The Long-Delayed Federal Investigation Into Darren Indyke and Richard Kahn (Part 2) (9/24/26) · The Epstein Chronicles

• 0:00
Speaker 1: What's up everyone and welcome to another episode of the
• 0:03
Speaker 1: Epstein Chronicles. In this episode we're going to pick up
• 0:06
Speaker 1: where we left off, talking about Darren Indyke, Richard Kahn,
• 0:10
Speaker 1: and the investigation. The government of the Virgin Islands certainly
• 0:14
Speaker 1: did not behave as though there was nothing worth investigating.
• 0:18
Speaker 1: Its civil litigation described what it called the Epstein Enterprise
• 0:21
Speaker 1: and attacked the web of corporations and other entities surrounding Epstein.
• 0:26
Speaker 1: Indyke and Kahn were pulled directly into that litigation. The
• 0:29
Speaker 1: Virgin Islands alleged that Epstein had constructed a complex network
• 0:33
Speaker 1: through which his activities and finances operated, and had sought
• 0:37
Speaker 1: to hold his estate and associated entities accountable. Indyk and
• 0:42
Speaker 1: Kahn denied the accusations against them, and the litigation ultimately
• 0:46
Speaker 1: ended without admissions of liability. But the importance of that
• 0:50
Speaker 1: litigation extends beyond whether any specific civil allegation was ultimately
• 0:55
Speaker 1: proven at trial. Territorial investigators were demonstrating that there was
• 1:00
Speaker 1: an entire financial universe available for examination. They were following entities, money, trusts,
• 1:06
Speaker 1: estate assets, and institutional relationships. They were doing precisely what
• 1:11
Speaker 1: any serious investigator confronted with Epstein's fortune should have understood
• 1:15
Speaker 1: was necessary. Every filing made the original federal failure more conspicuous.
• 1:21
Speaker 1: Then came the banking litigation, and the picture became even
• 1:24
Speaker 1: more embarrassing. The Virgin Islands lawsuit against JP Morgan exposed
• 1:29
Speaker 1: extraordinary details about Epstein's relationship with one of the largest
• 1:33
Speaker 1: banks in the world. Separate litigation involving Deutsche Bank revealed
• 1:38
Speaker 1: another chapter of the same financial story. Internal communication, compliance concerns, transactions,
• 1:45
Speaker 1: and institutional decisions became public because civil lawyers forced them
• 1:49
Speaker 1: into daylight. The settlements reached by the banks ran into
• 1:53
Speaker 1: hundreds of millions of dollars collectively without admissions, establishing every
• 1:58
Speaker 1: allegation made against them. I think the important point is
• 2:01
Speaker 1: that the cases demonstrated just how much evidence existed outside
• 2:05
Speaker 1: the traditional sex trafficking files. Epstein's financial relationships were not
• 2:10
Speaker 1: incidental details attached to the criminal story. They were the
• 2:14
Speaker 1: circulatory system that allowed his extraordinary lifestyle and sprawling operation
• 2:19
Speaker 1: to exist. anyone trying to understand the full scope of
• 2:23
Speaker 1: Epstein without aggressively investigating his finances was deliberately looking at
• 2:27
Speaker 1: only half of the body, and for years, that's exactly
• 2:31
Speaker 1: how the federal response appeared. Now, the same problem followed
• 2:34
Speaker 1: Indyke and Kahn into the Epstein estate. When Epstein died,
• 2:38
Speaker 1: these two men did not disappear into retirement and sever
• 2:42
Speaker 1: any connection with his affairs. They became the men in
• 2:45
Speaker 1: charge with administering what remained. Indyke and Kahn were named
• 2:49
Speaker 1: as executors in Epstein's will and trustees of the 1953
• 2:53
Speaker 1: trust that received his property. Think about how extraordinary that
• 2:57
Speaker 1: position was. Two longtime professional advisors to one of the
• 3:01
Speaker 1: most notorious sex offenders in America suddenly possessed enormous responsibility
• 3:06
Speaker 1: over his remaining financial world. They were sitting atop records, assets, entities,
• 3:11
Speaker 1: and institutional relationships accumulated over years. Victims were filing claims
• 3:17
Speaker 1: and Governments were litigating, and lawyers were trying to understand
• 3:20
Speaker 1: where the money had gone. If there were unanswered questions
• 3:24
Speaker 1: about Epstein's finances, these were the two people investigators had
• 3:28
Speaker 1: every reason to examine carefully. Yet it took years before
• 3:32
Speaker 1: the possibility of a federal investigation into them became public.
