Latest / THE DAILY BRIEF / Inciting hostility Mullin, Mamdani spar over ICE shooting in New York
Transcript
- 0:00Speaker 1: Good evening.
- 0:00Speaker 2: Tonight, the Trump administration is facing a legal battle to
- 0:03Speaker 2: keep a suspected gang member in federal custody after he
- 0:06Speaker 2: was shot by an ICE agent right here in New
- 0:08Speaker 2: York City. DHS tells us Oscar Belgal is from the
- 0:12Speaker 2: Dominican Republic and in the country illegally with a prior
- 0:16Speaker 2: felony conviction, an act of warrant, and suspected ties to
- 0:19Speaker 2: a violent New York street gang. Federal officials also say
- 0:23Speaker 2: he was questioned in connection to last year's shooting of
- 0:26Speaker 2: an off-duty Border Patrol agent right here in Manhattan.
- 0:31Speaker 3: He has three years of extensive criminal activity. You're going
- 0:34Speaker 3: to call that a New Yorker? I think that's a
- 0:37Speaker 3: far cry.
- 0:40Speaker 2: New body camera footage today from the scene. It shows
- 0:42Speaker 2: Belgal there right on the ground after he was shot
- 0:45Speaker 2: by the agent during a targeted enforcement operation. DHS tells
- 0:49Speaker 2: Fox an agent opened fire after Belgal tried to drive
- 0:53Speaker 2: off heading right toward officers. His five-year-old son was in
- 0:56Speaker 2: the back seat but was not hurt. Belgal is now
- 0:59Speaker 2: being held at a federal detention center in Brooklyn as
- 1:02Speaker 2: attorneys fight to get him released, saying he still needs
- 1:05Speaker 2: medical care.
- 1:07Speaker 4: All I can say is that we're deeply concerned.
- 1:08Speaker 5: Anybody who's still walking around with a bullet in their
- 1:10Speaker 5: body is obviously raises a ton of questions.
- 1:13Speaker 4: About their well-being.
- 1:15Speaker 2: The shooting sparked major protests and clashes with NYPD officers.
- 1:19Speaker 2: Five people arrested. Some were Democratic Socialist leaders on the
- 1:22Speaker 2: ground demanding the police commissioner resign.
- 1:27Speaker 6: We know that ICE is rotten to its core. They
- 1:30Speaker 6: have killed far more of our neighbors than they could
- 1:32Speaker 6: ever have claimed to save.
- 1:35Speaker 2: Bill Gall's attorneys say they will advise the courts on
- 1:38Speaker 2: Tuesday about whether they want the case in New York
- 1:41Speaker 2: or in New Jersey, Brett.
- 1:43Speaker 4: All right, Alexis, thank you.
- 1:45Speaker 7: Joining me now by phone, DHS Secretary Mark Wayne Mullen.
- 1:48Speaker 7: Secretary Mullen, thank you very much. It's good to have
- 1:50Speaker 7: you with us. Obviously, this was a chaotic night, didn't
- 1:55Speaker 7: necessarily need to be. And then you had a two-hour
- 1:59Speaker 7: phone call with you, Mayor Mamdani, and President Trump. What
- 2:02Speaker 7: can you tell us about the back and forth on
- 2:04Speaker 7: that call, Secretary?
- 2:05Speaker 3: Well, the governor was on the phone, too, back and forth.
- 2:10Speaker 3: And the governor, I've got to be frank here, the
- 2:13Speaker 3: governor was being somewhat respectful and reasonable. Madame was being,
- 2:18Speaker 3: or the mayor was being cordial, but unrealistic. The fact
- 2:23Speaker 3: that they wanted to release this individual back on the
- 2:25Speaker 3: streets is absurd. President Trump was very cordial. He was
- 2:30Speaker 3: very nice. He said, listen, NYPD, they're the finest. If
- 2:36Speaker 3: you guys want to take custody of him, then we'll
- 2:38Speaker 3: be happy to give you custody of him while the
- 2:41Speaker 3: investigation is going. But keep in mind, this guy is
- 2:43Speaker 3: on probation for, let me explain what he's on probation for.
