- 2:07you on yesterday's show that Secretary Warner quite upset by an executive order coming from
- 2:13President Biden as it pertains to so called get out the vote campaign. Secretary
- 2:16Warner and several other secretaries of state are fighting back, kind of banded together.
- 2:22We're going to talk to Secretary Warner about that. Plus, Nitro Mayor
- 2:25Dave Casebolt is here as well. Amelia Nicely is with us. She's an
- 2:30investigative reporter with West Virginia Watch. She's been closely following some of the tragedy
- 2:32situations if on the kids in our state. We're going to talk to her,
- 2:37but we're going to start off on a happy note. Let's bring in
- 2:39officially now. Drum roll please, the James Beard Award winner direct from Chicago,
- 2:46Illinois. Paul Smith. Sheff, Paul, you want it all,
- 2:50buddy, Congratulations, Hey, thanks Dave. I really appreciate it. I'm
- 2:53sorry, I'm outside in Chicago just taking it all in. So it's a
- 2:58little loud. It's gonna have to be with me. Have you had any
- 3:00sleep at all? You know, I slept a little bit. The after
- 3:06party was epic. You know that there are thirty James Beard Award winning chefs
- 3:10and mixologists that are cooking for us, and it was it was surreal.
- 3:16I woke up this morning figure it was a dream, and then my wife
- 3:21pinched me and I realized it wasn't. And I literally had almost six hundred
- 3:27and fifty text messages in my inbox. And that's the beautiful thing about all
- 3:31this. You know that the hardware is great, the win is great,
- 3:36but just the outpouring from our great state West Virginia is amazing. It's it
- 3:45has been a world wind ride. And I was one of those that was
- 3:47texting you and Mass and genm and I appreciate you taking time to join us
- 3:52on the show. I know you're still taking it all in, but I
- 3:54did want to give you the opportunity just to say, uninterrupted by me,
- 3:58whatever's on your mind, whatever you want to say. Well, number one,
- 4:02I want to say thanks to my partners, my teams. You know,
- 4:08Tintin is what restaurant was nominated, but you know, the pitch and
- 4:15all of the restaurants that I am involved with, whether it's consulting, whether
- 4:20it's helping. You know, this, this rising tide that we're all a
- 4:26part of, is raising all of our boats. So I'm just happy to
- 4:29be a little bit of the water in the tide. I I was so
- 4:34humbled with so many businesses that reached out, like Huntington Bank and the Nel
- 4:42Chilton Foundation and you know, Ben Selango and you know it. There were
- 4:51probably twenty different sponsors that allowed us to do this event last night at the
- 4:59Capitol Mark, you know, the Capital Market AARP. I mean, holy
- 5:02cow, it was. It was epic. I mean I saw it for
- 5:06the first time this morning. The reaction of that crowd, it was amazing.
- 5:11Ugly cried, I literally ugly cried. Harry was like, are you
- 5:14okay? And I said, watch this, and you know it's funny.
- 5:18I watched the video of the awards last night, and you know, they're
- 5:24naming the chefs of the Southeast and when they named my name, you could
- 5:29almost hear a pin drop and maybe two or three people clapping that were probably
- 5:32Stephen Keith and Jason Adams and my Sioux chefs and my wife right and then
- 5:39now everybody knows who West Virginia is. Now everybody knows that we are a
- 5:45force to be reckoned with in tourism, in the culinary world. And I'm
- 5:48just happy to be able to leave the charge. So, I mean,
- 5:53we know, you get the award and the recognition is there like a Golden
- 5:56Spatchelor or something that they give you. What goes along with that, they
- 6:00give you a medallion you know, on stage that goes around your neck and
- 6:04it is you know, it is the Culinary Oscars. You know, it's
- 6:12it's an honor to just be you know, Academy Award nominee, James Beard
- 6:17nominee. But to win it, you know, it was it was amazing.
- 6:21You know, there's there's two thousand chefs at Union Station last night,
- 6:27and you know, everyone, not everyone, but so many chefs took their
- 6:32time to say, hey, congratulations West Virginia. Huh, that's amazing.
