- 0:01Speaker 1: In just a few hours.
- 0:02Speaker 2: The man accused of trying to assassinate President Trump over
- 0:05Speaker 2: the weekend is set to appear in court as new
- 0:07Speaker 2: photos reveal the suspects smiling with guns and knives just
- 0:11Speaker 2: minutes before the attack.
- 0:12Speaker 1: Chailey Painter here with the details.
- 0:15Speaker 3: Hey Todd, good morning. So at today's detention hearing, prosecutors
- 0:18Speaker 3: will ask the judge to keep Cole Allen behind bars
- 0:21Speaker 3: while he awaits charges on attempting to assassinate the President.
- 0:25Speaker 3: In new court filings, prosecutors include this selfie Alan took
- 0:29Speaker 3: of himself in the hotel room minutes before the attack.
- 0:32Speaker 3: The thirty one year old is seen smiling with at
- 0:34Speaker 3: least one knife strap to his body, as well as
- 0:37Speaker 3: a leather bag with ammunition. Prosecutors say that shortly before
- 0:41Speaker 3: taking the pictures, Allan visited a number of websites confirming
- 0:45Speaker 3: the President's presence at the dinner and before making his
- 0:48Speaker 3: way downstairs and charging a security checkpoint with a shotgun, handgun,
- 0:53Speaker 3: and multiple knives. Here you can see a close up
- 0:55Speaker 3: of the many weapons Alan had on him. Investigator say
- 0:59Speaker 3: Alan fired a single shot from the shotgun in the
- 1:02Speaker 3: direction of the ballroom before being tackled and arrested. They
- 1:05Speaker 3: also say a Secret Service agent was hit before returning
- 1:08Speaker 3: five shots which did not strike anyone. While the court
- 1:11Speaker 3: filings are unclear on how the agent was struck, according
- 1:15Speaker 3: to a report from CBS, that agent was not hit
- 1:18Speaker 3: by friendly fire.
- 1:20Speaker 1: Do you expect any changes to the Usccret Service moving forward?
- 1:26Speaker 2: And I wanted to be agreeing that.
- 1:28Speaker 3: Next yesterday, Vice President Jade Vance, who of course was
- 1:32Speaker 3: at Saturday's dinner, told our Will Kine how well he
- 1:36Speaker 3: thought the Secret Service performed.
- 1:37Speaker 1: Watch.
- 1:39Speaker 4: The thing that I really gained an appreciation for, Will,
- 1:42Speaker 4: is what an amazing job the agents of the Secret Service.
- 1:45Speaker 5: Do you saw?
- 1:46Speaker 4: They went right to me, They went right to the
- 1:48Speaker 4: President of the United States. They put their lives in
- 1:51Speaker 4: harm's way. It's easy to forget that the reason they're
- 1:53Speaker 4: there is for nights like what happened Saturday night. So
- 1:57Speaker 4: I just feel very grateful to him and very great
- 2:00Speaker 4: for what they do, and frankly grateful to God that
- 2:03Speaker 4: that agent who was shot was not seriously hurt.
- 2:06Speaker 3: And CBS is also reporting that sources tell them that
- 2:09Speaker 3: not only was that shot that struck the Secret Service
- 2:13Speaker 3: agent not friendly fire, it was also likely that it
- 2:16Speaker 3: hit his cell phone that was tucked inside a pocket
- 2:18Speaker 3: of his bulletproof best and of course, thankfully that agent
- 2:20Speaker 3: was not seriously hurt.
- 2:23Speaker 1: Carly, I'll send it, but do you.
- 2:24Speaker 5: My goodness, a bulletproof fast and a well placed cell phone,
- 2:26Speaker 5: all of this could have been so much worse, Chanley
- 2:29Speaker 5: Painter life for us. Chandley, thank you. Let's bring in
- 2:31Speaker 5: criminal de sense attorney David Gelman.
- 2:32Speaker 1: David, great to see you. Thank you for joining us.
- 2:34Speaker 1: This selfie photo.
- 2:36Speaker 5: He hasn't entered a plea yet the suspect if it
- 2:38Speaker 5: is not guilty. I mean, how do you defend against
- 2:40Speaker 5: something like this.
- 2:41Speaker 6: It's going to be pretty difficult. I mean, look, that's
- 2:43Speaker 6: not a great photo at all. It's not He shouldn't
- 2:46Speaker 6: be using that in tender, that's for sure. But if
- 2:48Speaker 6: you think about it, this all shows that number one,
- 2:51Speaker 6: this is premeditated. This was just a horrible act to
- 2:56Speaker 6: begin with, and he took steps to make sure that
- 2:59Speaker 6: he got close enough to the president and other members
- 3:02Speaker 6: of the cabinet to try to actually execute his disgusting,
- 3:06Speaker 6: horrible plan. So I don't know how you're going to
- 3:09Speaker 6: be able to defend against it. He's probably going to
- 3:11Speaker 6: use some type of mental issue. I don't think that's
- 3:13Speaker 6: going to be able to work, though, because the preparation
- 3:15Speaker 6: that he did. Remember, he staked out the President, he
- 3:19Speaker 6: looked at where the White House correspondents dinner was going
- 3:22Speaker 6: to be. He traveled across country on a train with
- 3:26Speaker 6: weapons and all these different things to prepare to do
- 3:30Speaker 6: the horrible act that he tried to do.
