- 0:46Speaker 2: A lot going on, so please join us at the
- 0:48Speaker 2: Wild Fork Restaurant. And we're going to talk about Prop
- 0:52Speaker 2: fifty right now. But before I do, and this somehow
- 0:56Speaker 2: has been lost a little bit in the shuffle, and
- 1:00Speaker 2: that is the Supreme Court is hearing a case as
- 1:03Speaker 2: to does the President have the right to arbitrarily invoke tariffs?
- 1:09Speaker 2: And he's done this under the National Emergency Powers Act.
- 1:12Speaker 2: And effectively, what the Court is going to decide is
- 1:16Speaker 2: the president's declaration of a national economic emergency?
- 1:21Speaker 1: Is that legitimate? If he says it is that true.
- 1:25Speaker 1: That's it. That's where the Court's going to go. If
- 1:29Speaker 1: he says it's true, it is true.
- 1:31Speaker 2: Same thing with the war powers act, with the cartels,
- 1:34Speaker 2: with the immigration. If there is an invasion, it is true.
- 1:38Speaker 2: There is an invasion, notwithstanding anything else. Okay, that's a big,
- 1:41Speaker 2: big deal, which we'll be talking about now. Prop fifty
- 1:44Speaker 2: passed yesterday overwhelmingly. It passed basically two to one, and
- 1:48Speaker 2: we sort of knew that was going to happen. And
- 1:51Speaker 2: this has to do with redistricting. Now, there are two
- 1:56Speaker 2: kinds of redistricting, and that's drawing a district map and jerrymandering,
- 2:01Speaker 2: which should draws these ridiculous maps that enclose some neighborhoods
- 2:06Speaker 2: and not others. And there are two kinds of the redistricting.
- 2:11Speaker 2: Who does it one independent commissions. California decided back during
- 2:15Speaker 2: the Schwarzenegger years that we didn't want to politicize this.
- 2:20Speaker 2: We wanted an independent commission to redistrict so politics did
- 2:26Speaker 2: not have anything to do with it, and that was
- 2:28Speaker 2: happening every ten years based on the census. The other
- 2:32Speaker 2: side of it is the legislatures still have the power
- 2:36Speaker 2: and this is mainly in the South, still have the
- 2:38Speaker 2: power to redistrict themselves where they look at politics and
- 2:43Speaker 2: it's pure politics. And what California is done this time
- 2:49Speaker 2: is now pass a law that undos the Independent Commission
- 2:52Speaker 2: temporarily until twenty thirty and it gives the legislature the
- 2:58Speaker 2: power to redistrict. And what's going to happen. This is
- 3:01Speaker 2: what redistricting is about. Is the legislature takes one district
- 3:07Speaker 2: reforms it. So let's say all in this case, it
- 3:10Speaker 2: is this way, all the Democrats in the South, all
- 3:14Speaker 2: the Democrats are in one area. They sort of draw
- 3:18Speaker 2: the line around a well with a Democrat with this
- 3:22Speaker 2: legislature around a Republican area, leaving all the areas around
- 3:29Speaker 2: it at least a good chance to be to vote
- 3:33Speaker 2: on the other side.
- 3:35Speaker 1: Okay, does that make sense? It can be a little.
- 3:38Speaker 2: Complicated, so it basically almost guarantees that what was a
- 3:42Speaker 2: swing district can now be much closer to your political position.
- 3:48Speaker 2: And Prop fifty undid that. Now, some democratics states did this,
- 3:53Speaker 2: but this one was in direct response to President Trump
- 3:57Speaker 2: who told Texas, I I want you to readistrict. I
- 4:03Speaker 2: want the legislature to draw those districts. So all the
- 4:07Speaker 2: Democrats in that area are in one district, Okay, we'll
- 4:10Speaker 2: give you that one, but the ones around it, we
- 4:14Speaker 2: want the chance for them to be Republican. And it
- 4:16Speaker 2: looks like five seats could go the other way and
- 4:21Speaker 2: become Republican. So California did exactly the same thing. California said, Okay,
- 4:28Speaker 2: you do that, We're gonna do the same thing. Screw
- 4:31Speaker 2: the independent commissions. We're gonna make sure that a Republican
- 4:36Speaker 2: district stays Republican, but all the areas around it, we're
- 4:40Speaker 2: gonna make absolutely sure that they're going to be democratic.
