- 0:00Speaker 1: Well, as I say, the breaking news of the night
- 0:02Speaker 1: is that Donald Trump's illegal tariffs are gone thanks to
- 0:06Speaker 1: a ruling of the United States Court of International Trade.
- 0:11Speaker 1: Futures trading is now soaring tonight in the expectation of
- 0:15Speaker 1: an explosively positive reaction by the stock market tomorrow, when
- 0:19Speaker 1: the world will reset itself around the restoration of law
- 0:24Speaker 1: and order in international trade and the crushing of the
- 0:29Speaker 1: Trump tariffs and resultant personal worldwide humiliation of Donald Trump.
- 0:37Speaker 1: The Trump tariffs were always illegal and unconstitutional, and you
- 0:41Speaker 1: heard that on this program every time we covered Donald
- 0:45Speaker 1: Trump's comments about tariffs, including very much during the presidential campaign,
- 0:50Speaker 1: when the campaign press court never ever reported to voters
- 0:56Speaker 1: that the Trump proposed tariffs during the campaign were completeletely
- 1:00Speaker 1: illegal and unconstitutional. The campaign press corps never reported to
- 1:06Speaker 1: voters that those proposals were constitutionally insane, and the person
- 1:12Speaker 1: pronouncing those proposals at those Trump rallies was constitutionally out
- 1:17Speaker 1: of his mind just based on what he was saying
- 1:20Speaker 1: about tariffs alone. The campaign press corps completely failed the
- 1:25Speaker 1: American voter on this issue, with American voters just discovering
- 1:29Speaker 1: tonight from the International Court of Trade just how illegal
- 1:33Speaker 1: and unconstitutional and Trump tariffs always have been. The United
- 1:38Speaker 1: States Court of International Trade, which has exclusive jurisdiction over
- 1:42Speaker 1: cases involving tariff disputes, has ruled unanimously then when it
- 1:47Speaker 1: comes to tariffs, Donald Trump does not have quote unbounded authority,
- 1:54Speaker 1: and the court sets aside the challenged tariffs. The court
- 1:59Speaker 1: gave the plaintiffs suing the Trump administration even more than
- 2:04Speaker 1: they expected. The plaintiffs include twelve states with Democratic governors
- 2:09Speaker 1: who sued arguing that the Trump tariffs are unconstitutional and illegal,
- 2:14Speaker 1: and asked the court for at least a temporary injunction
- 2:17Speaker 1: temporarily blocking the tariffs. But the Court went all the
- 2:22Speaker 1: way and delivered a full and final ruling in the case,
- 2:27Speaker 1: granting what the Court calls a summary judgment against Donald
- 2:31Speaker 1: Trump and all of his tariffs. So, as of this
- 2:35Speaker 1: hour tonight, it is no longer illegal at any port
- 2:38Speaker 1: of entry in the United States for a United States
- 2:40Speaker 1: custom service to collect a single dollar of Trump tariffs.
- 2:46Speaker 1: Civil lawsuits like this seldom have such total and complete
- 2:50Speaker 1: and final victories. Just two weeks after the court heard
- 2:54Speaker 1: arguments in the case. Victories in this case for plaintiffs
- 2:58Speaker 1: at this stage of this litigation are very unusual. But
- 3:03Speaker 1: here we are, and as I've been reporting to you
- 3:06Speaker 1: literally for years now, there are few things more clear
- 3:10Speaker 1: in law than Congress's complete authority over tariffs. The Court
- 3:14Speaker 1: of International Trade said in its opinion that even if
- 3:17Speaker 1: Congress wanted to give Donald Trump power over tariffs, it
- 3:21Speaker 1: would be unconstitutional to do so. Quote. An unlimited delegation
- 3:27Speaker 1: of tariff authority would constitute an improper abdication of legislative
- 3:33Speaker 1: power to another branch of government. Donald Trump's illegal tariffs
- 3:36Speaker 1: were based on the International Emergency Economic Powers Act of
- 3:41Speaker 1: nineteen seventy seven, and today, finally, the Court of International
- 3:46Speaker 1: Trade said what I've been saying since the day Donald
- 3:49Speaker 1: Trump invoked that law to support his tariffs. Quote, any
- 3:53Speaker 1: interpretation of the International Emergency Economic Powers Act that delegates
- 3:58Speaker 1: unlimited tariff authority, he is unconstitutional. The Court rejected Donald
- 4:03Speaker 1: Trump's claim of a national emergency to justify his tariffs, saying,
- 4:08Speaker 1: the mere incantation of national emergency cannot, of course sound
- 4:14Speaker 1: the death knell of the Constitution. And that's what Donald
- 4:18Speaker 1: Trump is trying to do. He's trying to kill the
- 4:22Speaker 1: Constitution of the United States in a different way every day.
