Speaker 1: What's up, everyone, and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to pick up where we left
• 0:04
Speaker 1: off with the Tyler Robinson prelim hearing day one. Kathy Nestor. Yes,
• 0:11
Speaker 1: Your Honor. Judge Graff. All right. To the state. Prosecution. Yes. Graff.
• 0:17
Speaker 1: All right. Go ahead. And let's play Exhibit 7. Is
• 0:20
Speaker 1: there a sound? Prosecution. There is, Judge. Judge Graff. All right.
• 0:24
Speaker 1: Let's make sure that. Inaudible. Thank you. Thank you. That
• 0:28
Speaker 1: concludes playing of Exhibit 7. You may proceed. Question. Thank you, Judge.
• 0:34
Speaker 1: Agent Hull, any more video that you collected or either
• 0:37
Speaker 1: you or another agent with the SBI? Answer. Yeah, we
• 0:42
Speaker 1: were able to collect video. TPUSA had a videographer, Visual Impulse,
• 0:46
Speaker 1: who was taking coverage of the event, and they provided
• 0:48
Speaker 1: video to us that they captured on September 10th, 2025. Question, okay,
• 0:54
Speaker 1: and do you know who or how that video was
• 0:56
Speaker 1: collected from Visual Impulse? Answer, yeah. Mr. Farnsworth originally provided,
• 1:01
Speaker 1: I believe, a flash drive to Lieutenant O'Brien with one
• 1:04
Speaker 1: of the local agencies, and a short time after that,
• 1:07
Speaker 1: on September 10th, he provided downloadable versions, electronic versions, to
• 1:12
Speaker 1: Agent Mortensen. And an 1102 was collected from him on
• 1:15
Speaker 1: May 6th, 2026. Question, so an 1102 was prepared by
• 1:20
Speaker 1: someone with Visual Impulse? Answer, yeah. Terrell Farnsworth was the
• 1:25
Speaker 1: individual that prepared it. And in preparation for this, I
• 1:29
Speaker 1: spoke to him personally regarding that statement. Question, and do
• 1:32
Speaker 1: you know how his association or what it was with
• 1:36
Speaker 1: Visual Impulse? Answer, I believe he's the owner-operator or the
• 1:39
Speaker 1: director of the company. Question, and then who collected that
• 1:42
Speaker 1: 1102 statement from Mr. Farnsworth? Answer, it was Agent Mortensen
• 1:47
Speaker 1: who collected it. Question, okay. And do you know that
• 1:51
Speaker 1: Agent Mortensen told you so or... Answer. He provided it
• 1:56
Speaker 1: to me. And then, as I mentioned, I subsequently spoke
• 1:59
Speaker 1: to Terrell Farnsworth personally regarding his statement. Question. Okay. Have
• 2:03
Speaker 1: you had a chance to look at Mr. Farnsworth 1102 statement? Answer.
• 2:06
Speaker 1: I have. Yes. Question. Okay. And again, does that statement
• 2:10
Speaker 1: include an advisory that any statement that he provided would
• 2:14
Speaker 1: be used at a prelim hearing in lieu of his
• 2:16
Speaker 1: live testimony? Answer. Yes. Question. Did it also include a
• 2:21
Speaker 1: warning that a false statement would potentially be punished by
• 2:24
Speaker 1: a Class A misdemeanor? Answer, it did, yes. Question, okay.
• 2:29
Speaker 1: I'm going to have exhibited on your screen what's been
• 2:31
Speaker 1: marked State Exhibit 8.1. Let me know when that comes up. Answer,
• 2:36
  Speaker 1: it's up. Question, I think it's a single page, is
• 2:38
Speaker 1: it not? Answer, I believe it is. Question, go to
• 2:41
Speaker 1: the top of the screen. Can you see that, Agent Hall? Answer, yes. Question,
• 2:45
Speaker 1: do you recognize that? Answer, I do, yes. Question, okay,
• 2:49
Speaker 1: and again, what is it? Answer, it's the 1102 statement
• 2:53
Speaker 1: that was provided to me, completed by Mr. Farnsworth from
• 2:57
Speaker 1: Visual Impulse, who's the videographer for TPUSA for the events
• 3:01
Speaker 1: that they do. Question, okay, Judge, the state would move
• 3:05
Speaker 1: to admit State Exhibit 8.1. Kathy Nestor jumps in after
• 3:09
Speaker 1: the judge asks her if she has an objection. Of
• 3:11
Speaker 1: course she does. Thank you, Your Honor. At this point,
• 3:14
Speaker 1: we renew our objection. This statement is hearsay. We have
• 3:17
Speaker 1: a constitutional concern for the reasons we raised in our
• 3:20
Speaker 1: standing objection. We would also like to cross-examine Mr. Farnsworth
• 3:25
Speaker 1: about whether or not and to what extent these videos
• 3:27
Speaker 1: may have been altered in any way. It's clear that
• 3:30
Speaker 1: clips were being made out of larger videos because he sent,
• 3:34
Speaker 1: even his own statement says he sent larger videos, and
• 3:36
Speaker 1: this is just a small portion of them. So obviously
• 3:40
Speaker 1: someone made clips, and we don't know who, and we
• 3:42
Speaker 1: don't know how, we don't know what they did. And
• 3:45
Speaker 1: for those reasons and the reasons in our standing objection,
• 3:48
Speaker 1: we would object to the admissibility of it as well
• 3:51
Speaker 1: as the, I don't have the redacted version of 8.1,
• 3:54
Speaker 1: but I assume there is one. There is personal information
• 3:57
Speaker 1: on this one. Do you have the, okay, I don't
• 4:00
Speaker 1: have that one. All right. And we would object to
• 4:02
Speaker 1: publication just for our concerns for a fair trial. Same issues.
