- 0:10Speaker 2: Welcome to Conspiracy The Show, the world's most trusted conspiracy
- 0:16Speaker 2: dairy podcast, with your hosts Adam Todd Brown and Olivia Hidar.
- 0:32Speaker 1: Hey, everybody, welcome to Conspiracy The Show. I'm Adam Todd.
- 0:38Speaker 3: Brown and I'm Olivia Hidar and that.
- 0:41Speaker 1: Makes us your hosts Olivia. Happy New Year. How's it going?
- 0:45Speaker 3: Happy New Year?
- 0:48Speaker 1: How's how's it going?
- 0:49Speaker 3: Oh it's going. Okay, I miss you saying that it's good.
- 0:53Speaker 3: You know, I'm sick, but I'm almost not sick. So
- 0:58Speaker 3: that's the important thing.
- 0:59Speaker 1: That's That's one of the best phases of being sick
- 1:02Speaker 1: is the almost not sick but still sick enough that
- 1:05Speaker 1: you can be like, hey, I'm sick, fuck off.
- 1:08Speaker 3: Right, Yeah, Like I'm not like actively in misery, but
- 1:12Speaker 3: I can like I have a valid excuse to tell
- 1:14Speaker 3: people I don't want to do stuff.
- 1:16Speaker 1: But nonetheless, here we are working on New Year's Day.
- 1:19Speaker 1: I didn't realize this is like the officially observed New
- 1:23Speaker 1: Year's Day. I thought they were just going to observe
- 1:25Speaker 1: it on Sunday.
- 1:26Speaker 3: But what do you mean?
- 1:27Speaker 1: This is like literally, yeah, this is like officially everyone's
- 1:32Speaker 1: day off, right except us, because we have well that's.
- 1:36Speaker 3: Yeah, that's how it usually is when the holiday lands
- 1:38Speaker 3: on like a Sunday.
- 1:39Speaker 1: Yeah. So we're recording this with a pretty big anniversary
- 1:46Speaker 1: looming at the end of the week, January sixth, it's
- 1:50Speaker 1: going to be the two year anniversary of the Capital Riots.
- 1:56Speaker 3: Yeah. Crazy that it's been two years. I know, like
- 1:59Speaker 3: obviously passes or whatever, fuck you, But like I it's
- 2:03Speaker 3: just nuts that it's been two years since that happened.
- 2:05Speaker 3: It feels like I mean, it feels like both yesterday
- 2:08Speaker 3: and an eternity ago.
- 2:09Speaker 1: So yeah, it does feel like it was Yeah, you're right,
- 2:14Speaker 1: both longer and shorter ago.
- 2:16Speaker 3: Yeah.
- 2:16Speaker 1: And we're talking about the January sixth Committee this week
- 2:21Speaker 1: because conveniently, just right on the verge of the two
- 2:26Speaker 1: year anniversary of the Capitol Riots, the January sixth Committee
- 2:30Speaker 1: is finally putting out their final report, releasing their findings.
- 2:35Speaker 1: They've done all of that, and we're gonna talk about it.
- 2:39Speaker 1: I don't know how comfortable I am with all of
- 2:43Speaker 1: this happening right up against the anniversary.
- 2:47Speaker 3: Yeah, I guess. I mean, it just it makes I
- 2:51Speaker 3: feel like if something it makes, it's gonna happen on
- 2:53Speaker 3: the anniversary. I don't know.
- 2:55Speaker 1: Yeah, I mean, nothing happened on the anniversary last year,
- 2:58Speaker 1: so I don't think there's anything special about the two
- 3:02Speaker 1: year anniversary that would cause a repeat of it except
- 3:08Speaker 1: word coming down that like Trump won't be allowed to
- 3:12Speaker 1: run for office anymore, or Trump getting arrested. I don't
- 3:17Speaker 1: right that would happen this.
- 3:20Speaker 3: Yeah, but like, yeah, none of that's happening this week,
- 3:22Speaker 3: is the thing. Like, even though like obviously there's been
- 3:26Speaker 3: a lot of revelations and discussions from the report, like
- 3:30Speaker 3: that's how fast the federal government moves, right.
- 3:35Speaker 1: Not usually this would be the one time where it's
- 3:38Speaker 1: an exception and they're like, suck, yeah, arrest them on
- 3:41Speaker 1: January fifth. It's like, man, wait till the eighth, come on.
- 3:46Speaker 3: I mean sure, I don't know, Like, if people are
- 3:49Speaker 3: gonna do shit, they're gonna do shit. I don't think that.
- 3:51Speaker 3: I mean, And also I feel like, and maybe I'm
- 3:55Speaker 3: totally misreading this. I could totally just be wrong, but
- 3:59Speaker 3: it feels like most of the people on the right
- 4:02Speaker 3: aren't like happy about January. It doesn't feel like a
- 4:07Speaker 3: thing that they want would want to celebrate or commemorate.
- 4:11Speaker 3: It feels like they're trying to move past it and
- 4:13Speaker 3: get to the next crazy thing that they're gonna do.
- 4:16Speaker 1: I sure hope so, but I don't know. Yeah, either way,
- 4:20Speaker 1: there are a lot of developments to talk about when
- 4:22Speaker 1: it comes to the January sixth Committee, and that's what
- 4:27Speaker 1: we're gonna talk about on this episode. We're gonna just
- 4:31Speaker 1: keep everyone abreast of the situation. I love saying it
- 4:35Speaker 1: that way. Sure, keep me a breast, Yeah, do we
- 4:38Speaker 1: still say to me?
- 4:39Speaker 3: Yeah, I say, keep me a boob of the situation?
- 4:41Speaker 3: Keep me like, what what do you mean? It's like
- 4:46Speaker 3: a play on words like breast boob.
- 4:48Speaker 1: Anyway, So, one of the first things that came down
- 4:52Speaker 1: the January sixth Committee did recommend criminal charges against Trump.
- 4:59Speaker 1: They referred Trump to the Justice Department for criminal charges
- 5:05Speaker 1: for his role in the Capitol riot. Whether he does
- 5:08Speaker 1: get charged or not is up to the Department of Justice. Yeah,
- 5:14Speaker 1: and if they go for it, this would be the
- 5:16Speaker 1: first time a former president would face federal charges.
- 5:21Speaker 3: Yeah. It's one of those things where it's like I'll
- 5:23Speaker 3: never believe it until literally it happens. It doesn't matter
- 5:29Speaker 3: how much it seems like that's what's going to happen.
- 5:31Speaker 3: I've seen him get away with too much for me
- 5:35Speaker 3: to ever think that he's actually going to get charged
- 5:38Speaker 3: or something, But who knows, Maybe I'm wrong.
- 5:40Speaker 1: Yeah, it's interesting how much of our political system kind
- 5:45Speaker 1: of mirrors the things that have been happening in Brazil lately,
- 5:50Speaker 1: with especially with jaiyr Boalsnaro rising to power like he was,
- 5:55Speaker 1: you know, Brazilian Trump. Yeah, but they also had a
- 5:59Speaker 1: situation where a former president was charged with a crime
- 6:04Speaker 1: and like actually arrested and sent to prison, and he
- 6:09Speaker 1: was hugely popular. But the only difference is he was
- 6:14Speaker 1: more of an Obama type, right, and Balsonaro is a
- 6:18Speaker 1: Trump type. But that guy they call him Lula, I
- 6:22Speaker 1: don't like they call him Lula to the degree that
- 6:25Speaker 1: I don't even really know his real name, but he
- 6:28Speaker 1: has one. He's like president again. He went to prison,
- 6:32Speaker 1: got out and ran for president and is now their
- 6:36Speaker 1: president again.
