- 4:53Speaker 2: is a small declaimer. I'm using my platform for for
- 5:00Speaker 2: people to voice there to put out their information. So
- 5:06Speaker 2: this is no reflection on the crew podcasts. Everything is
- 5:11Speaker 2: coming from them and it's not coming from It's not
- 5:15Speaker 2: a reflection of the Crew podcast. I'm waiting for my
- 5:19Speaker 2: co hosts to Chop to call in Cornell. He'll be
- 5:22Speaker 2: calling any minute. But right now I have mister Legate
- 5:28Speaker 2: on the fall with us. Mister Legate, how are you
- 5:35Speaker 2: doing this? How are you doing this?
- 5:40Speaker 4: So that's good?
- 5:43Speaker 2: So it be yes, I can hear you fine, can
- 5:47Speaker 2: you hear me?
- 5:49Speaker 9: Yes?
- 5:50Speaker 2: That's good. So how how have you been doing since
- 5:53Speaker 2: the last time we talked?
- 5:56Speaker 9: Well, I've been pretty busy. I adds down to the
- 6:00Speaker 9: courts for a new Toronto under the Texas Bugles, the
- 6:04Speaker 9: criminal procedure forty four overs one word you can if
- 6:07Speaker 9: you if you meet the four ball relearnment, they should
- 6:11Speaker 9: be entitled to a tutra, which I showed them that
- 6:13Speaker 9: I too, because once the evidence really shows that really
- 6:19Speaker 9: there is no poy to accuse me to take away
- 6:21Speaker 9: the actually who getting hurt of Frederic themoter telling me
- 6:27Speaker 9: I need to go take care of this guy. He
- 6:29Speaker 9: takes him away, and now they don't have no evidence
- 6:31Speaker 9: to bring against type of motive because there's no independent cooperation.
- 6:36Speaker 9: I'm like, well, who who's accused me of? What am
- 6:40Speaker 9: I here for? So that's what I'm doing, and that's
- 6:43Speaker 9: crazy guy every day because I have people like you
- 6:46Speaker 9: helping meet and trying to bring out uh, bring awareness
- 6:51Speaker 9: to this injustice. And thank you no Pluch for having
- 6:54Speaker 9: me bat and the following mes. You share a little
- 6:57Speaker 9: bit more and answer all the questions, use your audience
- 7:00Speaker 9: whatever I want. You ask the questions. I'm ready to
- 7:02Speaker 9: be sure. And all I ask is people, you know,
- 7:05Speaker 9: go take my work for it. If they want to
- 7:07Speaker 9: go see the documentary, go to YouTube and click on
- 7:11Speaker 9: that this ship the.
- 7:12Speaker 4: Big Ope Murder.
- 7:13Speaker 9: If they want to read the story that was written
- 7:16Speaker 9: my textive de Fliver magazine, the story that called the
- 7:19Speaker 9: part of the proof about the first I discovered that
- 7:23Speaker 9: this was in twenty eleven. So uh with that be insane.
- 7:28Speaker 9: I mean, there's so much that's going on right now
- 7:30Speaker 9: with my case that I'm to do it, and it's
- 7:33Speaker 9: surprised because I can't even get the course to give
- 7:36Speaker 9: me another dentry here. I can't even get the course
- 7:39Speaker 9: to do anything for me. I haven't attorney on running
- 7:42Speaker 9: if I get the talk to my pilot, because I
- 7:45Speaker 9: don't even get a response, you know.
- 7:49Speaker 2: So now, yeah, because I talked to mister Earl probably
- 7:55Speaker 2: a week ago, and he told me the same thing
- 7:57Speaker 2: that you guys are. I'm not getting your mail all
- 7:59Speaker 2: the time. So right now my co host is joining us. Everybody,
- 8:05Speaker 2: welcome my co host back Cornell.
- 8:08Speaker 9: How are you doing, hell ma'am, how are you doing?
- 8:11Speaker 9: And I'm glad to be here tonight. How are you doing? Legate?
- 8:15Speaker 9: And how are you doing? Audience? How are you doing?
- 8:17Speaker 4: Uh?
- 8:17Speaker 9: Let's I'm doing great? Thank you.
- 8:23Speaker 2: So we're gonna we want to take off first. You know,
- 8:28Speaker 2: let me get this. We've been trying to meet. We've
- 8:33Speaker 2: been going back and forth, bouncing ideas. Are things off?
- 8:37Speaker 2: Are off each other? Meant me and mister Cornell have
- 8:42Speaker 2: so mister Legate, dude, you recall is there a backdoor
- 8:50Speaker 2: to that establishment, to the to the bar. Do you
- 8:54Speaker 2: recall is there a ball door.
- 9:00Speaker 9: To detective say or what community? And that's so uh mother.
- 9:12Speaker 2: So the the the detectives, there's no back door to
- 9:15Speaker 2: that to the establishment.
- 9:19Speaker 9: Yes, yes, man, there's no back door or nothing there.
- 9:22Speaker 8: Uh.
- 9:22Speaker 9: They laughing as part as my turkey was telling me
- 9:25Speaker 9: because they well, maybe there's a back door to many
- 9:27Speaker 9: said no, there's no back door, and they can't be
- 9:29Speaker 9: checked on in that often. No, No, there is no
- 9:32Speaker 9: back to can you hear me?
- 9:36Speaker 2: I can hear you, Cardinal?
- 9:38Speaker 9: Okay, well, yes, yes, Sam, thank you very much ma'am
- 9:42Speaker 9: for having me here listening the gate. Okay, sir, when
- 9:46Speaker 9: you were sitting in the in the bar, Okay, how
- 9:49Speaker 9: many people were in that witches Well it was kind
- 9:55Speaker 9: of I got there like about len a thirty in
- 9:58Speaker 9: the afternoon and I there Waby's like vis that must
- 10:02Speaker 9: by a handful of propulent oh man, kind of hard
- 10:07Speaker 9: to call. I know that the bartender was there with
- 10:09Speaker 9: her sister who was waite. Uh, that was a tiny
- 10:13Speaker 9: brandy there. Uh, it was maybe I think there was
- 10:18Speaker 9: maybe s eight people tops. Okay, So that being said,
- 10:24Speaker 9: how did you directed at the gilt of the offense
- 10:27Speaker 9: of mister Edie garstin.
- 10:30Speaker 2: Judd he wanted h The question was how was you directed?
- 10:36Speaker 2: Who got you to go? Directed you to mister Eddie
- 10:42Speaker 2: Garcia Uh? Who directed you over there?
- 10:47Speaker 9: Okay? Well that that right there is because learning bad
- 10:51Speaker 9: at yourself. I met learning through Ali Flea, who was
- 10:54Speaker 9: the owner of brus Worts Cards. He had me go
- 10:58Speaker 9: and take as matters go get her car register because
- 11:01Speaker 9: she had just bought a car from Row Sports Cars.
- 11:04Speaker 9: And like I mentioned last time, she had a franciscope
- 11:08Speaker 9: on her view mirror and did to break the ic.
- 11:11Speaker 9: You know, I asked her she was in the medical field.