• 4:07
Speaker 1: Inaudible Kathy Nestor. Yeah, gotcha. Yep, I think so, thank you,
• 4:12
Speaker 1: and for all those reasons, we would want to object
• 4:14
Speaker 1: to its admissibility, its publication, and its ability to be
• 4:17
Speaker 1: filmed by the media, Your Honor. Judge Graff, Ms. Nestor,
• 4:21
Speaker 1: I just wanted to check, did you get a copy
• 4:23
Speaker 1: of the redacted? Kathy Nestor, I was just handed it. Now,
• 4:29
Speaker 1: back to the prosecution. Judge Graff, okay, thank you. Prosecution,
• 4:33
Speaker 1: would you like to respond? Prosecution, sure, Judge, thank you.
• 4:37
Speaker 1: With regard to admissibility of the statement, Judge, I think
• 4:40
Speaker 1: the foundation has been laid that this statement was collected
• 4:43
Speaker 1: in compliance with Utah Rule of Evidence 1102, subsection B-8.
• 4:47
Speaker 1: It constitutes reliable hearsay. It's a statement that may have
• 4:51
Speaker 1: been made by a declarant that's written and it's under oath,
• 4:54
Speaker 1: or not under oath, but pursuant to a notification to
• 4:57
Speaker 1: the declarant that a false statement made is punishable. I
• 5:01
Speaker 1: think there's been foundation to support that. In addition, Judge,
• 5:05
Speaker 1: Article 1, Section 12, of the Utah Constitution makes it
• 5:08
Speaker 1: very clear that the state, at prelim hearings, can rely
• 5:11
Speaker 1: upon reliable hearsay. Judge Graff, all right, anything further before
• 5:16
Speaker 1: I make my ruling? Kathy Nestor, no. Judge Graff, thank you. Okay,
• 5:20
Speaker 1: applying the same analysis from the previous exhibits as it
• 5:24
Speaker 1: relates to the written statement under Rule 1102 and also
• 5:27
Speaker 1: under the Utah Constitution, Article 1, Section 12, in that
• 5:31
Speaker 1: last paragraph, I will overrule the objection. and admit States
• 5:35
Speaker 1: Exhibit 8.1. Let me hold off on that final phrase.
• 5:39
Speaker 1: If you could scroll down to the States Representative and
• 5:42
Speaker 1: just stop right there. Thank you. I just want to
• 5:44
Speaker 1: make sure I fully review it before I make that ruling.
• 5:47
Speaker 1: And if you could continue scrolling down, and I just
• 5:50
Speaker 1: go ahead and go ahead and scroll down to the end.
• 5:52
  Speaker 1: I don't believe there's anything else, but I want to
• 5:54
Speaker 1: make sure. Thank you. So I do rule that, overrule
• 5:57
Speaker 1: the objection, and the States Exhibit 7, I'm sorry, 8.1,
• 6:01
Speaker 1: is admitted into evidence and may be published. Prosecution, Judge,
• 6:06
Speaker 1: let me speak with regards to that. With regards to
• 6:09
Speaker 1: the 1102 statement prepared by Mr. Farnsworth in its redacted form,
• 6:13
Speaker 1: we believe that the presumption is this is a public record,
• 6:16
Speaker 1: and that it should be published both here, in court,
• 6:19
Speaker 1: and made available to the public by virtue of the camera. Ms. Nestor,
• 6:23
Speaker 1: Kathy Nestor, I just stand on my objection I made before,
• 6:26
Speaker 1: Your Honor. Judge Graff, thank you, all right. looking at
• 6:29
Speaker 1: the same analysis, is admissible under Rule 1102 as well
• 6:33
Speaker 1: as Article 1, Section 12 of the Utah Constitution. And
• 6:37
Speaker 1: being that this person's identifying information is redacted and not viewable,
• 6:42
Speaker 1: I'm going to overrule the standing objection and have it
• 6:44
Speaker 1: published both in court and it may be published by
• 6:46
Speaker 1: the media. So let's just get it situated. And what
• 6:50
Speaker 1: I'll have you do, to the representative of the state,
• 6:53
Speaker 1: pause on this screen, and then in 10 seconds scroll
• 6:56
Speaker 1: down to the full text portion. And then 10 seconds later,
• 6:59
Speaker 1: just slowly scroll to the remainder of the document. Thank you.
