Latest / Beyond The Horizon / Mega Edition: Chad Daybell Trial (Part 25) (10/24/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're heading back out to Idaho to check
- 0:06Speaker 1: in on what went down during day number 25 of
- 0:09Speaker 1: the Chad Daybell trial. And for the first time in
- 0:12Speaker 1: 25 days, there was a glimmer of hope for Chad
- 0:17Speaker 1: Daybell and for his defense team. However, that glimmer of
- 0:20Speaker 1: hope was extinguished by Judge Boyce's ruling at the end
- 0:24Speaker 1: of the proceedings. So with that in mind, why don't
- 0:27Speaker 1: we dive into this article from EastIdahoNews.com and get caught
- 0:31Speaker 1: up on what went down on day number 25 of
- 0:34Speaker 1: the Chad Daybell trial. And like I said, this article
- 0:37Speaker 1: was published by EastIdahoNews.com. The author of this article is
- 0:42Speaker 1: Nate Eaton. 8.20 a.m. It's day 25 of the Chad
- 0:47Speaker 1: Daybell trial, and the prosecution will call retired FBI agent
- 0:50Speaker 1: Doug Hart as its final case in chief witness. Judge
- 0:54Speaker 1: Stephen Boyce has said that it will be a short
- 0:56Speaker 1: day today. John Pryor, Daybell's attorney, likely won't start his
- 1:00Speaker 1: defense case until tomorrow or Monday. 8.29 a.m. Four jurors
- 1:05Speaker 1: who served in the Lori Vallow trial are in the
- 1:07Speaker 1: courtroom today. Larry Woodcock is also here, and there are
- 1:11Speaker 1: around 30 to 40 people in the gallery. Chad's seated
- 1:14Speaker 1: next to his attorney, John Pryor, and prosecutors are at
- 1:17Speaker 1: their table. 8.33 a.m. Jurors are in their seats, and
- 1:20Speaker 1: Fremont County Prosecuting Attorney, Lindsay Blake, calls Doug Hart to testify.
- 1:25Speaker 1: He walks into the courtroom and he's sworn in. 8.36 a.m.
- 1:30Speaker 1: Hart retired from the FBI and currently works for the
- 1:32Speaker 1: Canyon County Sheriff's Office. When he was with the FBI,
- 1:36Speaker 1: Hart was brought in to help with the search of
- 1:38Speaker 1: JJ and Tylee. 8.40 a.m. Several other agents became involved
- 1:43Speaker 1: in the investigation for the missing kids. Hart previously worked
- 1:47Speaker 1: on Native American reservations and identified clandestine gravesites. Hart was
- 1:52Speaker 1: present when JJ and Tylee were found. Blake moves to
- 1:56Speaker 1: admit and exhibit. 8.43 a.m. Blake shows a photo and
- 2:00Speaker 1: Hart describes it as JJ's burial site. There is consistent shrubbery,
- 2:04Speaker 1: plant growth, but the middle of the photo, there is
- 2:07Speaker 1: a rectangular area that is a different color and length. 8.45 a.m.
- 2:13Speaker 1: Blake shows more photos of the ground above where JJ
- 2:16Speaker 1: was found. Investigators used probing sticks on the property. and
- 2:20Speaker 1: the first layer of sod in the area was removed.
- 2:23Speaker 1: That's where they uncovered four rocks lined up in a row.
- 2:27Speaker 1: Under the rocks, investigators found wooden planks. Beneath the wood
- 2:31Speaker 1: was JJ's body. 8.47 a.m. On the night of June 9th,
- 2:35Speaker 1: Hart and another agent went to speak with Chad's children.
- 2:38Speaker 1: The agents explained they wanted to talk with them about
- 2:41Speaker 1: some things and asked if the kids would meet with them. Initially,
- 2:44Speaker 1: the children agreed to meet, but the next day, they
- 2:46Speaker 1: said they wouldn't meet after they spoke to their dad. Well,
- 2:49Speaker 1: that's a shock, huh? And I have no idea how
- 2:52Speaker 1: if you're this man's children and you have seen the
- 2:54Speaker 1: evidence that's been presented, how in the hell can you
- 2:57Speaker 1: say to yourself, all right, well, my dad's innocent, obviously,
- 3:00Speaker 1: and I have to have his back, especially considering the
- 3:03Speaker 1: abundance of evidence we have pointing in a different direction. 8.48 a.m.
- 3:08Speaker 1: Hart spent over 100 hours viewing the Lolly Time and
- 3:11Speaker 1: Lori for Style iCloud accounts. Both belong to Lori. It's
- 3:15Speaker 1: a tremendous amount of information. Tens of thousands of text messages,
- 3:19Speaker 1: multimedia messages, voicemails, thousands upon thousands of photographs, videos, emails,
- 3:25Speaker 1: everything you would find on a modern smartphone. 8.52 a.m.
- 3:29Speaker 1: There is an evidentiary ruling the court needs to take
- 3:32Speaker 1: up outside the presence of the jury. Jurors are being excused. 8.54 a.m.
- 3:38Speaker 1: Blake says the exhibit is part of the iCloud account
- 3:41Speaker 1: that have already been admitted by stipulation. Pryor is aware
- 3:45Speaker 1: but worries that the contents may have been altered. Boyce
- 3:48Speaker 1: says he's going to allow the exhibit, but Pryor can
- 3:50Speaker 1: object if he has a problem during the presentation. 9am.
- 3:55Speaker 1: Jurors are brought back in. The first slide shows a
- 3:57Speaker 1: text message from Lori to Alex on March 20th, 2019.
- 4:02Speaker 1: I'm finding out some great stuff about you. I'm gonna
- 4:04Speaker 1: do some ceilings. Can't wait to share all the things
- 4:07Speaker 1: I learned about you. Wow. You're gonna like it. It
- 4:10Speaker 1: explains a lot. Alex responds, okay, hurry up, please. Lori responds,
- 4:15Speaker 1: going to check everything with my source tonight to make
- 4:18Speaker 1: sure I got this all right, but it's really good.
- 4:21Speaker 1: We can talk about it tomorrow, hopefully, 9.01 a.m. Hart
- 4:24Speaker 1: noticed that Lori had to check everything with her source.
- 4:27Speaker 1: The next slide shows Chad to Lori on July 18th.
- 4:31Speaker 1: I have been instructed to focus my efforts on Hillary,
- 4:33Speaker 1: so I will. Lori to Chad, okay, find out her
- 4:36Speaker 1: percentage from me and JJ's. Chad to Lori, she is
- 4:40Speaker 1: at a. 13. I turned up the pain to 10
- 4:43Speaker 1: and placed a spiritual virus in her. He is at 99.99.
- 4:48Speaker 1: Raphael visited him and told him to follow Amy into
- 4:51Speaker 1: the light. I also assured him that James would love
- 4:54Speaker 1: and take care of his mommy, which he will do
- 4:57Speaker 1: with all of his heart and soul, Lori says. That
- 4:59Speaker 1: is sweet. I miss you desperately. 9.04 a.m. Hillary was
- 5:03Speaker 1: a reference to Tylee. Raphael was a name for himself.
- 5:06Speaker 1: Hart could never determine who Amy was. He noted that
- 5:09Speaker 1: Chad said he had instructed to focus his efforts on
- 5:12Speaker 1: Tylee Ryan. Lori asked Chad to find out the death
- 5:16Speaker 1: percentage of Tylee and JJ. Hart says this is the
- 5:19Speaker 1: first in a series of texts over three weeks between
- 5:22Speaker 1: Lori and Chad where they discuss death percentages of Tylee, JJ,
- 5:26Speaker 1: and Tammy. Yeah, but it's all a coincidence, right? Two
- 5:30Speaker 1: little kids and a relatively healthy woman just dropped dead
- 5:34Speaker 1: and all of this other stuff that was going on
- 5:36Speaker 1: between Chad and Lori and Alex Cox. Ah, just a coincidence, folks.