- 11:13Speaker 9: She said yeah. I said, I'm here. She said no,
- 11:16Speaker 9: oh the upper culebra and Callahan. Well right away. I
- 11:19Speaker 9: had a friend of mine that met the textas gems
- 11:23Speaker 9: and I said, right next to textis jams and she goes,
- 11:26Speaker 9: she like looked at me and she goes, yeah, you know,
- 11:29Speaker 9: I said, yeah, my friend owns that barrector. And like
- 11:31Speaker 9: I also mentioned, in nineteen ninety six, they started construction
- 11:36Speaker 9: on that office and that's how I learned that they
- 11:39Speaker 9: were having that. I didn't know it was dependable over her. Well,
- 11:42Speaker 9: you was going to be an overlooking So when uh,
- 11:46Speaker 9: when he got the I go and hang out around
- 11:50Speaker 9: her house.
- 11:52Speaker 4: Oh what.
- 11:57Speaker 9: Okay? When minute uh? When Holly Kala asked me if
- 12:01Speaker 9: I could find the car for him? You know, I
- 12:04Speaker 9: ain't hip at the job, so why used to go
- 12:05Speaker 9: to her house and I'd wait around, but I never
- 12:08Speaker 9: see no car. I never see nothing. I'd thrive up
- 12:10Speaker 9: at three o'clock in the morning, I wouldn't see nothing.
- 12:13Speaker 9: And I'd be around there and nothing, so I done.
- 12:16Speaker 8: Well.
- 12:17Speaker 9: They told me she worked over there, So that's why
- 12:20Speaker 9: I went to that place. Because she told me she
- 12:22Speaker 9: worked and I kind of figured it's gonna you know,
- 12:25Speaker 9: she might drive up to pick up her chake or something,
- 12:27Speaker 9: and so that's what brought me up with it. Nobody
- 12:30Speaker 9: asked me to go there. I just went on my own.
- 12:34Speaker 9: So kind of go ahead, Cornell, So will you rent
- 12:40Speaker 9: to that office? The bird turn the stude? You go
- 12:43Speaker 9: to that office? Right. I don't know if she saw
- 12:48Speaker 9: me any going, because I said she was inside. I
- 12:50Speaker 9: just walked out and walk in that direction. So she
- 12:54Speaker 9: goes walk Because so are you indicating at the Birn
- 13:00Speaker 9: there's a sea Vale? Yes, yes, the one, the one
- 13:04Speaker 9: that actually worked. Her name was h Josie Hernandez. Hka
- 13:13Speaker 9: all right, at Josie Hernandez, a sister Rosco. Okay, if
- 13:20Speaker 9: do you have any relations to lift attention to Hernndez?
- 13:25Speaker 9: Oh no, not that I know of. No, No, okay.
- 13:29Speaker 9: So but you said you walked in the office on
- 13:31Speaker 9: your own life. So when you got to my office,
- 13:35Speaker 9: how did you have your suit case? Did you have
- 13:37Speaker 9: your suitcase in your handle? Did you sit your suitcase down?
- 13:42Speaker 9: What respected it too for letting your suitcas go? How
- 13:46Speaker 9: is that properable?
- 13:48Speaker 1: Oh?
- 13:49Speaker 9: I I walked here with my friend because I had
- 13:52Speaker 9: my cards and everything with me. So when I got
- 13:55Speaker 9: to the door, I walked in during the gentleman who
- 13:58Speaker 9: happened to be any guardian who I didn't know at
- 14:00Speaker 9: the time. He was on the phone. Right there was
- 14:03Speaker 9: the reception, it said, except there was no reception. That
- 14:06Speaker 9: figures they were following the Mexic work. So he told
- 14:10Speaker 9: me to waiting, so as I went to that walk
- 14:12Speaker 9: and then he turned to walk to his office and
- 14:14Speaker 9: wanted for me to follow him. And while he wouldn't
- 14:17Speaker 9: be having people, I have to my bag on top
- 14:21Speaker 9: of there and this car on the phone, And when
- 14:25Speaker 9: he got up the call, that's when I tried to
- 14:28Speaker 9: shake the can and introduce myself from giving my business
- 14:31Speaker 9: card and just this where everything just to prove that
- 14:34Speaker 9: he just put the table over. Everything had to so
- 14:37Speaker 9: bad as they think, I know, I'm coming out of
- 14:39Speaker 9: the burner chat that was down the ways on I
- 14:42Speaker 9: think you said, Ingram so you so you said.
- 14:46Speaker 2: That mister Garcia is the one that motioned you to
- 14:50Speaker 2: come into the office.
- 14:53Speaker 9: Right right right there, to his office or whatever. Their
- 14:56Speaker 9: office was right there, and I just din I was
- 14:59Speaker 9: insigne he was right here, might by a receptionist said,
- 15:02Speaker 9: And then he hoped for me to follow him, so
- 15:04Speaker 9: I did. He went to the middle office and uh,
- 15:07Speaker 9: I went around at the table, and that's when everything happened.
- 15:12Speaker 2: Did you know anybody else inside the office or did
- 15:18Speaker 2: anybody follow come in behind you? Do you do you
- 15:21Speaker 2: recall anybody anything like that?
- 15:27Speaker 9: Now? I know if I walked in dinner. He told
- 15:30Speaker 9: me to wait, and I followed him, and my my
- 15:33Speaker 9: attention was getting my business card out. I had a
- 15:36Speaker 9: business card in my hand, and I'm sure they bought
- 15:38Speaker 9: the business cards that I didn't tell my driver's license
- 15:40Speaker 9: and everything else that identified they found it in the office.
- 15:44Speaker 9: I never lied. Oh no, I wasn't there. I wasn't
- 15:47Speaker 9: to the old there. So I'm looking for a medic
- 15:49Speaker 9: medic and this is where they getting in all computers
- 15:52Speaker 9: because they were trying to tell me that Merdon medics
- 15:54Speaker 9: didn't work there. Well they wanted that they should did
- 15:57Speaker 9: she just didn't work there at that point in time. Okay,
- 16:01Speaker 9: mister the gate that's trying attending right now what you
- 16:04Speaker 9: was trying to pronounce to you, is how d it
- 16:06Speaker 9: long impossible that you were there with your suitcase? You
- 16:10Speaker 9: set your suitcase down.
- 16:12Speaker 8: On your desk.
- 16:13Speaker 9: You said that when you want to shake you in
- 16:16Speaker 9: and have him one of your business cards. He immediately
- 16:20Speaker 9: trying to now why would he do that? Did he
- 16:24Speaker 9: listen to look beyond you and saw somebody behind you?
- 16:30Speaker 9: Is when the shot I believe that when the worst
- 16:35Speaker 9: I believe that was the guy come in on and
- 16:41Speaker 9: drunk and just shoot up the poster here because I
- 16:45Speaker 9: wouldn't follow him. So marriage you ran immediately, leaving your
- 16:52Speaker 9: toothcas on the desk right again.
- 17:00Speaker 8: Thing over?
- 17:02Speaker 9: Okay, so when you very h the fact, you know,
- 17:06Speaker 9: I meant to say, what you came in? You didn't
- 17:09Speaker 9: see the shooter? Oh yeah, like I said, I saw
- 17:13Speaker 9: somebody and that I even feel it an artist or nothing.
