- 0:24Big big news out of the Supreme Court this week.
- 0:27We've been we've been watching this case out of Colorado, and the Supreme Court has come to a decision regarding conversion therapy.
- 0:38Colorado banned it, other states have banned it, and the Supreme Court this week said no, you cannot, you cannot ban this therapy because it is in violation, and any ban is in violation of the constitution of a therapist's right to free speech.
- 0:59The first amendment, my friends, was on display here.
- 1:03Really, what what's on display ultimately is the fight for the soul of the nation.
- 1:11Now I know it it feels melodramatic when I say it that way.
- 1:15It might even sound it, but it's not, it's not melodramatic.
- 1:21We are in the fight for our very souls here.
- 1:25And it's it's the quest for our souls that is that is the most important thing.
- 1:32It is the most important element of education, is soul formation.
- 1:38You know that we talk about it here all the time.
- 1:41It's why around here we engage in a classical education because it's soul formation.
- 1:47And the education has been under assault for decades, and therefore the soul of the nation has been under assault for decades.
- 1:56And this week, the Supreme Court stood up for America.
- 2:02This week the Supreme Court stood up for our very souls.
- 2:05Yes, yes, I know, I know.
- 2:07I just said it.
- 2:08Sounds melodramatic, but it's not.
- 2:11You know, a few years ago, somebody said to me, and I've talked about this here from time to time.
- 2:18Somebody somebody thanked me for defending Western civilization, and in regard to the classical education that we are providing at Waterbrook.
- 2:29And they just matter of fact, it was, you know, at the end of the conversation of thanks for defending Western civilization.
- 2:37And I thought, wow, that that's dramatic.
- 2:42But the more I contemplated, and the more I dwelt on it, and the more I thought about that statement, the more I thought about what we're doing here, not only at Waterbrook, but here in this program, the more I agreed with that sentiment that we are defending Western civilization.
- 3:04Western civilization is under assault, and American values are under assault.
- 3:13And the Supreme Court said, no, we're not doing this.
- 3:18We're not going down this road.
- 3:19You can't tell a therapist what they can and cannot say under the the guise of their own practice.
- 3:29That is paramount to destroying their First Amendment rights.
- 3:34And this is exactly what Colorado wanted to do.
- 3:38It's what they attempted to do.
- 3:40It's what other leftist states have joined in the Colorado fray here.
- 3:48But not only did the Supreme Court say no, but they said no in an eight to one decision.
- 3:54That is, I mean, we I think we all anticipated a six to three decision, but an eight to one decision.
- 4:00So who is the one?
- 4:02All right, let's uh let's I am open for uh I don't know, I don't want to call the Supreme Court roulette, but okay, let's play, let's play Supreme Court Roulette.
- 4:15Who is the one justice who said no?
- 4:18Okay, all right, we got your answer.
- 4:21Okay, you all right, yeah.
- 4:24And all right.
- 4:25Okay, all four of you are correct, all four of you, all four of you nailed it.
- 4:31Uh, it is uh Justice Brown Kintanji Jackson brought us.
- 4:36How do you say her name?
- 4:37I don't even know.
- 4:38Justice Kintanji.
- 4:40Oh no, I'm sorry, it's Brown Jackson.
- 4:43Kintanji Brown Jackson, my fault.
- 4:47But it's it's the you're right, it's the justice who doesn't know who she is because she doesn't know what a woman is.
- 4:53It's it's that lady.
- 4:54It's she said she said no.
- 4:58Yeah, I know it.
- 4:59I'm just I'm not surprised.
- 5:01And I know you're not surprised either.
- 5:02It's humorous.
- 5:04We're gonna we're gonna get into some of her statements too, equally equally humorous.
- 5:09So the decision was eight to one.
- 5:12The uh eight of the justices, eight of the nine said a lower court failed to properly analyze whether the Colorado law violated the First Amendment.
- 5:23They didn't analyze it properly, and this is from the court's majority opinion written by Gorsuch.
- 5:31Neil Gorsuch came through in the clutch here.
- 5:35Uh and I I think we're just we're shocked ultimately that um Sotomayor and uh Alana Kagan joined with the six conservatives here.
- 5:48Um I'm completely blown away by that.
