- 0:21Speaker 2: Judge Mabeling's here to tell you.
- 0:23Speaker 1: And if the cockroaches from the food truck end up
- 0:25Speaker 1: in your apartment when you move in, can you get
- 0:28Speaker 1: upset and just get your money back? Judge Alex Rules, Real.
- 0:31Speaker 2: People cases thanke Justice.
- 0:33Speaker 3: This is.
- 0:36Speaker 2: Gabble Gavel. Coaches gave Gavel cockroaches.
- 0:40Speaker 1: Hello everybody, Welcome to Yo Gabble Gavel, the bi weekly
- 0:43Speaker 1: program where we dive into the world of courtroom shows.
- 0:48Speaker 2: Thank you many damas you're working on that.
- 0:51Speaker 1: Huh, who do you have?
- 0:53Speaker 2: I got, Judge Mabeley, is that the People's Court?
- 0:56Speaker 3: No, Judge Millan, is the People's for the thousandth time,
- 1:04Speaker 3: You're the worst human being they're doing it. Know their names,
- 1:08Speaker 3: no people's names. Every time you go to the People's Court,
- 1:12Speaker 3: you're like, it's somebody.
- 1:13Speaker 1: It's not her, it's one of the m's.
- 1:15Speaker 2: Christina Milion, dip it low.
- 1:16Speaker 1: Yeah, dip it low, baby, that's right. Well, I'm over
- 1:20Speaker 1: on Judge Alex. Yeah, a show that hasn't been on
- 1:22Speaker 1: in a long time, and it's hard to find cases,
- 1:24Speaker 1: but I found one.
- 1:25Speaker 2: You found one? Yeah, what do you want to do?
- 1:26Speaker 3: Okay?
- 1:26Speaker 1: First, First, Timothy Clark is suing Mary Joe Lucas. Yeah,
- 1:32Speaker 1: really serious there for Timothy, Timothy Clark, Sorry, not Tim,
- 1:38Speaker 1: not Tim Scott. Tim Scott's not saying. Timothy Clark is
- 1:41Speaker 1: suing Mary Joe Lucas for thirteen fifty for rent and
- 1:47Speaker 1: a deposit refund.
- 1:49Speaker 2: Okay.
- 1:50Speaker 1: Mary Joe Lucas is counter suing for one thousand, six
- 1:53Speaker 1: and eighty seven dollars for breach of lease. So you're
- 1:57Speaker 1: ready to dive in.
- 1:57Speaker 2: I'm ready to marry.
- 1:59Speaker 1: Joe explains what her place is like, that she's she
- 2:05Speaker 1: is the landlord, yes, and she gives us a whole
- 2:07Speaker 1: verbal walkthrough of her rental. It sounds delight sounds, it
- 2:12Speaker 1: sounds wonderful. Tim says, not delight not delightful. Tim says
- 2:17Speaker 1: that he goes to view this place and it is
- 2:23Speaker 1: quite messy before this is before he runs. It is
- 2:26Speaker 1: quite messy, but somebody is literally there cleaning the place, okay,
- 2:33Speaker 1: and it's I think it's Mary Joe's son is giving
- 2:37Speaker 1: him to walk through. It's like everything's gonna be a
- 2:38Speaker 1: tip top shape. He shows up too, uh two weeks
- 2:44Speaker 1: later to sign the contract and do the walkthrough, and
- 2:51Speaker 1: so mary Joka does to walk through. He claims that
- 2:54Speaker 1: the power was not turned on, so it was dim
- 2:58Speaker 1: kind of hard to see. He walked through, and but
- 3:02Speaker 1: he suddenly suddenly and when he moves in, he so
- 3:07Speaker 1: he pays the security deposit and first month rents for
- 3:10Speaker 1: a total of thirteen fifty and uh. He goes in
- 3:13Speaker 1: and he is shocked to find that this place is
- 3:16Speaker 1: an absolute mess. He brings pictures, lots of pictures of
- 3:20Speaker 1: the mess, and a video showing him cleaning. He does
- 3:24Speaker 1: one one pass of a wind decks and in this
- 3:30Speaker 1: and a paper towel on a fridge, and it's the
- 3:35Speaker 1: paper towel is just black.
