Speaker 1: What's up, everyone, and welcome back to the program. Now
• 0:03
that the indictment for Sean Ditty Combs has been unsealed,
• 0:07
we're finally getting a look at the charges that the
• 0:09
government is bringing against Ditty, and all of those charges
• 0:13
that he's been slaped with come with mandatory sentences. And
• 0:17
it's not something that a lot of people are talking
• 0:19
about because obviously the five hundred pound gorilla in the
• 0:22
room is the rico charges. But all this other stuff
• 0:26
is bad news for him. And one thing that's really
• 0:29
going to come back and bite him in the ass
• 0:31
and probably cause enhancers to kick in are those guns
• 0:35
that have obliterated serial numbers. You can't run around with
• 0:38
firearms with obliterated serial numbers. That's a ten year stint
• 0:43
right there, just on the gun. So this dude's looking
• 0:46
at serious time, folks, and he's in serious jeopardy of
• 0:50
going to prison for the rest of his life. Today
• 0:53
we have an article from Newsweek and the headline Sean
• 0:56
Combs case compared to r Kelly, Jeffrey Epstein, and didty
• 1:00
is screwed? This article was authored by Jenna Sundel Well.
• 1:04
I certainly can't disagree with the Didty is screwed portion,
• 1:08
and I think that if we're going to compare what's
• 1:10
going on with Didty to anyone, I think that R
• 1:12
Kelly's probably the right way to go. That's how this
• 1:15
is going to be prosecuted. And my guess is that's
• 1:18
the blueprint that they're going to use. Remember this is
• 1:20
the same office that went after R Kelly as well.
• 1:23
So I think that there are similarities obviously between the
• 1:26
criminal enterprises of Diddy and Jeffrey Epstein. But we have
• 1:30
to remember that Jeffrey Epstein and what he was doing
• 1:33
was on an international level. He was bringing women in
• 1:36
from Eastern Europe. He was bringing women in from god
• 1:39
knows where, and these women were coming here and being
• 1:42
put up at a building on East sixty sixth Street
• 1:45
in Manhattan, all with the promise of a lucrative modeling
• 1:48
career waiting for them in the United States, but that
• 1:50
never materialized. Instead, they were sent out to go to
• 1:54
different meetings with people to try and collect compromount So
• 1:57
while there are similarities, there's no doubt both criminal enterprises,
• 2:01
they're both based on human trafficking. There are also some
• 2:05
serious differences when it comes to Epstein. And Diddy, and
• 2:09
I think, in my opinion anyway, the more apt description,
• 2:12
the more apt comparison would be with R. Kelly, and
• 2:16
I think that's what the prosecutors are going to do.
• 2:19
When you look at the charges that they've hit Diddy with.
• 2:22
I think they're going to use the blueprint that they
• 2:24
built during that R Kelly prosecution, especially considering the success
• 2:29
they had with it. Right, they were able to nail
• 2:31
them and send them to prison for the rest of
• 2:33
his life with that game plan, So I don't see
• 2:35
them deviating from that course and going a different way.
• 2:39
I think they're going to pursue Diddy the same exact
• 2:41
way they did R Kelly, and I think when all
• 2:43
is said and done, we're gonna have the same result.
• 2:46
Legal experts are weighing in on disgraced rapper and music
• 2:49
producer Sean Diddy Comb's indictment on charges of sex trafficking
• 2:53
and racketeering. Combs fifty four, pleaded not guilty to the
• 2:57
charges on Tuesday. The indictment alleged is a criminal enterprise
• 3:01
operating over a series of several years, that involves coercing
• 3:04
individuals to participate in various sexual acts. So one thing
• 3:08
that we have to take from that is that them
• 3:10
saying it's a criminal enterprise. There was definitely other people involved,
• 3:14
So it's going to be real interesting to see who
• 3:17
else gets indicted, who was around Diddy and who was
• 3:20
working with them in forum, as opposed to the people
• 3:23
who don't get indicted, because those people have probably flipped right,
• 3:26
because the only way to get yourself out of trouble
• 3:28
here is to turn on whoever the boss is, and
• 3:32
according to the government, the boss in this situation was Diddy.
• 3:35
Diddy is screwed. Nyama rockmani, former federal prosecutor and president
• 3:40
of West Coast Trial Lawyers, told Newsweek the big takeaways
• 3:43
are obviously, these are very serious charges. Everyone talks about
• 3:47
the racketeering and how there is potential life sentence, but
• 3:50
more importantly, some of these charges carry mandatory minimum sentences
• 3:55
in prison. And that's what I was saying earlier. There's
• 3:58
a lot in this indictment that's bad news for Diddy,
• 4:00
and I think that the guns are really going to
• 4:03
come back to bite them. I talked a little bit
• 4:04
about this on Twitter last night, and I think that
• 4:08
with the mandatory sentences that you see with these other charges.
• 4:12
I think that Diddy is in gigantic trouble and if
• 4:16
things go the way that the prosecution thinks they're going
• 4:18
to go, Diddy's gonna end up going to prison for
• 4:21
the rest of his life, just like R. Kelly. Kathy Fleming,
• 4:25
a principle at the Office of Kerman Litigation Practice Group,
• 4:29
also emphasize the severity of the charges. To Newsweek, they
• 4:33
have alleged very serious crimes in a federal court, alleging
• 4:36
issues related to sex trafficking, meaning misusing the victims, and
• 4:40
there is serious time consequences if someone is convicted of this,
• 4:44
Fleming said to Newsweek, Yeah, no doubt about it. And
• 4:48
we haven't even talked about the man Act or anything
• 4:50
else yet. And there's no way that this is the
• 4:53
last iteration of this indictment. It's going to be superseded.
• 4:57
They're going to add more to it. It's just a
• 4:59
matter of time. Trey Lovell and entertainment and civil attorney,
• 5:03
spoke to Newsweek about the similarities between R. Kelly sex
• 5:06
trafficking case and colmb's case, and I think this is
• 5:09
the most important comparison. I know a lot of people
• 5:12
want to compare it to Epstein, and I understand why, right.
• 5:16
Epstein was one of the most disgusting, vile people in
• 5:18
the history of the world. And then you look at
• 5:21
what Diddy was up to, and it's very similar. But
• 5:24
when you really look at it, it's not the same.
• 5:26
They weren't up to the same thing. It wasn't international,
• 5:29
it wasn't for a compromunt So there are a lot
• 5:32
of differences. Does that make what Diddy was doing any
• 5:35
less heinous or disgusting than what Epstein was up to?
• 5:38
Of course not, especially to the people who were affected
• 5:42
by it. So I'm not trying to say one's worse
• 5:44
than the other. I'm just saying that they're different, And
• 5:47
for me, I think the better comparison is the r.
• 5:49
Kelly case. Now that doesn't mean that there aren't similarities.
• 5:53
That doesn't mean that we shouldn't run them side by side.
• 5:55
We're going to, But I think that when all is
• 5:58
said and done, and we see the way that this
• 6:00
gets prosecuted, and we see the evidence that's brought forward,
• 6:04
it's going to resemble the r. Kelly case much closer
• 6:06
than it did the Epstein or Maxwell case. R Kelly
• 6:10
and now Ditty are representatives of high level famous and
• 6:14
in this case in the music world, moguls who have
• 6:17
chosen to live a lifestyle which the authorities question is
• 6:20
illegal in many respects. Level said, and look, we all
• 6:24
know that these depraved ass rich people live a different
• 6:26
way than we do. They're up to a bunch of
• 6:29
wild shit, and they don't get off the way we do.
• 6:31
When you're a billionaire, you don't get off the same
• 6:33
way the working man does. I know that if I
• 6:36
go to the casino and I blow a couple of
• 6:38
hundred bucks, that's exhilarating, right, that's fun. You got a
• 6:42
chance to maybe win a couple of bucks. Whatever. You
• 6:45
think that gets Ditty off. Of course it doesn't for Ditty,
• 6:49
it's something completely different. And that is something that he
• 6:51
certainly had in common with Epstein. Once you get to
• 6:54
this level, the depravity just increases, and it seems like
• 6:58
all of these people that roll around in this so
• 7:01
called elite society or up to the same bullshit. He
• 7:04
said that both cases send a message about law and power.
• 7:08
The government wants to make a statement that says, no
• 7:10
matter who you are, how much money you have, how
• 7:13
powerful you are, we're not going to let you get
• 7:15
away with stuff like this, Lovell said. Lovell also explained
• 7:19
what has caused the shift in prosecuting these cases that
• 7:23
have been ongoing for many years. I think it was
• 7:26
triggered by the Me Too movement. When the Me Too
• 7:28
movement happened and it cast this light on the dark
• 7:31
world of the entertainment industry, Lovell said. ROCKMANI drew comparisons
• 7:35
between Comb's case and the sex trafficking case against Jeffrey Epstein.
• 7:40
R Kelly didn't have a whole lot of rich and
• 7:41
famous people participate in acts with him, but did he?
• 7:45
Reportedly did, and we know Epstein did, at least according
• 7:48
to some of the evidence, even though a lot of
• 7:51
those people haven't been prosecuted. Well, that much is certainly true.
• 7:54
And I will say that the similarities between Epstein and
• 7:58
did He certainly have to do with the famous people
• 8:00
that they were paling around with. There's zero doubt that
• 8:02
did he had some powerful friends. But there's levels to this, right,
• 8:07
It's one thing to have powerful friends, It's another thing
• 8:10
to be an intelligence asset. And did he most certainly,
• 8:13
in my opinion, was not that was he a depraved,
• 8:16
sick bastard. Absolutely did he have a lot of high
• 8:19
placed friends who are very powerful in the music industry
• 8:22
and in business most certainly, and there's no doubt that
• 8:25
a lot of those people were attending these parties. Does
• 8:28
that mean they were taking part in all this? I
• 8:30
  don't know. I wasn't there. I haven't seen any video.
• 8:33
I haven't heard anybody come out and talk about who
• 8:35
else might have participated. But it's certainly something that's on
• 8:39
the table, and I'm not gonna say it didn't happen.