• 7:02
Speaker 1: All right. You can continue. Prosecution. Thank you, Judge. Judge
• 7:07
Speaker 1: Graff jumps in and slows him down. Hold on now.
• 7:09
Speaker 1: She's still going through it. She's going to show you
• 7:11
Speaker 1: the whole document. Judge Graff. Well, I should have clarified.
• 7:15
Speaker 1: Thank you. All right. And she concludes State Exhibit 8.1,
• 7:19
Speaker 1: the publication of that document. Prosecution. Judge. Thank you. I
• 7:23
Speaker 1: appreciate that. Agent Holt. Have you personally, so the video
• 7:26
Speaker 1: that's referenced in Mr. Farnsworth's 1102 statement, have you watched
• 7:30
Speaker 1: the visual impulse video? Answer, yes. Question, and what was
• 7:35
Speaker 1: depicted in that video? Answer, it's a view from the
• 7:38
Speaker 1: cameras that visual impulse had established at the event, actually
• 7:42
Speaker 1: looking out from the stage into the crowd. It's too
• 7:45
Speaker 1: graphic in nature and shows the moment that Mr. Kirk
• 7:48
Speaker 1: was shot. Question, okay. Does it also show Mr. Kirk
• 7:52
Speaker 1: throwing hats into the crowd, do you recall? Answer. If
• 7:55
Speaker 1: my recollection serves, Mr. Kirk used to do that at
• 7:58
Speaker 1: the beginning of his events, and I believe the video
• 8:00
Speaker 1: does show him engaging with the crowd prior to becoming
• 8:03
Speaker 1: seated on the stage. Question. Okay, Judge. At this point,
• 8:07
Speaker 1: the state would seek to admit what's been marked State's
• 8:09
Speaker 1: Exhibit 8. With regard to publication, Judge, it's our position
• 8:13
Speaker 1: that it not be published here in the courtroom, and
• 8:15
Speaker 1: that it not be published so that the cameras can
• 8:17
Speaker 1: display it. Judge Graff. Ms. Nestor. Ms. Nestor, Your Honor,
• 8:22
Speaker 1: we would like to renew our objection to to authentication
• 8:25
Speaker 1: for admissibility purposes under 901, for the reason that I
• 8:28
Speaker 1: mentioned in the 1102, which is someone prepared the clips.
• 8:32
Speaker 1: We don't know who. We don't have that person here
• 8:34
Speaker 1: to cross-examine in terms of what, if anything, was edited.
• 8:38
Speaker 1: And for that reason, we think it can't be authenticated,
• 8:41
Speaker 1: and we object to its admissibility, and our standing objection
• 8:44
Speaker 1: for constitutional grounds. Judge Graff, thank you. Just a moment here.
• 8:49
Speaker 1: Prosecution Judge, would you like me to respond? Prosecution, or judge,
• 8:53
Speaker 1: yes please. Prosecution. Judge, with regard to authentication, again, the
• 8:57
Speaker 1: state must produce evidence sufficient to support a finding the
• 9:00
Speaker 1: item is what the proponent claims it to be. And again,
• 9:04
Speaker 1: under subsection B1, it's sufficient to provide testimony from someone
• 9:09
Speaker 1: that has first-hand knowledge or observed or has first-hand knowledge
• 9:12
Speaker 1: regarding the authenticity of that video. You heard Agent Hull
• 9:15
Speaker 1: testify that he spoke to the owner of it and
• 9:18
Speaker 1: the director of Visual Impulse. Visual Impulse, I believe. It
• 9:22
Speaker 1: was testified, too, that they had a contract with TPUSA
• 9:25
Speaker 1: to film their events. This particular video the state seeks
• 9:29
Speaker 1: to introduce as Exhibit 8 was shown to Mr. Farnsworth,
• 9:33
Speaker 1: and that is the video that Mr. Farnsworth authenticates and
• 9:36
Speaker 1: says that this video was captured by visual impulse cameras.
