Speaker 1: Now we turn to the Mountain Eagle to read news
0:04
from Weissberg. Your reader today is Bill den Arsdale. We
0:08
will begin with the addition dated February eighteenth, twenty twenty six,
0:13
which the publishers have donated to RADIOI as reminder. RADIOI
0:18
is a reading service intended for people who are blind
0:21
or have other disabilities that make it difficult to read
0:24
printed material. The first headline is the caption of a
0:28
photograph pulling pork building a dream. Philip Howard, known as
0:35
Big Phil to his fellow miners, and his wife Shanna
0:39
Fox of Neon opened the Valley Country Store on Monday.
0:45
Howard is originally from Eolia. Fox is from Martin County.
0:50
Their new business is located on US one nineteen on
0:53
the Eolia side of Pine Mountain, in the county owned
0:56
building that previously housed the General's Store at Pine Mountain Crossing.
1:02
In addition to a strong emphasis on barbecue, the Valley
1:06
Country Store will offer household essentials and freshly prepared foods.
1:11
The couple is also considering adding Cajun and Creole dishes
1:14
to the menu. The store currently serves burghers, hot dogs,
1:19
deli sandwiches, and sweet treats. In the accompanying photograph, Howard,
1:24
dressed as he often is when coming from his work
1:26
in the coal mines, prepares a pulled pork sandwich from
1:30
a freshly smoked pork shoulder looking ahead. Howard and Fox
1:35
hope to grow the business to the point that Howard
1:37
can transition from coal mining to running the store full time.
1:43
Their long term plans include developing the location into a
1:47
base for mobile smokers that can travel to festivals. The
1:52
next headline is Attorney Stein's will take the Fifth if
1:57
he must testify. An attorney for former Electric County Sheriff
2:01
Mickey Steins has filed a motion to intervene in a
2:05
lawsuit against the Sheriff's department and former court security officer
2:09
Ben Fields, asking a judge to prevent Steins from being
2:13
transported to London to testify. The motion says that if
2:18
the state is required to transport him to the civil trial,
2:22
Stein's will invoke his Fifth Amendment right not to give
2:25
testimony that could incriminate him. The facts of the litigation
2:29
currently before the court are inextricably intertwined with the facts
2:33
of the criminal case. Attorney Jeremy Bartley wrote in the
2:37
motion compelling mister Stein's transportation and presence at trial. Merely
2:43
to invoke the privilege multiple times in front of the
2:45
jury creates undue prejudice to the original parties and invites
2:50
impermissible inferences. The motion was filed in the federal civil
2:55
suit brought by Sabrina Atkins against the Sheriff's Department, Fields
3:00
and East Kentucky Correction Services, Incorporated. Stein's was removed from
3:05
the case after he resigned from office following his arrest
3:09
in the slaying of District Judge Kevin R. Mullens. East
3:14
Kentucky Corrections has since settled with Atkins. Bartley's motion says
3:19
Stein's has already given a deposition in the lawsuit, and
3:23
that the deposition should be used in place of live testimony,
3:26
avoiding security risks or delays. The motion suggests that if
3:32
the court does grant a writ to bring Steins to court,
3:35
he be provided topics in advance, that the Court prohibit
3:39
questioning design to elicit privileged testimony, that no adverse inference
3:44
be allowed from his invocation of the Fifth Amendment, and
3:48
that he be permitted to appear remotely by video to
3:52
avoid transportation. The motion was filed in response to a
3:56
request by Atkins to have the state transport Stein's mo
4:00
Leslie County jail to the Federal Courthouse in London for
4:04
the civil trial. It is one of several motions filed
4:07
in the past week. The Letcher County Sheriff's Office and
4:11
Fields have both filed motions joining Stein's request. They argue
4:16
that forcing him to appear would serve no purpose because
4:20
other department employees already listed as witnesses by the plaintiff
4:24
can answer any necessary questions. Fields's attorney wrote that extensive
4:29
worldwide news coverage of the killing of Judge Mullens makes
4:33
it likely jurors would recognize Stein's His appearance in court,
4:39
combined with repeated invocation of the Fifth Amendment, would only
4:43
serve to deeply prejudice the jury and to focus their
4:46
thoughts away from the evidence and the law. The Sheriff's
4:50
Department's response says the circumstances do not warrant such extraordinary relief.
4:56
It argues that much of the testimony sought by plaintiffs
4:59
attorney Joe Childers is already in written form, was covered
5:03
during Stein's deposition, or can be provided by other department personnel.
