:13
won't excuse me, Judge won't release secret grand jury papers,
22:18
And again it just it's another blow to transparency. It's
22:24
another blow to those of us who want the truth,
22:27
and it just again throws up another curtain over what
22:35
everybody perceives at this point is government malfeasans. You would
22:40
think that they'd want to expose that, right, you would
22:43
think that they'd want to put that on blast, But
22:45
that's not how it works. They're going to cover your
22:49
ass mode and they got to protect the other scumbags
22:52
that they work with. And it's just such a dog
22:56
and pony show at this point, and the illusion that
23:00
there's a fair justice system, the illusion that there isn't
23:04
a two tier justice system, is being shattered on a
23:08
regular basis at this point. A Palm Beach County Circuit
23:14
judge on Monday refused to release secret documents that could
23:17
explain why a two thousand and six grand jury indicted
23:21
serial child molester Jeffrey Epstein on a single charge of
23:25
prostitution despite evidence that showed he abused more than a
23:29
dozen girls at his Palm Beach mansion. Now let that
23:32
sink in for those of you who aren't really completely
23:36
up to date on the case. You know, those of
23:38
you who have, you know, had a life for the
23:39
last three years, this might seem like what the hell
23:44
are you talking about here? How is that even possible?
23:46
But this is what they've been dealing with, Meaning the
23:48
survivors from the beginning, law enforcement has not been on
23:53
their side. Law enforcement, in fact, a lot of the
23:57
time has worked against them. And do you see it
24:00
here again when you have this judge who makes the
24:05
decision that these grand jury documents will not see the
24:09
light of day, as if it's some sort of national
24:12
security issue where nobody should ever see those grand jury documents. Now,
24:18
I understand if there was a legitimate reason, a legitimate
24:22
issue keeping those documents from the public, But there's no
24:25
legitimate reason unless, of course, you're trying to cover for somebody,
24:29
unless of course you're trying to protect your friends. In
24:37
a ten page order circuit, Judge Donald Haffle rejected arguments
24:42
by attorneys for the Palm Beach Post who pushed him
24:44
to release the records, citing a rarely used state law
24:48
that allows the secrecy of the grand jury to be
24:51
pierced to further the interests of justice. And if this
24:55
isn't a case where that hits home, I don't know
24:58
what is these grand jury testimony should be the excuse
25:07
me released They shouldn't be hidden from the public for
25:12
all of these years, especially if it moves the interests
25:17
of justice, and it certainly would, considering the non prosecution
25:20
agreement is based on all of this, So to get
25:25
rid of that non prosecution agreement, wouldn't it stand to
25:29
reason that having these grand jury documents released would go
25:32
a long way to making that occur. While Halfle noted
25:41
the newspaper offered strong arguments, he said he was bound
25:44
by the state's law. The court rules against the newspaper
25:48
because the established and binding maxims of Florida law constrain
25:52
it to do so, Halfley wrote. Halfly wrote, and again
25:57
we know that that's not one hundred percent the case.
26:00
If it promotes the interest of justice, as according to
26:03
the state law in Florida, then the documents can be released,
26:06
the transcripts can be released. But they don't have any
26:09
interest in doing that. Him, the other judge that's involved
26:12
in this, Krystal Marx, all of them had ties to
26:15
Barry Krisher or other people involved in the case. That's
26:19
how these things work with these bureaucrats. They're all friends,
26:22
They're all going to the same company functions, and on
26:27
and on. And on it goes. We've discussed it a
26:29
lot here on this podcast. You're not buying the lawyer
26:33
for what they're going to do in the courtroom. For
26:35
the most part, you're paying for a lawyer for the
26:40
connections they have outside of the courtroom, for the access
26:44
they can get you to the prosecutor's office. Why do
26:48
you think in a situation like Maxwell's she hires somebody
26:52
like Christian everde ex prosecutor has a lock with the
26:56
SDNY knows all of the prosecutors. They're all probably chummy.
27:00
They probably go to barbecues together, you know what I'm
27:03
talking about. While state law allows the release of grand
27:09
jury records to further the interest of justice, he said,
27:13
it is clear the legislature intended that exception to be
27:16
used only in pending criminal or civil cases. So just
27:22
because this happened a while back, and now Epstein's dead,
27:25
let's just forget it ever happened. We'll just move on.
