- 0:00Speaker 1: This is the New Realm Compliance Brief, Volume one, Edition 12 for Wednesday, August 26. Our top story. An updated Congressional Research Service report says the Food and Drug Administration is six months late on hemp guidance that Congress required by February 10. The agency has yet to publish lists of naturally occurring cannabinoids and THC class compounds and guidance defining the word container, the term that determines how the new zero point four milligram total THC cap applies to a can, a multipack or a case. Those caps take effect November 12.
- 0:37Hemp entrepreneur Jim Higdon said it is difficult to comply with the law while key definitions are still in question. In other federal news, House members remain divided over the Senate's one month delay of those hemp THC caps. The Senate's stopgap bill would move the compliance date from November 12 to December 11. Representative Morgan Griffith of Virginia said he favors delaying implementation, while Representative Andy Harris of Maryland opposes a delay, calling the products intoxicating and unregulated. The chambers must reconcile their bills before funding lapses September 30.
- 1:15Around the states, California lawmakers sent Governor Newsom a bill barring cannabis packaging that appeals to minors, effective 01/01/2028, if signed. An Oregon senator plans a 2027 push to cap cannabis edibles, including drinks, at ten milligrams of THC. And in Wisconsin, Forward Beverage Company said its THC beverage taproom will close September 13, with the owner saying 95 percent of its products would not be allowed under the incoming federal standard. On the radar, the corrected DEA rescheduling hearing transcript is due today. Canada's retaliatory tariffs are set to begin September 8 and the federal hemp THC limits arrive November 12.