• 8:41
I don't know. We'll have to wait and see how
• 8:43
much more evidence makes itself available to us as this
• 8:46
whole process continues to evolve. But I would say that
• 8:49
there's a good possibility that other famous people are going
• 8:53
to find themselves caught up in this. ROCKMANI also raised
• 8:56
the possibility of other individuals being implicated in did He
• 9:00
alleged criminal scheme. Anyone who participated in the sex acts
• 9:04
should be really worried. ROCKMANNI said, there's a lot of
• 9:07
rumors down here in la I live a mile away
• 9:09
from Diddy. There are a lot of rumors that a
• 9:11
lot of other celebrities participated in these acts. I would
• 9:15
certainly be worried if I were them, because they could
• 9:18
easily be charged, especially if there's video evidence. If you're
• 9:22
on video and you were over at Ditty's diddling somebody,
• 9:25
you're gonna be in big trouble, no doubt about it.
• 9:28
The question is how many of these people were participating.
• 9:31
So what we're gonna do around these parts is we're
• 9:33
going to take the same approach that we did with Epstein,
• 9:36
and we're going to look at all the evidence and
• 9:38
we'll go from there because there's gonna be a lot
• 9:40
of disinformation. There's gonna be a lot of bs surrounding
• 9:44
what's going on with Diddy, what's going down with Diddy,
• 9:46
and who he might have been associated with. So we're
• 9:49
going to take the same approach that we did with
• 9:51
Epstein as we work our way through this. Fleming described
• 9:54
some of the difficulties the defense will face if Diddy
• 9:57
does go to trial. You have to get a jury
• 9:59
who who says they're fair and impartial, which for the
• 10:03
defense is a challenge because a lot of people believe
• 10:05
if you're charged, you must be guilty. Fleming said, that's
• 10:08
an unfair concept and they shouldn't do that. Everyone's presumed
• 10:12
innocent unless and until the government proves its case beyond
• 10:16
a reasonable doubt. She said the media coverage could also
• 10:19
pose a challenge for the defense. They also have a
• 10:23
problem of pre trial publicity. That this is a big
• 10:26
story and a lot of people are writing about it,
• 10:28
and there's always a concern that potential jurors will read
• 10:31
about it make up their minds before they hear the
• 10:33
evidence in the courtroom, as opposed to what they read
• 10:37
about it in the newspapers and particularly the internet, because
• 10:41
the internet is not known for being accurate in lots
• 10:44
of respects, Fleming said, all but the media is the
• 10:48
media has been lying to us for how long and
• 10:50
all of a sudden the media should be the arbiter
• 10:52
of truth. Still, sorry, I don't buy that. I don't
• 10:54
buy that for a second, And my guess is most
• 10:57
of you listening to this podcast don't buy it either.
• 11:00
Lovell said that the sheer amount of evidence in the
• 11:02
case can also pose some difficulties. Yeah, you think, I
• 11:06
would think that that's the most important thing, the evidence
• 11:08
in the case, and the evidence here seems to be
• 11:11
pretty overwhelming when you have what prosecutors said is up
• 11:14
to fifty witnesses and victims and you have video evidence
• 11:17
and physical evidence they got from the houses, and if
• 11:20
indeed it corroborates each other, that's very compelling, Lovell said.
• 11:24
Prosecutors will also face some struggles as they argue their case.
• 11:28
According to Fleming, they've got to convince all twelve jurors
• 11:31
that the person they've charged is guilty beyond a reasonable
• 11:34
doubt on all the elements of the crime. Fleming said,
• 11:37
and they also have the challenge of they've got a
• 11:41
very famous defendant and that makes it highly watch proceeding. Well,
• 11:45
that's true, but guess what the evidence is. What the
• 11:47
evidence is, And for me that's the most important thing.
• 11:51
All the salacious bullshit, all the nonsense, that's fine and well,
• 11:54
people are going to engage in that. But me, I'm
• 11:57
trying to get to the meat and potatoes. What are
• 11:59
the actual charges, what do they mean, and who's involved?
• 12:02
And then from there, well we can see where the
• 12:05
salaciousness takes us. Fleming spoke about our own experiences being
• 12:09
part of high profile cases. There are differences. The first
• 12:13
is that the press is out there and they do
• 12:14
a lot of investigative work, which can either help or
• 12:17
hurt depending on what the facts are, Fleming said. Another
• 12:20
part of it is that there's a lot of press
• 12:23
in the courtroom. People in the courtroom at trials, including
• 12:26
generally the judge as well as the participants, behave differently.
• 12:29
They're conscious of the press being in the room. Well,
• 12:32
we have an open system here in America, so they
• 12:35
better get used to it. Prosecutors must also face off
• 12:38
against someone who can afford a lot of resources. Having
• 12:41
a lot of resources can help a defendant significantly because
• 12:45
they can afford to hire not only the best lawyers,
• 12:47
but they can afford to hire investigators and find out
• 12:50
ways that they can help to attack the government's case
• 12:52
at trial. Fleming said. Witnesses called in the case could
• 12:56
also feel worried about facing the defendant. According to rock Nani,
• 13:01
they may be afraid of them, and he may intimidate
• 13:03
the witnesses. Rockmani said. While fame can often impact high
• 13:08
profile cases, Lovell does not think that will benefit Didty.
• 13:11
I would think that based on the allegations and how
• 13:14
serious they are. I don't really think his celebrity is
• 13:17
going to help him, Lovell said. And I don't think
• 13:19
it's going to either. I think that ditty's cooked and
• 13:22
I think right now, we're just at the point where
• 13:24
we're learning how cooked he is, right, Is he going
• 13:27
to be well done or is he going to maybe
• 13:29
escape with some lesser burns, if you will. But one
• 13:34
thing's for damn sure. There's no way that he's just
• 13:37
walking away from this, unless, of course, he pleads guilty.
• 13:39
But besides that, this is going to trial and we're
• 13:43
going to be following along every step of the way
• 13:45
as it makes its way through the system and eventually
• 13:49
into the courtroom. All of the information that goes with
• 13:52
this episode can be found in the description box, have
• 13:56
not really discussed here on the podcast. And that person
• 13:59
is R. Kelly. And the reason I'm bringing him up
• 14:03
is when you look at the cases that are in
• 14:05
the news, there aren't many that fit the bill of
• 14:10
the Jeffrey Epstein case. But when you look at the R.
• 14:13
Kelly case and some of the charges brought against him,
• 14:17
and you look at how aggressively the government's going after
• 14:21
him for being the head of a criminal enterprise, one
• 14:24
is left to wonder why the same zeal isn't being
• 14:27
shown when they're going after Glenne Maxwell. Now, if anything
• 14:33
has ever been a RICO case it's certainly the Jeffrey
• 14:37
Epstein case, and as far as this R. Kelly case goes,
• 14:42
I say kudos to the government for going into their
• 14:45
toolbox and using this charge on him, because, as you're
• 14:49
going to see in this article, the stuff R. Kelly
• 14:52
was up to was the same shit Jeffrey Epstein was
• 14:57
up to, but it wasn't to the level of Jeffrey
• 15:01
Epstein's deviousness. And that's pretty mind blowing considering how disgusting,
• 15:09
how gross the shit R. Kelly was up to is,
• 15:14
And then you think about how much longer, how many
• 15:18
more survivors and victims there were of Jeffrey Epstein, and
• 15:23
it's enough for you to want to take a bleach shower.
• 15:27
But the real question remains, why is there not a
• 15:31
RICO charge hanging over the co conspirators of Jeffrey Epstein.
• 15:37
If R Kelly is hit with a leadership charge, if
• 15:41
R Kelly is said to be in charge of a
• 15:44
criminal enterprise that's based around sexual assault of women and
• 15:50
young girls, then don't you think that Jeffrey Epstein and
• 15:54
Glane Maxwell should be classified the same way Keith Rayniery
• 16:01
racketeering RICO all these other people Rico racketeering, but not
• 16:06
Glan Maxwell. So again it makes you ask yourself why. Now,
• 16:11
don't get me wrong. R Kelly rich ass guy, dude,
• 16:14
no doubt about it. Had a bunch of money. What
• 16:16
he didn't have the political connections of Glan Maxwell and
• 16:19
Jeffrey Epstein. Same goes with Rainiery. Keith Rainiery a little
• 16:24
bit more connected, right, but not completely locked in certainly
• 16:28
didn't have a picture of a president in address hanging
• 16:30
on his wall. So you see, if it's good enough
• 16:35
for these two scoundrel ass scumbags pieces of shit, why
• 16:40
is it not good enough for Glan Maxwell? Why is
• 16:43
it not good enough for Jeffrey Epstein? That case should
• 16:48
have been Rico from the very beginning. It is everything
• 16:51
that you want for predicates of Rico. It's a criminal enterprise,
• 16:56
people in leadership roles, people were enriching them selves from
• 17:00
ill gotten gains. And never mind all of the other
• 17:03
things that go along with it, wire fraud, coercion, you
• 17:07
name it. Oh, I've seen them hit regular people, bookies, Okay,
• 17:13
people that were engaged in quote unquote illegal sports gambling
• 17:19
get hit with one hundred literally one hundred rego predicates
• 17:22
know one. They're not gonna be able to stick all
• 17:24
of them to them, but hopefully one of them sticks
• 17:27
and in the hopes that you plea down and then
• 17:30
you go to prison, they don't have to go to trial.
• 17:32
It's a win win for them, but not for Glenn Maxwell,
• 17:37
not for her people. Still, they don't even have a
• 17:39
man Act charge against Glene Maxwell. So let's jump into
• 17:46
this article today from the Chicago Tribune and let's take
• 17:49
a look at R Kelly's situation, and let's run that
• 17:54
side by side concurrently with the Jeffrey Epstein case. And
• 17:59
then I'll ask you so again, why is Jeffrey Epstein's
• 18:02
cohort Why is Glainne Maxwell not being charged with RICO
• 18:09
headline a sex abuse enterprise breaking down the unusual racketeering
• 18:14
case against R Kelly. The authors of this article are
• 18:19
Jason Meisner and Megan crapou R and B Superstar. R
• 18:26
Kelly had embarked on what was supposed to be a
• 18:29
high flying tour in twenty sixteen when two members of
• 18:33
his ent garage allegedly expressed concern the singer was physically
• 18:38
and psychologically abusing a teenage girl traveling with them. YO
• 18:42
that's insane to think about. I mean, imagine being on
• 18:49
this road crew. I worked in entertainment, and I can't
• 18:53
even imagine being on a road crew where somebody's being
• 18:56
kept in servitude, being abused physically, psychologically, and not stepping
• 19:03
up to do something about it. It's crazy to think
• 19:08
how much power people like this wield, somebody like R
• 19:11
Kelly in his circle, right, But I don't see how
• 19:18
people could not report this so good on the entourage.