- 5:51Didn't see it coming.
- 5:52I'm proud of these two ladies.
- 5:54I'm proud of them for standing up for the First Amendment.
- 5:58We are not shocked, however, by Justice Jackson and her decision to uh promote buffoonery and anti-American values.
- 6:09All right, so he here are some things that Gorsuch said in his opinion for the majority.
- 6:16The Colorado law censors speech based on viewpoint, and Colorado may regard its policy as essential to public health and safety.
- 6:27Certainly, censorous governments throughout history have believed the same.
- 6:33But the First Amendment stands as a shield against any effort to enforce orthodoxy and thought or speech in this country.
- 6:42So he's saying, look, you know, but Colorado may be acting in good faith here.
- 6:49They may be of the opinion that their policy is essential to public health and public safety, but it's not.
- 6:58It's a law censoring speech based upon one's viewpoint.
- 7:04And then he called out censorous governments throughout history who believed that they were doing the same, that they were they were acting uh on on behalf of public health and public safety.
- 7:17Um, but the first amendment shields against that.
- 7:20Now, I don't I think Gorsuch is is maybe taking the high road here.
- 7:25I personally can I just can I just give you my personal opinion.
- 7:29I mean, it's my show, right?
- 7:31I I'm allowed to give my opinion.
- 7:34Uh again, I don't I don't have anything to base this opinion on other than just my gut.
- 7:42I just want to put that out there.
- 7:43This is just a gut reaction opinion.
- 7:46I I don't believe that Colorado officials regard their policy as essential to public health and public state.
- 7:56I don't believe that.
- 7:57I believe they regard their policy to hammer a an anti-American ideology.
- 8:07That that's what I believe.
- 8:09And also, you know, Gorsuch taking the high ground talking about censorous governments throughout history that have probably believed the same, that they were acting uh essential to public health and public safety.
- 8:22I I don't believe that.
- 8:23I believe censorous governments are acting out of a preservation of their own power, a preservation of their own existence, and and I believe they're acting out of the the iron fist mentality to keep their populace down, to keep their citizens down, to maintain control, to maintain dominance.
- 8:46That that's it's my opinion here, so I'm going to part ways with with the justice.
- 8:52I'm gonna part ways with Gorsuch on his viewpoint of government leadership here.
- 9:01I I just I just don't think he's he's accurate in that.
- 9:06But that's that's just a sidebar.
- 9:08That's just me.
- 9:09That's just me being brilliant.
- 9:13I mean, you know, in my own humble opinion.
- 9:18Uh let's see, Gorsuch continues here.
- 9:21He says it reflects instead a judgment that every American possesses and analienable right to think and speak freely, and a faith in the free marketplace of ideas as the best means for discovering truth.
- 9:38So this is kind of in um, you know, because he's talking about the first amendment standing as a shield against any effort to enforce orthodoxy and thought or speech.
- 9:51And so he's referring to the first amendment here, where he says it reflects instead of judgment that every American possesses and an
- 10:00Alienable right to think and speak to speak freely, a God-given right to think freely and to speak freely, and a faith in the free marketplace of ideas as the best means for discovering truth.
- 10:18So Colorado came along and they said, you know, conversion therapy isn't a thing.
- 10:25Therapists can't try to talk gay people out of being gay in order to fix them.
- 10:31Can't do that.
- 10:32You got to let them be gay.
- 10:34But Gorsuch says that Americans have this inalienable right to think freely and speak freely.
- 10:43And to have faith in the free marketplace of ideas as the best means for discovering truth.
- 10:48So what are you so worried about, leftists in Colorado?
- 10:53Are you worried that young people will actually stop being gay?
- 10:59Is that what you're upset about?
- 11:00That because conversion therapy, you're afraid it's going to work.
- 11:13And to uh I don't know.
- 11:17Maybe step into the biological role that of creation that God intended for all of humanity.
- 11:27Uh the soul dissenter here, of course.
- 11:30You guessed it.
- 11:32Justice Kintanji Brown Jackson.
- 11:36The soul dissenter.
- 11:37Are you ready?
- 11:38Are you ready for some Jackson fun?
- 11:41Are you ready for some some some Jackson input?
