Transcript
- 0:00We are back from NTL with Joe Fantini.
- 0:03Mark Rieu, I'm John Robinson. There is so much going on in the
- 0:06world of mass torts right now. We're going to jump right into
- 0:09the trial of the year. I think social media addiction,
- 0:13jury selection is underway. When will we see opening
- 0:16arguments, Joe? Yeah, good question, John.
- 0:19So everybody's buzzing about this case.
- 0:21It was probably the most talked about litigation at NTL.
- 0:25We had a little bit of breaking news last week.
- 0:28Now we have 2 defendants who've settled Snap and TikTok.
- 0:31Jury selection was underway, but we just got word one of the
- 0:34defense attorneys, one of the main attorneys got sick over the
- 0:38weekend. And because of that, the judge
- 0:40dismissed the potential jurors. They're told to come back on
- 0:44Thursday. So it looks like on Thursday,
- 0:46jury selection is going to pick back up the courts hoping that
- 0:49it's going to be paneled by the end of Friday and then we could
- 0:53have opening arguments next week on Monday.
- 0:55Trials expected to last anywhere between 4:00 to six weeks.
- 1:00This has been so anticipated. I'm going to be heading out to
- 1:02LA next Tuesday. I might catch the opening on
- 1:06Tuesday. Maybe if it happens on Monday
- 1:08I'll be there the day after. But make sure you follow us on
- 1:11social. I'll be trying to report as much
- 1:13as possible what's going on during the trial.
- 1:16Yeah. How does that work?
- 1:16Can we get seats if we're in town?
- 1:18Can we pop in and watch like a football game or is it if you
- 1:21have VIP passes to get into that?
- 1:23It is closed. It's not live streamed.
- 1:25I think it's just talking to the attorneys after the fact and
- 1:28figuring out what's going on behind and closed doors, if
- 1:30they'll even share. Yeah, So that's how it's been
- 1:33kind of been followed in the news here.
- 1:35And I've seen reports out of CNN kind of giving the weekly
- 1:39updates. It'll be really interesting.
- 1:41What I'm kind of paying attention to is whether one of
- 1:44the other big defendants settle, you know, with this little bit
- 1:47of additional time. We have another weekend.
- 1:50We saw a lot of action last week.
- 1:52It's possible we hear about another defendant settling
- 1:55before things really kick off. But exciting trial, everybody's
- 1:59anticipating this, got some great attorneys.
- 2:01So looking forward to seeing what you learn next week out
- 2:04there in California. No one wants to be last company
- 2:07standing, right? Snapchat settled, TikTok
- 2:09settled. We recorded live last week from
- 2:11NTL in the morning and then by the time we got to the
- 2:14afternoon, TikTok had already settled out of the case.
- 2:16So things are moving super quick.
- 2:18Exciting case and we'll see what happens next week.
- 2:21If you're listening to Tortalk, you know that scaling a mass
- 2:23tort docket isn't about spending more, it's about spending
- 2:26smarter. At our Digital, we specialize in
- 2:29the high stakes world of mass toward advertising.
- 2:31Over the past three months, we have launched 400 campaigns and
- 2:34signed up more than 16,000 cases for our clients.
- 2:37Whether you're targeting Roundup.
- 2:39Roblox or the next emerging MDL? Go to rrdigitalmedia.com to grow
- 2:44your docket with verified high quality claimants.
- 2:47All right, moving on to the next one, Roblox, the initial case
- 2:50management conference held before Judge Richard Seaborg in
- 2:54the Northern District of California on January 30th.
- 2:57What should we expect over the next three to six months?
- 3:00Yeah. This is another one of those
- 3:02kind of big tech social media type litigations where we sing
- 3:06this kind of new frontier of mass torts.
- 3:08This one was just formed. Like you mentioned, Mark, we had
- 3:11the initial case management conference, a little bit unique,
- 3:14but prior to the initial case management conference, the judge
- 3:18requested that attorney submit applications for leadership.
- 3:22And so following the hearing, the judge appointed 3 Co league
- 3:26plaintiffs. We have Brian Alstock out of
- 3:28Alstock Witkin, probably most well known for the three M
- 3:32litigation. We have Sarah London who's out
- 3:35of Gerard Sharp. She's really heavily involved in
- 3:38Uber. And then the last third one, we
- 3:41have Alex Walsh out of Annapolis, my old home.
- 3:44So they're the three that are going to be serving as Co lead.
- 3:47I really like the judge in this case.
- 3:49We like the venue. The judge is also requiring them
- 3:52to basically reapply every year for leadership position,
- 3:56something we've seen in other MDLSA little bit of a shocker.
- 4:00Mark Lanier actually did not get appointed Co lead.
- 4:03I can't remember the last time that happened.
- 4:05Looks like he's going to lead up the executive committee.
- 4:08We don't have formal appointment, but we'll have
- 4:11liaison council. Mark Lanier will be really
- 4:14involved in the case, which is great for everybody.
- 4:16But over the next three to six months, we have this initial
- 4:19formation of an MDL where leadership and the judge and the
- 4:23defendants kind of comes to agreement about what's going to
- 4:26be the road map for this case. What's going to be the
- 4:28discovery, what's going to be the short form complaint, what's
- 4:31going to be the master complaint, what's going to be
- 4:33the timeline for experts. So we'll hash that out over the
- 4:36next three to six months. Once we get some short form
- 4:39complaints entered and some real case management orders, we'll
- 4:42see some more filings coming in. Excited to see this one picking
- 4:45up some steam. In addition to Roblox, we
- 4:47actually did have two other mass torts really start last week.