- 6:37Speaker 3: Good for him, you know, yeah, I mean the thing.
- 6:40Speaker 1: He went to prison for was some bullshit. We've covered
- 6:43Speaker 1: it before. It was one of those scandals that involved
- 6:47Speaker 1: like all politicians, and they were just like, oh, we
- 6:50Speaker 1: can probably just pin it on him and send him
- 6:51Speaker 1: to prison. And that's fastened but yeah, I know, it
- 6:55Speaker 1: seems unlikely that the Department of Justice would charge him,
- 6:59Speaker 1: But the Attorney General did also just appoint a special
- 7:02Speaker 1: counsel name Jack Smith. If that is his real name.
- 7:09Speaker 3: You should have point someone else. You should have point
- 7:11Speaker 3: someone with a real sounding name. Like, no offense to
- 7:13Speaker 3: Jack Smith. I'm sure he's fine or whatever. He might
- 7:15Speaker 3: be totally evil. I don't know, but like, oh probably, Yeah,
- 7:19Speaker 3: he's just got a fake ass name. That's a fake
- 7:21Speaker 3: fucking name, Jack Smith. And I know there's Jack Smith here.
- 7:24Speaker 3: Might be a Jack Smith listening because the reason it's
- 7:27Speaker 3: a fake sounding fucking name is because there's a lot
- 7:28Speaker 3: of you motherfuckers.
- 7:30Speaker 1: Yeah, yes, with all due apologies to Jack Smith's. Yeah,
- 7:35Speaker 1: get a real or sounding name.
- 7:36Speaker 3: If I mean get like that's this is the thing,
- 7:39Speaker 3: Merrick Garland. That's a that's a tough to make up name.
- 7:42Speaker 1: You know, that's a bitch and name.
- 7:44Speaker 2: It's not.
- 7:45Speaker 3: It's a pretty good name.
- 7:46Speaker 1: But yeah, Jack Smith. But he has been appointed for
- 7:49Speaker 1: this very reason to look into the possibility of charging
- 7:53Speaker 1: Trump over the Capitol riots. And now with well the
- 7:56Speaker 1: January sixth committee recommending charges, it could be a thing.
- 8:01Speaker 3: I mean, I obviously think that Trump should face consequences
- 8:07Speaker 3: for at least some of the terrible things that he's done.
- 8:13Speaker 3: That would be nice, But it's just one of those things.
- 8:17Speaker 3: I'll have to see it happen before I can believe it.
- 8:21Speaker 1: I don't know. I want to say I'm not confident
- 8:24Speaker 1: that they would charge Trump, but I am. I actually
- 8:27Speaker 1: am kind of confident that they're gonna do it, because
- 8:32Speaker 1: I mean, you gotta send the message if nothing else.
- 8:35Speaker 3: But also charging him and him suffering consequences aren't necessarily
- 8:43Speaker 3: the same thing. Like he could be charged and then
- 8:46Speaker 3: come out of it.
- 8:47Speaker 1: Fine, Yeah, he could be charged and also come out
- 8:49Speaker 1: of it like more powerful and scarier. Sure, so I
- 8:55Speaker 1: think there is a historical example of a Trump type
- 8:59Speaker 1: pulland some shit and going to prison for it and
- 9:02Speaker 1: then coming out the other end a little bit mightier.
- 9:05Speaker 1: I don't know who I'm thinking of. I'm thinking of Hitler.
- 9:07Speaker 1: I'm talking about Hitler, that exactly. Yeah, but like it
- 9:12Speaker 1: happened with Hitler.
- 9:13Speaker 3: Well, Hitler hadn't been Feurer. True, that is slightly different.
- 9:18Speaker 3: I'll say, Yes, it's more like Napoleon.
- 9:21Speaker 1: Okay, yeah, either way, not great, Yeah, not a good thing.
- 9:25Speaker 1: I agree Trump should go to prison or face some consequences,
- 9:30Speaker 1: but also, ugh, that's gonna be a shit storm when.
- 9:35Speaker 3: It I mean, yeah, well there's no good thing that
- 9:38Speaker 3: comes out of that or any sort of I mean,
- 9:43Speaker 3: it has to be done. This is the problem, Like
- 9:46Speaker 3: it has to be done, but what just it does?
- 9:49Speaker 3: That doesn't mean that it's going to end well, but
- 9:52Speaker 3: it's something that must be done. Whether or not it will.
- 9:56Speaker 1: Who knows the charges that he's facing, We should run
- 9:59Speaker 1: through those. They recommended four different charges. Obstruction of an
- 10:05Speaker 1: official proceeding, and that is based on the riot's main goal,
- 10:10Speaker 1: which was to delay or block the counting of the
- 10:15Speaker 1: Electoral College votes. Conspiracy to defraud the United States. That's
- 10:21Speaker 1: also based on the plans to delay or block the certification,
- 10:26Speaker 1: but that's more the planning and build up to it.
- 10:29Speaker 1: Hence the conspiracy, conspiracy to make a false statement based
- 10:34Speaker 1: on a scheme to submit alternate slates of electors who
- 10:38Speaker 1: supported Trump to Congress from states that supported Biden, and
- 10:42Speaker 1: the last one inciting assisting and giving aid and comfort
- 10:46Speaker 1: to an insurrection, And that one seems pretty self explanatory.
- 10:52Speaker 1: I have the same question here that I had about
- 10:56Speaker 1: the one trial that eventually happened over Jonestown. The one
- 11:02Speaker 1: guy who was charged, Larry Layton, was charged with conspiracy
- 11:06Speaker 1: by himself. He was the only person charged, which begs
- 11:09Speaker 1: the question who are the other conspirators? Because this is
- 11:14Speaker 1: Trump and Trump alone being recommended for charges, And it's like, well,
- 11:19Speaker 1: who's actually No, I'm wrong. I believe his lawyer, John Eastman,
- 11:23Speaker 1: is the other conspirator. So scratch that. I just wanted
- 11:26Speaker 1: to slip that Jonestown point in under the doors. Yeah,
- 11:31Speaker 1: but yeah, I believe it's John Eastman, his lawyer, who
- 11:34Speaker 1: is the other conspirator, who is charged with helping him
- 11:38Speaker 1: come up with this plan to send an alternate slate
- 11:41Speaker 1: of electors to Congress. So here's a quote from the
- 11:45Speaker 1: January sixth Committee after recommending charges. We understand the gravity
- 11:51Speaker 1: of each and every referral we are making today, just
- 11:54Speaker 1: as we understand the magnitude of the crime against democracy
- 11:59Speaker 1: that we describe in our report. But we have gone
- 12:02Speaker 1: where the facts and the law lead us, and inescapably
- 12:05Speaker 1: they lead us here end quote. So what do we
- 12:08Speaker 1: think you think they're going to charge him? They should,
- 12:11Speaker 1: I just don't want him to do it this week,
- 12:13Speaker 1: Like don't charge him this week. Let January sixth pass.
- 12:19Speaker 3: And then I guess, I mean, it's not gonna happen
- 12:21Speaker 3: this week, so we're okay, there's just no way.