• 19:21
Probably stage hands that reported his ass, right, Probably some
• 19:26
you know, audio technician or lighting technician that was tired
• 19:29
of R. Kelly's bullshit every day, tired of his dumb
• 19:32
ass rider requests every day, and said, you know what,
• 19:35
this dude's a sick prick. I'm ratting him out, and
• 19:38
good on whoever it was who snitched on him. You know,
• 19:43
I'm a pretty mind my own business kind of guy, right,
• 19:47
but not in circumstances like this. And again, I'll say
• 19:51
it one hundred thousand times, You're lucky if only the
• 19:54
cops get called on you, homie, because I gotta tell you,
• 19:59
I don't know if i'd be able to control myself
• 20:02
I catch somebody hurting one of these kids or engaged
• 20:06
in trafficking of women. I might just go ahead and
• 20:10
let off. Honestly, I'm not even kidding. You know, violence
• 20:14
is not the answer ever, All kidding aside, right, you
• 20:20
don't want to engage in violence at all. I mean,
• 20:23
there's nothing cool about it or anything like that. But
• 20:25
people like this man, and if you're around it, I mean, like,
• 20:29
you know you're working for this guy and you find out,
• 20:32
I don't know, I'd freak out. I would freak the
• 20:35
fuck out, guaranteed, one hundred percent freak out, and there'd
• 20:41
be a confrontation. I would definitely confront the person engaging
• 20:44
in this. So good on the crew members, whoever it was,
• 20:49
to step up and rat this disgusting fucker out. The
• 20:55
girl was kept locked up in a tour bus for
• 20:58
hours on end, according to a recent court filing by
• 21:01
federal prosecutors in New York. Her eyes were red and puffy.
• 21:05
She looked rough. As one employee allegedly put it, so
• 21:10
you're gonna keep somebody locked in a tour bus for
• 21:12
hours on end, and nobody's gonna know the difference. Nobody's
• 21:15
gonna say, Hey, r Kelly, the fuck you doing? Man?
• 21:19
Why you got this girl locked up in your tour bus.
• 21:25
All of those people that were around him as well,
• 21:28
just like the people that were around Epstein pieces of shit.
• 21:32
Tell me you didn't know what was going on. You
• 21:34
knew what was going on. Kind of fucking kind of man.
• 21:38
Has anyone locked up in a tour bus for a
• 21:40
few hours tho it was wrong with you? Something is
• 21:46
really strange about the treatment and behavior of the little one,
• 21:49
the employee texted on May seventeenth, twenty sixteen. According to
• 21:53
the filing, when she gets to Florida, she needs to
• 21:57
run and never look back. She should be living the fun,
• 22:01
living the fun life of an eighteen year old high
• 22:03
school senior. She's been on punishment forever, whatever that means.
• 22:08
Talk about cryptic and scary and whoever sending that message,
• 22:13
What do you mean you're sending a message? Bro? What
• 22:16
kind of coward are you? Walk onto that bus, grab
• 22:21
that girl, and walk off that bus and tell any
• 22:25
of them motherfuckers that are in your way if they
• 22:28
try and stop you, they're finna get it, pretty simple,
• 22:33
pretty simple. Too many do nothing mfs running around this world.
• 22:40
Too many people that are waiting for other people to
• 22:42
step up, to the plate and fix shit or to
• 22:45
do something. Well, guess what, Sometimes it's your number that's called.
• 22:49
Sometimes you're the one that has to step up and
• 22:51
make the play. And if you're ever around a situation
• 22:56
like this, at the very least, go to the authorities
• 23:00
right away. The employee's concerns go to the heart of
• 23:07
the unusual federal racketeering case against Kelly that is expected
• 23:12
to attract national attention when Jerry selection begins Monday at
• 23:16
the Federal courthouse in Brooklyn. And now remember he's in
• 23:19
the same the same facility as Glenn Maxwell right now,
• 23:26
So you got the jury's getting ready to be selected,
• 23:31
the whole nine, it's all getting ready to crack off
• 23:33
for r Kelly. And the question is, again, why would
• 23:37
he be slapped with racketeering and not Glenn Maxwell. Now,
• 23:40
please don't misunderstand me. I'm not saying that har Kelly
• 23:43
shouldn't be hit with this. I think all of these
• 23:45
fucking people should be Raynieri, him Maxwell. If you're going
• 23:50
to be part of a criminal organization, a criminal enterprise
• 23:53
that's enriching everyone around you on the back of human trafficking,
• 23:56
you should all get slapped with Rico what. It's only
• 24:00
good if somebody has a vow at the end of
• 24:02
their last name. The shit's only good if somebody's a
• 24:05
crack dealer in watts Naw, fuck that. If you're part
• 24:08
of a criminal enterprise, I don't care what sort of
• 24:10
criminal enterprise it is, It's time for the Rico Act
• 24:15
to slap you directly in your mouth. Unlike the singer's
• 24:23
previous criminal trial in Cook County over a decade ago,
• 24:26
which centered on a single sex tape and ended in
• 24:29
an acquittal, the expansive indictment in New York accuses him
• 24:33
of being the head of a criminal enterprise that, for
• 24:36
decades used his celebrated musical talents to not only sell records,
• 24:41
but also to abuse and enslave girls, produce child pornography,
• 24:47
and satisfy Kelly's personal sexual urges. Boy, where have we
• 24:51
heard all of that before? Huh? So wouldn't Jeffrey Epstein
• 24:54
and Maxwell be the head of a criminal enterprise check
• 24:58
that for decades used his celebrated musical talents r Kelly,
• 25:02
but Epstein his power and influence to not only sell records,
• 25:07
not only make money for Epstein, but to abuse an
• 25:11
enslaved girls and produce child porn. Check check, check, check check.
• 25:14
All of those boxes are filled. All of those parameters
• 25:18
are met by Maxwell and Epstein as well. So again
• 25:21
I'm gonna ask the question, why aren't they being charged
• 25:25
with racketeering? Why are they not being smacked with RICO?
• 25:32
Legal experts said, charging Kelly under the Racketeering Statute commonly
• 25:37
referred to by the acronym RICO is likely unchartered territory
• 25:42
for the nineteen seventy law, which was originally designed to
• 25:45
go after mafia bosses who shielded themselves by using underlings
• 25:50
to do their dirty work. One hundred percent, that's what
• 25:53
RICO was created for, and that's what we have here R. Kelly,
• 25:57
him and his group, no doubt about it. But more specifically,
• 26:01
in the vein that we discuss, Jeffrey Epstein and his
• 26:05
criminal enterprise, no different than the mafia, was set up
• 26:08
the same way to insulate him and his lieutenants from blowback.
• 26:14
And when that blowback came, look what happened. They were
• 26:17
insulated so well that they were all able to get
• 26:20
put onto that non prosecution agreement. So these guys R. Kelly,
• 26:28
Jeffrey Epstein all of these people who are in charge
• 26:31
of groups like this that are engaging in any sort
• 26:34
of human trafficking. Look, if you're transferring girls across state
• 26:37
lines for sexual purposes, you, my friend, are in violation
• 26:41
of the man Act. Okay, right away. Never mind all
• 26:45
of the other stuff that comes along with it. RICO
• 26:48
and the rest. Here. R. Kelly is the godfather, said
• 26:54
Jeff Grell, a professor of the University of Minnesota Law
• 26:57
School and an expert in RICO law. The enter as
• 27:00
the managers, the bodyguards, and the runners who do his bidding. Okay,
• 27:04
let's slip in what we talk about here here, Jeffrey
• 27:09
Epstein is the godfather. The enterprise is the managers, Gallah, Maxwell,
• 27:14
the core four, the bodyguards. In Epstein's case, that would
• 27:19
be the accountant and the lawyer, and runners who do
• 27:22
his bidding. So what is different with Jeffrey Epstein's organization
• 27:25
in R. Kelly's organization, How can the federal government charge
• 27:29
one with RICO and not the other. What makes the
• 27:35
racketeering charge such a powerful weapon against Kelly legal expert
• 27:39
set is the prosecutors can give jurors a thirty thousand
• 27:42
foot view of the Singer's alleged criminal behavior, both in
• 27:46
terms of long longevity and the number of victims involved.
• 27:51
So that's what RICO does, Right, We've talked about this.
• 27:54
I'm sure some of you are sick of it at
• 27:56
this point. So that's what RICO does. Though. It gives
• 28:00
you a full aerial view of all the crimes and
• 28:04
lets you dive on in no matter what it is.
• 28:08
If I sent you money and I'm under criminal investigation
• 28:12
with a RICO case, you are now part of my
• 28:15
criminal organization. You are now receiving ill gotten gains. So
• 28:21
you're part of the RICO investigation. That's how it works
• 28:24
in the real world. That's how it works. If you're
• 28:26
a regular old Italian, you know how I know life
• 28:30
experience is my friends. That's how it works. So how
• 28:33
is it that Jeffrey Epstein and his friends aren't caught
• 28:38
up in the same net. It's an effective tool for
• 28:43
prosecutors because it allows them to bring in evidence they
• 28:47
might not otherwise be able to bring in, to give
• 28:50
jurors a much broader look at the playing field, said
• 28:53
Jeffrey Kramer, a former federal prosecutor who is now senior
• 28:57
managing director of the Chicago based security firm Guidepost Solutions. One.
• 29:03
Look again, I've told you a million times, and I'll
• 29:05
tell you a million times more. RICO is the most
• 29:08
feared charge in the toolbox. You talk to any criminal
• 29:12
who's involved in a criminal enterprise and they will tell
• 29:15
you straight up they fear RICO like it's nobody's business.
• 29:20
And you know those powerful drug cartel members running around
• 29:24
in other countries, you know they fear the most extradition
• 29:27
to the United States because of laws like RICO. So
• 29:31
it's a very powerful tool, the kind of tool that
• 29:34
makes even the most hardened criminal turn snitch, turn rat
• 29:40
turn charman. So, hell yeah, drop that right on r
• 29:45
Kelly's ass, right on him all of his friends, make
• 29:49
all of their lives miserable and have them ratting on
• 29:53
each other. But at the same time, can you do
• 29:58
the same thing to Glenn Maxwell, and you do the
• 30:00
same thing to Jeffrey Epstein's friends. We're talking decades here.