27:27
And you know what it is, what it is. Sorry,
27:29
the girls who are victimized, no justice for them. It's
27:33
basically what this judge is saying. And I mean it
27:37
shouldn't shock anybody considering you know what we see these
27:40
judges do on a regular basis from the bench here
27:43
in America. But you would think that something like this,
27:47
with all of the interests surrounding it, all of the
27:51
questions that still need to be answered, that if you
27:55
were a judge, you'd say to yourself, you know what,
27:57
in the interests of justice, in the interests of moving
28:00
the truth forward, I'm going to release these transcripts. And
28:05
that's what the law is put on the books for.
28:07
But unfortunately this judge didn't want to interpret the interpret
28:11
it that way. Instead, the newspaper advocates a more expensive
28:15
interpretation of the term. He wrote, the newspaper wants the
28:19
ability to publish the materials and reference them in its reporting,
28:23
and also to make the materials available to the public. Yeah,
28:27
that's how this works, judge. Okay, the public is interested
28:30
in a case that's probably one of the most corrupt
28:33
of all time. So yeah, there is going to be
28:37
a bit of hesitancy to trust you. There is going
28:40
to be a bit of cynicism when it comes to
28:42
court rulings, and the fact that you want to keep
28:46
this stuff away from the public is just going to
28:49
feed into conspiracy theories and outlandish thoughts the government plays
28:57
a huge part in all of that. They could stem
29:00
and stop a whole bunch of the conspiracy stuff with
29:03
a whole lot of different topics if they just stop
29:06
their bullshit. But they don't want to ever be transparent.
29:09
They want to keep everything private. Everything's a national security issue,
29:13
isn't it, And that's what they'll say. Or if you're
29:17
looking to get information about something, say like Jeffrey Epstein's
29:21
first alleged suicide attempt, what they'll say is the information
29:24
is unavailable because it's still part of an ongoing investigation,
29:28
and that ongoing investigation has to do with Tartaglioni. So
29:33
they'll just run you in circles for as long as possible,
29:37
and if somehow you do get some Freedom of Information
29:40
Act information from them, it'll be heavily redacted or partial.
29:45
You'll never get the full story like the newspapers. Attorneys
29:53
Halfl said the transcripts could help answer troublesome questions about
29:57
why the politically connected multimillionaire peediphile escape serious punishment. Some
30:02
claim that then State Attorney Barry Krisher was improperly influenced
30:06
by Epstein's high octang defense team. I agree with that.
30:10
I definitely think he was. When you go back and
30:12
you look at all of the documentation, and you look
30:15
at the reporting, and you look at how things broke,
30:19
it's very obvious that he wasn't working as an advocate
30:23
for these survivors, and neither was the Prosecutor's Office of
30:26
Florida or a hell, the federal Prosecutor's office either. Because remember,
30:31
while Acosta was the one who was the direction man, right,
30:36
the guy who was considered the quote unquote boss on
30:40
the ground, he had people to answer to as well.
30:43
He's just a mid level bureaucrat. He don't make decisions
30:46
like this. He had to kick that up the chain
30:49
to move Mukzi and the rest of them. So they
30:53
all failed from the top down, from the federal government
30:56
all the way down to the state, and now all
30:59
the way back to this judge. Absolute failures a top
31:03
of absolute failures. It may very well be that the
31:09
disclosure of Jeffrey Epstein's grand jury records could reveal the
31:13
fair treatment did not occur, and that mister Epstein might
31:16
have escaped appropriate punishment through some failing of our justice system.
31:20
Haffel said, Yeah, well, how about releasing the documents then
31:27
instead you'll just sit on them right like a dragon
31:29
hoarding its gold. Post hasn't decided whether to appeal, but
31:36
he said state law can't be ignored on a whim
31:38
or to satisfy the public's curiosity. The court's interpretation of
31:42
the scope of the state law end of the phrase,
31:45
furthering justice is governed and constrained by the established rules
31:49
of statutory construction, Halfley wrote. Attorneys for the Posts said
31:54
they were reviewing the order and had not yet decided
31:58
whether to appeal. Hope they do. I mean, I know
32:02
it's an extra cost on them to appeal stuff like this,
32:06
and you know, the attorney fees get to be a
32:08
bit excessive, but you would think that in the interest
32:12
of justice, in the interest of transparency, that they would
32:17
release this documentation. And really what it comes down to
32:22
is this judge's interpretation of the law. That's all it is.
32:29
But he said state law can't be ignored on a
32:31
whim or to satisfy the public's curiosity. In a statement,
32:38
a comptroller and Clerk of the Courts, Joe Abruso, said
32:41
that while he hired a top media lawyer to represent
32:44
his office, in the lawsuit, he wasn't against the newspaper's request.
32:49
While Florida's statute is clear on its prohibition of releasing
32:52
information from grand jury cases, I want to be clear
32:55
that I have absolutely no objection to releasing grand jury
32:59
information in the EPSOM case if directed by the court.
