Transcript
- 0:02Speaker 1: Well, good morning, ruminators. It is Friday, August twenty second.
- 0:06Speaker 1: He is Jose. I'm preston a show fifty four to
- 0:08Speaker 1: thirty seven of the Morning Show with Preston Scott. It
- 0:12Speaker 1: is great to be with you. We are joined by
- 0:17Speaker 1: Lee Williams aka the gun Writer. You can find his
- 0:21Speaker 1: work at the gun Writer dot substack dot com. Good morning, Lee.
- 0:26Speaker 1: How are you, sir?
- 0:27Speaker 2: Good Preston, I'm doing well. How are you, sir?
- 0:30Speaker 1: I am doing very well. That said, I am probably
- 0:35Speaker 1: not to the degree you are, because you have invested
- 0:38Speaker 1: so much time and effort in uncovering the dirty details.
- 0:42Speaker 1: And dirty is probably a polite word for what the
- 0:45Speaker 1: ATF has done to ruin a young man's life in
- 0:49Speaker 1: Patrick Tato Domiak, you wrote a piece that you released yesterday,
- 0:55Speaker 1: it's time for President Trump to end the ATF. And
- 0:58Speaker 1: obviously this is much more more than just Tata Domiak.
- 1:03Speaker 2: Yeah, I mean I started it off with no one
- 1:05Speaker 2: makes the case that it's time to end the ATF
- 1:08Speaker 2: better than the ATF, and they really do, brother, I mean,
- 1:10Speaker 2: these guys screw up internationally and consistently. I've written more
- 1:16Speaker 2: than one hundred stories about ATF since I started doing this,
- 1:20Speaker 2: and I've never seen a bloodier history. I mean, and
- 1:23Speaker 2: like I said in my story earn my column, it's
- 1:25Speaker 2: the blood of innocent Americans. I mean, look at every
- 1:28Speaker 2: twenty eight, nineteen ninety three, they took out Waco, they
- 1:32Speaker 2: killed people in their homes, and then just last year
- 1:36Speaker 2: March nineteenth, ATF agent Tyler Coward did it to a
- 1:42Speaker 2: fifty three year old Arkansas Airport executive who was in
- 1:47Speaker 2: his home, thought he was being burglarized. Never committed a crime.
- 1:50Speaker 2: I mean, ATF has committed atrocity after atrocity after trocity,
- 1:54Speaker 2: and they've never been held accountable. And I'm telling you
- 1:57Speaker 2: they're going to keep doing it under Trump until he
- 2:00Speaker 2: does something about the agency. So I think I think
- 2:03Speaker 2: it's time for the agency just to go. And that's
- 2:05Speaker 2: what I said in my piece yesterday. It's time for
- 2:07Speaker 2: President Trump to end the ATF. They cannot be trusted.
- 2:11Speaker 1: What is the history of ATF? How do we get
- 2:14Speaker 1: how did we get it?
- 2:17Speaker 2: You know, it started out like a lot of federal agencies.
- 2:20Speaker 2: The agents were unarmed, they were tracking stills, and then
- 2:24Speaker 2: they just added in addition to alcohol, they started adding
- 2:28Speaker 2: things to them, tobacco, and then when they got to firearms,
- 2:32Speaker 2: ATF was like, oh yeah, okay, now we can really run.
- 2:35Speaker 2: I mean if you look at look at I guarantee
- 2:39Speaker 2: you go to their website. Just look at the Remembering
- 2:41Speaker 2: Waco homepage. Okay, remember Waco. You would think they would
- 2:46Speaker 2: they would have some type of guilt about the seventy
- 2:50Speaker 2: eighty people that were killed. But no, I mean they
- 2:53Speaker 2: really don't. They really don't. I mean they they talked
- 2:58Speaker 2: a little bit about some misjudgment and then they just
- 3:00Speaker 2: go right into what a great job their agents do nationally.
- 3:04Speaker 2: It's ludicrous. I mean, I've never seen anything like it.