- 4:44Speaker 2: That's jerry mandering, that's redistricting. And California went that way.
- 4:48Speaker 2: So now the politics of this, I'm going to come
- 4:52Speaker 2: back with deal with this one. The politics of this
- 4:54Speaker 2: has to do with which way Democrats are deally within
- 5:01Speaker 2: this state, Gavin Newsom and how powerful he has become,
- 5:07Speaker 2: and the power of the president when he says this
- 5:11Speaker 2: is what I want, and of course the Republican Party
- 5:15Speaker 2: does exactly that is what happened in Texas. So there's
- 5:19Speaker 2: a few moving pieces here that I want to share
- 5:21Speaker 2: with you. And then the absolute fun one. This is
- 5:25Speaker 2: a post by the President. And I'm not gonna say
- 5:28Speaker 2: yout does himself because he outdes themselves every time he
- 5:31Speaker 2: posts something, and then he out does himself. But it's
- 5:34Speaker 2: one of the reasons, one of the reasons why there
- 5:39Speaker 2: was a guarantee that Prop. Fifty was going to pass
- 5:42Speaker 2: under any circumstances outside of the overwhelming number of Democrats
- 5:48Speaker 2: in this state. As a matter of fact, we knew.
- 5:51Speaker 2: I knew it was going to pass. Why I know
- 5:53Speaker 2: it was going to pass because the President in social
- 5:58Speaker 2: site on his called the vote a giant scam and
- 6:02Speaker 2: it was rigged and under very serious legal and criminal review.
- 6:07Speaker 1: Stay tuned.
- 6:08Speaker 2: Okay, when that happens, it's a win on the other
- 6:12Speaker 2: side usually.
- 6:13Speaker 1: So, now, what does this mean.
- 6:16Speaker 2: I told you in the previous segment the particulars, and
- 6:19Speaker 2: that is it's redistricting. It's making if you're a Republican
- 6:25Speaker 2: legislature you're going to get extra seats in the Republican Congress,
- 6:30Speaker 2: and if you're a Democrat it goes the other way completely. Now,
- 6:34Speaker 2: this has to do with a couple of things that
- 6:37Speaker 2: are really important. One, it's fighting fire with fire. If
- 6:42Speaker 2: Texas did this, pursue it to the request of the president,
- 6:44Speaker 2: then we're going to do this. It's just that simple.
- 6:48Speaker 2: It's fighting fire with fire, nothing more, nothing less. And
- 6:52Speaker 2: now comes the politics of this. Gavin Newsom he bet
- 6:57Speaker 2: effectively his political future on Prop fifty and it won
- 7:03Speaker 2: two to one, immediately catapulting him into more of a
- 7:10Speaker 2: national figure than he was before to the extent that
- 7:15Speaker 2: he is going to be running for president. And also
- 7:17Speaker 2: keep in mind Alex Padilla, US Senator just dropped out
- 7:20Speaker 2: Kamala Harris. She says she's not running, So it's big
- 7:26Speaker 2: news for Gavin Newsom. And the other one is a
- 7:30Speaker 2: repudiation of the president. I was watching Fox News yesterday
- 7:36Speaker 2: with their analysis, which I thought was damn good by
- 7:38Speaker 2: the way, I thought that actually I thought it was
- 7:42Speaker 2: better than CNN and better than MSNBC. And they pointed
- 7:46Speaker 2: out that without Trump on the ticket, the chances of.
