Transcript
- 0:00Speaker 1: The Justice Select Committee has recommended several changes to soften
- 0:03Speaker 1: the Firearms Prohibition Order's Legislation Amendment Bill. It says the
- 0:09Speaker 1: order will give police too much power for warrantless searches.
- 0:13Speaker 1: As it stands, someone with an FPO a Firearms Prohibition
- 0:16Speaker 1: Order cannot hold a firearms license, use firearms, or associate
- 0:21Speaker 1: with anybody who has a firearm. And the new bill
- 0:24Speaker 1: would give new warrantless search powers to anyone suspected of
- 0:28Speaker 1: being under a firearms Prohibition order. Ginny Anderson as Labour's
- 0:32Speaker 1: Justice spokesperson, and she's with me now, Jenny, good morning.
- 0:36Speaker 2: Good morning.
- 0:36Speaker 1: Could you give us an example of where you think
- 0:40Speaker 1: this power could go and what's wrong with it?
- 0:44Speaker 2: Right, So, say, just for the sake of it, let's say,
- 0:48Speaker 2: Mike Costkins, your friend had FPO put on by the courts.
- 0:52Speaker 2: You don't know about it, but are you invited around
- 0:55Speaker 2: to your house and he's run at your house either
- 0:57Speaker 2: for dinner or doing something else, so that you don't
- 1:00Speaker 2: even know that he has an f PO on him
- 1:03Speaker 2: and police would be able to search your whole house.
- 1:08Speaker 2: And the way that the bill was originally written that
- 1:12Speaker 2: police just had to suspect that he might have an
- 1:16Speaker 2: FPO on him in order to search your entire house,
- 1:20Speaker 2: or if he was in your car, your whole car.
- 1:22Speaker 2: So it just is quite wide in terms of not
- 1:25Speaker 2: just only the people who it's intending to capture, but
- 1:29Speaker 2: also who they're associating. Was immediately whether or not that
- 1:33Speaker 2: associate necessarily it was in a gain or not.
- 1:36Speaker 1: Right, But how why would the cops be coming to
- 1:39Speaker 1: my house or to my car in the first.
- 1:41Speaker 2: Place, Because if the person was an FPO on them
- 1:45Speaker 2: is in your house, then that can be searched too.
- 1:48Speaker 1: But how do they know he's in my MIC's in
- 1:50Speaker 1: my house? Do you know what I mean?
- 1:52Speaker 2: Like, it's surely they're probably blotting outside.
- 1:55Speaker 1: I don't know.
- 1:56Speaker 2: I mean, when you get into scenarios, that's hard. But
- 1:59Speaker 2: if they've been more uttering someone, all they have to
- 2:01Speaker 2: do is is we've changed it now that you used
- 2:04Speaker 2: to just bespect that he had an FPO on them,
- 2:06Speaker 2: and they're checking on the conditions. So when you have
- 2:09Speaker 2: one of these on you, it enables police to continually
- 2:12Speaker 2: check that the conditions of the SEO are being complied
- 2:16Speaker 2: with right right, and they can do that at any time,
- 2:19Speaker 2: like a bail check, they can come around and check that.
- 2:21Speaker 1: Right, And if I have so Mike's got an FPO,
- 2:24Speaker 1: if I have a firearm illegally a firearm in my house,
- 2:29Speaker 1: he can be arrested for just being in the same house.
- 2:31Speaker 2: Right, that's absolutely correct. And you might not know, you
- 2:37Speaker 2: might have stored a firearm for someone else. And if
- 2:40Speaker 2: he's anywhere there, that's exactly right. He would be arrested
- 2:44Speaker 2: for a period of time if he was in and
- 2:46Speaker 2: around firearms. That does depend on the conditions of the SEO.
- 2:50Speaker 2: These are put on by the courts, and so the
- 2:52Speaker 2: judge at the time can put on special conditions that
- 2:56Speaker 2: might be different from time to time. So we thought
- 2:58Speaker 2: that that was a much and it's been changed to
- 3:02Speaker 2: the police has to believe that there is an SPO
- 3:06Speaker 2: on this person in order to conduct those searchers. But
- 3:09Speaker 2: we still think that we're the balance about right. The
- 3:12Speaker 2: previous spos about who she has been done, about a
- 3:16Speaker 2: third of those are gang members. We also had that
- 3:19Speaker 2: Criminal Activity Intervention Bill which for a period of fourteen
- 3:24Speaker 2: days if there was tensions between gangs, then police had
- 3:27Speaker 2: the ability to go and search in a whole range
- 3:29Speaker 2: of different areas while those into gang tensions. Both those
- 3:33Speaker 2: piece of legislation we felt was working really well, and
- 3:38Speaker 2: this is sort of another thing. Design's a lot tough,
- 3:41Speaker 2: but it's not quite clear what is the problem it
- 3:44Speaker 2: is actually fixing.
- 3:45Speaker 1: All right. That's Jenny Anderson, Labour's Justice spokesperson. The Justice
- 3:49Speaker 1: Select Committee has recommended to send several changes to that
- 3:53Speaker 1: bill to soften it up. For more from News Talks'
