- 0:02Speaker 1: Hi, guys, welcome to Legally Brunette. I will be your
- 0:04Speaker 1: host today, Emily Simpson with Shane. Okay, guys, today we
- 0:09Speaker 1: are doing the big One. I have avoided doing an
- 0:13Speaker 1: episode on this case just because it's so complex. This
- 0:17Speaker 1: is Scott Peterson and Lacy Peterson, which I'm sure you'd
- 0:20Speaker 1: have to live under a rock to not know about
- 0:23Speaker 1: Lacy Peterson, right, Lacy Peterson, Lacy Peterson. Now, the timing
- 0:29Speaker 1: of doing this episode, we wanted to. I have had
- 0:32Speaker 1: lots of people ask if we were going to do it,
- 0:34Speaker 1: but I also knew. I'm not sure. I think it
- 0:36Speaker 1: was twenty twenty three that the la Innoson's project took
- 0:38Speaker 1: up Scott Peterson's case, which I did know about. I
- 0:42Speaker 1: wanted to wait until we did the Scott Peterson case
- 0:46Speaker 1: until a lot of that information and a lot of
- 0:48Speaker 1: that evidence, and a lot of the new things that
- 0:50Speaker 1: they are purporting came out publicly teeth into right. So,
- 0:55Speaker 1: now that I did get a hold of the petition
- 0:58Speaker 1: that the la Innocon's probably filed on behalf of a
- 1:01Speaker 1: Scott Peterson. It's eight hundred and fifty four pages. I
- 1:04Speaker 1: did not read the whole thing, but I did pick
- 1:06Speaker 1: and choose from it and have been going over it anyway.
- 1:09Speaker 1: Now I feel like and also we know that the
- 1:11Speaker 1: new documentary came out with like the New Evidence. Yeah,
- 1:16Speaker 1: well I watched it on Hulu.
- 1:17Speaker 2: Hulu.
- 1:18Speaker 1: Yeah. So now we have something that we can divide
- 1:22Speaker 1: into two parts. So today we were going to do
- 1:23Speaker 1: part one of the Scott Peterson case. We were just
- 1:25Speaker 1: going to go back in time, back to two thousand
- 1:27Speaker 1: and two. We're going to talk about the case. We're
- 1:29Speaker 1: going to talk about the circumstantial by the way, it's
- 1:32Speaker 1: all circumstantial evidence against Scott Peterson, the trial, how he
- 1:37Speaker 1: ended up in prison, he ended up on death row.
- 1:39Speaker 1: I don't know if you know, but he's not on
- 1:40Speaker 1: death row anymore. He's in for life without parole, but
- 1:42Speaker 1: he's not on death row anymore anyway. So today is part.
- 1:46Speaker 2: One, death row. I mean, you're going to die in jail, well.
- 1:49Speaker 1: Right, but he's not going to just natural cause he's
- 1:51Speaker 1: not going to be executed anyway. So today we're going
- 1:55Speaker 1: to go into part one, and then we are going
- 1:58Speaker 1: to record a separate episode in part two when we
- 1:59Speaker 1: are going to go into the Los Angeles Innocence Project
- 2:04Speaker 1: and their findings and the new information. So are you ready?
- 2:11Speaker 2: All right?
- 2:11Speaker 1: All right?
- 2:12Speaker 2: So wait, no, currently currently prior to let's say, go
- 2:16Speaker 2: back two years ago, okay, twenty what was your belief
- 2:22Speaker 2: as to the crime.
- 2:24Speaker 1: No, two years ago, I was questioning whether he was guilty.
- 2:27Speaker 2: Five years ago, five years ago.
- 2:29Speaker 1: Oh, absolutely he did it. And I also would like
- 2:31Speaker 1: to ask the listeners that not so much in part one,
- 2:34Speaker 1: but definitely when we get to part two, you're gonna
- 2:35Speaker 1: have to be a little more open minded.
- 2:38Speaker 3: And I just wanted to set the record straight at
- 2:42Speaker 3: a point, Yes, Emily was very convinced, as many were
- 2:47Speaker 3: and everyone is, that he was guilty, right, like beyond
- 2:51Speaker 3: a reasonable doubt, right, Okay, just wanted to make so
- 2:54Speaker 3: it's not like, okay and then you saw the light.
- 2:58Speaker 2: Well, I don't know whatever. Well, GE's no idea what
- 3:01Speaker 2: the evidence is that's going to come before us.
- 3:02Speaker 1: So let's get We'll get to that in part two,
- 3:04Speaker 1: but let's go through this. So on Christmas eve A,
- 3:06Speaker 1: two thousand and two. Also, by the way, this was
- 3:08Speaker 1: two thousand and two. Do you remember this in the media.
- 3:11Speaker 2: I just want to that was an adult too.
- 3:13Speaker 1: No, I know, but I mean, do you remember how
- 3:15Speaker 1: much it was in the idea, how much it was covered.
- 3:18Speaker 2: I remember when he was being prosecuted, then it was
- 3:23Speaker 2: made eleivised and all over the place. But yes, I
- 3:27Speaker 2: think in two thousand and two, I remember like surfacing
- 3:30Speaker 2: as a you know, breaking news and things like that,
- 3:34Speaker 2: and then it died and then you forget about it,
- 3:36Speaker 2: especially when I'm at that age when school and whatever.
- 3:38Speaker 2: And then it surfaced as a trial, and that a
- 3:42Speaker 2: lot of coverage.
- 3:43Speaker 1: On Christmas Eve A two thousand and two, Lacy Peterson,
- 3:46Speaker 1: who was eight months pregnant, disappeared from her home in Modesto, California.
- 3:51Speaker 1: Her husband, Scott, said that he had spent the day
- 3:53Speaker 1: on a solo fishing trip out in the San Francisco Bay,
- 3:57Speaker 1: a strange choice for Christmas Eve, but it didn't raise
- 4:00Speaker 1: any immediate red flags. The longer investigators looked at Scott Peterson,
- 4:04Speaker 1: the harder it became for them to look away. There
- 4:07Speaker 1: was a secret affair. There was behavior that felt off,
- 4:11Speaker 1: not the frantic desperate energy of a man whose wife
- 4:13Speaker 1: an unborn child were missing. Then April rolled around and
- 4:18Speaker 1: the bay that Scott had fished in that Christmas Eve
- 4:20Speaker 1: morning killed all Hope of Lacy and Connor coming back.
- 4:23Speaker 1: There were two sets of human remains that washed up
- 4:26Speaker 1: on the shore close to where Scott said that he
- 4:28Speaker 1: had been fishing. What came next was a trial that
- 4:31Speaker 1: gripped the entire country in a verdict that landed in
- 4:34Speaker 1: a packed courtroom broadcast live with millions of people watching
- 4:38Speaker 1: from home. Also, I just want to say, in two
- 4:41Speaker 1: thousand and two, I was in law school, but I
- 4:43Speaker 1: was so overwhelmed by law school that I mean, I
- 4:46Speaker 1: knew about it, but I didn't pay close attention to
- 4:51Speaker 1: the details and follow it, you know what I mean.
- 4:54Speaker 2: I had nothing to other things. It had to do
- 4:55Speaker 2: with schooling.
- 4:56Speaker 1: Yes, I was very busy. I was in law school.
- 4:58Speaker 1: May fourth, nineteen sev Lacey Denise Rocha is born in Modesto, California,
- 5:04Speaker 1: to Sharon and Dennis Roacha. She grows up partly on
- 5:07Speaker 1: her family's dairy farman later studies ornamental horticulture. Do you
- 5:10Speaker 1: know what ornamental horticulture is?
- 5:13Speaker 2: Horticulture's vegetation, right.
- 5:14Speaker 1: Well, horticulture is like, I don't know. I think if
- 5:16Speaker 1: you want to be a landscaper or something like that,
- 5:19Speaker 1: you study all the plants and the genesis and all
- 5:21Speaker 1: those things. But I didn't know what ornamental horticulture. To me,
- 5:24Speaker 1: I guess that means more like residential maybe planning, like
- 5:28Speaker 1: different types of anyway, all right, she studied this.
- 5:32Speaker 2: We don't need to know because we probably never hear that.
- 5:34Speaker 1: I know, I just I found that interesting. She studied
- 5:37Speaker 1: at the California Polytech State University and San Louis Obispo,
- 5:42Speaker 1: and she was there in the summer of nineteen ninety four.
- 5:44Speaker 1: While attending cal Poly, Lacey meets Scott Lee Peterson.
- 5:48Speaker 2: Has put out some victims there.
- 5:50Speaker 1: You know what. And when I read this initially, I
- 5:53Speaker 1: read and this is a fun fact, Lacy Peterson and
- 5:57Speaker 1: Kristen Smart were at cal Poly at this same time.
- 6:01Speaker 1: Do you not find that interesting?
- 6:02Speaker 2: Really?
- 6:03Speaker 1: Yes? Yeah, that's so interesting. So col Pauly has put
- 6:07Speaker 1: out Lacy Peterson and has put out Kristen Smart. I
- 6:10Speaker 1: have decided that cal Poly is not on and Chester
- 6:13Speaker 1: the molester. Cal Poly is not on the list of
- 6:15Speaker 1: colleges that Annabel will be attending in any way, Shaefer Farm.
- 6:18Speaker 2: You could probably go to any single college and find
- 6:21Speaker 2: some unfortunate crimes like that. So what is she never
- 6:24Speaker 2: going to go to school?
- 6:24Speaker 1: Again, what are the chances of lace the huge crimes
- 6:28Speaker 1: Lacey Peterson and Kristen Smart or both at cal Paully.
- 6:32Speaker 2: They're not huge crimes. They're murder no less than any
- 6:35Speaker 2: other murder, no more.
- 6:37Speaker 1: I'm talking about the media attention on a global basis.
- 6:40Speaker 2: Two to go to school where the crimes are swept
- 6:43Speaker 2: under the rug, and they'll get media.
- 6:44Speaker 1: I want her to go where there's no crime, all right.
- 6:48Speaker 1: So she meets Scott Lee Peterson, who is a fellow
- 6:50Speaker 1: student who is working as a waiter at the Pacific Cafe.