- 11:44Oh man, here we go.
- 11:46Jackson said the fallout from the new ruling could be catastrophic.
- 11:52Hmm.
- 11:53Catastrophic to your leftist liberal anti-American ideas.
- 11:58Yes.
- 11:58Yes, it will be catastrophic to your anti-Americanism.
- 12:03Absolutely, 100%.
- 12:06She said her colleagues failed to consider the potential long-term and disastrous implications of this ruling.
- 12:14Long term.
- 12:16And disastrous implications.
- 12:20Well, yeah.
- 12:21The hatred for American values.
- 12:25This is going to be disastrous for them.
- 12:27Your hatred, your your uh antitheticalness, your uh disparity.
- 12:36I that's not a strong enough word.
- 12:38I mean, I mean, hatred is probably as strong as I can get.
- 12:41Your hatred for American values will there, this decision brings them long-term and disastrous implications.
- 12:51Jackson said Colorado's law was based on the oh boy, here we go.
- 12:59Are you ready?
- 13:00Okay.
- 13:01She said Colorado's law was based on the medical profession's broad consensus that this medical treatment, which seeks to change a gay or transgender person's sexual orientation or gender identity, is ineffective and harmful.
- 13:20Uh the medical profession's broad consensus.
- 13:24Harmful, uh, and effective.
- 13:29I guess what's your and effective for whom?
- 13:32Uh I guess we have to ask that question.
- 13:36It's not an effective for the person being who's receiving the the therapy.
- 13:44It's very effective for them to have their eyes opened up and to step into uh again biologically to step into the role that they were uh created to to step into, and that is to create.
- 14:03We, my friends, were created, created to create to create human life.
- 14:12I'm sorry, if you're gay, you you don't you don't have that opportunity.
- 14:18It's not presented to you.
- 14:20If you're just, I mean, two men they can't create, they can't create life.
- 14:25Two women, you just can't do it.
- 14:28It's impossible.
- 14:30I know, I know maybe you know what I'm saying is not politically correct, but it's it's biologically correct.
- 14:39We were designed to reproduce.
- 14:43We were designed to create what about the people that can't have babies.
- 14:47What about uh I get it, and I know there's there's people that can't.
- 14:51So are you saying you're not stepping into the no?
- 14:54I'm I'm not saying that at all.
- 14:55I'm I'm I'm saying that that they're attempting, they're trying, and and uh in a lot of instances, you know, they're unsuccessful.
- 15:04I know people, people that I'm close to that have been unsuccessful.
- 15:09I understand that.
- 15:12But but they're not choosing to abdicate that uh that desire to reproduce and and to multiply and to create.
- 15:24We were we were we were created to create.
- 15:29Uh and we have uh in this therapy, which allows people to step into that role.
- 15:37It's not ineffective, and it's not harmful.
- 15:40I mean, I guess it's ineffective to Justice Jackson's way of thinking, because her her anti-American hatred is being thwarted, and I guess it's harmful to her way of thinking, because her anti-American hatred's being being thwarted here and an eight-to-one decision.
- 16:02So, yeah, it's harmful to her, it's ineffective to her, but to the populace and to those people who uh are undergoing this treatment.
- 16:11No, it's it's it's not ineffective.
- 16:14I'm sorry, Justice Jackson.
- 16:15It's not harmful.
- 16:17Uh, but she didn't stop there.
- 16:20She said ultimately, because the majority plays with fire in this case, I fear that the people of this country will get burned.
- 16:30Oh, Justice Jackson.
- 16:33Oh, Justice Jackson who does not know what a woman is.
- 16:37Oh, Justice Jackson who uh who has no capability and and actually defining a woman who being a woman herself, ironically, doesn't know how to define a woman uh says that the majority plays with fire.
- 16:59And the people, I fear that the people of this country will get burnt.
- 17:04Well, okay, fear on Justice Jackson, fear on okay.
- 17:08I want to dive into the the uh the other details of this case because it's interesting, it's intriguing.
- 17:16And then we had to get to Justice Jackson first because of the comedy that she provides, the the uh, you know, a merry heart doeth good like a medicine, right?
- 17:28And there is definitely some uh some comedic relief here brought to us, brought to you by Justice Jackson.

