- 0:00Speaker 1: What's up everyone, and welcome back to the Epstein Chronicles.
- 0:05So we've been focusing a little bit on the Diddy situation,
- 0:08but don't think for a minute that I haven't been
- 0:10paying attention to what's going on down in the US
- 0:13Virgin Islands as a lawsuit continues to make its way
- 0:16through the system. And today we have a letter from
- 0:21Jean de Jong's lawyers address to Judge Submaranian. So let's
- 0:27just dive right in and let's see what John Dejeong
- 0:30has to say for himself. Case number one twenty three
- 0:34DASH CV DASH one zero three zero one. Dear Judge Submaranian,
- 0:42we represent defendant, Governor John Dejeong, Junior, and we submit
- 0:46this supplemental briefing on topic discussed at the conference pursuant
- 0:50to this Court's order and to highlight particular cases or arguments,
- 0:55including those made at the conference by a plaintiff's council.
- 0:58We also join in and in corporate the other arguments
- 1:01made by the code defendants in their respective letter submissions.
- 1:06While Jean DeJong JDJ has elected to focus here primarily
- 1:10on venue arguments, JDJ still maintains that the second amended
- 1:14complaint should be dismissed for the reasons argued by JDJ
- 1:18and other defendants. If it is not dismissed, including for
- 1:22improper venue, the case should be transferred to the District
- 1:25of the Virgin Islands one plaintiffs inadequate responses to venue questions.
- 1:32This case should be dismissed or transferred because plaintiffs file
- 1:35this case in the wrong venue US Code twenty eight
- 1:38section fourteen oh six A thirteen ninety one B, and
- 1:41this court lacks jurisdiction US Code twenty eight section sixteen
- 1:45thirty one. Even if venue is proper in the SDNY,
- 1:49the case should still be transferred pursuant to US Code
- 1:52twenty eight section fourteen oh four A. The court addressed
- 1:56the venue issues at the hearing, asking plaintiff's council, mister Murson,
- 2:00let me ask you a practical question. You could avoid
- 2:03all of these personal jurisdiction issues simply by filing this
- 2:07case in the US Virgin Islands or by consenting to
- 2:09transfer to the US Virgin Islands. Is there a reason
- 2:12why you don't want to do that. The court appears
- 2:16to have determined that the first part of the two
- 2:18part test under US Code twenty eight, Section fourteen oh
- 2:21four is satisfied the case might have been brought in
- 2:25the transfer revenue the USVII Franswais versus BAC Servicing twenty
- 2:30fourteen WL one three eight three two six zero at
- 2:34one SDNY twenty fourteen. Mister Merson did not dispute that
- 2:39the case might have been brought in the USVII either. Instead,
- 2:42mister Merson responded claiming there's a whole bunch of reasons
- 2:46why plaintiffs didn't file in the USVII, but in fact
- 2:50that bunch of reasons does not support venue in the
- 2:53SDNY A conclusiory statements about fear of the DVII. Mister
- 2:58Merson's lead argument was a k pclusiony assertion that all
- 3:01plaintiffs are afraid to go back to the DVII. Mister Merson,
- 3:05the main reason is we have clients who are afraid
- 3:08to go back to the US Virgin Islands and litigate
- 3:11their case there. First, Mister Merson's conclusiory statements that the
- 3:15plaintiffs are afraid to go back to the USVII is
- 3:18not evidence. See big Vision verse ei DuPont d no.
- 3:22Moor's one F dot supp three D two twenty four
- 3:25two fifty five N thirty six, SDNY twenty fourteen, noting
- 3:31the lack of any evidence in the record supporting a
- 3:33party's allegations other than Council's conclusiory assertions at oral argument,
- 3:38which of course is not evidence. LCM twenty two, verse
- 3:43Curtis Simmons Betting twenty twenty one, WL nine one eight
- 3:47seven five four SDNY twenty twenty one. Statements at oral
- 3:51arguments are not evidence. Second, the plaintiff's apprehension about litigating
- 3:56in a forum where she was injured cannot categorically render
- 3:59the forum and proper, especially because the citis of the
- 4:02incident is normally the basis of the venue. In Paigic
- 4:06versus Choice Hotels International, the plaintiff brought claims related to
- 4:11sexual assault against the defendant, who sought a venue transfer
- 4:14pursuant to us CO twenty eight Section fourteen oh four A.