- 5:39Speaker 1: Nothing to see here. 9.10 a.m. Hart says this is
- 5:44Speaker 1: the first time in messages that he saw references to
- 5:46Speaker 1: death percentages, but there are several that follow in the
- 5:50Speaker 1: next three weeks. Later on, there are conversations regarding Tammy. 9.11 a.m.
- 5:55Speaker 1: That same day, Chad texts Lori, you are so adorable, beautiful, wonderful, heavenly, luscious,
- 6:01Speaker 1: and angelic. Luscious and angelic, huh? So many divine attributes
- 6:07Speaker 1: rolled into one dynamic, desirable package. I want you even
- 6:11Speaker 1: more desperately than you want me. Chad to Lori, just
- 6:14Speaker 1: grab me by the storm and I will follow you
- 6:16Speaker 1: to the ends of the universe. And remember the storm
- 6:19Speaker 1: for these two morons, Mr. Stunad and Scafusa over here.
- 6:24Speaker 1: When they say storm, they're referring to Chad Daybell's private parts.
- 6:28Speaker 1: So if you are looking for a little bit of
- 6:30Speaker 1: nausea to go with your breakfast this morning, there it is.
- 6:33Speaker 1: Lori to Chad, when might that be? Chad responds Wednesday
- 6:37Speaker 1: evening and then repeatedly and gloriously until Friday. Blake asks,
- 6:41Speaker 1: what is the storm in reference to? Hart says, that's
- 6:44Speaker 1: Chad Daybell's penis. 9.13 a.m. Tammy Daybell was still alive
- 6:48Speaker 1: during this time. The next slide shows the messages continue.
- 6:52Speaker 1: Lori to Chad. And then what? Back to crying and
- 6:55Speaker 1: saying goodbye. Back to the box. Chad to Lori. This
- 6:59Speaker 1: trip to Utah had a lot of finality to it.
- 7:02Speaker 1: I was told extreme changes are coming for me and
- 7:04Speaker 1: to Utah. I welcome them both. 9.15 a.m. Hart says
- 7:09Speaker 1: Lori repeatedly went to Chad for guidance and answers. These
- 7:13Speaker 1: messages were one week following Charles Vallow's death. 9.17 a.m.
- 7:18Speaker 1: Blake asks Hart what Chad meant by extreme changes in
- 7:21Speaker 1: the text messages. Within three months of that date, Tylee, JJ,
- 7:25Speaker 1: and Tammy are all dead. Well, we all know what
- 7:27Speaker 1: he meant. That's what he meant by extreme changes. And
- 7:30Speaker 1: they don't get more extreme than murdering two children and
- 7:34Speaker 1: your wife. 9.18 a.m. On July 20th, Lori texted Chad,
- 7:39Speaker 1: what's Blake's percentage? He drew three crosses on the wall
- 7:43Speaker 1: in his bedroom. We just finished painting over them like
- 7:46Speaker 1: he was marking it for the dark side to find them.
- 7:49Speaker 1: Chad responds, Blake is at seven. I took my sword
- 7:51Speaker 1: of light and sliced his aura vertically in several places.
- 7:54Speaker 1: You should be able now to rip and burn it.
- 7:57Speaker 1: I also decreased his pain tolerance to 1% and greatly
- 8:00Speaker 1: increased his pain. His desire to depart is at 80%.
- 8:04Speaker 1: Blake was three to four years old at the time
- 8:07Speaker 1: and is Melanie Boudreau's son. She is Lori's niece, and
- 8:10Speaker 1: now Melanie Pawlowski. Yeah, that's not terrifying or anything. Mr.
- 8:14Speaker 1: Witch Doctor over here, Chad Daybell, talking about your son
- 8:18Speaker 1: is dark, and he's taking his sword, and he's slicing
- 8:21Speaker 1: his aura. Really, bro? Anyone that believes this shit deserves
- 8:25Speaker 1: to get smacked directly in the face with a brick. 9.20 a.m.
- 8:30Speaker 1: This is a conversation about a child, Hart notes, and
- 8:33Speaker 1: Chad talked about greatly increasing his pain. The other message
- 8:36Speaker 1: referred to Chad turning up Tylee's pain. The next slide
- 8:39Speaker 1: is from July 23rd. Lori to Chad. Good morning. Missing you.
- 8:43Speaker 1: Didn't sleep much. Need you to check JJ. Weird stuff
- 8:46Speaker 1: happened in the middle of the night. It's like they
- 8:48Speaker 1: distracted us with Blake. When you get home, check Tylee.
- 8:52Speaker 1: She is being super sweet and helpful, and she cleaned
- 8:54Speaker 1: her room. See if she got switched. Totally not her.
- 8:57Speaker 1: Chad to Lori, yes, she was switched. Please let me
- 9:00Speaker 1: know when you can talk and I will explain it.
- 9:03Speaker 1: And as vile as Lori Vallow is and was, this
- 9:06Speaker 1: dude's just as bad. Anyone who doesn't think that he
- 9:09Speaker 1: was out here dog walking Lori Vallow is not really
- 9:13Speaker 1: capable of processing the information that they're given. Because this
- 9:17Speaker 1: was a two-way street. Both of them were playing on
- 9:20Speaker 1: each other. 9.24 a.m. There's an 11-hour gap of time
- 9:26Speaker 1: between Lori asking Chad to check JJ and asking him
- 9:29Speaker 1: to check Tylee. Chad then responds two hours later. Chad
- 9:33Speaker 1: Daybell is the one who will explain to Lori Vallow.
- 9:36Speaker 1: Lori Vallow is making inquiries to Chad Daybell, and Chad
- 9:39Speaker 1: Daybell tells her, I will explain it, Hart says. 9.25 a.m.
- 9:44Speaker 1: On July 26, 2019, Chad texted Lori, How are things
- 9:48Speaker 1: at home? Lori responds, She's fine. Need you to check JJ.
- 9:52Speaker 1: She said he was calm. And he watched movies all day,
- 9:56Speaker 1: which he would never do. Missing you. Most of these
- 9:59Speaker 1: messages have lips, kiss, fire emojis. I mean, what are
- 10:02Speaker 1: you guys, 12? The fire emojis and the rest of it. Like,
- 10:06Speaker 1: for real, for real? Here's an idea. Instead of sexting
- 10:09Speaker 1: with each other, how about you take care of your families,
- 10:11Speaker 1: you miserable pricks? 9.27 a.m. The next slide shows text
- 10:16Speaker 1: from the same day. Chad to Lori, missing you too.
- 10:19Speaker 1: It is still JJ. I'm told she is lying about
- 10:22Speaker 1: him being calm and watching movies. Lori to Chad. Mel knew.
- 10:26Speaker 1: She called me. She felt the real Brighton last night
- 10:29Speaker 1: and knew she was different. She was told I didn't
- 10:32Speaker 1: want to tell her. She is taking it well and
- 10:34Speaker 1: knowing it is part of the big plan. She's amazing,
- 10:37Speaker 1: although I'm pretty upset over it. I love you, trying
- 10:40Speaker 1: to hang in there, missing your kisses. 9.29am. Brighton is
- 10:44Speaker 1: another one of Melanie Boudreau's sons. Mel refers to Melanie. 9.30am.