- 22:44All right.
- 22:45So we're talking about this groundbreaking decision that the Supreme Court has brought us.
- 22:53We have said this court more times than not.
- 22:58They are delivering home runs for us.
- 23:00I mean, there are times that, you know, Coney Barrett and maybe Kavanaugh and sometimes Gorsuch, I mean, certainly regularly the chief, that, you know, they they leave us scratching our heads in bewilderment.
- 23:19Sometimes they do.
- 23:21But then there are other times that they just knock it out of the park.
- 23:24And this is one of those times.
- 23:27So this this case here that we're talking about, Chiles V Zalazar, Salazar, was brought by therapist Kaylee Chiles.
- 23:38Chiles said that Colorado's law, which again banned conversion therapy.
- 23:47Unconstitutionally infringed on her ability to help minors struggling with gender dysphoria and unwanted same-sex attraction.
- 23:57Now this has been our I mean, my me personally.
- 24:04This has been one of my what do I want to call it?
- 24:08Hanging point.
- 24:09I don't know.
- 24:10One of the things that's so frustrating is because young people are confused.
- 24:20Confusion is certainly a thing.
- 24:24I mean, they're their minds aren't developed.
- 24:27And they are inundated with so much stuff on social media.
- 24:32And they're inundated with so many falsehoods from people in positions of trust.
- 24:43People that are in positions that naturally others trust them because of their position.
- 24:52Kind of that there's this ethos, there's this natural credibility that is given to, for example, a doctor and a white coat.
- 25:02The white coat gives instant credibility.
- 25:05Now it shouldn't, but it does.
- 25:08It's the nature of it.
- 25:10A school teacher offers instant credibility to that individual.
- 25:16Again, it shouldn't, but it does.
- 25:18Young people trust these individuals.
- 25:20They trust doctors.
- 25:22They trust men and women in the white coats.
- 25:26They trust their school teachers.
- 25:29They they trust the men and women that are in educational leadership.
- 25:35These positions bring trust.
- 25:38And many individuals in these positions have been leading young people astray.
- 25:45They've been taking them further down this dark road of confusion.
- 25:53And you've got therapists out there like Kaylee Chiles who are really trying to bring the bring these young people out of the confusion.
- 26:04And offer them hope.
- 26:07Give them a shining light.
- 26:09And Colorado comes along and says, no, you you have to keep them in confusion.
- 26:14You can't.
- 26:15How dare you bring them out of confusion by by telling them the truth?
- 26:20Now that's not what Colorado's saying, but that's what they're saying.
- 26:25The can conversion therapy is helping these young people work through the confusion.
- 26:32They're confused.
- 26:34They're confused about who they are.
- 26:36They're confused about their gender, their gender identity.
- 26:40Now I'm not.
- 26:42Again, I'm I'm not belittling the young people that are going through this confusion.
- 26:49Far from it, not at all.
- 26:52I am I'm angry at the adults who are promulgating the confusion, especially the adults who are standing in the way of other adults who want to help them through their confusion.
- 27:11I mean, if someone's confused about where to go, and they don't know if they should you know, they're they're trying to get to the store, and they have to go to the up here to the light and make a right, and that'll get them to the store.
- 27:26And but they're confused, they don't know which way to go, right or left.
- 27:30Would you tell them to go to the light and go left and keep them lost?
- 27:36No, you wouldn't.
- 27:37You tell them you go to the light and you make a right, and you'll you'll you'll come to the store.
- 27:42Uh, uh, you know, but you got to make the right at the light.
- 27:46You make a left, you're gonna continue to be confused, wandering around lost, aimless.
- 27:54Well, we we have therapists for a reason because they're supposed to help people through their confusion.
- 28:01And and they're trying to help young people go to the light here.
- 28:05Okay, if you're a female, you you're created a female, all right.
- 28:10So make a right at the light and go to femininity.
- 28:13I mean, if you're a male, well, well, then you know, make a left at the light and go to masculinity.
- 28:20I mean, this is this is the point.
- 28:23The left calls it conversion therapy because you're trying to convert them from what they're naturally are.
- 28:30No, I'm I'm sorry.