- 6:39You're doing great things. I've been there, you know. And that's the
- 6:43great thing about West Virginia is once people come here, they they don't want
- 6:47to leave. You know, we have this innate sense of hospitality. You
- 6:51know, you anytime you're out of town and you run into somebody from West
- 6:55Virginia. There were so many people last night that were like, I lived
- 6:58in West Virginia, have been hidden, or I lived in Greenbrier County or
- 7:01whatever, and it was it was just, this is a surreal experience.
- 7:06And you know, I don't do it alone, obviously. You know,
- 7:10my team was on Cloud nine last night at ten ten at the pitch at
- 7:15Ellen's ice Cream and it's just it is awesome to be able to make a
- 7:20difference in people's lives. And usually it's you know, we get to cook
- 7:26for people that have means, that have you know, expendable income that could
- 7:31come in and enjoy our cuisine. But you know, what the James Beard
- 7:35Foundation stands for is inclusion. And I'm so happy that they included geographically.
- 7:44You know, we're not in Chicago, we're not in Atlanta, we're not
- 7:48in New York City, we're not in la We are in Charleston, West
- 7:53Virginia. And it's just amazing that we are in the same conversation and now
- 7:59we're congratulations. I've got a Milia Nicely here with us from West Virginia.
- 8:03Watch he's going to be on immediately after you and I was going to give
- 8:07a Meali, you would like to say hello to the chef pollsman. Hello,
- 8:09congratulations. We're also proud of you, and I loved in your acceptance
- 8:13speech that you talked a little bit about your personal story and what a beautiful
- 8:18representation of West Virginia. So thank you for representing us so well. We're
- 8:22proud of you. Well, thank you so much. And you know,
- 8:24everybody has something going on in their life, whether it's mental health, whether
- 8:30it's addiction, or whether it's just having a bad day. And you know,
- 8:33if someone at the top of their game can talk about it and shed
- 8:37a little bit of light on it and create a you know, a safe
- 8:41place in a restaurant environment like we've created. You know, my door is
- 8:46always open, and I know we all have some things going on in our
- 8:50lives and we can all overcome them. You know, five years ago this
- 8:54wouldn't be possible. But you know, you take you ask for help,
- 9:00you accept help, and then you you know, you take charge and your
- 9:05trajectory starts going straight up. So thank you so much, Cheff Paul.
- 9:09I think you're going to be doing a lot of these type interviews. I'm
- 9:11glad I got to be one of the first and I think Dave Wilson's going
- 9:15to have you on talk line coming up here in an hour. So I
- 9:18appreciate you being here, being here, and again, congratulations from all of
- 9:20us. Man, thanks a lot, Thank you so much for having me.
- 9:24It's a pleasure. Take care all right, Cheff Paul smith the James
- 9:26Beard Award winning Cheff Paul smith Man, meally, is that cool or what
- 9:30I mean? You know Nashville, Atlanta, all these big cities and oh
- 9:35yeah, Charleston, West Virginia. I know it takes it all. And
- 9:37the first time they were able to say West Virginia on the stage, that's
- 9:41amazing. I thought he was going to say at some point, oh West
- 9:45Virginia. Yeah, somebody's gonna say, yeah, I used to live in
- 9:46Richmond. Now you used to live in Rohano. Now we're actually a state
- 9:50where actually Amelia Nicely is here. Uh so, I appreciate you. You
- 9:54put in your your congratulations there. Million Nicely is here. First of all,
- 9:56tell us about West Virginia. Watch about the in the news outlet.
- 10:01Sure so we are a nonprofit news outlet, no paywall, and we are
- 10:05part of State's newsroom. They have a newsroom in every state, mostly focused
- 10:07on politics capital coverage. I have mostly focused on child welfare and education since
- 10:13we started last year. And one of the coolest things about us is that
- 10:18every paper in the state can use our content for free. So our stories
- 10:22regularly are run in the Register Herald, in the Times West Virginian and the
- 10:26Fairmount area and I love that. So we're we're available for anyone to run
- 10:30our content. And how are you funded and be able to do this?