- 3:36Speaker 2: We see it, we see it, we see it.
- 3:39Speaker 1: The pictures are tough, and we will walk through some
- 3:41Speaker 1: of them here. Uh and just in just a few moments.
- 3:45Speaker 1: But he uh, she's like, well he he says, I
- 3:51Speaker 1: the fridge. She explains that the fridge was left over
- 3:55Speaker 1: from the old tennis. It's not a part of the least,
- 3:57Speaker 1: So if it broke or was a mess or whatever,
- 4:01Speaker 1: he'd has to replace it. It's not a part of
- 4:02Speaker 1: the lease, he says. Behind the stove, he sees some
- 4:07Speaker 1: rat droppings. Take pictures of that, pictures of that.
- 4:11Speaker 3: He did sign a lease, I want to be clear,
- 4:13Speaker 3: though he did sign.
- 4:16Speaker 1: He sees rat droppings. He then does some more exploration,
- 4:21Speaker 1: finds just a mess of stuff around the water heater.
- 4:28Speaker 1: When you kind of pull some stuff back, you see
- 4:31Speaker 1: what looks to be a nest of sorts, lots of
- 4:35Speaker 1: poop around that, lots of damage around that that you
- 4:39Speaker 1: don't see upon looking at it first. There there's just
- 4:45Speaker 1: a lot going on here. So he says that he goes.
- 4:48Speaker 1: So he moves in, spends the whole day cleaning, leaves.
- 4:53Speaker 1: The next day, goes to work, comes back. The smell
- 4:56Speaker 1: of mildew and mold hits him in the face. And
- 4:58Speaker 1: when he goes into the kitchen he just sees just
- 5:03Speaker 1: a ton of cockroaches. We do see pictures of cockroaches.
- 5:08Speaker 1: Oh my gosh, tons of pictures, tons of bugs, tons
- 5:13Speaker 1: of dirt, just an absolutely mess. And Mary Joe sees
- 5:17Speaker 1: the picture and she's like, oh, wow, are they alive
- 5:20Speaker 1: and he's like, yeah, they were alive.
- 5:23Speaker 2: Why have they've not talked about this before going to court?
- 5:25Speaker 1: Okay, So Tim sees this and he's like, forget it,
- 5:29Speaker 1: I'm out of here and just leaves. He calls her
- 5:34Speaker 1: and tells her about the rat droppings and whatnot, and
- 5:39Speaker 1: so she goes out and gets it treated. Somebody comes
- 5:44Speaker 1: out for treatment and she calls him up and is like, hey,
- 5:48Speaker 1: I'll give you ten days off your lease that it's
- 5:51Speaker 1: been treated treated, and he we just continue to see
- 5:56Speaker 1: pictures of it being a mess, and he explains that
- 5:58Speaker 1: he was, you know, just having to It was so
- 6:01Speaker 1: much that he had to clean up. And Mary Justice,
- 6:03Speaker 1: have you never rented a place before? And Alex is like,
- 6:07Speaker 1: are you saying that he's being too critical of the
- 6:11Speaker 1: condition of your house? And she says, he moved in,
- 6:15Speaker 1: he did a walk through, he accepted the property to
- 6:18Speaker 1: let h and to let her know if there's anything
- 6:21Speaker 1: that needs to be fixed. I prove that I'm willing
- 6:23Speaker 1: to do something if he just lets me know. He
- 6:27Speaker 1: didn't give me that chance. He just left, which it
- 6:29Speaker 1: breaks breaks the lease you left, Alex says, But Mary, Joe,
- 6:34Speaker 1: this isn't a window that is tough to open. This
- 6:39Speaker 1: is a house that, to be honest with you, looks
- 6:43Speaker 1: like a crack house. It looks. But did she get
- 6:46Speaker 1: it treated, she got the the poop, Yeah, she got
- 6:51Speaker 1: that dream. You rented him a crackhouse. Look at the roaches,
- 6:57Speaker 1: She says, roach has never hurt anyone. He says, would
- 7:02Speaker 1: you live there?
