- 7:41Speaker 9: sit back, We're gonna talk, We're gonna I'm gonna ask
- 7:43Speaker 9: him some questions about his about the wrong for conviction
- 7:50Speaker 9: that he's been facing. He's been incarcerated for the last
- 7:54Speaker 9: fourteen years for a crime that he didn't commit.
- 7:58Speaker 6: So with.
- 8:03Speaker 9: Well, no more talking for me because I'm a little nervous.
- 8:07Speaker 9: I have wine on the phone.
- 8:10Speaker 7: Wine.
- 8:11Speaker 6: Oh hello.
- 8:14Speaker 9: So I was just sharing with everyone about the wrong
- 8:17Speaker 9: for conviction and first I would like for you to
- 8:22Speaker 9: get them a little insight on you let them know
- 8:30Speaker 9: who win Johnson.
- 8:31Speaker 6: Is well won. Johnson is for one.
- 8:40Speaker 9: Uh.
- 8:41Speaker 6: I want to thank you for around me to use
- 8:44Speaker 6: your platform to get my message out on this wrong
- 8:49Speaker 6: for conviction, first and foremost warn Johnson four years old,
- 8:55Speaker 6: born and raised in County, California. I am a fire
- 9:00Speaker 6: of seven children, five grandchildren. I have my own businesses.
- 9:06Speaker 6: When I was when I was out in the world,
- 9:10Speaker 6: in the free world, our own mom brobecue spot, and
- 9:16Speaker 6: also drove over the road truck. I drove over the roads.
- 9:23Speaker 9: Okay, you sound just as nervous as I do. So
- 9:27Speaker 9: we just we just gonna just go like we normally
- 9:31Speaker 9: just talk.
- 9:32Speaker 6: So okay.
- 9:33Speaker 1: In July.
- 9:37Speaker 9: Of twenty nine, twenty on nine, am I correct, tell
- 9:45Speaker 9: us what happened that day. Let let us know what
- 9:49Speaker 9: Let the listeners know what happened. I want to start
- 9:53Speaker 9: from the beginning and then we get into the meat
- 9:56Speaker 9: of the of how everything you know, start from let
- 10:02Speaker 9: the listeners know how everything went down, and then we'll
- 10:05Speaker 9: take on to the the trial.
- 10:10Speaker 6: Well, July twenty first, two thousand and nine, was William,
- 10:15Speaker 6: the worst.
- 10:15Speaker 8: Day of my life.
- 10:17Speaker 13: I was uh, I was uh picked I was picked up.
- 10:23Speaker 6: I was picked there for my place of business and
- 10:27Speaker 6: taken into custody for homicide which a person lost his life.
- 10:33Speaker 6: His name is Roberto human As, and you know, my
- 10:36Speaker 6: heart goes out to his family. I was arrested for
- 10:41Speaker 6: for homicide which I did not commit, and even the
- 10:45Speaker 6: Julia twelve said that I did not commit.
- 10:49Speaker 9: Okay, so we're going to get to that part. So
- 10:52Speaker 9: to day that that you're was arrested. Were that was
- 10:57Speaker 9: there a warrant did they have for warrmth for are
- 11:01Speaker 9: your arrest?
- 11:04Speaker 6: Uh No, it wasn't. It wasn't a one out for
- 11:06Speaker 6: my arrest. I was picked up, and I guess the
- 11:09Speaker 6: detective was hoping I had any information, which I didn't
- 11:16Speaker 6: when he when he when I was picked up.
- 11:20Speaker 9: So basically, they wanted you to make up a story
- 11:25Speaker 9: or give them some information or or what you know,
- 11:31Speaker 9: can you explain that a little more for me.
- 11:34Speaker 6: Or you know, when I was I was asked by
- 11:38Speaker 6: the detective or I was told by the detective, okay,
- 11:43Speaker 6: you know, pretty much he wanted me to implement myself
- 11:48Speaker 6: in a crime that I did not commit. So pretty
- 11:51Speaker 6: much he was saying, uh me him, which is a
- 11:53Speaker 6: detective on this case, wanted me to uh implement myself
- 12:00Speaker 6: give him some information on this case, which I didn't
- 12:04Speaker 6: have any, and he said, may he say the first
- 12:08Speaker 6: horse to the finish line wins the race? So many
- 12:10Speaker 6: he's saying that anyone that offered him information pretty much
- 12:15Speaker 6: will be charging the people that was involved in this case. Also, uh,
- 12:20Speaker 6: didn't never get charged in this case because again he said,
- 12:25Speaker 6: the first horse to the finished life wins the race.