- 17:18Speaker 9: I think was dead because like I said, when I
- 17:20Speaker 9: was in the county, I was like, like the fire,
- 17:23Speaker 9: what am I doing? I did it become murder? Who
- 17:24Speaker 9: got and murdered? I didn't hurt nobody. If I finally remember,
- 17:28Speaker 9: I remember, So this is why I remember. Somebody was
- 17:31Speaker 9: finding guy and this was the kicker. Is when I
- 17:35Speaker 9: was playing with detectives in December and there was somebody
- 17:39Speaker 9: behind me and the dude head dark clothing on with
- 17:42Speaker 9: nothing like a do rag or something on his head,
- 17:44Speaker 9: and uh uh and and that's what I saw. Well
- 17:48Speaker 9: next sure you know, I'm hearing that all the witnesses
- 17:51Speaker 9: were saying that it was the guy in the black
- 17:52Speaker 9: they ran by it, but they also said they saw
- 17:55Speaker 9: a guy in a white shirt, which is me, and
- 17:57Speaker 9: even even the two sisters. Her testimonies contradicted each other
- 18:02Speaker 9: because the markteader was saying that I had dark clothing on,
- 18:05Speaker 9: but the fisher said no, he had a white shirt on.
- 18:08Speaker 9: He even got a hot house on his shirt, which
- 18:10Speaker 9: they catched for blood.
- 18:12Speaker 4: Right in fact negative, Let me up, Let me jump
- 18:16Speaker 4: in real quick.
- 18:18Speaker 2: Angela just informally that she has a video. I sent
- 18:22Speaker 2: her a clip, so I want to play the one
- 18:25Speaker 2: of the clips for the audience real quick. So Angela,
- 18:30Speaker 2: if you can, can you go ahead and roll that
- 18:32Speaker 2: clip so we can listen to it.
- 18:44Speaker 6: Linkoli Gate to the murder, except he was in the
- 18:46Speaker 6: building and he ran. He didn't have gunpowder residue on
- 18:50Speaker 6: his hands, no fingerprints were found. There is no motive.
- 18:58Speaker 3: When we had the detective on the stand, Detective Albright,
- 19:01Speaker 3: I asked him about forensics, specifically, was their blood on
- 19:05Speaker 3: James Legate's clothes and he said no, there was not.
- 19:08Speaker 3: I then asked him about gunpot of residue and he
- 19:11Speaker 3: said there was no gunpot of residue. James Legate tested
- 19:15Speaker 3: within hours clean, nothing on his hands, nothing on his clothes.
- 19:21Speaker 3: I asked him about fingerprints. He said there was no fingerprints.
- 19:24Speaker 3: I said, so, in general, there's no forensic connecting my
- 19:27Speaker 3: client to this case.
- 19:28Speaker 4: Is that correct?
- 19:29Speaker 2: He said, that's correct.
- 19:33Speaker 10: Well, I think it was the evidence that was found
- 19:36Speaker 10: at the scene, pointed us immediately to him.
- 19:41Speaker 2: You don't have many murderers who leave their identification. Okay,
- 19:50Speaker 2: we're bet mister Legate. Is that the first time you
- 19:54Speaker 2: heard the little clipping?
- 19:58Speaker 9: Yes, ma'am. I've never even seen the docum mensary. All
- 20:00Speaker 9: I ever got from this from now was a four
- 20:03Speaker 9: page letter explained everything that she found and and what
- 20:08Speaker 9: uh the state actually said when they brought uh summote
- 20:11Speaker 9: us to their attention, and and uh on uh uh
- 20:15Speaker 9: Jesse Hernandez Hall everything about his life well even in
- 20:18Speaker 9: the even the detective all right succlement report it showed
- 20:22Speaker 9: that he about everything and that he didn't even want
- 20:25Speaker 9: to take a but they didn't even bother to look
- 20:29Speaker 9: at that. They didn't even bother to do anything because
- 20:31Speaker 9: though he had a cocaine uh charge, right after the murder,
- 20:36Speaker 9: they charged him with cocaine, and I think they believe
- 20:38Speaker 9: they indicted him as well, and then they dispit that
- 20:41Speaker 9: case to testifying against me, so they knew he was
- 20:44Speaker 9: lying about his policdentity. They despiped the case because it
- 20:48Speaker 9: wasn't under one once on her Nance, which is his
- 20:50Speaker 9: real name. It was under Jesse Hernanis, which is still
- 20:53Speaker 9: on that record today. And uh, uh no, uh I didn't.
- 20:58Speaker 9: I've never heard of this. Uh I've never heard any
- 21:00Speaker 9: of his clips or even to the documentary.
- 21:02Speaker 4: You know, sorry, and you know I wanted.
- 21:08Speaker 2: I cliped that one so everyone can see that you
- 21:16Speaker 2: are an innocent man.
- 21:18Speaker 8: You are.
- 21:19Speaker 2: You are an innocent man that's being framed. You did
- 21:27Speaker 2: you hear what they said?
- 21:28Speaker 4: You was tested?
- 21:29Speaker 2: He was tested within hours or minutes. What they said.
- 21:34Speaker 2: He didn't have no gun side, no gun residue on
- 21:38Speaker 2: his hands, on his clothes, no fingerprints, and he just
- 21:43Speaker 2: supposedly fired a weapon. They said he was arrested within
- 21:48Speaker 2: what thirty minutes?
- 21:53Speaker 4: Yeah, so that didn't give that wouldn't.
- 21:56Speaker 2: Have gave him no chance to go change no clothes.
- 21:58Speaker 2: He was still in the same clothes, shoes, didn't give him,
- 22:02Speaker 2: no chance to wash his hands or anything. I don't
- 22:05Speaker 2: know how long gun shop residues down your how long
- 22:09Speaker 2: the resident down your hand. But they didn't have no evidence.
- 22:17Speaker 2: The detective testified that they didn't have no evidence against him.
- 22:26Speaker 9: Right, and now now you take away and federal some
- 22:30Speaker 9: motive from the equation. Now I don't even have ancus
- 22:36Speaker 9: excuture didn't even different. So what am I doing in prison?
- 22:40Speaker 9: If you have somebody because you have the right to
- 22:44Speaker 9: confront the winkeet against you, Well they take away against you.
- 22:49Speaker 9: Who do I to have? Yeah, you know what, I'll
- 22:52Speaker 9: just liberal.
- 22:54Speaker 2: I want to jump in because this just dropped in
- 22:56Speaker 2: my spirit real quick. It came from the Bible. Remember
- 23:02Speaker 2: when the the man took the woman that was having
- 23:07Speaker 2: an adultory affair to Jesus and he was down in
- 23:11Speaker 2: the ground, and he was right in the ground, and
- 23:14Speaker 2: he said he told them to cast the further whoever
- 23:20Speaker 2: have not sinned, cast the first stone or and then
- 23:26Speaker 2: everybody walked away and he said, now, woman, where's your
- 23:30Speaker 2: accusers at? Where's your where's your accusers at? Mister loo Gate.