- 3:08Speaker 2: They said their big admission about Waco. Certain actions by
- 3:12Speaker 2: ATF were criticized. If we didn't have seventy people dead,
- 3:19Speaker 2: you know, eighty total with the four ATF agents that
- 3:23Speaker 2: you know, it's like they just don't get it. And
- 3:27Speaker 2: then when you look at recent stuff, you got Patrick
- 3:29Speaker 2: Tata Domiac, the US Navy petty officer. You got Mark
- 3:34Speaker 2: chuff Omanley who was at home with his family when
- 3:38Speaker 2: ATF did him. Russell Fincher, a guy who was a
- 3:42Speaker 2: Baptist pastor, they took him out, and then of course
- 3:45Speaker 2: Brian Melanowski, they shot and killed in his home. You know,
- 3:49Speaker 2: I just don't see why we need this agency. I mean,
- 3:53Speaker 2: they these cases, they clearly show ATF can't tell the
- 3:56Speaker 2: difference between a criminal and a legitimate gun owner. And
- 4:00Speaker 2: it's this inability, brother that resulted in them filing false
- 4:04Speaker 2: criminal charges like they did to a domiac.
- 4:09Speaker 1: Joining me, Lee Williams the gun writer, and he writes
- 4:13Speaker 1: about the Second Amendment. He writes about cases that are
- 4:17Speaker 1: an affront to the Second Amendment. And let's work. Let's
- 4:21Speaker 1: work from work backwards from your story. Let's start with
- 4:24Speaker 1: Brian Malinowski. Let's remind everybody what he was accused of
- 4:27Speaker 1: doing and being.
- 4:30Speaker 2: He was never accused of doing and being anything. They
- 4:34Speaker 2: had a search warrant to search his home. Brian was
- 4:37Speaker 2: a banker in Arkansas. He was the I'm sorry, an
- 4:40Speaker 2: airport executive. I get my guys confused, and the senior
- 4:43Speaker 2: airport executive. He had an incredibly high salary and he
- 4:47Speaker 2: went to gun shows. You get a table and he'd
- 4:49Speaker 2: trade some stuff. He was into coins. He would do
- 4:51Speaker 2: that too. ATF got a search warrant for his home,
- 4:56Speaker 2: rather than picking him up at the office or going
- 4:58Speaker 2: to knocking on his door. They hit him in the
- 5:00Speaker 2: middle of the night. He thought there were burglars coming in.
- 5:03Speaker 2: He armed himself, fired around, hit some ATF agent in
- 5:07Speaker 2: the sole of his shoe. Of course, Tyler Cohort, who's
- 5:11Speaker 2: an ATF agent, sighted in on his head and shot
- 5:13Speaker 2: him dead. Uh, it's just a tragedy, absolute tragedy. He
- 5:19Speaker 2: had never charged with a crime.
- 5:21Speaker 1: What was what were they suspecting him of doing that
- 5:25Speaker 1: warranted a midnight raid.
- 5:28Speaker 2: That's the way ATF works. If they're going to do
- 5:31Speaker 2: a search warrant, rather than just knock on the guy's
- 5:34Speaker 2: door or go into his office which is a no
- 5:37Speaker 2: gun zone in the middle of an airport, say hey, Brian,
- 5:39Speaker 2: you know we need to we need to go search
- 5:41Speaker 2: your home. Come with us. They always try and go commando,
- 5:46Speaker 2: and they kicked indoors. They taped over his camera right
- 5:50Speaker 2: outside on his front door. It was terrible. And then
- 5:54Speaker 2: of course he has no He's got a huge home.
- 5:56Speaker 2: He has no idea who's in his home. None of
- 5:58Speaker 2: them are wearing any police accouterment. He didn't hear him,
- 6:02Speaker 2: and they shoot him dead in the hallway and they
- 6:05Speaker 2: were exonerated.
- 6:08Speaker 1: How is that possible exonerated based on what.
- 6:12Speaker 2: Based on the threat that he presented. They said that
- 6:16Speaker 2: the coward shot was okay, and he shot him in
- 6:21Speaker 2: the head and they left him laying there. He died
- 6:24Speaker 2: three days later. I mean, it's just a terrible They
- 6:28Speaker 2: weren't even giving him aid. It's a horrible situation.
- 6:31Speaker 1: Please tell me the family's suing.
- 6:34Speaker 2: Yes, the wife, I'm sorry. The widow has filed a lawsuit.
- 6:39Speaker 2: And if ATF knows anything, they better damn well.
- 6:42Speaker 1: Payoff does n't bring the husband and father back, though
- 6:46Speaker 1: Russell Fincher tell us about him.