• 30:03
People have been waiting for justice. People are getting tired
• 30:06
of it. To prove the main racketeering count, prosecutors planned
• 30:12
to put on evidence that goes back thirty years to
• 30:15
when R. Kelly was rocketing from Chicago street musician to
• 30:19
worldwide fame as his career blossomed. Prosecutors say, so did
• 30:24
the enterprise, which allegedly used a mix of co conspirators
• 30:28
to recruit girls for Kelly and help keep them under
• 30:31
his control. Boy, where have we heard this story before? Huh?
• 30:35
As Jeffrey Epstein's star rose, so did his power, so
• 30:39
did his grasp, and so did his atmosphere. Same with R. Kelly.
• 30:44
The more famous R. Kelly got, the more money he got,
• 30:47
the more powerful Jeffrey Epstein got as far as getting
• 30:50
inside of these inner sanctums of the financial world. The
• 30:54
more power, the more profile, and the more sway he got.
• 30:58
And they all had both the lieutenants. They both had
• 31:01
people running underneath them to keep this enterprise going to
• 31:04
bring these girls in and out. So what's the difference here?
• 31:09
Why is this bitch ass sixth son of a bitch
• 31:11
R Kelly slab with Rico but Maxwell not. The evidence
• 31:19
includes alleged acts as recent as twenty eighteen, as Kelly's
• 31:23
career was crumbling amid the Me Too movement. It would
• 31:27
soon implode when lifetimes docuseries Surviving R. Kelly brought renewed
• 31:32
attention to his alleged crimes, and if you haven't watched
• 31:36
that series yet, it's heart wrenching. Honestly, as soon as
• 31:43
this Jeffrey Epstein case became something that I just was
• 31:47
so locked into, I knew that I had to watch
• 31:51
that R. Kelly series even though I knew it was
• 31:53
gonna be disturbing, and it was disturbing, no doubt about it.
• 31:58
It's such a sad state of things when you have
• 32:01
people like this running around the world, and how many
• 32:06
of them are there that we don't even know about.
• 32:15
In all, prosecutors plan to introduce evidence involving nineteen women,
• 32:20
including at least seven who were minors the time of
• 32:23
the alleged misconduct, as well as additional allegations that Kelly
• 32:27
sexually abused a seventeen year old boy he met at McDonald's.
• 32:31
I mean, really, so this guy's running around a prolific molester.
• 32:37
According to the prosecution, boys, girls, it doesn't matter however,
• 32:42
he can get his rocks off this sick fuck. So
• 32:46
there should be a place underneath the prison for people
• 32:49
like this, people like R. Kelly, people like Glaine Maxwell,
• 32:54
people like Keith ray Neary, and certainly people like Jeffrey Epstein,
• 33:02
jurors will hear evidence that Kelly knowingly passed a sexually
• 33:05
transmitted disease to some victims, orchestrated hush payments to others,
• 33:09
and employed a strict system of discipline and psychological manipulation
• 33:14
with victims that in some cases spanned years. Court record.
• 33:18
Show boy, that all sounds familiar. Huh Now, not the
• 33:22
sexual transmitted disease, but all the other stuff. Psychological manipulation,
• 33:28
strict system of discipline and abuse that lasted for years,
• 33:34
tried decades in Epstein's For Epstein's part, decades folks, okay,
• 33:39
seventies at least. Attorneys for Kelly, meanwhile, will be tasked
• 33:45
with poking holes in each of the alleged predicate acts
• 33:48
that make up the racketeering charge, challenging witnesses on their
• 33:52
memories and motives and on the existence of any illegal
• 33:56
enterprise to begin with, legal experts said, and that's would
• 34:00
be the challenge for Maxwell and her team, right, how
• 34:04
would they prove that there was no illegal enterprise? They
• 34:11
can't prove that there certainly was, right, And again, I'm
• 34:16
the reason I am even introducing this right now, we're
• 34:19
even talking about this, So you can look at both
• 34:21
cases and say to yourself, well, why would one get
• 34:25
rico and not the other. What's the difference here? Well,
• 34:31
one has political connections and one doesn't, point blank period.
• 34:41
Among the questions for jurors to sort out, were the
• 34:43
alleged victims really coerced or were they merely fans of
• 34:47
Kelly's who participated willingly? Did they have a reasonable fear
• 34:51
of retaliation for leaving? And in the case of alleged
• 34:55
minor victims, did Kelly actually know they were underage? And
• 34:59
these are all questions that can come up in the
• 35:00
Epstein case as well. Right, Look, the parallels are uncanny.
• 35:04
When you look at the two cases and you see
• 35:07
how R. Kelly went about his business and how Jeffrey
• 35:10
Epstein went about his business, you can see how the
• 35:13
organizations are very similar. Now, one of them was way
• 35:18
higher up in the atmosphere, meaning Jeffrey Epstein's, but they
• 35:22
had the same kind of operational motives, right said, Kelly's
• 35:29
lawyers will clearly have a much tougher time defending this case. Then,
• 35:33
at his last criminal trial in two thousand and eight,
• 35:36
when a Cook County jerry decided they couldn't be sure
• 35:39
Kelly was the man seen in a grainy videotape having
• 35:43
sex with a thirteen year old girl. Nah, it wasn't him.
• 35:45
It was somebody who just looked like him, a grainy videotape.
• 35:49
Technicalities and loopholes, and yet he's let go, and he
• 35:55
continues on his way, continuing abusing people, hurting people, ruining life.
• 36:00
Just like Jeffrey Epstein, there isn't just one thing that
• 36:06
can be explained away, like a sex tape where you
• 36:09
can argue you can't tell who's in it, Grell said
• 36:12
of the charges Kelly now faces. If prosecutors are able
• 36:15
to show this whole scope and pattern of activity, it's like,
• 36:19
come on, it's overwhelming. Yeah, no shit, I'm just a
• 36:23
regular guy, you know, no experience as an investigator, and
• 36:30
I sure the hell put together Eerrico case on Epstein's
• 36:34
go take a look back at the catalog, folks. We've
• 36:36
built the case for them. If they're too lazy to
• 36:38
do it themselves, all they have to do is put
• 36:41
the technical paperwork together. The case is there. The stakes
• 36:48
couldn't be higher for Kelly fifty four, who has been
• 36:51
in federal custody, since his arrest in July twenty nineteen,
• 36:55
and could face decades in prison if convicted. The trial
• 36:59
is scheduled to be in Earnest on August eighteenth with
• 37:02
opening statements and is expected to last more than a month.
• 37:06
See that's the thing with Rico cases too, they can
• 37:08
go on forever, and to build a Rico case takes
• 37:13
years sometimes, Like when you're building a Rico case against
• 37:16
somebody like say John Gotti, it takes years to build
• 37:18
that case, witnesses and tapes and you name it. The
• 37:27
outcome may also give guidance how authorities and other districts
• 37:30
preced in other cases against him, including a pending indictment
• 37:34
in US District Court in Chicago and other charges brought
• 37:37
in Cook County in February twenty nineteen. Long list of accusations.
• 37:44
The allegations against Kelly date back to nineteen ninety one,
• 37:48
two years before his album twelve Play, along with the
• 37:51
number one single Bump and Grind, were released to go
• 37:54
on and sell more than five million copies, and center
• 37:58
around his musical career, both in the studio in Chicago
• 38:02
and while on tour performing at venues across the country.
• 38:06
All the way back to nineteen ninety one. I was
• 38:09
eleven years old in nineteen ninety one. Folks world sure
• 38:14
was a different place back then, But this dude, for
• 38:18
thirty years was able to go on abusing people, molesting children,
• 38:24
raping girls, molesting boys too, I guess, and nobody stepped
• 38:30
up to stop him either. Huh. Now, think about that
• 38:35
for a minute. All R. Kelly had was money in fame,
• 38:38
not political connections, and that money in fame shielded him
• 38:42
for that this long. Now you add the political connections
• 38:46
to it, and you can see how people like Epstein
• 38:50
were able to operate almost with impunity. According to the indictment,
• 38:57
at the height of Kelly's fame, it was standard for
• 39:00
his entourage to issue riskbands to girls some minors attending
• 39:04
his concerts that allowed them backstage access and direct interaction
• 39:08
with Kelly. I can confirm that that happened at concerts.
• 39:11
I mean, I'm not too sure that underage stuff. I
• 39:17
never seen anything like that, honestly, but they definitely did
• 39:20
do that at concerts. You know, they'd go out and
• 39:22
there'd be people who worked for the bands. Their job
• 39:25
would be to wrangle up girls, you know, groupies. They'd
• 39:29
go out to the crowd. They'd pick out some chicks
• 39:31
and bring them backstage and whatever. Whatever. But this is
• 39:36
on a whole other level, going out looking for kids
• 39:39
to bring back, giving kids riskbands. Fuck is wrong with you?
• 39:46
When Kelly identified a girl he wished to see again,
• 39:48
he'd ask for a contact information or direct his associates
• 39:52
to obtain it. The girls were then invited to meet
• 39:55
with Kelly at future shows, with some provided lodging, according
• 39:59
to the charge, And that was all part of it, right,
• 40:02
You know, now you're feeling special. Oh r, Kelly wants
• 40:05
me to come hang out with him. He's gonna get
• 40:07
a hotel room for me. He really likes me, you know,
• 40:10
famous guy, young naive girls. You see the problem here?
• 40:15
You see where this is going. The charges alleged Kelly
• 40:21
had rules for the girls he groomed. They were to
• 40:23
call him Daddy and were not allowed to leave their
• 40:26
rooms unless instructed by Kelly to do so, including to
• 40:29
eat or go to the bathroom. The indictment said, so
• 40:33
this was on another level, right, This was like he
• 40:36
had them enslaved, like they couldn't do shit without his approval.
• 40:40
You can't go eat, you can't go to the bathroom.