- 10:31Sure? So we are at our corporate level, our state's newsroom, our
- 10:35owners. They do the fundraising and it's donation and grant. We also take
- 10:39donations on our level as well, but it's mostly grants and donations that they're
- 10:43funding us. You know you said that primarily your focus has been child welfare.
- 10:46Well, you've been busy the last couple of months because it seems like
- 10:50Amelia every day there's another story about their growing crisis with kids somehow in the
- 10:54Mountain state. The two that have gotten the most attention probably the tragic situations
- 10:58in Sissonville and also in Boone County. And we know there are more,
- 11:01seemingly more come out every day, but these two, for obvious reasons have
- 11:05gotten the majority of the attention. I'm gonna let you start with either one
- 11:09of those situations in the Sistanmville or the Boone County situation. Now we'll get
- 11:13into some other stuff too, but I'm gonna ask you the sixty four million
- 11:16dollar question, how did we get here? How does this? How do
- 11:18these stories happen? Yeah, we probably don't have time for the full journey,
- 11:22right, Well, wrap it up on Thursday, but go ahead,
- 11:26But I think it's important to note if you didn't if you don't know anything
- 11:28about child welfare, the childwelfare crisis in West Virginia, it is coming out
- 11:35of poverty, it is coming out of the opioia crisis, and we have
- 11:39an overwhelmed child welfare system. The majority of children we have about six thousand
- 11:43kids in foster care right now. The majority of those kids come in for
- 11:46abuse and neglect referrals related to drug abuse or substance abuse in the home,
- 11:52not all, but many, and years of underfunding the problem other issues we
- 12:00have a depleting workforce in West Virginia has resulted and we do not have enough
- 12:03CPS workers to check on children, and we do not have enough foster homes,
- 12:07traditional foster homes to care for children, and so that has resulted in
- 12:11some of these other horrific stories you've heard of kids being left in homes or
- 12:16kids sleeping in hotels, kids sleeping and out of state facilities that aren't safe.
- 12:20And so that's kind of like the big picture of it. These two
- 12:24situations you've mentioned in Sistonville and Boone County are both times where neighbors and even
- 12:31in this case a trooper for the Boone County story have said we have called
- 12:35CPS and no one came out and checked on these children. And it has
- 12:39been a struggle for where I've covered it for four years prior to coming to
- 12:41West Virginia Watch, but ask any reporter here, it has been an absolute
- 12:46struggle to get any information from the Department of Human Services about this situation.
- 12:52And in the Boone County situation, specifically the case of Kennedy, it seems
- 12:56like there has been a whole lot of finger pointing going around, yeah,
- 13:01and that has been difficult to navigate as a reporter. We had a press
- 13:05conference last week. I'm sure you've talked about it at some point on your
- 13:07show, but essentially the Troop Western State Police and Department of Human Services,
- 13:13which oversees child protective services. They're saying, even if that referral had made
- 13:18it to us, it would not have triggered an abuse of neglect investigation.
- 13:22So now lawmakers are focused on changing homeschooling regulations because Kennedy had been being homeschooled,
- 13:28but there was really no one who stepped up and said I could have
- 13:30done X y Z better. And I want to talk about the homeschooling aspect
- 13:33of it here. And I know coming up the Little Show preview next hour
- 13:37that Dave Wilson's in for Hobby this week and he's going to talk about the
- 13:41homeschooling situation. He's got Delagate, Amy Summers and Senator Rucker, I think,
- 13:45are both going to be on separately to talk about that. I had
- 13:48one of my best friend in high school homeschooled her kids and there was reporting.