- 6:53Speaker 1: Lacy leaves him her phone number and they begin dating.
- 6:56Speaker 1: Soon afterward. Around Christmas of nineteen ninety four, Scott and
- 6:59Speaker 1: Lacey become engaged, and then August ninth of nineteen ninety seven,
- 7:03Speaker 1: Scott and Lacey mary at Sycamore Mineral Springs resort in
- 7:07Speaker 1: California's of Villa Valley, approximately one hundred and fifty family
- 7:11Speaker 1: members and friends at ten. In June of nineteen ninety eight,
- 7:14Speaker 1: Scott graduates from cal Poly with a degree and agricultural business,
- 7:19Speaker 1: and he and Lacey later operate a Hamburger restaurant called
- 7:23Speaker 1: The Shack. That's interesting, I didn't know that. I think
- 7:27Speaker 1: the first time around that they owned a restaurant together,
- 7:29Speaker 1: like a small little yeah. I think it was popular
- 7:32Speaker 1: near cal Poly for students.
- 7:37Speaker 4: Hi, it's Jenny Garth, hosts of the I Choose Me podcast.
- 7:41Speaker 4: This week Monica Lewinsky. Yes, that Monica, the one the
- 7:45Speaker 4: world tore apart. She's still standing. She's back and done hiding.
- 7:49Speaker 1: It really felt like it was one of those situations
- 7:53Speaker 1: where you literally do or die.
- 7:55Speaker 4: Monica stared down shame and came out the other side,
- 7:59Speaker 4: and she is here to change what you thought you knew.
- 8:02Speaker 4: And it's sort of not over until we try it.
- 8:04Speaker 4: A conversation that will inspire you to choose yourself starting today.
- 8:09Speaker 4: Listen to I Choose Me on the iHeartRadio app, Apple Podcasts,
- 8:12Speaker 4: or wherever you get your podcasts.
- 8:19Speaker 1: In two thousand, Scott and Lacey sell the shack and
- 8:22Speaker 1: moved to Medesto to be closer to Lacey's family as
- 8:24Speaker 1: they plan to have children. They purchased the home at
- 8:27Speaker 1: five twenty three Covina Avenue. All right, please add that
- 8:30Speaker 1: to my Leely Brunette tour. That's their home. It's in Modesto.
- 8:33Speaker 1: The address is five twenty three Covina Avenue. Scott works
- 8:37Speaker 1: for the agricultural Supply Company Trade Corp. While Lacey works
- 8:41Speaker 1: as a substitute teacher. He sells fertilizer.
- 8:43Speaker 2: Did you know that he's been selling it ever since?
- 8:46Speaker 1: Yeah. June of two thousand and two, after experiencing difficulty
- 8:50Speaker 1: conceiving and undergoing fertility treatments, Lacey announces that she is pregnant.
- 8:54Speaker 1: The couple learns they are expecting a boy, and they
- 8:57Speaker 1: plan to name him Connor. I know of the other
- 9:00Speaker 1: issues that came up at trial, and I don't know
- 9:02Speaker 1: if we get a lot into it, but they're the prosecution.
- 9:05Speaker 1: I do believe alleged that part of the reason that
- 9:08Speaker 1: he allegedly killed Lacey was because he did not want
- 9:11Speaker 1: to have children, and that he had made it clear
- 9:13Speaker 1: that he didn't want to have children, so that was
- 9:16Speaker 1: a source of the for are.
- 9:18Speaker 2: Other measures to take so you don't have children other
- 9:21Speaker 2: than killing your family?
- 9:23Speaker 1: Again, I said, allegedly killed, And I'm just saying that.
- 9:29Speaker 2: Well, right, don't you Well it sounds like you're going
- 9:32Speaker 2: in the direction of wrongfully blamed for killing.
- 9:36Speaker 1: Maybe possibly, but we're going to talk about that in
- 9:38Speaker 1: part two.
- 9:39Speaker 2: We got Part two.
- 9:39Speaker 1: On November twentieth of two thousand and two, Scott begins
- 9:42Speaker 1: a romantic relationship with Fresno massage therapist Amber Fry, after
- 9:47Speaker 1: being introduced to her by a friend named Sean Sibley.
- 9:51Speaker 1: Scott tells Amber that he is single and lives alone
- 9:54Speaker 1: in Sacramento. From November to December of two thousand and two,
- 9:58Speaker 1: Scott becomes involved in Amber's life and spends time with
- 10:01Speaker 1: her young daughter. According to Amber, he discusses a future
- 10:04Speaker 1: with them, but says he does not want biological children
- 10:07Speaker 1: of his own and has considered having a vasectomy. In
- 10:11Speaker 1: early December of two, Sean Sibley, he was the friend
- 10:14Speaker 1: that introduced them, learns that Scott is married and confronts him.
- 10:17Speaker 1: Scott reportedly claims that he has lost his wife, but
- 10:21Speaker 1: does not explain what happened to her. December of two
- 10:26Speaker 1: thousand and two, Scott purchases as small he.
- 10:30Speaker 2: Has to say he has a wife beat because they
- 10:32Speaker 2: know he has kids.
- 10:34Speaker 1: Who has kids?
- 10:35Speaker 2: Well, why is he saying he lost his wife?
- 10:37Speaker 1: Because he's having an affair and he doesn't want her
- 10:40Speaker 1: to She never knows that he's married.
- 10:42Speaker 2: But that's the thing. Why did he even have to
- 10:44Speaker 2: say that. Why can't you say I'm single?
- 10:46Speaker 1: I don't. I don't know, because he just says he
- 10:50Speaker 1: lost his wife. He says he doesn't look he's a douchebag.
- 10:52Speaker 1: I'm not disputing that the.
- 10:53Speaker 2: Guy is a I wasn't alleging that. I was just saying,
- 10:56Speaker 2: why why does he have to come up with a story.
- 10:58Speaker 1: That's his story he comes up with, and I believes
- 11:00Speaker 1: that's what he tells amberfry to He says that he
- 11:02Speaker 1: lost his wife. This is before it's weird. This is
- 11:05Speaker 1: before Lacey disappears.
- 11:06Speaker 2: No, I do.
- 11:07Speaker 1: That's not great for him. That doesn't look great for him.
- 11:09Speaker 2: I will love it looks great for this guy.
- 11:10Speaker 1: I will agree with that. In December of two thousand
- 11:13Speaker 1: and two, Scott purchases a small fishing boat for approximately
- 11:16Speaker 1: fourteen hundred dollars in cash and keeps it at his
- 11:19Speaker 1: warehouse without telling Lacey. We'll dispute that. Later records later
- 11:26Speaker 1: introduced by prosecutors reportedly showed that he researched boats, fishing locations,
- 11:30Speaker 1: and fish in season and currents in San Francisco.
- 11:34Speaker 2: Saying that is this statement that he bought it without
- 11:38Speaker 2: her knowing and did not disclose it to her, implying
- 11:43Speaker 2: that it was in preparation of, yes, fishing trips with
- 11:50Speaker 2: dead bodies. He threw me off when you said, fishing
- 11:52Speaker 2: trips with dead bodies.
- 11:53Speaker 1: The prosecution during the trial alleges that the boat was
- 11:57Speaker 1: bought in secret as a premeditation to tactic in order
- 12:01Speaker 1: to get rid of his wife, and that she did
- 12:03Speaker 1: not know about the boat.
- 12:05Speaker 2: However, that means nothing to me. So whether he told
- 12:09Speaker 2: her or not does not imply murder or not murder.
- 12:13Speaker 1: Well, but that's part of their I mean, it's all
- 12:16Speaker 1: circumstantial evidence that he's convicted on.
- 12:18Speaker 2: You can see the fishing boat and be like, wait,
- 12:20Speaker 2: what do you have planned for me? What's going on here?
- 12:22Speaker 1: No, but there there. Their argument is that he bought
- 12:26Speaker 1: it in secret so that he could get rid of
- 12:28Speaker 1: the body. And no one knows that he has a
- 12:30Speaker 1: fishing boat.
- 12:31Speaker 2: That's what they're other people knowing he has a fishing.
- 12:34Speaker 1: It was supposed to Well, he claims, we're going to
- 12:37Speaker 1: get into this impartant too, because there's more. He has
- 12:40Speaker 1: a boat, right, but he claims that he bought the
- 12:43Speaker 1: boat as a gift for his father in law, and
- 12:47Speaker 1: that and then the prosecution during the trial makes it
- 12:49Speaker 1: out to be like it's a secret fishing boat that
- 12:51Speaker 1: nobody knew about, and this is his way of premeditated
- 12:54Speaker 1: that he knows he's going to kill her, and this
- 12:55Speaker 1: is his way of getting rid of the body. However,
- 12:58Speaker 1: we will dispute that later. We're not going to do
- 12:59Speaker 1: that now, Part two, Part two. According to Amber, this
- 13:05Speaker 1: is December ninth of two thousand and two. So this
- 13:07Speaker 1: timeline's very important because you know that Lacey is going
- 13:10Speaker 1: to disappear soon. So December ninth of two thousand and two,
- 13:13Speaker 1: according to Amber, Scott tells her that he has lost
- 13:16Speaker 1: his wife and that the upcoming holiday will be his
- 13:19Speaker 1: first without her. This conversation occurs approximately two weeks before
- 13:23Speaker 1: Lacey actually does disappear. Now, this does not look great
- 13:26Speaker 1: for Scott.
- 13:27Speaker 2: Nothing it looks great for Scott.
- 13:29Speaker 1: I know, nothing looks great. I understand. But when we
- 13:32Speaker 1: get to part two, there are going to be some
- 13:34Speaker 1: things that you are going to have to No, no,
- 13:37Speaker 1: we can't.
- 13:37Speaker 2: We gotta do this and then we'll do a prequel.
- 13:39Speaker 1: But one this does bother me that he continues to
- 13:43Speaker 1: tell people that he lost his wife. Why not like
- 13:46Speaker 1: you said, why not just say you're single? I don't.
- 13:48Speaker 1: I don't know.
- 13:49Speaker 2: Yeah, I don't tell people I lost you. I had
- 13:50Speaker 2: to say I'm single.
- 13:52Speaker 1: Oh well, that's great.