- 10:50Speaker 1: The next slide is from July 29th. Chad to Lori.
- 10:53Speaker 1: One question. Do you want me to cause pain yet
- 10:55Speaker 1: to those two threes you're riding with? Lori to Chad.
- 10:58Speaker 1: Probably hold off on them till we arrive. They will
- 11:01Speaker 1: be a mistake to deal with, but I'll text you
- 11:03Speaker 1: if they start acting up and we can zap them. Miserable,
- 11:06Speaker 1: not mistake. Chad to Lori. Sounds great. Yes, if they
- 11:10Speaker 1: are going to act up, well, at least give them
- 11:12Speaker 1: a reason to scream. I love, cherish, treasure, and adore you.
- 11:16Speaker 1: The wonderful memories just keep coming back. You are mesmerizing.
- 11:20Speaker 1: Raphael is one lucky guy. 9.33am. On July 30th, Chad
- 11:25Speaker 1: texts Lori. I got the inspiration to go back to
- 11:28Speaker 1: my original death percentages that helped us track Charles, Ned, etc.
- 11:32Speaker 1: Tammy is very close. Her percentage has fallen steadily since
- 11:35Speaker 1: Hippos left. It is encouraging. Lori to Chad. What's the
- 11:39Speaker 1: percentage now? What about JJ's too? Chad to Lori. Tammy
- 11:43Speaker 1: is at a 3. JJ is at a 2. Both
- 11:46Speaker 1: are being heavily shielded to stop intruders. 9.34 a.m. Hart
- 11:51Speaker 1: says this is the first time we see the full phrase,
- 11:53Speaker 1: death percentages, and that they are Chad's, he says, my
- 11:57Speaker 1: original death percentages. And that lights the whole entire Pryor
- 12:01Speaker 1: defense on fire, basically, right? Pryor has tried to tell
- 12:05Speaker 1: us that Chad Daybell had nothing to do with this, really,
- 12:08Speaker 1: and that he was just somebody along for the ride,
- 12:10Speaker 1: and that this was all Lori Vallow's doing. And while
- 12:13Speaker 1: he's not wrong that Lori Vallow's a disgusting beast, what
- 12:16Speaker 1: he is wrong about is that his client had nothing
- 12:18Speaker 1: to do with this. And I think, so far, that's
- 12:20Speaker 1: what the evidence has shown us. 9.37 a.m. The next
- 12:24Speaker 1: slide starts with Lori to Chad. Two and three percent,
- 12:27Speaker 1: not zero. Chad to Lori. I will explain when we talk.
- 12:31Speaker 1: Lori to Chad. Okay, still feeling hot for you. 9.41 a.m.
- 12:36Speaker 1: The message from Chad to Lori shows he is the
- 12:38Speaker 1: source of what is happening. Hart says. Next slide. If
- 12:41Speaker 1: a text from Chad to Lori, yes, we might need
- 12:44Speaker 1: to release a little steam when we talk. Anyway, this
- 12:47Speaker 1: is the chart that checks what percentage mortals are still
- 12:50Speaker 1: in their body. It worked for my friend's wife who died,
- 12:53Speaker 1: my neighbor, George Bush, Stan Lee, etc. I kind of
- 12:57Speaker 1: forgot about it because we were dealing with zombies and
- 13:00Speaker 1: demonic entities. But this afternoon, Tammy said she felt lightheaded
- 13:04Speaker 1: as if her body and spirit weren't connected. Chad follows
- 13:07Speaker 1: up seven minutes later. I will update the list and
- 13:10Speaker 1: figure out Brandon, Adam, and others. 9.44 a.m. Hart can
- 13:14Speaker 1: never find the actual percentage chart. 9.45 a.m. The next
- 13:18Speaker 1: slide shows a photo of Chad standing by a picture
- 13:21Speaker 1: of Jesus Christ hanging on a wall in an old
- 13:24Speaker 1: LDS church. Alex sent it to Lori with caption, Look
- 13:28Speaker 1: at the bubbies. There is also a photo of Alex
- 13:30Speaker 1: standing by the same picture of Jesus Christ. Chad texted
- 13:34Speaker 1: Lori the image with the caption, Two exalted beings. 9.48 a.m.
- 13:39Speaker 1: These photos were taken on August 7th, 2019. Tammy Daybell
- 13:43Speaker 1: was still alive. The next screen shows messages from August 7th.
- 13:47Speaker 1: Lori to Chad, I love you. Taking Braxy home now.
- 13:51Speaker 1: I'll check on her. She's asleep. She put a bunch
- 13:53Speaker 1: of holes in the wall and door. Definitely had demons
- 13:56Speaker 1: helping her. Probably 1,000. Mel wants us to come up
- 14:00Speaker 1: there tomorrow, but I said next Thursday to Sunday. What
- 14:03Speaker 1: do you think? We are both tired. So taking care
- 14:06Speaker 1: of demons, we were weary. Please ask the Lord to
- 14:09Speaker 1: take them. 9.50 a.m. On August 10th, Lori texts Chad
- 14:13Speaker 1: at 1.18 a.m. Please check JJ. He just woke up
- 14:17Speaker 1: saying crazy stuff and won't go back to sleep. He's
- 14:19Speaker 1: talking to Blake. It's weird. Chad responded at 7.24 a.m.
- 14:24Speaker 1: JJ is still JJ. I'm told his spirit recognizes Blake
- 14:28Speaker 1: is evil and is unsettled by him. An hour later,
- 14:31Speaker 1: Chad texts, Hi, my love. How is JJ now? Lori responds,
- 14:34Speaker 1: He's better. He was just up talking nonsense for like
- 14:37Speaker 1: two hours later at night. I'm sure they were bugging him.
- 14:41Speaker 1: Is he at zero yet? I miss you. 9.53 a.m.
- 14:44Speaker 1: Charles had been dead for a month. When these messages
- 14:47Speaker 1: were exchanged, he had been a big help in caring
- 14:50Speaker 1: for JJ, Hart says. Chad responds to Lori, yes, he's
- 14:53Speaker 1: at zero. He probably was partly through the veil, talking
- 14:57Speaker 1: to people both light and dark, Lori responds. Maybe he
- 15:00Speaker 1: was talking to the real Blake. Chad says, yes, that
- 15:03Speaker 1: was the real Blake. 9.55 a.m. Again, Blake is Milani
- 15:07Speaker 1: Boudreaux's child. Text continue, Lori to Chad. Do you think
- 15:10Speaker 1: there is a perfectly orchestrated plan to take the children,
- 15:14Speaker 1: and we just have to wait for it to be
- 15:15Speaker 1: carried out? I feel lost. Like, I should be doing
- 15:18Speaker 1: something to help. Chad to Lori. There is a plan
- 15:21Speaker 1: being orchestrated for the children. I was shown last night
- 15:24Speaker 1: how it fit together, but it has been taken from
- 15:27Speaker 1: my mind, of course. Oh, of course it has been. 9.56 a.m.
- 15:31Speaker 1: Blake asks where Tylee and JJ's remainings. were ultimately located,
- 15:35Speaker 1: Hart says on Chad Daybell's property. 9.58 a.m. Laurie to Chad,
- 15:41Speaker 1: what should I be doing? Chad to Laurie, you were
- 15:43Speaker 1: doing everything right, my love. The Lord told me she
- 15:46Speaker 1: is right on track. He said to just keep resolving
- 15:49Speaker 1: the telestial issues so you were unencumbered and fully free.
- 15:52Speaker 1: That actually feels good that JJ was talking to the
- 15:55Speaker 1: real Blake, getting close. When I was sitting across from him,
- 15:58Speaker 1: eating bacon, I sensed he was barely attached to his body.
