- 0:00The Morning Show with Preston Scott. Can you fly this plane and land it?
- 0:03Surely you can't be serious. I am serious, and don't call me.
- 0:07Shrow on News Radio one hundred point seven WUSLA all right, thirty six
- 0:16minutes after the hour, and joining us now in the program is the founder
- 0:21and chairman of Liberty Council, frequent guests of the show, friend of the
- 0:24radio program, and we are friend of theirs. Matt Staver. Matt,
- 0:28good morning, Welcome, how are you. Good morning, Good to be
- 0:31with you. Thank you for having me, my pleasure. You're going to
- 0:34be coming to Tallahassee tomorrow to visit the Florida State Supreme Court. Explain please
- 0:39the importance of tomorrow. Well, tomorrow at nine o'clock at the Florida Supreme
- 0:44Court will be having oral arguments on the Florida Abortion Amendment. They have now
- 0:48gotten over eight hundred thousand signatures to put on on the ballot. So the
- 0:53last thing is this argument here. Any voter initiative has to comply with two
- 0:58things. Number one, it has to be very clear and unambiguous, without
- 1:00any deceptive language or information, you can't deceive the voters. And number two
- 1:07it must address only a single subject, not multiple subjects. So your yes
- 1:11is just a yes on one specific issue, rather than a yes on some
- 1:15things you agree with but not on other things that you don't agree with.
- 1:19So that's the issue Tomorrow at the Florida Supreme Court, I'll be presenting an
- 1:25argument along with the Florida Attorney General and then the proponents. This language is
- 1:29so broad. It says that no law shall prohibit penalized delay or restrict abortion
- 1:37prior to our buildity. It means no law, no law. Just listen
- 1:41to these words. No law shall restrict abortion before viability. Now that's going
- 1:45to be late second, early third trimester. That means no parental consent,
- 1:51no informed consent, no wating periods, no licensing requirements of doctors, no
- 1:57health and safety stand no ban on partial birth abortion, nothing. No law
- 2:05can restrict abortion. Every law restricts its subject matter. And if you say
- 2:08no law shall restrict abortion, that means nothing. Everything is wiped out,
- 2:13totally wiped out, with his abortion totally unregulated. And then after viability,
- 2:20after viability, a healthcare provider can have an absolute veto over any late term
- 2:27abortion law just by saying that it's necessary to protect the health of the woman.
- 2:34Now, who is a health care provider, Well, that's not defined.
- 2:37But under Florida law, healthcare practitioners include fifty eight categories, which includes
- 2:43a nine to one to one operator, a tattoo artist even or an orthodic
- 2:49fitter assistant, somebody who assists an orthotic person to put, you know,
- 2:57things in your shoes that have no medical tree, an audiologist, someone who's
- 3:02an optimologist. It has a huge list, fifty eight categories. When you
- 3:07and I think of health care provider, we think of a medical doctor.
- 3:10Now, these are non medical people that would be under the term health care
- 3:15provider, and they would have the ability to determine post viability, whether the
- 3:21baby's viable, and even if it is viable, it doesn't matter what the
- 3:24law is, whether that person could still have an abortion. So really you
- 3:30have totally unregulated abortion through all nine months of pregnancy at any time for any
- 3:37reason uptil the point of birth. And that is very deceptive. That is
- 3:42not explained to the voter in this Vallid summary that they have proposed to go
- 3:47on the ballot. The voter will not read what I just said. But
- 3:51that's in fact what this amendment does, and that's why it's deceptive. It
- 3:55fools the voters intentionally to vote for something that they would never vote for.
- 4:00Floridians, no matter where they are on this issue, would never vote for
- 4:05no regulation, no health regulation, nothing. You are listening to the Mad
- 4:13Radio Network where you're challenged to make a difference each and every day. Good
- 4:17morning, and welcome to the Morning Show with Preston Scott. Making a difference.
- 4:24It's why I support the Liberty Council. Challenge you to do the same.