- 2:47Speaker 3: Four robbery charges, two charges of felony assault, felony larceny, assault,
- 2:54Speaker 3: weapons assault, weapons possession of misdemeanor larceny, possession of stolen property,
- 2:58Speaker 3: and two felony charges of dangerous drugs, all in three years.
- 3:01Speaker 3: And that's how long he's been in the country. And
- 3:03Speaker 3: the president's like, he's got probation violations. New York PD
- 3:07Speaker 3: can obviously pick him up, hold him. If you're willing
- 3:09Speaker 3: to do that, we'll release him to your custody, to
- 3:12Speaker 3: which the mayor refused to do that. They said they
- 3:14Speaker 3: wanted him fully released and back on the streets, and
- 3:16Speaker 3: we can't do that. President Trump said we were going
- 3:18Speaker 3: to go after the worst of the worst and restore
- 3:21Speaker 3: law and order, even when these sanctuary politicians won't. So
- 3:24Speaker 3: while it was a long conversation, it wasn't very productive,
- 3:28Speaker 3: even though President Trump tried his best to make a deal.
- 3:31Speaker 7: So what evidence do you all have that this individual
- 3:35Speaker 7: is related to this Trinitarios gang, which likes to ride
- 3:39Speaker 7: around on mopeds and wield weapons and rob people? What's
- 3:44Speaker 7: the connection to that and also to a potential shooting
- 3:47Speaker 7: of a border official that you think he may have
- 3:50Speaker 7: had knowledge of?
- 3:52Speaker 3: Well, we know his gang affiliation without question is to
- 3:56Speaker 3: that gang. That's not even questionable. The NYPD... And the
- 4:02Speaker 3: mayor himself doesn't deny that. We feel like this gang
- 4:07Speaker 3: is directly related to a CVP officer that was shot
- 4:11Speaker 3: last year. We feel that there's a good chance that
- 4:14Speaker 3: he is directly or indirectly involved or has knowledge of
- 4:17Speaker 3: this shooting. That's why he got on our radar to
- 4:20Speaker 3: begin with. This guy, Oscar, he's not a good guy.
- 4:26Speaker 3: He is the worst of the worst. And what's frustrating
- 4:29Speaker 3: to me, Martha, is that you had the mayor going
- 4:32Speaker 3: out and grandstanding on this individual that has no business
- 4:37Speaker 3: being in our country to begin with because he's illegal. Well,
- 4:40Speaker 3: he has an extensive rap sheet. Time after time, New
- 4:44Speaker 3: York City has released him. The Biden administration released him
- 4:47Speaker 3: back on the streets. And yet the mayor was completely
- 4:51Speaker 3: silent last week when his own NYPD officer was stabbed
- 4:56Speaker 3: seven times by also two criminals from Dominican Republic that
- 5:01Speaker 3: was released back on the streets that DHS had detainers
- 5:04Speaker 3: on and asked them to release them to our custody.
- 5:06Speaker 3: And they released them on the streets and they stabbed
- 5:07Speaker 3: an officer seven times. All three of these individuals, Oscar
- 5:10Speaker 3: and these two that stabbed the officer, are all three
- 5:13Speaker 3: from a Dominican Republican.
- 5:14Speaker 7: Yeah, I mean, it's obvious that the streets of New
- 5:18Speaker 7: York would be safer with these gang members and related
- 5:22Speaker 7: individuals not on the streets. It's hard to understand why
- 5:25Speaker 7: Mayor Mamdani can't see that, that he doesn't want the
- 5:29Speaker 7: streets to be as safe as possible. I would also
- 5:32Speaker 7: point out, you know, the two areas of backlash, and
- 5:34Speaker 7: I want you to give you an opportunity to address these.