33:02
A Bruso said, so what the comptroller is saying. Look,
33:06
I'll release this information, but I have to be directed
33:08
to do so by the court. That's the only way
33:11
that I can release this. And once again it goes
33:15
back to the judges. These guys running around like their
33:18
Taiwan lanister in the courtroom. He hired Shane Voight, a
33:26
Tampa attorney who won a one hundred and forty million
33:29
dollars verdict against Gawker on behalf of retired professional wrestler
33:33
Hulk Cogan and has represented others in fights against news outlets,
33:37
to represent the office. During a hearing on October twenty second,
33:43
Void argued that if half approved the newspaper's request, it
33:47
would open the floodgates for others to do the same. Well,
33:51
so what open the floodgates? And then on a case
33:53
by case basis, decide what should or what shouldn't be released.
33:58
Why is that so difficult? Oh? Is it to cause
34:00
extra work for the clerks? God forbid? I mean, are
34:06
we supposed to just slow everything down and you know,
34:10
oh well, let's wait on things here because you know,
34:13
we don't have enough time or enough people. I don't
34:17
even understand what any of it means. The floodgates will open. Well,
34:22
if they're legitimate requests, then maybe the floodgates need to
34:26
be opened. Halfle said he could craft the narrow order
34:31
that would assure the clerk wouldn't be inundated with demands
34:34
for grand jury records. Still, he said, after reviewing the law,
34:38
he determined the documents must remain secret. State Attorney Dave
34:43
Ahrenberg declined to comment on Halfle's decision. While the paper
34:48
initially named him in the lawsuit, he was dropped after
34:50
he claimed he didn't have the records. Executives of the newspaper,
34:54
which is owned by Gannet Gannet Company, said they were
34:57
disappointed by Halfle's decis yeah, you would think so. Right.
35:01
As a newspaper organization, the idea is to get as
35:05
much information to the public as possible. Let the public
35:09
decide and what better way to do that than to
35:13
provide raw data such as transcripts. I don't need the middleman, right,
35:18
provide us with the transcripts, provide us with the information
35:21
that we need, and let us decide what's going on
35:23
here as the public. But no, they'll keep everything hidden.
35:29
And then what he'll do is he'll cite some obscure
35:31
law here. Oh well, it'll cause a flood of other requests.
35:35
And all of it is nonsense. Whenever I hear any
35:38
of this stuff, all I hear is no, we don't
35:40
want to be transparent. No, you can't know the truth.
35:44
That's basically what I hear every time they start in
35:46
on the nonsense. While the Post appreciates the court's consideration
35:53
of the issues, we respectfully disagree with the legal conclusion
35:57
that public access to the Epstein grand jury material is
36:00
not warranted under the circumstances, said Marrable Perez Wadsworth, President
36:05
of Gannett News USA Today Network and publisher of USA Today.
36:10
It is our right and responsibility to report all aspects
36:13
of this case, and we will continue to diligently seek
36:16
the facts in our pursuit of transparency. Can argue with
36:21
that and props to them for doing it. I mean,
36:25
is it too much to ask to have some transparency
36:29
or as the public, to have the proper information in
36:32
a case that is so important. Post Executive editor Rich
36:40
Christy echoed those sentiments. For sixteen years, the Post has
36:44
been driven to report on the heinous acts of Jeffrey
36:47
Epstein for two reasons, justice for the victimized girls and
36:51
accountability for our readers. He said, today's ruling by Circuit
36:56
Judge Haffl, while disappointing, does not deter us from our
37:00
mission of furthering justice for Epstein's young victims. The Post
37:04
will always fight to shine a spotlight wherever it is
37:07
needed to expose the actions or in actions of those
37:10
charged with serving and protecting the public period. He concluded, Hey,
37:14
I'll tell you what, I'm all for that, and I'll
37:17
be right here with you, ride and shotgun as far
37:20
as trying to get these transcripts, because it's a big deal.
37:24
It's a huge deal, and I can't express enough how
37:29
important that non prosecution agreement is in protecting these people. Still,
37:34
and all of this plays such a huge part in
37:36
that the ruling was a blow to efforts to unravel
37:42
the sordid case that grabbed international attention. It also came
37:46
on a day that a federal jury in New York
37:49
began deliberating whether Epstein's longtime girlfriend co conspirator Glein Maxwell
37:55
recruited in groom teens for his pleasure. The fifty nine
37:58
year old British socialite conspirator General all around scusbag bipedal Serpent,
38:03
faces a lengthy prison term if connected if convicted of
38:07
multiple charges in connection with the sex trafficking scheme. During
38:11
the October hearing, the newspaper's attorneys argued that the case
38:14
was unique. More than fifteen years has passed. Epstein is dead,
38:18
so none of the information can be used against him.