- 16:01Speaker 1: 10 a.m. The text continue. Chad to Lori. You're so
- 16:06Speaker 1: incredible in many ways, your mission has barely begun. Lori
- 16:09Speaker 1: to Chad. As long as it ends with you, it's
- 16:12Speaker 1: all good. Chad to Lori. Yes, check to check, loin
- 16:15Speaker 1: to loin. Lori to Chad. I wish I could be
- 16:18Speaker 1: with you cheek to cheek. Chad to Lori. It is
- 16:20Speaker 1: very far away, my love. I seriously cannot stop crying.
- 16:24Speaker 1: I was allowed to feel my own emotions. I will
- 16:26Speaker 1: experience as you sing them to me, and the love, admiration,
- 16:30Speaker 1: and reverence I have for you are indescribable. Everything we
- 16:33Speaker 1: do together is going to be spectacular. Lori to Chad.
- 16:37Speaker 1: I cannot wait. I have no patience. I want you now.
- 16:40Speaker 1: Chad to Lori. I'm certainly your biggest fan. I love you. Lily.
- 16:44Speaker 1: Hold on, my sweet angel. We're so close to the
- 16:47Speaker 1: finish line. Lori to Chad. I'm trying. Chad to Lori.
- 16:50Speaker 1: We'll make it. 10.05 a.m. Hart says the finish line
- 16:54Speaker 1: was the plan that they had without Charles, Tammy, JJ,
- 16:58Speaker 1: and Tylee. Yeah, that sounds about right, huh? And not
- 17:01Speaker 1: only did they plan this. According to the evidence that
- 17:04Speaker 1: we've seen so far, they carried it out. All right, folks,
- 17:08Speaker 1: we're going to wrap up right here. And in the
- 17:09Speaker 1: next episode, we're going to pick up where we left off.
- 17:12Speaker 1: All of the information that goes with this episode can
- 17:15Speaker 1: be found in the description box. What's up, everyone, and
- 17:18Speaker 1: welcome back to the program. In this episode, we're getting
- 17:21Speaker 1: right back to the Chad Daybell trial, and we're going
- 17:23Speaker 1: to pick up where we left off. This article was
- 17:26Speaker 1: authored by Nate Eaton, and it was published by East
- 17:29Speaker 1: Idaho News. 1030 a.m. Back in the courtroom, Blake continues
- 17:34Speaker 1: to show slideshows with text messages. On September 3rd, Alex
- 17:38Speaker 1: texted Lori, Wi-Fi is on. What you doing? Lori says,
- 17:42Speaker 1: working on Zs. What did you decide on a username
- 17:44Speaker 1: and a password? Alex to Lori, network name is Auntie Layman.
- 17:49Speaker 1: PW is too many kids. Lori responds, funny. Oh yeah,
- 17:53Speaker 1: real funny. Real funny to talk about your kids like that.
- 17:56Speaker 1: And then the kids end up going missing and getting killed? Yeah,
- 17:59Speaker 1: nobody's gonna look at you, Lori Vallow, and that's not
- 18:01Speaker 1: gonna come up at your trial or anything. Talk about
- 18:05Speaker 1: an absolute moron. The whole lot of these people, from
- 18:08Speaker 1: Zulema Pastanis to Melanie to Chad Daybell to Lori Vallow,
- 18:13Speaker 1: they're all gross in my opinion. 10.32 a.m. Tylee Ryan's
- 18:18Speaker 1: last known sighting was a few days later, September 8th.
- 18:21Speaker 1: Alex continues to Lori... and I can change it to
- 18:24Speaker 1: whatever you want if you want to change it. I'm
- 18:26Speaker 1: proud of you. No more Zs. Lori responds, we're trying
- 18:30Speaker 1: to get to the bottom of what we need to
- 18:32Speaker 1: do to eliminate them completely. I'm sure you will be
- 18:35Speaker 1: told also. Alex says, excellent. 10.34am. Hart says these texts
- 18:40Speaker 1: help explain Alex's role in the relationship with Chad and Lori.
- 18:44Speaker 1: Alex was not included in the messages regarding death percentages,
- 18:48Speaker 1: Hart says, and that's because he was a henchman. That's
- 18:51Speaker 1: all Alex Cox was, just another tool to be moved
- 18:54Speaker 1: around on the board for Lori Vallow and Chad Daybell.
- 18:57Speaker 1: Does that make him any less responsible, or any less
- 19:00Speaker 1: of a jerk-off? Of course not. But there's no doubt
- 19:02Speaker 1: that he was being dog-walked. 10.36am. In the video section
- 19:07Speaker 1: on the Lori for Style iCloud, the last known video
- 19:10Speaker 1: of Tylee was taken on September 8th, 2019, at 2.49pm.
- 19:15Speaker 1: She is holding JJ while they stand next to Alex
- 19:17Speaker 1: at Yellowstone National Park. It was taken 5 days. after
- 19:21Speaker 1: the messages about eliminating zombies completely. 10.38 a.m. The next
- 19:25Speaker 1: slide shows the last known video of J.J. Vallow. It
- 19:28Speaker 1: was on September 22nd at 10.46 a.m. He is sitting
- 19:32Speaker 1: on the couch in an apartment wearing red pajamas, playing
- 19:35Speaker 1: with a cup. Blake plays the short clip. 10.39 a.m.
- 19:40Speaker 1: The next slide is a text from Sidney Woodbury, the
- 19:43Speaker 1: babysitter to Lori on September 24th. Hi, Lolo. Are we
- 19:47Speaker 1: still good for me coming today? Lori responds, hi, Sydney.
- 19:50Speaker 1: I hope the wedding was good. So JJ's grandparents came
- 19:53Speaker 1: this weekend and they took him for a few weeks
- 19:55Speaker 1: to give me a break. So we won't be back
- 19:57Speaker 1: until probably the end of October. I wish I had
- 20:00Speaker 1: other work for you to do. You are such a
- 20:02Speaker 1: darling girl. I understand if you need to get another job.
- 20:05Speaker 1: Lori sent another follow up message. Of course. I'm not
- 20:09Speaker 1: sure when he will be back, but I'm going to
- 20:11Speaker 1: do some traveling while he's gone. Probably see my friends
- 20:14Speaker 1: in Hawaii, but I'll let you know for sure when
- 20:17Speaker 1: we are both back in Rexburg. You are great. 1041 AM.
- 20:21Speaker 1: The next slide shows a message from Chad to Lori
- 20:23Speaker 1: on October 3rd. Good night, Angel Lily. So excited to
- 20:26Speaker 1: go on our date. Lori to Alex on October 4th.
- 20:30Speaker 1: We're supposed to go on a real date tonight, but
- 20:32Speaker 1: we are discussing it. Perhaps an evening at home would
- 20:34Speaker 1: be better, so we are not out and about. I'll
- 20:36Speaker 1: let you know, but you could come and sing with
- 20:38Speaker 1: us after your shower. Chad DeLore on October 5th. Hello,
- 20:42Speaker 1: sweet angel. Big news about Tammy. Please let me know
- 20:45Speaker 1: if you are awake and I can talk to you.
- 20:47Speaker 1: I love you. This was during the time frame Chad
- 20:50Speaker 1: encouraged Tammy to go to Utah to see her family. 10.45 a.m.