- 3:32Speaker 5: Yeah, and the round that struck the Secret Service agent
- 3:35Speaker 5: is now being reported as not coming from friendly fire.
- 3:38Speaker 5: That's how it's being warded right now. Dive into that
- 3:41Speaker 5: and how that impacts things.
- 3:42Speaker 6: Well, it's going to be kind of big because think
- 3:44Speaker 6: about it, he's the one who actually used a shot.
- 3:48Speaker 6: He's shot I think what six times are saying, and
- 3:51Speaker 6: that wasn't friendly fire, which is good because that was
- 3:53Speaker 6: always a question in the beginning, was this a friendly fire?
- 3:55Speaker 6: Because you saw multiple agents were using their guns as
- 3:58Speaker 6: well to try to stop.
- 3:59Speaker 5: This individual, potentially one round from him and then five
- 4:02Speaker 5: or six from the Secret Survey agents. In response to that,
- 4:06Speaker 5: his court appearance today, what's going to happen?
- 4:07Speaker 6: So it's a detention hearing. Now, if I'm the defense attorney,
- 4:10Speaker 6: I'm probably going to just waive it. But I don't
- 4:12Speaker 6: know what his public defender is going to do, because
- 4:15Speaker 6: there is no way he is going to be able
- 4:17Speaker 6: to get out out of prison today, out of the
- 4:19Speaker 6: detention facility, because the judge is going to be looking
- 4:21Speaker 6: at number one, is he a threat? I think the
- 4:24Speaker 6: answer is very clear. He tried to assassinate the president
- 4:27Speaker 6: and other cabinet officials, so I think the threat level
- 4:31Speaker 6: is incredibly high. So I don't think there is any
- 4:34Speaker 6: way that he is going to be getting out today.
- 4:36Speaker 5: The other thing that we want to talk to you
- 4:37Speaker 5: about is James Colemy because he turned himself in yesterday
- 4:41Speaker 5: and appeared in federal court after being charged with that
- 4:43Speaker 5: eighty six forty seven Instagram post.
- 4:45Speaker 1: Here's what the President said about the charge. Watch this.
- 4:50Speaker 5: People like Kombie have created tremendous danger, I think for
- 4:54Speaker 5: politicians and others.
- 4:57Speaker 1: So he did not enter a plea yesterday. How do
- 5:00Speaker 1: you see this one playing out?
- 5:02Speaker 6: So carly, it's going to be interesting. James Comy, he's
- 5:05Speaker 6: obviously professional, he's an attorney, and he's got very good
- 5:08Speaker 6: attorneys with them. They didn't do a plea for a reason.
- 5:10Speaker 6: They want to see what the evidence is. Because they
- 5:12Speaker 6: don't have the evidence yet, and we don't have the evidence,
- 5:15Speaker 6: we don't know what's going on. This is going to
- 5:17Speaker 6: be a very long case in my opinion. But the
- 5:19Speaker 6: government has a ton of evidence. They got witnesses, they've
- 5:23Speaker 6: gone through the phones and records, and they did a
- 5:24Speaker 6: ten month investigation on James Comy. At the end of
- 5:28Speaker 6: the day, I think James Comy is going to have
- 5:29Speaker 6: a lot of issues.
- 5:30Speaker 1: Wow.
- 5:30Speaker 5: So there's going to be even more evidence and pictures
- 5:33Speaker 5: and statements other than that.
- 5:35Speaker 1: Beach post that we've all seen.
- 5:37Speaker 6: This is just the beginning.
- 5:38Speaker 1: Wow.
- 5:40Speaker 5: So obviously we have free speech in this country.
- 5:43Speaker 1: Violent rhetoric does not cover that.
- 5:44Speaker 5: But I think the question would be would that fall
- 5:47Speaker 5: under the violent rhetoric that free speech doesn't cover.
- 5:51Speaker 6: I think it does. Now, Look, you're going to have
- 5:53Speaker 6: to look at, or jury's going to have to look at.
- 5:55Speaker 6: If you think about it, what a reasonable person believe
- 5:58Speaker 6: that that eighty six forty A is violent rhed eric?
- 6:02Speaker 6: Would that incite violence? Now? In my opinion, yes, I
- 6:06Speaker 6: think it certainly would, because anybody in the right mind
- 6:08Speaker 6: knows what does eighty six mean? It means to get
- 6:11Speaker 6: off means to kill, all right, and he can't say, oh,
- 6:13Speaker 6: I just happen to see this on a beach walking
- 6:15Speaker 6: down there one day. Come on, that's ridiculous, got.
- 6:18Speaker 1: It, all right, David Gelman life for us. Thank you
- 6:20Speaker 1: so much for joining us on both stories.