- 7:03Speaker 2: And she.
- 7:06Speaker 1: Says that she never even got a chance to fix
- 7:08Speaker 1: the conditions before he moved out. If he would have
- 7:11Speaker 1: just told me, hey, the place is a mess, I
- 7:13Speaker 1: would have fixed it. Instead, he did not, and he left,
- 7:19Speaker 1: and um, okay, So Alex says, why are you a landlord?
- 7:29Speaker 1: Why are you in this business? And she says what
- 7:32Speaker 1: And he says, sorry, why are you a Why are
- 7:34Speaker 1: you a slum lord? Alex? I can't believe he got
- 7:39Speaker 1: canceled And she says, I don't consider myself a slum lord.
- 7:43Speaker 1: And he says, these are the worst conditions I've ever
- 7:49Speaker 1: seen a tenant to bring. Typically it's reversed and the
- 7:55Speaker 1: landlord is bringing a house that has been absolutely trashed.
- 7:58Speaker 2: Yes.
- 7:59Speaker 1: No, And in this case, you're a landlord that, uh
- 8:03Speaker 1: just is renting out a place that isn't it's just nasty.
- 8:07Speaker 1: It's it is uninhabitable and you chose to rent it out.
- 8:12Speaker 1: And she says, you're being subjective, you're not following the law. Yeah,
- 8:18Speaker 1: and he kicks her out and she's like, does that
- 8:22Speaker 1: mean I lost? And he is now ready to rule.
- 8:26Speaker 2: Yeah.
- 8:26Speaker 3: This is a tough one because it's clear she's awful.
- 8:28Speaker 3: It's clear that the place is awful. But she's on
- 8:31Speaker 3: the right side of the law.
- 8:33Speaker 2: Here. What's his sixteen eighty seven countersuit for?
- 8:38Speaker 1: What is she countersuing for?
- 8:40Speaker 2: Oh, she's countersuing my bad.
- 8:42Speaker 1: No, no, no, I thought he he issuing her thirteen fifty.
- 8:46Speaker 2: What's her sixteen eighty seven?
- 8:48Speaker 1: It is the amount of money that she would have
- 8:52Speaker 1: made in the time it took to find a new tenant.
- 8:55Speaker 3: I I feel like he should give nothing to either.
- 8:59Speaker 3: But because he kicked her out of the courtroom, he's
- 9:02Speaker 3: probably gonna rule that he's got to pay the rent.
- 9:07Speaker 1: Yeah, so Alex is really mad at her. It's while yes,
- 9:14Speaker 1: there's a contract in place, there's also he's she's just
- 9:21Speaker 1: being she's just being dirty. Yeah, she's just a sketch
- 9:24Speaker 1: ball here. So she has to pay him thirteen fifty
- 9:30Speaker 1: plus one thousand dollars of punitive damages. Yeah, for a
- 9:33Speaker 1: total of what is that fifty?
- 9:36Speaker 2: Yeah?
- 9:37Speaker 1: Uh, tactle elet for just for being the worst. I
- 9:43Speaker 1: can't fully express how unlikable this woman is.
- 9:47Speaker 3: But what's wild is it's clear, just like what's great
- 9:50Speaker 3: about Alex is he's like, I know I can't fix
- 9:52Speaker 3: this problem as a whole, but I'm gonna do what
- 9:54Speaker 3: I can right now.
- 9:55Speaker 2: Yeah.
- 9:55Speaker 1: Basically, so, I mean I think, what, uh, this is
- 9:59Speaker 1: an interesting case because he did sign the contract.