- 5:37Speaker 7: One is the child who was in the back of
- 5:39Speaker 7: the vehicle And the other is the description of the
- 5:45Speaker 7: ICE agents and the wielding of this AR-15. There's video
- 5:51Speaker 7: that is making the rounds and questions about whether or
- 5:54Speaker 7: not you feel that, you know, all of the actions
- 5:56Speaker 7: here were appropriate when you look at it. What do
- 5:59Speaker 7: you say?
- 5:59Speaker 3: Well, I can't get into the specifics of the case
- 6:03Speaker 3: because it is being investigated. I will tell you though,
- 6:07Speaker 3: the individual they're showing online was not the individual that
- 6:09Speaker 3: approached the vehicles. He was given lethal or lawful demands
- 6:16Speaker 3: to exit the vehicle. The perpetrator, Oscar, refused to exit
- 6:21Speaker 3: the vehicle. He knew we were looking for him because, Martha,
- 6:24Speaker 3: he had ran from us in September, so he knew
- 6:27Speaker 3: we were coming for him. He knew well who we
- 6:29Speaker 3: were because when we gave him lawful demands, we also
- 6:32Speaker 3: identified ourselves. We had no idea that the child was
- 6:35Speaker 3: in the vehicle. Oscar put his child at risk when
- 6:39Speaker 3: he chose to accelerate hit two federal vehicles and also
- 6:44Speaker 3: weaponized the vehicle and moved towards an accelerator rate towards
- 6:50Speaker 3: officers that were trying to apprehend him. We understood this
- 6:53Speaker 3: was going to be a contentious arrest, and we had
- 6:59Speaker 3: taken all the precautions we could. We had both ends
- 7:01Speaker 3: of the block blocked off. They talk about the streets
- 7:05Speaker 3: being wide open. That isn't accurate. We had worked our
- 7:10Speaker 3: best to try to get as many people away before
- 7:13Speaker 3: we actually went towards the individual. Now, it's a public street,
- 7:17Speaker 3: so there was some people on the street, but we
- 7:19Speaker 3: did our best to de-escalate it. He's the one that
- 7:21Speaker 3: escalated it. But, you know, this should have never happened
- 7:26Speaker 3: if NYPD was allowed to keep him in custody because
- 7:30Speaker 3: the sanctuary politicians that run New York City now They
- 7:34Speaker 3: released him back on the streets, and this is what
- 7:36Speaker 3: took place. If they would honor our detainers, I want
- 7:39Speaker 3: to throw some numbers out to you, Martha. We have 14,766
- 7:44Speaker 3: detainers right now on individuals that New York City has
- 7:48Speaker 3: in custody or the state of New York. That represents 47,750
- 7:53Speaker 3: criminal charges. Just to give you some perspective on this,
- 7:57Speaker 3: 96 homicide cases in the state of New York, 93
- 8:01Speaker 3: for the city of New York. Kidnappings, these individuals, 114
- 8:03Speaker 3: individuals kidnapping, 113 in New York City. Sexual assault, 448.
- 8:12Speaker 3: in New York, 441 in New York City. These are
- 8:15Speaker 3: the type of individuals we have detainers on, and the
- 8:17Speaker 3: state of New York and the city of New York
- 8:20Speaker 3: City will not honor these individuals. It's absurd. It's astounding.
- 8:24Speaker 7: Those numbers are incredible. And every leadership person in New
- 8:27Speaker 7: York City should want those people off the streets so
- 8:29Speaker 7: that people can live safely here. And I would just
- 8:32Speaker 7: want to reiterate what you said about this child, because
- 8:35Speaker 7: if he had stepped away from the car and cooperated
- 8:39Speaker 7: with the officials, He had it within his own power
- 8:43Speaker 7: to make sure that there was never any that the
- 8:45Speaker 7: child was never in any danger. And you have stated
- 8:47Speaker 7: that you all had no idea that there was a child.