- 13:54Speaker 2: They let make me feel better.
- 13:55Speaker 1: I feel great now, thank you. Now, I know you're
- 13:56Speaker 1: not going to kill me, get on me. You're not
- 13:58Speaker 1: going to kill me.
- 13:58Speaker 2: Though, And I don't by the fishing boat, I tell you, yeah.
- 14:01Speaker 1: I would know if you had a fishing boat. I
- 14:03Speaker 1: know everything you do, I know everywhere you do anything.
- 14:07Speaker 1: All right, Now we get to December twenty at the
- 14:08Speaker 1: two thousand and two, Scott purchases a two day fishing
- 14:11Speaker 1: license valid for December twenty third and the twenty fourth.
- 14:15Speaker 1: All right, December twenty third to two thousand and two,
- 14:17Speaker 1: So this is the day before we know is.
- 14:19Speaker 2: He a fisherman by trade?
- 14:21Speaker 5: Like?
- 14:21Speaker 2: Is he?
- 14:21Speaker 1: I think he enjoys fishing.
- 14:23Speaker 2: So that's not that's It's not like if I bought
- 14:24Speaker 2: a fishing boat, you'd like, can never fish in your life?
- 14:26Speaker 1: Would you know if you bought a fishing boat, that
- 14:28Speaker 1: would be weird. I went and call Shane outdoorsy a
- 14:33Speaker 1: fisherman or outdoorsy.
- 14:36Speaker 2: Like I can't go out. I'm trapped at home all
- 14:37Speaker 2: the time, right, you keep me kept in here?
- 14:39Speaker 1: Yes, I'm sorry, all right, false imprisonment, all right. So
- 14:43Speaker 1: now we get to December twenty third to two thousand
- 14:45Speaker 1: and two. This is the day before her disappearance, and
- 14:48Speaker 1: this is the day before Christmas Eve. Lacey visits the
- 14:51Speaker 1: salon where her half sister, Amy Roacha works. Amy assumes
- 14:55Speaker 1: that Scott plans to golf the following day because she
- 14:57Speaker 1: had recently cut his hair for that purpose. I don't know.
- 15:00Speaker 1: I guess he needed a haircut for a golf outing,
- 15:02Speaker 1: he does tell police when they interview him. I do
- 15:05Speaker 1: remember that they said, what were your plans for that day?
- 15:08Speaker 1: He's going through the timeline of when Lacey, you know, disappeared.
- 15:11Speaker 1: He had seen her that morning. He says that he'd
- 15:13Speaker 1: planned either to go golfing or to go fishing. So
- 15:17Speaker 1: the fishing trip, according to him in the interviews, was
- 15:20Speaker 1: a spontaneous Okay, I'm just going to go fishing. December
- 15:24Speaker 1: twenty third to two thousand and two, approximately at eight
- 15:27Speaker 1: thirty pm, Lacey does speak briefly with her mother, Sharon Roache.
- 15:31Speaker 1: This is the last confirmed contact that anyone other than
- 15:35Speaker 1: Scott has with her.
- 15:36Speaker 2: This is on the twenty third.
- 15:38Speaker 1: This is the twenty third, so this is the day
- 15:40Speaker 1: before Christmas Eve. Now we get to December twenty fourth,
- 15:42Speaker 1: at two thousand and two. It is the morning time.
- 15:45Speaker 1: Scott later tells investigators that he and Lacey ate breakfast
- 15:48Speaker 1: and watched Martha Stewart Living. He says Lacey planned to
- 15:52Speaker 1: mop the floor and walk the couples this old watch
- 15:55Speaker 1: riever Mackenzie more innocent.
- 15:57Speaker 2: Ah, we were watching Martha Stewart Living.
- 16:00Speaker 1: Yes, okay, But this is funny though, because he does
- 16:02Speaker 1: tell investigators that and they don't believe him at all,
- 16:05Speaker 1: and I believe they don't do their due diligence. So
- 16:08Speaker 1: then in trial, I believe that they think that they're going.
- 16:12Speaker 2: To be They question him, like what she was preparing
- 16:14Speaker 2: that day, Martha Stewart.
- 16:16Speaker 1: Or something, Yes, and he said merengue, and.
- 16:18Speaker 2: Then they looked it up.
- 16:19Speaker 1: They didn't look it up. They just assumed that he
- 16:21Speaker 1: was lying. Then the defense pulls up the actual episode
- 16:29Speaker 1: and she does talk about marengue. Oh, I think they
- 16:33Speaker 1: talked about marringe at nine forty eight in the morning,
- 16:35Speaker 1: So that's establishing a time.
- 16:37Speaker 2: You're like, that would be weird if it was like,
- 16:39Speaker 2: what if they watched Housewives, Yeah, and they're like, I
- 16:41Speaker 2: remember it was in Emily said I'm going to kill you. Yeah,
- 16:44Speaker 2: and then they pull it up in court.
- 16:45Speaker 1: Yeah, that would be great. I would love to contribute
- 16:48Speaker 1: in any way possible. December twenty fourth two or in
- 16:52Speaker 1: the morning, he talks about Martha Stewart living After approximately
- 16:56Speaker 1: nine forty eight am, Scott leaves the couple's home and
- 16:59Speaker 1: drives to his where house located about three miles away.
- 17:02Speaker 1: We're going to talk about this timeline and the timeline
- 17:04Speaker 1: and trial because the timeline, Yeah, well and part two
- 17:07Speaker 1: we're going to pick up our turt right now. I know,
- 17:09Speaker 1: but right now we're just going to go with what
- 17:11Speaker 1: the prosecution alleges.
- 17:13Speaker 2: So we're kind of going in chronological order of how
- 17:15Speaker 2: the evidence is being surfaced and everything.
- 17:17Speaker 1: They claim that he left prior to ten in the morning,
- 17:20Speaker 1: because I believe when he gets to work his work
- 17:23Speaker 1: computer he's logged on I think at like ten oh
- 17:26Speaker 1: eight or something like that, and his office is very
- 17:29Speaker 1: close by his home. So the timeline is suggesting that
- 17:33Speaker 1: he probably I think the Martha Stewart episode where they
- 17:36Speaker 1: said Meringue was nine forty eight, but then he logs
- 17:38Speaker 1: into his work computer at ten oh eight, So you
- 17:41Speaker 1: can you can give.
- 17:42Speaker 2: Twenty minutes is not reasonable for him to go from?
- 17:45Speaker 1: No, it is? It is, So I'm saying.
- 17:47Speaker 2: He can't add up.
- 17:48Speaker 1: Then well, yeah, he probably leaves the house at nine
- 17:53Speaker 1: point fifty and then he gets to work at ten.
- 17:55Speaker 1: But they have They're very stuck on that timeline because
- 17:58Speaker 1: for the prosecution, they claim that she was murdered prior
- 18:02Speaker 1: to that time. That's the how Scott's guilty. Right. She
- 18:06Speaker 1: has to be dead before he leaves for work.
- 18:09Speaker 2: Right, because he logged into his computer. That was the
- 18:11Speaker 2: alibi for where he was at that time. Thus the
- 18:13Speaker 2: murder had to take place prior to if it was him.
- 18:18Speaker 1: Also, on December twenty fourth, this is approximately at ten
- 18:21Speaker 1: eighteen am, the neighbor Karen Service, finds Mackenzie the dog
- 18:26Speaker 1: wandering outside with his leash still attached. She returns the
- 18:30Speaker 1: dog to the Peterson's yard.
- 18:32Speaker 2: What time is this again?
- 18:32Speaker 1: This is at ten eighteen. She claims it's ten eighteen,
- 18:35Speaker 1: and the prosecution goes with her timeline again. I'm going
- 18:38Speaker 1: to say this probably five million times. There are other
- 18:41Speaker 1: witnesses that we're going to talk about in part two
- 18:44Speaker 1: that might pick apart this timeline. But as for today's purpose,
- 18:48Speaker 1: based upon a receipt that she had and some other
- 18:50Speaker 1: things going on, she narrows it down to about ten
- 18:53Speaker 1: eighteen that she finds the dog with the leash attached. Also,
- 18:56Speaker 1: by the way, I don't know if this was in
- 18:58Speaker 1: the original trial or not, but the leash is found
- 19:02Speaker 1: wet and with lots of pieces of grass on it,
- 19:04Speaker 1: which would mean that the dog.
- 19:06Speaker 5: Well at least went through some grassy area, right, Not
- 19:09Speaker 5: that the dog, Not that Lacey had had the dog
- 19:12Speaker 5: and put the leash on and then maybe ran back
- 19:14Speaker 5: in the house really quickly to get something, and the
- 19:16Speaker 5: dog was only briefly there that Scott Peterson put the
- 19:20Speaker 5: leash on the dog and set the dog loose. Well
- 19:23Speaker 5: wait a minute, but why couldn't the dog by itself
- 19:25Speaker 5: go through a gag grassy field.
- 19:28Speaker 1: It could. I'm not saying that she took the dog
- 19:31Speaker 1: through the grassy field. I'm just saying that its significant
- 19:35Speaker 1: that the leash is wet and has grass stuck all
- 19:37Speaker 1: over it, which means that the dog had been probably
- 19:40Speaker 1: out somewhere, not just left briefly in front of the house.
- 19:44Speaker 1: That's all I'm saying right now, all right, all right,
- 19:47Speaker 1: So the dog is found with the leash still attached.
- 19:49Speaker 1: Now December twenty fourth of two thousand and two. Now
- 19:52Speaker 1: we get to approximately ten thirty to eleven am. Computer
- 19:56Speaker 1: activity places Scott at his warehouse where he reads and
- 20:00Speaker 1: sends emails. He then attaches his fishing boat to his
- 20:03Speaker 1: truck and drives roughly ninety miles to the Berkeley Marina.
- 20:07Speaker 1: Now that's another question I have, and a lot of
- 20:09Speaker 1: people question this, and this is why a lot of
- 20:11Speaker 1: people think that he was guilty if you're going to
- 20:13Speaker 1: go fishing, because he claims that he only takes the
- 20:15Speaker 1: fishing boat out. This is a very small fishing boat.