- 4:26Speaker 1: He tried and failed, thanks to the Court of International
- 4:30Speaker 1: Trade to sound the death knell of the Constitution by
- 4:33Speaker 1: stealing Congress's exclusive power over tariffs, and in a forty
- 4:39Speaker 1: nine page ruling co authored by three judges of the
- 4:42Speaker 1: Court of International Trade in New York City, donald Trump's
- 4:46Speaker 1: attempts to kill the Constitution this time have failed. Judge
- 4:52Speaker 1: Gary Katzman was appointed by President Obama. Judge Jane Ristani
- 4:56Speaker 1: was appointed by Republican President Ronald Reagan. Timothy Reef was
- 5:01Speaker 1: appointed by Republican President Donald Trump, and those three judges
- 5:08Speaker 1: unanimously agreed to every word in tonight's breaking news opinion
- 5:13Speaker 1: that there is nothing in American law that can make
- 5:17Speaker 1: Donald Trump's tariffs legal. Two sets of plaintiffs brought cases
- 5:23Speaker 1: to the Court of International Trade, and in their unanimous
- 5:26Speaker 1: opinion tonight, the Court said, the question in the two
- 5:28Speaker 1: cases before the Court is whether the International Emergency Economic
- 5:32Speaker 1: Powers Act of nineteen seventy seven delegates these powers to
- 5:35Speaker 1: the President in the form of authority to impose unlimited
- 5:39Speaker 1: tariffs on goods from nearly every country in the world.
- 5:43Speaker 1: The Court does not read the International Emergency Economic powers
- 5:47Speaker 1: act to confer such unbounded authority and sets aside the
- 5:52Speaker 1: challenged tariffs imposed there under for Donald Trump's benefit, though
- 5:59Speaker 1: he of course could actually read a single page of
- 6:01Speaker 1: a court opinion, but mostly for the benefit of the
- 6:04Speaker 1: United States Supreme Court. The trade experts on the Court
- 6:08Speaker 1: of International Trade wrote a brief history of international trade
- 6:14Speaker 1: right in their opinion, and a brief history of international
- 6:17Speaker 1: trade law for Donald Trump's Supreme Court justices to study,
- 6:21Speaker 1: because they know very little about international trade law. When
- 6:25Speaker 1: Donald Trump no doubt appeals this case all the way
- 6:28Speaker 1: up to the judges on the Supreme Court, who he
- 6:30Speaker 1: believes owe him their permanent loyalty, the Trade Court identified
- 6:35Speaker 1: three different kinds of tariff's donald Trump was illegally imposing,
- 6:39Speaker 1: and ruled against each of them, calling each of them
- 6:43Speaker 1: illegal and unconstitutional. The referred to tariff's imposed on countries
- 6:48Speaker 1: to indirectly force them to somehow stop the flow of
- 6:53Speaker 1: fentanyl around the world and other illicit drugs that are illegal.
- 6:57Speaker 1: Because tariffs cannot legally be used to leverage the behavior
- 7:03Speaker 1: of other governments on issues other than regulated international trade,
- 7:08Speaker 1: the Court wrote attacks deals with a budget deficit by
- 7:12Speaker 1: raising revenue a dam deals with flooding by holding back
- 7:16Speaker 1: a river, but there is no such association between the
- 7:19Speaker 1: act of imposing a tariff and the unusual and extraordinary
- 7:24Speaker 1: threats that the trafficking orders purport to combat. The trafficking
- 7:29Speaker 1: orders do not deal with their stated objectives. Rather as
- 7:34Speaker 1: the government technologies the orders aim to create leverage to
- 7:39Speaker 1: deal with those objectives. That use is impermissible, not because
- 7:45Speaker 1: it is unwiser ineffective, but because Section seventeen oh one
- 7:50Speaker 1: does not allow it. The Court laid out the legal specifics,
- 7:56Speaker 1: striking down all of what Donald Trump calls his reciprocal tariffs,
- 8:01Speaker 1: and throughout the opinion, the Court was very clear that
- 8:04Speaker 1: Congress would have the authority to impose any of these tariffs,
- 8:08Speaker 1: but the president simply does not have that legal authority.
