- 0:01With. The red light.
- 0:05On I'm just waiting for the. Change.
- 0:10On February 18, ACT Policing raided a music venue in
- 0:15Canberra, evacuated patrons and declared the place a crime
- 0:19scene. It was because of so called art
- 0:23hanging on the wall. This is exactly what many have
- 0:28warned would happen when the government rushed through the
- 0:32new hate speech laws. Legal experts warned it.
- 0:36Civil libertarians warned it, and I wanted to, because after
- 0:40more than a decade in policing, I know how vague powers get used
- 0:45in the real world. They don't stay confined to
- 0:48extremists. They expand.
- 0:51They get weaponized, and eventually they land on ordinary
- 0:55people who simply hold the wrong political view.
- 1:03So the hypothetical became reality.
- 1:07You might think, well, if someone displayed a hate symbol,
- 1:11surely they intended to spread hate.
- 1:14But that is the trap. Under these laws, you don't need
- 1:19intent. As I said, you only need to be
- 1:22reckless about whether a symbol was displayed, and that
- 1:25threshold is dangerously, dangerously low.
- 1:29So the posters in question were anti fascist satire mocking
- 1:34world leaders as dictators, not promoting them.
- 1:38But the police didn't care about context, They saw a symbol tick
- 1:42the box and shut a business down.
- 1:45That's what happens when legislation is drafted broadly
- 1:49and enforced mechanically. So just to be absolutely clear,
- 1:55I do not like the posters, nor do I agree with the messaging in
- 2:00the posters. But the government says this is
- 2:05about safety. But when police are shutting
- 2:08down gigs to assess the artistic merit of a poster, you have to
- 2:13ask whether the government has handed itself a weapon it
- 2:16doesn't know how to control. So here's the incident.
- 2:22We have a Canberra venue called Descent Cafe and Bar.
- 2:25It was forced to close and cancel a gig after police seized
- 2:295 posters following a complaint about possible hate imagery.
- 2:36Police attended. They've asked the owner to
- 2:39remove the posters and when he declined, which he is legally
- 2:45entitled to do, they escalated. A crime scene was declared, the
- 2:50venue was shut down, the posters were seized.
- 2:55ACT Policing later said 5 posters were subsequently seized
- 3:01and will be considered under recently enacted Commonwealth
- 3:06legislation regarding hate symbols.
- 3:09They also confirmed they are seeking legal advice on whether
- 3:14the posters are even illegal. Did you hear that?
- 3:19So as someone who spent more than a decade in policing, let
- 3:23me translate that little statement for you.
- 3:26What they're saying is they weren't sure it was a crime, but
- 3:31they acted as if it was. That statement alone should
- 3:37terrify you. It terrifies me.
- 3:40The political reaction has been fierce.
- 3:43The Greens and several independents have condemned the
- 3:47action as wrongly or sorry, worryingly Orwellian and a
- 3:53direct threat to free speech. They're now questioning whether
- 3:57the legislation was rushed and whether it's even workable.
- 4:02And honestly, they are right to ask.
- 4:05But they probably should have thought about this beforehand
- 4:09and questioned a lot more So what the posters actually were.
- 4:16The posters depicted figures like Donald Trump, Benjamin
- 4:20Netanyahu, Vladimir Putin, Elon Musk in photoshopped Nazi style
- 4:26uniforms. The artists who called the Grow
- 4:30Up art collective said it was anti fascist satire.
- 4:34The venue owner said the same. So again, I do not like the
- 4:37posters nor do I agree with the message.
- 4:41However, we need free speech and this kind of political
- 4:45commentary has existed for decade whether I agree with it
- 4:49or not. But under these laws, context
- 4:53doesn't matter, intent doesn't matter, matter.
- 4:56Satire doesn't matter. The symbol is the offence, and
- 5:03that's the problem. So this is really a legal trap.
- 5:10Let's talk about the hidden mechanics of this law, because
- 5:12this is where the danger really lies.