- 20:17Speaker 1: If you've seen a picture of it, it's it's just
- 20:19Speaker 1: like a little like ten fishing boat blow ten. I
- 20:24Speaker 1: don't know. It's great aluminum.
- 20:26Speaker 2: It's ten ten ten ten T I number no ten
- 20:30Speaker 2: t N like a just small little fishing boat.
- 20:35Speaker 1: It doesn't have a cover.
- 20:36Speaker 2: You know, it's not something you would go out with
- 20:38Speaker 2: your girlfriends on.
- 20:39Speaker 1: Not with your with your No. I would suggest don't
- 20:42Speaker 1: go out in as an old right, Yeah, right December
- 20:48Speaker 1: twenty fourth of two, twelve fifty four pm, a parking
- 20:51Speaker 1: receipt places Scott at the Berkeley Marina. He later says
- 20:54Speaker 1: he took the boat out to test it and fish
- 20:57Speaker 1: near Brooks Island approximately between one and two pm. Scott
- 21:03Speaker 1: says he fishes in San Francisco Bay, and prosecutors would
- 21:06Speaker 1: later emphasize that Lacy and Connor's remains were eventually found
- 21:10Speaker 1: close to this area. All Right, around two fifteen pm,
- 21:13Speaker 1: Scott calls the Peterson home and Lacy's cell phone. He
- 21:17Speaker 1: leaves a message saying he is leaving Berkeley and asked
- 21:19Speaker 1: Lacy to pick up a holiday gift basket. I have
- 21:22Speaker 1: listened to this voicemail. He's very, very very sweet. Now
- 21:28Speaker 1: here's the question, go k salved. Well, here's the question.
- 21:32Speaker 1: Is she already dead and he knows that she's dead,
- 21:34Speaker 1: so he's establishing an alibi by calling and leaving a voicemail,
- 21:38Speaker 1: or is she not dead? He has no idea she's
- 21:40Speaker 1: dead and he's just being and playing the doting husband
- 21:43Speaker 1: that's having an.
- 21:44Speaker 2: Affair that she has hearst of. That is, does he
- 21:46Speaker 2: normally leave messages to her? Well, if I left a
- 21:50Speaker 2: message for you. That would be weird.
- 21:52Speaker 1: It would be very weird.
- 21:53Speaker 2: On well, we do texting now, but that that's what
- 21:56Speaker 2: I'm saying. Out of the ordinary.
- 21:57Speaker 1: Well, he calls and leaves a message, and he calls
- 21:59Speaker 1: her sweet and he's like, if you called left me
- 22:02Speaker 1: a voicemail and you called me sweetie, there's a serious
- 22:05Speaker 1: problem that you've done something wrong. You're up to no good.
- 22:09Speaker 1: Then we get to approximately four thirty pm. Scott returns
- 22:13Speaker 1: to his warehouse, leaves the boat there, and drives home.
- 22:16Speaker 1: He says that he finds Lacey's car in the driveway,
- 22:18Speaker 1: the front door unlocked, and Mackenzie is in the yard
- 22:21Speaker 1: with the leash still attached. Later in that afternoon, Scott
- 22:25Speaker 1: puts his clothes in the washing machine, eats leftover pizza,
- 22:27Speaker 1: and takes a shower before contacting Lacey's family. He later
- 22:31Speaker 1: says he initially assumed that she was at her mother's house.
- 22:34Speaker 1: Then by five seventeen pm, this is still on Christmas Eve,
- 22:38Speaker 1: Scott calls Sharon Rocha and learns that Lacey is not
- 22:40Speaker 1: with her family. He tells Sharon that Lacey is missing.
- 22:44Speaker 1: Five forty seven pm, Lacey's stepfather, Ron Grantsky calls nine
- 22:48Speaker 1: one one and reports that eight month pregnant Lacey has disappeared.
- 22:52Speaker 1: Approximately six pm, the Mowdesto Police begins searching East Laloma Park,
- 22:57Speaker 1: where Lacey reportedly walked the dog Anna's Sam In the
- 23:00Speaker 1: Peterson home. Investigators find no obvious signs of forced entry
- 23:04Speaker 1: or a violent struggle. December twenty fourth to the twenty
- 23:09Speaker 1: fifth police search the home, Scott's truck, and his warehouse.
- 23:13Speaker 1: Scott voluntarily participates in a videotaped interview shortly after midnight
- 23:17Speaker 1: and initially says he is willing to take a polygraph.
- 23:20Speaker 1: He later declines on his father's advice. Let me just
- 23:24Speaker 1: say a little bit about this taped interview. They show
- 23:27Speaker 1: this interview all the time. Anytime you watch a Lacy
- 23:29Speaker 1: Peterson Scott Peterson documentary, they show this interview of its
- 23:34Speaker 1: detective Brokini interviewing Scott about Lacey, what he did that day,
- 23:40Speaker 1: he went fishing, all those things. Scott looks like the
- 23:44Speaker 1: biggest doucher in this interview because his wife is missing.
- 23:48Speaker 1: At this point, no one knows where she is. She
- 23:51Speaker 1: hasn't been seen, she's eight months pregnant. They interview him
- 23:55Speaker 1: it's on video tape. I've seen it multitudes of times.
- 23:59Speaker 1: He's completely relaxed. He shows no emotion, stoic kind of huh, well,
- 24:05Speaker 1: I mean stoic. He's disengaged, disassociative, whatever you want to
- 24:11Speaker 1: call it. Like, he doesn't seem to give a carer
- 24:13Speaker 1: in the world. That is pregnant wife of eight months
- 24:16Speaker 1: is missing and no one can find her.
- 24:18Speaker 2: I can picture that. I remember that Scott Peterson used
- 24:22Speaker 2: the word missing immediately when calling his mother in law Sharon,
- 24:25Speaker 2: on Christmas Eve in two thousand and two, which Sharon
- 24:29Speaker 2: testified felt like a premature and suspicious choice of language
- 24:34Speaker 2: when he called her.
- 24:35Speaker 1: Okay, but listen, if you come home and you can't
- 24:38Speaker 1: find me and you don't know where I am, you
- 24:39Speaker 1: wouldn't call my sister and say Emily is missing.
- 24:42Speaker 2: No, your sister lives in Ohio. How that can help me?
- 24:45Speaker 2: This is this? Nope, you have to make it apples
- 24:48Speaker 2: and apples. If you don't hear from me from ten
- 24:51Speaker 2: o'clock until five o'clock, right, I don't respond or anything,
- 24:57Speaker 2: and then you want to know where I am because
- 24:59Speaker 2: you want to get mad at me for something, Right,
- 25:01Speaker 2: then you call my parents, Do you say Shane is
- 25:05Speaker 2: missing or I can't. I haven't heard from him. I
- 25:08Speaker 2: can't find him. Have you heard from him? Do you
- 25:10Speaker 2: know where he is? You don't say Shane is missing.
- 25:14Speaker 2: That's not that's not true. It's not missing. He's not
- 25:16Speaker 2: missing yet.
- 25:17Speaker 1: Maybe I would say Shane is missing because you're always here.
- 25:20Speaker 1: If you're always here and you're not here, you're missing.
- 25:22Speaker 1: I probably would call your mom and go, Shane is missing.
- 25:27Speaker 1: I don't know. I don't know, stucking up, Shane is missing.
- 25:32Speaker 1: Let me ask you a question. Though he initially says
- 25:34Speaker 1: in the interview that he will take a polygraph, and
- 25:36Speaker 1: then he goes, it's accurate, right, he asked the detective,
- 25:39Speaker 1: and the detectives like, well, yeah, I mean, I guess, yeah,
- 25:41Speaker 1: it's accurate.
- 25:42Speaker 3: You know.
- 25:43Speaker 1: Would you advise him if you were his attorney, would
- 25:45Speaker 1: you advise him to take a polygraph?
- 25:47Speaker 2: No?
- 25:48Speaker 1: Well, he then he declines later I believe after he
- 25:50Speaker 1: talks to his dad and he just declined a polygraph,
- 25:53Speaker 1: I would not. Yeah, would you take a polygraph if
- 25:56Speaker 1: I was missing?
- 25:58Speaker 2: Do I have anything to do with it? Because that
- 26:01Speaker 2: changes my answer.
- 26:05Speaker 6: Dancing with the Stars is looking for a new pro,
- 26:08Speaker 6: and since last season I came in eighth place. I'm
- 26:11Speaker 6: basically an expert easy there.

- 26:16Speaker 7: you could use some help. I'm Danielle Fischer and I'm Vouchmerkovsky,

- 26:45Speaker 7: a lifetime opportunity.
- 26:47Speaker 1: Do you think I could win?
- 26:48Speaker 2: No?
- 26:49Speaker 6: Listen to Stepping on Toes on the iHeartRadio app, Apple
- 26:52Speaker 6: Podcasts or wherever you get your podcasts.
- 27:01Speaker 1: Now December twenty six, so we get to the day
- 27:03Speaker 1: after Christmas as Search headquarters opens at the Red Lion Hotel.
- 27:07Speaker 1: Volunteers conduct extensive searches by foot, horseback and boat. December
- 27:12Speaker 1: twenty six, of two thousand and two, a home across
- 27:14Speaker 1: the street from the Peterson residence is burglarized. The defense
- 27:18Speaker 1: later argues that the burglary could be connected to Lacey's disappearance,
- 27:21Speaker 1: and police arrest the burglars and conclude the crime occurred
- 27:25Speaker 1: on December twenty six and was unrelated, although the timing
- 27:29Speaker 1: and possible connection remained disputed by Peterson's supporters. Again, I
- 27:35Speaker 1: will say that I do not think in any way,
- 27:38Speaker 1: shape or form that this burglary took place on December
- 27:41Speaker 1: twenty six. There's no way. By this point Lacey had
- 27:45Speaker 1: been missing for two days, which means that her entire
- 27:49Speaker 1: street is full of police, police, investigators, caution, tapets, reporters.
- 27:57Speaker 1: You're gonna tell me that with all that police presence
- 28:01Speaker 1: and all those reporters, and they.
- 28:02Speaker 2: Probably would rather steal all the Christmas presents under the
- 28:05Speaker 2: tree on the twenty fourth rather than on twenty six,
- 28:07Speaker 2: and they have to go find it exactly.