- 7:55Speaker 1: Passage are far far less.
- 7:58Speaker 2: In other words, carrying some carrying someone, or it's a
- 8:03Speaker 2: down ticket that is going to win. That's how important
- 8:07Speaker 2: Donald Trump is to the Republican Party, to the MAGA supporters,
- 8:11Speaker 2: to the election of any kind as far as the
- 8:13Speaker 2: Republicans are concerned.
- 8:16Speaker 1: And so if.
- 8:17Speaker 2: Trump isn't there you know what, I don't think we're
- 8:21Speaker 2: gonna vote that way. If it ain't Trump, it ain't good.
- 8:24Speaker 2: Even when he endorses people, they look at the endorsement
- 8:31Speaker 2: not nearly as powerfully as when he is on the ticket.
- 8:36Speaker 2: And what does that translate to, Well, it wasn't just
- 8:39Speaker 2: Prop fifty. It was on the East coast, the governor
- 8:43Speaker 2: of New Jersey, the governor of Virginia, Mom Donnie On,
- 8:47Speaker 2: the socialist mayor in New York. It was a across
- 8:52Speaker 2: the country. It was a Democratic landslide. It was a wipeout.
- 8:58Speaker 2: And so the now the Republicans are looking at do
- 9:02Speaker 2: we really want Trump's endorsement, much like Joe Biden towards
- 9:08Speaker 2: the end, Democrats didn't want to get anywhere near Biden's endorsement.
- 9:13Speaker 2: Even when he offered it. The Democrats said, no, no, no,
- 9:16Speaker 2: I don't want it. That's not gonna help me. He's
- 9:18Speaker 2: probably gonna hurt me. And I think in the case
- 9:21Speaker 2: of Trump, an endorsement is going to hurt a candidate
- 9:25Speaker 2: more than not because what this was and described not
- 9:30Speaker 2: only redistricting, not only either gaining seats or losing seats
- 9:35Speaker 2: depending on which side of the coin you're on which
- 9:38Speaker 2: side of the aisle, but it was defined as and
- 9:43Speaker 2: I believe it's true. This vote was a direct repudiation
- 9:48Speaker 2: of Donald Trump by a lot of America. And in
- 9:51Speaker 2: Fox they did that. They did a diagram and doing
- 9:54Speaker 2: the analysis, and the number of voters who voted across
- 9:59Speaker 2: the country, not for the issue at hand, but for
- 10:04Speaker 2: the repudiation of Donald Trump was an astronomical figure. Frankly,
- 10:12Speaker 2: I was stunned. Republicans, I think were stunned. Not at
- 10:16Speaker 2: the win, because everybody knew Prop fifty was going to
- 10:18Speaker 2: win two to one.
- 10:22Speaker 1: Wow.
- 10:23Speaker 2: And then when you look at the governor's race in Virginia,
- 10:26Speaker 2: you look at the governor's race in New Jersey that
- 10:30Speaker 2: was supposed to be Democrats still had.
- 10:31Speaker 1: A lead, but very close.
- 10:34Speaker 2: It was a wipeout, and Mam Donnie, well, we knew
- 10:38Speaker 2: that was gonna win. The only place where Mamdani lost
- 10:43Speaker 2: dramatically was in the Jewish parts of New York because
- 10:47Speaker 2: he's a Muslim, and not so much he's a Muslim,
- 10:50Speaker 2: is that in the past his political views were very
- 10:54Speaker 2: anti Israel and very pro Palestinian and and he's walking
- 10:58Speaker 2: that back.
- 10:59Speaker 1: By the way. The same thing with defund the police.
- 11:02Speaker 2: A lot of his politics and his positions are coming
- 11:07Speaker 2: back and why well, he had to to win the election.