5:09
The transportation of an incarcerated individual who may or may
5:13
not be competent, who is facing capital murder charges, likely
5:17
to assert Fifth Amendment privileges, and whose criminal proceedings have
5:21
garnered national media attention presents significant security issues and requires
5:28
substantial resources. However, Childers argues that a written deposition is
5:33
not a substitute for live testimony and called the suggestion
5:37
that Stein's would invoke his Fifth Amendment rights ludicrous. It
5:42
is entirely unreasonable that stein should get away with refusing
5:46
on Fifth Amendment grounds to answer questions he has previously
5:49
answered under oath. Childers wrote Children's filings, says Stein's is
5:55
expected to testify about seventeen matters, most or all of
6:00
which were addressed in his deposition. The list includes testimony
6:04
to authenticate sexually crude messages he shared with his deputies
6:10
as a policymaker. The response argues Stein's testimony is uniquely
6:15
material and necessary, particularly because of the lawsuit's claim of
6:19
municipal liability. The filing also says a video appearance would
6:24
be acceptable if it allows for a live, two way
6:28
remote testimony, preserving confrontation like functionality for cross examination and
6:33
authentication of exhibits. The next story is Kentucky Power to
6:39
PSC approved deal or it's off. Utility defends its record
6:46
in Eastern Kentucky issues a warning to PSC. In a
6:51
new sharply worded reply brief, Kentucky Power Company defends its
6:55
record in Eastern Kentucky, highlights its charitable giving and EA
7:00
economic development efforts, and warns the Kentucky Public Service Commission
7:04
PSC that altering a proposed rate settlement could cause the
7:08
agreement to unravel. The filing, submitted to the PSC on
7:14
the night of February tenth, responds to arguments by the
7:17
Office of Attorney General Russell Coleman and several intervener groups
7:22
seeking to halt or reduce the company's requested rate increase.
7:27
Throughout the twenty one page brief, Kentucky Power portrays itself
7:31
as both a utility seeking lawful cost recovery and a
7:35
community partner working to support impoverished counties in its service territory.
7:41
Kentucky Power argues that it recognizes Eastern Kentucky faces unique
7:45
economic challenges and says it has taken steps beyond its
7:49
core obligation to provide electricity. The company cites a one
7:54
million dollar charitable donation through the Kentucky Power Foundation for
7:58
weatherization assistance, more than two hundred seventy thousand dollars in
8:03
housing assistance in twenty twenty five, donations for flood relief
8:08
and local food banks, volunteer work by employees in food pantries,
8:14
and community listening sessions with stakeholders. The company emphasizes that
8:19
those charitable contributions are funded by shareholders, not ratepayers. Kentucky
8:25
Power cannot solve the systemic issues plaguing Eastern Kentucky on
8:29
its own, the brief states, adding that the company does
8:33
all it can to help because a stronger service territory
8:36
benefits everyone. At the heart of the brief is Kentucky
8:40
Power's rejection of Attorney General Coleman's argument that regulators could
8:44
deny any rate increase at all. The company calls that
8:48
position completely unreasonable, claiming that even the Attorney General's own
8:53
expert witnesses have recommended a substantial annual increase. Kentucky Power
8:59
argues that without some increase, it would be forced to
9:02
scale back spending on operations, tree cutting and trimming, and
9:07
reliability programs, and could jeopardize future investments such as advanced
9:12
metering or in state generation projects. The company says it
9:17
must be allowed to recover prudently incurred costs and earn
9:21
a reasonable return to attract capital and maintain service a
9:26
clear warning. The brief also addresses the possibility of changes
9:30
to the settlement. When Kentucky Power first filed its rate case,
9:35
it proposed an overall increase that would have raised residential
9:39
bills by about fourteen point nine percent before taxes and
9:44
various rioters are included. For a typical household using around
9:49
one thousand, two hundred ten kilowatt hours per month, that
9:52
would have meant roughly twenty six more dollars per month.
9:57
Under the negotiated settlement now before the Public Service Commission,
10:01
that increase would be smaller for at least in the
10:04
first two years. According to Kentucky Power, the first year
10:08
revenue increase would be about fifty two point four million
10:12
dollars after credits, rather than the higher amount originally requested.
10:18
That translates to about an eight point two percent increase
10:21
for a typical residential customer, roughly seventeen dollars and fifty
10:25
cents more per month instead of twenty six dollars. The
10:29
reduction comes in part from deferred tax liability or DTL credits,
10:36
which temporarily offset a portion of the increase. Those DTL
10:40
credits are designed to reduce bills during the first two
10:43
years after new rates take effect. However, the credits are temporary.
