- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is avoiding digital pitfalls and domestic relations matters.
- 0:25And this episode today is based on an article on
- 0:28our blog Familawheadquarters dot com dated January thirtieth, twenty twenty six,
- 0:35and the title of that article is avoiding Digital Pitfalls
- 0:39Daring divorce and FAMI law cases. So as a follow
- 0:42up to the episode today, going over to Familawheadquarters dot
- 0:45com and read this article for more information. All right,
- 0:49so let's jump into the topic at hand, and it's
- 0:51really an important one, okay. In today's digital age, obviously,
- 0:55lots of parties use email, lots of parties are on
- 0:58social media, and this is really prevalent in society today.
- 1:04But look, there's some risk when going through a domestic
- 1:07relations case, and it's really important that parties are careful
- 1:11and that parties are doing the right things and these
- 1:14types of cases, and that they're not overstepping and that
- 1:17at the same time, they're securing their email and social
- 1:21media accounts as well. Okay, so let's go ahead and
- 1:25jump on in in more detail in terms of things
- 1:29to do and things not to do. And let's start
- 1:33with talking about a really big item in terms of
- 1:36not doing something. Okay, this is something never ever to do.
- 1:40This is never a road to go down. This is
- 1:42never right, This is never a path to go down.
- 1:45This is never something to think about, contemplate, or do
- 1:49in any shape, matter or form.
- 1:50Speaker 3: Okay.
- 1:50Speaker 2: So, look, when a divorce is begun or a famil
- 1:54ot case has begun, or even where it's reasonably anticipated,
- 1:59do not log in to your spouses or the opposing
- 2:01parties accounts. Okay, Look when when parties are married, or
- 2:05maybe when couples are living together and they're not married.
- 2:08Let's say it could be common in a marriage or
- 2:12in a relationship where where parties or partners of living together,
- 2:15you know, to know each other's account logins. And oftentimes
- 2:20in a marriage or in a relationship, parties willingly give
- 2:23their login information to their spouse or their significant other,
- 2:27and so it's just sort of common knowledge, you know,
- 2:29So parties have the log of information to the other
- 2:32individual's email accounts. Maybe there's social media accounts, and it
- 2:36could be other things as well, you know, online banking
- 2:40could be something, could be investment accounts, retirement accounts.
- 2:45Speaker 3: You know.
- 2:45Speaker 2: To log in information is just freely given to the
- 2:48spouse or the significant other, right and you know, most
- 2:52couples or you know, most spouses think nothing of this,
- 2:57and it's just sort of normal.
- 2:59Speaker 3: To do this, Okay.
- 3:01Speaker 2: But look, when a divorce or familylaw case has begun
- 3:05or it's reasonably anticipated, right, like, parties know this is
- 3:10going to result in either divorce or attorney case or
- 3:13some other type of litigation.
- 3:15Speaker 3: Okay.
- 3:16Speaker 2: One of the most important rules and things not to
- 3:18do is at this point you cannot log into your
- 3:22spouses or the other parties accounts. Okay, So you cannot
- 3:26be logging into their email, you cannot log into their
- 3:30social media accounts again, even if you were given the
- 3:32log in previously. Okay, you got to know that this
- 3:36is a bad idea and something that cannot be done.
- 3:40Speaker 3: Okay. Obviously this is.
- 3:42Speaker 2: Something to talk about with your lawyer, talk about with
- 3:45your attorney. But any good and decent lawyer attorney will
- 3:48tell you not to do this, right, that this is
- 3:51really bad to do this or to think about doing this. Okay,
- 3:56And for a lot of individuals, they might wonder why
- 4:00why is this bad? I mean, my spouse gave me
- 4:02the log in my significant other game at the log in.
- 4:04They didn't change their log in information. They never told
- 4:08me I couldn't go in there, and they told me
- 4:11I could go in there in the past. You know,
- 4:13why is it bad now? Well, look, you know it's
- 4:18bad for all kinds of reasons.
- 4:20Speaker 3: Okay.
- 4:20Speaker 2: One, if an individual is communicating with their attorney through
- 4:25that email account, yeah, this could be a problem in
- 4:30terms of attorney client privilege in confidentiality, like a party
- 4:35cannot be reading, reviewing in any shape, matter or form.
- 4:40There's spouses or there's significant others communication with their warrior
- 4:46about a legal matter that involves them, right, I mean
- 4:49it's really bad, Okay, really really bad.
- 4:53Speaker 3: It just cannot happen.
- 4:55Speaker 2: Obviously when you get into you know, social media accounts
- 4:58and stuff like this too. I mean you're dealing with
- 5:00privacy issues, confidentiality issues. I mean the user agreements with
- 5:04these social media entities. I mean, only the actual user
- 5:09is supposed to be logging in and so you know,
- 5:13a party cannot do it. This is a harsh reality
- 5:17as well. But this can even be criminal. This could
- 5:21be construed as hacking, which violates some federal laws, maybe
- 5:28some state laws in your jurisdiction, So it could be
- 5:30construed as hacking, and so it could result in criminal implications.