- 12:29Speaker 9: Okay, So since you didn't have no information, they went
- 12:36Speaker 9: to the next to someone else, he broke up. Since
- 12:42Speaker 9: you didn't have no information to give them, he went
- 12:45Speaker 9: to someone.
- 12:46Speaker 6: Else, He went to someone else. Yes, and I ended
- 12:49Speaker 6: up with the charges.
- 12:51Speaker 9: And what was the charges?
- 12:55Speaker 6: First degree murder after delibrace and first agree feeder the murder.
- 13:00Speaker 9: Okay, So with that with them two charges, how long
- 13:08Speaker 9: did it take them to get you before the judge?
- 13:13Speaker 9: Before your trials actually started?
- 13:19Speaker 6: It took believe like the close of two years for
- 13:23Speaker 6: me to go to my first trial. And then my
- 13:27Speaker 6: first trial was a mistrial, and I believe it was
- 13:31Speaker 6: like four four months later, made of September, like four
- 13:37Speaker 6: or five months later I had my second trial which
- 13:40Speaker 6: I was found not guilty of first three murder after deliberation.
- 13:44Speaker 6: But I was found guilty of Saurny murder.
- 13:47Speaker 9: Okay. So you said it took you almost.
- 13:53Speaker 6: Twenty seven months altogether for both trials. For me to
- 13:57Speaker 6: be convicted took twenty seven months.
- 14:00Speaker 9: Twenty seven months. So why did it take so long
- 14:02Speaker 9: before before the first trial started? Why did it take so.
- 14:08Speaker 6: Long the first Well, the witness that was in this
- 14:15Speaker 6: case had a fair case that he was that he
- 14:20Speaker 6: was arrested for, and they wanted to see where the
- 14:24Speaker 6: detectives offer him a deal too, pretty much implement me.
- 14:29Speaker 9: In this case.
- 14:30Speaker 13: And I found all that out in the interrogations that
- 14:34Speaker 13: he had, so pretty much my lawyers wanted to wait
- 14:38Speaker 13: to see what the deal was before we end up
- 14:42Speaker 13: on the trial.
- 14:44Speaker 9: Okay. So you said that your first trial was a
- 14:48Speaker 9: mistrial because lack of evidence, no evidence, Okay, So we
- 14:57Speaker 9: went to So you get to the second trial. The
- 15:00Speaker 9: day of jury, the day they was picking a jury.
- 15:04Speaker 9: What was going on outside of the court the day
- 15:07Speaker 9: they was picking jury?
- 15:10Speaker 6: Uh well, around lunch time. When on when the when
- 15:14Speaker 6: the jaugs dismissed the potential jeels for lunch, it was
- 15:18Speaker 6: a rally going on outside on the courthouse. Uh, in
- 15:23Speaker 6: the on the courthouse steps. It was a rally, uh
- 15:27Speaker 6: speaking about murder victims. So they were having a rally
- 15:33Speaker 6: speaking on uh, how to put murders away for life,
- 15:39Speaker 6: unsolved murders and uh so on and so forth. It
- 15:43Speaker 6: was a rally for victims of murder.
- 15:46Speaker 9: So with the rally going on outside of the court,
- 15:50Speaker 9: and then jury was on lunch, did your lawyer participant
- 16:00Speaker 9: or go to the judge and ask them to look
- 16:04Speaker 9: into that or you know, to throw out that that
- 16:07Speaker 9: jury because I would think that the jury is tainted
- 16:10Speaker 9: with the pro the protests that's going on outside the court.
- 16:17Speaker 9: So you know what what happened? You know, let us
- 16:21Speaker 9: know what happened.
- 16:23Speaker 6: Well, we came back in. Well when when when everybody
- 16:27Speaker 6: came back in after once my attorneys went to well, actually,
- 16:33Speaker 6: judge can't approach. They went and approached the judge and
- 16:37Speaker 6: and and let her know that it was a rally
- 16:39Speaker 6: going on outside, and they they petitioned her to dismiss
- 16:44Speaker 6: this jury pool because they wasn't sworn in yet, so
- 16:48Speaker 6: it wasn't prejudiced on either side, so it wouldn't have
- 16:51Speaker 6: hurted anything to dismiss this jury pool and come back
- 16:57Speaker 6: another day. So my lawyers were saying that I wasn't
- 17:00Speaker 6: going to get a fair trial, but the judge refused
- 17:03Speaker 6: to and her name was Christine Hoppis, that was the
- 17:06Speaker 6: judge on my trial. She refused to give to dismiss
- 17:10Speaker 6: this jury pool and said that she would just ask
- 17:15Speaker 6: certain individuals or over half her were out there at
- 17:19Speaker 6: this rally. Just watched the whole rally throughout the whole
- 17:22Speaker 6: lunch period, which was like an hour, hour and a half.