- 23:40Speaker 9: That kid I don't have none if you take away
- 23:43Speaker 9: gets you because the whole motive of Hernandi that they
- 23:47Speaker 9: already go. The whole motives or having me connected crime
- 23:54Speaker 9: was because I mean, Gilbra Dorsia was shying, you can't
- 23:59Speaker 9: go over the business that they were supposed to be
- 24:01Speaker 9: partners in. He was trying to push him out of
- 24:04Speaker 9: the business so he could take the business so himself.
- 24:06Speaker 9: That was the whole motive of Samoa wanting him dead.
- 24:12Speaker 9: Now in document you remember, you gotta remember where Tomortive
- 24:17Speaker 9: was supposedly dead when they had this motives. But when
- 24:22Speaker 9: miss Romero brought the information to the state that hey,
- 24:27Speaker 9: look Timoa, hat did be deactual ther line. But now
- 24:30Speaker 9: they recanted the kid man theory. Yeah, it's the line.
- 24:36Speaker 9: They recanted everything and said, well, it's more than likely
- 24:40Speaker 9: that you'll ever pay charges because there's no independent collaboration
- 24:43Speaker 9: to bring your take again. So well, wait a minute,
- 24:46Speaker 9: you had just hear an engine who are no longer
- 24:49Speaker 9: any equation because even hits as Timoti Soka and you
- 24:53Speaker 9: could take in some motive. So where is my accusers?
- 24:57Speaker 9: They did say John hern editre her headed to two
- 25:01Speaker 9: other individual per se but turn to uh to uh trial.
- 25:09Speaker 9: None of them went to trial because he never testify
- 25:13Speaker 9: or anything to cooborate this. So I've been trying to
- 25:17Speaker 9: get an avid Danky here so they can compete at
- 25:19Speaker 9: these guys and hey, scot tutors, you know, because I
- 25:23Speaker 9: want to prove my health in court. I don't want
- 25:25Speaker 9: to be domerated for shade, but I want to prove
- 25:29Speaker 9: in court. I want my day in court. I want
- 25:31Speaker 9: my day in court, and I want the proof. And
- 25:33Speaker 9: I cannot say, hey, okay, listen to the gate, sir,
- 25:37Speaker 9: right up there for a second man, aeah, listen the gate.
- 25:41Speaker 9: This issue is only please the evidence that late you
- 25:44Speaker 9: to the crime. Say the they saw you right out
- 25:47Speaker 9: of the office, and the and the suit tief, the
- 25:49Speaker 9: receipt and again the paperwork on the floor. So my
- 25:52Speaker 9: question serves this, you left your suitcase inside of the
- 25:56Speaker 9: office after the shops for fire. You say that says
- 25:59Speaker 9: no bad to him. So are you here to me
- 26:02Speaker 9: that you saw a male figure behind him you after
- 26:06Speaker 9: the shock to fire? Is that the bartenders the female
- 26:10Speaker 9: and that they're saying that they only saw you and
- 26:14Speaker 9: another individual will run out of the office. Is that true?
- 26:18Speaker 9: Is that what you're saying? Oh yeah, what it is.
- 26:22Speaker 9: And they only run by the front door of the club,
- 26:26Speaker 9: which the balka And then say the guy in the
- 26:30Speaker 9: black and like I did, like I said, there was
- 26:33Speaker 9: a guy named uh Adolf Sala who is right there
- 26:38Speaker 9: in the front of the bar eating up his car.
- 26:42Speaker 9: Dhr guy in black running running out from the up
- 26:46Speaker 9: and make sure uh car she had thought she had
- 26:49Speaker 9: chop to the ground. There was the metal guy that
- 26:52Speaker 9: was at the corner on the pole. Said that another
- 26:55Speaker 9: guy ran by going straight towards the whole ever street
- 27:00Speaker 9: where he was wearing a white shirt. So that shows
- 27:03Speaker 9: there's two individuals at that point of out. Okay, so
- 27:07Speaker 9: where was the body of just the guard still found
- 27:10Speaker 9: that right there on the on the sidewalk as you're
- 27:16Speaker 9: coming out from the from the office to the sidewalk
- 27:19Speaker 9: right there. Because when you try to grab the guy,
- 27:22Speaker 9: I ordered to miss your fallows he was running him,
- 27:28Speaker 9: but he didn't. He missed him and jumped. So with
- 27:34Speaker 9: that being said, the suitcase has been in the office
- 27:38Speaker 9: My part is this, how did that suitcase get out
- 27:42Speaker 9: of that office? And the people was from your suitcase
- 27:45Speaker 9: got on the floor and the suitcase put the got
- 27:49Speaker 9: down the street. How does that happen? Can you I
- 27:53Speaker 9: mean get well you get it, couldn't find it, but
- 27:59Speaker 9: it's my attorney. And if you and me looking at that,
- 28:02Speaker 9: you someboddy nobody put the team my name, They followed,
- 28:08Speaker 9: they told my history or whatever. They kill a bad
- 28:11Speaker 9: guy and they said, want you want to get in
- 28:13Speaker 9: out anybody in the offense. But the manage to prying
- 28:18Speaker 9: somewhere else. Okay, logic and logic. Let's look at logic
- 28:22Speaker 9: number one. E scuse me, ma'am.
- 28:23Speaker 4: This does tha Okay, this.
- 28:25Speaker 9: Is a murder, mister Legate. This is a murder case,
- 28:28Speaker 9: mister Legates. And you know one thing, the Paris are
- 28:30Speaker 9: going to come because this man just got shot, so
- 28:33Speaker 9: they'll come investigated, the police and everybody comes to the
- 28:36Speaker 9: fire scene. The question is this when they went to
- 28:39Speaker 9: his office. Investeah, you took pictures? Where was that suitcase
- 28:45Speaker 9: at because that suitcase, what's the murder off? Get it
- 28:48Speaker 9: up down and behind the building. How did your suitcase
- 28:51Speaker 9: hit out of that office? Sell? Of course, so if
- 28:54Speaker 9: that's the box the bartender, somebody began to established it
- 28:59Speaker 9: happened they get the suitcase behind the buildings. Wow, because
- 29:02Speaker 9: you're saying that the man you kill is because you
- 29:04Speaker 9: take yourself ran how of the front door? So how
- 29:07Speaker 9: did the suitcase get behind the building? That's the question
- 29:10Speaker 9: I'm asking. Can you give me any type of vernonomics today?
- 29:15Speaker 9: I can't. I can't really uh really keep you a
- 29:18Speaker 9: definite and that conclusionary allegations that anything for the acts.
- 29:23Speaker 9: But the only thing I could change, the only thing
- 29:25Speaker 9: I could change it. And I can't say it's a
- 29:29Speaker 9: parttender because you she was in the club and this
- 29:33Speaker 9: is the office right in the club. So I do
- 29:37Speaker 9: not believe it has to do with any event. They
- 29:39Speaker 9: went in there and and seriously ranting the thing. But
- 29:42Speaker 9: I wouldn't think you were probably somebody from the police
- 29:45Speaker 9: department and actually said it up.