- 4:18The plaintiff and the conclusiony assertion that San Juan, Puerto
- 4:22Rico is not the proper forum for this matter twenty
- 4:25nineteen w L one three two three four one oh
- 4:28five at three Southern District, Florida, twenty nineteen and in
- 4:33response to defendants analysis of the public and private factors
- 4:36under section fourteen oh four A, plaintiff merely stated she
- 4:40suffered severe physical and emotional trauma at the hands of
- 4:44defendants in San Juan, Puerto Rico, and so should not
- 4:47be forced to litigate in Puerto Rico. The district Court
- 4:50concluded that in short, plaintiff fell to aid the court
- 4:54in any other respect in explaining why a transfer of
- 4:57venue should not be granted. Similarly, in Montante versus La Hood,
- 5:01the district court granted the defendant's motion to transfer venue
- 5:05pursuing the US Code twenty eight Section fourteen oh four A.
- 5:09The plaintiff opposed, stating that she feared emotional and physical
- 5:13harm from an unknown public that may disagree with her.
- 5:16Case twenty thirteen w. L. One two one eight four
- 5:19to one four nine at four and two, Southern District
- 5:23of California, twenty thirteen. However, because plaintiff did not explain
- 5:27why she feared such harm in the transferree diistrict, the
- 5:31court did not afford strong weight to plaintiff's contention. Mister
- 5:35Merson's lead argument against transfer is his conclusiony assertion in
- 5:39open Court that the plaintiff's all fear of returning to
- 5:42the USVII, this statement is not evidence and not a
- 5:46sufficient ground for opposing a venue transfer. B Everything did
- 5:50not happen in New York. Mister Myerson stated that the
- 5:54second reason plaintiffs chose not the file in the SDNY
- 5:58was that with respect to Epstein, everything has happened to
- 6:01New York. Where was Epstein? Where did Epstein live? Where
- 6:04was he supposed to stand trial? Later, mister Meerson repeated,
- 6:08everything has happened to New York. At another point, mister
- 6:11Merson qualified his position somewhat, asserting everything occurred in New
- 6:15York except the actual sexual abuse tr At fifty one,
- 6:20apparently admitting no alleged sexual abuse occurred in New York.
- 6:24Plaintiff's position at oral argument is directly refuted by plaintiff's
- 6:28own opposition and the sac itself. In the opposition, the
- 6:32plaintiff concedes that the immunity afforded to Epstein also occurred
- 6:36in the USVII ecf at one forty eight through and
- 6:41one at ten emphasis added. Taken together, the plaintiff concedes
- 6:45that the abuse and the acts of many, mostly John
- 6:48Doe defendants conferred immunity on Epstein all in the USVII,
- 6:53but the SAC itself ultimately conflicts with councils in court
- 6:57statements and their own opposition. The SAC alleges substantial conduct
- 7:02exclusively in the USVII. For example, the defendants John Doe's
- 7:07one through one hundred constitute ninety two percent of the
- 7:10one hundred and eight defendants. Everything the SAC alleges the
- 7:14John Doe defendants did necessarily occurred only in the USVII.