- 28:32We're not trying to convert conversion therapy isn't even a good name for it.
- 28:36It's just therapy.
- 28:38You know, confusion therapy would be a better way to describe it.
- 28:42And those of us, again, those of us that are uh conservative in our way of thinking, conservative in our mentality, need to take the narrative back.
- 28:55It's not conversion therapy, it's confusion therapy.
- 28:59We're not converting them.
- 29:00We are helping them through their confusion.
- 29:05Uh I just, you know, but they they've got these names and these names stick because you know, they've got willing accomplices everywhere to help these names stick.
- 29:17So Kaylee Childs comes along and she says, Colorado is infringing upon my constitutional rights and ability to help minors who are struggling with gender dysphoria and unwanted same-sex attraction.
- 29:36Um of course, this therapy, you know, is deemed any emotional or physical therapy used to cure, quote unquote, or repair, quote unquote, a person's attraction to the same sex or their gender identity or or their expression.
- 29:54When actuality, the definition is we're trying to help these young people through this very
- 30:00Very confusing time in their life, uh, confusion that's being aided and abetted by certain people and authority, certain individuals and white lab coats and certain individuals in the classroom and the school building.
- 30:18You know, if we if we look at the list here, I'm looking, this article is out of the epoch times, and they they state that in addition to the District of Columbia, there are 23 states in the union, almost half of the union that ban this type of therapy for minors.
- 30:40Can you believe that?
- 30:4223 states are infringing upon the constitutional rights of therapists, and saying, you can't, you can't talk these kids out of being confused.
- 30:54How dare you?
- 30:56How dare you thwart our efforts and confusing the next generation?
- 31:01I mean, if that isn't the end game here, please someone tell me what is the end game.
- 31:09It's a legitimate question.
- 31:10If the end game is not to confuse a generation of Americans in regard to their identity, well, what is it?
- 31:21You know, since uh Trump took office.
- 31:26I don't have these numbers right in front of me.
- 31:28I've read them recently.
- 31:30So, you know, forgive me if I'm not spot on here.
- 31:33I'm I'm not gonna throw out a percentage.
- 31:35I'm just going to say that the number of people identifying as the opposite gender has decreased since Trump took office.
- 31:45Now, what does that tell you?
- 31:48It tells you that this isn't how do I want to say it?
- 31:55Let me put it together.
- 31:56So it basically says that this is a political issue, that a put a particular political party, those on the left, the Marxist wing, the Marxist faction, by the way, is very adamant about confusing people in terms of their gender, confusing young people, getting them to think they're one way when they're not.
- 32:18I don't know how else to explain it.
- 32:20Trump gets into office, he starts calling this business out, and all of a sudden, those that identify as the opposite gender, that that amount is those numbers are decreasing.
- 32:33Have people automatically seen the light?
- 32:36Or you know, is it that the political heat's been turned down?
- 32:40Uh, this particular law in Colorado allows officials to take away the licenses of healthcare professionals who have been deemed to have offered this type of therapy to minors.
- 32:58I mean, that is that is a huge penalty that you you're stripped of your ability to practice your profession.
- 33:06If you are trying to help somebody through their confusion, the punishment is you lose your license.
- 33:13You can't practice in Colorado.
- 33:16If uh the asininity here, the this is not uh again.
- 33:25This is where I'm going to uh I'm gonna part company here with Gorsuch.
- 33:30These people that have created this law, they don't they don't believe that this policy is essential to public health and safety.
- 33:38No, they want to destroy anyone's ability to help young people work through their confusion.
- 33:48They want them to stay confused.
- 33:52And uh also back to this Colorado law.
- 33:55Not only would one lose their license, but one would also be fined as much as $5,000, in addition to having one's license stripped from them.
- 34:07The law prohibits licensed therapists from attempting to quote change an individual's sexual orientation, including efforts to change behaviors or gender expressions, or to eliminate or reduce sexual or romantic attraction or feelings toward individuals of the same sex.
- 34:26How dare you attempt to change their sexual orientation?
- 34:32Well, what if they've come to you for that very thing?
- 34:36What if they've come to you for that for that very help?
- 34:39And you're not allowed.
- 34:42Well, uh, Kaylee Chiles said, Oh, no, enough's enough.