• 40:43
You can't do anything unless you ask me. Oh and
• 40:46
by the way, you gotta call me daddy. Uh Hello,
• 40:51
creepy fucking creeper tin and the people around him that
• 40:56
let this occur, all of his close confidants, bunch of
• 41:00
sick fucks, just like Jeffrey Epstein's people. Many survivors allegedly
• 41:06
were videotipped by Kelly are performing sex acts and were slaps, spanked,
• 41:10
or otherwise physically assaulted. Some were told they had to
• 41:13
look at the floor. Others were forced to write letters
• 41:17
containing falsehoods and embarrassing, embarrassing allegations for Kelly to use
• 41:21
at his discretion if and when the need arose. Prosecutors
• 41:25
have alleged so he'd have some compromont on them. Where
• 41:28
do we hear that before? Huh, you have a little
• 41:31
bit of dirt on somebody, It's a lot easier to
• 41:34
mold them to do what you want them to do,
• 41:36
isn't it. So we know Epstein was the king of compromont,
• 41:41
and it looks like R. Kelly had himself some compromont
• 41:43
here as well. One of the survivors central to the
• 41:49
indictment is a Leah Houghton, a one time phenom singer,
• 41:53
referred to the charges as Jane Doe Number one, who
• 41:56
died in a plane crash in the Bahamas in two
• 41:59
thousand and one. Geez, I can't even imagine that. You
• 42:04
think about Aliyah, right, and you know her music and
• 42:07
all of that, and then to think that R. Kelly
• 42:09
sexually abused her. Fucking mind boggling. Aliah met Kelly when
• 42:15
she was just twelve as his protege. She went on
• 42:19
to become a teenage R and B star. Her smash
• 42:22
hit May nineteen ninety four debut album, Age Ain't Nothing
• 42:26
But a Number was produced and written by Kelly. Yikes. See,
• 42:30
this is all stuff I didn't even really know. I've
• 42:32
never honestly, I try not to delve too deep into
• 42:36
this shit besides the Epstein case, because it's also disturbing
• 42:39
to me. I mean, I you know, we live in
• 42:45
a very sick, six sick world filled with very sick people.
• 42:48
Age Ain't Nothing but a number? And it was written
• 42:52
by R. Kelly. Boy that aged well, didn't it? When
• 42:56
you're In nineteen ninety four, Bride the state employee to
• 43:00
create a fake ID for Aliah, showing she was eighteen,
• 43:03
when in fact she was only fifteen. The next day, Kelly,
• 43:06
then twenty seven, married Aliyah in a secret ceremony with
• 43:10
the falsified paperwork. The marriage was later annulled by a
• 43:14
Michigan judge at the insistence of Aliah's family. Wow, imagine
• 43:19
this sick fuck taking advantage of this little girl. Oh,
• 43:23
I'm gonna make you a superstar. I'm gonna make you
• 43:26
the greatest R and B singer of all time, getting
• 43:30
her a fake ida when she's fifteen so he can
• 43:33
marry her. I hope R Kelly fucking rots at the
• 43:37
bottom of the prison. Prosecutors have said a witness will
• 43:44
testify that Kelly had secretly arranged the marriage after he
• 43:47
got her pregnant and wanted to shield himself from criminal charges.
• 43:51
Oh more arranged marriages. Huh boy, There sure are a
• 43:54
lot of parallels here. There sure are a lot of parallels. Meanwhile,
• 44:03
Kelly's former tour manager, Dimitrius Smith, said in the Surviving R.
• 44:07
Kelly documentary that he'd arranged the forged documents for Kelly
• 44:11
and was one of a handful of people present at
• 44:13
the small ceremony in the Chicago suburb of Rosemont. So
• 44:18
basically what you're telling, was Dimitrius Smith, is that your
• 44:22
job was more important than these young girls' lives. Keeping
• 44:25
your job was more important than calling out your bitch
• 44:29
ass boss or serving them up that three piece with
• 44:32
the soda. You were there and you didn't stop it.
• 44:38
You knew this girl's fifteen. You're letting this motherfucker marry her.
• 44:44
It was just a quick little ceremony. She didn't have
• 44:46
on a white dress, he didn't have on a tuck,
• 44:48
said Smith, who later told media outlets he's been subpoena
• 44:51
to testify in Kelly's criminal case. Just every day where
• 44:55
she looked worried and scared. Oh that's nice. So you're
• 44:58
at a wedding and you know this is little girl.
• 45:00
She looks worried and scared, but you still take part. You,
• 45:03
my friend, are a piece of shit as well. Another
• 45:09
alleged survivor, who met Kelly at a mall in two
• 45:11
thousand and three when she was in her early twenties
• 45:14
and working as a radio station intern, is expected to
• 45:17
testify that she was invited to interview Kelly at a
• 45:20
Chicago music studio where she was forced to sign a
• 45:24
non disclosure agreement before being locked in a room without
• 45:27
sustenance for three days. What the what? So I show
• 45:32
up to interview you and I get locked in a
• 45:34
room for three days with no sustenance? Where are her people?
• 45:37
Where's her boss? Her friend's her family? Her boyfriend? I
• 45:41
got news for you. Somebody locks carry up, somebody somewhere.
• 45:45
I'm showing up. You better believe it, and I'm not
• 45:48
going to be alone. Fuck you mean you had her
• 45:51
locked up for three days and nobody shows up. After
• 45:57
a member of Kelly's entourage finally gave her something to drink,
• 46:00
she became tired and dizzy and passed out. The indictment
• 46:03
alleged she woke up sometime thereafter to Kelly with her
• 46:07
in the bedroom in circumstances that made it apparent that
• 46:12
he had sexually assaulted her while she was unconscious. Prosecutors alleged,
• 46:16
so did they give her something to make her pass out?
• 46:19
Some kind of drug or something like that? Doesn't make
• 46:23
any sense, But the fact of the matter is this R.
• 46:26
Kelly and the people around him were sick fucks and
• 46:29
they all deserve to be charged with RICO. The only
• 46:32
thing I'm wondering is where's the rico for? Say it
• 46:36
with me in the back folks. Epstein and his crew
• 46:43
also expected to testify as an alleged male survivor of
• 46:46
Kelly's identified as John Doe number one, who says he
• 46:50
was sexually abused as a teen after meeting Kelly in
• 46:52
December two thousand and six at an unspecified Chicago McDonald's
• 46:58
prosecutors alleged in a recent court filing that Kelly invited
• 47:01
the boy to a party at his Chicago residence, but
• 47:04
when the boy brought his parents, Kelly advised him to
• 47:07
come without them to the next gathering. Oh yeah, sound
• 47:10
doesn't sound terrifying or anything. It's not a red flag. Hey, mom, Dad,
• 47:15
next time I go to R. Kelly's house, you're not
• 47:17
allowed to come? What what'd you just say to me?
• 47:20
I'm not allowed to do? What? Well, guess what, You're
• 47:23
never going there again? How about that? Fuck? Does that
• 47:26
mean you can't bring your parents? I think that would
• 47:29
be a red flag for parents out there. No. Kelly
• 47:35
also asked John Doe one what he was willing to
• 47:38
do to succeed in the music business and clarify that
• 47:41
he wanted John Doe number one to engage in sexual
• 47:44
contact with Kelly. Prosecutors alleged with that backdrop, Kelly then
• 47:49
engaged in sexual contact with John Doe. Number One. Prosecutor
• 47:54
said Kelly also forced the boy to have sex with
• 47:57
females as Kelly videotaped the acts. Yo, this guy is
• 48:02
shaping up to be quite the fucking scumbag. Huh. So again,
• 48:08
every single charge you could possibly hit him with, I
• 48:11
say do it. If there's more charges besides RICO hit
• 48:14
him with those two People like this do not deserve
• 48:17
to breathe the same air as the rest of us, folks.
• 48:20
There's no rehabilitating somebody like R. Kelly or Jeffrey Epstein
• 48:26
Rico creativity. The case against R. Kelly is just the
• 48:30
most recent example of federal prosecutors in New York's Brooklyn
• 48:34
office using the RICO law and rather inventive fashion. Legal
• 48:38
experts told the Tribune, Oh, that's nice. So everybody's getting
• 48:42
rico's but Jeffrey Epstein. Huh, we're hands in them. Mount
• 48:45
everybody like Candy, but Epstein and his boys, Nah, no
• 48:49
Rico for them. It's very frustrating, folks, very very frustrating.
• 48:57
In twenty fifteen, the office announced an indictment that rocked
• 49:00
international Sports, charging fourteen defendants with racketeering, wire fraud, and
• 49:06
money laundering conspiracies in connection with FIFA, the worldwide governing
• 49:11
body of soccer. And those are some of their favorite
• 49:15
RICO predicates. Boys and girls, let me tell you, racketeering,
• 49:19
wire fraud, and money laundering. Didn't I I've talked about
• 49:21
all of those before here, haven't I. I think I've
• 49:24
seen those charges. In fact, look, those are some of
• 49:28
the most basic REGO charges, and they're definitely predicates that
• 49:33
they slam people with. Perhaps the closest analog to the
• 49:40
Kelly case, according to one expert, was a successful RICO
• 49:43
prosecution of the Upstate New York group Nexium, a cult
• 49:48
like organization that purported to be a self help group.
• 49:51
A federal Jerry and Brooklyn convicted leader Keith Rayniery on
• 49:55
charges including racketeering and sex trafficking in June twenty nineteen,
• 50:00
the month before the RICO indictment against Kelly was unveiled.
• 50:05
Rayniery was sentenced to one hundred and twenty years in prison.
• 50:12
Paging Maureen Comy, Hello, Maureen Comy, you have precedent all
• 50:18
over the place. What are you doing? When are we
• 50:21
going to get a superseded indictment here? When is Maxwell
• 50:24
going to get smacked with Rico charges? Randy D. Gordon,
• 50:29
executive professor at Texas A and M University Law School
• 50:32
who has extensively studied RICO, said the Nexium sex cult
• 50:36
had a concrete organizational structure reporting to Rayniery, while the
• 50:41
enterprise Kelly allegedly led appears far looser one hundred percent.
• 50:45
And that's my point exactly. If you're gonna hit r.
• 50:48
Kelly with RICO, and you should, Jeffrey Epstein and his
• 50:51
people should be slap with it too. It's an ironclad
• 50:54
Rico case, folks, iron clad. If Epstein's last name was Gambella,
• 51:03
forget it. We're not even thinking about a traditional prostitution
• 51:10
ring though this is the sort of this is sort
• 51:13
of within that space of sex trafficking, Gordon said. From
• 51:16
the defendant's perspective, I suppose he can argue that the
• 51:20
alleged enterprise is too a MorphOS and ill defined, he said,
• 51:24
I still think the government has the better argument on
• 51:27
the issue of whether the alleged enterprise is just disguised
• 51:30
allegation that Kelly is the enterprise. Look again, the similarities
• 51:38
in this case, no doubt. But what Epstein did was
• 51:40
on such a larger scale and spanned intercontinentally. It was
• 51:46
government officials involved, magnates of business involved. But he doesn't
• 51:50
get slapped with RICO. Okay, I guess we'll just accept it.