- 20:54Speaker 1: The next slide shows a text from Chad DeLore on
- 20:57Speaker 1: October 5th. The short version is that she has been switched,
- 21:00Speaker 1: Tammy is in limbo, and a level 3 demonic entity
- 21:03Speaker 1: named Viola is in her body. It happened at about
- 21:06Speaker 1: 10pm and was done by Tammy's sister Sam, who I
- 21:10Speaker 1: always knew was 3D, but it turns out she is
- 21:12Speaker 1: multiple creation. Viola has been attached for about a year
- 21:15Speaker 1: to my niece Danica, who is Sam's 12 year old daughter.
- 21:19Speaker 1: I have connected with Tammy in limbo and she is
- 21:21Speaker 1: very frustrated and upset. She wants Viola removed as soon
- 21:25Speaker 1: as possible. Viola seems to be similar to Penelope. The
- 21:28Speaker 1: personality differences from Tammy should be evident quickly. Please seek
- 21:32Speaker 1: a confirmation on this, but I have now checked three
- 21:35Speaker 1: times since I got home and get more affirmative answers
- 21:38Speaker 1: each time. 10.49 a.m. Chad continues, Sam is much like Brandon.
- 21:43Speaker 1: She has been my biggest enemy over the years. She
- 21:46Speaker 1: refuses to read my books and threw the biggest fit
- 21:48Speaker 1: when we moved to Idaho. She has only visited us
- 21:51Speaker 1: when the kids got married and has always fled Idaho
- 21:54Speaker 1: within hours, like she was being burned. She definitely comparable
- 21:58Speaker 1: to Brandon and Summer. Not really sure of the timing
- 22:01Speaker 1: for removal, but once her actions verify the differences, I
- 22:04Speaker 1: don't want to wait. 10.50 a.m. Four days later, the
- 22:07Speaker 1: first attempt on Tammy Daybell's life happened in her driveway.
- 22:11Speaker 1: The next slide shows text messages from October 19th, the
- 22:14Speaker 1: day Tammy died. An unknown person texts Lori at 10.33 a.m.
- 22:19Speaker 1: I'm not sure if you heard, but Chad's wife died
- 22:21Speaker 1: last night. Lori responds, oh my gosh, I did not
- 22:24Speaker 1: hear that. I'm in Hawaii and it's 6 a.m. Do
- 22:27Speaker 1: you know how it happened? The unknown person responds she
- 22:30Speaker 1: was awoke in the night coughing, threw up, collapsed, and
- 22:33Speaker 1: passed away. 10.54 a.m. Lori texts Chad at 9.52 p.m.
- 22:38Speaker 1: that day. Not fun without you. Can you call me?
- 22:42Speaker 1: Another from Lori to Chad. How are you doing is
- 22:44Speaker 1: the question. Chad responds I'm hanging in there. My parents
- 22:47Speaker 1: are staying here and we are still getting visitors but
- 22:50Speaker 1: I will call you soon. 10.55 a.m. The next slide
- 22:54Speaker 1: is from October 20th, the day after Tammy died. Chad
- 22:57Speaker 1: to Lori. Percentage in body. Holcer, 24. Cola, 11. Grisone, 14.
- 23:04Speaker 1: Chad to Lori. Great job on lowering them. I love
- 23:06Speaker 1: talking with you. Is it baby night? So come get
- 23:09Speaker 1: me later. Chad to Lori. Missing you so much. I
- 23:12Speaker 1: can feel you in my bed with me. Can't wait
- 23:14Speaker 1: to truly hold you tightly every day and every night.
- 23:17Speaker 1: Lori to Chad. I'm missing you more. I need you desperately.
- 23:20Speaker 1: I can't wait. 10.59 a.m. The next slide shows a
- 23:24Speaker 1: text from Lori to Chad on October 20th. Need you
- 23:27Speaker 1: to hold me tight. That would be great. What about
- 23:30Speaker 1: the idea of you coming here Thursday or Friday, or
- 23:33Speaker 1: do you want me to come home? Chad to Lori,
- 23:35Speaker 1: their apartment is haunted and we can't clear the place,
- 23:38Speaker 1: so they are looking to move away, and I have
- 23:41Speaker 1: the perfect place for them. I need to be here
- 23:43Speaker 1: to get sorting the financial stuff, and I truly need
- 23:46Speaker 1: your help. So please come home Thursday so we can
- 23:49Speaker 1: spend the night together. Then as soon as I have
- 23:51Speaker 1: things under control, we can return. I seriously want you
- 23:54Speaker 1: to look for a condo for us while you are
- 23:56Speaker 1: there that we could return to at the first of
- 23:59Speaker 1: the month. 11 a.m. Next slide is a text from
- 24:02Speaker 1: Chad to Lori. I want you to get going full
- 24:05Speaker 1: steam on the Lily workout plan. Tighten the abs, get
- 24:08Speaker 1: a full body tan, grow my hair out. This could
- 24:10Speaker 1: be really good for both of us. Lori to Chad,
- 24:12Speaker 1: I love that plan. It's not soon enough though. This
- 24:15Speaker 1: is torture. Maybe you need to clear my mind so
- 24:18Speaker 1: I can remember how much I love you. Chad to Lori,
- 24:20Speaker 1: I will try, but it feels like Raphael and Lily
- 24:23Speaker 1: are together about 100%. Not sure it will ever be
- 24:27Speaker 1: lower again. 11.03 a.m. The next text from Lori to
- 24:30Speaker 1: Chad on October 20th at 8.20 a.m. That's true. I
- 24:34Speaker 1: do feel you. I feel lovesick. I don't want to eat.
- 24:37Speaker 1: I just want you. It's so consuming. Chad to Lori,
- 24:40Speaker 1: I know exactly how you feel. I'm feeling sad, but
- 24:43Speaker 1: it isn't for the reason everyone thinks. 11.05 a.m. Blake
- 24:47Speaker 1: asked hard if Alex would do what Chad asked. Hart
- 24:50Speaker 1: says yes. Tammy Daybell did not know Alex. The only
- 24:53Speaker 1: connection was Chad. The next slide shows text from October 23rd, 2019.
- 24:59Speaker 1: Lori to Chad, I had a bad dream about Al.
- 25:02Speaker 1: Make sure you still him and protect him. He would
- 25:05Speaker 1: be the one they use to get us both. All
- 25:08Speaker 1: this a long time is not a good for him.
- 25:10Speaker 1: Chad to Lori, I will try to reach out to
- 25:12Speaker 1: him later today. Around 20 minutes later, Chad wrote, I
- 25:16Speaker 1: just cleared all of Al's weapons, curses, and cords, and
- 25:19Speaker 1: filled him with malachite healing balm. I also put angels
- 25:23Speaker 1: around him. Imagine really running around talking like this and
- 25:27Speaker 1: acting like you're some kind of prophet. What an absolute
- 25:31Speaker 1: fucking clown. 11.09 a.m. Blake is nothing further. Pryor will
- 25:37Speaker 1: now cross-examine. 11.10 a.m. Pryor asks if it would be
- 25:41Speaker 1: fair to say that you would look at a new
- 25:43Speaker 1: husband if children are missing. Hart says yes, but you
- 25:46Speaker 1: can't put blinders on and have to keep an open mind.
- 25:48Speaker 1: 11-12 a.m. Pryor asks if the FBI ever uses a
- 25:53Speaker 1: medium to try to locate or talk to children who
- 25:55Speaker 1: have passed on. Hart says it's extremely common for mediums
- 25:59Speaker 1: to come forward during investigations, but the FBI does not
- 26:02Speaker 1: employ mediums. Pryor asks about a person named Allison Dubois.
- 26:07Speaker 1: Hart says she's a spiritual medium, but he doesn't know
- 26:09Speaker 1: what specific ability she has. Pryor asks if a medium
- 26:13Speaker 1: has ever been utilized to get information about missing children.