• 3:37
Speaker 1: And throughout those years, allegations continued accumulating around the structure
• 3:41
Speaker 1: they helped administer. Survivors sued. The Virgin Islands sued. Banks
• 3:46
Speaker 1: were sued. Records surfaced through discovery. Emails emerged. Corporate entities
• 3:51
Speaker 1: were identified. Transfers were scrutinized. Epstein's relationship with financial institutions
• 3:57
Speaker 1: were reconstructed in painstaking detail. Indyk and Kahn repeatedly denied
• 4:02
Speaker 1: knowingly facilitating Epstein's abuse. And those denials must be acknowledged
• 4:07
Speaker 1: because we have to remember that accusations are not convictions.
• 4:11
Speaker 1: But their denials never eliminated the need for investigation. A
• 4:15
Speaker 1: denial is the beginning of testing a proposition, not the
• 4:18
Speaker 1: end of the inquiry. Investigators compare the denial to documents, communications, transactions, timelines,
• 4:25
Speaker 1: and witness testimony. That process should have been undertaken with
• 4:29
Speaker 1: ruthless thoroughness the moment Epstein was arrested. Waiting years while
• 4:34
Speaker 1: other litigants assemble the evidence was an abdication of investigative initiative.
• 4:39
Speaker 1: And I think that one of the most infuriating aspects
• 4:42
Speaker 1: is that none of this required some mystical secret file
• 4:45
Speaker 1: hidden beneath Little St. James. You didn't need a mythical
• 4:48
Speaker 1: client list or an anonymous intelligence officer whispering from a
• 4:52
Speaker 1: parking garage. You needed subpoenas. You needed forensic accountants. You
• 4:57
Speaker 1: needed grand jury testimony. You needed search warrants where probable
• 5:01
Speaker 1: cause supported them. You needed prosecutors willing to follow financial
• 5:05
Speaker 1: records wherever they led without worrying whose name appeared on
• 5:09
Speaker 1: the next page. The Epstein case has been buried beneath
• 5:12
Speaker 1: so much mythology that people sometimes overlook the brutally ordinary
• 5:17
Speaker 1: investigative work that was never publicly demonstrated on the scale
• 5:21
Speaker 1: the case demanded. Follow the money has become a cliche
• 5:25
Speaker 1: because it works. With Epstein, the government had an ocean
• 5:29
Speaker 1: of money to follow and somehow spent years dicking around
• 5:32
Speaker 1: on the shoreline. And this is where the question of
• 5:35
Speaker 1: blast radius becomes impossible for me to ignore. I've argued
• 5:40
Speaker 1: for years that the government's approach to Epstein makes far
• 5:43
Speaker 1: more sense if you view it as an effort to
• 5:45
Speaker 1: contain the investigation rather than expand it. And look, that
• 5:49
Speaker 1: doesn't require believing that every famous person who encountered Epstein
• 5:54
Speaker 1: committed a crime, because that proposition is obviously unsupported. It
• 6:00
Speaker 1: requires recognizing that a sprawling enterprise investigation would inevitably have
• 6:04
Speaker 1: dragged powerful institutions and powerful people into subpoenas, depositions, interviews,
• 6:10
Speaker 1: and documentary scrutiny. Banks would have been embarrassed. wealthy associates
• 6:15
Speaker 1: would have been questioned. Lawyers and accountants would have faced
• 6:18
Speaker 1: uncomfortable demands for records. Government agencies might have been forced
• 6:22
Speaker 1: to explain earlier decisions. The 2007-2008 non-prosecution agreement would have
• 6:29
Speaker 1: received even greater scrutiny because investigators would have been examining
• 6:33
Speaker 1: what survived after that extraordinary deal. A narrow case controlled
• 6:37
Speaker 1: the blast radius, while a genuine enterprise case risked detonating it.
• 6:42
Speaker 1: And look, I think that theory becomes more compelling, not less,
• 6:45
Speaker 1: when we compare what federal authorities could have investigated in
• 6:49
Speaker 1: 2019 with what the public learned later. Civil litigation uncovered
• 6:53
Speaker 1: banking communications that federal prosecutors could have subpoenaed themselves. Survivors
• 6:59
Speaker 1: described organizational conduct that investigators could have tested against financial records.