- 11:11Speaker 2: And as Barack Obama said, it's when he was after
- 11:16Speaker 2: he became president. It's real easy to campaign. I mean,
- 11:20Speaker 2: it's a grind, but it's real easy to campaign and
- 11:25Speaker 2: say what you're going to do and what you're not
- 11:27Speaker 2: going to do. Get behind that desk. It is a
- 11:31Speaker 2: whole different world, and I think that's what Momdani is
- 11:36Speaker 2: going to have to deal with. Okay, Okay, I want
- 11:39Speaker 2: to tell you a story. Okay, and let me start with.
- 11:44Speaker 2: Federal judges are appointed for life, literally for life vacations.
- 11:53Speaker 2: They take them whenever they want cases they can say
- 11:57Speaker 2: no to. They can sit on a beach in Cancun.
- 12:01Speaker 2: Now they don't even for the most part. They work very,
- 12:04Speaker 2: very hard. So there is one federal judge and this
- 12:07Speaker 2: has to do with people aging out, and that connects
- 12:11Speaker 2: with Mom, Donnie and certainly Cuomo. There is a US well,
- 12:18Speaker 2: there's a federal US Circuit Court judge by the name
- 12:22Speaker 2: of Pauline Newman. Pauline Newman is ninety eight years old.
- 12:30Speaker 2: Pauline Newman, Pauline Newman does not know what they have,
- 12:34Speaker 2: where she is, and what she is. She knows she's
- 12:38Speaker 2: a federal judge. She knows she can't be bounced. The
- 12:42Speaker 2: only way a federal judge can be removed is by impeachment,
- 12:47Speaker 2: so they are there for life. She's the oldest federal
- 12:53Speaker 2: judge not to have taken the form of semi retirement
- 12:56Speaker 2: known as senior status. Senior status means that they hear
- 13:00Speaker 2: oceans and do calendar calls and don't get into the merits.
- 13:05Speaker 2: They don't get into the weeds of a case. She says, nope,
- 13:08Speaker 2: I'm going to hear cases now. Is there anything that
- 13:12Speaker 2: can be done?
- 13:12Speaker 1: Well?
- 13:13Speaker 2: Yeah, The Chief Federal Circuit Judge, kimber Judge Kimberly Moore
- 13:18Speaker 2: said that she has shown signs of serious cognitive and
- 13:22Speaker 2: physical impairment, and then put her on this retirement if
- 13:29Speaker 2: you will, but still on the men. She still makes
- 13:31Speaker 2: her two hundred and fifty thousand dollars a year, and
- 13:35Speaker 2: she is suing. She says she is fit to serve
- 13:41Speaker 2: and sued the council. This judicious council considered consisting of
- 13:45Speaker 2: other judges who want to put her on senior status,
- 13:49Speaker 2: which means she's not going to hear any cases.
- 13:52Speaker 1: And the wow.
- 13:55Speaker 2: Now, so far the appeals court has ruled against her,
- 13:59Speaker 2: saying the courts themselves have consistently affirmed the judiciaryes authority
- 14:03Speaker 2: to police itself, not remove her. That is not going
- 14:07Speaker 2: to happen there. When I lived in Los Angeles on
- 14:14Speaker 2: the West side, Hancock Park, adjacent my neighbor, his dad
- 14:21Speaker 2: was the oldest sitting judge in the country. He was
- 14:25Speaker 2: hearing cases at ninety three. But again he was only
- 14:29Speaker 2: hearing motions, and he did calendar calls. Lawyers would go,
- 14:34Speaker 2: your honor, I can't do trial at that time. I
- 14:37Speaker 2: have to go ahead and ask for continuance. That's what
- 14:40Speaker 2: he sort of did. Newman wants to hear cases. Is
- 14:47Speaker 2: she going to She should sit in Cancun and by
- 14:51Speaker 2: the way, she's going to die in office. There's one
- 14:53Speaker 2: apocryphal case and it's I don't know if it's an
- 14:59Speaker 2: urban leg or not, but there's one a profitable apocryphal
- 15:03Speaker 2: case of one of the judges sitting in California that
- 15:08Speaker 2: one of the senior judges that win the clerks applied
- 15:12Speaker 2: to be applied to their office.