10:50
Once they expire, bills would move closer to the full
10:53
underlying rate level unless changed in a future case. Kentucky
10:58
Power argues that the settlement already cuts deeply into its
11:02
original request and that further reductions would jeopardize its financial
11:07
balance and potentially cause it to withdraw from the agreement.
11:11
Kentucky Power argues the DTL credits and the revenue requirement
11:16
are interdependent and were carefully constructed to protect credit metrics
11:20
and financial ratios. Any material modification, the company says, will
11:26
likely result in Kentucky Power having to withdraw from that agreement.
11:31
Lower revenue or larger credits, it argues, would reduce cash flow,
11:35
affect funds from operations to debt ratios, potentially increase borrowing costs,
11:42
and ultimately raise the cost of service to customers. The
11:46
company also pushes back against proposals to eliminate demand side
11:50
management programs arguing they save customers money and costs the
11:55
average residential customer less than one dollar per month. Guide
12:00
Management DSM programs are efforts by Kentucky Power to help
12:05
customers use less electricity or use it more efficiently. Instead
12:09
of building more power plants, DSM focuses on reducing customer
12:13
demand through weatherization and insulation assistance, energy efficiency, rebates, home
12:20
energy audits, and programs targeted to low income households. Supporters
12:27
say DSM lowers long term system costs and helps reduce
12:32
high winter bills. Critics argue it add costs now and
12:36
may not benefit every customer equally. The programs are reviewed
12:41
and approved by the PSC. The brief repeatedly characterizes intervener's
12:46
arguments as late, unsupported, or outside the scope of the case.
12:51
Beyond the legal arguments, The tone of the filing is
12:55
somewhat unusual. Kentucky Power frames itself as an entity actively
13:00
trying to stabilize an economically distressed region, while arguing it
13:05
cannot be expected to shoulder those burdens without adequate rates.
13:09
It calls for partners and not adversaries, in addressing Eastern
13:13
Kentucky's systemic challenges. The next headline is interveners to PSC
13:22
settlement doesn't fix region's death spiral. A coalition of consumer
13:28
and community groups is calling on the Kentucky Public Service
13:31
Commission PSC to look beyond the proposed settlement within Kentucky
13:37
Power Company's rate case, asserting the agreement falls short of
13:41
the legal minimum, lowest reasonable rate and it does nothing
13:45
to respond to the region's affordability crisis. In a February
13:50
tenth reply brief, the joint interveners Appalachian Citizens Law Center
13:55
of Whitesburg, Kentuckians for the Commonwealth of London, Kentucky, the
14:00
Solar Energy Society of Louisville, and Mountain Association of Berea
14:05
define Kentucky Power's service territory as confined to a financial
14:10
death spiral, one where higher prices compound population decline and
14:16
shrinking customer bases, which increases rates. In turn, the groups
14:21
claim the settlement may lower the company's original request, but
14:25
drives a higher one that hits struggling households and the victims.
14:30
A central dispute in the brief is the legal standard
14:33
the PSC should follow. Kentucky Power believes that the settlement
14:37
represents a balanced compromise The interveners argue that balanced is
14:43
not the same thing as lawful, and they refer to
14:47
Kentucky Supreme Court language indicating that under the zone of reasonableness,
14:52
regulators might allow lowering rates which are not the lowest
14:56
reasonable rate, even if the utility would be allowed to
14:59
operate while doing the rate. They emphasize that the burden
15:03
of proof falls on Kentucky Power to demonstrate that its rates,
15:07
including those it requested in the settlement, meet that standard.
15:12
The filing's most pointed argument is that Kentucky Powers mitigation
15:16
measures do not really fix affordability problems, they shift costs
15:21
in time. The interveners list several things amounting to deferrals
15:26
that could raise future bills, including parts of the proposed
15:31
Deferred Tax Liability DTL rider, and potential associated financing costs,
15:37
such as enabling customers to receive temporary credits now but
15:42
later to be reimbursable at higher rates or financing fees.
15:46
Deferred storm cost treatment enabling the corporation to recover storm
15:51
repair costs over time rather than all at once, which
15:55
might add to bills during future years. Deferred expenses relating
15:59
to to vegetation management trees outside right of way, reducing
16:04
certain tree trimming spending now versus potentially returning them to
16:09
customers later. Deferred costs tied to the Mitchell power plant
16:14
in West Virginia, and other accounting treatments, spreading out power
16:18
plant related costs instead of fully accounting for them then,
16:21
which could mean having more in long term charges. Deferral
16:26
of costs to establish a proposed pre payment program, postponing
16:31
recovery of program set up costs which would later be
16:34
incorporated into rates. Deferral of losses associated with gas purchases,
16:41
delaying recovery of fuel expenses so that people may eventually
16:44
see such costs reflected in future bills instead of present ones.