- 5:34And I know this is hard for a lot of
- 5:36parties to really realize and wrap their arms around. But
- 5:39they'll be like, well, I was given the log in
- 5:41or whatever and they never changed it, So how is
- 5:44that hacking or why is it a problem? Look, it's
- 5:46a problem in terms of attorney client privilege, confidentiality, privacy laws,
- 5:51and then you know criminal laws in terms of hacking
- 5:55and computer tampering and these kinds of things.
- 5:57Speaker 3: It's just bad news.
- 5:58Speaker 2: So don't you know, don't do it, right, Just do
- 6:03not do it.
- 6:05Speaker 3: It's really, really, really bad.
- 6:07Speaker 2: Okay, So do not ever go into your spouse's or
- 6:12the opposing party's email or social media accounts or other
- 6:15logins that could be again could be online banking, their
- 6:18retirement accounts, could be various other things.
- 6:21Speaker 3: Credit cards.
- 6:22Speaker 2: I mean, if this isn't your retirement account or your
- 6:25credit card and your name's not on it. It doesn't
- 6:29matter that you were given the log in before. I mean,
- 6:31once the case is reasonably anticipated or the divorce or
- 6:35the familylaw case has begun, you cannot be going in there.
- 6:38If you go in there, you could cause great problems
- 6:40for your case.
- 6:42Speaker 3: Okay. So that's rule number one.
- 6:44Speaker 2: And again i'd encourage any of the listeners speak with
- 6:47your attorney about this. But any good and decent lawyer
- 6:49is going to tell you not to do this. And
- 6:52you know, if you were to do it and then
- 6:54try to pass that information on, I think a lot
- 6:56of lawyers are going to withdraw from the case and
- 6:59I want to be your lawyer anymore, and it could
- 7:01really impact the case result as well.
- 7:05Speaker 3: Okay.
- 7:05Speaker 2: So I mean it's this doctrine of like tainted fruits.
- 7:08So it's like, oh, okay, you go in there and
- 7:10you get some information and you think it's going to
- 7:12be helpful to your case, but it's tainted.
- 7:14Speaker 3: You know, they're poisonous fruits.
- 7:16Speaker 2: You can't even use them, so so be very careful there.
- 7:20Speaker 3: Okay.
- 7:20Speaker 2: Other things parties need to think about and contemplate. And
- 7:23this is sort of the inverse of what I just said.
- 7:25It is like, look, if you were given your logins
- 7:27to your spouse, your your significant other or something like that,
- 7:32once a case is reasonably anticipated or it's begun, like,
- 7:35change your logins, right, it's time to change your passwords,
- 7:40maybe your user names, make them something different that your
- 7:44spouse or your significant other will not know, will not
- 7:47be able to guess, because you have to have some
- 7:50element or worry that they might try to log into
- 7:52your stuff, right, because you gave them the log in before.
- 7:56So you have to go around and change all your
- 7:59user names and passwords and make them something different, something
- 8:03that they can't guess. And so this is one of
- 8:05the you know, important things a party ought to do
- 8:09once they know that, hey, things are bad litigations come
- 8:13in here, we're getting divorced, we're breaking up, or whatever
- 8:15the deal is. Change your user names and passwords because
- 8:17you don't want your acts going in there logging in
- 8:21reading stuff between you and your attorney. And you don't
- 8:24want them going in there accessing accounts and information that
- 8:28they shouldn't be able to have access to as well. Okay,
- 8:31so a lot of parties forget this, don't think about this,
- 8:34don't contemplate it, but change your user name and passwords,
- 8:38make it something different than what you've ever used before.
- 8:42That way it can't be guessed. And that way your
- 8:45accounts are secure and you don't have to worry that
- 8:49you know, there's going to be some sort of breach
- 8:51or hacking or tampering or something like that occurring in
- 8:55terms of your communication. Okay, So again this is an
- 8:58important topic. I mean, it's one that's relevant in today's age. Unfortunately,
- 9:03it's one that you know, parties can be tempted to do,
- 9:07can think about contemplate doing. But again it's very important
- 9:10that parties.
- 9:12Speaker 3: Do not do this.
- 9:12Speaker 2: So do not be logging in to the opposing parties
- 9:15or your ex's social media or email accounts or any
- 9:19other accounts that aren't your accounts. I mean, you can't
- 9:22do that. And please consider, you know, changing your logins
- 9:27to your email and social media accounts to make sure
- 9:31that there's no hacking into your accounts.
- 9:33Speaker 3: Okay.
- 9:34Speaker 2: You know, as a follow up to this episode, to
- 9:36any of the listeners, if you have a lawyer, talk
- 9:38with your lawyer about this in more detail. They can
- 9:40give you more case specific advice. Obviously I'm speaking very
- 9:43generally here, but this is a very important topic and
- 9:46one I wanted to cover here today. All right, so again,