- 10:02Speaker 3: Yeah, if he was in like Judge Ross's courtroom, Judge
- 10:08Speaker 3: Ross would give her a lecture and then not like
- 10:11Speaker 3: still side of the contract.
- 10:12Speaker 1: Yeah, so he doesn't even really even acknowledge the fact
- 10:15Speaker 1: that he signed a contract. He's just basically like, yeah,
- 10:18Speaker 1: you sign a contract, but at the very least as
- 10:23Speaker 1: a landlord. Basically, his claim is, you sign a contract
- 10:29Speaker 1: for a livable place. This is not a place. Therefore
- 10:32Speaker 1: the contract's void. That's kind of his argument. So there
- 10:35Speaker 1: you go.
- 10:36Speaker 2: I'm here for it.
- 10:36Speaker 1: Ike ike though, ike ikey, Let's move.
- 10:40Speaker 3: Over to something kind of ikey as well. Charles Guerrero
- 10:43Speaker 3: is suing Amelia Torres. For nine thousand, nine thousand largest, largest,
- 10:50Speaker 3: nine thousand largest, and this is money. He claims his
- 10:53Speaker 3: food truck has lost because of the actions of miss Torres. Now,
- 10:58Speaker 3: I think nine thousand maybe the it's we don't get
- 11:01Speaker 3: into like the nuts and bolts.
- 11:02Speaker 1: Of why of the breakdown of that number.
- 11:05Speaker 3: So Charles is like, look, miss Torre has made false
- 11:07Speaker 3: accusations on social media about my food truck. Okay, she
- 11:13Speaker 3: came to the taco truck three separate times, and.
- 11:17Speaker 1: She he I'm sorry real quick. So he's suing her.
- 11:20Speaker 3: He's suing her, suing her over a review over yeah,
- 11:23Speaker 3: he So what he says is she came to the
- 11:26Speaker 3: taco truck three separate times, claims she got food poisoning
- 11:30Speaker 3: from all three and found a cockroach.
- 11:34Speaker 2: This is a bold, bold move.
- 11:36Speaker 1: And when I get food poisoning, here we go. I
- 11:38Speaker 1: don't go back.
- 11:39Speaker 3: Yeah, so Mabeling cuts in, and not only do I
- 11:42Speaker 3: not go back, I typically have a hard time going
- 11:44Speaker 3: back to even the type of food that it was.
- 11:48Speaker 3: Maybeling's like, she got food poisoning, went back two more tons,
- 11:54Speaker 3: and Charles is like, exactly, your on her.
- 11:57Speaker 2: It's not only hard to believe it's just not true.
- 12:00Speaker 1: Okay, all right, And immediately it is like, okay, first
- 12:03Speaker 1: of all, the first time I got food poisoning, I
- 12:06Speaker 1: wasn't sure that it was his food.
- 12:08Speaker 2: I didn't know what it was.
- 12:10Speaker 3: And so I went back the second time, and I
- 12:13Speaker 3: was able to identify that it was his food, And.
- 12:17Speaker 1: Uh so what about the third time?
- 12:19Speaker 2: It's like, how, okay, we're getting there.
- 12:21Speaker 1: It's a good question.
- 12:22Speaker 3: Maybe it's like how She's like, well, I got some
- 12:25Speaker 3: steak tacos, I went to the doctor, started feeling sick,
- 12:28Speaker 3: and it was the only thing I'd had to eat
- 12:29Speaker 3: that day, and so I have documentation to prove it.
- 12:33Speaker 3: Maybe it's like show me. She's like, here you go.
- 12:36Speaker 3: Here's the doctor's visit, and the description of the doctor's visit.
- 12:39Speaker 2: More on that.
- 12:40Speaker 1: Later she said that I guess maybe I'll get back
- 12:43Speaker 1: to it. But she's she went to the doctor because
- 12:47Speaker 1: she was feeling sick. Yes, yes, we'll get I promised somewhere.