- 12:24Speaker 1: But I also don't know that whether it happens on
- 12:28Speaker 1: January sixth or not is going to play a role
- 12:30Speaker 1: in whether his supporters subsequently riot over it. If he
- 12:35Speaker 1: goes to trial and gets convicted, goes to jail, there's
- 12:37Speaker 1: going to be some unrest.
- 12:40Speaker 3: Yes, I think that's fair.
- 12:42Speaker 1: We talked about it on this week's Unpopular Opinion. But
- 12:45Speaker 1: that's one of the scariest things about Trump is he's
- 12:48Speaker 1: almost the only US politician right now that has that
- 12:52Speaker 1: like royal family energy, where if he died, there's going
- 12:57Speaker 1: to be idiots like blubbering in the s over it.
- 13:01Speaker 1: Sure like there's not really, I mean, I guess like
- 13:05Speaker 1: AOC maybe, like if she unexpectedly passed, I feel like
- 13:10Speaker 1: people would maybe get in the streets and be upset,
- 13:13Speaker 1: but other like by she murdered. Yeah yeah, but like Biden,
- 13:18Speaker 1: no way.
- 13:19Speaker 3: Like But also people on the left tend to not
- 13:24Speaker 3: always be as idolatrous of their politicians as the people
- 13:29Speaker 3: who are really into the populist right, you know, there's
- 13:32Speaker 3: more of a cult of personality. But even then, that's.
- 13:36Speaker 1: Even then, I don't think like if George W. Bush, well,
- 13:42Speaker 1: if he had died in office, like people would have
- 13:44Speaker 1: been upset, but it wouldn't be like the outpouring of
- 13:47Speaker 1: grief and anger and frustration that I feel like we
- 13:51Speaker 1: would see with Trump. Like no one was going to
- 13:53Speaker 1: storm the capitol for George W. Bush.
- 13:57Speaker 3: Absolutely, I know, I don't disagree. I mean, I know
- 13:59Speaker 3: what you mean, and I agree that Trump is different,
- 14:02Speaker 3: Like he's got he has this cult of personality that
- 14:06Speaker 3: no other politician has, especially in recent times, has been
- 14:12Speaker 3: able to cultivate. And that's one of the things that
- 14:14Speaker 3: makes him the most dangerous as a polic I mean
- 14:18Speaker 3: it's not his policies. I mean, he has terrible policies, obviously,
- 14:22Speaker 3: but it's his ability to get people excited that is scary.
- 14:27Speaker 3: And so yeah, like I think if anything happens to him,
- 14:30Speaker 3: it would go crazy. I don't think even if Bernie
- 14:33Speaker 3: Sanders died, people on the left would be sad because
- 14:37Speaker 3: one of our most effective left leaning politicians will be
- 14:41Speaker 3: gone and we don't have a lot of those. So
- 14:46Speaker 3: I think that would be where our pain comes from,
- 14:49Speaker 3: not from specifically the loss of this person, because we
- 14:53Speaker 3: see our goals as being greater than any one person. Right,
- 14:59Speaker 3: That's why we're hard on our politicians. But like Trump,
- 15:03Speaker 3: people like Trump and whatever policies Trump says, that's what
- 15:08Speaker 3: people like, and it's just you know that, Yeah, there's
- 15:12Speaker 3: not an analog to that anywhere else.
- 15:14Speaker 1: Yeah, yeah, and that's what makes it so concerning to me.
- 15:18Speaker 1: But at the same time, like you said, you gotta
- 15:20Speaker 1: do it, like, oh yeah, they kind of have to charge.
- 15:24Speaker 3: Him, so that since like you know, he got into
- 15:28Speaker 3: office under legal means, Like you know, I've been saying,
- 15:32Speaker 3: it doesn't matter how bad it is in the long
- 15:36Speaker 3: run or how few consequences there are, it has to
- 15:40Speaker 3: be done or else we have no moral foot to
- 15:43Speaker 3: stand on right at the United States.
- 15:46Speaker 1: I was going to say that part's already a little
- 15:48Speaker 1: shaky pre Trump exactly. So a few days after recommending
- 15:53Speaker 1: criminal charges, the final report was released eight hundred and
- 15:59Speaker 1: forty five payes you read it yet?
- 16:02Speaker 3: Yeah, you know, I was sick, and so I was like,
- 16:04Speaker 3: I'll just what better way to get better than to
- 16:07Speaker 3: read an almost nine hundred page like legal document.
- 16:12Speaker 1: That'd be great if it's half as thrilling as the
- 16:15Speaker 1: Muller Report. Sure, I have no doubt that people will
- 16:18Speaker 1: be on the edge of their seat. I loved I
- 16:21Speaker 1: say this every time the Muller Report comes up. I
- 16:23Speaker 1: love that there were politicians getting in front of TV
- 16:26Speaker 1: cameras being like, I read all of the Mueller Report.
- 16:30Speaker 1: It's like, motherfucker, it's like four hundred pages. You of
- 16:32Speaker 1: course you should have read it.
- 16:34Speaker 3: God damn well better, Why.
- 16:36Speaker 1: Wouldn't you read the Muller Report?
- 16:38Speaker 3: Uh? Yeah, I mean I think it's a kind of
- 16:41Speaker 3: an interesting sign of how the culture has shifted since
- 16:47Speaker 3: Trump left office that this, like the Muller Report was
- 16:50Speaker 3: like a book like people. It was like published just
- 16:53Speaker 3: like an airport.
- 16:54Speaker 1: Like, oh, this is tech.
- 16:56Speaker 3: It is Oh I didn't know that.
- 16:57Speaker 1: Yeah you can, you can get it. It kind of
- 16:59Speaker 1: looks like a Dianetics book. The cover is fucking jazzy.
- 17:03Speaker 3: Yeah, it's like volcanoes and shit.
- 17:05Speaker 1: Yeah, it looks like l Ron Hubbard fucking wrote it.
- 17:07Speaker 3: Okay, I missed that, so I don't know. Then, it
- 17:10Speaker 3: just seems like it's not making the impression that the
- 17:12Speaker 3: Moull Report. Everybody cared about the Mole report. Everybody had
- 17:15Speaker 3: the thing. I don't know.
- 17:17Speaker 1: I think the difference here, and one of the reasons
- 17:22Speaker 1: we're not running through all the details of January sixth
- 17:25Speaker 1: and the specifics of the riot is because it's so obvious,
- 17:30Speaker 1: Like I don't I don't need the January sixth Committee
- 17:34Speaker 1: to tell me that Trump incided a riot. Like the
- 17:38Speaker 1: insights that they have, like in as far as the
- 17:42Speaker 1: back room workings and things, are very interesting, but in
- 17:46Speaker 1: my heart, I already know Trump did it, and we
- 17:48Speaker 1: saw it happen on TV, and I think that's right.
- 17:51Speaker 1: Probably why it's not as interesting to people.
- 17:55Speaker 3: That's fair, But yeah, that makes sense.
- 17:57Speaker 1: It is interesting to me in that when I saw
- 18:02Speaker 1: this unfold on TV, the impression I got was that
- 18:06Speaker 1: it was kind of a spontaneous thing and that Trump
- 18:10Speaker 1: just planned to have this rally that day and it
- 18:14Speaker 1: erupted in violence. But it seems like that wasn't the case.