- 13:54She is in Indiana now, but she was in West Virginia when she
- 13:56homeschooled her kids. There was quite a bit of reporting that she she told
- 14:00me about that was required to do. And I don't know if it's if
- 14:03it's changed somehow, but I mean she may as well been a public school
- 14:07teacher for all the Maybe she just did a little bit more than she was
- 14:09supposed to do. I don't know, but I mean, we seem to
- 14:13have an issue here with this. Yeah, and I think what's going to
- 14:16be really key moving forward, both for journalists and lawmakers who are looking to
- 14:18make good policy, is to understand the scope of the problem. So right
- 14:22now they have four years they have to complete assessments. We know that in
- 14:26Kennedy Miller's case they didn't complete that assessment. That should have triggered some type
- 14:31of truancy investigation. However, the way the law's written now, they didn't
- 14:35have to follow up on it. From everything I'm understanding, but is this
- 14:39a widespread problem in homeschooling. We don't know, and I think that's something
- 14:41that we need to know. How many kids have failed, have their parents
- 14:46fail to turn in those assessments you reference. The press conference was held last
- 14:50week with the Governor's office without the governor, but she was staff. Brian
- 14:52Abraham and others were there. Your thoughts on that press conference, Well,
- 14:58it's the first time we've had an in person press conference at the Governor's office
- 15:01in years, so that was, you know, interesting, But I would
- 15:05say my thoughts were I'm appreciative of the time that we were given. They
- 15:09let us all ask multiple questions. I appreciate that. However, there was
- 15:13a lot of finger pointing, as you said, and there was this tone
- 15:16of we are not going to talk about this anymore, so get all of
- 15:18your questions out now. Well, that's not how news works. We're going
- 15:22to continue to dig and continue to ask questions and follow those public records requests.
- 15:26But I think we all left being a little bit like no one is
- 15:31taking responsibility, and I'm not sure the clear steps moving forward besides altering homeschool
- 15:37laws, which is just one part of her story. And going back to
- 15:41your initial question, as Child Protective Services is very overwhelmed. We've got a
- 15:45lot of issues across foster care. I mean, they're embroiled in an extremely
- 15:48large lawsuit that outlines many problems in the system. I think it's hard for
- 15:54us as journalists to say, how is her case not connected to the foster
- 15:56care crisis at all? And that's still a question that's hanging out there.
- 16:00So what are you looking at? You and others that are covering this,
- 16:02So by the way you've done a fantastic job on it. I think it's
- 16:04you know, and I talked about this on the show before. We're all
- 16:07quote unquote competitors. You know, we have the media in Charleston, from
- 16:11Metro News to the TV stations, yourself and because that mail and whatever.
- 16:15But everybody seems to be kind of on the same page on this. And
- 16:17Leslie Grubin I think when she was on with Hopey talked about that a couple
- 16:19of weeks ago. This is not a thing where we're trying to race to
- 16:22get to the story. I mean, well, we'll do that when a
- 16:25new business is coming to town or something. This is something, Amelia that's
- 16:29far more, far too important to get into that competition between the media outlets.
- 16:33I mean, everybody's pretty much on the same page on these stories.
- 16:37Yes, absolutely, And excuse me. I could pull up multiple group chats
- 16:41with Leslie, with other reporters that are only about this case, where we
- 16:44have been sharing records with one another and cheering one another on and really and
- 16:48we don't have to remind each other of this, but we all feel the
- 16:51same that this is not about us. You know, you might have seen
- 16:52there have been attacks on reporters from the administration for covering this case. There
- 16:57were comments made that well press conference, for example, Brian Abraham said something
- 17:02like, well, the only reason we lied or misspoke. I don't think
- 17:04he said lied, but the reason we misspoke is because you all were asking
- 17:07us too much, too many questions. Well, that's our job, and
- 17:11what better important question than following up on the death of a child. So
- 17:17we are not competing on this. We're trying to push each other to continue.
- 17:19And while that press conference certainly marked a significant part in this story,
- 17:25it is not going to be the end for us, because there are other
- 17:27children like Kennedy out there that we need to make sure that. When I
- 17:32think, for me, the biggest question moving forward is when someone calls CPS,
- 17:36do we know that someone is answering the call, logging the referral and
- 17:40going out to check on them and to bring back up Sissonville. Through a
- 17:44public records request, I found out that they did indeed have a referral for
- 17:48the kids who were locked in a shed without a toilet or running water,
- 17:52but they could not produce a single travel record for months showing that they ever
- 17:56checked on these kids before the police found them that a tragedy, and now
- 18:00we're seeing that some of that same stuff in Kennedy's case. So I think
- 18:03that's the biggest question moving forward is what documentation And I've asked EHS that what
- 18:10can you give me that can show me that when a mandated reporter or a
- 18:14neighbor calls your hotline, that somebody will answer the phone and go check on
- 18:18the child. Bill Nicely, we got to leave it there for West Virginia
- 18:21watch. I appreciate you being here, Thanks a lot, Thank you.