- 12:50Speaker 1: We'll get back to second trip steak tacos. Then I
- 12:54Speaker 1: went to the doctor. So Maybeleane's like, so then you
- 12:57Speaker 1: contacted the food truck afterwards, righting to let him know
- 12:59Speaker 1: some of the wrong with their.
- 13:00Speaker 2: Food, and she's like, no, I didn't.
- 13:03Speaker 3: I was feeling too sick to contact He's like, do
- 13:06Speaker 3: you know how to use email? She's like, well, he
- 13:08Speaker 3: doesn't have an email address.
- 13:10Speaker 2: That I know.
- 13:11Speaker 3: And Mabelin goes, well, how do you know how to
- 13:14Speaker 3: find the taco truck that moves around if you don't
- 13:17Speaker 3: know how to contact him? Where do you know where
- 13:19Speaker 3: the food truck's going to be? Miss Torres goes well,
- 13:22Speaker 3: it's on my way to work every day, and Mabelin goes, oh,
- 13:26Speaker 3: so when you went back to work, then you swung
- 13:28Speaker 3: by and you talked to him about it, right, you
- 13:32Speaker 3: you went back to work, and she goes, well, I
- 13:34Speaker 3: took a couple of days off work, okay, But then
- 13:37Speaker 3: after you took a couple days off work, you food
- 13:40Speaker 3: trucks on your way you went by and saw him, right,
- 13:43Speaker 3: And then she goes, you're on her I was sick
- 13:44Speaker 3: for like two weeks. And Mabeling's like, you just told
- 13:48Speaker 3: me you're sick for two days. Now you're saying it's
- 13:51Speaker 3: two weeks, okay, it could be two months. You eventually
- 13:55Speaker 3: went back to work, did you talk to him? She's like, no,
- 14:00Speaker 3: I didn't She's like, but you went back a third
- 14:03Speaker 3: time to eat and you didn't talk to him.
- 14:07Speaker 2: She goes, yeah, I was hoping this time would be different.
- 14:11Speaker 1: No, no, no, brow.
- 14:12Speaker 3: She was like, you you went twice sick for two days,
- 14:17Speaker 3: two weeks, and I hope that the third time would
- 14:19Speaker 3: be different. And she goes, yes, your honor, I was
- 14:22Speaker 3: hoping it would be my lucky day. She goes, okay,
- 14:27Speaker 3: so you win a third time. She goes, yeah, and
- 14:29Speaker 3: I had a burrito and there was a cockroach in
- 14:32Speaker 3: my burrito. Oh, so I posted about it on social media.
- 14:36Speaker 1: Does she have a picture?
- 14:37Speaker 3: Yeah, okay, she said, how do you know? How'd you
- 14:40Speaker 3: know there's a cockroach in there? Before eating? She goes,
- 14:42Speaker 3: A burrito's cutting hap as soon as I opened up
- 14:44Speaker 3: the foil, there's a cockroach in the burrito, And so
- 14:47Speaker 3: I posted about it on social media because I was
- 14:50Speaker 3: so sick of getting food poisoned. From this point, I
- 14:54Speaker 3: do love that Charles is like, your honor, I have
- 14:57Speaker 3: brought in the picture that she posted on social media.
- 15:00Speaker 2: She didn't bring in the picture. I brought it in.
- 15:02Speaker 3: That's an interesting like really, She goes, why have you
- 15:05Speaker 3: done that? He goes, because I'd like for you to
- 15:06Speaker 3: look at it. So he puts the picture up, and
- 15:09Speaker 3: there is a cockroach in this burrito. There is she
- 15:12Speaker 3: He's like, you're on her. Uh, here is a picture
- 15:16Speaker 3: of one of my burritos. He wraps his burritos in
- 15:19Speaker 3: a clear wrapping. This is like this weird party, red
- 15:24Speaker 3: and silver tinfoil. Like, He's like, this burrito clearly did
- 15:29Speaker 3: not come directly from my food truck. Like evidence I
- 15:33Speaker 3: could show you any like, it didn't come from my
- 15:35Speaker 3: food truck.