- 18:19Speaker 1: It seems like there were at least some elements who
- 18:22Speaker 1: kind of knew it was going to progress to that point.
- 18:25Speaker 1: But also if that's the case, they didn't do shit
- 18:27Speaker 1: once it got to that point. I mean, yeah, who
- 18:32Speaker 1: knows who knows.
- 18:34Speaker 3: I don't know. I mean, it's it is very possible
- 18:38Speaker 3: that it's a combination of these things. It's a bunch
- 18:41Speaker 3: of people with different motivations who all just were in
- 18:44Speaker 3: the same place.
- 18:45Speaker 4: Yeah.
- 18:45Speaker 1: The Guardian called the final report quote one of the
- 18:49Speaker 1: most damning official portraits of a president in American history
- 18:54Speaker 1: end quote. And I can see that being the case
- 18:58Speaker 1: because this is it's similar to Watergate in that with Watergate,
- 19:03Speaker 1: Nixon recorded everything, Yeah, like a fucking idiot.
- 19:08Speaker 3: Well, also, because literally every president recorded everything that happened
- 19:12Speaker 3: in the Oval office, that was one thing that he
- 19:15Speaker 3: was actually not that much outside of the norm about.
- 19:19Speaker 1: And these days everything happens on electronic devices and it's
- 19:25Speaker 1: very hard to shake that trail once you have created it.
- 19:30Speaker 1: So we know like the text messages and the things
- 19:34Speaker 1: that Trump was doing and saying on that day. And
- 19:37Speaker 1: I think the most obviously damning part of it is
- 19:41Speaker 1: that he never ordered the military to intervene or help, which,
- 19:47Speaker 1: on the one hand, you know you don't want like
- 19:50Speaker 1: you're you're walking a fine line when you sick the
- 19:53Speaker 1: military on protesters, right, but this was a little difference.
- 20:00Speaker 3: Well, I would say the biggest thing is just the
- 20:03Speaker 3: contrast between his reaction to this and his reaction to say,
- 20:09Speaker 3: the Black Lives Matter protests in twenty twenty and people
- 20:13Speaker 3: doing way less, way further away from government buildings, getting
- 20:17Speaker 3: the National Guard and the like sicked on them.
- 20:20Speaker 1: He tear gassed a group of protesters who were standing
- 20:24Speaker 1: behind the barricade that was set up for them to
- 20:28Speaker 1: stand behind. That's insane.
- 20:31Speaker 3: Yeah, but yes, I agree, But like you know, so,
- 20:35Speaker 3: I mean, on the one hand, like you said, I
- 20:38Speaker 3: am not in support of the president calling in the
- 20:41Speaker 3: military on protesters. And you know, I don't like the
- 20:47Speaker 3: January sixth events because mostly because they were stupid as fuck.
- 20:51Speaker 3: But you know, I wouldn't have wanted the military. That
- 20:54Speaker 3: wouldn't have helped anything. But it's showing his eyes very
- 21:00Speaker 3: obvious on their face biases by his differing responses.
- 21:05Speaker 1: Right, And I don't know that we would have wanted
- 21:08Speaker 1: the military to just like come in and start shooting people.
- 21:11Speaker 3: It's absolutely not.
- 21:13Speaker 1: But it was also pretty clear the Capitol police needed
- 21:16Speaker 1: some help. They were overwhelmed, and I think that was
- 21:20Speaker 1: more of the thing.
- 21:21Speaker 3: Half of them.
- 21:22Speaker 1: Yeah, that's the problem too, because half of them were
- 21:25Speaker 1: fucking in on it. And that was one of the
- 21:27Speaker 1: other concerns I read about. I don't think I put
- 21:29Speaker 1: it in the notes, but yeah, Trump didn't call in
- 21:32Speaker 1: the military. But there was also some element on that
- 21:35Speaker 1: day that was like, don't ask Trump to call the military.
- 21:38Speaker 1: He will call the military on his behalf right, he
- 21:41Speaker 1: will just send them in to fucking kill Congress or something.
- 21:46Speaker 1: So there was that element too where people didn't necessarily
- 21:49Speaker 1: want Trump to have his finger on that button on
- 21:53Speaker 1: that show, which was probably for the best.
- 21:57Speaker 5: Yeah, he, I'm gonna say, is not the kind of
- 22:00Speaker 5: person that I would want commanding the most advanced military
- 22:05Speaker 5: on the face of the planet in the history of
- 22:07Speaker 5: the world.
- 22:08Speaker 3: No, it's just not the guy I trust with that job.
- 22:10Speaker 3: Come on, I know, I know, I know I'm overreacting.
- 22:15Speaker 1: So this report basically just blames Trump. This is a
- 22:20Speaker 1: quote The central cause of January sixth was one man,
- 22:24Speaker 1: former President Donald Trump, who many others followed. None of
- 22:28Speaker 1: the events of January sixth would have happened without him.
- 22:32Speaker 1: End quote. I think that's probably true.
- 22:35Speaker 3: Absolutely, Like we were just saying, like, he's the only
- 22:39Speaker 3: ideologue that we've got that could do something like.
- 22:42Speaker 1: That, and he didn't have to have that fucking rally
- 22:45Speaker 1: on January sixth. No, like, no, that was that was very,
- 22:50Speaker 1: very avoidable. He waited something like three hours before he
- 22:56Speaker 1: put out a message and called for people to stop.
- 22:59Speaker 1: And here's the thing. That part is scary to me too,
- 23:02Speaker 1: the part where he just went on TV and was
- 23:03Speaker 1: like all right, cool it and everyone was like, okay,
- 23:05Speaker 1: we'll leave now. Like, that part's terrifying. So one of
- 23:10Speaker 1: the things that the report found is that in the
- 23:14Speaker 1: months between election day and the riot, Trump and his
- 23:18Speaker 1: people made at least two hundred attempts to pressure election officials,
- 23:24Speaker 1: including at least sixty eight meetings, phone calls or texts,
- 23:28Speaker 1: eighteen prominent public remarks, and one hundred and twenty five
- 23:33Speaker 1: social media posts. See that's the other thing. That's the
- 23:37Speaker 1: other reason this isn't ringing as many bells as the
- 23:41Speaker 1: Mueller report. We saw all of this, like we know
- 23:44Speaker 1: these phone calls happened. We saw the social media posts
- 23:47Speaker 1: like it's good that all of this has been confirmed
- 23:50Speaker 1: and put on the record in an official way. But
- 23:53Speaker 1: if this is all they're coming back with, I'm not
- 23:55Speaker 1: reading eight hundred and forty five pages to be told,
- 23:58Speaker 1: Trump tweeted a bunch about not in the elections, like
- 24:01Speaker 1: I know, I know.
- 24:02Speaker 3: Yeah, I mean, like this is the thing, Like, I'll
- 24:05Speaker 3: let them read it now, they need to read it.
- 24:08Speaker 3: I don't. I'm good, I get it.
- 24:10Speaker 1: They also recommended a congressional ethics investigation of Kevin McCarthy.
- 24:14Speaker 1: Come on, no, oh, what that guy?
- 24:18Speaker 4: Wow.
- 24:19Speaker 1: So let's talk about a couple of other things that
- 24:22Speaker 1: have come out of this that are obviously still Trump related,
- 24:25Speaker 1: but not quite as Trump related.
- 24:28Speaker 4: Sure.
