- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:04In this episode, we're going to continue with the Inspector
- 0:08General's report into Jeffrey Epstein's death and the circumstances that
- 0:14led up to it. Chapter two Background, Part one, Significant
- 0:21Entities and Individuals. Jeffrey Epstein was born in nineteen fifty three,
- 0:27and prior to his arrest, worked at various jobs in
- 0:31the financial industry and ultimately developed considerable wealth. On July second,
- 0:37twenty nineteen, a federal grand jury of the US District
- 0:41Court for the Southern District of New York returned an
- 0:44indictment that charged Epstein with engaging in sex trafficking and
- 0:48a sex trafficking conspiracy in violation of eighteen US Code
- 0:54three seventy one fifteen ninety one a B two and two.
- 0:59These charges were based on allegations that between two thousand
- 1:03and two and two thousand and five, Epstein paid girls
- 1:06as young as fourteen years old hundreds of dollars in
- 1:10cash each for engaging in sex acts with him at
- 1:13his Florida and New York residences. The indictment further alleged
- 1:18that Epstein also paid each of these minor victims hundreds
- 1:22of dollars in cash to recruit other girls to engage
- 1:26in sex acts with Epstein. On July sixth, twenty nineteen,
- 1:31Epstein was arrested at Teterborough Airport in New Jersey upon
- 1:35his return to the United States from France and was
- 1:38transported to the Federal Bureau of Prisons BOP Metropolitan Correctional Center,
- 1:44located at one fifty Park Row in New York, New York.
- 1:49Following a detention hearing on July fifteenth, twenty nineteen, the
- 1:53court ordered that Epstein be detained pending trial based on
- 1:57the court's finding that he was a dangered to the
- 2:00community and the flight risk. MCC New York is a
- 2:04federal administrative detention facility operated by the BOP that primarily
- 2:09provides pre trial detention services for the U S District
- 2:13courts for the Southern and Eastern districts of New York.
- 2:18The BOP temporarily closed MCC New York in October twenty
- 2:23twenty one due to substandard conditions that are unrelated to
- 2:27this investigation. When it was operational, MCC New York housed
- 2:31approximately seven hundred and fifty inmates at any given time,
- 2:36Prior to its closure, the majority of mcc new York's
- 2:40inmates were individuals with pending criminal charges, as opposed to
- 2:44individuals who had been convicted of offenses and were serving
- 2:48a sentence of imprisonment but whom the court had determined,
- 2:53under applicable law, should remain in custody pending trial, either
- 2:57because they represented danger to the community, a substantial flight risk,
- 3:01or both. Mcc new York has several different housing units.
- 3:07Epstein was initially assigned to mcc new York's general inmate population,
- 3:13but on July seventh, twenty nineteen, he was moved to
- 3:16special housing unit pending reclassification due to the significant increase
- 3:21in media coverage and awareness of his notoriety among the
- 3:25other inmates. The Shoe is a housing unit within mcc
- 3:29new York where inmates are securely separated from the general
- 3:33inmate population and kept blocked in their cells for approximately
- 3:37twenty three hours per day to ensure their own safety
- 3:41as well as the safety of the staff and other inmates.
- 3:45Correctional Officer Toauvin Owell and material handler Michael Thomas began
- 3:50working together in mcc new York Shoe at twelve a m.
- 3:54On August tenth, twenty nineteen. During their shift, they each
- 3:59created and submitted falsified official BOP forms documenting inmate counts,
- 4:05often referred to as count slips, and Noel completed and
- 4:09signed more than seventy five separate entries on an official
- 4:13BOP form documenting thirty minute rounds, often referred to as
- 4:18a round sheet, falsely stating that she and Thomas had
- 4:22conducted such rounds when in fact they had not. On
- 4:26November nineteenth, twenty nineteen, a federal grand jury of the U.
- 4:30S District Court for the Southern District of New York
- 4:34returned an indictment that charged Noel and Thomas with one
- 4:37count each of conspiracy and multiple counts each of falsification
- 4:42of records in violation of eighteen US Code three seventy
- 4:47one one thousand and one A three and two. The
- 4:52indictment alleged that on August ninth, twenty nineteen, Noel fell
- 4:56to conduct the mandatory four PM and ten zen PM
- 5:00counts of inmates in the mcc New York Shoe, and
- 5:04that on August tenth, twenty nineteen, both she and Thomas
- 5:08failed to conduct the mandatory twelve am three am and
- 5:12five am counts and mandatory thirty minute rounds within the
- 5:16mcc New York Shoe. The indictment further alleged that Noel
- 5:21and Thomas created, certified, and submitted false documentation indicating that
- 5:27the counts and rounds had been done as required to
- 5:30conceal their failure to perform their assigned duties. As a result,
- 5:35it appeared from documentation that prisoners in the Shoe, including Epstein,
- 5:40were being regularly monitored, when in fact no COO had
- 5:45checked on Epstein from approximately ten forty pm on August ninth,
- 5:49twenty nineteen, until approximately six thirty am on August tenth,
- 5:54twenty nineteen, when Epstein was found hanged in his cell.