• 9:39
Speaker 1: So with regards to authentication, I think the state has
• 9:42
Speaker 1: sufficiently provided the court with evidence to authenticate it. Judge Graff,
• 9:47
Speaker 1: and this is State Exhibit 8. All right. I'm going
• 9:50
Speaker 1: to overrule the objection and admit State Exhibit 8, as
• 9:53
Speaker 1: it relates to publication citing Article 1, Section 28.1a, that
• 9:58
Speaker 1: this is a declaration of rights. of crime victims and
• 10:00
Speaker 1: it states, to be treated with fairness, respect, and dignity.
• 10:05
Speaker 1: And to those two points of respect and dignity, the
• 10:07
Speaker 1: court is not publishing this in the courtroom, nor is
• 10:10
Speaker 1: it being published obviously online, but the court will watch
• 10:13
Speaker 1: it in court. And again to the parties, if you
• 10:16
Speaker 1: could protect your screens, however you choose to, And then
• 10:19
Speaker 1: I'll check to see when we're ready. And then we'll
• 10:21
Speaker 1: have it played. So turning to the defense is more
• 10:24
Speaker 1: time needed to, okay, thank you. Turning to the state,
• 10:27
Speaker 1: to your screens, all right, they are. And I see
• 10:29
Speaker 1: a head nod, yes. And let's go ahead and play
• 10:32
Speaker 1: this video only on the monitors. And if there's sound
• 10:35
Speaker 1: associated with it, sound can be played as well. You
• 10:38
Speaker 1: may proceed. And that concludes state exhibit eight. Prosecution, you
• 10:43
Speaker 1: may proceed. prosecution thank you judge so any additional video
• 10:47
Speaker 1: that was collected by either you or another member of
• 10:49
Speaker 1: sbi answer yeah the campus itself uvu is very well
• 10:54
Speaker 1: equipped with cameras throughout and they were willing to work
• 10:57
Speaker 1: with us to provide video from those cameras and so
• 11:00
Speaker 1: that was collected as part of the investigation also question
• 11:04
Speaker 1: with regards to uvu surveillance video do you know what
• 11:07
Speaker 1: video was collected from there behind where mr kirk was
• 11:10
Speaker 1: seated at the time he was shot answer yeah I'm
• 11:13
Speaker 1: aware that under the Hall of Flags, I'll refer to
• 11:16
Speaker 1: it as a breezeway, but a way for people to
• 11:18
Speaker 1: move from one side into the amphitheater, walking underneath the
• 11:21
Speaker 1: Hall of Flags. And I know that there was a
• 11:23
Speaker 1: camera situated in that location. Question okay. And do you
• 11:27
Speaker 1: know with regard to that camera view? Well, let me
• 11:30
Speaker 1: ask you this. So that particular camera view, there was
• 11:33
Speaker 1: surveillance that was provided to you or another agent from UVU?
• 11:37
Speaker 1: Answer correct. Question okay. And do you recall who provided
• 11:40
Speaker 1: that video to you initially and who collected it? Answer. Initially,
• 11:44
Speaker 1: I don't know who specifically collected that video, but I
• 11:47
Speaker 1: know that the whole process was overseen by Mr. Olson,
• 11:50
Speaker 1: who's responsible for the system. Question. Okay. Do you have
• 11:53
Speaker 1: a first name for Mr. Olson? Answer. Curtis Olson. Question.
• 11:58
Speaker 1: I'm sorry. Answer. Curtis Olson. Question. Okay. And do you
• 12:01
Speaker 1: know what Mr. Olson or Curtis Olson's position is at UVU? Answer,
• 12:05
Speaker 1: I believe he's the director. Question, is it his job
• 12:09
Speaker 1: to basically gather and forward any video that's captured by
• 12:12
Speaker 1: UVU scans? Answer, yeah. He has a long title, but
• 12:16
Speaker 1: I think it's director of infrastructure, but he's responsible for
• 12:19
Speaker 1: that system. Question, okay. With regard to that particular video,
• 12:23
Speaker 1: the video from underneath the Hall of Flags, what, if anything,
• 12:26
Speaker 1: have you done with that video in preparation for today's hearings? Answer,
• 12:31
Speaker 1: I went specifically to meet Mr. Olson, have him review
• 12:34
Speaker 1: the video that we had, and again. With, like the others,
• 12:38
Speaker 1: I had him complete the 1102 statement for us, describing
• 12:41
Speaker 1: his role, and verifying the videos. I did that actually
• 12:44
Speaker 1: on July 2nd of this year. Question, July 2nd of
• 12:47
Speaker 1: this year? Answer, correct. All right, folks, we're going to
• 12:51
Speaker 1: wrap it up right here, and in the next episode,
• 12:53
Speaker 1: we're going to pick up with the prosecution at 542
• 12:56
Speaker 1: and 38 seconds. All the information that goes with this
• 13:01
Speaker 1: episode can be found in the description box.