- 34:46Well, I'm not doing this.
- 34:49We're not playing this game.
- 34:52Childs argued that the law banning this therapy encourages young people to change their sexual orientation or gender identity away from the heterosexual norm.
- 35:05And the law further prohibits the provision of counseling for same-sex desires or identification with the opposite gender, even if the young person wanted that counseling, even if the young person wanted that help, begging for that help, and many of them are, by the way.
- 35:26A federal court previously declined to block the law, stating that Colorado was regulating professional conduct rather than constitutionally protected speech.
- 35:39Now, Colorado, uh, this is the same state that uh said that the that the cake person, the person who didn't want to make the cake for the uh the homosexual couple, that that was that was speech.
- 36:00But in the case of the therapist here, it's not speech, it's conduct.
- 36:04You've got these judges that are on the left that are so willing to twist and turn and alter and shape the definition of the law based upon their own ideological preference.
- 36:24You can't have it both ways.
- 36:26I mean, in the case of the of the baker, it's it can't be free speech, and then in the case of the therapist, uh, be um professional conduct.
- 36:38I mean, what is more speech related talking through therapy or baking a cake?
- 36:45It seems baking a cake would be professional conduct.
- 36:48I don't know if there's any talking going on while you're choosing to bake a cake or not choosing to bake a cake.
- 36:54That would be professional conduct.
- 36:57Therapy would be actual free speech, actual verbiage.
- 37:04But you see, do you do you see what I'm getting at here?
- 37:10The the stupidity, the inability to correctly uh uh carry the the definition of the law for all cases and in all matters.
- 37:23The left can't do it.
- 37:25I mean, I don't know.
- 37:26I don't maybe they actually can't do it.
- 37:29Maybe they can't.
- 37:30Maybe they can't get beyond their own ideological bent because they don't really love the law, they don't have a love for the law.
- 37:38They they have a love for their own ideological persuasion.
- 37:42That's what they love, and they love that over the law, and they think that their ideological persuasion should be the law.
- 37:50I mean, if that's the case, then yes, they love the law.
- 37:53But for the law's sake, they don't love it.
- 37:55They don't love the constitution.
- 37:57They they believe the constitution should be a living, breathing document that changes with society, and and the way we define it should be based upon the the way society is moving and the current stream that society is going down.
- 38:12No, no, that that would be the worst thing possible ever in the history of ever.
- 38:18No, the constitution is not a living breathing document, it's fixed, it's etched in stone.
- 38:25The definitions of the word and words and the document, when originally used and applied, those definitions still stand, they still hold.
- 38:37The original usage, the original application still applies today.
- 38:43If it doesn't, we don't have a law.
- 38:45If it no longer applies, we we don't have uh any type of measuring stick.
- 38:53The goalposts keep moving.
- 38:55If if the goalposts are going to keep moving, you don't have a game.
- 38:59If if 12 inches no longer equals a foot, we got nothing.
- 39:04And that's why the Constitution has to stay intact.
- 39:09Uh, and so kudos to this to this court.
- 39:13Absolutely to this court for standing up and and getting it done.
- 39:22All right, I'm looking at the clock.
- 39:24I'm not quite done with this conversation yet.

- 43:12And we would love for you to be there.
- 43:13All right.
- 43:14Speaking of good times, the Supreme Court is giving us some good times.
- 43:21And and just to celebrate uh the Constitution, they stood up for the Constitution this week.
- 43:29Doesn't always happen, mind you, but this week they did it.
- 43:34Uh Judge Charlotte Sweeney of the U.S.
- 43:37District Court for the District of Colorado.
- 43:42Uh, she is the judge here that the Supremes are just smacking down theoretically.
- 43:49She said that children are entitled to a state's protection from therapeutic modalities that have been shown to cause long-standing psychological and physical damage.
- 44:03I would like Judge Charlotte Sweeney to uh did she cite any documentation of longstanding psychological and physical damage that this therapy's caused.
- 44:19Or are they just at this point babbling the talking points?
- 44:26I promise you, I'm I'm gonna step out here right now.
- 44:30There is no legitimate study or research.
- 44:33Emphasis on the word legitimate.