- 24:29Speaker 1: First off, there are some electoral college reforms that have
- 24:34Speaker 1: come out of the January sixth commite.
- 24:37Speaker 3: Like abolser they're getting rid of it, right?
- 24:38Speaker 1: Yeah, I think are they abolishing it all together? Let
- 24:40Speaker 1: me check. No, Unfortunately, that is not what we're doing,
- 24:43Speaker 1: because that seems like it would have been the easiest
- 24:46Speaker 1: fix if they were to just come out and say, hey,
- 24:49Speaker 1: let's just go with popular vote. What do you think?
- 24:51Speaker 3: Yeah, I mean, that's just never it's never going to happen.
- 24:54Speaker 3: I want it needs to happen, it should happen, but like,
- 24:57Speaker 3: there's way too many vested ins in keeping that around
- 25:03Speaker 3: that it's just not going to happen.
- 25:05Speaker 1: But they did pass an overhaul of the Electoral Count
- 25:10Speaker 1: Act as part of Congress's year end spending bill. Senate
- 25:15Speaker 1: approved it to bipartisan support.
- 25:17Speaker 3: Baby, yeah, now it goes we might need to read.
- 25:21Speaker 1: Yeah, we probably need to see what else is in here.
- 25:24Speaker 1: It goes to Biden to sign off on. He's probably
- 25:27Speaker 1: gonna have to check with the Saudis first or something,
- 25:30Speaker 1: but I'm sure it'll pass. One of the changes is
- 25:35Speaker 1: added wording that makes it clear that the Vice president's
- 25:39Speaker 1: role in the certification process is strictly ceremonial and has
- 25:44Speaker 1: no say in determining who won. Which that's that's good.
- 25:48Speaker 1: That's the part that almost got Mike Pence hanged last
- 25:52Speaker 1: time around. So yeah, so yeah, protect Mike Pence.
- 25:57Speaker 3: I guess I guess good.
- 26:00Speaker 1: Hey, Mike Pence is safe that if you, I don't
- 26:04Speaker 1: know how much. Probably none of Mike Pence's account of
- 26:08Speaker 1: January sixth you've read, but it's actually pretty fascinating, Like, yeah,
- 26:13Speaker 1: you can tell he kind of felt like Secret Service
- 26:17Speaker 1: might kidnap him, like he had he has his own
- 26:20Speaker 1: secret Service. And that guy was like, all right, get
- 26:23Speaker 1: in this car, and Mike Pence was like, no, I'm
- 26:26Speaker 1: not getting in a car without you, Like you were
- 26:29Speaker 1: the only person on my side right now. It's fucking intense.
- 26:34Speaker 3: Yeah.
- 26:35Speaker 1: They also raised the threshold required for members of Congress
- 26:39Speaker 1: to object to certifying the electors. Previously, only one member
- 26:44Speaker 1: of the House and Senate had to object to force
- 26:48Speaker 1: a role call. And it's a thing that happens a lot.
- 26:50Speaker 1: Democrats did it to object to certifying George W. Bush
- 26:54Speaker 1: and Trump both, but the difference is when Democrats did it,
- 26:58Speaker 1: they had already conceded those When Republicans did it for
- 27:02Speaker 1: Trump in twenty twenty, they were like minutes away from
- 27:06Speaker 1: the riots having just ended.
- 27:09Speaker 3: Also, George W. Bush had legitimately been illegally installed as president,
- 27:14Speaker 3: and so I think protesting that was appropriate.
- 27:17Speaker 1: Yeah, the Supreme Court gave George Bush that election. We
- 27:22Speaker 1: still need to do an episode about the two thousand
- 27:24Speaker 1: and four election that you.
- 27:26Speaker 3: Could do like six.
- 27:27Speaker 1: Yeah, that was a legitimately shady election, and yeah, we
- 27:34Speaker 1: didn't do shit about it, like not a thing. But
- 27:39Speaker 1: that's neither here nor there. Republicans, we'll get to it.
- 27:43Speaker 1: So now one fifth of each chamber would be required
- 27:47Speaker 1: to force a vote. They also put a law in
- 27:49Speaker 1: place that bars Congress from considering elector slates submitted by
- 27:53Speaker 1: any state official other than the governor was required to
- 27:57Speaker 1: sign off on slates before they're sent to Congress. And
- 28:01Speaker 1: the new legislation also closes a loophole that wasn't used
- 28:04Speaker 1: in twenty twenty that says a state legislature can name
- 28:07Speaker 1: electors in defiance of their state's popular vote in the
- 28:11Speaker 1: event of a quote failed election. You won't believe this,
- 28:15Speaker 1: but up to this point, failed hadn't really been defined
- 28:20Speaker 1: all that well. So you could, you know, get a
- 28:23Speaker 1: governor who comes out and says, well, too many black
- 28:27Speaker 1: people voted, so this is a failed election. Let's send
- 28:31Speaker 1: an alternate slate of electors, So now that can't happen. Cool. Also,
- 28:35Speaker 1: abolish the fucking electoral college.
- 28:37Speaker 3: Yeah, we should get rid of it. It doesn't apply
- 28:41Speaker 3: to our modern world.
- 28:44Speaker 1: No, no, it really doesn't. But let's talk about this
- 28:47Speaker 1: next story. This is the story that it might be
- 28:51Speaker 1: the weirdest to me, sure, or maybe I'm just overthinking it.
- 28:56Speaker 1: Do you find any part of this next story suspicious
- 28:59Speaker 1: at all?
- 29:01Speaker 3: I mean, I obviously there are a lot of weird
- 29:05Speaker 3: and suspicious and shady things about this story, But the
- 29:11Speaker 3: connection between a crypto guy and the Proud Boys is
- 29:16Speaker 3: not especially shocking to me. I don't find that too.
- 29:21Speaker 1: I don't find that part shocking at all.
- 29:23Speaker 3: That's not the part that's I mean, obviously there's weird shit.
- 29:26Speaker 1: Because here's the thing. A crypto bro accidentally wrote the
- 29:31Speaker 1: Proud Boys Capital storming document. And that's the headline you're seeing,
- 29:35Speaker 1: is that a crypto advocate. They call him, you know,
- 29:40Speaker 1: they don't call him a crypto bro. That's that's me talking, sure,
- 29:43Speaker 1: he is absolutely a crypto bro. And that's what all
- 29:47Speaker 1: the headlines are saying is, oh, this crypto guy wrote
- 29:51Speaker 1: this document and handed it off to the Proud Boys.
- 29:54Speaker 1: What they're not saying is that crypto guy was like
- 29:57Speaker 1: a he wasn't CIA, but he was like Special Operations
- 30:03Speaker 1: and was being groomed to join the CIA before he
- 30:07Speaker 1: conveniently pivoted to crypto And none of the headlines are
- 30:11Speaker 1: mentioning that part that a government official wrote the Proud
- 30:17Speaker 1: Boys seventeen seventy six returns document as right part of
- 30:22Speaker 1: his like like he says it was a private document
- 30:25Speaker 1: that he just wrote as part of like some wargame
- 30:27Speaker 1: stuff he was putting together. H But it's like, yeah,
- 30:31Speaker 1: you do that in your spare time. Sure that wasn't
- 30:33Speaker 1: like games. Sure that wasn't work related at all.