- 5:59On May twenty five, twenty twenty one, the U. S.
- 6:01Attorney's Office for the Southern District of New York entered
- 6:05into deferred prosecution agreements with Noel and Thomas. Their respective agreements,
- 6:11which are part of the court record in their case,
- 6:14includes admissions by Noel and Thomas that they falsely certified
- 6:18that they had conducted counts and rounds. The agreements also
- 6:23required them to are truthfully and completely disclose all information
- 6:28related to their activities and employment with the BOP be
- 6:32interviewed by the U. S. Attorney's Office of the Southern
- 6:35District of New York, the FBI, and the OIG complete
- 6:39one hundred hours of community service, refrain from violating the law,
- 6:44and fulfill other conditions related to pre trial supervision and
- 6:49their establishment of good behavior. On December thirteenth, twenty twenty one,
- 6:54after Noel and Thomas successfully fulfilled the terms of their
- 6:58deferred prosecution agreements as determined by the prosecutors, the U S.
- 7:03District Court for the Southern District of New York entered
- 7:07a null prosquay order and dismissed all charges pending against them.
- 7:13Prosecution was declined by the US Attorney's Office for the
- 7:16Southern District of New York for other BP employees assigned
- 7:20to the shoe who also falsely certified inmate count slips
- 7:24and round sheets on the day before and the day
- 7:27of Epstein's death. As discussed in greater detail in Chapter
- 7:32seven of this report, the OIG found that, in addition
- 7:36to Noel and Thomas, many other mcc New York staff
- 7:40members engaged in administrative misconduct, exercised poor judgment, and or
- 7:46failed to adequately perform their assigned duties Part two Methodology.
- 7:53During the course of this investigation, the OIG interviewed fifty
- 7:57four witnesses, several on more than one occasion. The witnesses
- 8:01interviewed included Noel Thomas and other mcc new York staff
- 8:07assigned to the Shoe on August ninth and tenth, twenty nineteen,
- 8:11MCC new York supervisors at the time of Epstein's death,
- 8:15including the warden, associate wardens, captain and lieutenants, medical staff,
- 8:21staff members responsible for mcc new York security camera system,
- 8:26other BOP staff and contractors, and a relative of Epstein
- 8:30who had requested to provide information. The BOP employees and
- 8:36contractors were interviewed, including employees involved in various aspects of
- 8:41the emergency response who worked at mcc new York in
- 8:45the days leading up to the response and following the response,
- 8:49as well as other individuals with information pertinent to our investigation. Additionally,
- 8:56the OIG participated in interviews of fifteen inmates who had
- 9:01been housed at mcc new York during time periods relevant
- 9:05to our investigation, including three who were housed in the
- 9:08l tier of the Shoe on the day Epstein died.
- 9:12Those three El tier inmates were housed in cells opposite
- 9:16Epstein's cell and therefore had a direct line of sight
- 9:19to epstein cell. On the night of August ninth and tenth,
- 9:23the OIG also reached out to one of Epstein's attorneys
- 9:27to discuss the possibility of providing information, but ultimately the
- 9:31attorney declined to be interviewed, citing attorney client privilege. The
- 9:36attorney client privilege survives a client's death and issues related
- 9:40to ongoing litigation involving Epstein's estate. The OIG also collected
- 9:47over one hundred and twenty seven thousand documents, as well
- 9:50as mcc new York video and photographs. Among these were
- 9:55BOP documents including staff rosters, daily logs and reports, in
- 10:00investigative and incident reports, documentation regarding inmate counts and thirty
- 10:05minute rounds, inmate housing assignment documentation, inmate transfer documents, psychology
- 10:12department reports, and medical records relating to Epstein. Epstein's institutional
- 10:18phone call records, mcc new York records on Epstein's visits
- 10:23with his attorneys, electronic communications including text messages and emails
- 10:29of BOP employees, and contractors, mcc new York Security camera
- 10:34surveillance video records from contractors regarding the mcc new York
- 10:39Security Camera System, Service records for mcc new York Security
- 10:45Camera System, mcc new York photographs, including photographs taken of
- 10:51efforts to revive Epstein on the morning of August tenth,
- 10:54twenty nineteen, BOP policies and program statements, mcc new York
- 11:00post orders, and financial records. The OIG also conducted forensic
- 11:06analysis of the computers located in the shoe and BOP
- 11:11cellular telephones. In addition, the OIG reviewed FBI investigative records,
- 11:16including review reports, FD DASH three two, notes from witness
- 11:21interviews and other meetings, and electronic communications. The OIG also
- 11:27reviewed Epstein's autopsy report and interviewed the medical examiner who
- 11:32performed the autopsy on Epstein. All right, folks, so we're
- 11:36going to wrap up part one of chapter two right here,
- 11:40and then the next episode where we're talking about this
- 11:43OIG report, we're going to pick up with Part three,
- 11:47which is applicable law, regulations and BOP policies. All of