- 28:09Speaker 1: So, you cannot convince me that that happened on December
- 28:12Speaker 1: twenty sixth. It happened on December twenty fourth. But we
- 28:14Speaker 1: will talk about that more or later. Part two, Part two.
- 28:17Speaker 1: On December twenty ninth of O two, Fresno police officer
- 28:20Speaker 1: Richard Byrd tells Amber that the Scott Peterson she is
- 28:23Speaker 1: dating appears to be the husband of the missing Modesto woman.
- 28:28Speaker 1: Amber then contacts Modesto police and meets with detectives Al
- 28:32Speaker 1: Brokini and John Buehler. She provides photographs, gifts, and details
- 28:36Speaker 1: establishing her relationship with Scott. At investigator's requests, she agrees
- 28:41Speaker 1: to secretly record future conversations with him. Then, on December
- 28:45Speaker 1: thirtieth of two, Scott hires attorney Kirk McAllister. While the
- 28:49Speaker 1: missing person investigation is underway, you know, it's also there's
- 28:54Speaker 1: so much footage of everyone looking for Lacey, and I
- 28:58Speaker 1: don't know if Scott was really involved in a lot.
- 29:02Speaker 2: He didn't go to the memorial thing or the thing
- 29:04Speaker 2: where they hold candles.
- 29:05Speaker 1: Yeah, you know, it's not a good look for him.
- 29:07Speaker 1: I don't feel like he I think nothing.
- 29:11Speaker 2: Nothing is a good look for this guy.
- 29:13Speaker 1: You keep saying that, you know, and he avoids the
- 29:15Speaker 1: media in the beginning, he doesn't answer questions. Not a
- 29:17Speaker 1: good look for him. And then when he does decide
- 29:20Speaker 1: that he's going to go in front of the media
- 29:22Speaker 1: and do interviews and answer questions. Horrible, horrible look for
- 29:27Speaker 1: him awful.
- 29:28Speaker 2: Well, then then I know we're fast forwarding. But then
- 29:30Speaker 2: he tries to run away, doesn't He bleach his hair
- 29:32Speaker 2: and get a bunch of cash and he goes to
- 29:34Speaker 2: the border. It's like, dude, this guy.
- 29:37Speaker 1: He does he does? Yeah, I don't know, though. You
- 29:39Speaker 1: could look at that two ways. You could look at
- 29:41Speaker 1: it like he already knows the police have honed in
- 29:42Speaker 1: on him, and that you.
- 29:44Speaker 2: Can always look at it like you're running because you're innocent.
- 29:46Speaker 2: I get it.
- 29:47Speaker 1: But yeah, I'm just saying be open minded. On January
- 29:51Speaker 1: sixth of two thousand and three, Scott does admit to
- 29:53Speaker 1: Amber that he has not been traveling overseas and that
- 29:55Speaker 1: his pregnant wife has disappeared. On Christmas Eve, Amber confronts
- 29:59Speaker 1: him about why he previously said he had already lost
- 30:02Speaker 1: his wife, and Scott does not provide a clear explanation
- 30:05Speaker 1: or confess to harming Lacey. You know, she records all
- 30:09Speaker 1: these conversations thinking that at some point she's going to
- 30:11Speaker 1: get some kind of evidence where he's going to admit
- 30:13Speaker 1: to her that like he did, something to Lacy, but
- 30:15Speaker 1: he never does.
- 30:16Speaker 2: You know.
- 30:16Speaker 1: My favorite though, is when he pretends to be in Paris.
- 30:19Speaker 1: He tells her that he's been traveling across Europe.
- 30:21Speaker 2: I guess something.
- 30:23Speaker 1: Yeah, and he's like, I'm and he's like talking to
- 30:25Speaker 1: her and he's like, I'm looking at the Eifel.
- 30:28Speaker 2: Fertilizer in Paris.
- 30:30Speaker 1: Yeah.
- 30:31Speaker 2: I was like, my gosh, why would he do that?
- 30:34Speaker 2: Is he trying to say he's romantic without her? Like,
- 30:36Speaker 2: I don't get it?
- 30:37Speaker 1: Well, I think he can't see her because the police
- 30:39Speaker 1: are looking for his wife, so he has to come
- 30:41Speaker 1: up with a reason why they can't get together. So
- 30:43Speaker 1: he tells her he's traveling in Europe. So he keeps
- 30:46Speaker 1: calling her to keep this relationship going, but he can't
- 30:50Speaker 1: physically see her because he's supposed to be looking for
- 30:53Speaker 1: his wife, right right, And he can't get caught with
- 30:56Speaker 1: his I mean, he's got the media all over him.
- 30:58Speaker 1: They'reollowing him every where he goes. So he tells her
- 31:00Speaker 1: he's traveling Europe and he's looking at the house.
- 31:03Speaker 2: Do not think that Amber Frey's going to see him
- 31:05Speaker 2: on TV?
- 31:07Speaker 1: I don't know. I'm not saying the guy's bride and.
- 31:09Speaker 2: It's not a good look. It's not a good look
- 31:11Speaker 2: for him, not a good look.
- 31:14Speaker 1: January twenty, third of three, Amber publicly reveals that she
- 31:17Speaker 1: began dating Scott after he told her that he was unmarried.
- 31:20Speaker 1: She explains that she immediately contacted the police after learning
- 31:24Speaker 1: of Lacey's disappearance. Lacey's family announces that it has learned
- 31:29Speaker 1: of Scott's affair, and family members who had initially defended him,
- 31:33Speaker 1: they withdraw their public support. They withdraw their support, like
- 31:37Speaker 1: on camera, they made sure they made a thing out
- 31:39Speaker 1: of it. They basically go up into a press conference
- 31:42Speaker 1: and say, we no longer support Scott Peterson.
- 31:45Speaker 2: Would you, I mean, was your son in law?
- 31:49Speaker 1: I don't. I don't know what I would do. I
- 31:51Speaker 1: don't know. I've never been in a situation like that.
- 31:53Speaker 1: I don't, I don't know. I mean, I wouldn't be.
- 32:00Speaker 2: He's county, so it's hard for you to say that's
- 32:02Speaker 2: what you would do.
- 32:05Speaker 1: So yeah, yes, all right, he doesn't, like I said,
- 32:09Speaker 1: He initially avoids all media contact. He doesn't do interviews,
- 32:11Speaker 1: he doesn't talk to anyone, he declines comments. He's always
- 32:15Speaker 1: you know, they show everyone out searching. He's like on
- 32:17Speaker 1: the outskirts or not there. He's not involved. He doesn't
- 32:19Speaker 1: look like he cares. So I think they.
- 32:21Speaker 2: Sell his car too soon.
- 32:23Speaker 1: He sold her car, yeah, not soon, but it was,
- 32:27Speaker 1: you know, not a good look. It was before I
- 32:29Speaker 1: believe he sold I'm not sure when he sold her car,
- 32:31Speaker 1: but I think it was before the body was found.
- 32:35Speaker 1: On January twenty eighth of two thousand and three, Scott
- 32:38Speaker 1: does an interview with Diane Sawyer on Good Morning America.
- 32:42Speaker 1: He should have never done this interview.
- 32:44Speaker 2: Why why would you do an interview? Well, you know
- 32:46Speaker 2: why you would do an interview if you if you're innocent,
- 32:48Speaker 2: and you're trying to get the word out, and you're
- 32:50Speaker 2: really trying to get exposure so hopefully you get some
- 32:53Speaker 2: leads and stuff.
- 32:54Speaker 1: No. I think that because so many people were telling
- 32:56Speaker 1: him that he looks so bad in the press and
- 32:58Speaker 1: in the media, that maybe he sho should.
- 33:01Speaker 2: You should go in Good Morning America and look bad.
- 33:03Speaker 2: I'm terrible for the press.
- 33:05Speaker 1: He denies murdering Lacey or having anything to do with
- 33:09Speaker 1: her disappearance. However, this is so ridiculous. I can't believe
- 33:13Speaker 1: he did that. He claims that Lacey knew about the
- 33:16Speaker 1: affair with Amber Fry and that she was okay with it.
- 33:20Speaker 1: I was like, oh my gosh, why would you say
- 33:23Speaker 1: something like that.
- 33:25Speaker 2: And then they always say that, They always say like, oh, yeah,
- 33:28Speaker 2: we were kind of separating. They kind of knew.
- 33:31Speaker 1: No, but he doesn't claim that they were like separated right.
- 33:33Speaker 2: Now, but they always kind of Oh, this is even worse.
- 33:35Speaker 2: He's like, he.
- 33:36Speaker 1: Claims that, like she knew about it, she was okay
- 33:38Speaker 1: with it. She's eight months pregnant. She's fine with him
- 33:40Speaker 1: having an affair with somebody else.
- 33:42Speaker 2: Most couples watch Martha Stewart and then he can go golfing,
- 33:46Speaker 2: fishing and screws someone on the side.
- 33:48Speaker 1: Right, Yes, he you know, I don't. He needed a
- 33:53Speaker 1: media consultant, He needed someone to help him before he
- 33:57Speaker 1: did this interview.
- 33:59Speaker 2: Don't go into me, or he needed.
- 34:01Speaker 1: To just not say anything. He needed to stick with
- 34:02Speaker 1: the not talking to the media because going in front
- 34:05Speaker 1: of Diane Sawyer and answering questions about an affair, but
- 34:09Speaker 1: then saying that Lacey was fine with the affair and
- 34:11Speaker 1: she was cool with it, and then when Diane pressed
- 34:13Speaker 1: him on it and he said, well, you just don't
- 34:15Speaker 1: know our relationship. You sound like an idiot, a complete idiot.
- 34:19Speaker 1: You sound like a liar.
- 34:20Speaker 2: Not a good look.