- 29:47Speaker 2: Because you know, because in the documentary, the only thing
- 29:53Speaker 2: that the witnesses that were standing outside, the people that
- 29:58Speaker 2: were standing outside, they just said that they seen you running.
- 30:04Speaker 2: They didn't say they seen you with a briefcase or anything.
- 30:09Speaker 2: Only how the briefcase came in place is when I
- 30:13Speaker 2: was looking at the documentary. It says that this is
- 30:17Speaker 2: the type of briefcase or step satchel that you are known,
- 30:22Speaker 2: that you are known to carry.
- 30:27Speaker 9: It.
- 30:28Speaker 2: Didn't say that you had and that they seen it bar.
- 30:31Speaker 2: No one ever said that they seen you running with
- 30:36Speaker 2: that briefcase. They just seen it inside the bar. And
- 30:42Speaker 2: you are known to carry a sachel like that. That's
- 30:47Speaker 2: what the documentary says, and no one, no one seen
- 30:51Speaker 2: you run with it. My question is to you is
- 30:57Speaker 2: if supposed to you were supposed to have been the hitman,
- 31:03Speaker 2: why would you drive your car and run passing your
- 31:07Speaker 2: car instead of getting in your car? You know that
- 31:10Speaker 2: that that would be my thinking. You know, if I'm
- 31:13Speaker 2: gonna do something crazy like that, whichy'all want, I probably
- 31:19Speaker 2: would have parked my car around the street or had
- 31:23Speaker 2: somebody waiting down down the street. You know, you wouldn't
- 31:30Speaker 2: just gonna take your car and park it out there
- 31:32Speaker 2: and knowing that you finished go do a crime like
- 31:38Speaker 2: this and have no information inside of that car. At least,
- 31:43Speaker 2: I wouldn't think he would do anything like that.
- 31:48Speaker 9: Well, yeah, I mean something like that, And I believe
- 31:56Speaker 9: Journey had had something to that point and put nobody
- 32:03Speaker 9: detending was smart another word trying to say that was stupid. Look,
- 32:08Speaker 9: hang up, would you like can I call back?
- 32:10Speaker 2: Yes, you can call back Angela actually have but we're
- 32:14Speaker 2: going to play another clip and got allow of you
- 32:19Speaker 2: guys to call me back.
- 32:21Speaker 4: Okay, okay, thank you, you're.
- 32:27Speaker 9: The game.
- 32:29Speaker 6: The building away from the murder scene didn't have guns
- 32:33Speaker 6: on his hands, no fingerprints.
- 32:35Speaker 9: Were coming to town.
- 32:36Speaker 6: There's no mode on the murder scene.
- 32:38Speaker 9: It was found in a in a small fenced area
- 32:40Speaker 9: that was connected with an apartment complex.
- 32:42Speaker 3: When we had the detective on the stand, Detective ball
- 32:44Speaker 3: Brook found about friends with sacifically with briefcase, black bookcase,
- 32:50Speaker 3: and he said, that's the description of a about guns.
- 32:54Speaker 3: The gate was known to carry. There was no gun pow.
- 32:57Speaker 9: Opportunity gate and also because was clean described by.
- 33:01Speaker 3: The nothing on his hands with it in the bar,
- 33:02Speaker 3: nothing on his clothes.
- 33:04Speaker 1: James finger rested, there was no power.
- 33:08Speaker 3: I said, so in general, there's no friend to this case.
- 33:12Speaker 4: Is that definitely said that's what.
- 33:17Speaker 9: Well.
- 33:17Speaker 10: I think it was the evidence that was found at
- 33:20Speaker 10: the scene immediately excellent work.
- 33:24Speaker 6: And invest You don't have any murderers who leave their
- 33:27Speaker 6: identification problem is that the murder except he was in
- 33:31Speaker 6: the building, didn't have gunpowder resident on his hands, No
- 33:36Speaker 6: fingerprints were found.
- 33:37Speaker 3: There is no motive, the jury told myself. Did everything stopped?
- 33:42Speaker 3: Nobody investigated anything else. We have a detective picture, James,
- 33:47Speaker 3: I asked, he didn't anything. Flood pointed close and so
- 33:52Speaker 3: when that was nother one would have to say after
- 33:54Speaker 3: and then asked those twenty four it wasn't. There was
- 33:57Speaker 3: no gun powder, James, get your job was within hour
- 34:02Speaker 3: was a d job. Nothing on his hammer, this thing
- 34:04Speaker 3: and nothing on this and make sure it was James
- 34:06Speaker 3: gask him about fingerprints. He said there was no fingerprints.
- 34:09Speaker 3: I said, so in general, there's no friends.
- 34:15Speaker 2: Wow, so we're back. I'm just waiting on my co
- 34:19Speaker 2: host and mister Legate to call me back. And here's
- 34:24Speaker 2: mister Legate, give me one minute a.
- 34:27Speaker 9: Free call from James Legate. And you guys.
- 34:35Speaker 8: Please monitoring to accept this free calls. One to refuse
- 34:41Speaker 8: this pre thank you for producing secure US. You may
- 34:44Speaker 8: start the conversation now.
- 34:46Speaker 2: Okay, okay, we just waiting on mister Cornell to call back.
- 34:53Speaker 2: But doing the we just played where they just showed
- 34:59Speaker 2: the clip where the soup the briefcase was found along
- 35:05Speaker 2: with the gun.
- 35:07Speaker 4: Was fine.
- 35:09Speaker 2: So here's mister Cornell so we can finish our talk.
- 35:13Speaker 4: Yah, you know this is just.
- 35:17Speaker 2: I don't know your your your case really stands.
- 35:23Speaker 8: Out too to learn how to put money into your
- 35:28Speaker 8: pre Thank you producing secure us. You may start the
- 35:31Speaker 8: conversation now, Cornell.
- 35:38Speaker 2: So we're we're all back. We're all back. So where
- 35:44Speaker 2: did we leave off of with?
- 35:47Speaker 9: Okay, you about the vehicle.
- 35:50Speaker 2: Yeah, about the vehicle. So you know, what would you
- 35:54Speaker 2: saying about your about your your lawyer was.
- 36:00Speaker 9: Attorney yes, and I'm like, you know, asked some kind
- 36:06Speaker 9: of something about the question about who can their their
- 36:10Speaker 9: owner dentication and everything to my hit and that three
- 36:15Speaker 9: if I remember correct me, uh that he never want
- 36:17Speaker 9: to sick part she was sifted prosecutor. She said, well,
- 36:21Speaker 9: nobody says that the dettending was smart an other wise
- 36:25Speaker 9: trying to say that I was so stupid and I'm
- 36:27Speaker 9: going to go down there with with my credentials parking
- 36:31Speaker 9: the car right in front and everything, and like you said,
- 36:34Speaker 9: I mean, who's gonna do that? And that don't make
- 36:37Speaker 9: no sense. I mean anybody can. I mean I didn't
- 36:40Speaker 9: even know there was a shape back there in the
- 36:42Speaker 9: back and and I said it was not my food.