- 17:27Speaker 6: But the judge refused to dismiss the pool and just
- 17:31Speaker 6: said that she would ask by a raise of hands,
- 17:33Speaker 6: who get an effect over like I said, over half
- 17:37Speaker 6: of them. It was seventy two, seventy two people or
- 17:41Speaker 6: seventy two potential judgs there in the courtroom, and over
- 17:44Speaker 6: half of them raised their hands as saying that they
- 17:47Speaker 6: seemed through trial.
- 17:49Speaker 8: And it went on from there.
- 17:51Speaker 6: So she started then she asked how many did it effect?
- 17:55Speaker 6: Multiple raised their hands. We end up going into to
- 17:59Speaker 6: the chamber and she asked them, you know how it
- 18:02Speaker 6: affects you and different things like that. Five of them
- 18:07Speaker 6: said that it really affected and they they was dismissed.
- 18:11Speaker 6: The other one said that they can uh be partial. Uh,
- 18:17Speaker 6: But at the same time, I have Casewater said that
- 18:20Speaker 6: if one drill was affected, potential drill was affected, all
- 18:25Speaker 6: of them were affected and you must get rid of
- 18:27Speaker 6: all of them. But she refused to do that.
- 18:30Speaker 9: Did she give up? Did she give a reason why
- 18:34Speaker 9: she wasn't going to just dismiss the.
- 18:39Speaker 6: The jury, the potential jurors. Yes, No, she just she
- 18:44Speaker 6: dismissed the five but said that they couldn't that they
- 18:48Speaker 6: were affected by it. They was a couple of them
- 18:51Speaker 6: was crying and the air and the champe and everything.
- 18:54Speaker 6: But she just said that, Uh, she wentn't gonna dismiss
- 19:00Speaker 6: because she wasn't fit the start a new trial. But again,
- 19:03Speaker 6: if you if they always out there and see it,
- 19:06Speaker 6: they're human beings and speaking on the murders, it has
- 19:11Speaker 6: an effect on people and when they when they when
- 19:13Speaker 6: they're out there rallying it, it's speaking of how to
- 19:17Speaker 6: put murders away for life because some people got away
- 19:21Speaker 6: with it. Some people wouldn't, uh think the murders that
- 19:24Speaker 6: was the victims of the rally having their cases wasn't closed.
- 19:30Speaker 6: And so by me being on trial for murder, it
- 19:35Speaker 6: affected the jilly from.
- 19:37Speaker 9: Day night okay, So let's start with your charges. You
- 19:46Speaker 9: said that your first charge was murder first okay, and
- 19:55Speaker 9: the second charge was.
- 19:58Speaker 6: Second charges first murder, which was Setny murder. So it's
- 20:02Speaker 6: a A B. That's what makes them different. Okay, they'll
- 20:06Speaker 6: run the same, well learning the same. Uh. The first
- 20:11Speaker 6: we know how the deliberation is the actual.
- 20:13Speaker 8: Body well that's been murdered, uh, which.
- 20:18Speaker 6: Would be a murder happened in the commission of a suddenty,
- 20:24Speaker 6: which makes it Setny murder.
- 20:26Speaker 9: Okay. So during your trial, now we we we're we're
- 20:30Speaker 9: fens to going to the trial. As during your trial,
- 20:36Speaker 9: when the witness was on stage, I mean up on
- 20:42Speaker 9: on a witness stand, did he mentioned to the that
- 20:49Speaker 9: he fabricated anything when the detective came to him, because
- 20:58Speaker 9: I was reading into your transcripts and it was they
- 21:04Speaker 9: were saying that that the witness and his wife made
- 21:11Speaker 9: up stories before the detectives came to to pick him up.