- 8:50Speaker 3: In the backseat. As a father of six kids, it's
- 8:54Speaker 3: my job to protect my kids. I would never put
- 8:56Speaker 3: them into a dangerous situation like that. I the last
- 8:59Speaker 3: thing I would do is I'd give my life to
- 9:01Speaker 3: protect my kids life. And every parent would say the
- 9:03Speaker 3: same thing. And that's why I say he chose to
- 9:07Speaker 3: endanger the five year old. And that should have never
- 9:10Speaker 3: taken place. That tells you how selfish of an individual
- 9:12Speaker 3: that Oscar is.
- 9:15Speaker 4: Well put.
- 9:16Speaker 7: Thank you so much, Secretary Mullen. Good to have you
- 9:18Speaker 7: with us today.
- 9:19Speaker 3: Thank you, sir. Thank you.
- 9:21Speaker 1: So we've learned a lot that we didn't know this morning.
- 9:24Speaker 1: Oscar Bagao, age 28, had a gang association, according to
- 9:27Speaker 1: that press conference. They tried to arrest him in September.
- 9:32Speaker 1: They still had a detainer on him in New York alone. Dana,
- 9:36Speaker 1: I wrote down seven charges, robbery, grand larceny, et cetera.
- 9:41Speaker 1: There were body cams and there's a possibility that there
- 9:44Speaker 1: were several body cams. And I don't when we see
- 9:46Speaker 1: that video, maybe later today.
- 9:47Speaker 4: We'll wait on that.
- 9:49Speaker 1: Also, it's been reported that for two hours on the phone,
- 9:52Speaker 1: the president and Mark Wayne Mullen were in conversation with
- 9:56Speaker 1: Mayor Mamdani here in New York and likely the Attorney
- 10:00Speaker 1: General Letitia James as well. So we'll try and nail
- 10:03Speaker 1: that second part down. But there's a lot of new information.
- 10:05Speaker 1: I'm going to bring in Vicki Palladino now. She's the
- 10:07Speaker 1: Republican New York City Councilwoman. We talked to her before.
- 10:10Speaker 1: We'll bring in Mary Katherine Hamm and Tudor Dixon in
- 10:12Speaker 1: a moment here. Vicki, your reaction now to what we
- 10:14Speaker 1: just heard from the Department of Homeland Security. Let's start there,
- 10:17Speaker 1: then we'll get into all the other details next.
- 10:19Speaker 8: He was amazing. Absolutely. Secretary Mullen was amazing. He carried
- 10:24Speaker 8: it from start to finish. He couldn't make it more clear.
- 10:29Speaker 8: As a sitting elected official in the city of New York,
- 10:32Speaker 8: I had to hear Mayor Mondani get up there last
- 10:35Speaker 8: night as if he was some sort of whoever he
- 10:38Speaker 8: thinks he is. Anyway, we're a municipality, okay? We've had
- 10:42Speaker 8: this problem now since the Adams administration when we allowed
- 10:48Speaker 8: all these people.
- 10:49Speaker 9: In over the border.
- 10:50Speaker 8: Again, to Secretary Mullen, you nailed it on every point.
- 10:55Speaker 8: The Bronx has been ridden with crime. Illegal mopeds, murder.
- 11:00Speaker 8: Do they talk about the little kids that are shot
- 11:03Speaker 8: by these gang members? A young mother pushing a one-
- 11:07Speaker 8: or two-year-old baby in a carriage that was struck last
- 11:12Speaker 8: year or over this past summer, shot dead in the head.
- 11:16Speaker 8: This has been a constant battle. And to see these
- 11:19Speaker 8: maniacs out in the street. Let's remember, Zoran wants to
- 11:23Speaker 8: close Rikers Island. The governor wants to close Rikers Island.
- 11:29Speaker 8: This guy here that you got the picture of, he
- 11:32Speaker 8: has been on their tail. They have been on his
- 11:35Speaker 8: tail now for over two years. They got him yesterday.
- 11:39Speaker 8: They had a six-year-old. He had a six-year-old. in the car.
- 11:43Speaker 8: It was his doings, not ICE's doings. That kid is safe.
- 11:47Speaker 4: He got away.