- 22:08I appreciate that. In fact, we had about every position was unopposed
- 22:14except for our Council at large. We had four people run for that position
- 22:17and the community ended up electing the three incumbents, Andy Shamblin, Bill James
- 22:22an Emily bar So it was another very quiet election, to say the lee.
- 22:26It was. Indeed. Now I do want to talk about Rita Cox.
- 22:30Miss Cox had been the recorder there for some time in the city.
- 22:33In fact, I worked with her when I was working for the Secretary of
- 22:36State's office. She opted to retire and rich highly ran ran for that seat
- 22:41unopposed and was voted in. But she was a treasurer in your town,
- 22:44sir, she was our recorder. Yes, and I'll tell you what she
- 22:48was the wisdom whatever I need, some wisdom. That's who I went to.
- 22:51Rita is a very smart person and we're going to miss her. I
- 22:55hate to see her lee, but Rich'll step in and do a fantastic job.
- 22:57We are sure that. So, I guess it's fair to say that
- 23:02citizens and others in Nitro must be pretty happy Mayor with what's been going on
- 23:06there. Well, I'll tell you, Dave, we just have a fantastic
- 23:10staff, fantastic employees who are dedicated, dedicated, hard working. They're deeply
- 23:18appreciated by our community. I think the community sees how hard our employees work,
- 23:23and they our community does a fantastic job of electing city council members too.
- 23:30I'll tell you what I've been involved in city government for. Well,
- 23:32this'd be my twenty fourth year, and I'm going to tell you I have
- 23:36never seen a city council that works as hard as Nitro City Council. They
- 23:40are out in the community every day, involved with our youth, involved with
- 23:44our seniors involved with recreation, just doing things to make life better for the
- 23:49citizens of Nitro. We just have a fantastic council and the community sees that
- 23:55they see how hard they work and they're deeply appreciative that. Talk about the
- 23:59levee in thispal levee you had that was approved, right, Yeah, that
- 24:03was approved. I think it was approved that eighty or eighty one percent.
- 24:07In fact, I think most of the municipal levees were approved. I think
- 24:10that's a pretty pretty strong indication that most people in the cities are approved of
- 24:17how the money is being spent. So, uh, it was it was
- 24:21you know, ours was approved pretty easily. I want to talk about what's
- 24:25on the horizon, Mayor, as you begin your new term for the city
- 24:29of for your city of Nitro. What are some what are some big things
- 24:33that you and the council and the citizens can look forward to. Well,
- 24:36I will say this, this will be my last four years. I've now
- 24:38set to just about everybody, well at least all city council knows that this
- 24:45will be my last four years. But we do have quite a few projects
- 24:48that we're working on now that we need to complete. Project at the Lake.