- 15:15Speaker 1: That's how that's what happens after law school.
- 15:17Speaker 2: If you really want to move up, you clerk for
- 15:19Speaker 2: a judge, usually a federal judge or above. Part of
- 15:22Speaker 2: the job is they had to change the judges diapers.
- 15:26Speaker 2: That is a tough thing to do as a court clerk.
- 15:32Speaker 2: Why because judges stay put for the rest of their lives.
- 15:38Speaker 2: So now, yesterday I heard an interview with Nancy Pelosi.
- 15:43Speaker 2: Nancy Pelosi is eighty six years old. She gave up
- 15:46Speaker 2: her leadership. She was speaker, and she voluntarily gave up
- 15:50Speaker 2: her leadership to Hakim Jeffries, who I think is in
- 15:53Speaker 2: his forties, to go to a younger generation. And she
- 15:57Speaker 2: said something very interesting the reasons she gave it up,
- 16:00Speaker 2: and talked about Trump, who she hates, and went on
- 16:04Speaker 2: and and she said she's retiring at the end of
- 16:07Speaker 2: this term. But she also said, if I decide to
- 16:12Speaker 2: run again, I will win. That's a given. There is
- 16:18Speaker 2: no argument against that. That is as real as gravity.
- 16:24Speaker 2: There's no chance I would ever lose at eighty six.
- 16:29Speaker 2: And therein lies the issue, and this is particularly among Democrats.
- 16:34Speaker 2: Are Democrats a lot of them the leadership roles just
- 16:37Speaker 2: too old, is it? The Joe Biden syndrome where you go.
- 16:42Speaker 1: That's enough.
- 16:44Speaker 2: This really took a turn when Biden ran for president
- 16:49Speaker 2: the second time out. Why because I think he was
- 16:52Speaker 2: eighty one at the time, and an old eighty one.
- 16:55Speaker 2: He shuffled, he had a real problem with cognition. He
- 17:01Speaker 2: would forget. I mean, he was a really old eighty one.
- 17:06Speaker 2: Now Donald Trump was no youngster. But Donald Trump, I
- 17:10Speaker 2: think is he eighty yet. I don't know if he's
- 17:13Speaker 2: seventy nine or eighty, but he is one of the
- 17:15Speaker 2: youngest seventy nine or eighties that exists. The guy has
- 17:19Speaker 2: unbelievable amounts of energy. And if you're talking about old Biden,
- 17:26Speaker 2: old Trump young for his age. And they're into the problem,
- 17:31Speaker 2: particularly with the Democratic Party, because what you have, effectively
- 17:36Speaker 2: are old people that should be termed out that are
- 17:42Speaker 2: not termed out, because as long as they are keeping
- 17:45Speaker 2: getting elected, you can have people being elected into their nineties.
- 17:48Speaker 2: I think the oldest person whoever was re elected in
- 17:52Speaker 2: the Senate was either strom Thurman or Robert Byrd. I'm
- 17:55Speaker 2: trying to remember which one, but they were elected in
- 17:58Speaker 2: their nineties. So there's no such thing as turning out
- 18:03Speaker 2: when running for office. But here is A real problem
- 18:08Speaker 2: is that look at where the demic party is moving.
- 18:13Speaker 2: What did mom Dommy win? Was it just politics? No,
- 18:16Speaker 2: I don't think so. A lot was made of the
- 18:19Speaker 2: fact that he's thirty four years old, and Andrew Cuomo
- 18:22Speaker 2: is sixty seven years old, and sixty seven years old
- 18:26Speaker 2: is a youngster in the world of the Senate and Congress.
- 18:32Speaker 2: Jerry Nadler, who is a congressman, and he announced he's
- 18:38Speaker 2: not going to seek reelection. Why, well, he's seventy eight,
- 18:43Speaker 2: and he said, that's it.