- 11:48Speaker 8: He's in jail, now removed out of the state. Best
- 11:52Speaker 8: thing they could have done. And don't trust a word
- 11:55Speaker 8: that Kathy Hochul said as far as she's going to
- 11:58Speaker 8: try to cooperate. There's going to be no cooperation here,
- 12:01Speaker 8: not from the state. and not from the city. And
- 12:05Speaker 8: we've got a big election coming in November that we
- 12:08Speaker 8: could kind of change things around. This blue city, this
- 12:11Speaker 8: blue state, we're in big trouble. Thank you to ICE.
- 12:15Speaker 8: Thank you to Secretary Mullen. That was as strong as
- 12:19Speaker 8: could be. And anybody that.
- 12:21Speaker 4: And why you.
- 12:22Speaker 8: The fact that we're doing this is to answer Zoran Mondani. Zoran,
- 12:27Speaker 8: take a back seat. You're the mayor of a new municipality.
- 12:31Speaker 8: the city of New York, and you're ordering us? Then
- 12:35Speaker 8: you had the Bronx borough president cursing her head off
- 12:38Speaker 8: outside of her office last night, too, using all sorts
- 12:44Speaker 8: of profanity and raising... the heat in this city to
- 12:49Speaker 8: the highest level it could possibly go. Meanwhile, they're doing
- 12:53Speaker 8: their job. They're taking the worst of the worst off
- 12:56Speaker 8: of our streets, and I welcome Isaac to my office
- 13:00Speaker 8: anytime they want to come for a cup of coffee.
- 13:01Speaker 4: Okay. Okay. Okay.
- 13:02Speaker 8: Had to relax a little bit.
- 13:04Speaker 4: Gotcha.
- 13:04Speaker 8: This is ridiculous.
- 13:05Speaker 1: I just want to let our viewers know, you represent
- 13:07Speaker 1: the neighborhood of Whitestone, which is in Queens, New York.
- 13:09Speaker 1: It was just east of Manhattan, so I just want
- 13:11Speaker 1: to clear that up. Also, one other thing. The president
- 13:13Speaker 1: is coming to New York State later tonight He's going
- 13:16Speaker 1: to hold a rally in Syracuse, New York, on behalf
- 13:19Speaker 1: of Bruce Blayton, who's trying to unseat Kathleen.
- 13:23Speaker 10: So protesters clashing overnight with the New York City police
- 13:27Speaker 10: after a criminal illegal migrant was shot by ICE agents.
- 13:31Speaker 10: The mayor slamming the agency, saying it does not keep
- 13:34Speaker 10: the city safe.
- 13:37Speaker 6: Today's shooting is only further devastating confirmation of what we
- 13:41Speaker 6: have long known. which is that ICE operates with impunity,
- 13:44Speaker 6: that they sow chaos and terror across our country. This
- 13:48Speaker 6: city wants ICE out. All they do is terrorize this city.
- 13:53Speaker 10: Joining us now to react, the New York GOP Attorney
- 13:56Speaker 10: General candidate, Saritha Kamatiri.
- 14:02Speaker 4: Thank you so much for joining the program.
- 14:03Speaker 3: Thank you.
- 14:04Speaker 10: Saritha, what do you make of the mayor's comments right there?
- 14:09Speaker 6: Listen.