- 7:19This is because the SAC alleges their conduct as USVII
- 7:23customs agents and or officers at fifty one USVII air
- 7:28traffic controllers and employees of the USVII Airport baggage check agent,
- 7:33employees of the USVII, employees of the USVII and USVII
- 7:37Coast Guard Agents. There are many other examples of substantial
- 7:41conduct in addition to the sex abuse alleged to have
- 7:43occurred exclusively in the USVII. For example, SAC one twenty
- 7:48six alleges no sexual assault, but instead alleges Jane Doe
- 7:52three and Epstein's substantial interactions with unidentified USVI officials in
- 7:58the USVII to procure travel documents in the USVII. The
- 8:02SAC alleges that US Customs officials on the USVII never
- 8:07examined either the passport or luggage of anyone arriving on
- 8:10Epstein's private jet. USVI officials directed law enforcement officers, airport personnel,
- 8:17customs officials, and any other government employees to extend any
- 8:21courtesy or assistance to Abstein and as affluent customers and
- 8:25guests as part of their official duties. Sac At one
- 8:28seventy three. All of these things happened only in the USVII.
- 8:33The alleged efforts to protect Ebstein procure as travel documents,
- 8:37communications with non party customs, airport and other officials occurred
- 8:41nearly entirely in the USVII, according to the SAC. The
- 8:46SAC itself negates mister Mersan's assertion that everything has happened
- 8:50in New York. Nearly everything occurred in the USVII. According
- 8:54to the SAC, CEG Crinberg First Dow Chemical Company nine
- 9:00forty six f DOT supp two D three twenty nine
- 9:03three thirty one SDNY two thousand and seven transferring Venue,
- 9:07after finding that most of the operative events at issue
- 9:10took place in the transferree venue and concluding that it's
- 9:13likely that most of the witnesses and documents are located there.
- 9:18Collins Verus Aikman Corporation Secretary Litt. Four thirty eight Ft supp.
- 9:24Two d three ninety two, three ninety five, three ninety seven,
- 9:28SDNY two thousand and six. Transfer motion granted where numerous
- 9:32party and non party witnesses resided in the transferree forum,
- 9:36most relevant documents were located in the transferree forum, and
- 9:40the transferre reforum is where the subject conduct alleged happened.
- 9:45In this case, the ties to the USVII outweigh any
- 9:48connection this litigation may have to New York see. Plaintiff's
- 9:53council admits to forum shopping. The third reason mister Mrson
- 9:57offered for why the plaintiffs filed in the SDNY and
- 10:00instead of the DVII was that if the case is
- 10:02bumped to the US Virgin Islands, the next thing you
- 10:05are going to hear is that the cases should have
- 10:07a twenty five thousand dollars limit under the Virgin Islands
- 10:10Toward Act. So that is clearly inadequate compensation for my clients.
- 10:15Mister Myersan admits to form shopping in the SDNY for
- 10:19advantageous state law. However, mister Myerson is wrong on the
- 10:23law that will apply. It's true that after a transfer
- 10:27from an improper venue to a proper venue under section
- 10:30fourteen oh six A, the transferre court applies its own
- 10:34law as if the case had been originally filed there Ie,
- 10:38the plaintiff does not get the benefit of form shopping
- 10:41Grant vers Kia Motors twenty fourteen, WL six sixty eight
- 10:46zero six eighty six, at two, citing GBJ versus East
- 10:52Ohio Paving one thirty nine ft three d ten eighty
- 10:55ten eighty five six Circuit nineteen ninety eight. If the
- 10:59state law in them in which the action was originally
- 11:01commenced is applied following a Section sixteen thirty one or
- 11:06fourteen oh six transfer, the plaintiff would benefit from having
- 11:10brought the action in an impermissible forum. Choquette vers San Felipo,
- 11:15two thousand and one w. L one two six six
- 11:17three zero five, at four. As the Sixth Circuit and
- 11:21Martin Verse Stokes recognized, plaintiffs would thereby be encouraged to
- 11:26file their actions in federal district court, where the state
- 11:29law was most advantageous, regardless of whether that district court
- 11:33was the proper forum. If venue is improper in the SDNY,
- 11:37plaintiffs were never entitled to New York law to begin with,
- 11:41they have lost nothing. In that event, plaintiffs would not
- 11:44be harmed by the DVII applying USVII law. However, if
- 11:48the court determines venue was proper in the SDNY but
- 11:52transfers for convenience, a court receiving a matter from a
- 11:55transfer of court under section fourteen oh four A applies
- 11:59to the law of the transferer court. Kelly Brown versus
- 12:02Winfrey twenty thirteen w L six five seven four nine
- 12:06one eight at one, SDNY twenty fourteen. The plaintiff gets
- 12:12the benefit of forum shopping Grant twenty fourteen six sixty
- 12:15eight zero six eighty six at two. So if the
- 12:19case is transferred, mister Merson's clients may still seek the
- 12:22benefit of the New York law they perceive as more advantageous.