- 5:16A defence is not a shield that stops police from entering your
- 5:22building. A defence is something you argue
- 5:25months later in court after you've been charged, your
- 5:31property has been seized, your business has been disrupted and
- 5:36you've spent thousands on legal fees.
- 5:40To rely on the artistic purpose defence, the display must be
- 5:45genuine and reasonable. And who decides what's genuine?
- 5:51Art? Art was always in the eye of the
- 5:54beholder. So first the police officer
- 5:56standing in your venue, later a court.
- 6:01So you have to ask yourself, is it reasonable to display a
- 6:06swastika in a cafe window where a Jewish passerby might see it
- 6:11and feel threatened? Even if the intent is satire,
- 6:15that is exactly the question the prosecution will ask.
- 6:20And here's the irony, the artists used fascist imagery to
- 6:26criticise fascism. But the law doesn't care about
- 6:29ideology, it bans the symbol not the meaning.
- 6:35So an anti fascist mocking a leader they believe is a
- 6:40dictator is treated the same as a neo Nazi promoting promoting
- 6:47hate. So this law captures the
- 6:50satirist and the extremist alike and forces the satirist to hire
- 6:55a lawyer to explain the difference.
- 6:58So here's the policing reality. When police say they are seeking
- 7:02legal advice, that is code 4. We don't actually know if this
- 7:08is legal, but by that point the venue is closed, the posters are
- 7:15gone, the gig is cancelled, the damage is done.
- 7:23Police operate on a risk averse model.
- 7:27If they leave the posters up and it turns out to be a hate crime,
- 7:31then they've failed. If they seize them and it turns
- 7:34out to be art, they can return them later.
- 7:38So from a policing standpoint, seizure is the safest option.
- 7:45But from a civil liberties standpoint, that safe option is
- 7:51catastrophic. It means freedom of speech
- 7:55becomes secondary to administrative caution.
- 8:00Legal bodies warned this would happen.
- 8:03They warned police would struggle to distinguish between
- 8:07hate speech and commentary about hate speech.
- 8:12Not because police are stupid, but because police enforce the
- 8:16law, they don't interpret it, and when the law is vague, they
- 8:21take the safest path, as they always do.
- 8:27So the bigger picture, the bigger picture in all this is
- 8:31that this law was born out of a real tragedy and a real rise in
- 8:36anti semitism, but it is now being applied in a way that
- 8:40targets political dissent and political communication.
- 8:45So the shutdown of the Descent Cafe, I mean, the name says it
- 8:50all, proves that the safeguards in this legislation are not
- 8:54enough to prevent overreach. We've created a system where the
- 9:00symbol carries more legal weight than the intent or the ideology
- 9:05behind it. Police are still seeking legal
- 9:11advice, but the fact they needed advice after shutting down a
- 9:16business tells you everything you need to know about how
- 9:21confusing and poorly communicated these powers are.
- 9:27And if you think this won't affect you, think again.
- 9:32Next time. It might not be a Cafe in
- 9:35Canberra. It might be a history teacher, a
- 9:41comedian, a Bible teaching pastor or you sharing a meme in
- 9:48a group chat. All it takes is 1 complaint.
- 9:54That's all it takes. The government says this is
- 9:57about making Australia safer, but we have to ask ourselves,
- 10:03where do we draw the line between safety and just being
- 10:07silenced? And is this just about
- 10:12manipulation and control? As always, this is just my
- 10:18opinion. I'm Jay Fallon.
- 10:21Thank you for listening to The Slippery Slope.
- 10:24They just. Feel the desire they will take
- 10:27me higher. I'm on fire because nothing's
- 10:29going to bring me down. Nothing's going to be done,
- 10:30nothing's going to stop me now. No one deals to be done as I'm
- 10:34not going to stand on me going and nothing 's going to and
- 10:56nothing's going to hold me down. Got my eye on the eyes, got my
- 11:10sign. It seems nothing's going.
- 11:16Nothing's. Going to stop me now.
- 11:20Nothing's going to stop me now.