- 14:10Speaker 5: Our system in New York, it's broken. It's important to
- 14:13Speaker 5: understand how it got this way. Letitia James and all
- 14:17Speaker 5: of the defund the police movement broke it in 2019
- 14:20Speaker 5: and 2020. And I saw that because I was a
- 14:23Speaker 5: federal prosecutor. And I started under President Obama. Let me
- 14:27Speaker 5: tell you how we used to do things. We used
- 14:30Speaker 5: to make sure that when someone was caught by the
- 14:32Speaker 5: NYPD for a crime, like grand larceny or drug trafficking,
- 14:38Speaker 5: If they're a danger to the community, we used to
- 14:40Speaker 5: have laws in New York where they would be held
- 14:43Speaker 5: instead of released. But then bail reform came along, and
- 14:46Speaker 5: that was Letitia James who championed bail reform. So we
- 14:49Speaker 5: got a catch-and-release policy where people who are dangerous are
- 14:52Speaker 5: released into the community. And then, even when those people
- 14:56Speaker 5: are here illegally, like violent criminals here illegally, under the
- 15:01Speaker 5: Obama administration, you would take the people who came out
- 15:04Speaker 5: of state jail... and hand them over to federal officials
- 15:08Speaker 5: at the jailhouse door. No one had to go into
- 15:11Speaker 5: any neighborhoods. But that also changed because Letitia James sued
- 15:15Speaker 5: to change it. And they passed something called... They call
- 15:18Speaker 5: it the Protect Our Courts Act. I call it the
- 15:20Speaker 5: Protect Our Criminals Act. And it, again, releases violent criminals.
- 15:24Speaker 4: Into the community.
- 15:25Speaker 5: So you get these tragedies like we saw last night.
- 15:28Speaker 5: And the facts are still coming out. So I don't
- 15:30Speaker 5: want to prejudge them. I will say... No one really
- 15:34Speaker 5: wants to see these enforcement operations happen in communities when
- 15:37Speaker 5: they could happen safely at the jailhouse door. That's how
- 15:41Speaker 5: we used to do it under Democrats and Republicans. It
- 15:44Speaker 5: changed because Tish James decided to put in place every
- 15:48Speaker 5: policy she could think of that just releases criminals into
- 15:51Speaker 5: our communities.
- 15:52Speaker 10: So speaking of Tish James, Attorney General, she has been outspoken.
- 15:57Speaker 10: She's a special prosecutor now for the Cornell case and
- 16:01Speaker 10: the allegations there. But she's weighed in on the investigation
- 16:05Speaker 10: before she's even gotten all the facts.
- 16:07Speaker 7: That's right.
- 16:07Speaker 4: There's been some pushback on that.
- 16:09Speaker 10: Here's one of the attorneys from one of the men accused.
- 16:13Speaker 7: And we are going to abolish ICE, and we're going
- 16:15Speaker 7: to take that to the federal level, and we're going
- 16:16Speaker 7: to do that in Congress.
- 16:19Speaker 4: I'm sorry about that. That was a wrong sign. Let's
- 16:21Speaker 4: try it again.
- 16:25Speaker 5: Her words....
- 16:27Speaker 9: I think are reasonably read as she's accepted a central
- 16:31Speaker 9: factual premise of the allegations. And that person should not
- 16:36Speaker 9: be tasked with an independent investigation.
- 16:41Speaker 4: Is those the right comments right there?
- 16:43Speaker 5: Listen, sexual assault cases are some of the most important
- 16:47Speaker 5: kinds of criminal cases that you can handle as a prosecutor.
- 16:50Speaker 5: I was a federal prosecutor for 12 years. I personally
- 16:53Speaker 5: prosecuted sexual assault cases. I even put a man in
- 16:55Speaker 5: prison for life for a series of horrific sexual assaults.
- 16:59Speaker 5: So I know how to handle those cases. She obviously
- 17:01Speaker 5: does not. She's never prosecuted a criminal case at all
- 17:05Speaker 5: in her entire career. And it's correct. You cannot and
- 17:10Speaker 5: should not judge a case before you know the facts
- 17:12Speaker 5: of the actual case. She's prejudged it. And I understand
- 17:15Speaker 5: the comments from that attorney, but... The reality is everyone's
- 17:19Speaker 5: saying the same thing. The New York Times, the Wall
- 17:21Speaker 5: Street Journal, the New York Magazine, folks across the political
- 17:25Speaker 5: spectrum have realized that what she has said is wrong.
- 17:29Speaker 4: Saritha Kamarata Reddy.
- 17:32Speaker 5: Kamati Reddy.
- 17:32Speaker 4: Reddy, New York GOP Attorney General candidate. Thank you so much.
- 17:36Speaker 5: Thank you.