- 21:19Speaker 6: Uh. Yeah, when he was in his interrogation. And also
- 21:24Speaker 6: understand he admitted to Ryan and making up stories so
- 21:28Speaker 6: that he wouldn't get in trouble just throughout his whole
- 21:33Speaker 6: his whole time, I mean his own interrogation with the detective. Uh,
- 21:38Speaker 6: he was, he was swy. Well, he made up stories
- 21:42Speaker 6: and if he felt right the detective was believing him,
- 21:46Speaker 6: he would stick with that story. But when the detective
- 21:48Speaker 6: would jump down on curs out him and everything and
- 21:51Speaker 6: said that he was ring, he would change his story
- 21:54Speaker 6: to something else. This is what he was staying on
- 21:57Speaker 6: the stand. But he made up stories throughout the whole
- 22:01Speaker 6: uh uh interrogation. He's speaking misunderstand when he said at
- 22:07Speaker 6: he's making upstairs, you admitted to lion. Uh admitted to
- 22:12Speaker 6: just fabricating everything. And so because because he was facing
- 22:19Speaker 6: an indictment, he had been invited on the floor to
- 22:22Speaker 6: fill case. So he was looking for a deal.
- 22:26Speaker 9: So also in your transcripts, it says that it said
- 22:33Speaker 9: that the the the camera was cut off and when
- 22:37Speaker 9: it was interrogating the witness, but the volume was the
- 22:46Speaker 9: still the volume was still.
- 22:50Speaker 6: Okay. So yeah, so pretty much the detective tone uh
- 22:55Speaker 6: toe rover was operating the camera the time the camera up,
- 22:58Speaker 6: but the the the audio was still on and the detectives.
- 23:03Speaker 8: Tell him, hey, you you must say it like this.
- 23:05Speaker 8: We only friends in this and you need to.
- 23:08Speaker 6: You need to say exactly what we're telling you to say,
- 23:12Speaker 6: so you need.
- 23:12Speaker 9: To do it this way.
- 23:13Speaker 6: Pretty much coherciony uh uh uh pretty much telling him
- 23:19Speaker 6: what to say in this trial. Uh, you know, in
- 23:23Speaker 6: this terrogation.
- 23:24Speaker 9: Okay, so much.
- 23:27Speaker 6: So.
- 23:28Speaker 9: I also read that his wife said that he called
- 23:32Speaker 9: he called them and asked them, asked her to leave
- 23:36Speaker 9: the house.
- 23:39Speaker 6: Uh from what I from what I learned over my
- 23:42Speaker 6: research and my cases. But the drug build went down, Uh,
- 23:50Speaker 6: the vile the witness is actually the one that I
- 23:54Speaker 6: believe pulled the trigger to kill this guy, and he
- 23:58Speaker 6: killed his friend to keep the money that was involved
- 24:00Speaker 6: in the whole drug bill. Ah. And when that happened,
- 24:06Speaker 6: he thinks he's not knowing that he's that he's deceased
- 24:09Speaker 6: at this time. So he ended up, uh I guess,
- 24:13Speaker 6: getting up getting the phone or getting the phone and
- 24:15Speaker 6: calling his wife to get out of the house because
- 24:19Speaker 6: he didn't know where he went after he's been shot.
- 24:21Speaker 6: So throughout all that, throughout all that incident, he was
- 24:27Speaker 6: he told his wife and all this is in the transcripts, uh,
- 24:32Speaker 6: to get out of the house and go to his
- 24:33Speaker 6: mother's house with stay down the street.
- 24:36Speaker 10: Uh.
- 24:36Speaker 6: Later on, when they found out that that Roberto was deceased.
- 24:40Speaker 6: They ended up going back home. Uh, I believe made
- 24:45Speaker 6: up stories over the month, the month that he was
- 24:48Speaker 6: before he was interrogated, Uh, and go back to work
- 24:52Speaker 6: as nothing happened, just living his life.
- 24:57Speaker 9: Oh wow. So when the victim's wife got on the stage,
- 25:07Speaker 9: I also read hers, and my heart goes out to
- 25:12Speaker 9: her where she was saying that they asked her, how
- 25:19Speaker 9: did your husband sound? Did he sound like he was
- 25:24Speaker 9: in any distress or anything? How did he sound? And
- 25:29Speaker 9: she said normal that you know, he wasn't under no
- 25:34Speaker 9: distress or anything. So I also read that the witness
- 25:46Speaker 9: said that you Jan Johnson did not rob him, but
- 25:58Speaker 9: my but you was charged what you uh, felony murdered
- 26:04Speaker 9: and under my stand in Colorado murders felling, the murder
- 26:09Speaker 9: statue is that you have to commit a felony in
- 26:13Speaker 9: order to be convicted of felony murder? Am I right?
- 26:22Speaker 9: Or am I wrong?
- 26:24Speaker 6: So so pretty much when he's understand, I mean, when
- 26:29Speaker 6: she's understanding, I'm gonna talk about, is uh Roberta's white first?