• 7:04
Speaker 1: The Virgin Islands mapped companies and assets that federal forensic
• 7:08
Speaker 1: accountants could have mapped years earlier. Congressional investigations eventually hauled
• 7:13
Speaker 1: Epstein's former advisors into questioning that federal authorities had every
• 7:18
Speaker 1: opportunity to pursue through criminal investigative tools. Document releases have
• 7:23
Speaker 1: continued filling in pieces of the financial picture long after
• 7:27
Speaker 1: Epstein was buried. None of those developments require technology invented
• 7:31
Speaker 1: after 2019. None depended upon evidence that could only exist
• 7:35
Speaker 1: seven years later. Much of the underlying material already existed
• 7:40
Speaker 1: in files, servers, bank accounts, and business records when Epstein
• 7:43
Speaker 1: was arrested. The failure was never a lack of places
• 7:46
Speaker 1: to look. Now, consider what Indyk himself represented to an
• 7:52
Speaker 1: investigator in 2019. Here was a lawyer whose professional relationship
• 7:56
Speaker 1: with Epstein stretched for roughly two decades. A lawyer in
• 8:00
Speaker 1: that position potentially sits at the intersection of corporate organization
• 8:04
Speaker 1: and estate planning, contractual arrangements, litigation, property matters, and communications
• 8:10
Speaker 1: with other professionals. Attorney-client privilege can protect legitimate, confidential communications,
• 8:17
Speaker 1: but it does not magically erase every underlying business record
• 8:20
Speaker 1: or fact connected to a client, nor does privilege transform
• 8:24
Speaker 1: a long-time professional advisor into somebody investigators should simply ignore.
• 8:29
Speaker 1: Federal prosecutors routinely navigate privilege issues in complex, white-collar investigations,
• 8:35
Speaker 1: They employ filter teams, litigate privileged disputes, and obtain non-privileged
• 8:39
Speaker 1: corporate and financial records from independent sources. The idea that
• 8:44
Speaker 1: Epstein's legal world was somehow too complicated to investigate is ridiculous.
• 8:49
Speaker 1: Complexity is the reason the Justice Department has entire units
• 8:53
Speaker 1: filled with experienced prosecutors and forensic specialists. Now, Kahn's role
• 8:59
Speaker 1: raises equally obvious questions because accountants live where narratives collide
• 9:04
Speaker 1: with numbers. Epstein could tell people whatever story he wanted
• 9:07
Speaker 1: about his fortune, his investments, or his relationships, but financial
• 9:12
Speaker 1: records impose their own reality. An accountant responsible for managing
• 9:16
Speaker 1: portions of that universe would interact with banks, entities, payments,
• 9:20
Speaker 1: and tax-related information that investigators would naturally want to understand.
• 9:25
Speaker 1: Records released in 2026 have already shown Kahn communicating with
• 9:29
Speaker 1: Morgan Stanley concerning Epstein-related trusts and accounts. Those records... do
• 9:35
Speaker 1: not by themselves establish criminal wrongdoing by Kahn, but they
• 9:39
Speaker 1: do demonstrate exactly why his financial role mattered. Someone was
• 9:44
Speaker 1: communicating with the banks, was managing the entities, understood how
• 9:47
Speaker 1: the pieces fit together sufficiently to keep the machinery functioning.
• 9:52
Speaker 1: That's why forensic investigators start with the books and work outward.
• 9:56
Speaker 1: It should never have taken seven years for that principle
• 9:59
Speaker 1: to become relevant to the federal epstein investigation and look
• 10:03
Speaker 1: there's another element that should make people angry epstein was
• 10:06
Speaker 1: not an unknown quantity in 2019 this was not a
• 10:10
Speaker 1: case where professionals could plausibly say their client suddenly revealed
• 10:14
Speaker 1: a completely hidden public identity overnight Epstein had pleaded guilty
• 10:18
Speaker 1: to offenses involving a minor in 2008 and registered as
• 10:23
Speaker 1: a sex offender. His Florida investigation had been covered extensively.