38:21
The sixty six year old financier pedophile who counted former
38:25
President Bill Clinton and Britain's Prince Andrew his friends, hung
38:29
himself allegedly in a Manhattan jail cell in August twenty
38:33
nineteen while awaiting trial on dozens of sex trafficking charges
38:37
in New York. Again, he's dead. None of this information
38:43
can be used against him or anything like that, so
38:45
I don't understand how it won't be released. Now. Look,
38:49
if he was still alive and there was a chance
38:51
that this information could be used or all right, I
38:54
get it. I might not agree with it, but I
38:56
get it. I don't agree with it, and I don't
38:59
get it. In this instance, the guy's dead, he's rotting.
39:02
It's time for transparency. A dozen girls said they were
39:10
sexually abused, only one testified as part of a twenty
39:14
nineteen investigation titled the First Failure. Sources familiar with the
39:18
grand jury proceedings told the Post that while more than
39:22
a dozen teens told Palm Beach police that Epstein molested them,
39:26
only one, a fourteen year old girl, was called to testify.
39:30
And this is what I talk about a lot in
39:32
reference how only one girl was called to give testimony,
39:35
and how it flashes shades to what we saw here
39:38
in the Maxwell trial with only four girls being called. Well,
39:43
I understand the scopes a little bit different. It's just
39:46
for those of us who have been through this already,
39:49
it's concerning to see the sources said. Christian's top lieutenants
39:56
villified the teen. Instead of focusing on the abuse she
39:59
sa effort at the hands of the wealthy pedophile, they
40:02
quizzed her about her social media activity, which included references
40:06
to boys and drinking. Her posts on her MySpace page
40:09
were given were given to Kursher by Harvard law professor
40:14
Alan Dershowitz, one of Epstein's top flight attorneys, And that
40:18
was the strategy. Then, it's the strategy now, and it'll
40:21
continue to be the strategy until these juries wake up
40:25
and start convicting these people. We all know that the
40:29
girls were absolutely destroyed by not only the authorities, but
40:34
by Epstein's attorneys. Oh they're talking to boys, they were
40:38
smoking weed, they drank on their MySpace page. Really, let
40:43
me ask you, how many of you out there, as
40:45
young teenagers didn't do any of those things. I know
40:48
we all did. I know I did. If you're gonna
40:51
base my life on what I did as a young man,
40:54
then boy, I'll tell you I'd be in big trouble.
41:01
Her alleged treatment by state prosecutors could explain why grand
41:05
jurors indicted Epstein on the lone prostitution charge instead of
41:09
multiple counts of child molestation that were sought by the police.
41:16
The prostitution charge ignored the tender age of Epstein's accusers
41:19
and the fact that teens under the age of eighteen
41:22
couldn't legally consent to sex. We've talked about that from
41:25
the jump too. How can you even call a girl
41:28
under eighteen a prostitute when they can't even consent to sex?
41:31
How is that? Even logical legal experts say prosecutors will
41:38
tremendous influence over grand jurors who aren't skilled in the law. Cynically,
41:43
some embrace a time honored maxim that a prosecutor, if
41:46
he desired, could indict a ham sandwich. And this is
41:50
a fact as well. You know, the grand jury rooms
41:54
are places where indictments definitely come down at a huge swell.
42:00
The statement you get a ham sandwich indicted at a
42:04
grand jerry certainly rings true because it's something that a
42:08
lot of people talk about who are in the know.
42:13
After his death, scores of young women came forward publicly
42:16
describing how Epstein sexually assaulted them at his home in
42:19
Palm Beach, his penthouse apartment in Manhattan, his ranch in
42:23
New Mexico, and his private island in the Virgin Islands.
42:27
Some said he forced them to have sex with his
42:29
celebrity friends while aboard his private jet, the Lolita Express.
42:34
Many teen victims were from Palm Beach, County. Like teens
42:38
from Royal, Palm Beach and John I. Leonard High Schools,
42:41
many were allured to Epstein's homes with the promise of
42:44
being paid two hundred dollars to give him a massage.
42:47
He greeted them wearing little more than a towel. He
42:50
offered to pay them more to disrobe, let him fondle them,
42:54
and to have sex. Boy, what does that all sound like?
42:57
Sounds like a bunch of testimony we just heard, doesn't it.