- 24:52We have a lot of city improvement, city park improvements that we need
- 24:55to complete. We're looking at putting in some electric car charging station, creating
- 25:00new investment through our property tax held properties acquisitions. Got a new pickleball court
- 25:07cover we need to put over that, and we think we can attract a
- 25:11lot of big termaments with that. So we got a lot of things on
- 25:15the horizon that we're looking at that we help to get done the next four
- 25:18years. I will say this day that I think a big part of our
- 25:22success is how we involve the community in our planning. They whenever for a
- 25:29future planning, we always we always encourage citizen input and we take their ideas
- 25:33and we listen to them, we value those ideas and then we incorporate them
- 25:37into our planning. So the community is just as big as part of our
- 25:41success as anything else. All right, Well, you guys do some fantastic
- 25:45things there in the city of Nitro. I appreciate you. Of course,
- 25:48you just had to run for the wall there a couple of weeks ago,
- 25:52and I know you get the big pickleball event happening real soon. Johnny Rutherford
- 25:55knows, folks, So wish you the best of luck with everything, and
- 25:57you're always welcome on the show. Mayor congraduates on your win, and everyone
- 26:00else is there and we'll talk soon. Buddy, thanks a lot, Hi,
- 26:03Dave, thank you man. Take care. That is Dave Caseball,
- 26:07the mayor of Nitro. I don't know if that was breaking news or not
- 26:10that he said he's this is the last term he's done after this. He's
- 26:14done a great job there, I think, is the mayor. I think
- 26:15people in Nitro would probably agree with that, and but this is it for

- 31:04Mac Warner on the show, Secretary, good morning, welcome back, Hey,
- 31:07good to be with you, Dave. Before we get into the reason
- 31:11you're here today, there's a lot of focus, of course on the primary
- 31:14elections last month and now looking to add to the November general, but there's
- 31:18still a lot of elections going on around the state even today. I heard
- 31:22on the air this morning of the Morning I think Martinsburg is one of the
- 31:25cities that's having an election today. Generally speaking, the first two tuesdays of
- 31:29June. There are a lot of municipal elections around the state. I know,
- 31:32as I said, Nitro just had one. Just talk to Mayor Dave
- 31:33Casebold, who was re elected to a fourth term. So there's a lot
- 31:37of municipal elections going on around the state today. We don't want to forget
- 31:41about those there are. The legislature recently has moved to try to make these
- 31:47aligned with the general elections, the normal elections, but states or cities have
- 31:52their own charters and so forth. So yeah, so, and that's important
- 31:56why sports for talk radio shows that get information out people to keep the interest
- 32:00the attention on these elections as they occur, because those local elections are the
- 32:05ones that are the most important. So I'm glad you're talking. Yeah,
- 32:09there's quite a few round the state today. And I'll get to this too.
- 32:13I touched on this just a little yesterday, and I know, having
- 32:15worked in the office, that there's not a whole lot you can say about
- 32:19the hint of an investigation, but there are people raising some questions Secretary about
- 32:22some particular voting, the regularities in the primary and the recent Mingo County election.
- 32:27I don't know. You may not be able to say anything at this
- 32:30point, but do you care to make a comment. Just we were aware
- 32:34of these situations, we are on top of that. We've been doing what
- 32:37we're allowed to do or supposed to be doing. And as you said,
- 32:40we can't talk about investigations, but people should know that it is we have
- 32:45gotten our attention, We're on it, and we'll see how this thing plays
- 32:50out very good. Talking to Secretary of State Mac Warner, we posted a
- 32:52story Secretary over the weekend that you and Secretary of the State from a few
- 32:57other states Arkansas, Indiana, Louisiana, Mississippi, Montana, New Hampshire,
- 33:01Tennessee, and Wildbean, some of you have issues with what you say is
- 33:06an attempt by the Biden administration to federalize elections. How So, yeah,
- 33:12I'm really glad that you're raising this because another example where West Virginia is leading
- 33:15the nation in election integrity and security, and we have these other states that
- 33:20you just mentioned joining in on us. And where this comes from is a
- 33:22case that came came out of Pennsylvania where a number of legislators, about twenty
- 33:28eight legislators in Pennsylvania sued on the same premise that we've been talking about now
- 33:34for three years, and that is the federal overreach where the Biden administration is
- 33:37trying to take over the running of elections and time states how to run the
- 33:43election, and it's contrary to the US Constitution. There's an election cause in
- 33:46the US Constitution, Article one, Section four. It's the time, place,
- 33:52and manner of elections shall be left the state legislatures. And so this
- 33:57case in the particular has two interesting components to it. Noticed that word in
- 34:00there shall be left to and then state legislatures. And so the issue that
- 34:06came out of this Pennsylvania case is the district court in Pennsylvania tossed the case
- 34:12out saying that these individual legislats tours didn't have standing. The legislature did that
- 34:16not the legislate tours, So the individual people, these twenty eight people.