- 18:44Speaker 1: I'm done.
- 18:45Speaker 2: Maybe younger people can do a better job. But why
- 18:49Speaker 2: do few politicians in his age bracket feel the same way? Well,
- 18:55Speaker 2: because it's a good job. I mean there's a lot
- 19:00Speaker 2: of work. If you do it right, you make a
- 19:04Speaker 2: real impression. You really have a power where you can
- 19:10Speaker 2: make change. And I think that is part and parcel
- 19:14Speaker 2: of it. But people just don't require retire. Maxine Waters
- 19:21Speaker 2: owns her district has for I don't know how many decades.
- 19:25Speaker 1: She's eighty seven. Stenny Hoyer when.
- 19:28Speaker 2: The leaders of the Republican or the Democratic Party, he's
- 19:31Speaker 2: eighty six. Nancy Pelosi is eighty five, Bernie Sanders is eighty.
- 19:37Speaker 1: Four, you know, at some point the.
- 19:41Speaker 2: Electorate say, okay, it's time for a younger generation. And
- 19:46Speaker 2: this is where a lot of people gave Nancy Pelosi,
- 19:49Speaker 2: or give Nancy Pelosi a lot of credence and a
- 19:55Speaker 2: lot of credit because she said, remember she's eighty six.
- 19:59Speaker 1: She said at his time for a younger generation.
- 20:03Speaker 2: We can't have people in their eighties and nineties still
- 20:06Speaker 2: deciding which way the company the country goes.
- 20:09Speaker 1: She's still in Congress. She just took a back seat.
- 20:13Speaker 2: She gave up the most powerful position that she held
- 20:16Speaker 2: for decades in the House of Representatives, and that's speaker.
- 20:21Speaker 2: And if the Democrats take over the House, it'll be
- 20:25Speaker 2: Hakim Jeffries. He is now the minority leader anyway, who
- 20:30Speaker 2: has has trend's power as the leader of the party
- 20:38Speaker 2: not in power, and he has power now the speaker.
- 20:43Speaker 2: That is an astoundingly powerful position. The speaker can call
- 20:46Speaker 2: a vote, can say we're not voting. The speaker can
- 20:51Speaker 2: bring a bill on the floor the speaker. The speaker
- 20:55Speaker 2: can say nope, we're not going to bring a vote
- 20:57Speaker 2: on the floor. And what you're gonna have is a fight.
- 21:02Speaker 2: What you do have is hockeying. Jeffries via Mike Mike Johnson,
- 21:08Speaker 2: who is a speaker. Both young men and I think
- 21:12Speaker 2: that they're going to stay in powerful positions. But these ulsters, man,
- 21:17Speaker 2: it is it time just to move. At some point,
- 21:21Speaker 2: you know, you have to give it up, and it's
- 21:24Speaker 2: hard to give up. I mean a lot of kudos
- 21:28Speaker 2: going on, You get a lot of free meals, a
- 21:30Speaker 2: lot of yes sirs, Yes, ma'am. They have tremendous power.
- 21:33Speaker 2: No one says no to a congress person in their
- 21:37Speaker 2: own district, old people. That's why I'm going to be
- 21:43Speaker 2: here for the rest of my life. Matter of fact,
- 21:47Speaker 2: when I lose all cognition, which actually I have already,
- 21:52Speaker 2: when I don't know where I am.
- 21:55Speaker 1: That's pretty much what's happening right.
- 21:56Speaker 2: Now, when I grope for words and don't really understand
- 22:01Speaker 2: what I'm speaking of. Yeah, pretty much, okay, KF I
- 22:08Speaker 2: am six point forty.
- 22:10Speaker 1: You've been listening to The Bill Handle Show.
- 22:12Speaker 2: Catch My Show Monday through Friday six am to nine am,