- 36:45Speaker 9: And uh but I used to go to that club
- 36:48Speaker 9: there because there was a player, but I moved to
- 36:51Speaker 9: the back or anything like that. I just seen on
- 36:53Speaker 9: the main street and drop all the way down the
- 36:55Speaker 9: freeway or or back to the other way. Uh So
- 36:58Speaker 9: I done really paid attention. That was a little surprising
- 37:01Speaker 9: to me because anybody, anybody knows that neighborhood, they could
- 37:04Speaker 9: have just parked on the back and back if they
- 37:07Speaker 9: knew that there was a short cut to get to
- 37:08Speaker 9: that street, just like turning the one they said that
- 37:11Speaker 9: that that guy wearing black turned and he ran through
- 37:14Speaker 9: the back. You know, anybody would have known that. I mean,
- 37:17Speaker 9: I didn't know nothing about that, and that was so
- 37:21Speaker 9: so uh ironic to me, you know, but I told
- 37:24Speaker 9: my turn of that too, I'm looking if you don't
- 37:26Speaker 9: look at it, I ain't that existed there. I didn't
- 37:29Speaker 9: know nothing about that street. So yeah, so I hope
- 37:33Speaker 9: that answers your question.
- 37:34Speaker 2: Yeah, because that, you know, that was like to me
- 37:38Speaker 2: when I seen it and to and they said your
- 37:41Speaker 2: car was there, and I was like, wow, you know,
- 37:44Speaker 2: he don't book passed his car. He left the car
- 37:47Speaker 2: on scene. You know there, you know, the quickest getting
- 37:50Speaker 2: away with being jumping your car, just go or a
- 37:53Speaker 2: parky car down the street. I'm not giving nobody no ideas,
- 37:58Speaker 2: So I'm just saying we're just having a conversation.
- 38:05Speaker 8: You know.
- 38:08Speaker 2: Then you say this birch guard, and now I ain't
- 38:13Speaker 2: saying that. I'm just and mister leg Case. We're talking
- 38:17Speaker 2: about mister Legates. Nothing else.
- 38:21Speaker 9: Okay, Well, mister Waus. She had made an a question
- 38:27Speaker 9: to me earlier. She asked the question, how do mister
- 38:32Speaker 9: suggested Hernandez a form Hernndez, little, mister Legates, Well, I
- 38:39Speaker 9: I thank you to my turn in the first day.
- 38:42Speaker 9: If I'm you're a but if you came you know
- 38:47Speaker 9: to me by John nag he was folks were of
- 38:54Speaker 9: my of my boss. Jim Walker was the owner of
- 38:57Speaker 9: Advantage out of finance. He had made him mused with
- 39:01Speaker 9: John Hernandez. He sold him a car, bought his wife
- 39:03Speaker 9: a car, He bought my boats and way runners. And
- 39:08Speaker 9: uh that's how I met John Hernandez. That was how
- 39:11Speaker 9: I met him. I didn't know him anywhere any any
- 39:14Speaker 9: other way other than that. And uh you know that
- 39:18Speaker 9: was did you? He was job? He was a young kids. Okay,
- 39:22Speaker 9: So now my question is this, Well, would he say
- 39:26Speaker 9: that he was close by you, mister Rule and uh
- 39:29Speaker 9: and others when mister Muller Lrua was sending you and
- 39:35Speaker 9: the other guy that he needed to tation. Why would
- 39:37Speaker 9: mister hernandus say that he actually gave you a weapon
- 39:41Speaker 9: after that conversation. You know, I don't know, but if
- 39:46Speaker 9: you look at the the supplemental report, you're gonna shot
- 39:49Speaker 9: the contraction. He he he met Lona a week before
- 39:56Speaker 9: the murder, but then in the investigation report because also
- 40:01Speaker 9: that uh uh, and he gave me a gun a
- 40:05Speaker 9: month before the murder because I got into an agreement
- 40:08Speaker 9: to protect that tomorrow. So I'm like, well, what don't
- 40:12Speaker 9: make no sense? You see, I was saying, other to
- 40:15Speaker 9: get your stories. And one thing about the state, they
- 40:19Speaker 9: never paid my attorney his statement. They never had them.
- 40:23Speaker 9: We never had to prous havin him or anything like that.
- 40:26Speaker 9: We had to just go with whatever they thought to ask.
- 40:29Speaker 9: Even though the judge told her that well if he
- 40:31Speaker 9: made take ma, she need to give it to him.
- 40:33Speaker 9: But we never got it. Okay, So the girl was
- 40:37Speaker 9: there said to have to give it to you a
- 40:39Speaker 9: month before, mister God said had even made any mentions
- 40:42Speaker 9: of the discovery that the PSI was losing money because
- 40:46Speaker 9: the listener the moon was given away drinks and stuff
- 40:49Speaker 9: like that. Is that what you're saying, Well, yeah, the
- 40:53Speaker 9: gun was post We give it to me a month
- 40:55Speaker 9: before so that I can protect tomorrow. And remember he
- 40:59Speaker 9: also said it introduced me to the mona. There's a
- 41:06Speaker 9: big difference from a month to a week, you know
- 41:10Speaker 9: what I'm saying, So to protect your mooddy in the
- 41:14Speaker 9: future that I don't even know. And then I just
- 41:16Speaker 9: turned to meet him, uh later on in the future
- 41:19Speaker 9: a three weeks later or a funk lator that way,
- 41:22Speaker 9: And there was the all week we got three weeks later.
- 41:25Speaker 2: Could I ever could I jump in real quick?
- 41:28Speaker 9: Yes?
- 41:29Speaker 2: Well, yes, you know, I was just reading this article.
- 41:35Speaker 2: I sent you the article. Uh, mister Legate and mister
- 41:43Speaker 2: Garcia was he was don't nobody deserve to lose their life?
- 41:50Speaker 2: But he was tied into a lot of a lot
- 41:55Speaker 2: of other things. Did that And for them to say
- 42:00Speaker 2: the clip that we just played that once they arrested you,
- 42:04Speaker 2: the investigation didn't it just stopped. They didn't look into nothing,
- 42:09Speaker 2: nobody else but I'm looking at this article and I
- 42:14Speaker 2: can't wait for you to read it, and I'm gonna
- 42:16Speaker 2: send it to YouTube. Cordell something about the light is
- 42:20Speaker 2: the light of newspaper down here? Or what is the
- 42:26Speaker 2: light down there?
- 42:32Speaker 9: It wasn't a paper company owned by the Hurst Corporation.
- 42:37Speaker 8: So.
- 42:40Speaker 2: Mister mister Eddie Garcia was trying to acquire that. Did
- 42:48Speaker 2: you guys know.
- 42:49Speaker 9: That, right? I heard about it. I just didn't.