- 34:21So that's what was thrown out, and they appealed and they went straight to
- 34:24the Supreme Court. And that's where we have now going in leading these other
- 34:29eight states saying we agree, and what we're asking the US Supreme Court to
- 34:34do is to side on the merits, not understanding the issue that the came
- 34:38out of Pennsylvania, but the actual issue, and that is that the general
- 34:43government should not be reaching in and telling states how to run their elections.
- 34:46And so what happened we saw in the twenty twenty election was the unusual situation
- 34:52that came with COVID, the mail in ballots, that dropped boxes, accepting
- 34:57ballots without signatures, accepting ballots after the election was over. Those were issues
- 35:01that they tried to federalize. They tried to do that with HR one,
- 35:06if you might know it, two or three years ago, but it came
- 35:08up in the House and the Senate and it was defeated, that very narrowly
- 35:13defeated. And again West Virginia played a key role with our senators being involved
- 35:17in that. So now they have tried to take it out of that congressional
- 35:23where it should be the congressionally decided issues and turned it into an executive order
- 35:29to the President. President Biden said, we're going to turn all six hundred
- 35:32federal agencies into get out the vote senators and so things absurd as says the
- 35:40Department of Agriculture with their borrowing and loan guarantee programs, that they would now
- 35:47hand you a voter registration form and say you ought you want to fill this
- 35:53out, Or the Environment of Education with student loans and work study programs handing
- 35:58you a voter registration. Department of Treasure were tax assistance, Well here's the
- 36:04one. The Immigration Services, Homeland Security would be handing uniform So all those
- 36:13sorts of things are just or if you come out of prison or you go
- 36:16into fit federal prison, they would encourage you to register to vote. Well,
- 36:22we don't think that that should be part of the system. This is
- 36:24supposed to be lester the states. And so that's where we've led this effort
- 36:30to get the other states to join in and say, federal government, you're
- 36:35overreaching. This is supposed to be lefter the states. And that's what we're
- 36:38asking the Supreme Court to decide on. What's Regina Secretary of State mac Wanner
- 36:43again, So basically, what I'm hearing you say not devot word. If
- 36:45you're saying hands off our elections, that's what you and the other Secretary of
- 36:50the States are saying. Right, we are that the Constitution clearly says that
- 36:53it's left to the to the to the states, not to anybody else,
- 37:00not the government, not the federal government, not the governors, no one,
- 37:04not the attorney generals. It's left to the state legislatures. And so
- 37:07when our state legislature says you will have voter ID, that's what they mean.
- 37:12In the federal government. The president shouldn't be able to come in and
- 37:15say Nope, you don't need vot ideas, or you can accept ballots without
- 37:19signatures, or you can use drift boxes. That's a state prerogative. Let
- 37:23us decide how to run our states. And that's what's very clearly in the
- 37:27Constitution, and that's why we're leading this effort to say hands off. It's
- 37:31somewhat akin to if you remember the doctor Bucks situation. We don't want our
- 37:37elections being run by Google, Facebook, Twitter, you know, x whatever,
- 37:42coming in and sponsoring elections in the state and giving us hundreds of millions
- 37:45of dollars to run our elections to say we're they're particular candidate, just like
- 37:50we don't want large corporations to run the elections. Who don't want the federal
- 37:53government, whether it's Republican Democrat, I don't care. I don't want them
- 37:58to get out the vote. You in federal tax dollars to favor one side
- 38:04versus another. Let the states run it. We've been perfectly capable of doing
- 38:07this for two hundred and fifty years. Leave us alone and don't try to
- 38:10overreach and tell us how to run our election. And you're hoping this will
- 38:15get to the Supreme Court. You any other secretary of the state, is
- 38:16that right now? Well, we have a wonderful General Counsel, Dave Cook
- 38:20in our office wrote the anarchust free and the other states now have liked his
- 38:24work and signed on. I've tribute to shout out to Dave Cook and Winter
- 38:29for he's done in our office and just a tremendous job writing this brief and