- 34:21Speaker 1: It's not a good look. Early in two thousand and three,
- 34:25Speaker 1: investigators monitor Scott as he makes several trips to the
- 34:28Speaker 1: Berkeley Marina, authoritizing his vehicle. I think, right, oh, yeah,
- 34:31Speaker 1: they had trackers on him. Yeah. Authorities conduct searches of
- 34:34Speaker 1: the bay, but initially failed to locate Lacey so this
- 34:40Speaker 1: she disappeared on December twenty fourth. On April thirteenth of
- 34:42Speaker 1: two thousand and three, following a storm, the remains of
- 34:46Speaker 1: a male fetus are discovered along the San Francisco Bay
- 34:49Speaker 1: shoreline in Richmond on April fourteenth. The following day, the
- 34:53Speaker 1: decomposed torso of an adult woman is found nearby. The
- 34:57Speaker 1: body is missing its head, forearms, and lower legs. Investigators
- 35:01Speaker 1: note that both sets of remains washed ashore near the
- 35:04Speaker 1: area where Scott said he had gone fishing. Autopsies and
- 35:09Speaker 1: DNA testing identify the remains as Lacey and Connor, and
- 35:13Speaker 1: because of the condition of Lacey's body, examiners cannot conclusively
- 35:17Speaker 1: determine precisely when, where or how she died, and that
- 35:22Speaker 1: is a theme that will carry all the way into trial.
- 35:25Speaker 1: There is no evidence. I just want to reiterate this.
- 35:28Speaker 1: There is no evidence, no DNA, no forensics that can
- 35:34Speaker 1: identify how she died, when she died, where she died.
- 35:39Speaker 1: In April of two thousand and three, forensic pathologist doctor
- 35:42Speaker 1: Brian Peterson concludes that Connor died in Utero and was
- 35:46Speaker 1: likely expelled from Lacey's body after her death. He finds
- 35:50Speaker 1: no indication that Connor was naturally delivered or removed by
- 35:53Speaker 1: cesarean section. All right, so now we get to the
- 35:57Speaker 1: arrest of Scott Peterson on April eighteenth, the two thousand
- 36:01Speaker 1: and three police follow Scott into San Diego as he
- 36:04Speaker 1: drives toward Tory Pines golf Course, where.
- 36:06Speaker 2: It's an hour four months later or four months later,
- 36:09Speaker 2: Modesto and San Diego. It's a little bit of a drive.
- 36:12Speaker 1: It's like eight hours, right, because it we're Modesto's up
- 36:15Speaker 1: by the San Francisco.
- 36:16Speaker 2: Up towards that direction, Amita, how far up.
- 36:18Speaker 1: And now we're getting down to San Diego. It might
- 36:19Speaker 1: even be longer than eight hours, maybe that's nine.
- 36:21Speaker 2: Either way, it's now meaning it's not just like the
- 36:24Speaker 2: county next door.
- 36:24Speaker 1: It's like right, right, they issue an arrest warrant for
- 36:30Speaker 1: him for murder, but they they're tracking him, and they
- 36:34Speaker 1: track him in San Diego.
- 36:37Speaker 2: They probably saw it as fleeing, and so they quickly
- 36:41Speaker 2: right got an arrest warrant.
- 36:43Speaker 1: Right because he's getting close to Mexico. Right after Scott
- 36:46Speaker 1: attempts to evade the vehicles following him, officers arrest him.
- 36:50Speaker 1: This is on April eighteenth. Of three authorities find approximately
- 36:55Speaker 1: fifteen thousand dollars in cash, four cell phones, camping supplies,
- 37:00Speaker 1: his brother's identification, a map to Amber's workplace. His hair
- 37:05Speaker 1: and goateee have been dyed blonde. Prosecutors and the media
- 37:08Speaker 1: characterized these circumstances as evidence that he may have planned
- 37:12Speaker 1: to flee. Scott's family says he changed his appearance to
- 37:15Speaker 1: avoid reporters and possessed the other items for innocent reasons.
- 37:21Speaker 1: I don't know, I mean, maybe he was planning to flee.
- 37:23Speaker 2: Where did they catch him though? It wasn't he golfing?
- 37:25Speaker 1: Well, they claimed that he was supposed to meet, you know,
- 37:27Speaker 1: his family to play golf at the Tory Pines golf course.
- 37:30Speaker 2: Uh huh do you know? Did they just pull him over?
- 37:33Speaker 1: Yeah, and arrest him. But he was driving somebody else's vehicle.
- 37:36Speaker 1: He wasn't driving his own. He was driving like some
- 37:38Speaker 1: older two seater Mercedes. Obviously he's trying to avoid. I mean,
- 37:43Speaker 1: I understand he's probably trying to avoid not only police,
- 37:45Speaker 1: but also he's trying to evade. I'm sure he's followed
- 37:48Speaker 1: everywhere by reporters too. Yeah, I mean, this guy can't
- 37:52Speaker 1: He can't go golf at Tory Pine's golf course without
- 37:55Speaker 1: having a media frenzy following him everywhere he's going. While
- 37:59Speaker 1: detect his transport Scott back to Modesto, they receive confirmation
- 38:03Speaker 1: that the remains belong to Lacy and to Connor. Scott's
- 38:07Speaker 1: response is later described by investigators as limited. I don't know.
- 38:11Speaker 1: I don't think he shows much emotion once he knows
- 38:13Speaker 1: that it's confirmed that it's his wife and son that
- 38:15Speaker 1: have been found in the bay. I don't think he
- 38:18Speaker 1: shows that's a big thing, like.
- 38:20Speaker 2: One way or another. Like he's not feeling like, hey, okay,
- 38:23Speaker 2: well I'm glad we found her body. We can now
- 38:26Speaker 2: investigate further. And it's not even sadness that she's dead.
- 38:30Speaker 1: Right, No, he doesn't show much emotion ever since the
- 38:33Speaker 1: day she disappeared. But then, you know, sometimes I think
- 38:36Speaker 1: if someone if I was missing and someone interviewed you
- 38:39Speaker 1: about me missing, I don't know if you would show
- 38:42Speaker 1: a lot of emotion either, because you're not a very
- 38:44Speaker 1: emotional person. But that doesn't mean you're guilty.
- 38:49Speaker 2: No, that was a very nice thing to say.
- 38:53Speaker 1: Well, I'm just saying, like, you're not the kind of
- 38:55Speaker 1: guy that's going to be like weeping and crying and
- 39:00Speaker 1: like throwing yourself on the ground, and like why why I.
- 39:03Speaker 2: Don't know any guy that would do that in media
- 39:06Speaker 2: if their wife is missing, throw themselves on the ground.
- 39:09Speaker 1: I don't know. I'm just saying, you're not going to
- 39:10Speaker 1: make a big emotional You're not going to look emotional.
- 39:13Speaker 1: I just know you. You just you don't show a lot
- 39:15Speaker 1: of emotion sometimes. So I'm just saying, if I disappeared
- 39:18Speaker 1: and they interviewed you, I.
- 39:20Speaker 2: Might show some emotions.
- 39:21Speaker 1: Oh yeah, all right. Scott is arraigned on two murder charges.
- 39:26Speaker 1: He is charged with first degree murder in Lacy's death
- 39:29Speaker 1: and second degree murder in Connor's death. Prosecutors announced that
- 39:32Speaker 1: they will seek the death kind of.
- 39:33Speaker 2: You know, if I didn't show emotions.
- 39:35Speaker 1: Oh we're back to that again.
- 39:36Speaker 2: Okay, it wouldn't work really too much against me, you
- 39:41Speaker 2: know I because I also didn't go fishing where your
- 39:46Speaker 2: body was found. I didn't have an affair that I'm
- 39:50Speaker 2: saying is so stupidly recognized by you and is okay
- 39:53Speaker 2: by you. You know. I wouldn't have any of those things.
- 39:57Speaker 1: I get it. You're so you could and that.
- 40:00Speaker 2: Would be one thing, big deal.
- 40:02Speaker 1: Right, Okay, so you're allowed to have a lack of emotion.
- 40:05Speaker 1: Could you do anything else wrong? Scott's family hires high
- 40:16Speaker 1: profile defense attorney. Who does he hire? You know this?
- 40:20Speaker 2: He hires?
- 40:24Speaker 1: Come on, yes. Garago's team investigates possible sightings of Lacey
- 40:32Speaker 1: after Scott left home, and the burglary across the street,
- 40:35Speaker 1: and other alternative theories. April first of two thousand and four,
- 40:40Speaker 1: President George W. Bush signs the Federal Unborn Victims of
- 40:43Speaker 1: Violence Acts, sometimes called the Lacy and Connor's Law. The
- 40:47Speaker 1: legislation recognizes an embryo or fetus as a separate victim
- 40:50Speaker 1: when injured or killed during certain federal violent crimes. California
- 40:54Speaker 1: already had a fetal homicide law, under which Scott was
- 40:57Speaker 1: charged separately for Connor's death. All Right, he goes to jail,
- 41:00Speaker 1: or he goes to trial in January of two thousand
- 41:03Speaker 1: and four.
- 41:03Speaker 2: Okay, if he's found not guilty and he's now has charged,
- 41:07Speaker 2: his conviction is reversed, does that make Garrogos look like
- 41:11Speaker 2: a bad attorney? Is that not a good look for him?
- 41:15Speaker 1: What do you mean?
- 41:16Speaker 2: Well, just in general, if let's say, let's say evidence
- 41:19Speaker 2: now surfaces. Yeah, let's say I don't know, there's a
- 41:22Speaker 2: retrial or a mini trial or some appeal or something
- 41:26Speaker 2: where now it's like, you know what, Scott Peterson, there
- 41:28Speaker 2: is doubt, well that.
- 41:29Speaker 1: Is going on right now, the project is according.
- 41:32Speaker 2: To that's the that's the court order. They reverse it.
- 41:37Speaker 2: Does that make his defense attorney look bad?
- 41:40Speaker 1: Well? I think that Gargos made some mistakes, that's for sure.
- 41:43Speaker 1: But I also when we get to part two, we
- 41:45Speaker 1: will talk about the fact that there was a lot
- 41:47Speaker 1: of evidence that the that the police suppressed that Gargos
- 41:52Speaker 1: was not privy.
- 41:52Speaker 2: To Okay, Okay, So that's more of a legal administrative matter.