- 26:16Speaker 1: Hart has never spoken with Alison Dubois and has never
- 26:20Speaker 1: requested her services. Many times these people come forward offering
- 26:24Speaker 1: their services and offering what they claim to have seen.
- 26:27Speaker 1: Oh yeah, psychics and mediums and all that bullshit is
- 26:30Speaker 1: exactly that, bullshit. Carnival barkers and grifters. Okay, nobody's going
- 26:34Speaker 1: to tell you the future. If they knew the future,
- 26:37Speaker 1: wouldn't they be out here playing the lottery? 11.15 a.m.
- 26:41Speaker 1: Pryor asks if Hart if Chad was having spiritual gifts
- 26:43Speaker 1: is unusual. Hart says he doesn't believe it's common. Pryor
- 26:47Speaker 1: asks about a breakup between Lori and Chad, and he
- 26:50Speaker 1: moves to admit an exhibit containing four text messages from
- 26:53Speaker 1: Lori and Chad from August 11, 2019. 11.18 a.m. Pryor
- 26:59Speaker 1: shows a text from Chad to Lori on August 11, 2019,
- 27:02Speaker 1: but the next two days will be torture. Thankfully, I
- 27:05Speaker 1: will be alone more of Wednesday and beyond. Lori to Chad.
- 27:09Speaker 1: Is that what he wants? For me to sit around
- 27:11Speaker 1: waiting for you endlessly? And you miserably wasting time? It
- 27:14Speaker 1: just doesn't feel right. Chad to Lori. I agree. It
- 27:18Speaker 1: feels so drawn out. 1121 AM. Prior asked if this
- 27:22Speaker 1: is an example of Lori manipulating Chad. Hart says absolutely.
- 27:26Speaker 1: They both manipulated each other. Yes, 1000%. This is a
- 27:31Speaker 1: two-way street. I've said that from the beginning. And after
- 27:34Speaker 1: seeing this avalanche of evidence against Chad Daybell, I'm more
- 27:37Speaker 1: sure than ever. 11.22 a.m. Chad to Lori. I'm just
- 27:42Speaker 1: so frustrated. I'm sorry, honey. Lori to Chad. You can't
- 27:46Speaker 1: just keep tearing my heart out. I really can't take
- 27:48Speaker 1: it anymore. I'm sorry. Chad to Lori. It is tearing
- 27:51Speaker 1: both of our hearts out. Please look beyond the next
- 27:54Speaker 1: two days. Lori to Chad. What about the past two days?
- 27:57Speaker 1: I didn't even get to talk to you on your birthday.
- 28:00Speaker 1: I'm clearly not a priority. I just don't want to
- 28:02Speaker 1: be so sad all the time and so heartbroken. 11.24 a.m.
- 28:07Speaker 1: Lori to Chad. If you really love me, you wouldn't
- 28:10Speaker 1: want that either. Chad to Lori. I could have talked,
- 28:13Speaker 1: but the girls were there. I truly love you with
- 28:15Speaker 1: all my heart. Lori to Chad. You should give all
- 28:18Speaker 1: your love and your attention to your wife and family.
- 28:20Speaker 1: I'm just a distraction. Go have fun with your family.
- 28:23Speaker 1: I really do want you to. I just can't be
- 28:25Speaker 1: in the way anymore. If things change, then we can talk,
- 28:28Speaker 1: but we have nothing until things change anyway. 11.25 a.m.
- 28:33Speaker 1: Pryor suggests this was an example of Laurie trying to
- 28:35Speaker 1: manipulate Chad. Hart agrees. Pryor has nothing further. 11.26 a.m.
- 28:41Speaker 1: Blake will now redirect. She asks about manipulation by Laurie.
- 28:45Speaker 1: Throughout your investigation, did you also find manipulation from Chad Daybell?
- 28:50Speaker 1: Hart says he did. He found throughout the entire course
- 28:52Speaker 1: of the investigation, Chad determined someone was dark, a zombie,
- 28:56Speaker 1: and dark percentages. 11.29 a.m. Blake shows a slide showing
- 29:02Speaker 1: the text where Chad indicates a plan is being orchestrated.
- 29:05Speaker 1: Blake asks where Tammy's body was located. In her bed.
- 29:09Speaker 1: She asks where JJ and Tylee were located. On the
- 29:12Speaker 1: pasture of Chad Daybell's property. Blake has nothing further. 11.31 a.m.
- 29:17Speaker 1: Blake says the state has no further witnesses. Boyce asks
- 29:20Speaker 1: if the state is resting. Blake asks for a sidebar. 11.36 a.m.
- 29:25Speaker 1: Sidebar is over. Blake says the state rests its case. 11.38 a.m.
- 29:30Speaker 1: Boyce says we will take a break and the defense
- 29:32Speaker 1: motion will be heard in 30 minutes. All right, we're
- 29:35Speaker 1: going to break here as well. And in the next episode,
- 29:37Speaker 1: we'll finish off day number 25 of the. Chad Daybell trial.
- 29:41Speaker 1: All of the information that goes with this episode can
- 29:44Speaker 1: be found in the description box. What's up, everyone, and
- 29:48Speaker 1: welcome back to the program. In this episode, we're getting
- 29:51Speaker 1: right back to the Chad Daybell trial, and we're going
- 29:54Speaker 1: to finish off day number 25. To do that, once again,
- 29:58Speaker 1: we're using an article that was published by East Idaho News,
- 30:01Speaker 1: and the author of this article is Nate Eaton. 12.09 p.m.
- 30:05Speaker 1: We're back in the courtroom. Pryor will now argue for
- 30:08Speaker 1: a directed verdict, a ruling from the judge, after determining
- 30:12Speaker 1: that there is no legally sufficient evidentiary basis for a
- 30:15Speaker 1: reasonable jury to reach different conclusion. Oh yeah, sure. Not
- 30:19Speaker 1: enough evidence here, folks. We should pack it in. I mean,
- 30:22Speaker 1: Chad Daybell's obviously innocent, right? No reasonable jury could reach
- 30:26Speaker 1: a different conclusion. Are you smoking toad venom? 12.11 p.m.
- 30:31Speaker 1: Pryor says there is no indication that Chad was present
- 30:34Speaker 1: in the murders of JJ or Tylee. Yeah, well, neither
- 30:37Speaker 1: was John Gotti. How did that work out for him?
- 30:40Speaker 1: Pryor says in regards to the conspiracy charges, there is
- 30:43Speaker 1: no indication that Chad was involved. For the fraud charge,
- 30:46Speaker 1: Pryor says, the only testimony he heard was the insurance
- 30:50Speaker 1: was raised. At this point, I don't think the state
- 30:52Speaker 1: has met its burden regarding the fraud. all the conspiracy charges,
- 30:56Speaker 1: and they have not met their burden in the murders. 12.13 p.m.
- 31:02Speaker 1: Ingrid Beatty argues that Jerry should determine the weight of
- 31:05Speaker 1: the evidence. She lists out the charges and says the
- 31:07Speaker 1: state has presented evidence on all aspects of the charges. 12.15 a.m.
- 31:13Speaker 1: Beatty lists out the evidence the state presented in relation
- 31:16Speaker 1: to each charge. She mentions the overt acts relating to
- 31:19Speaker 1: the charges. 12.17 p.m. Betty says there's ample evidence of
- 31:25Speaker 1: the murders of Tylee and JJ because the bodies were
- 31:27Speaker 1: found buried on Chad's property. 12.22 p.m. Betty mentions that
- 31:32Speaker 1: Chad told numerous people in his life that Tammy was
- 31:35Speaker 1: going to die. Chad sent text to his mistress that
- 31:38Speaker 1: he felt trapped. Lori was shopping for wedding rings before
- 31:41Speaker 1: Tammy died. Chad told conflicting stories about how Tammy had died.