- 30:36Speaker 3: Like what kind of wargame involves this? I would love
- 30:42Speaker 3: to know, like it needs Like I don't necessarily doubt
- 30:45Speaker 3: that this was developed for wargame. But was it like
- 30:50Speaker 3: a leftist Sevci's control of the nation and we must
- 30:53Speaker 3: take it back wargame because in that case, it's not
- 30:57Speaker 3: like much of a defense buddy.
- 30:59Speaker 1: Yeah, he's as he wrote it for like a war
- 31:01Speaker 1: games type thing, but he was laying out a scenario
- 31:05Speaker 1: where a right wing element could basically take over the government.
- 31:10Speaker 3: Yeah.
- 31:11Speaker 1: The document is called seventeen seventy six Returns, and we.
- 31:15Speaker 3: Should we should fucking right wing be They're so fucking nerdy,
- 31:20Speaker 3: they're just such losers. Oh my god, seventeen seventy six Returns.
- 31:25Speaker 3: Fuck off Jesus.
- 31:26Speaker 1: Meanwhile, I'm not a single flute in that fucking crowd.
- 31:30Speaker 3: Right, Yeah, this is seventeen seventy six Returns. Where's the
- 31:33Speaker 3: musical numbers?
- 31:34Speaker 1: Ah, where's the drums? Where are the fucking drums?
- 31:37Speaker 3: Give me a fucking fife, man, And here's the thing.
- 31:40Speaker 1: I bet there was. I bet there was absolutely fucking
- 31:44Speaker 1: larp ass motherfucker playing drums in the fucking fight, wearing
- 31:48Speaker 1: a stupid goddamn.
- 31:49Speaker 3: Hat fuck trike corner hat motherfucker.
- 31:54Speaker 1: So this document seventeen seventy six returns. It is kind
- 31:58Speaker 1: of the centerpiece of conspiracy charges that Proud Boys leaders
- 32:03Speaker 1: are facing over the Capitol riot. And it's a document
- 32:07Speaker 1: that outlined strategic plans for the takeover of US government buildings.
- 32:13Speaker 1: On January sixth, twenty twenty one, called for occupying several
- 32:17Speaker 1: DC government buildings, three Senate offices, three Congress offices, the
- 32:22Speaker 1: Supreme Court, and the CNN headquarters in d C. Nerds, Yeah,
- 32:28Speaker 1: fucking nerds, Like why just CNN And maybe they're the
- 32:32Speaker 1: only ones who have a building in DC, but like
- 32:34Speaker 1: there's gonna be other news outlets who don't agree with you.
- 32:38Speaker 3: That's like CNN is the symbolic yeah enemy.
- 32:44Speaker 1: Yeah, I owned a CNN T shirt for a while,
- 32:48Speaker 1: And it's a fun way to like smoke out right
- 32:52Speaker 1: wingers in your orbit, because anyone who looks at and goes, oh,
- 32:56Speaker 1: you look fake news, it's like, oh, I know what,
- 32:58Speaker 1: I know who the fuck you are?
- 33:00Speaker 3: Gross. I mean, like, yeah, CNN sucks, but you're saying.
- 33:06Speaker 1: They absolutely suck. Weirdly, the Capitol was not on the
- 33:10Speaker 1: list of buildings to infiltrate.
- 33:13Speaker 3: I would say, and I'm not a legal expert, but
- 33:17Speaker 3: if there's one thing that would be a way to
- 33:20Speaker 3: get these people like out of trouble, it's that, Yes,
- 33:23Speaker 3: the fact that the Capitol building isn't on their supposed plan.
- 33:28Speaker 1: Right, it's shown in a Google Map screenshot on the
- 33:32Speaker 1: final page of the document. And we'll talk about the
- 33:36Speaker 1: guy who wrote it in a minute, but that's kind
- 33:38Speaker 1: of his argument, is well, he wrote like the foundation
- 33:42Speaker 1: of it, and then it got to the Proud Boys
- 33:45Speaker 1: and they added all this extra shit, So that would
- 33:48Speaker 1: explain the Capital only showing up in a Google Map
- 33:52Speaker 1: screen shot. I guess I'm just doing a little bit
- 33:55Speaker 1: of lawyer in here on this guy.
- 33:57Speaker 3: Sure behalf Like, I'm not thinking that this guy is
- 34:00Speaker 3: or any of the Proud Boys are innocent, so to speak,
- 34:04Speaker 3: But that would just that's just the first thing that
- 34:07Speaker 3: pops to my mind as like, oh, that seems like
- 34:09Speaker 3: an easy loophole.
- 34:10Speaker 1: Yeah, it's a five stage plan infiltrate, execute, distract, occupy
- 34:18Speaker 1: sit in. I'm guessing from where it is in the
- 34:21Speaker 1: hierarchy that execute doesn't actually mean execute government officials. This
- 34:27Speaker 1: feels like more of a protest than a murder plan.
- 34:31Speaker 3: Just gonna say, yeah, if it's if it's killing people,
- 34:34Speaker 3: I feel like execute has to come after sit in.
- 34:38Speaker 3: Otherwise it's a weird de escalation.
- 34:41Speaker 1: Yeah. Yeah, by that point, like you should just move
- 34:43Speaker 1: in if if you've pulled off all that other shit,
- 34:47Speaker 1: it's hot work.
- 34:48Speaker 3: Also, occupy and sit in our separate Like.
- 34:51Speaker 1: Yeah, steps those those are two two different things for
- 34:55Speaker 1: some reason, But I haven't read the document. I'm not
- 34:58Speaker 1: a proud boy. No, it feels like such a weird thing.
- 35:03Speaker 1: I'm not a proud boy shamed.
- 35:06Speaker 3: Not only not only is it a weird thing to
- 35:09Speaker 3: say about yourself, Like it's a it's a very stupid name.
- 35:12Speaker 3: It sounds like something that Toddler would say. It's like
- 35:15Speaker 3: you're talking about that, Oh, who's a proud boy. But
- 35:17Speaker 3: also it comes from Aladdin.
- 35:19Speaker 1: Oh that's right, I forgot about that.
- 35:22Speaker 3: Like it comes from a song that was deleted from
- 35:25Speaker 3: Aladdin called Proud of Your Boy. And they're like they
- 35:29Speaker 3: deleted that song so that boys wouldn't feel proud. So
- 35:33Speaker 3: we're gonna be the Proud Boys. It's like you are
- 35:36Speaker 3: getting upset about a deleted Disney.
- 35:40Speaker 1: Song Disney outtake.
- 35:43Speaker 3: Yeah, Jesus, guys, Calm, calm the fucked out.
- 35:46Speaker 1: Waiting for the box set. It'll come out, jeez. So
- 35:51Speaker 1: what's weird about this document is who wrote it and
- 35:55Speaker 1: how it got to the Proud Boys, Like we said,
- 35:58Speaker 1: a crypto bro from Florida named Samuel Armis told the
- 36:02Speaker 1: January sixth Committee during an interview that he didn't write
- 36:06Speaker 1: the document and had no role in the planning or
- 36:10Speaker 1: execution of the riot, but he said he did help
- 36:12Speaker 1: formulate some of the ideas that the document relied on.