- 26:34Speaker 6: When she was understand it was waiting first?
- 26:39Speaker 14: When when uh the witnesses understand, He's saying but me
- 26:46Speaker 14: and Roberto was fighting over the door to for me
- 26:50Speaker 14: to get.
- 26:50Speaker 6: Access into the car, which is another writing made up.
- 26:53Speaker 6: Uh so. And he was on the phone at this
- 26:57Speaker 6: time with his wife, uh and so when they asked
- 27:01Speaker 6: her life, how does he sound when he got off
- 27:04Speaker 6: the town, she said that he was after he was mama,
- 27:08Speaker 6: he said, I love you, just a baby and our
- 27:11Speaker 6: behind some she said, hurly because the food is cooked
- 27:16Speaker 6: food for you. That's what she said.
- 27:17Speaker 14: I understand.
- 27:18Speaker 6: So there was no fighting over the door because, like
- 27:21Speaker 6: I said, this is another story made up. Yes, I'm
- 27:27Speaker 6: gonna have to tell you like that. Okay.
- 27:32Speaker 9: So right now I am talking to my husband, Jayan Johnson.
- 27:39Speaker 9: He's currently incarcerated in Denver on a road. I it
- 27:49Speaker 9: kind of reading his transcripts and talking through to him.
- 27:56Speaker 9: It's unbelievable. It's unbelievable when you have a detective saying
- 28:04Speaker 9: that the first person to the that that gives that
- 28:11Speaker 9: that implements someone wins instead of going basing off the truth.
- 28:21Speaker 9: You have no search warrant. You never went to the house,
- 28:25Speaker 9: went to his house or his business to see if
- 28:33Speaker 9: if if you can find any evidence putting him on
- 28:37Speaker 9: a scene or or anything. You know, It's just it's
- 28:43Speaker 9: just mind bobbling and I just didn't understand it. I
- 28:50Speaker 9: just don't understand it. Wand you're back, Yeah, So I
- 28:59Speaker 9: was just you know, just share my little thoughts. You know,
- 29:04Speaker 9: I'm still a little nervous, and you know, this is
- 29:06Speaker 9: our first time really speaking like out like this. But
- 29:14Speaker 9: it just it's just mind boggling when you know, reading
- 29:19Speaker 9: your transcripts and talking to you, listening to your your
- 29:25Speaker 9: case and stuff, how you can actually be charged with
- 29:31Speaker 9: felling me murder and the witnesses on the stand saying
- 29:36Speaker 9: that wine didn't rob me.
- 29:41Speaker 6: Yes, he said that, and so so these understand and
- 29:46Speaker 6: they asked him, uh, you know the wine, Josh and Robbie.
- 29:51Speaker 6: He says no. So that would be one of the
- 29:53Speaker 6: elements that has to be proven in the court, in
- 29:57Speaker 6: the court the prosecution, and.
- 30:01Speaker 8: By me not being ever being charged with the robbery, I.
- 30:05Speaker 6: Never defended his robbery, which is one of the elements
- 30:08Speaker 6: again for fellerily murder. So it has to be. And
- 30:12Speaker 6: I am built. If I'm money, I can lead with
- 30:16Speaker 6: the Colorado family murder. Ruse states where the prosecution must
- 30:21Speaker 6: prove to render a conviction of femerally murder in Colorado,
- 30:25Speaker 6: and he says, good, only two elements of prosecuted must
- 30:28Speaker 6: prove for a conviction of felerly murder to hold a
- 30:31Speaker 6: felling was tood that I was attempted in a perishing
- 30:34Speaker 6: not participating, and the felamy was killed. Well, it says
- 30:40Speaker 6: the two elements above must be present for a fairly
- 30:42Speaker 6: murdered charge. A conviction requires proof beyond a reason about
- 30:47Speaker 6: of homicide which I was found not guilty by Julie,
- 30:51Speaker 6: the felermy which I was never charged with in my
- 30:55Speaker 6: charging documents, and the connection between the between both of
- 30:58Speaker 6: the crimes my my brother. And they said mohamoside must
- 31:03Speaker 6: be proven to beyond reason without and the underlying flamy
- 31:07Speaker 6: must be proven beyond reason without. So that's what makes
- 31:11Speaker 6: this felony murder conviction that I'm that I'm convicted of
- 31:15Speaker 6: illegal because again I was found out guilty of murder
- 31:18Speaker 6: and I was never charged little felony, which the prosecution
- 31:23Speaker 6: said a robbie.