• 10:28
Speaker 1: Civil lawsuits had been filed. Survivors had spoken publicly. Journalists
• 10:32
Speaker 1: had documented the scandal. By the time federal agents arrested
• 10:36
Speaker 1: Epstein in New York, his history was not buried inside
• 10:39
Speaker 1: a sealed intelligence vault that was only accessible only to
• 10:43
Speaker 1: a handful of government officials. That shit was searchable on
• 10:46
Speaker 1: the internet. That reality doesn't prove that every professional working
• 10:52
Speaker 1: for him understood the full scope of his conduct. It
• 10:55
Speaker 1: does make the question of what they knew, when they
• 10:57
Speaker 1: knew it, and why they continued working with him absolutely unavoidable.
• 11:02
Speaker 1: And that's the question investigators should have put under a
• 11:04
Speaker 1: microscope immediately after the 2019 arrest. What did Indyk know
• 11:09
Speaker 1: about the 2005 Palm Beach investigation while continuing to work
• 11:13
Speaker 1: with Epstein afterward? What did Kahn know about Epstein's conviction
• 11:17
Speaker 1: while continuing to handle financial matters for him? What information
• 11:21
Speaker 1: did either man receive through lawsuits, settlements, banking inquiries, or
• 11:25
Speaker 1: interactions with employees? What questions did financial institutions ask them
• 11:29
Speaker 1: about Epstein? What documents were provided in response? What payments
• 11:34
Speaker 1: connected to women in Epstein's orbit crossed their desks or
• 11:37
Speaker 1: accounts they administered? What corporate entities existed primarily to hold
• 11:42
Speaker 1: assets and what entities conducted actual business, who authorized payments,
• 11:47
Speaker 1: and who reviewed them. Those aren't accusations disguised as questions.
• 11:52
Speaker 1: Those are basic questions that should have anchored a legitimate investigation. Instead,
• 11:57
Speaker 1: the country received years of institutional shoulder shrugs while survivors
• 12:01
Speaker 1: and civil lawyers continued pulling threads. That's backwards. Victims should
• 12:06
Speaker 1: not have been responsible for reverse engineering Jeffrey Epstein's financial
• 12:10
Speaker 1: empire through private litigation. Reporters should not have been responsible
• 12:15
Speaker 1: for discovering banking relationships that law enforcement possessed the power
• 12:19
Speaker 1: to subpoena. Territorial prosecutors should not have been the ones
• 12:22
Speaker 1: demonstrating what an enterprise-focused theory of a case looked like.
• 12:27
Speaker 1: Congress should not have needed to drag longtime Epstein advisors
• 12:30
Speaker 1: into hearings years after his death because basic questions still
• 12:34
Speaker 1: had no satisfactory public answers. The FBI and SDNY possessed
• 12:40
Speaker 1: weapons unavailable to almost everyone else. They had subpoena power,
• 12:44
Speaker 1: grand juries, forensic accountants, and the ability to coordinate with
• 12:48
Speaker 1: federal agencies around the world. If the current investigation uncovers
• 12:52
Speaker 1: meaningful evidence, it will make the original failure to deploy
• 12:55
Speaker 1: those weapons even harder to explain. And now, suddenly, here
• 12:59
Speaker 1: we are. According to the new reporting, federal prosecutors in
• 13:02
Speaker 1: Manhattan have begun investigating Indycan Khan and questioning potential witnesses.
• 13:08
Speaker 1: Both men deny wrongdoing, and neither has been charged with
• 13:10
Speaker 1: the crime. The scope of the inquiry has not yet
• 13:14
Speaker 1: been publicly defined, which means nobody should pretend to know
• 13:17
Speaker 1: where it'll end. But the existence of the investigation itself
• 13:21
Speaker 1: is enormously important because it represents movement into territory that
• 13:25
Speaker 1: should have been central from the beginning. Prosecutors are reportedly
• 13:29
Speaker 1: interested in financial records and communications. They're talking to people
• 13:34
Speaker 1: who may possess relevant information. They're finally examining the men
• 13:39
Speaker 1: who occupied critical professional positions inside Epstein's financial and legal world.