- 31:46Speaker 1: Chad told conflicting stories. about Tammy died and at her funeral.
- 31:51Speaker 1: Chad said he had miraculously asked Tammy for all the
- 31:53Speaker 1: financial passwords just days before her death. 12.25 p.m. Boyce
- 31:59Speaker 1: is prepared to make a ruling, but says he has
- 32:01Speaker 1: an issue with part of the indictment. The indictment was
- 32:04Speaker 1: amended on February 20, 2024, and says J.J. Vallow was
- 32:08Speaker 1: killed September 8 or 9, 2019. Boyce says J.J. Vallow
- 32:13Speaker 1: was clearly alive on those days. And you know how
- 32:17Speaker 1: I'm always harping on the prosecution having everything locked in? Well,
- 32:21Speaker 1: this is why. This could have really thrown things out
- 32:23Speaker 1: of balance, and it could have led to a mistrial.
- 32:26Speaker 1: Or at the very least, it could have let Chad
- 32:28Speaker 1: Daybell off the hook for the murder of JJ. Can
- 32:31Speaker 1: you imagine being JJ's family and hearing that? Thankfully, that
- 32:35Speaker 1: wasn't what happened. But this is what I'm talking about
- 32:39Speaker 1: when I mean prosecutorial misconduct. And if you think that
- 32:42Speaker 1: just something clerical like this can throw things into chaos...
- 32:46Speaker 1: What do you think would happen if they don't collect
- 32:48Speaker 1: evidence correctly? Or there's no chain of custody of that evidence?
- 32:52Speaker 1: Or they're using red solo cups to collect that evidence?
- 32:55Speaker 1: How do you think that's going to work out in
- 32:56Speaker 1: front of a jury? And not only just a jury,
- 32:59Speaker 1: but the appeal board. So that's why it's so important
- 33:01Speaker 1: to have everything locked in. And that's why it's so
- 33:03Speaker 1: important for the prosecution to be on their game. Prosecutors
- 33:07Speaker 1: asked to come back Monday morning and argue. Pryor says
- 33:09Speaker 1: the state has had plenty of time to change the
- 33:11Speaker 1: indictment and they had already amended it. He doesn't think
- 33:14Speaker 1: that they should be able to amend it any further.
- 33:17Speaker 1: Loopholes and technicalities, the only tools available to the guilty.
- 33:22Speaker 1: How long have I been telling you that? All the
- 33:24Speaker 1: way back in 2020, I was telling you that. And
- 33:27Speaker 1: whenever you see somebody that's grasping for loopholes and technicalities,
- 33:31Speaker 1: it usually means they don't have the evidence to help
- 33:33Speaker 1: them out when it comes to testimony. Now, with that said,
- 33:37Speaker 1: if there is some kind of prosecutorial misconduct or a misstep,
- 33:41Speaker 1: they should be sanctioned for it. The state has way
- 33:44Speaker 1: too much power at their fingertips for them not to be. 12.31 p.m.
- 33:48Speaker 1: Boyce says there is a filed amended indictment that has
- 33:51Speaker 1: the wrong dates for J.J. Vallow's death. He is giving
- 33:54Speaker 1: the state two hours to prepare for argument. We'll be
- 33:56Speaker 1: back at 2.30 p.m. 12.45 p.m. To clarify, the date
- 34:01Speaker 1: is wrong on count four of the indictment. First degree
- 34:04Speaker 1: murder of J.J. Vallow. The death dates are for Tylee Ryan. J.J.
- 34:09Speaker 1: Vallow died September 22nd, 23rd, according to prosecutors. Larry Woodcock
- 34:14Speaker 1: is outside the courthouse crying. Many others are too, wondering
- 34:17Speaker 1: what happens now. And of course, there's always that moment
- 34:21Speaker 1: of panic, right? Well, the good news is there's remedies
- 34:25Speaker 1: for this sort of thing. And if it's an obvious
- 34:27Speaker 1: clerical error, the judge is going to rule in that direction.
- 34:31Speaker 1: And this was obviously a clerical error. 2.27 p.m. We're
- 34:35Speaker 1: back in the courtroom. Here's a look at the original
- 34:37Speaker 1: indictment and the amended indictment. Link is in the description box. 2.30 p.m.
- 34:43Speaker 1: Judge Boyce is on the bench. John Pryor is sitting
- 34:45Speaker 1: next to Chad Daybell. Prosecutors are at their table. Boyce
- 34:49Speaker 1: has prepared a ruling on everything except count four. First
- 34:52Speaker 1: degree murder for J.J. Vallow. 2.32 p.m. Boyce says on
- 34:57Speaker 1: count one, state has presented significant evidence, so Pryor's motion
- 35:01Speaker 1: is denied. 2.35 p.m. On count two, Boyce says the
- 35:05Speaker 1: state has presented significant evidence, so Pryor's motion is denied. 2.37 p.m.
- 35:11Speaker 1: On count three, Boyce says state has presented significant evidence,
- 35:15Speaker 1: so prior's motion for acquittal is denied. 2.38 p.m. On
- 35:19Speaker 1: count five, Boyce says state has presented significant evidence, so
- 35:23Speaker 1: prior's motion for acquittal is denied. 2.40 p.m. On count six,
- 35:28Speaker 1: Boyce says the state has presented significant evidence, so prior's
- 35:32Speaker 1: motion for acquittal is denied. 2.41 p.m. On final count,
- 35:37Speaker 1: Boyce says the state has presented significant evidence, so Pryor's
- 35:40Speaker 1: motion for acquittal is denied. 2.41 p.m. Ingrid Beatty will
- 35:46Speaker 1: now argue count four. She says the state has three options. One,
- 35:49Speaker 1: because count four did not fall within the scope of
- 35:52Speaker 1: the court's December 8, 2023 order to amend, the court
- 35:56Speaker 1: can simply correct it so it conforms with what count
- 35:59Speaker 1: four should be. Second, the court could accept that there
- 36:02Speaker 1: is a variance and instruct jury that there is a variance.
- 36:06Speaker 1: Beatty said the court... could also add an item in
- 36:08Speaker 1: jury instruction. Third, the court could reopen the case to
- 36:11Speaker 1: allow the state to correct the indictment and formally amend it. 2.43 p.m.
- 36:17Speaker 1: Beatty argues her first option. She says state made a
- 36:20Speaker 1: motion to amend the indictment in November of 2023 in
- 36:23Speaker 1: three ways. Modify subsection in count one and three, modify
- 36:28Speaker 1: language in counts two, three, and five, and modify language
- 36:31Speaker 1: month to months. Nowhere in state's motion did the state
- 36:35Speaker 1: ever seek leave to amend any portion of Count 4,
- 36:38Speaker 1: Beatty says. Boyce approved the motion, and it was amended.
- 36:41Speaker 1: Beatty says when the amended motion was filed, the date
- 36:44Speaker 1: of JJ's death was inadvertently changed on Count 4. 2.46 p.m.