- 31:26Speaker 9: So if it's if you need a felony to go
- 31:31Speaker 9: with the murder, to have to get felony murder under
- 31:37Speaker 9: their statue, you have to have underlying felony. Right, yes,
- 31:44Speaker 9: So why wasn't you Why wasn't you able to defend
- 31:51Speaker 9: against the robbery charge?
- 31:55Speaker 6: Because I was never charged with it? So how did
- 31:59Speaker 6: you get but when I was, when I was charged
- 32:01Speaker 6: with murder, the public defenders and attorneys that I had,
- 32:06Speaker 6: we defended against the murder, which was the prosecution home
- 32:10Speaker 6: uh uh the prosecution many spoke on that Roon Joson
- 32:17Speaker 6: committed murder. It was nomber though Jan Johnson committed robbery,
- 32:21Speaker 6: but he mentioned it in the trial in passing saying
- 32:25Speaker 6: that oh je Joson committed murder, committed murder. Oh he'll
- 32:29Speaker 6: buy the way and the commission of Advalvat and Robberley.
- 32:32Speaker 6: So when when this is going on alalvator robbery is
- 32:36Speaker 6: one robbery? But when when I finished, when the when
- 32:39Speaker 6: we was at the end of the trial and the
- 32:42Speaker 6: jobs good for uh jury?
- 32:45Speaker 12: What you know? I just I just want to.
- 32:49Speaker 9: Go back real quick. So because you know this, you
- 32:53Speaker 9: know even when we talk you, I always go back
- 32:58Speaker 9: to it because this bride robbery. How can you how
- 33:04Speaker 9: can someone mentioned the word robbery? The DA mentioned robbery
- 33:11Speaker 9: and not and they won't give you a chance to
- 33:14Speaker 9: defend against it or you know, are you you was
- 33:19Speaker 9: in charge with it? So how can you defend against
- 33:22Speaker 9: something just by word of mouth, just by.
- 33:28Speaker 8: The mention I don't I don't have a clue I can.
- 33:31Speaker 6: I've been petitioning the courts. I had to how to
- 33:38Speaker 6: do it myself because again the course refused to give
- 33:42Speaker 6: me amia my process of.
- 33:46Speaker 9: Petitioning the courts.
- 33:48Speaker 6: So every time I petitioned.
- 33:52Speaker 8: Them for uh well, not answering my my, uh my issue.
- 34:00Speaker 6: But they're going around and saying that, oh, it should
- 34:03Speaker 6: have been brought up before. When I had a appeals
- 34:07Speaker 6: l which never brought up anything about the funding money.
- 34:11Speaker 6: He brought up issues about the rally U, protective posting
- 34:16Speaker 6: on the Ryan Witness and different things of that nature,
- 34:19Speaker 6: but never anything about falling murder. So the courture told
- 34:23Speaker 6: me that I proceedually bored from bringing up the fact
- 34:28Speaker 6: that I was another charged with Robin. When I've convicted
- 34:31Speaker 6: of family money without a murder, a conviction of the
- 34:36Speaker 6: company which.
- 34:38Speaker 9: Is rock boll how can you not bring that? How
- 34:42Speaker 9: come the courts it's saying that you can't bring that
- 34:47Speaker 9: out once again? You know, that's just that's just mind
- 34:50Speaker 9: Bobby just blowing my mind right there that this is
- 34:55Speaker 9: their law, and they saying that you have to have
- 35:01Speaker 9: an underline felony in order to tie it. In order
- 35:06Speaker 9: for it to be felony murdered, they need to do that.
- 35:12Speaker 9: The felony have to go with that, the underlying have
- 35:15Speaker 9: to go with that. So again, how could they not
- 35:23Speaker 9: charge you for for that? Well, they didn't charge you
- 35:27Speaker 9: for that, but how can they not let you defend
- 35:31Speaker 9: against something that you you know that they're saying that
- 35:36Speaker 9: you did by the word of mouth. They just mentioned
- 35:39Speaker 9: the word robbery. So oh so now we're gonna throw
- 35:42Speaker 9: robbery off in there. How can that you? I mean, like,
- 35:50Speaker 9: come on, Colorado, let's make it make sense.
- 35:54Speaker 6: It don't make sense. Again, I was trying by Julie
- 36:01Speaker 6: of twelve. I was never charged of trying un convicted
- 36:07Speaker 6: of a selny, which is required for seven murders. And
- 36:12Speaker 6: like I said, when I was going through twelve, Uh
- 36:15Speaker 6: for the dam a prosecutor with minching, but uh, agnivotal robbery.