• 13:45
Speaker 1: Seven years after the obvious questions were available, somebody in
• 13:48
Speaker 1: federal law enforcement finally appears willing to ask them with
• 13:52
Speaker 1: criminal investigative authority behind their request. Now the timing can't
• 13:56
Speaker 1: be separated from the avalanche of material forced into public
• 13:59
Speaker 1: view in recent years. The Epstein File Transparency Act changed
• 14:03
Speaker 1: the information environment by making it vastly harder for federal
• 14:07
Speaker 1: agencies to keep treating Epstein records as something the public
• 14:11
Speaker 1: should simply trust them to summarize. Documents have supplied details
• 14:15
Speaker 1: that once existed only behind institutional walls. Relationships that were
• 14:20
Speaker 1: dismissed as speculation can now be evaluated against actual communication
• 14:26
Speaker 1: and financial records. Transactions can be placed beside timelines. Banking
• 14:31
Speaker 1: arrangements can be examined alongside public claims. The distance between
• 14:35
Speaker 1: what government officials said and what documents show can be
• 14:38
Speaker 1: measured rather than guessed at. Now, that doesn't mean that
• 14:43
Speaker 1: every suspicion about Epstein has been validated, because plenty of
• 14:46
Speaker 1: nonsense still circulates around the case. It means the government
• 14:50
Speaker 1: no longer enjoys the same monopoly over the underlying evidence,
• 14:54
Speaker 1: and that fundamentally changes the pressure on prosecutors. And look,
• 14:58
Speaker 1: that pressure matters, because transparency destroys one of the bureaucracy's
• 15:02
Speaker 1: favorite defenses, obscurity. It's easy to tell the public there's
• 15:06
Speaker 1: nothing to investigate when the public cannot inspect the evidence.
• 15:10
Speaker 1: It becomes considerably harder when people can read emails, financial correspondence,
• 15:15
Speaker 1: litigation exhibits, and government records for themselves. Indyk and Khan
• 15:19
Speaker 1: have existed inside that documentary universe for years. Their names
• 15:24
Speaker 1: appear because their roles required them to conduct business inside
• 15:27
Speaker 1: Epstein's world. And the more the architecture becomes visible, the
• 15:31
Speaker 1: more absurd it becomes to treat the architecture as irrelevant
• 15:34
Speaker 1: to the criminal history. People can now see the trust.
• 15:37
Speaker 1: They can see the corporations. They can see the banking relationships.
• 15:41
Speaker 1: And once you can see the machine, you naturally begin
• 15:44
Speaker 1: asking why nobody dismantled it when they had the chance.
• 15:48
Speaker 1: And that's why this investigation must be more than another
• 15:51
Speaker 1: performative gesture designed to quiet public anger. Prosecutors should not
• 15:56
Speaker 1: approach Indycon Con merely looking for an easily prosecutable technical
• 16:00
Speaker 1: violation that allows the government to announce that it did something.
• 16:04
Speaker 1: they should reconstruct the Epstein financial apparatus from the ground up.
• 16:08
Speaker 1: Every company should be mapped against every other company. Every
• 16:12
Speaker 1: trust should be examined alongside its administrators, beneficiaries, and transactions.
• 16:18
Speaker 1: Every banking relationship should be reconstructed from opening documents through closure.
• 16:23
Speaker 1: Every substantial payment to people in Epstein's orbit should be
• 16:26
Speaker 1: categorized and explained. Every communication concerning reputational concern, sex offender status,
• 16:33
Speaker 1: legal exposure, or suspicious transactions should be compared with what
• 16:37
Speaker 1: the participants later claim to know. If the government's finally
• 16:40
Speaker 1: going to investigate the infrastructure, then investigate the damn infrastructure.
• 16:45
Speaker 1: And that investigation cannot stop within Dyke and Kahn, simply
• 16:49
Speaker 1: because their names currently occupy the headline. There are potential
• 16:53
Speaker 1: doorways into the system, not the entire building. If financial
• 16:58
Speaker 1: records identify other professionals who administered Epstein's entities, those people
• 17:02
Speaker 1: should be questioned. If communications reveal bankers raising concerns, investigators
• 17:08
Speaker 1: should determine what happened to those concerns. If payments identify
• 17:11
Speaker 1: recruiters or employees with unexplained roles, prosecutors should follow those payments.