• 51:57
That's a topic that Kelly's Chicago based defense team, which
• 52:00
has since been severed from the case, tried to raise
• 52:03
an emotion to dismiss last year, arguing the charges failed
• 52:07
to specifically name any co conspirators, which is unusual for
• 52:11
a RICO case. See again, there is more for a
• 52:17
RICO case in the Epstein situation than any of these
• 52:19
other ones. That's why it makes me so mental. That's
• 52:22
why I've got to scream about it from mountaintops pretty
• 52:25
much every day. Robert Kelly is not an enterprise. Attorney.
• 52:32
Stephen Greenberg wrote an emotion at the time, RICO was
• 52:35
not designed as a means to punish a single individual
• 52:38
for his own wrongful actions. That's exactly that's true. It's
• 52:41
not it was meant to punish people who had leadership
• 52:45
roles at the top of these organizations. So you're boy
• 52:48
r Kelly, Jeffrey Epstein, Gallainne Maxwell, those people. US District
• 52:55
judge and Donnelly denied the motion in May twenty May
• 52:59
of twenty two, saying it was up to the jurors
• 53:01
to decide. G Robert Blakey, who helped draft the Rico
• 53:05
statutes decades ago, said a case like Kelly's was not
• 53:09
quite what he pictured when writing the law, but over
• 53:11
the years the statute has proven to be extraordinarily flexible. Yeah,
• 53:16
that's one way of saying that they've used it to
• 53:19
hamstring plenty of people in this country throughout the years.
• 53:25
To prove their case, prosecutors must show that the enterprise
• 53:28
went beyond just Kelly himself, said Blakey, now a Professor
• 53:32
emeratus at Notre Dame's Law School. But they don't necessarily
• 53:36
have to prove a sophisticated mafia like structure existed under him.
• 53:41
Case law has held that the enterprise must only be
• 53:44
as organized as a pickup basketball game, Blakey said, and
• 53:48
Kelly's indictment more than meets the elements of a Rico case.
• 53:51
Bing bang boom case point, everything sold down the river.
• 53:56
It's all over and done with the guy who wrote
• 53:57
the law even just told you what recas' supposed to be. Now,
• 54:01
if Jeffrey Epstein and his organization don't fit those parameters,
• 54:04
I don't know what does. While they're playing the game,
• 54:11
you know the center is, you know who the center is,
• 54:14
and you know who the guards are. Everybody knows where
• 54:17
the basketball court is. Everybody knows to play on that court,
• 54:20
and the game goes on even though the people playing
• 54:23
it change over time. That's just like the mob, he said.
• 54:26
Can you identify roles in the group that was around
• 54:29
Kelly and did it have a reasonable long long? Was
• 54:32
it around for a reasonably long time? It's got to
• 54:35
be more than a weekend. It's gotta be years. Every parameter,
• 54:40
every box mark checked, everything ticked off. How in the
• 54:47
fuck is Maxwell not slap with rico. Stephen Block, a
• 54:55
former federal prosecutor in Chicago, said, it's likely the government true.
• 55:00
We considered Kelly to be by far the most culpable person,
• 55:03
and that is who they wanted to focus their efforts on.
• 55:06
It could be that other members of the enterprise are
• 55:09
cooperating with law enforcement, and we might find out at
• 55:12
a later time they were charged with indictments under seal,
• 55:15
Block said, and again that's something that is possibly happening
• 55:20
in the Epstein case as well. We don't know what's
• 55:22
happening under seal right now. We don't know who's getting
• 55:26
indicted or anything like that, So that's all up in
• 55:30
the air still. We'll find out later on, obviously, but
• 55:36
right now, who knows what's going on behind the scenes. Grell,
• 55:42
the RICO expert from the University of Minnesota, agreed that
• 55:45
while some of Kelly's alleged enablers could have faced federal
• 55:49
charges of their own, the singer was the true target
• 55:52
in this situation. The primary goal is to cut the
• 55:55
head off of the snake. He said, Well, folks, there
• 55:59
you go. R. Kelly facing some serious RICO charges, and
• 56:03
the question remains, when is Epstein going to face the
• 56:09
same kind or I should say Epstein's remaining criminal remnants
• 56:14
of his enterprise, namely Glenn Maxwell, because when you look
• 56:20
at the Nexium case, when you look at R. Kelly's
• 56:22
case and you put him side by side and compare
• 56:25
them to the Epstein case, there is no way that
• 56:28
both of those people should be charged with racketeering and
• 56:31
Maxwell not. So we'll see it's almost November. We're getting
• 56:36
closer to the trial, and who knows if the Government's
• 56:40
going to hit them with RICO. But I'll tell you what,
• 56:45
All of the parameters are met, and now it seems
• 56:50
to be just a matter of the government not having
• 56:55
the spine to go all the way. If you'd like

• 57:17
All of the links that go with this episode can
• 57:19
be found in the description Boxy. Tonight, we're going to
• 57:23
talk about Nexium a little bit and just a quick overview.
• 57:27
Nexium was this supposed self help group that was really
• 57:31
a sex trafficking operation, a money laundering operation, and just
• 57:35
basically a criminal enterprise. And it was led by Keith
• 57:39
Rayniery and the actress from the show Smallville, Allison mack. Now,
• 57:45
they both ended up getting charged with racketeering charges RICO charges,
• 57:51
and these were the charges and the template that was
• 57:54
used to go after Nexium and to eventually bring the
• 57:58
whole entire operation to its need. Now, the reason I'm
• 58:02
going to talk about this tonight, is because this shows
• 58:05
you that there's a blueprint already out there for dealing
• 58:08
with organizations like Jeffrey Epstein's and utilizing tools like RICO
• 58:15
to do just that. Now, Keith ray Neery was rich
• 58:20
and had powerful friends, there's no doubt about it. But again,
• 58:24
just like with Weinstein, he didn't have the protection from
• 58:29
whatever you know, intelligence agency you want to insert here,
• 58:32
there's several that you can insert, right, So he wasn't
• 58:35
afforded that protection. So he was, you know, acting. Maybe
• 58:40
the state prosecutors would look the other way because he
• 58:43
was rich, right, they wouldn't be so hard on him.
• 58:45
But when it's a parent like what happened with Nexium
• 58:49
and people start ratting on you, et cetera, et cetera,
• 58:52
there's no way for them to provide cover for you. Now,
• 58:56
in the Epstein case, what they were able to do
• 58:59
was they were able to provide cover for the co
• 59:02
conspirators with the immunity deal. Right, the very silly immunity
• 59:10
deal that Epstein got that covered co conspirators as well. Well.
• 59:14
Rayniery was never going to get something like that. There
• 59:16
was zero chance that Keith Rayniery or Alison Mack or
• 59:20
the Bromfman's were ever ever going to be afforded the
• 59:24
same sort of leniency that Epstein was, And that can
• 59:28
only be for the one simple reason. Right, Obviously, we
• 59:33
all know that Epstein was an asset of the intelligence
• 59:37
community at this point. That's what all the evidence points to.
• 59:41
And the fact that we keep reading about all of
• 59:43
these other people, high profile people that have just as
• 59:46
much money, if not more than Epstein, who get taken
• 59:49
down in these sort of rings all the time and
• 59:52
they end up doing actual jail time. Well, for some reason,
• 59:56
Jeffrey Epstein and his co conspirators they were able to skate.
• 59:59
They never had worry about any of that. So in
• 1:00:02
tonight's article, we're going to talk about Nexium and their downfall,
• 1:00:07
and obviously the most important aspect that has drawn me
• 1:00:11
to this case and brought it brought it to you know,
• 1:00:14
the forefrontier on the podcast is the racketeering angle, and
• 1:00:18
that's what I want everybody to focus on here. I
• 1:00:20
know we don't stray very often from the actual Epstein case,
• 1:00:24
but I believe this provides a good blueprint for how
• 1:00:28
the prosecution could deal with Jeffrey Epstein's remaining co conspirators
• 1:00:33
going forward. So this article is from the Cut and
• 1:00:40
it was authored by Amanda Arnold and the headline is
• 1:00:44
Nexium founder Keith Rayniery found guilty on all counts And
• 1:00:49
this article was produced on June nineteenth of two thousand
• 1:00:53
and nineteen, just over a year after being arrested on
• 1:00:58
suspicion of running a sett Nexium founder Keith Raynier has
• 1:01:02
been convicted. On Wednesday, jurors in Federal District Court in
• 1:01:06
Brooklyn found Rayniery guilty on all seven criminal charges against him,
• 1:01:10
including sex trafficking and racketeering. That's rico, my friends. The
• 1:01:16
New York Times reports, while Nexium purported to be a
• 1:01:20
self help organization, federal prosecutors say that it was instead
• 1:01:23
a front for a sex cult. They say manipulated women,
• 1:01:27
subject subjected them to ritual humiliations, monitored their their calorie intake,
• 1:01:33
and branded them with Rainieri's initials. Sounds like a real
• 1:01:37
hell of a guy, huh. Sounds like the sort of
• 1:01:39
fella that you would love for your daughter to be
• 1:01:41
hanging around. Actually, sounds like somebody that you would find
• 1:01:45
in polite New York society. Oh guess what, that's where
• 1:01:47
he used to hang out. Shocking. I know, I know
• 1:01:49
you're all shocked by that. At this point, with his
• 1:01:53
inner circle, he was the ruler in his universe. Who
• 1:01:56
does that sound like, folks? Does that sound like our
• 1:01:58
good friend Jeffrey Epstein, the ruler of his own universe?
• 1:02:03
That is the perfect description, because that's what Epstein felt
• 1:02:06
he was as well, right anytime that anyone was in
• 1:02:08
his atmosphere, they were his to do with as he pleased.
• 1:02:12
And we see that with people like Keith Rayinniery as well.