- 12:27D Epstein and Wealthy Abuser Friends are not parties. While
- 12:32the SAC alleges substantial conduct by Epstein and as wealthy
- 12:35abuser friends, none of them are named as defendants. The
- 12:40SAC fails to allege a sufficient nexus conspiracy or otherwise
- 12:44between the name defendants in Epstein and his abuser friends.
- 12:48Without this nexus, the plaintiffs cannot use non party conduct
- 12:52as a jurisdictional hook upon JDJ and other named USVII
- 12:56defendants if the sac does not allege a conspiracy. At best,
- 13:01it alleges a conspiracy by non parties and not JDJ
- 13:05or the name defendants. In the case e sexual abuse
- 13:09is the most substantial part of the case. Mister Merson's
- 13:12argument that everything occurred in New York except the actual
- 13:16sexual abuse minimizes the fact that the alleged sexual abuse
- 13:20is the most substantial part of the case. Gray versus
- 13:23Acadia Healthcare four oh eight f DOT supp three D
- 13:27twelve fifty twelve fifty five DNM twenty nineteen venue proper
- 13:32in district where rape occurred. Gold Schmeade versus Brifel, twenty
- 13:36eighteen w L six four three zero five four five
- 13:40at four c D, California, twenty eighteen VENU proper where
- 13:45sex harassment and assault occurred. Gerson versus Logan River Academy
- 13:49twenty twenty WL four seven three one three four at
- 13:53three Central District California, twenty twenty. Although plaintiff was kidnapped
- 13:59from California and transported to Utah, each of her claims
- 14:02stem from the alleged sexual child abuse that took place
- 14:05at Logan's academy. Accordingly, the operative facts did not substantially
- 14:10occur in the forum selected by plaintiff. Moreover, because plaintiff
- 14:14was sexually abused in Utah, the subject matter of the
- 14:17litigation is not substantially connected to California. Therefore, the Core
- 14:22finds that plaintiff's choice of forum is diminished and is
- 14:25entitled to only minimal consideration. Chesapeake Climate Action Network versus
- 14:31Imperial Bank, twenty thirteen WL six zero five seven eight
- 14:35two four AT two Northern District, California, twenty thirteen, noting
- 14:39that deference to plaintiff's choice of forum is substantially reduced
- 14:43where the forum lacks a significant connection to the activity
- 14:46is alleged in the complaint, even if the plaintiff is
- 14:49a resident of that forum. FSAC one hundred and seven Defendants,
- 14:56Evidence and Incident Sights in the USVII. Each of the
- 15:01one hundred and eight defendants, including John Doe's one through
- 15:04one hundred, are potential witnesses, they are all located in
- 15:07the USVII, save plasket. All their evidence and documents are
- 15:11located in the USVII. Furthermore, the SAC identifies critical locations
- 15:16in the USVII which may be the location of documents,
- 15:20the subjects of inspection during discovery, or even a site
- 15:23visit at trial. These include Cyril King Airport, Epstein's private Island,
- 15:30Epstein's RedHook office. And Although it's likely that all relevant
- 15:35documents can be transported from the state to state, at
- 15:37least in some fashion for purposes of deciding transfer, the
- 15:41fact that the documents are all currently located in Ohio
- 15:44favors transfer to Ohio Royal Insurance versus US nine ninety
- 15:48eight ft. Supp. Three fifty one, three fifty three and
- 15:52fifty four SDNY nineteen ninety eight. While photos or videotapes
- 15:57of the scene could be introduced at trial in any forum,
- 16:00inspection of the site by the trier of fact could
- 16:02only be accomplished if the case were tried in California
- 16:06g Court in power to transfer even if no personal jurisdiction.