- 41:57Speaker 1: A prosecutorial problem. Okay, And we'll get more to that,
- 42:02Speaker 1: all right. In January two thousand and four, Because of
- 42:04Speaker 1: extensive publicity in Modesto, the trial is transferred from Stanislaus
- 42:09Speaker 1: County to San Mateo County. Guerragos has requested Los Angeles,
- 42:14Speaker 1: but the court selects Redwood City. A jury selection takes place,
- 42:18Speaker 1: and prospective jurors are questioned extensively about media exposure, their
- 42:23Speaker 1: opinions of Scott, and their views on capital punishment. Look,
- 42:26Speaker 1: this case was so huge and it was so much
- 42:28Speaker 1: in the media. I don't know if change of venue
- 42:30Speaker 1: does anything to help Scott Peterson. I mean, I know
- 42:33Speaker 1: they're going to take it out of the Modesto ARAA.
- 42:36Speaker 2: That was probably defense wanting a more favorable venue. Maybe
- 42:39Speaker 2: he's more familiar with them, Maybe the peers will be
- 42:42Speaker 2: more lenient.
- 42:43Speaker 1: Maybe. June first of two thousand and four, Scott's trial
- 42:46Speaker 1: begins before Judge Alfred de Lucci. Prosecutor Rick Distasso argues
- 42:51Speaker 1: that Scott killed Lacy because he wanted freedom from the
- 42:55Speaker 1: marriage and from fatherhood. The prosecution theorizes that he killed
- 42:59Speaker 1: her at home in the morning, transported her body in
- 43:02Speaker 1: his boat, and then dumped her in the San Francisco
- 43:05Speaker 1: Bay using homemade concrete anchors. Garrigosa Hiss defense attorney argues
- 43:11Speaker 1: that Scott's adultery and lies do not make him a murderer.
- 43:15Speaker 1: That's very important because a lot of times when people
- 43:18Speaker 1: talk about Scott Peterson and they talk about how he's guilty,
- 43:22Speaker 1: I don't think anyone can actually articulate solid evidence as
- 43:27Speaker 1: to why they think he's guilty. Just everyone hates Scott Peterson,
- 43:32Speaker 1: so they put they hate that they have for Scott
- 43:34Speaker 1: Peterson and the fact that he had this affair with
- 43:37Speaker 1: Amber Fry and that he looks like a douchebag. That
- 43:41Speaker 1: doesn't equate murderer. Just wanted to put that out there.
- 43:44Speaker 2: Yeah, but you thought he was a murder at one
- 43:45Speaker 2: point for all those reasons.
- 43:47Speaker 1: I did until I until I've dug further into it,
- 43:53Speaker 1: which we will talk about.
- 43:54Speaker 2: At part two. In Part two, does you start to
- 43:57Speaker 2: look better? In part two?
- 43:58Speaker 1: Does what like?
- 43:59Speaker 2: So far? In part one? The theme is not a
- 44:02Speaker 2: good look?
- 44:03Speaker 1: Yeah?
- 44:04Speaker 2: Does he do anything that has a good look in
- 44:05Speaker 2: part two? Or is he still not a good look? Well?
- 44:10Speaker 1: No, I don't think he doesn't change his demeanor or
- 44:12Speaker 1: look better. I'm just saying in part two, there's a
- 44:14Speaker 1: lot of things that a lot of evidence that was
- 44:16Speaker 1: left out and that was suppressed, and I think that
- 44:18Speaker 1: we're going to dig into that and that you might
- 44:21Speaker 1: be more open minded and have an alternative viewpoint after
- 44:25Speaker 1: listening to other sides.
- 44:26Speaker 2: Sense right now life without parole?
- 44:28Speaker 1: Yes?
- 44:29Speaker 2: Is he doing anything to better himself in prison? Like
- 44:31Speaker 2: we learned with the Meninda's brothers, it regardless they were
- 44:36Speaker 2: pursuing education and reform and helping prisoners. Did he do
- 44:40Speaker 2: any of that? Because if not, it's not a good look.
- 44:43Speaker 1: He has long hair, I know that, and it hasn't
- 44:45Speaker 1: a ponytail.
- 44:46Speaker 2: Well, that doesn't equal murder, I know.
- 44:48Speaker 1: I'm just saying I don't know. Garrgos argues that Scott's
- 44:52Speaker 1: adultery and lies do not make him a murderer.
- 44:55Speaker 2: I have a comment on that. It doesn't make him
- 44:58Speaker 2: a murder. Yes, but it does and.
- 45:00Speaker 1: Help, No, it doesn't help.
- 45:01Speaker 2: It's not a good look.
- 45:03Speaker 1: No, it's not a good look. But the point is,
- 45:04Speaker 1: I think a lot of people, because they hate him
- 45:07Speaker 1: so much, it is hard to get past that hatred.
- 45:09Speaker 1: You just get to the point where you think he's
- 45:11Speaker 1: such a douchebag and such a terrible person, and he
- 45:14Speaker 1: comes off so horrible on camera that you just say
- 45:18Speaker 1: he did it without there being any evidence, no DNA,
- 45:22Speaker 1: no forensics, nothing linking him to it.
- 45:25Speaker 2: There's nothing showing him to be not guilty either, so far. Maybe.
- 45:29Speaker 1: In Part two, the defense emphasizes the absence of direct
- 45:32Speaker 1: forensic evidence establishing that Lacey was killed in the house, truck, warehouse,
- 45:37Speaker 1: or boat. There is no forensic evidence to prove that
- 45:42Speaker 1: she was killed in the house. There's no forensic evidence.
- 45:46Speaker 1: How did he do that? You're telling me he cleaned
- 45:49Speaker 1: four sights before the evening when he calls her mom
- 45:53Speaker 1: and tells her that she she's missing. He so he
- 45:57Speaker 1: manages to time. I ask you, no.
- 45:59Speaker 2: Did he Is there any record that he cleaned anything?
- 46:03Speaker 1: No?
- 46:04Speaker 2: Is there any record that he washed clothing or anything?
- 46:08Speaker 1: He did he washed his clothes, but maybe he always
- 46:11Speaker 1: washed his clothes. I don't know. Do you wash it?
- 46:13Speaker 1: You do laundry?
- 46:14Speaker 2: Yeah, I'm not Skott Peterson, all right, he he I
- 46:19Speaker 2: don't know. He watches Martha Stewart Living. Maybe he does
- 46:22Speaker 2: wash his clothes.
- 46:22Speaker 1: Yes. Juror Justin Falconer is questioned after making a comment
- 46:26Speaker 1: to Lacey's brother. He initially remains on the panel, but
- 46:29Speaker 1: is later removed after other jurors report that he discussed
- 46:32Speaker 1: evidence outside of the formal deliberations. This is on June
- 46:35Speaker 1: seventeenth of two thousand and four, after the trial started.
- 46:39Speaker 1: Prosecutors present evidence including Scott's undisclosed boat, the fishing license
- 46:44Speaker 1: is at Berkeley Marina, receipt, cell phone activity, concrete residue
- 46:48Speaker 1: at his warehouse, and his research into boats and bay currents.
- 46:51Speaker 1: Investigators also testify that Scott returned to the marina several
- 46:55Speaker 1: times after Lacey disappeared.
- 46:57Speaker 2: Ooh, why do he keep going to the marina? Maybe
- 47:00Speaker 2: he was fishing when his wife is missing.
- 47:04Speaker 1: Well, he's calling his girlfriend too when his wife is
- 47:06Speaker 1: missing and telling her, telling her that he's looking at
- 47:10Speaker 1: the Eiffel Tower. I'm just saying the prosecution experiences setbacks.
- 47:16Speaker 1: This is in the summer of two thousand and four.
- 47:18Speaker 1: During the trial, it incorrectly suggests that Scott lied about
- 47:21Speaker 1: watching a Martha Stewart segment involving meringue. The defense produces
- 47:25Speaker 1: the episode and confirms that the meringue was discussed. I
- 47:28Speaker 1: do know that when this trial first started, Garagos was
- 47:32Speaker 1: on a roll. I mean, he thought he was going
- 47:35Speaker 1: to win this thing.
- 47:36Speaker 2: I remember that he was media announcements.
- 47:39Speaker 1: He was taking out the prosecution right and left, and
- 47:44Speaker 1: it was looking good.
- 47:46Speaker 2: Add Peterson pay for this.
- 47:48Speaker 1: I think he has pretty wealthy parents.
- 47:50Speaker 2: Yeah.
- 47:50Speaker 1: They his parents retained Garagos because Garagos was going onto
- 47:55Speaker 1: Larry King Live. Because Larry King was always talking, like
- 47:58Speaker 1: every night they were talking about the Scott Peterson case,
- 48:01Speaker 1: and Gary Gos was always the you know, the guest,
- 48:05Speaker 1: the guest, the legal and he was always saying things
- 48:10Speaker 1: like there's no evidence. He was commenting on it, and
- 48:15Speaker 1: Scott Peterson's family watched it and liked that he was
- 48:18Speaker 1: always taking the position of there's not evidence, there's no DNA.
- 48:24Speaker 7: No.
- 48:24Speaker 1: I know they did. They reached out and hired him.
- 48:27Speaker 1: The defense produces the episode and confirms that meringue was discussed.
- 48:32Speaker 1: A police officer also gives testimony about Scott's behavior that
- 48:35Speaker 1: had not been properly disclosed to the defense. August tenth
- 48:39Speaker 1: of two thousand and four, Amber begins testifying jurors. Hear
- 48:43Speaker 1: about her relationship with Scott and listen to recorded calls
- 48:46Speaker 1: documenting his lies. Some jurors later say that the tapes
- 48:49Speaker 1: were important because they demonstrate his ability to manipulate others
- 48:53Speaker 1: and remain focused on Amber while Lacey was missing. You know,
- 48:59Speaker 1: amberfries that when she turned those tapes over to police
- 49:03Speaker 1: that she didn't have any idea that they were going
- 49:04Speaker 1: to be used in court, in open court, and that
- 49:08Speaker 1: I mean, I'm sure it was embarrassing for her for
- 49:10Speaker 1: those conversations to be publicly out there globally for everyone
- 49:14Speaker 1: to listen to their conversations. Detective Craig Grogan presents a
- 49:19Speaker 1: lengthy list of circumstances that investigators believe point to Scott.