- 4:28Go to LC dot org. Matt Staber, the founder and chairman with
- 4:31me man, I want to focus on two words here for a quick couple
- 4:34minutes each. The first word is health. The liberal left loves to be
- 4:41ambiguous when it uses words assault weapons, health. How are we defining the
- 4:48health of a mother? It's not defined. That's another problem. So before
- 4:54viability, no law at all. After viability, a healthcare that I've already
- 5:00talked about, has an absolute veto power over any law if that person says
- 5:06it's necessary for the patient's health. But health is not defined health. You
- 5:12know, when you go back to do versus Bolton back in nineteen seventy three.
- 5:16The companion of Roe v. Wade abortion decision use the World Health Organization
- 5:21definition of health, and that included physical, mental, emotional, psychological,
- 5:29chiological, financial, the age of the woman, all kinds of things that
- 5:32you wouldn't normally think of as health. When you look at the who's definition
- 5:38of health today, it's even broader, so it means not just the absence
- 5:44of disease. It is everything, whether it's financial or whatever. It is
- 5:48sociological, the location where you live, where you work, what your career
- 5:53is. It is undefined. That's why when this amendment says that after viability,
- 6:00a healthcare provider can still say an abortion is necessary to protect the health.
- 6:06Health is undefined. You can't challenge that because health is anything. There's
- 6:12no objective reality here, Matt. The other word I want to focus on
- 6:15is a word that's been used a lot here, and that's the word viability.
- 6:18You know, when I used to speak on some college campuses, the
- 6:21topic would come up and I would tackle the what I think is the fallacy
- 6:26of the argument of viability because in technical, literal, and I think legal
- 6:30terms, when you define viability, a child isn't viable until they can speak
- 6:35communicate, walk and talk and communicate what their needs are. They are dependent
- 6:41on others for the first five, six, seven years of life. We
- 6:45could joke and say, well some into college years, but you get my
- 6:47point. That's right, and that's exactly right. You know, some people
- 6:51think of viability and this is also another problem with the deceptive nature of the
- 6:57baby being able to live outside of the mother's worfy. So maybe late third
- 7:00trimester, late second trimester, early third trimester, twenty two to twenty four
- 7:04weeks and we're in there. Well, that may be somebody's definition, right,
- 7:09but that's not the universal definition because viable could be something like you're talking
- 7:16about. If the baby is outside the mother's womb, they always need assistance,
- 7:20right. You can't just birth a baby and let it sit there.
- 7:23It's going to die on its own. So it needs assistance, whether it's
- 7:27in the womb at the third trimester or out of the womb, you know,
- 7:30and it's actually physically there by itself, it needs assistance. So is
- 7:36that baby viable? I know for a fact that there are some people that
- 7:41are advocating. Professors at different universities, a professor by the name of a
- 7:46singer at Princeton University. He used to say that it would be like two
- 7:50years post of birth that you would give a right to life to a child,
- 7:57because until two years they're not able to make it on their own,
- 8:01and therefore they wouldn't be viable in that respect. So you have the word
- 8:05viable necessary. What's necessary. It's not because of the dire life and death
- 8:13of the mother. It's whatever anybody says. It is health and healthcare provider,
- 8:18all undefined and all exceptionally broad, Matt. The best way people to
- 8:24can help tomorrow, obviously is prior even to nine am, to be praying.
- 8:31Is there anything else? Yes, definitely pray. You can come to
- 8:37the court as well, or there's going to be a press conference afterward if
- 8:39you're in that area, but certainly pray. And you can also go to
- 8:43LC dot org forward slash fl Amendment, forward slash f Element, LC dot
- 8:50org forward slash fl Amendment all together and that's where we'll have information about this
- 8:56case. And then you can click on a link that will be there and
- 9:00listen to the oral argument live as it takes place. I wish you well,
- 9:05sir, thank you for doing what you do. As always You're welcome
- 9:07anytime. Thank you, my pleasure. Matt Staber, he is the founder,
- 9:11he's the chairman. I'll go ahead and say he's lead counsel. He
- 9:16doesn't lose folks, and I think you can hear it. He makes the
- 9:22principled, simple, direct arguments. This amendment is a travesty and it needs
- 9:31to be tossed off the ballot. We can't make this mistake. Too many
- 9:37lives are at stake. Forty six minutes after the hour