• 1:02:15
There are a lot of power parallels with this nexium case,
• 1:02:19
a lot of parallels, and I've meant to get to
• 1:02:21
this earlier, but now that we were talking about Rico
• 1:02:24
last night, I figured that's a great segue into this
• 1:02:27
so that we can see the parallels and the eventual
• 1:02:30
blueprint for how rainier he was taken down. Prosecutor Morapenza
• 1:02:36
told jurors during her closing statement, a crime boss with
• 1:02:39
no limits and no checks on his power. Boy, that
• 1:02:43
sure describes Jeffrey Epstein. Huh wouldn't it be nice if
• 1:02:46
the prosecutors would use such strong language in regards to
• 1:02:50
Jeffrey Epstein, wouldn't that be nice? What differentiates him from
• 1:02:55
Keith Rainiery or Weinstein? Why would they go so hard
• 1:03:00
and go after these men and use every trick at
• 1:03:04
in their disposal, every piece of artillery in their disposal,
• 1:03:08
and slap the rico charges on. But they didn't do
• 1:03:10
that against Epstein. What are they hiding? What are they
• 1:03:13
scared that they'll uncover? Rainieri's lawyers had argued that the
• 1:03:18
sexual acts in which Rayniery was involved were consensual. That
• 1:03:23
sounds familiar, doesn't it, and that women join nexium of
• 1:03:26
their own volition. Oh yeah, exactly right. That's exactly what
• 1:03:30
happened with all of the high school girls from with
• 1:03:31
Jeffrey Epstein too. That was exactly what they wanted to
• 1:03:34
do at fourteen years old, be molested by his ugly ass.
• 1:03:37
That's exactly what occurred. During lawyer Mark Agnafilo's closing statement,
• 1:03:44
he said, of Rainiery, you might find a lot of
• 1:03:46
things about him distasteful. Yeah, that's putting it lightly, but
• 1:03:50
most of them aren't part of the charges. Yeah, right,
• 1:03:53
bro give me a break. This guy was full on
• 1:03:55
involved in laundering money, was full on involved in fraud,
• 1:04:00
was full on involved in sex trafficking, you name it.
• 1:04:03
This guy was involved in it, just like our boy
• 1:04:06
Jeffrey Epstein, but to a smaller degree. Right, this guy
• 1:04:09
wasn't on Jeffrey Epstein's level when it comes to running
• 1:04:12
in the power circles that Epstein ran in, or at
• 1:04:15
the levels of Jeffrey Epstein's trafficking ring. And yet they
• 1:04:20
pulled out all the stops and slapped him with conspiracy charges,
• 1:04:23
slapped him with racketeering charges. But no one in the
• 1:04:27
Epstein enterprise or the Epstein organization as I like to
• 1:04:31
call them at this point were slap with rico charges.
• 1:04:34
None of them got slapped with forfeiture and seizure of
• 1:04:37
their property. Why just that's the question that needs to
• 1:04:41
be answered. And until somebody can give me a logical
• 1:04:44
answer on why Epstein was given beneficial treatment as opposed
• 1:04:49
to these other billionaires and other power players, there is
• 1:04:52
only one answer, folks, and the evidence has led us
• 1:04:54
there from the very beginning. Since early May, former high
• 1:04:59
ranking Nexium member and sex slaves have taken the stand
• 1:05:02
to deliver harrowing testimonies against Rayniery, with particular focus on
• 1:05:07
dos A hierarchical group comprised of masters and slaves. And
• 1:05:12
you see, this is what I'm talking about. The low
• 1:05:15
level folks in the organization were forced to turn on
• 1:05:18
the higher level folks because of the rico charges, the
• 1:05:21
conspiracy charges, the racketeering charges. Once you're looking at twenty
• 1:05:25
these racketeering charges, if they go all the way to
• 1:05:28
the you're looking at twenty years, twenty years per charge.
• 1:05:32
We're not talking about twenty years. Concurrently, each one of
• 1:05:34
these charges is gonna carry twenty years, and they're gonna
• 1:05:36
go for the gusto. This is the federal government. They
• 1:05:39
love to do that shit. So if you think that
• 1:05:42
that's not a motivating factor, and having these people start
• 1:05:45
rolling over on each other and ratting each other out,
• 1:05:48
you see it right here. These people are not built
• 1:05:50
for this life. They're not from the streets. They don't
• 1:05:52
live by the street code, if there is even that
• 1:05:55
these days, right, But as far as being rats, they
• 1:05:59
don't care about that. They're gonna rat on their friends
• 1:06:01
and then they're gonna go right back to the marina,
• 1:06:03
or right back to Martha's vineyard or wherever the hell
• 1:06:05
these rich people are hiding in their Heidi holes when
• 1:06:08
they're sex offenders. But for normal people, you rat there's
• 1:06:13
gonna be consequences, right, So these people were never built
• 1:06:16
for this life in the beginning from the jump. These
• 1:06:18
people were you know, brought in by promise of wealth.
• 1:06:25
Some of them just wanted to belong et cetera, et cetera.
• 1:06:28
But when you start throwing the rico charges around like
• 1:06:30
they did in this case at the lower level people involved,
• 1:06:34
you're gonna start racking up the arrests, and not only
• 1:06:36
the arrests, you're gonna get the indictments, and you're gonna
• 1:06:40
get a lot of plea deals. A lot of these
• 1:06:42
low level people are gonna get off of two, three,
• 1:06:44
four years, right, and of course we want some of
• 1:06:47
them to do a lot more time than that. But
• 1:06:49
if their testimony helps nail people that were in charge
• 1:06:53
in leadership positions, then it's always acceptable to trade, in
• 1:06:57
my opinion, a low level operator for one of the
• 1:07:00
big head honchos who were behind the leadership role, who
• 1:07:03
were behind the decision making, who were you know, basically
• 1:07:07
the Corps four in Gilain Maxwell and Jean Luke Brunell
• 1:07:10
at this point. So what you have to do is
• 1:07:12
start rounding everybody up, slam everybody with the rigo charges,
• 1:07:16
and you get the results that we see here. In
• 1:07:22
one testimony, a former slave claim that Raynieri blindfolded her
• 1:07:26
and permitted another woman to sexually assault her, just like
• 1:07:30
Jeffrey Epstein with Nadia Marsonkova. Right, We've seen this mo
• 1:07:33
o from Epstein as well. Another woman testified that Raynieri
• 1:07:37
took photos of her that mostly featured her vagina. Again,
• 1:07:42
just like Jeffrey Epstein, all of the pictures. He has
• 1:07:46
to take a trophy. He has to have a trophy
• 1:07:48
from every one of his conquests. That's how these sick
• 1:07:51
people operate. Even before Rainieri's trial started, the five other
• 1:07:57
people charged for their alleged and volution inexium, including Smallville
• 1:08:02
actress Alison Mack, who admitted in court to being a
• 1:08:05
leader in the Secret Master Slaves a sorority, pleaded guilty
• 1:08:08
to the racketeering charges against them. Look, I'm telling you
• 1:08:12
right now, folks, I am telling you as sure as
• 1:08:14
we're sitting here right now. When you start getting racketeering
• 1:08:18
charges thrown at you, it is the end for you.
• 1:08:21
R Kelly got Rico charges thrown at him as well.
• 1:08:25
So again, if it's good for if it's good enough
• 1:08:27
for r. Kelly, why is it not good enough for
• 1:08:28
Jeffrey Epstein. Now you see, as I just pointed out here,
• 1:08:33
that Alison Mack right away pleaded guilty to the racketeering
• 1:08:36
charges because each of them hold a twenty year sentence
• 1:08:39
and she wants not She wanted nothing to do with that.
• 1:08:41
She's hoping that her cooperation against dray Neery will get
• 1:08:46
her a lesser sentence. And look, again, that's a situation
• 1:08:53
where I don't believe that either of them should get
• 1:08:55
a light sentence. I look at Alison Mack and Keith
• 1:08:57
Rayniery kind of like Epstein and Gulayne right the two
• 1:09:00
heads of the organization, both in leadership roles, and both
• 1:09:04
people must pay for what they have done. But you see,
• 1:09:08
once you see the racketeering charges come out, you start
• 1:09:11
seeing plea deals across the board, and people start cooperating
• 1:09:15
because nobody is built for that twenty year life in
• 1:09:17
federal prison. I'm very sorry for the victims of this case,
• 1:09:22
Max said during her guilty plea. I'm very sorry for
• 1:09:26
who I have hurt through my misguided adherence to Keith
• 1:09:29
Rainiery's teachings. Now Rainieri awaits this sentencing, which is scheduled
• 1:09:35
for September, he faces life in prison. So look, that's
• 1:09:39
the blueprint right there. I'm telling you right now that
• 1:09:42
the Rico angle is the way to go after these people.
• 1:09:45
And if you use that Rico angle properly, you're going
• 1:09:49
to be able to get not only arrests in this case,
• 1:09:53
you're gonna get convictions because there's no way, zero chance
• 1:09:57
any of these people Vicars or or or Crow or
• 1:10:04
Adriana Ross or any of these girls are Marson Kova
• 1:10:09
are going to be able to stand up tall and
• 1:10:11
not rat on their friends when they're looking at these
• 1:10:14
these sort of racketeering charges, because this is this is
• 1:10:18
serious business. We're talking about twenty years per charge. And
• 1:10:21
you see how quickly Alison Mack was willing to just say,
• 1:10:24
you know what, I'm going to just plea. I'm going
• 1:10:26
to take the plea deal and I'm going to cooperate
• 1:10:29
against Keith Rainiery and hope that you know, things work
• 1:10:33
out in the way. I hope they work out, because
• 1:10:35
at this point, when you're somebody like Mac in a
• 1:10:38
leadership role, you're up against it right, you have no,
• 1:10:41
you don't have a pot to pisson, as they say,
• 1:10:44
you're really up against it, and you're gonna be the
• 1:10:46
one that's going down, especially in these leadership roles, because
• 1:10:50
all of your little henchmen are going to start rolling
• 1:10:53
over on you on a regular basis, one after the other,
• 1:10:57
because they don't want to do that federal time. It's
• 1:11:00
pretty obvious, right, Look, these people are quick to roll
• 1:11:06
over on each other, even in criminal enterprise these days.
• 1:11:09
I'm talking about hardened criminals. So if you think that
• 1:11:12
these girls aren't going to start singing like mockingbirds, I
• 1:11:16
have news for you. They're going to because there is
• 1:11:21
there's the blueprint. The blueprint is right here. Here is
• 1:11:24
the blueprint right here on how to go after Jeffrey
• 1:11:26
Epstein and his co conspirators as well, because I'm telling
• 1:11:29
you right now, they will start ratting on each other
• 1:11:35
the second they get these racketeering charges thrown their way.
• 1:11:41
All right. So there's also another article from a publication
• 1:11:45
called Art Voice, and this was published on June sixteenth
• 1:11:50
of twenty eighteen, and it's by an attorney from Albany
• 1:11:56
that goes by a pseudonym. All Right, So the headline is,
• 1:12:01
let's get fact straight about RICO as it relates to
• 1:12:04
Alison Mack and Keith Rayner's case. So what this does.