16:49
To show them as the cumulative effect, the interveners liken
16:53
the case to a Tetris game to see how ill
16:56
fitting pieces stack quickly and quickly before they are gained over.
17:01
In their view, the settlement could soften bills now, but
17:05
at the cost of a bigger responsibility down the road.
17:09
The interveners contend that the biggest cause of hardship in
17:12
eastern Kentucky isn't just the rate per kill abot hour,
17:16
but is a combination of high rates and high usage,
17:20
particularly in winter in poorly insulated homes. They cite a
17:25
prior PSC order instructing Kentucky Power to tackle high winter
17:29
use with cost effective measures to reduce demand, rather than
17:34
mask that winter demand with arbitrary rate reductions. Kentucky Power
17:38
has said it will look into high usage patterns. Interveners
17:42
say they want the PSC to impose enforceable obligations, requiring
17:47
evaluation of real alternatives and reporting back to regulators. Kentucky
17:53
Power believes the Deferred Tax Liability DTL rider is a
17:57
customer benefit contingent upon the settlement being approved without modification.
18:03
The interveners can test those claims. Those DTL credits have
18:08
been intended to reduce bills for the first two years
18:11
after new rates come into effect, and that's the process,
18:15
but the credits are temporary. Once they expire, bills would
18:19
move closer to the full underlying rate level unless modified.
18:23
In the next case in the next story, cities water
18:28
problems are complex. The boil water advisory has been lifted
18:33
in Whitesburg three weeks after changing weather began cracking open
18:37
water lines and pushed the water treatment plant to the
18:41
breaking point. The leaks were exacerbating a problem caused when
18:45
a landslide last year took out a one hundred and
18:48
seventy five thousand gallon storage tank on Tunnel Hill. That tank,
18:53
which was in danger of collapse, had to be torn down.
18:57
The city had already stopped using a three hundre drede
19:00
thousand gallon tank on hail Drive that was built in
19:03
the nineteen seventies, said Administrative Assistant Chris Caudle, who is
19:08
in charge of the city utilities. The city was already
19:12
seeking grants to replace the hail drive tank when the
19:15
Tunnel Hill tank failed. Caudle said the loss of the
19:19
tanks didn't cause the problems, but it sure didn't help.
19:23
We're losing two hundred thirty five gallons of water a
19:26
minute every time we run the plant, Caudle said. Last week,
19:30
we run the plant around the clock non stop while
19:34
workers are chasing weeks. The city has the Kentucky River
19:38
Area Development District pushing grant applications through the state and
19:43
federal systems, searching for money for a line replacement and
19:47
a new tank. Chris Back, a grant writer for k
19:51
r a d D, said, one application for one point
19:54
nine million dollars is under review and another is being revised.
20:00
The problem that we're having this week, I thought if
20:02
we had that tank, that would alleviate a lot of that.
20:05
Mayor Tiffanycraft said, I thought, since they the grant funding
20:09
agencies are seeing that we're having so many issues, that
20:12
that would push that right along. Meanwhile, water service is intermittent,
20:18
with low pressure and brown water in some places in
20:21
downtown and perfectly clear water with normal pressure in others.
20:26
Cardles of the biggest problems are in the older section
20:29
of the water system. The city is also looking for
20:33
money to replace those lines. Its application for money to
20:37
replace water lines in downtown is under review by the
20:41
Department for Local Government. The next story is grand jury
20:46
names four in indictments. Four people are named in felony
20:51
indictments handed up in Letter Circuit Court before Judge James W.