- 38:35these states assigned on. It has now been filed with the Supreme Court,
- 38:37and we're asking us because of the importance of this with this twenty twenty four
- 38:42election. We want them to decide the case right now in the face they
- 38:46throw it out, save that the President cover reached in this situation executive order
- 38:52it's a one four zero one NAT and say that's unconstitutional in Spreme Court shops
- 38:57also that throw it out. Talk you, Secretary of State Macwarner. Before
- 39:00we let you go, I want to switch gears for a moment. It
- 39:02was a hard fought campaign Secretary for Governor. In the end, Attorney General
- 39:07Patrick Morrissey defeated former Delegate more capital yourself and out of dealer Chris Miller to
- 39:12gain the Republican nomination for governor. Morrissey will now face honey to Mayor Steve
- 39:15Williams in the fall. Is it in your opinion? Time now for Republicans
- 39:21to get behind Patrick Morrissey, and will you yourself be supporting Patrick Morrissey for
- 39:24governor. Absolutely, And let me just clarify this. This is in my
- 39:30role as mac Warner private citizen, yes, governor whatever, not as Secretary
- 39:35of State. So just as I didn't, I've never endorsed anybody because of
- 39:39my situation as Secretary of State. So I have to maintain that separation in
- 39:44my role as Sectuary of State. But as a Republican, there are policies,
- 39:49there are ways to run government, and that's Patrick Morrissey's and I see
- 39:55things very much alike. And so in that regard, I support Patrick Morrisey,
- 40:00the Republican candidate for governor. I am behind him, and I just
- 40:06want to be very clear to everybody, but that is not an endorsement in
- 40:08any way that would say I can't fairly decide should an issue arise with a
- 40:15voting state, but we have gone in Bingo County or some other situation like
- 40:19that. I intend to be able to execute my duties as Sexuary Estate unencumbered
- 40:24by an endorsement. That's what I think. So I am supportive of Patrick
- 40:30Morrisey, think the Republican candidate and the principle that he and I believe in
- 40:35very very much alike. So I hope, yeah, yeah, And again
- 40:38I want to make sure maybe that was an unfair question on my part.
- 40:42I want to make sure people realize that it was too that I was asking
- 40:45that of Macwarner, not as a not of Secretary of State Macwarner. You
- 40:50have to be two different people at times when you work in that office.
- 40:52Secretary is always it's a pleasure to talk to you, and we'll talk against

- 41:07Yeah. I wanted to make sure we drew that distinction there because he
- 41:10was actually on the show. That's kind of on me. He was here
- 41:13to talk about Secretary of State business, and I kind of threw a little
- 41:15curve ball at because I just kind of wanted to see I mean, you
- 41:19know, we've heard all this stuff about certain members of the Republican Party wanting
- 41:23Joe Manchon Independent Joe Manchon to now get into the race, and you know
- 41:30that talk is coming from somewhere, and I had a feeling it was not
- 41:32coming from Mac Warner. But I just kind of wanted to clarify that because
- 41:36I know there's a big effort right now on behalf of Patrick Morrissey and others
- 41:38to try to get everybody. Obviously it's happened in every other election, to
- 41:43get everybody behind their candidate. There are some people, I think within the
- 41:45Republican Party some and I don't know that there are any of the people I
- 41:50mentioned that were candidates in the primary, but there are some who aren't exactly
- 41:54enamored with with Patrick Morrison. Possibly would like some to get it, but

- 48:04a battle amongst firefighters at the Tyler Mountain Volunteer Fire Department now at least ten
- 48:10members. This is according to jeff'sory. At least ten members from Tyler Mountain
- 48:15have resigned their positions. The Canawah County Commission issued a statement about it,
- 48:21which you can read as part of Jeff's story. In effect, it says
- 48:23that the residents and businesses will continue to be served and will not be understaffed
- 48:30now. The Commission says they have arranged to have departments from Dunbar Institute,
- 48:35Cissonville, Nitro, and Westside to help out. I don't know exactly,
- 48:39maybe even get an update on the next couple of days. No word exactly
- 48:43what the exact issues are there, and again you can read more about it
- 48:47on JEFF'STORYWV Metro News dot com. But I will gladly make time on the