- 36:50Speaker 1: Beatty says there was an indictment for two and a
- 36:52Speaker 1: half years that had the correct date, and all parties
- 36:54Speaker 1: were aware of it. She says it was a clerical error,
- 36:57Speaker 1: and the court should utilize Idaho rule to let jurors
- 37:00Speaker 1: know it was amended. 2.47 p.m. Beatty says the second
- 37:04Speaker 1: option is for Boyce to accept that there is a
- 37:06Speaker 1: variance with the indictment date and instruct the jury that
- 37:09Speaker 1: there is a variance. 2.50 p.m. Beatty says this is
- 37:13Speaker 1: a variance in dates while in other cases there have
- 37:16Speaker 1: been variances in years and it hasn't been a problem
- 37:19Speaker 1: in those trials. 2.51 p.m. Boyce asks Beatty about a variance.
- 37:24Speaker 1: He says a variance typically comes up when jury instructions
- 37:27Speaker 1: don't match the charging documents. What the state would be
- 37:30Speaker 1: requesting is we don't have a variance yet because the
- 37:33Speaker 1: jury hasn't been instructed on something that varies from the
- 37:36Speaker 1: charging documents. You're suggesting I permit a variance to essentially
- 37:40Speaker 1: cure the issue, Boyce says. He's not aware of any
- 37:43Speaker 1: other cases where a court proactively grants a variance. 2.53 p.m.
- 37:48Speaker 1: We are falling on our sword here. This was clearly
- 37:50Speaker 1: an oversight. We are talking about a clerical error in
- 37:53Speaker 1: a subsequent document that was not in the original document,
- 37:56Speaker 1: Beatty says. 2.56 p.m. Beatty finishes her argument, Pryor now arguing.
- 38:02Speaker 1: He says the authority to reopen a case almost exclusively
- 38:05Speaker 1: applies to evidence, not amending a complaint. He says he
- 38:09Speaker 1: didn't object to the original motion to amend it. From
- 38:12Speaker 1: that time forward, that's the information I relied on. Any
- 38:15Speaker 1: change after the state has rested is going to create
- 38:17Speaker 1: a substantial due process argument for Mr. Daybell. 2.57 p.m.
- 38:22Speaker 1: Pryor cites a rule that says the court can allow
- 38:25Speaker 1: an amendment before the state rests, but not after. Pryor
- 38:28Speaker 1: says the state doesn't have any right to ask for
- 38:31Speaker 1: a variance or amendment at this point in the trial.
- 38:34Speaker 1: They have to make any amendment and correction prior to
- 38:37Speaker 1: arresting their case, Pryor says. He says four lawyers have
- 38:40Speaker 1: had over a year to analyze this, and after they
- 38:43Speaker 1: arrest their case, the court corrected it. Pryor says he
- 38:45Speaker 1: wasn't going to tip the court off that there was
- 38:48Speaker 1: a problem. 3 p.m. Pryor asks Boyce to dismiss the charge. 3.01 p.m.
- 38:53Speaker 1: Pryor says Idaho Rule 7 says prosecutors cannot change the
- 38:57Speaker 1: indictment After they rest, they don't get to amend. Regardless,
- 39:01Speaker 1: they don't get to amend. It's a very specific rule
- 39:04Speaker 1: that references this very issue, Pryor says. Beatty responds by
- 39:08Speaker 1: saying there is a process for making amendments. We're asking
- 39:11Speaker 1: the court to correct what is clearly a clerical mistake,
- 39:14Speaker 1: she says. 3.02 p.m. Boyce asked Beatty to clarify about
- 39:18Speaker 1: how the issue happened. It was when the amendments were
- 39:21Speaker 1: approved on the other counts and the date on count
- 39:23Speaker 1: four somehow got changed. She says it was a clerical error.
- 39:27Speaker 1: Pryor says the jurors were read this indictment. It was
- 39:30Speaker 1: published and the mistake hasn't been caught until now. They
- 39:33Speaker 1: should not be allowed to change it. Boyce says he
- 39:35Speaker 1: needs to take a recess before he rules. 3.37 p.m.
- 39:39Speaker 1: Back in the courtroom. Attorneys are at their tables and
- 39:42Speaker 1: Judge Boyce is on the bench. 3.38 p.m. Boyce says
- 39:46Speaker 1: he's ready to rule. 3.39 p.m. Boyce says he has
- 39:50Speaker 1: considered the arguments of state and defense. He notes the
- 39:53Speaker 1: initial indictment and the right date for two and a
- 39:55Speaker 1: half years. In November, the state asked to amend the indictment,
- 39:59Speaker 1: Burbage and Counts 1, 3, and 5. Boyce issued an
- 40:03Speaker 1: order on December 8th granting permission to amend the indictment.
- 40:06Speaker 1: Count No. 4 was not one of the changes that
- 40:09Speaker 1: had been approved. The amended indictment was filed and had
- 40:12Speaker 1: an alteration. 3.40 p.m. State argued it's a clerical error.
- 40:16Speaker 1: Boyce says looking at the history, the court did not
- 40:18Speaker 1: authorize any amendment to count four. Count four should not
- 40:22Speaker 1: have been amended. The dates put into count four mirror
- 40:25Speaker 1: the dates of count two, which is alleged murder of
- 40:27Speaker 1: Tylee Ryan. Looking at that history, the court does believe
- 40:31Speaker 1: it was a clerical error that led to the change
- 40:33Speaker 1: of those dates, Boyce says. 3.41 p.m. Boyce says the
- 40:38Speaker 1: defendant was on notice for several years that the allegation
- 40:41Speaker 1: of JJ's murder occurred between September 22nd and 23rd. Boyce
- 40:46Speaker 1: says the evidence all pointed to the dates of September
- 40:49Speaker 1: 22nd and 23rd, and the same allegation was made in
- 40:53Speaker 1: Lori Vallow's case last year. The defense was aware at
- 40:56Speaker 1: the time. There's certainly no surprise when it comes to
- 40:58Speaker 1: the defense, knowing the dates that have been alleged are
- 41:02Speaker 1: the 22nd and the 23rd, Boyce says. 3.43 p.m. Boyce
- 41:08Speaker 1: finds that there has been sufficient evidence in the elements
- 41:10Speaker 1: alleged in count four. He denies the motion for acquittal.
- 41:14Speaker 1: As for the dates, because count four was changed without permission,
- 41:17Speaker 1: he finds it was an inadvertent mistake. While these jurors
- 41:20Speaker 1: have already heard the information contained in the amended indictment,
- 41:24Speaker 1: the court believes the jurors can be fairly and properly instructed. 3.45 p.m.
- 41:30Speaker 1: Boyce says he raised the issue, not the defense. Boyce
- 41:33Speaker 1: says he needs additional time as to how to exactly
- 41:36Speaker 1: fix the date problem, but he denies Pryor's request to
- 41:39Speaker 1: dismiss the charge. We will be in recess till Monday morning. Alright,
- 41:44Speaker 1: so there was a little bit of drama there at
- 41:45Speaker 1: the end, huh? Thankfully, things worked out and went the
- 41:49Speaker 1: way of justice. Because there's no doubt that the evidence
- 41:52Speaker 1: points to Chad Daybell. There's no doubt that he's not
- 41:56Speaker 1: getting railroaded here. And there's certainly no doubt, at least
- 41:59Speaker 1: in my mind, that the punishment he receives should be
- 42:02Speaker 1: the most harsh punishment the state has in its repertoire.
- 42:05Speaker 1: So we'll have to see what sort of defense... Chad
- 42:08Speaker 1: Daybell musters up here, but I think that the prosecution
- 42:11Speaker 1: did a fantastic job of slamming the door shut on
- 42:14Speaker 1: Chad Daybell, and I think that when all is said
- 42:16Speaker 1: and done, we're going to see a guilty conviction here.
- 42:18Speaker 1: But until then, that's going to do it for this one.
- 42:21Speaker 1: All of the information that goes with this episode can
- 42:24Speaker 1: be found in the description box.