- 8:12Speaker 1: In the same sense that the president does have the
- 8:14Speaker 1: power to pardon people convicted of federal crimes, which Donald
- 8:17Speaker 1: Trump is doing in the most corrupt manner in history,
- 8:20Speaker 1: but Congress does not have the power to pardon people
- 8:24Speaker 1: convicted of federal crimes. These distinctions in presidential and congressional
- 8:29Speaker 1: power have always been easy and simple for people to understand,
- 8:33Speaker 1: and no one has ever disputed them, just as no
- 8:36Speaker 1: one has ever imagined prior to Donald Trump, that a
- 8:39Speaker 1: president has the authority to raise or lower tariffs. The
- 8:43Speaker 1: Court went through a painful recitation of all the tariffs
- 8:47Speaker 1: Donald Trump has threatened to imposed and then reduced, and
- 8:50Speaker 1: then postponed, saying every one of those decisions was made illegally.
- 8:55Speaker 1: The Court explained that a summary judgment is the only
- 8:59Speaker 1: possible way in this case, that this case can be resolved,
- 9:03Speaker 1: and needs to be resolved now. And this Court explained
- 9:07Speaker 1: the standards for a summary judgment, saying the Court shall
- 9:13Speaker 1: grant summary judgment if the movement shows that there is
- 9:18Speaker 1: no genuine dispute as to any material fact, and the
- 9:22Speaker 1: movement is entitled to judgment as a matter of law.
- 9:27Speaker 1: That is a very high bar. But Donald Trump's constitutional
- 9:30Speaker 1: illiteracy easily delivered a summary judgment to the States and
- 9:35Speaker 1: other plaintiffs to end all of the Trump tariffs and
- 9:39Speaker 1: not allow them to be collected at any port of
- 9:42Speaker 1: entry anywhere in the United States. The Court, of course,
- 9:45Speaker 1: cited James Madison writing in the Federalist Papers on the
- 9:49Speaker 1: importance of Separation of Powers, and said an unlimited delegation
- 9:53Speaker 1: of tariff authority would be unconstitutional, The court said, quote,
- 9:59Speaker 1: the president's assertion of authority here has no meaningful limiting standards,
- 10:03Speaker 1: essentially enabling ling him to impose any tariff rate he
- 10:07Speaker 1: wants on any country at any time, for virtually any reason.
- 10:11Speaker 1: The Court stopped that madness tonight. It's over. The Trump
- 10:17Speaker 1: tariff madness ends now. The court said. Donald Trump's attempt
- 10:21Speaker 1: to use our international trade balance of payments with countries
- 10:25Speaker 1: around the world as a reason for a president to
- 10:28Speaker 1: impose tariff's was illegal and unconstitutional. Donald Trump has lost
- 10:33Speaker 1: in court many times before, most notably in the thirty
- 10:36Speaker 1: four guilty verdicts returned against him by a jury of
- 10:38Speaker 1: his peers in a criminal case in Manhattan last year,
- 10:42Speaker 1: and the judgment against Donald Trump by the Court of
- 10:45Speaker 1: International Trade will now take its place among those legal
- 10:48Speaker 1: cases in which Donald Trump has lost, and lost decisively.
- 10:53Speaker 1: On every single point that Donald Trump raised in the court,
- 10:59Speaker 1: there is not a single word that was said by
- 11:02Speaker 1: Donald Trump's lawyers justifying his tariffs that was accepted by
- 11:06Speaker 1: a single judge on the Court of International Trade, including
- 11:10Speaker 1: the Trump appoint the judge who joined this unanimous opinion,
- 11:14Speaker 1: and so Tomorrow, when Donald Trump stands before a microphone
- 11:17Speaker 1: and lies to the American people about his tariffs, it
- 11:20Speaker 1: will be another worldwide humiliation day for Donald Trump.