20:55
Craft the second. They are Ca C. S Irvin, forty
21:00
five one seven one five eight Highway sixty nine, North, Northport, Alabama,
21:06
who is charged with first degree sexual abuse victim under
21:09
twelve years of age, first degree rape and incest involving
21:13
a person under twelve years of age. Irvin, who lives
21:17
in the Tuscaloosa area of Alabama. Last had a court
21:21
appearance here in December twenty twenty five, when he was
21:25
ordered by Lecturer District Judge Nick Whittaker to pay one thousand,
21:29
fifty seven dollars and sixty one cents per month in
21:31
child support. Kentucky State Police Detective Tyler Smith testified before
21:37
the grand jury in the current felony case Ethan Robert Kaiser,
21:42
thirty five nine fifty six Highway three four oh eight Blackie,
21:47
who is charged with first degree possession of a control
21:50
substance first defense methem fetomine, third degree possession of a
21:54
control substance drug unspecified, and possession of a prescription control
21:59
substance not in its proper container first offense. Court documents
22:04
show that Kaiser was arrested at Jeremiah on January twenty third,
22:09
after a woman complained to Kentucky State Police that he
22:12
was on her property despite being told he was not
22:15
allowed there. Kentucky State Police Trooper Jarrett Fields, who testified
22:20
before the grand jury prior to the indictment being returned,
22:24
said he arrived at the Jeremiah property knowing that Kaiser
22:28
was wanted on two active arrest warrants charging him with
22:31
probation violations. After Kaiser was placed under arrest, a search
22:36
of his pockets turned up a blue pill bottle with
22:39
a label torn off. Inside the bottle was a packet
22:43
containing what is suspected to be methamphetamine and numerous tablets
22:47
of GABA penton, which is used to control nerve pain
22:51
and is sold under the brand name Neurontin Vanessa Adams
22:56
sixty nine fifty Blue Jay Hill Jeremiah, who is charged
23:00
with first degree trafficking in a control of substance, first
23:03
defense drug unspecified. Kentucky State Police Detective Gary Sykes testified
23:09
in the case. And Michael Fleming thirty six two twenty
23:13
one Cargo Lane Jenkins, who is charged with theft by
23:17
unlawful taking or disposition OTTO valued at more than one
23:21
thousand dollars and less than ten thousand dollars for allegedly
23:25
taking control of a twenty twenty five Kawasaki motorcycle belonging
23:29
to Susan Johnson. Kentucky State Police Trooper Bruce Kelly testified
23:35
in the case. The next story is man is sentenced
23:40
A Millstone man has entered a guilty plea to charges
23:43
against him. In Leeder Circuit Court Todd Stephen Brooks fifty
23:47
five thirty nine Mallard Drive. Millstone pleaded guilty to operating
23:52
a motor vehicle under the influence of alcohol and first
23:55
degree wanton endangerment. Works was sentenced to three years in prison,
24:00
probated for three years and In the next headline, House
24:05
budget proposal would cost counties to school districts. Leccher County's
24:11
two public school districts would lose a significant portion of
24:14
their transportation funding under the state education budget proposed by
24:19
the Kentucky House of Representatives. An analysis by the Kentucky
24:23
Center for Economic Policy estimates that changes to the state's
24:27
primary school funding formula would reduce funding to Jenkins Independent
24:32
School District by eighty seven nine hundred and sixty nine
24:35
dollars by twenty twenty eight, about a seven percent cut,
24:40
and decrease funding to Letcher County Public schools by nine
24:44
hundred ninety one thousand, two hundred thirty dollars, or about
24:47
nine percent. The funding in question comes through SEEK Support
24:53
Education Excellence in Kentucky, the state's main formula for financing
24:57
K through twelve public education, established in nineteen ninety. SEEK
25:02
was designed to insure equitable funding among school districts. The
25:07
formula calculates funding based on student attendance, special needs and
25:12
at risk populations, and transportation costs, while also accounting for
25:17
local property wealth. As introduced, House Bill five hundred would
25:22
freeze the seek base guarantee the minimum per student funding amount,
25:27
and reduce state support for student transportation. Analysts estimate the
25:33
combined changes would reduce state payments to local school districts
25:37
by more than one hundred million dollars by twenty twenty eight.
25:42
The proposal would suspend a state law requiring Kentucky to
25:46
fund one hundred percent of the cost of school transportation,
25:50
a provision that has been suspended in every budget since
25:53
two thousand four. The House plan funds seventy four percent
25:57
of transportation costs, about four forty million dollars less per
26:01
year than the current budget and one hundred and twenty
26:04
nine million dollars less annually than full funding under the
26:07
law would require. The Sikh formula splits funding responsibility between
26:12
the state and local school districts because it factors in
26:16
property values. Districts with higher property wealth are expected to
26:20
contribute more local revenue, while poorer districts receive a larger
26:25
share of state funding. The proposed reductions come as school
26:29
districts statewide face budget pressures from the expiration of federal
26:34
COVID nineteen relief funds. The House budget remains under consideration
26:39
as the General Assembly continues work on the state's biennial
26:43
spending plan. And this concludes the reading of the Mountain Eagle.

I thank you for listening, and I have a good deal. Hey,