• 1:12:08
It's going to show you how RICO is useful in
• 1:12:12
a case like Nexium and in the Jeffrey Epstein case
• 1:12:16
as well. Let's get a few facts straight about RICO.
• 1:12:20
The overall purpose of the RICO statute is to allow
• 1:12:23
for the prosecution of criminal acts that are committed as
• 1:12:26
part of an ongoing criminal organization. Check. We know that
• 1:12:29
that was occurring in the Jeffrey Epstein case, right, We
• 1:12:32
know for a fact that that was occurring. We had
• 1:12:34
all the money laundering going on. We had the actual
• 1:12:37
human trafficking aspect, we had the tampering with witnesses, we
• 1:12:41
had the paying off of witnesses, et cetera, et cetera.
• 1:12:45
In practice, a RICO prosecution usually focuses on the leaders
• 1:12:49
of a criminal organization who order illegal acts to be committed,
• 1:12:53
and allows those leaders to be prosecuted for those illegal acts. Example,
• 1:12:58
if the leader of a criminal organisation orders a member
• 1:13:01
to murder someone else and the murder is carried out,
• 1:13:04
the leader, along with the member who actually committed the
• 1:13:07
crime can be prosecuted for murder. And that's what RICO does.
• 1:13:12
It bypasses all of the defenses put into place for
• 1:13:15
people like Jeffrey Epstein, and it allows the prosecution to
• 1:13:19
manhandle him and to go in there and really start
• 1:13:22
slapping people around. And I'm telling you right now, this
• 1:13:26
is a huge deal, a huge weapon. It's a bazuka.
• 1:13:30
It is a bazuka, and they need to use it.
• 1:13:35
Rico prosecution or prosecutions are based on alleged i legal
• 1:13:38
acts that constitute at least one of a list of
• 1:13:41
twenty seven federal crimes or eight state crimes. These are
• 1:13:45
called predicate offenses, and of relevance to Nexium and its leaders.
• 1:13:49
They include such things as blackmail check for us in
• 1:13:52
Epstein right, bribery, another check for the Epstein case, extortion,
• 1:13:57
check for the Epstein case fraud, whoa, what do you know?
• 1:14:00
Another check for the Epstein case money laundering? Ding ding ding,
• 1:14:03
we have a winner. Another check for the Epstein case. Slavery.
• 1:14:07
Oh well, there you go. Another one in the in
• 1:14:10
the in the column of yep that happened in the
• 1:14:12
Jeffrey Epstein case. Theft, Yeah, we got that too. Bringing
• 1:14:16
in aliens to the US. You know, how about some
• 1:14:19
you know, fourteen year old triplets or Nadiam Marsonkova or
• 1:14:22
et cetera, et cetera. Got that as well, huh? Or
• 1:14:27
or and bringing in aliens to the US or helping
• 1:14:29
them enter for financial gain. Ding ding ding ding ding
• 1:14:32
ding ding. We have a winner. You get a car.
• 1:14:34
You get a car. Everybody gets a car. I mean,
• 1:14:36
are you kidding me? This is this is everything that
• 1:14:39
they slapped next to them with applies to Jeffrey Epstein
• 1:14:43
as well. In order for RICO to be invoked, the
• 1:14:49
defendant must have participated in at least two qualifying criminal
• 1:14:53
acts within a ten year period, and the axe must
• 1:14:56
be related to one another. So that would mean the
• 1:14:59
money launder as well as bringing people in from a
• 1:15:03
foreign country and have it connected. And that's very easy
• 1:15:05
for the investigators to do. For the prosecution to do,
• 1:15:08
all you need is a couple of competent forensic accountants
• 1:15:11
and its money in the bank. In this case, for
• 1:15:13
Jeffrey Epstein, this is a zero doubt about that. When
• 1:15:17
a RICO case is initiated, the prosecution can seek a
• 1:15:20
pre trial restraining order or injunction that temporarily freezes the
• 1:15:24
defendant's assets. Well what do you know, how what have
• 1:15:28
I been talking about for months now? And or seek
• 1:15:32
to have the defendant post a substantial performance bond. Either
• 1:15:36
of those actions can make it difficult for a defendant
• 1:15:38
to access the funds they need to hire a defense attorney.
• 1:15:42
Looks like Claire has already gotten around this by establishing
• 1:15:45
trust to pay defense attorneys for her and others. But
• 1:15:48
you see how that's important, right. It's one another tool
• 1:15:51
for the government to make life difficult for people that
• 1:15:54
are getting slapped with RICO charges. And it again, everything
• 1:15:58
that they use against Nexium applies to the Epstein criminal
• 1:16:02
operation as well. So make sure you're asking yourself as
• 1:16:06
we're going through this. Never keep the question far from mind.
• 1:16:09
Why was Epstein afforded protection that nobody else was afforded.
• 1:16:15
Anyone convicted under RICO can be fined up to twenty
• 1:16:18
five thousand dollars and sentenced to twenty years in federal
• 1:16:21
prison per count. Now you see why it's such a
• 1:16:24
dangerous law per count, boy, oh boy. In addition, they
• 1:16:30
can also be ordered to forfeit all ill gotten gains
• 1:16:33
and pay treble damages all ill gotten gains. And that
• 1:16:38
again is where the forensic accountant would come in. That's
• 1:16:40
definitely above my pay grade. I wouldn't know how to
• 1:16:42
chase that money down, but I sure as shit can
• 1:16:44
tell you. That's how it all works. That's how these
• 1:16:46
people go after it. That's how they do it. And
• 1:16:49
remember what I told you earlier. If you follow the drugs,
• 1:16:52
you're gonna end up at a drug dealer's house. If
• 1:16:55
you follow the money, you're gonna end up at the
• 1:16:57
distributor's house. RICO also has a civil component that allows
• 1:17:05
individuals to bring RICO actions against the leaders of criminal organizations.
• 1:17:09
Successful plaintiffs may also be awarded trebled damages. You can
• 1:17:13
pretty much count on this happening after the criminal trials
• 1:17:16
are over. So again, not only do they have the
• 1:17:19
survivors have RICO at their fingertips when it comes to
• 1:17:23
these people being prosecuted afterwards, they can use the RICO
• 1:17:26
civil statutes as well and go after them civilly. In
• 1:17:32
addition to the federal RICO Statute, a major a majority
• 1:17:35
of states has also enacted their own RICO statutes. New
• 1:17:38
York is one of those states. These state statutes generally
• 1:17:42
expand the list of underlying crimes that can be used
• 1:17:44
as the basis for bringing a Rico prosecution. They're making
• 1:17:48
it real damn easy to bring Rico charges and yet
• 1:17:51
we don't have any. And yet Berman has nobody brought in.
• 1:17:54
They're not shaking any trees, not kicking over any ants,
• 1:17:58
any these high Nope, nothing, just running around acting like
• 1:18:03
you know, the calling Prince Andrew out, acting like they're
• 1:18:05
actually doing something, but in reality there's no movement. Right,
• 1:18:09
let's go, let's get busy, mister Berman, or are you
• 1:18:12
going to get undercut by Denise George and the Virgin Islands?
• 1:18:15
Because at this point she seems like the more likely
• 1:18:18
of the two to really pursue this and to really
• 1:18:20
go after these people. So are Rico prosecutions a possibility
• 1:18:25
as regards to the leaders of Nexium, of course, will
• 1:18:29
the Feds go that route, We'll have to wait to
• 1:18:32
find out. And we know that they did go that route.
• 1:18:34
We know that they did get charged and found guilty
• 1:18:38
on the accounts of racketeering, they pled guilty, et cetera,
• 1:18:41
et cetera. If the FEDS decide to indict Claire and
• 1:18:46
or Sarah Bronfman, they might attempt to level the playing
• 1:18:49
field by couching the case as a RICO prosecution and
• 1:18:52
seek to freeze at least some of their assets, but
• 1:18:55
they could just as easily charge them under a variety
• 1:18:58
of federal criminal statutes and or make referrals to state prosecutions.
• 1:19:02
The latter probably won't happen until there's a district attorney
• 1:19:05
in Albany County or Saratoga County that hasn't been compromised
• 1:19:09
or corrupted by nexium, and that ends today's overview on RICO.
• 1:19:15
There you have it, folks. Now, I'm not a legal professional,
• 1:19:20
certainly not a lawyer, you know, I don't even pretend
• 1:19:22
to know the you know, the statutes and all of
• 1:19:25
the laws or anything like that. But one law I
• 1:19:27
do know is RICO. I've seen it wielded by the
• 1:19:30
federal government on people that I care about. I know
• 1:19:32
exactly how they roll. And the fact that they're not
• 1:19:35
using the Rico statutes to go after Epstein's co conspirators
• 1:19:39
it just again, it leaves a stench of stink hanging
• 1:19:43
over the case, because if they were serious about justice,
• 1:19:46
if they were serious about bringing these people down, then
• 1:19:49
they would slap them with these Rico charges and the
• 1:19:51
ball would get rolling and it would be game on.
• 1:19:57
So I wanted to, like I said, I wanted to
• 1:19:59
talk about this Nexium a little bit tonight. That way
• 1:20:02
we could see the parallels between the two and see
• 1:20:05
how RICO is applicable in the Epstein case as well
• 1:20:08
as this Nexium case. So hopefully this gave you a
• 1:20:12
little bit more of an idea, a bit of an
• 1:20:14
overview about what RICO is and how it can be used.
• 1:20:17
And I know there's been some confusion and some people,
• 1:20:20
you know, not too sure what the laws are or
• 1:20:22
what they can do, or you know, how they work
• 1:20:25
and how they're administered. Well, this gives you, like I said,
• 1:20:29
a blueprint, in my opinion, and a template on how
• 1:20:33
the government should conduct themselves going after Epstein. But in
• 1:20:37
the Epstein case they should be even more aggressive. Considering
• 1:20:40
how many people were involved, it was young children, and
• 1:20:43
how many decades this spent. This should be an all
• 1:20:47
out full court press by the government slapping everybody ever
• 1:20:50
involved Wexner, Dubin, et cetera, et cetera, name them all
• 1:20:54
in the Rico count the Rico case, and then let
• 1:20:58
the forensic accountants and the invest stigators sort it all out.
• 1:21:02
There's just no reason for this not to be RICO
• 1:21:04
at this point. So all right, folks, I'll be back
• 1:21:07
later on tomorrow morning, I should say, with the usual