- 36:17Speaker 1: And what I find suss here again is that all
- 36:22Speaker 1: of these articles just describe him as a cryptocurrency advocate. Sure,
- 36:26Speaker 1: what they don't call him is a former State Department
- 36:29Speaker 1: and Special Operations official who was quote groomed to join
- 36:35Speaker 1: the CIA and FBI before his stint in the State
- 36:39Speaker 1: Department and Special Operations end quote. He says the poll
- 36:45Speaker 1: the parts of the seventeen seventy six document he recognized
- 36:49Speaker 1: as his work were written as part of a quote
- 36:52Speaker 1: wargaming exercise end quote that he did in August or
- 36:56Speaker 1: September of twenty twenty, so you know, mere months before
- 37:02Speaker 1: the Capitol riot, a former special Operations officer writes a
- 37:09Speaker 1: strategic plan for occupying government buildings in Washington, DC. And
- 37:17Speaker 1: he says it was meant to be a private document,
- 37:20Speaker 1: but also that he shared it with a crypto friend
- 37:22Speaker 1: named Erica Flores. Sure, and he said, this is where
- 37:27Speaker 1: the stories diverge. He says he just forgot all about it,
- 37:32Speaker 1: and then at one point he recognizes some of his
- 37:36Speaker 1: thoughts and ideas in this Proud Boys document. What Erica
- 37:40Speaker 1: Flores says is no, this guy wrote it and asked
- 37:43Speaker 1: me to give it to the leader of the Proud Boys.
- 37:45Speaker 1: He knew that we were friends and he just asked.
- 37:48Speaker 1: And I'm sorry, but the second one sounds more reasonable
- 37:52Speaker 1: to me, Like I think this guy just wrote this
- 37:55Speaker 1: and gave it to the Proud Boys.
- 37:58Speaker 3: Sure, I don't know.
- 38:01Speaker 1: I mean it does. It matters a little bit, because I'm.
- 38:05Speaker 3: Not dismissing it. It's just that, like I literally have
- 38:08Speaker 3: no way of knowing whether what should account of this
- 38:11Speaker 3: is true. And I totally can like buy that he
- 38:14Speaker 3: is the guy who wrote this, especially with his weird
- 38:18Speaker 3: ass background.
- 38:20Speaker 1: Yeah, it is interesting to me because there have always
- 38:23Speaker 1: been those rumors surrounding the Capitol riot that the FBI
- 38:30Speaker 1: wasn't necessarily involved. Well, I mean I've heard the FBI
- 38:33Speaker 1: was involved, sure, like all the way down to Well,
- 38:37Speaker 1: the FBI knew that something might happen and just didn't
- 38:41Speaker 1: really say anything. And I'm gonna be honest, that is
- 38:45Speaker 1: vintage FBI, if nothing else, Like we know the FBI,
- 38:50Speaker 1: by their own admission, there were like ten FBI agents
- 38:54Speaker 1: in the room when Malcolm X was killed. Sure, so
- 38:57Speaker 1: they definitely weren't involved. They were just there as you know,
- 39:00Speaker 1: excited spectators to see it happen.
- 39:02Speaker 3: Yeah, they've always had an interest in the black freedom.
- 39:06Speaker 3: It was sorry, I just keep every time this comes up,
- 39:09Speaker 3: I think about that quote from the FBI museum.
- 39:12Speaker 1: Yeah, they've always been very interested in civil rights. Yeah, yeah,
- 39:17Speaker 1: you sure have, you sure have. And I don't know,
- 39:21Speaker 1: this just kind of reeks of that to me. Also,
- 39:25Speaker 1: like this this feels like, I mean, he's he's the
- 39:28Speaker 1: one who said he was being groomed to join the
- 39:31Speaker 1: CIA or FBI, and we know he was working in
- 39:36Speaker 1: special operations, which just sounds like domestic CIA probably sure,
- 39:42Speaker 1: And so like, I don't know that someone in that
- 39:45Speaker 1: position wrote this and then passed it off to the
- 39:48Speaker 1: Proud Boys. It feels conspiratorial to.
- 39:51Speaker 3: Me, sure, but I know what you mean.
- 39:54Speaker 1: Apparently the January sixth Committee did not see it that way.
- 39:57Speaker 3: Yeah, I mean, I guess we'll find out more of it. Yeah,
- 40:02Speaker 3: but who knows. I mean, yeah, Like I had nothing
- 40:05Speaker 3: about this would surprise me if like more evidence came out.
- 40:09Speaker 1: And the thing about the Capital Riots that always stood
- 40:13Speaker 1: out to me is that it was, whether it was
- 40:16Speaker 1: intended to be or not, it was a really great
- 40:19Speaker 1: honeypot operation because given all of the cameras and all
- 40:24Speaker 1: the facial recognition technology we have, like that was a
- 40:28Speaker 1: great way to smoke out like the truly most radical
- 40:32Speaker 1: elements in American politics and get them all in the
- 40:36Speaker 1: same place where you can identify them and infiltrate their shit.
- 40:41Speaker 3: Yeah, although I feel like if it were like this
- 40:44Speaker 3: has been kind of my whole thing about the January
- 40:47Speaker 3: six is that, like, if it were really the most
- 40:50Speaker 3: radical elements of the fringe right, I feel like more
- 40:54Speaker 3: people would have died.
- 40:56Speaker 1: Right, And so does that speak to there being some
- 40:59Speaker 1: government involvement? Because they did get right they got right
- 41:04Speaker 1: to the cusp. They were so fucking close, and then
- 41:08Speaker 1: it just like kind of stopped. There were moments where
- 41:11Speaker 1: there were actually elected officials, like up in the balcony areas. Yeah,
- 41:17Speaker 1: and the rioters were just down there and like either
- 41:20Speaker 1: didn't see the people up there or didn't care that
- 41:23Speaker 1: there were people up there. So I don't know.
- 41:26Speaker 3: Yeah, I don't know.
- 41:28Speaker 1: So let's talk about the big question. Sure, here, can
- 41:33Speaker 1: Trump still run for office if he is convicted of
- 41:37Speaker 1: a felony goes to prison, Will that bar him from
- 41:40Speaker 1: running for president in the future. And here's the thing,
- 41:43Speaker 1: probably not.
- 41:44Speaker 3: No.
- 41:45Speaker 1: Well link to an Ohio Capital Journal article written by
- 41:49Speaker 1: a writer named Stephanie Lundquist. Really well written, goes into
- 41:53Speaker 1: all of the ins and outs of this question and
- 41:55Speaker 1: all the possible scenarios. But the first thing they point
- 42:00Speaker 1: now is the simplest, which is that the Constitution is
- 42:04Speaker 1: pretty clear about what the requirements to run for president are,
- 42:07Speaker 1: and they are No person except a natural born citizen
- 42:12Speaker 1: or a citizen of the United States at the time
- 42:15Speaker 1: of the adoption of this Constitution shall be eligible to
- 42:18Speaker 1: the office of President. Neither shall any person be eligible
- 42:22Speaker 1: to that office who shall not have attained to the
- 42:25Speaker 1: age of thirty five years and been fourteen years a
- 42:29Speaker 1: resident within the United States. So the new fangled way
- 42:33Speaker 1: of saying that is you have to be thirty five
- 42:36Speaker 1: years old, you have to be a resident, and you
- 42:38Speaker 1: have to have been a resident for fourteen years. That's it.
- 42:41Speaker 1: That's it.
- 42:42Speaker 4: Yep.
- 42:42Speaker 1: All the Constitution says doesn't say anything about being a
- 42:47Speaker 1: convicted felon.