- 36:23Speaker 6: But they're gonna prove aggregated robiley. But again they never
- 36:26Speaker 6: charged me with any robbery.
- 36:28Speaker 10: Uh.
- 36:29Speaker 6: When when they passed out to Julie instructures. The Juilli
- 36:33Speaker 6: instructure have the instruction of a simple robbery, so that
- 36:36Speaker 6: would be two different robberies. But they're mentioning in my
- 36:40Speaker 6: priv at this time.
- 36:41Speaker 8: Well again, uh, they.
- 36:44Speaker 6: Give a vertic time for murder.
- 36:47Speaker 8: They gave me a vertet time.
- 36:49Speaker 6: They give a vertic time for murder in the first degree.
- 36:52Speaker 6: They are still give a vertet time for seveny murder,
- 36:55Speaker 6: but they never gave a seven They never gave a
- 36:59Speaker 6: vertic time for a robbery because it was never charged.
- 37:05Speaker 6: Now they charged me with the murder and everything, and
- 37:07Speaker 6: they had a mother confident. But all I'm asking the
- 37:10Speaker 6: court here is how do I how am I to
- 37:13Speaker 6: get through this fellow murdered when again, uh, none of
- 37:17Speaker 6: these none of these laws or ruseless problems. But again
- 37:22Speaker 6: they never addressed my issues. They only go around it
- 37:25Speaker 6: to say, but oh, it should have been brought up here.
- 37:28Speaker 6: Your procedure to borrow your your case is successive because
- 37:33Speaker 6: it should have been brought up before. So they never
- 37:35Speaker 6: answered none of my emotions or petitions that I petitioned
- 37:40Speaker 6: the court.
- 37:45Speaker 13: So it's been a back and forth.
- 37:47Speaker 6: I've been in my Felli found I see I've already
- 37:50Speaker 6: went up finally to the United States District Court, and
- 37:54Speaker 6: they said if they can't address my issue because they
- 37:57Speaker 6: wouldn't have exacted and uh, state courts. And this is
- 38:02Speaker 6: what I've been dealing with throughout this time. Uh you know,
- 38:06Speaker 6: I went back and forth with these crips. So pretty
- 38:09Speaker 6: much they're treating me as I as I know, professional
- 38:13Speaker 6: attorney and telling me that they're not going to hear
- 38:17Speaker 6: my case.
- 38:19Speaker 9: Yeah. And also and also I was looking at your
- 38:30Speaker 9: your charging documents. I was looking at the the the
- 38:36Speaker 9: verdict forms, I was looking at the jury instructions and stuff,
- 38:41Speaker 9: and I noticed that in the jury instruction for robbery,
- 38:54Speaker 9: it doesn't have the victims name in it, and it
- 39:02Speaker 9: has the witness name in it. The judge gave uh
- 39:08Speaker 9: an instruction on robbery with the witness name in it.
- 39:15Speaker 9: And on the charging document right here you it has
- 39:25Speaker 9: the the victim name in it. But on in the
- 39:31Speaker 9: journey struck instruction that the judge gave, it had the
- 39:37Speaker 9: witness name in it. And when the witness was on
- 39:42Speaker 9: the stage, the witness said, Ryan Johnson did not rob me, right.
- 39:54Speaker 13: So how is that?
- 39:55Speaker 9: How?
- 39:56Speaker 7: Now?
- 39:57Speaker 9: You know, It's just like I still I still don't understand.
- 40:01Speaker 9: I still don't understand did you exalt? We have a question,
- 40:09Speaker 9: did you exalt all your pills?
- 40:16Speaker 8: Right now? I mean right now?
- 40:18Speaker 6: And the suplice court, h I have I have a
- 40:23Speaker 6: district courts court did not double jeopardy because I've seen
- 40:28Speaker 6: a double jeopardy plan. So I'm a court right now
- 40:34Speaker 6: waiting on a decision.
- 40:37Speaker 9: Okay, okay, So you know, it's just like it just
- 40:42Speaker 9: blow it just blows my mind that you have all
- 40:48Speaker 9: these wrongful conviction men and women serving time on wrongful
- 40:56Speaker 9: con wrongful convictions, you know, bens By, just by a
- 41:02Speaker 9: word of mouth because somebody making up stories. Are you know,
- 41:08Speaker 9: the the d A or the prosecutors just wanna just
- 41:15Speaker 9: you know, just just want to win a case or
- 41:19Speaker 9: whatever they're doing. And it just it just blows my
- 41:23Speaker 9: mind that you can actually take away somebody freedom for
- 41:28Speaker 9: something they didn't do.