43:00
Imagine this testimony mirrors that testimony. And if they would
43:04
have actually done their job during this first arrest and
43:08
had more than one of the victims give their testimony
43:13
to the Grand Jerry, a lot of this could have
43:15
been stopped. Perhaps the girls, some from hardscrabble backgrounds, were
43:23
promised careers in high fashion, college educations, or other perchs
43:28
that were beyond their reach. The Grand Jerry marked the
43:31
beginning of when the case spun out of control. Angry
43:35
at Chrishier's handling, at his agent's angry at Chrishier's handling
43:39
of his agency's investigation, Palm Beach Police Chief Michael Ryder
43:43
went to the FBI, Ultimately in his secret deal. South
43:47
Florida attorney Alex Acosta agreed to shelve the fifty three
43:51
page federal indictment against Epstein if he would plead guilty
43:54
to state prostitution charges. And now, remember, it's not just
43:58
a costa here. He's the scumbag with no spine, no
44:01
doubt about it, and he deserves his infamy for his role.
44:05
But he wasn't the one who made the decision. He
44:09
might have been the one who you know, filed it
44:11
up the chain of command, but he didn't okay it,
44:14
that's for sure. As part of the so called non
44:19
prosecution agreement, Krisher added a charge of solicitation of a
44:23
minor for prostitution. Federal prosecutors insisted on the second charge
44:28
because it would force Epstein to register as a sex offender.
44:31
How that work out in New Mexico? Oh, that's right.
44:33
He didn't have to register there. Because he knew he
44:37
planned all of this, he took precautions. On June thirtieth,
44:45
two thousand and eight, Epstein plea pleaded guilty in Palm
44:49
Beach County Circuit Court to both prostitution charges. He served
44:53
thirteen months of an eighteen month sentence in a largely
44:56
vacant wing of the county stockade. He was given liberal
44:59
work relief privileges. He was allowed to spend up to
45:02
twelve hours a day, six days a week working at
45:05
a private foundation he created months earlier. The fallout from
45:09
what one state prosecutor described as the deal of the
45:12
century was far reaching, if delayed, And not only was
45:17
Epstein out, according to some of these other accusers, he
45:20
was abusing them while he was out on this work
45:23
release program. Fantastic job done by the federal government. Huh,
45:27
fantastic job done by the Florida state authorities. After Epstein
45:34
was charged in New York, a Costa resigned as former
45:37
President Donald Trump's labor secretary when questions were raised about
45:41
his involvement in crafting the non prosecution agreement. Before his resignation,
45:45
a Costa sought to blame Krisher. He claimed he was
45:48
forced to clean up a mess Krisher created when the
45:51
state prosecutor refused to file serious charges against Epstein. Acosta
45:56
pointed out that Krisher originally offered to allow Epstein to
45:59
plead guilty aggravated assault, serve no jail time, and have
46:03
the felony record A raised if he complied with the
46:05
terms of his probation, that was unacceptable, Acosta said during
46:09
a nationally televised news conference. So basically, it's a point
46:15
um game. Right, you did it, I did it, he
46:17
did it, she did it. And in reality, what they
46:20
do is they cause enough confusion then that nobody's held responsible.
46:28
Krisher responded that Acosta was attempting to rewrite history. In
46:32
a prepared statement, he said, I can emphatically state that
46:35
mister Acosta's recollection of this matter is completely wrong. A
46:40
federal investigation in twenty twenty found that Acosta place too
46:43
much trust in Krisher. A two year state investigation completed
46:47
last year concluded that Krisher had little input into the
46:51
nonprofit prosecution agreement and found no wrongdoing. State investigators were
46:56
denied access to the grand jury proceedings. So not only
47:02
has the public locked out, they locked out the state
47:04
investigators who were investigating wrongdoing. Here in the FDL report, Yeah,
47:10
nothing to see here, folks, keep on moving. Everything is
47:13
just fine. We're all fine. After Epstein died, authorities in
47:21
the US Virgin Islands worked with those who were administering
47:24
his estate to set up a fund to compensate his victims.
47:27
They wrapped up their work in August after paying slightly
47:30
more than one hundred and twenty one million to more
47:32
than one hundred and thirty five people, according to the
47:35
New York Times. Look, this is a situation that, obviously,
47:39
as you can tell here, has been going on for
47:42
quite some time, and there was hope that this judge
47:45
was going to release these grand jury documents. Well that's
47:49
not going to occur. So the battle continues for transparency, folks,
47:54
and we'll continue to report on it and we'll continue
47:57
to talk about it until there's some movement and we
48:00
finally get a glimpse behind the curtain. All Right, folks,
48:07
that's gonna do it for me today, and I'll be
48:09
back later on obviously with a evening update and expect
48:13