- 42:55Speaker 2: Yeah, And it was and it gives a lot of
- 42:59Speaker 2: you know, the Justice Apartment isn't aimed in this. A
- 43:05Speaker 2: couple of one. Senator, I just can't wait for you
- 43:10Speaker 2: to to get this this I can't wait for you
- 43:16Speaker 2: guys to get it, because we're gonna have to have
- 43:18Speaker 2: you come back and once you get it so we
- 43:21Speaker 2: can clear this up. We got a senator and we
- 43:24Speaker 2: got a consoleman all in this right, and you you know,
- 43:36Speaker 2: and it's just like for them to stop investigating just
- 43:40Speaker 2: because your I D. Because they found not even the
- 43:43Speaker 2: hard copy of your I D. They found a copy
- 43:48Speaker 2: of your I D. For them just to stop and
- 43:51Speaker 2: not look into all the other business dealings that he
- 43:56Speaker 2: was associated with. Looking at the documentary, you know, one
- 44:00Speaker 2: of his daughters. I really truly believe that the family,
- 44:06Speaker 2: I really believed that you didn't. They believe that you
- 44:10Speaker 2: have a part in it, but they don't believe that
- 44:13Speaker 2: you was actually committed the crime. Let me put it
- 44:20Speaker 2: like that, you know, and they want the truth, but
- 44:26Speaker 2: they go with this conviction, this unlawful conviction. They go
- 44:30Speaker 2: ahead and go take it because someone is actually in
- 44:36Speaker 2: prison for the murder of a father when you are
- 44:40Speaker 2: actually an innocent man.
- 44:43Speaker 9: Okay, okay, So yeah, let's let's look. They're indicating that
- 44:50Speaker 9: two people ran from this officer, two people yourself and
- 44:54Speaker 9: another individual who y'all have said that Garcia was chasing
- 44:58Speaker 9: and trying to collap. Okay, now, money up. He was
- 45:01Speaker 9: found outside of the office. That's the question, number one?
- 45:05Speaker 9: How could that logic be possible? That don't nobody know
- 45:07Speaker 9: that this man was not shot by it about somebody
- 45:10Speaker 9: else who he was cheeking, but obvious that he knew
- 45:13Speaker 9: who had shot at him and shot him five times.
- 45:16Speaker 9: So now I was logically possible, sir, that you are
- 45:20Speaker 9: being the only one who was investigated for causing the
- 45:24Speaker 9: death of mister Eddie gar Cia. But here is nobody
- 45:27Speaker 9: else is edicating that the guy who missed the gods.
- 45:29Speaker 9: It was stating, why is it that the people that
- 45:34Speaker 9: owned that was in the club did not point out
- 45:36Speaker 9: that the murderer had a weapon. So now let me
- 45:39Speaker 9: ask you this question. Then, how did the murder weapon
- 45:42Speaker 9: get found around the corner with the with the suitcase?
- 45:45Speaker 9: If the murderer ran out the building with the gun,
- 45:48Speaker 9: that don't add us? Did you think that I had
- 45:52Speaker 9: us bought me. No, it's gone, it's done. And you
- 45:57Speaker 9: because that's what they said, my whole belief, which I
- 46:01Speaker 9: can't support it because I don't have no brood and
- 46:04Speaker 9: that somebody who was investigating your case saw my name,
- 46:07Speaker 9: probably ran my name and can almost be benish told
- 46:10Speaker 9: before let just go ahead and give it to him,
- 46:13Speaker 9: should say, and just get going and hear everything you know,
- 46:16Speaker 9: set it all up, the pictures of it and everything.
- 46:19Speaker 9: That's my period. But I don't have no und So
- 46:22Speaker 9: I can't you earth that somehow this is a political
- 46:31Speaker 9: hitch to edicating to me wow, because I'm saying I'm
- 46:35Speaker 9: the fact that the muker a ran out of the office,
- 46:38Speaker 9: ran out of the business with the murder weapon that
- 46:40Speaker 9: he used to kill his me. Now your suitcase with
- 46:43Speaker 9: another girl was found around the corner. Is this a
- 46:46Speaker 9: se point type of a murder? On wasn't a prop
- 46:49Speaker 9: murder from some political forces to have the big mister
- 46:52Speaker 9: Edydart there killed? How was it logically possible, sir, that
- 46:57Speaker 9: there's nobody going out a second individual? And I grew
- 47:00Speaker 9: up being the only one for the of that's not
- 47:07Speaker 9: and and and then and that's that don't don't it
- 47:10Speaker 9: don't have uh don't add because one like he said
- 47:15Speaker 9: that none of those dirty falls even even uh Adolf
- 47:18Speaker 9: fellows are that was that was getting up a car
- 47:21Speaker 9: right there in the front of the club, Right there
- 47:22Speaker 9: in front, he said. The guy was looking was wearing
- 47:25Speaker 9: dark clothing. He said, the guy and I was the
- 47:28Speaker 9: only one in the lineup. There was nobody else in
- 47:31Speaker 9: the line by my fil and and how adols Are said, well,
- 47:36Speaker 9: he looked similar, but the guy that he saw had
- 47:39Speaker 9: dark cloth straight up told him like that. But they
- 47:42Speaker 9: just kept on, kept me, kept me. They didn't go
- 47:45Speaker 9: and investigate nobody else. They weren't looking for nobody else
- 47:49Speaker 9: or anything like that. And like I said earlier, I
- 47:52Speaker 9: explained to the detectives, I think somebody wearing dark clothing
- 47:55Speaker 9: because every everything happened so fast. I mean, it's kind
- 47:58Speaker 9: of hard they think that people with with somebody. I
- 48:01Speaker 9: wasn't doing drinking for all right. Everything happened so bad.
- 48:06Speaker 9: It's not like somebody's gonna stop and take a picture
- 48:09Speaker 9: over your mind and just be okay, I'm gonna remember
- 48:12Speaker 9: everything here and then you take off running. When everything
- 48:16Speaker 9: happened right there, It's like if I worked for a
- 48:18Speaker 9: Twilight Gone. I mean, it was just so crazy because
- 48:20Speaker 9: any think I know, I was coming out of the
- 48:23Speaker 9: berber key. I don't even remember getting out that boss
- 48:26Speaker 9: like they told me the bus. I don't remember nothing
- 48:29Speaker 9: of that. I can remember nothing I remember if I
- 48:33Speaker 9: wasn't playing for miss But because we don't have much time, listen,
- 48:40Speaker 9: my opinion in this particular case to get you some
- 48:43Speaker 9: type of relief on your convictions, I would be this
- 48:46Speaker 9: is that we would have to come up with a
- 48:48Speaker 9: signature petition asking that the some of his office re
- 48:51Speaker 9: looking to your Okay, so wow, because there's too many
- 48:54Speaker 9: unappad questions. Number one, you know, and number two, y
- 48:58Speaker 9: is it that the second ed it didn't it was?