• 17:17
Speaker 1: If corporate records point toward additional advisors, subpoena them. If
• 17:21
Speaker 1: records contradict testimony previously given to Congress or investigators, examine
• 17:26
Speaker 1: the contradiction. If evidence establishes no criminal conduct by a
• 17:30
Speaker 1: particular person, say so and move on. But nobody should
• 17:33
Speaker 1: receive immunity from scrutiny merely because the investigation reaches into
• 17:37
Speaker 1: a boardroom instead of an alleyway. And there's no denying
• 17:41
Speaker 1: that the larger institutional lesson is ugly because Epstein repeatedly
• 17:45
Speaker 1: benefited from fragmentation. Palm Beach police investigated one piece. Federal
• 17:50
Speaker 1: prosecutors in Florida handled another. Victims pursued civil claims. New
• 17:55
Speaker 1: York prosecutors eventually charged them again. The Virgin Islands attacked
• 17:59
Speaker 1: the estate and financial structure. Banks fought separate lawsuits. Congressional
• 18:04
Speaker 1: committees pursued their own inquiries years later. Each institution possessed
• 18:08
Speaker 1: a fragment of the picture, while Epstein's overall apparatus existed
• 18:13
Speaker 1: across all of them. A Rico-style federal investigation could have
• 18:17
Speaker 1: centralized that information and treated the fragments of components as
• 18:21
Speaker 1: one system. That is precisely why that framework exists. Instead,
• 18:26
Speaker 1: the Epstein story became a collection of boxes and powerful
• 18:29
Speaker 1: people survived, by remaining in the empty spaces between them.
• 18:34
Speaker 1: And those empty spaces are where accountability goes to die.
• 18:37
Speaker 1: One agency says the banking issue belongs to regulators. Another
• 18:41
Speaker 1: says the abuse happened in a different jurisdiction. Another says
• 18:44
Speaker 1: the estate matter belongs in civil court. Another says an
• 18:48
Speaker 1: associate has not been accused of sexual abuse, as though
• 18:51
Speaker 1: sexual abuse were the only crime investigators are permitted to examine.
• 18:56
Speaker 1: Another points to statutes of limitation. Another points to Epstein's death.
• 19:01
Speaker 1: And before long, everybody has a procedural explanation for why
• 19:06
Speaker 1: somebody else should investigate the thing nobody is investigating. Epstein's
• 19:11
Speaker 1: world benefited from exactly that bureaucratic atomization for decades. An
• 19:16
Speaker 1: enterprise investigation would have destroyed those artificial boundaries. It would
• 19:21
Speaker 1: have asked one overriding question. What was this machine, who
• 19:25
Speaker 1: operated its components, and did anyone commit crimes while keeping
• 19:29
Speaker 1: it running? and that is ultimately why Indyk and Khan
• 19:32
Speaker 1: and the investigation matters far beyond Darren Indyk and Richard Khan.
• 19:37
Speaker 1: It represents a chance, perhaps the last serious chance, to
• 19:41
Speaker 1: investigate Jeffrey Epstein as something larger than a dead predator
• 19:45
Speaker 1: with a collection of disgusting habits. Epstein built and maintained
• 19:49
Speaker 1: an ecosystem that survived scandal, criminal investigation, conviction, incarceration, and
• 19:54
Speaker 1: sex offender registration. Bro continued moving through elite financial circles
• 19:59
Speaker 1: after everyone supposedly had enough information to know better. He
• 20:03
Speaker 1: continued controlling enormous wealth. He continued maintaining properties, businesses, and trusts.
• 20:09
Speaker 1: He continued employing professionals capable of navigating sophisticated legal and
• 20:14
Speaker 1: financial systems. None of that happened automatically. Machines do not
• 20:20
Speaker 1: operate themselves. And the public deserves to know who kept
• 20:24
Speaker 1: this one operating and what those people knew while they
• 20:27
Speaker 1: were doing it. If Indyk and Khan committed no crimes,
• 20:30
Speaker 1: a serious investigation should establish that conclusion after every relevant
• 20:35
Speaker 1: record has been examined and every meaningful inconsistency tested. If
• 20:40
Speaker 1: the evidence demonstrates criminal conduct, prosecutors should charge whatever offenses
• 20:44
Speaker 1: the evidence supports without fear or favoritism. What is unacceptable
• 20:49
Speaker 1: is the seven-year vacuum that preceded this moment. Epstein was
• 20:53
Speaker 1: arrested in July of 2019, and the federal government had