- 15:37Speaker 2: It didn't. It didn't come from there.
- 15:39Speaker 1: Oh boy, it's not from there.
- 15:41Speaker 3: And if it was from there, she took it out
- 15:43Speaker 3: and put it in a different foil, who knows what
- 15:45Speaker 3: else she did with it, right, Oh boy. So Mabeline's like,
- 15:51Speaker 3: let me read this doctor's note. So she reads the
- 15:54Speaker 3: doctor's note.
- 15:54Speaker 1: Which she went to the doctor where she was feeling.
- 15:57Speaker 3: Says that please excuse such an such from any work
- 16:01Speaker 3: or work related whatever. She's contracted food poisoning from this
- 16:05Speaker 3: bacteria that's found in a cockroach that was found in
- 16:08Speaker 3: her burrito. Now that was after the third time, right,
- 16:12Speaker 3: she told her that after the second time she went
- 16:15Speaker 3: after this note is about the burrito, I'm tracking, and
- 16:21Speaker 3: she's like, why did you post this on social media?
- 16:24Speaker 3: She said, I just posted that the food made you sick,
- 16:26Speaker 3: And she said so sick that you kept going back,
- 16:29Speaker 3: And she goes, you're honor. It's the only food truck
- 16:32Speaker 3: on my way to work. And Mabelinge's like, do you
- 16:36Speaker 3: hear how crazy you say? There's gonna be other restaurants?
- 16:38Speaker 2: Though?
- 16:39Speaker 4: Right?
- 16:39Speaker 2: She is? She exactly right?
- 16:41Speaker 1: Is she an only food truck person?
- 16:42Speaker 2: Yeah, Mabeling's ready to rule.
- 16:46Speaker 1: Oh, well, she's a liar the best I can figure
- 16:49Speaker 1: at the very here's the thing, I do have a
- 16:53Speaker 1: tough not a tough time like all. He's saying, that's
- 16:58Speaker 1: not my foil, Like, I would like some proof of that.
- 17:02Speaker 1: Show me picked other pictures that people have posted that
- 17:05Speaker 1: show it in different foil, Like I'm not I don't
- 17:07Speaker 1: want to just take your word for it. But there
- 17:10Speaker 1: is proof that she is a liar because she said
- 17:13Speaker 1: she went to the doctor for the second time. The
- 17:15Speaker 1: doctor's note is clearly from after the third time, and
- 17:18Speaker 1: so for that reason, because she's lying about this, she's
- 17:22Speaker 1: likely lying about the whole situation. And so I'm gonna
- 17:25Speaker 1: Give'm gonna give him. Oh, I don't know. I don't really,
- 17:31Speaker 1: I would like to know how it's broken down. That's
- 17:33Speaker 1: basically like it's nine thousands for defamation essentially basically, and
- 17:38Speaker 1: so yeah, I don't he didn't necessarily, Yeah, I don't know,
- 17:44Speaker 1: give him half of that.
- 17:45Speaker 2: She's like, do you hear how crazy this sounds?
- 17:48Speaker 3: Uh? And I mean it was like yes, She's like,
- 17:49Speaker 3: this is absurd, you're absurd. Pay the man is money.
- 17:52Speaker 3: Gives him all of his money, all nine grand.
- 17:55Speaker 1: This is why you always go big, You go big, Sue,
- 17:59Speaker 1: and you just kind of see how it shakes.
- 18:01Speaker 3: Ms Is once again in Ross's court roomor justice isn't
- 18:04Speaker 3: a foreign concept. He would have been liked to break
- 18:06Speaker 3: down the nine thousand for me, but Maybeling didn't do that,
- 18:08Speaker 3: and so he got away with it.
- 18:10Speaker 2: Good for him because this woman shady. Yeah she's shady,