- 48:59Speaker 9: Now say, because he was never caught, So why is
- 49:02Speaker 9: it that the Distant Attorney's office focus only on you
- 49:05Speaker 9: when you didn't have no gun file of residue on
- 49:07Speaker 9: your clothing on your head, That there was no finger
- 49:10Speaker 9: prints on the mineral weapon that they training, miss clearier
- 49:12Speaker 9: weapon that was found. There was no finger press on
- 49:15Speaker 9: the suitcase, there was no other special even connections the
- 49:18Speaker 9: pile of deadly weapon that college that THETI. With that
- 49:22Speaker 9: being said, sir, you know, we're as for anybody who's
- 49:26Speaker 9: in to this podcast tonight is to come on and
- 49:29Speaker 9: join the forces. And here we could sign a petition
- 49:31Speaker 9: to get mister James Lagate's cage reopened through the District
- 49:35Speaker 9: Attorney's office, the FBI, and the Department of Justice, because
- 49:38Speaker 9: the Tennis and man is being trained for a crime
- 49:40Speaker 9: that he did not commit number one and this clime
- 49:43Speaker 9: of is being covered up on the District Attorney's office,
- 49:45Speaker 9: the SDI and whoever else is covering this case up
- 49:48Speaker 9: because of the name of the individual killing the case
- 49:51Speaker 9: and his pride to cut congress members, tenators, they went
- 49:55Speaker 9: the vents senators and stuff like this. So listen legates
- 49:58Speaker 9: and then he's been trained for crimate didn't commit. And
- 50:01Speaker 9: I would hope that anybody that's listened to this podcast
- 50:04Speaker 9: tonight would join in on any time petition for the
- 50:08Speaker 9: disc Returney's office in their county to open up looks
- 50:12Speaker 9: at the ampligation.
- 50:13Speaker 4: Thank you, ma'am.
- 50:13Speaker 9: That's my take on this.
- 50:16Speaker 2: And you know what, I just want to read this
- 50:18Speaker 2: right for you, because this, you know, just keep on.
- 50:21Speaker 2: You know, they keep saying that it was a hit,
- 50:24Speaker 2: that you know it was a hit, that you know
- 50:27Speaker 2: they passed you that uh go do this, and it
- 50:33Speaker 2: says this little article says the DA got a controversy conviction,
- 50:40Speaker 2: but nobody had ever figured out who bank wrote this
- 50:45Speaker 2: alleged hit. Mister look Gate, this is my last question,
- 50:51Speaker 2: because we got nine minutes to wrap it up. Did
- 50:56Speaker 2: they ever check your bank account to see if how
- 50:59Speaker 2: much more was in your bank account, if if you
- 51:03Speaker 2: was paid to do this hit.
- 51:06Speaker 9: Yes, ma'am, they checked my bank account and the only
- 51:09Speaker 9: thing they all was a few hundred dollars that I
- 51:11Speaker 9: had in there. That's all I had. They have no more,
- 51:15Speaker 9: they have no other money nothing. In fact, my my
- 51:18Speaker 9: mom who helped me with my attorney, My mom paid
- 51:21Speaker 9: for everything. You know that she's a she's a still
- 51:25Speaker 9: living and I thank God for that. But she she's
- 51:28Speaker 9: the one who spent her life, savings and everything to
- 51:31Speaker 9: try to help me with my cage and all that time.
- 51:33Speaker 9: It was ninety nine years prince for the murder.
- 51:36Speaker 4: I didn't do.
- 51:38Speaker 9: Wow, but they did say. They did say, yeah, MYI
- 51:44Speaker 9: of whose money? Who go off this congressmanship because of
- 51:48Speaker 9: Ady Garcia? Try to go and talk to a guy
- 51:52Speaker 9: named Charles ro Previous who came from He was the
- 51:55Speaker 9: surprise with that. They brought in outside the front of
- 51:58Speaker 9: the jury and went to Charles L. Friggas. He offered
- 52:01Speaker 9: a thousand dollars hit for Lady Garcia, and that the
- 52:06Speaker 9: hitman was supposed to be thrown in from California was
- 52:09Speaker 9: a Hungarian descent. Uh. And I had that on an
- 52:13Speaker 9: affidavit in my attorney rope against my eleven O seven
- 52:18Speaker 9: and he brought that. Uh. He also brought up that
- 52:20Speaker 9: I told him, oh, they got Jesse Hernandels tell him
- 52:25Speaker 9: that they got too, which was alive. And I objected
- 52:27Speaker 9: to that. And every every way possible he has made
- 52:30Speaker 9: it possible. I think he contributed part to my conviction
- 52:34Speaker 9: too by even asking for a self defense uh instructions
- 52:38Speaker 9: when I actually told him, no, don't do that, because
- 52:41Speaker 9: I know I'm not an attorney, but that almost I
- 52:44Speaker 9: keep putting me on the on the conference by me
- 52:46Speaker 9: saying I had a gun. I said, that's bland. I
- 52:48Speaker 9: didn't hire you to ride. I was hired you to
- 52:51Speaker 9: defend me. Was a not guilty defense. But they did
- 52:56Speaker 9: it anyway. And I also had a woman coming go
- 52:59Speaker 9: to the belief detective. They have to conctors come and
- 53:02Speaker 9: see me while I was your economy, I mean out
- 53:03Speaker 9: of ecologies, and they said that you want to be
- 53:07Speaker 9: the daughter of the deceased who said she believed that
- 53:10Speaker 9: I didn't do it, but I know who did it.
- 53:13Speaker 9: And like I told him, I said, look, I've already
- 53:16Speaker 9: got all this time in here. I'm not going to
- 53:17Speaker 9: do somebody at this time. If I too look at
- 53:20Speaker 9: this crime, trust me, I ain't got no shape in
- 53:23Speaker 9: my hand. By killing the mood was because I'm not
- 53:25Speaker 9: doing the time for nobody. This time has cost me
- 53:29Speaker 9: my daughter who died in two thousand and six. I
- 53:32Speaker 9: wasn't able to I wasn't okay, I wasn't yeah, I
- 53:42Speaker 9: wasn't able to tell the bar. I wasn't able to
- 53:45Speaker 9: hold her. I wasn't able to burry her so very
- 53:50Speaker 9: wrong that.
- 53:53Speaker 2: Okay, I know how you feel, mister. It's okay, it's okay,
- 54:02Speaker 2: it's okay, it's okay. I my heart goes out to you.
- 54:10Speaker 2: My heart goes out to you, mister Legate. It's okay.
- 54:15Speaker 2: We got five minutes and I'm gonna wrap it up
- 54:19Speaker 2: with our mister Legate, my heart goes out to you.
- 54:24Speaker 2: My heart goes out to you. I know how you

- 54:34Speaker 2: know that feeling, but I know how it feels to
- 54:37Speaker 2: lose a child. And my heart goes out to you.
- 54:41Speaker 2: And I'm sending you a great big hug all the
- 54:45Speaker 2: way over there. And I will personally give you a
- 54:48Speaker 2: hug when you walk up out of them gates, free

- 58:02Speaker 3: James Legate, at the time, was a person who repossessed cars.
- 58:08Speaker 3: James Legate was in the area of the Player's Bar
- 58:12Speaker 3: in Edny Garcia's office because he was trying to repossess
- 58:16Speaker 3: a car belonging to Maryland Maddox.
- 58:19Speaker 4: He knew Maryland.
- 58:20Speaker 3: Maddox had worked for a home healthcare agency, but he
- 58:24Speaker 3: didn't know whose home health care agency. That day he
- 58:30Speaker 3: had gone to players, and while he was in the bar,
- 58:34Speaker 3: he'd started thinking about the home healthcare which was next door,
- 58:38Speaker 3: and he started thinking about going over there to inquire
- 58:40Speaker 3: about whether Maryland Maddox had ever worked there.
- 58:44Speaker 10: James Legate in nineteen ninety eight was a small lot
- 58:48Speaker 10: car salesman,