- 16:11Even if this court determines it does not have personal
- 16:13jurisdiction over the defendants, it may still transfer this case
- 16:17to the DVII. This court has the power to transfer
- 16:20this suit to a district where it might have been brought,
- 16:23even though the court does not have personal jurisdiction over
- 16:26the defendants. Two Sovereign immunity applies to Governor JDJ. JDJ
- 16:34joins the GVII and other defendants sovereign immunity agreements. Territorial
- 16:39sovereign immunity applies not only to the GVII, but also
- 16:42to the individuals sued in their official capacities as territorial officials.
- 16:48Three response to plaintiffs CPLR three zero two A one
- 16:51personal jurisdiction argument. In their ten to four to twenty
- 16:55four letter, plaintiffs continue to argue that receiving a single
- 16:59payment in another state without maintaining a New York account
- 17:03gives rise to jurisdiction. Again, this is not always true.
- 17:07It can be true based on the nature of the
- 17:09financial relationship. Plaintiff's site to the first Manhattan Energy one
- 17:13Meyer one fifty A D three five twenty one. But
- 17:17Meyer was designated in the escro agreement as the assigned
- 17:21escrow agent, and he accepted the funds pursuant to the agreement.
- 17:25This is very different from a defendant receiving payment from
- 17:28Epstein that happens to come from a New York bank,
- 17:31especially when it's simply not plausible that any defendant requested
- 17:34money from a New York account. Four not plausible that
- 17:39defendants requested money specifically from New York accounts. Plaintiffs argue
- 17:44in their letter brief that requesting money from New York
- 17:46accounts in exchange for unrestricted trafficking of New York women
- 17:51with New York customers via a New York plane is
- 17:54sufficient for personal jurisdiction. It is not plausible that defendants
- 17:58requested money specifically from New York bank accounts, are knew
- 18:02or cared from what state the money came. It's also
- 18:05not plausible that defendants specifically knew that the customers were
- 18:08New York customers or that the plane was a New
- 18:11York plane. Indeed, the SAC itself alleges that conduct happened
- 18:16in New York, Florida, USVII, and around the world SAC
- 18:20three oh one through three five. The SAC also alleges
- 18:24that the defendants sought access to money and influential people
- 18:27from around the world and not just n Y. Plaintiff's
- 18:30argument of targeted and y conduct in their letter brief
- 18:33is directly contradicted by the allegations in the SAC. The
- 18:38alleged payments and conclusiony statements are insufficient to show that
- 18:42the defendants elicited money specifically from NY Bank accounts. Rosner
- 18:47Versus Boc. Three forty nine Federal Appendix six thirty seven,
- 18:51six thirty nine, Second Circuit, two thousand and nine, finding
- 18:55a lack of factual allegations that point to actual knowledge
- 18:58of the fraudulent source of the deposited money. Since the
- 19:02bank's relationship with the perpetrators of the underlying fraud did
- 19:06not extend beyond the banking relationship in Agapi of Litigation
- 19:10seven seventy three Ft. Supp. Two d. Two ninety eight,
- 19:13three seventeen Eastern District, twenty eleven, a banking relationship alone
- 19:18is insufficient to show that the funds held that the
- 19:20bank were obtained through fraudulent means. Defendant JDJ respectfully requests
- 19:25that the SAC be dismissed or, in the alternative, transferred
- 19:29to the District Court of the Virgin Island Saint Thomas Vicinity.