- 6:50Speaker 2: Russell's a really neat guy. A high school history teacher,
- 6:54Speaker 2: lives in a small small town Tuskahoma, Oklahoma, Baptist minister,
- 6:58Speaker 2: a part time gun dealer. Yet a little shed built
- 7:00Speaker 2: outside his home where he sold guns. And then twenty
- 7:05Speaker 2: twenty three seven vehicles come up and they disgorged a
- 7:08Speaker 2: dozen ATF agents. They yelled and screamed that it put
- 7:11Speaker 2: him in handcuffs on his porch right next to his son,
- 7:14Speaker 2: and yelled and screamed at him enough until they scared
- 7:17Speaker 2: him and he agreed to stop selling firearms. They just
- 7:19Speaker 2: charged him with selling a box of ammunition to somebody
- 7:23Speaker 2: with a felony license or with a felony record, who
- 7:27Speaker 2: I don't know how Russell was supposed to know that
- 7:29Speaker 2: in Oklahoma you don't run people background for selling it
- 7:33Speaker 2: for buying AMMO. But that was their big git. They
- 7:38Speaker 2: he sold a box of AMMA to somebody with a
- 7:40Speaker 2: felony So where is He's out of the business. He's
- 7:44Speaker 2: out of the business.
- 7:45Speaker 1: Where's Oklahoma law in all of this? Where's the Oklahoma
- 7:49Speaker 1: Attorney General in all of this?
- 7:51Speaker 2: The AG got involved. There were some lawmakers from Oklahoma
- 7:55Speaker 2: who represented him, who got involved. They yelled and screamed
- 7:59Speaker 2: at ATF, and of course ATF just doesn't care. They
- 8:02Speaker 2: did nothing for this man who now has a felony record,
- 8:06Speaker 2: can't sell guns. Campusess Guns.
- 8:09Speaker 1: Tell us about Mark Manley.
- 8:12Speaker 2: Great guy, He's going to be at the at R.
- 8:16Speaker 2: I'm sorry our big get together next month when the
- 8:19Speaker 2: Second Amendment Foundation gets together, I'm gonna be talking to
- 8:22Speaker 2: him there. He's a gun owner, gun collector, Second Amendment advocate.
- 8:26Speaker 2: He had seventy legally owned firearms stored in a huge
- 8:29Speaker 2: safe in his home. He lived by Baltimore, and then
- 8:33Speaker 2: one morning he gets up super early he sees ATF
- 8:36Speaker 2: agents run around outside. They kick in the door, They
- 8:39Speaker 2: go down in his basement. They throw a stungernad into
- 8:43Speaker 2: the room where his son is sleeping. They threw a
- 8:46Speaker 2: stungernad into the living room. They tell him they're going
- 8:50Speaker 2: to cut the front of his safe. He's like, hey,
- 8:53Speaker 2: I'll open up where I got nothing in there to
- 8:54Speaker 2: worry about, And he didn't went through all his guns,
- 9:00Speaker 2: said well, we're going to get back to you. Do
- 9:02Speaker 2: you could be charged? Of course, they never took anything.
- 9:04Speaker 2: Everything is illegal except for in my humble opinion, what
- 9:08Speaker 2: they did to him again, ATF agent using a bad informant,
- 9:13Speaker 2: said that he had illegal firearms. He had nothing illegal,
- 9:17Speaker 2: and then they just terrorized the hell out of him
- 9:19Speaker 2: and his family for no reason.
- 9:21Speaker 1: Lee, in your world of reporting, you know that you
- 9:25Speaker 1: have to be very careful about sourced information, and that
- 9:30Speaker 1: you know in the media world, you do everything possible
- 9:32Speaker 1: to find multiple sources. You don't report on one source
- 9:36Speaker 1: for this very reason. How is it possible, Yeah, how
- 9:40Speaker 1: is it possible that an agency with the amount of
- 9:43Speaker 1: authority and power it has doesn't follow what basic journalism requires.
- 9:49Speaker 2: You know, when I was a police officer. I worked dope,
- 9:51Speaker 2: I worked gangs. If we had an informant say hey,
- 9:54Speaker 2: there are bad things in this house, we would always
- 9:57Speaker 2: get a second opinion. And you know, you work enough
- 10:01Speaker 2: CI's confidential informants, eventually you know when they're telling the
- 10:04Speaker 2: truth of when they're lying. And when you've got a
- 10:06Speaker 2: guy who's facing charges, he's probably going to give you
- 10:10Speaker 2: a name or number. You got to be really careful.