- 4:51At the end of last week, the JPML had their initial
- 4:54conference and we found out some information about both Lyft
- 4:57sexual assault, which is separate from Uber and Cartiva
- 5:01cartilage implant. You tell us about what's going
- 5:03on there, Joe. Yeah.
- 5:04So these are kind of the two new mask towards.
- 5:07We're waiting right now still for the order to come down.
- 5:10Everybody feels pretty confident that that Lyft MDL is going to
- 5:13be formed. They're asking for it in the
- 5:15same jurisdiction as we have the Uber MDL.
- 5:18That kind of just makes sense to everybody be able to meet the
- 5:22requirements with the court usually looks at which is the
- 5:25numerosity, the common defendants, the common injuries,
- 5:28the common theme. So with Uber being granted, they
- 5:31fought us tooth and nail on that.
- 5:33I don't see how this doesn't get granted.
- 5:35So we should expect that probably before the end of this
- 5:38week, that MDL being formed. I'd expect it to be out in
- 5:41California as well. Then the other one that's
- 5:43basically a toe implant. So strikers, the manufacturer in
- 5:47this case, it's a large toe implant.
- 5:50And basically it came out initially about 10 years ago in
- 5:542016. Then as time went on, there were
- 5:57reports of failure. Some reports are high as
- 6:00anywhere from 60 to 80% failure rate.
- 6:02There ended up being a full recall by the FDA in October of
- 6:0724. The cases have been going on in
- 6:10various federal courts, but now we have some more cases that
- 6:13we're going for consolidation. Where we're at initially in the
- 6:16federal courts is the first trial supposed to be in the
- 6:19summer of 26th that could get kicked down if we get the MDL.
- 6:22My main concern about this one is kind of the numerosity.
- 6:26Usually it looks like the panel likes to see 25 or so.
- 6:30No case is filed before they do consolidation.
- 6:33I don't think we had that number, but since it's a common
- 6:35defendant, common injuries, it's got the recall it could get.
- 6:38Granted, we're looking actually for West Virginia just because
- 6:42the case is so far along. They're not a venue we typically
- 6:45go to for MDLS. 20 fives seems very low.
- 6:48What do you usually see is like the smallest amount that gets
- 6:51consolidated? Usually always double digits
- 6:53right? I can't remember a case where it
- 6:56was under 10 because one of those kind of elements that the
- 7:00panel looks for is the numerosity.
- 7:02So we want to be able to move forward and say, hey, there's so
- 7:06many different courts and judges dealing with these issues.
- 7:09Instead of wasting the resources across the country, let's get
- 7:12these consolidated now. So when you don't have the
- 7:15different lawsuits filed, that makes it a little bit harder.
- 7:18So usually, most times the panel grants the request.
- 7:22Typically we see it 60 to 70% of these requests gets granted off
- 7:26the bat. And when we're above that 25
- 7:28number, that percentage goes even higher to about 80 to 85%.
- 7:33I'm moving on to Roundup while we're waiting for the Supreme
- 7:36Court argument later this year. We had an important decision
- 7:40come down out of Missouri. What can you tell us about this
- 7:42litigation, Joe? Right.
- 7:44So the litigation is really focused out in Missouri right
- 7:47now in the MDL, we're down to about 4500 cases.
- 7:51Those cases are moving forward. The judge entered interesting
- 7:54order out in the MDL basically saying anybody who previously
- 7:58received an offer as part of the settlement program, they have
- 8:02the opportunity to reconsider it now that the Supreme Court is
- 8:06taking up this appeal. But really the action in
- 8:10Missouri that you were talking about, Mark, as expected, Baer
- 8:14said, hey, all the trials should be postponed.
- 8:16We can't go forward with anything.
- 8:18We're waiting on this huge ruling from the Supreme Court.
- 8:21Let's stay everything. We can't do anything over the
- 8:23next six months. We have a similar motion in two
- 8:26cases. In one case, the judge ruled in
- 8:29our favor and that it's not needed right now.
- 8:31We don't need to stay everything and wait for the Supreme Court
- 8:35to rule. We're going to be able to move
- 8:36forward. We're going to be able to move
- 8:38forward with discovery, other deadlines, motion practice,
- 8:41things of that nature. So that's a win for the
- 8:44plaintiffs because it keeps the pressure on the defendants.
- 8:47It keeps their attorneys working, it keeps them billing
- 8:49and spending money. So that was good momentum.
- 8:52Like we talked a little bit before, now is a good time to
- 8:56have conversations with the defendants about some sort of
- 8:59settlements. They have a little bit more
- 9:00leverage than they had with this potential Supreme Court ruling
- 9:03coming down. And then they also have been
- 9:06facing these huge verdicts. So I'm hoping we're going to
- 9:08start hearing about some inventory settlements.
- 9:11It will be challenging for a global, but now would be the
- 9:14time for those who. Are invested in Roundup.
- 9:17We're seeing some progress here. Hopefully we get to a resolution
- 9:21by the end of 2026. Thanks Joe for joining us for
- 9:23another episode of Tort Talk. Best 10 minutes in mass torts