- 41:32Speaker 6: An halifaction il a factur my caser there I have
- 41:37Speaker 6: case roll uh cases has been overturned due to the
- 41:43Speaker 6: fact that the predicure defense was overturned. Uh. One question
- 41:50Speaker 6: that I had he was uh uh putting it of
- 41:54Speaker 6: the predicate offense, but he was still convicted of for
- 41:59Speaker 6: the charge. But when do you want to the Supreme Court,
- 42:04Speaker 6: the Supreme Court because there is no predicate offense.
- 42:09Speaker 9: Okay, but okay, so the Supreme Court. Now you said
- 42:16Speaker 9: they overturned his case because it wasn't no predicatere offense, right,
- 42:22Speaker 9: so you I mean, you don't. But what they charge
- 42:28Speaker 9: you doesn't the crime that they have you in there
- 42:32Speaker 9: on the what the charges they have you in there
- 42:34Speaker 9: on you it's not a predicative offense. You didn't get
- 42:39Speaker 9: the chance to defend against the robbery charge. No, no,
- 42:51Speaker 9: And you know again with your charging documents, I'm gonna
- 42:58Speaker 9: just show this as you can see, this is the
- 43:02Speaker 9: charging document and you can see the chargings, the charges
- 43:08Speaker 9: on their and it's not it's nothing on their pertaining
- 43:12Speaker 9: to robbery. Those are two charging documents. That's the charges
- 43:20Speaker 9: that he was charged with. Well, thank you one for
- 43:27Speaker 9: sharing some of your story with us on this evening.
- 43:33Speaker 9: I would like for you to come back again and
- 43:38Speaker 9: sit with me and talk with me and stuff and
- 43:41Speaker 9: things and stuff. We're where, we're not nervous. This is
- 43:46Speaker 9: the first time that.
- 43:49Speaker 7: I was.
- 43:51Speaker 9: I spoke out against something. I always was a listener,
- 44:00Speaker 9: I never was a talker. I just sat back and
- 44:03Speaker 9: I just listened. But things like this, it needs a voice.
- 44:10Speaker 9: We have men and women that's incarcerated that doesn't have
- 44:15Speaker 9: a voice. But what I mean that don't have a voice,
- 44:19Speaker 9: that don't have family members or anyone that can speak
- 44:24Speaker 9: out on their behalf. And this is the reason for
- 44:30Speaker 9: this platform. If you know someone, are you just want
- 44:35Speaker 9: to come in and sit down and talk to me,
- 44:38Speaker 9: call me, you know, I would love to have you.
- 44:41Speaker 9: We need to stand up against this people that the
- 44:47Speaker 9: officers are getting away with killing people every day and
- 44:55Speaker 9: they have body camera to see it. Just in Denver
- 45:00Speaker 9: last month, the verdict came back when they killed this
- 45:05Speaker 9: young African American man, Elijah. I want to say about
- 45:11Speaker 9: two a year or two ago.
- 45:13Speaker 12: One and.
- 45:17Speaker 9: Two of the officers was found uh was acquitted and
- 45:23Speaker 9: one officer, one officer was found guilty. You know what
- 45:32Speaker 9: his sentence was. He's out with a with an anklet
- 45:37Speaker 9: on his wrist, on his leg. Six months, six months probation,
- 45:46Speaker 9: six months probation. Here you is, you have men and
- 45:52Speaker 9: women behind the wall behind that's locked up with and
- 46:00Speaker 9: when they don't have they didn't commit these crimes. When
- 46:06Speaker 9: are we gonna stand up and say enough is enough?
- 46:10Speaker 9: When are we gonna use our voice for something positive
- 46:15Speaker 9: instead of talking about people using our tongue going Because
- 46:21Speaker 9: your tongue is the most deadly thing on your body.
- 46:25Speaker 9: We can either use it to speak life or we
- 46:30Speaker 9: can speak death. And I'm gonna use minds to speak
- 46:33Speaker 9: life into someone. I thank you guys for joining me
- 46:39Speaker 9: on today and let me talk, letting you know, get
- 46:45Speaker 9: get used to this feeling. I thank you and I
- 46:48Speaker 9: hope that you guys join me again on Let's talk
- 46:52Speaker 9: about it. You can join me on the first and
- 46:55Speaker 9: third Monday of the month at eight pm Eastern stone