- 10:13Speaker 1: Yep.
- 10:13Speaker 2: And the ATF isn't isn't. Brian Melanowski, Mark Chupamanley Russell Fincher,
- 10:21Speaker 2: and Patrick Tata Domiak all were hurt in these non
- 10:27Speaker 2: legal terms because the HF doesn't know that anything about
- 10:30Speaker 2: an informant Tata Domiak.
- 10:32Speaker 1: Patrick is sitting in prison and has he was about
- 10:36Speaker 1: to be a Navy seal officer but now is in
- 10:41Speaker 1: prison and why.
- 10:44Speaker 2: He's on the third year of his twenty year sentence. Again,
- 10:47Speaker 2: ATF kicked in the door. They found nothing illegal, so
- 10:52Speaker 2: they bring in this kid, and I mean he's a kid,
- 10:56Speaker 2: He's got nothing going on in his life to stop there.
- 11:01Speaker 2: He's an ATF employee, he's not a special agent. And
- 11:04Speaker 2: what he does is he uses his creativity to take
- 11:08Speaker 2: the stuff the legal items that Tate had in his
- 11:11Speaker 2: safe and turn them into bad things. For example, he
- 11:17Speaker 2: had a toy sten. You want one, to cost you
- 11:19Speaker 2: about one hundred bucks to mail it right to your house.
- 11:21Speaker 2: This kid took a real Sten barrel, real Sten action,
- 11:24Speaker 2: mounted him in the in the toy Sten, couldn't get
- 11:27Speaker 2: a magazine to fit, so it fired one round. Boom,
- 11:30Speaker 2: it's a machine gun. They're still sold online. Everything that
- 11:33Speaker 2: Tate had is still available online. Half most of it.
- 11:39Speaker 2: You don't even need a driver's license or any kind
- 11:42Speaker 2: of federal paperwork to get it. It's just amazing how
- 11:46Speaker 2: badly they went after Tate. They found nothing there illegal. Boom.
- 11:49Speaker 2: They went right after it.
- 11:51Speaker 1: You could walk around my studio right now, Lee, and
- 11:54Speaker 1: you could take different things that are in my studio
- 11:57Speaker 1: and create quote, an assault weapons. That's what this guy did.
- 12:01Speaker 2: Yeah. Jeffrey R. Bodell, he's not an agent. He's an
- 12:05Speaker 2: ATF firearms enforcement officer. This was the first trial he
- 12:08Speaker 2: ever testified in. And I got to tell you, he's
- 12:12Speaker 2: the reason that Tate is looking at twenty years. They
- 12:14Speaker 2: tried to get him for thirty years, but his attorney
- 12:17Speaker 2: got him out of ten years. But still, I mean,
- 12:20Speaker 2: this guy should be leading in the seal platoon and
- 12:23Speaker 2: instead he's sitting in a prison in New Jersey. It's
- 12:26Speaker 2: the most convoluted thing I've ever seen in my life.
- 12:29Speaker 2: It is the most screwed up case I've ever seen
- 12:32Speaker 2: in my life. You've got a guy in federal prison
- 12:35Speaker 2: who's got seventy more years to serve, who literally did
- 12:38Speaker 2: nothing wrong. Go to my story. We have all the
- 12:42Speaker 2: documents where we examined every little bit of evidence, everything
- 12:46Speaker 2: they took from him, and the documents are damning, but
- 12:49Speaker 2: not for Domiak. They're damning for the ATF. They show
- 12:52Speaker 2: that nothing he had was illegal. Not a thing he
- 12:55Speaker 2: was charged with was illegal. It's just a botched trade.
- 12:59Speaker 1: And that you can look up all of these items
- 13:01Speaker 1: now and purchase them legally online.
- 13:04Speaker 2: Right, absolutely, absolutely.
- 13:07Speaker 1: Real, Quickly, what's the update on Tate's case.
- 13:12Speaker 2: Well, he's getting some attention from high levels, let's just
- 13:17Speaker 2: put it that way. Whether or not he'll get a
- 13:19Speaker 2: pardon yet, I don't know. I certainly pray he does.
- 13:22Speaker 2: I really do. This kid does not need to be
- 13:25Speaker 2: in prison. He needs to be running a seal platoon.
- 13:29Speaker 1: Lee, thanks for all the work. You're doing, and again
- 13:31Speaker 1: a reminder to all of you, Thegunwriter dot substack dot