- 49:23Speaker 1: They include his secret boat purchase, the marina, received fishing license,
- 49:28Speaker 1: bay research, concrete debris and limited early cell phone activity,
- 49:31Speaker 1: and repeated visits to the marina. Forensic pathologist doctor Brian
- 49:37Speaker 1: Peterson testifies about the condition of Lacy and Connor's remains.
- 49:41Speaker 1: He says Connor most likely died before being expelled from
- 49:44Speaker 1: Lacey's uterus, undermining the theory that Lacey gave birth while
- 49:47Speaker 1: being held captive by abductors. I do know that Lacey's
- 49:54Speaker 1: mother went to court every single day except for the
- 49:57Speaker 1: day that they talked about the condition of the remains.
- 50:03Speaker 1: Doctor Gregory DeVore estimates that Connor died honor around December
- 50:08Speaker 1: twenty third. Isn't that convenient that he just uses this information,
- 50:13Speaker 1: this chart from nineteen eighty four and he comes up
- 50:15Speaker 1: with this conclusion that Connor died on December.
- 50:18Speaker 2: Based on some evidence he saw as to the bot
- 50:21Speaker 2: and status of the body. He is some chart and
- 50:24Speaker 2: it leads to December twenty third.
- 50:26Speaker 1: Yes, I just find and he's the expert, and I'd
- 50:29Speaker 1: find that interesting. Defense expert doctor Charles March places Connor's
- 50:34Speaker 1: death several days later, but admits that his calculation relies
- 50:37Speaker 1: partly on assumptions and that fetal age cannot be determined
- 50:40Speaker 1: with complete certainty. Jury's later report finding DeVore that's the
- 50:44Speaker 1: first one. That's the prosecution's expert more credible. You know,
- 50:50Speaker 1: I don't even know. Sometimes I feel like, you know,
- 50:53Speaker 1: when you talk about junk science, like we've talked about
- 50:55Speaker 1: how bite marks have been used in the past to
- 50:59Speaker 1: convict someone one.
- 51:00Speaker 2: Well, in last week we talked about fire science, right,
- 51:06Speaker 2: and how now how that that was a wrongfully reported
- 51:11Speaker 2: origin of fire with arson accelerants versus electrical.
- 51:15Speaker 1: Right, So now when you look back on this fetal
- 51:18Speaker 1: age and being able to look at a body and
- 51:21Speaker 1: determine the gestational age. Obviously, the prosecution wants to establish
- 51:28Speaker 1: that Lacy and Connor died on December twenty third, because
- 51:33Speaker 1: if they died any later than December twenty third or
- 51:36Speaker 1: the twenty fourth, that means Scott Peterson didn't do it.
- 51:39Speaker 1: So it has to be the twenty fourth or twenty third,
- 51:43Speaker 1: And so to find an expert that says that based
- 51:48Speaker 1: upon I don't know, these are.
- 51:51Speaker 2: Really composed fetus right.
- 51:54Speaker 1: I don't know. To me, it seems more like junk science. Again.
- 52:00Speaker 1: November first of two thousand and four, closing arguments began.
- 52:03Speaker 1: Prosecutors stress that Scott placed himself at the bay on
- 52:07Speaker 1: the day Lacey disappeared, and that the body's surface near
- 52:10Speaker 1: his fishing location. They acknowledge that the exact manner of
- 52:14Speaker 1: death is unknown, but suggest strangulation or suffocation. He also
- 52:21Speaker 1: ran into people when he was there, so he so fishing. Yeah,
- 52:26Speaker 1: So they alleged that he takes his truck and he
- 52:29Speaker 1: puts the body in his truck. So he's got to
- 52:31Speaker 1: move the body from the house to the truck without
- 52:34Speaker 1: anyone seeing him, even though the neighbors see him in
- 52:36Speaker 1: the morning when he's outside.
- 52:38Speaker 2: Yeah, it's not like he has some remote home on
- 52:40Speaker 2: some property behind trees, right, So it's like a regular
- 52:43Speaker 2: neighborhood with homes across the street and right next door neighbor.
- 52:46Speaker 1: So he's got to get let's just think about this logically,
- 52:49Speaker 1: he's got to get a pregnant woman out of the
- 52:52Speaker 1: house and into the back of his truck. Then he's
- 52:56Speaker 1: got to drive his truck to his warehouse where he
- 52:59Speaker 1: keeps the boat. Now I saw the video of his warehouse.
- 53:04Speaker 1: There's a lot of businesses that are in this warehouse.
- 53:07Speaker 1: It's not just a loan warehouse. There's multiple doors like
- 53:10Speaker 1: garage doors, so he has a space, so there's lots
- 53:13Speaker 1: of other people that have space here. So he then
- 53:16Speaker 1: has to get the body out of his truck and
- 53:19Speaker 1: into the boat without anyone seeing him. Again, this is
- 53:24Speaker 1: just a shallow aluminum boat, not a ten. Then he's
- 53:32Speaker 1: got to drive the body in the boat ninety minutes
- 53:37Speaker 1: to a marina, and he doesn't go to.
- 53:39Speaker 2: Some remote Let me disagree with you. Why did he
- 53:43Speaker 2: have to put the body in the boat. I'm telling you.
- 53:47Speaker 2: I'm just saying, maybe you're the amount of transferring of
- 53:50Speaker 2: the body isn't as much as you think he puts
- 53:52Speaker 2: in it. It was a truck.
- 53:53Speaker 1: He has to put it in the boat. How does
- 53:55Speaker 1: he take it?
- 53:55Speaker 2: Let me finish my statement, lady. He put it in
- 53:57Speaker 2: the truck right then he drives and he connects the boat.
- 54:00Speaker 2: He didn't need to take it out yet. Then maybe
- 54:03Speaker 2: he went when he had a more secluded area that
- 54:07Speaker 2: he was in for taking it off the trailer. When
- 54:10Speaker 2: he's dipping the boat into the lake of the bay,
- 54:13Speaker 2: then he could have put it in there at that time.
- 54:15Speaker 1: But he goes to a highly populated place to put
- 54:18Speaker 1: his boat into the water. He's talking to other people
- 54:20Speaker 1: about fishing and what they caught that day. So I'm
- 54:23Speaker 1: saying the prosecution claims that the body is in the
- 54:26Speaker 1: boat November two. In two thousand and four, Garrigos argues
- 54:29Speaker 1: that there is no direct forensic evidence proving Lacey was
- 54:32Speaker 1: murdered in the Peterson home or transported in Scott's vehicle
- 54:36Speaker 1: or boat. He portrays the investigation as a rush to
- 54:39Speaker 1: judgment against an unfaithful husband. Now we get to the
- 54:44Speaker 1: deliberations and the verdict. So during the deliberations, jurors reviews
- 54:47Speaker 1: Scott's first police interview, examined his boat, and reconsidered the
- 54:51Speaker 1: prosecution's circumstantial case again circumstantial. Some jurors interpret his early
- 54:58Speaker 1: mention of grief, council, efforts to sell the house and
- 55:02Speaker 1: Lacy's vehicle, and addition of adult cable channels as signs
- 55:06Speaker 1: that he knew she would not return. I mean, he
- 55:09Speaker 1: did try to sell the house and he did sell
- 55:11Speaker 1: her car before she was found, So that is an indication.
- 55:16Speaker 1: You could look at it as an indication that he
- 55:18Speaker 1: knew that she was not coming back.
- 55:20Speaker 2: Not a good look.
- 55:21Speaker 1: Not a good look.
- 55:22Speaker 2: You know. I remember the one that made for TV
- 55:24Speaker 2: movie on this Yeah, who played Scott Peterson? No, Dean Kine.
- 55:30Speaker 1: Dean Kane.
- 55:31Speaker 2: I remember that? Oh really yeah, I watched. It was
- 55:33Speaker 2: a poorly dumb movie. I wouldn't recommend it.
- 55:35Speaker 1: No, well, there's a lot of documentaries on the documentaries.
- 55:39Speaker 1: Juror fran Gorman is removed after disclosing that she independently
- 55:43Speaker 1: researched a fishing website, and foreman Greg Jackson is later
- 55:46Speaker 1: replaced and eventually removed after reporting that he discussed the
- 55:49Speaker 1: case outside formal deliberations. Alternates to join the panel, requiring
- 55:54Speaker 1: deliberations to restart. On November twelfth of two thousand and four,
- 55:59Speaker 1: the jury Scott guilty of first degree murder for Lacey's
- 56:02Speaker 1: death and second degree murder for Connor's. The first degree
- 56:05Speaker 1: verdict reflects of finding that Lacy's murder was deliberate and premeditated.
- 56:10Speaker 1: Jurors select second degree murder for Connor because they find
- 56:13Speaker 1: insufficient evidence that Scott separately planned to kill him. After
- 56:18Speaker 1: a separate penalty phase, the jury recommends that Scott received
- 56:22Speaker 1: the death penalty. Judge Delucci formally sentence Scott to death
- 56:28Speaker 1: by lethal injection. This is on March sixteenth of two
- 56:32Speaker 1: thousand and five, and he is sent to San Quentin
- 56:35Speaker 1: State Prison, where I believe he is still today. And
- 56:39Speaker 1: as we discussed earlier, he is no longer sentenced to death,
- 56:43Speaker 1: that has been re sentenced to life in prison. All right,
- 56:48Speaker 1: we have gotten through Part one. All right, This concludes
- 56:52Speaker 1: part one of our analysis on the Scott and Lacy
- 56:55Speaker 1: Peterson case. Please listen to Part two exclusively and the
- 56:59Speaker 1: Legally Brunette feed for news on the Los Angeles Innocent
- 57:03Speaker 1: Projects petition to overturn Scott's conviction and what we can
- 57:07Speaker 1: expect to see next with this case. Also, I would
- 57:11Speaker 1: just like to reiterate that the Los Angeles Nosence Project
- 57:16Speaker 1: is a very respected innocence project that only takes cases
- 57:22Speaker 1: where they believe someone is factually innocent, not that there's
- 57:29Speaker 1: a reasonable doubt, not that they didn't have good defense counsel,
- 57:35Speaker 1: where they truly like the evidence that someone is factually innocent.
- 57:42Speaker 1: So we will get into that into part two, so
- 57:45Speaker 1: please make sure to listen to Scott Peterson Part two.