- 44:35There was no legitimate study or legitimate longstanding research that shows longstanding psychological and physical damage to young people who are going through therapy, helping them through their confusion.
- 44:51Judge Charlotte Sweeney of the U.S.
- 44:54District Court for the District of Colorado.
- 44:59The U.S.
- 45:00Court of Appeals for the 10th Circuit upheld the Colorado law as a regulation of child's conduct, not her speech.
- 45:08We're not talking about her speech here, even though she's actually speaking.
- 45:13Her professional conduct.
- 45:15Now the the person baking the cake, oh, that's speech.
- 45:18That's not professional conduct.
- 45:20But here, here it's its conduct.
- 45:25And shockingly, my friends, shockingly.
- 45:29Justice Alana Kagan filed a concurring opinion along with Justice Sonia Sotomayor.
- 45:36They filed a concurring opinion with Gorsuch.
- 45:40Kagan said she agreed that the Colorado law, as applied to talk therapy, conflicts with core First Amendment principles because it regulates speech based on viewpoint.
- 45:55Ha ha didn't see it coming.
- 45:59Not from Kagan.
- 46:01Not from Soda Myor.
- 46:04A law drawing a line based on the ideology of the speaker, disadvantaging one view and advantaging another, said Kagan, skews the marketplace of ideas.
- 46:19Our society dispend depends on to discover truth.
- 46:23What?
- 46:25Justice Kagan acknowledged that our society depends upon the marketplace of ideas in order to discover truth.
- 46:36Holy smokes.
- 46:39That means that that a therapist has to be able to present ideas in order for his or her client to discover truth.
- 46:53Now, if the therapist is not allowed to dispense with the free marketplace of ideas, then it seems the only objective for that disallowance would be for someone to not discover truth.
- 47:10And that's the name of their game here.
- 47:12They don't want young people discovering truth.
- 47:16They want them perpetually confused, eternally and perpetually, in a state of confusion.
- 47:25Not in a state of truth.
- 47:27Not in a state of understanding.
- 47:30Not in a state of exploring the free marketplace of ideas.
- 47:40And kudos here.
- 47:42Congratulations.
- 47:43High praise and high marks for Alana Kagan for acknowledging this very thing.
- 47:49And for Sonia Soda Myor for climbing on board her opinion.
- 47:54And equally acknowledging it.
- 47:57Kagan continued.
- 47:59She said if the first amendment prohibits anything, it is the official suppression of ideas.
- 48:05Well, well, what do you what do you think about that, Judge Charlotte Sweeney of the U.S.
- 48:11District Court for the District of Colorado?
- 48:15What do you think about that?
- 48:16U.S.
- 48:16Circuit Court of Appeals for the 10th Circuit.
- 48:20What do you think about that?
- 48:21Your own Kagan and Soda Myor, your very own has smacked you down.
- 48:30Your very own has come on board and said, look, you the constitution means what it says it means.
- 48:40The uh Supreme Court then reversed the 10th circuit decision and remanded the case for further proceedings.
- 48:48Consistent with their opinion.
- 48:50Uh tell you what, why don't you why don't you look at this and make sure you're you're you're looking at it with a lens that's consistent with our opinion?
- 49:00Yeah, we're the supremes here.
- 49:02You're not.
- 49:04Uh, this feels so good.
- 49:06Doesn't it?
- 49:06Am I alone here?
- 49:08Am I I know I'm not.
- 49:09I'm not alone.
- 49:10I know this just brings excitement and joy to the room, doesn't it?
- 49:15Don't you feel it?
- 49:16Aren't you equally excited that the Supreme Court has made this determination?
- 49:26Uh Child's attorney, he's pretty stoked.
- 49:29Jim Campbell of Alliance Defending Freedom.
- 49:33He said the Supreme Court's ruling in this case, which was based on his client, Chiles, based on her engaging in voluntary conversations, will lead to similar laws in other states being struck down.
- 49:48Now, here's the good news.
- 49:50Because 23 states, along with the District of Columbia, all have these laws that therapists cannot try to talk young people off.
- 50:00Of their gayness and into straightness.
- 50:02Can't do it.
- 50:04Well, that's going to change things.
- 50:06That's going to I don't know that we fully understand the uh the the shape of the playing field right now and how that shape is about to change.
- 50:20This this Supreme Court ruling is huge, it's massive.
- 50:24It delivers a death blow to one of the ideological uh strongholds that the left has placed on this country.
- 50:39This supreme court decision delivers the death blow to it.
- 50:43Matter of fact, that I might I might title the article that right there.
- 50:47I always put an article out with the podcast.
- 50:51Supreme Court, I write this down.
- 50:53Supreme Court decision delivers death blow to leftist ideology.
- 51:01Oh, I love it.
- 51:03Absolutely.
- 51:04Love it.
- 51:05Um Jim Campbell continued.
- 51:09Uh the court said laws like these that discriminate based on viewpoint, single out a particular perspective for silencing.
- 51:19That those laws have to be subject to the highest, highest First Amendment scrutiny.
- 51:26And so that's going to apply to every single one of these laws around the country.
- 51:30And the one thing we know, he continued, is that whenever a court has applied that kind of heightened scrutiny to one of these laws, it has struck it down.
- 51:40All other laws follow like dominoes.
- 51:46Right straight down, just like the dominoes.
- 51:50Well, uh, Colorado, uh, they can't be happy about this.
- 51:55The leftists over there, the Marxists in charge of Colorado.
- 52:01They're not happy.
- 52:02The Colorado AG, Phil Weiser, uh, who isn't, said the high court's decision was a setback for Colorado's efforts to protect children and families from harmful and discredited mental health practices.
- 52:20Oh, just the comedic value here.
- 52:23Again, harmful and discredited.
- 52:27Who?
- 52:28Who, Mr.
- 52:29Weiser?
- 52:30Who isn't?
- 52:31Who has discredited this except uh Marxists who obviously don't want it because they want to keep kids in confusion?
- 52:43Wiser, who isn't continued.
- 52:45For generations, states have set and enforced standards to ensure that licensed professionals provide safe and appropriate care.
- 52:54We strongly disagree with the court's reasoning because obviously a care to lead a young person out of confusion is not safe, nor is it appropriate to our Marxist cause.
- 53:07That's the caveat.
- 53:09It's not safe or appropriate to Marxism.
- 53:13Uh, but he wasn't done there.
- 53:15He said this this therapy is a practice that every major medical and mental health association in the country has rejected as unsafe and effective.
- 53:24Really?
- 53:25Every major medical and mental health association in the country has rejected it as unsafe and ineffective.
- 53:34Now, are you are you referencing the uh um that that child pediatric organization that is on board with uh with solving mental health problems with uh transgender surgery?
- 53:50Is that what you're you're referring to them?
- 53:53Because they're discredited.
- 53:55Now, I will tell you this, Mr.
- 53:57Weiser, who isn't any major medical and mental health association that has uh rejected this as unsafe and ineffective, they are discredited.
- 54:09That they are a major medical and mental health association that is steeped in discredit, they reek of it, they they reek and stink of it.
- 54:22All right, I just use the same word just in a different way twice.
- 54:26Okay, uh, when we get to that point, I mean we know that we know the deed is done.
- 54:32All right, look, the bottom line is uh not only is the first amendment saved, but young people throughout this country now have the opportunity to equally be saved from confusion, saved from hardship, saved from turmoil, saved from wandering aimlessly through their life, wondering who they are, and we are we are grateful, and ultimately we gotta say this.
- 55:06Uh, this is rare when we say this, but we're gonna say it.
- 55:09We're grateful to two of the leftist judges, Kagan and Soda Mayor.
- 55:14Obviously, you know, having them on board didn't alter the decision one way or the other, but uh congratulations to them for seeing the truth on this.
- 55:25I'm genuinely shocked.
- 55:27I am, it's genuine, and and because I'm I'm so shocked, my gratitude to them is is equally genuine.
- 55:36I truly am.
- 55:37I'm I'm grateful that they that they see the truth here in this.
- 55:43Not surprised about the about the other, not surprised about her at all, at all whatsoever.
- 55:49Okay, uh, my friends, good news.
- 55:52Very, very good news, excellent news.
- 55:54We were happy about this.
- 55:55You know what else we're happy about?