- 42:48Speaker 3: No, And I'd like to say, I think that's good. Yeah,
- 42:52Speaker 3: I don't think being a convicted felon should bar you
- 42:55Speaker 3: from running for any office, especially president, because, especially with
- 43:00Speaker 3: our fucking justice system, that should just not be something
- 43:04Speaker 3: like it's weird to say that when we're talking about
- 43:07Speaker 3: it in the context of Trump, who obviously sucks ass.
- 43:11Speaker 3: And I would not want running to be able to
- 43:13Speaker 3: run for president again, but like we have no reason,
- 43:17Speaker 3: Like I just don't want to ever be the person saying, yeah,
- 43:21Speaker 3: if someone's a convicted fella, they shouldn't be able to
- 43:23Speaker 3: run for office. Absolutely should be able to absolutely should
- 43:26Speaker 3: be able to vote, and have all the rights of
- 43:28Speaker 3: a citizen agreed.
- 43:30Speaker 1: The article also points out, though, that the Supreme Court
- 43:34Speaker 1: has made it pretty clear that Congress and or the
- 43:37Speaker 1: States have no authority to alter the qualifications for holding
- 43:41Speaker 1: public office. They point to a nineteen sixty nine ruling
- 43:45Speaker 1: nice after the House of Representatives barred pastor and New
- 43:49Speaker 1: York politician Adam Clayton Powell Junior from taking his seat
- 43:54Speaker 1: in the ninetieth Congress. They wanted to ban him because
- 43:57Speaker 1: he diverted campaign funds and made false reports. Supreme Court
- 44:02Speaker 1: rule they couldn't do that, and Powell was allowed to
- 44:05Speaker 1: take office. And so it seems like if it comes
- 44:08Speaker 1: down to it, I mean, of course, the Supreme Court
- 44:11Speaker 1: is going to side with Trump anyway, like as it's
- 44:15Speaker 1: currently constructed, but it seems like historically they're just going
- 44:19Speaker 1: to side with Trump also. But there is section three
- 44:24Speaker 1: of the fourteenth Amendment which disqualifies any person from holding
- 44:28Speaker 1: federal office quote, who, having previously taken an oath to
- 44:32Speaker 1: support the Constitution of the United States, shall have engaged
- 44:37Speaker 1: in insurrection or rebellion against the same, or given aid
- 44:43Speaker 1: or comfort to the enemies thereof. That's the one that
- 44:47Speaker 1: might keep Trump from running again, because that is one
- 44:51Speaker 1: of the charges, is giving aid or comfort to an insurrection.
- 44:56Speaker 1: So if he is charged and convicted of that crime,
- 45:01Speaker 1: according to the Constitution, he should not be able to
- 45:04Speaker 1: run for president again.
- 45:06Speaker 3: And I think that's fair. I think that's a wholly
- 45:09Speaker 3: different matter than being a felon. Yeah, like, this is
- 45:13Speaker 3: very specific circumstances.
- 45:15Speaker 1: Yeah, it's way different than you have DUIs on your record.
- 45:18Speaker 1: You can't be president. It's like, sure you can, why not?
- 45:22Speaker 1: Very different thing, right, So even then that's probably going
- 45:26Speaker 1: to go back and forth in court. Sure, if it happens,
- 45:31Speaker 1: he could still run even if he is in prison.
- 45:34Speaker 1: That is a thing that's happened. In seventeen ninety eight,
- 45:38Speaker 1: House Member Matthew Lyon was elected to Congress from a
- 45:41Speaker 1: jail cell. Eugene Debs, who was the founder of the
- 45:45Speaker 1: Socialist Party of America, ran for president in nineteen twenty
- 45:48Speaker 1: while serving a prison sentence for sedition yikes, and won
- 45:53Speaker 1: more than nine hundred thousand votes. And Lyndon Larush's crazy
- 45:57Speaker 1: ass also ran for president from a jail cell in
- 46:00Speaker 1: nineteen ninety two.
- 46:01Speaker 3: God, I forgot about Lyndon LaRue. Jesus fucking Christ.
- 46:05Speaker 1: Yeah, we did an episode about him. He was He
- 46:08Speaker 1: was a real character. I know, a comedian whose brother
- 46:10Speaker 1: like fell into the Lyndon Larouge.
- 46:13Speaker 3: Cult weird wrapped up in it.
- 46:16Speaker 1: Yeah, that's you don't expect that like now, like in
- 46:20Speaker 1: modern times, did Lyndon Larouge die. I don't even know
- 46:23Speaker 1: what that fucking guy looks like.
- 46:25Speaker 3: I have no idea. If he's still alive.
- 46:27Speaker 1: Well, the people need to know. He died in twenty nineteen,
- 46:32Speaker 1: but Olivia the movement carries on. Oh good, don't worry.
- 46:37Speaker 3: I was. I was worried.
- 46:39Speaker 1: So yeah, it seems like this, unless he gets literally
- 46:43Speaker 1: charged with insurrection, is probably not going to keep Trump
- 46:47Speaker 1: from running again. But right if he was in prison
- 46:50Speaker 1: and somehow got elected, the vice president could always just
- 46:54Speaker 1: like twenty fifth Amendment him, so sure we'd have that
- 46:57Speaker 1: going for us. But also, there's no way Trump is
- 47:00Speaker 1: winning an election in twenty twenty four. I think all
- 47:04Speaker 1: of this like it's interesting legal talk, but I don't
- 47:07Speaker 1: think anyone's under the impression that Trump's going to win
- 47:11Speaker 1: an actual election in twenty twenty four. I don't. I
- 47:15Speaker 1: think we have hit the point in history where he's
- 47:17Speaker 1: not going to get the Republican nomination, Like they would
- 47:20Speaker 1: be out of their minds to not nominate Ron DeSantis
- 47:25Speaker 1: the way he performed in Florida, he won like one
- 47:29Speaker 1: hundred and eighteen percent of the vote. There's no way.
- 47:31Speaker 3: But like DeSantis against independent Trump, I don't think stands
- 47:37Speaker 3: a chance.
- 47:38Speaker 1: Well that's the thing. I do feel like Trump will
- 47:41Speaker 1: run as an independent sure, and if that is at
- 47:46Speaker 1: all close in the end, there will be another Capital riot.
- 47:51Speaker 1: There will absolutely let It'll just be directed at Ron DeSantis,
- 47:56Speaker 1: I guess.
- 47:56Speaker 3: But like and also like, there's no way if Trump
- 47:59Speaker 3: runs it that his vice presidential pick would be someone
- 48:04Speaker 3: who would twenty fifth amendment him.
- 48:05Speaker 1: Oh no, if he was in prison, well, I don't know,
- 48:09Speaker 1: because Trump is gonna pick some evil fuck face. Like
- 48:13Speaker 1: I think it's gonna be like Carrie Lake or Marjorie
- 48:15Speaker 1: Taylor Green. And in that case, I don't trust them
- 48:18Speaker 1: to not stab Trump in the back if he's in prison.
- 48:22Speaker 3: Maybe, but I feel like anybody, first of all, he's
- 48:25Speaker 3: gonna be very selected. I don't think we're gonna get
- 48:27Speaker 3: another Mike Pins or somebody, you know, like I do think.
- 48:31Speaker 1: I do think it's gonna be carry Lake.
- 48:32Speaker 3: Maybe, But like the thing is, like I feel like
- 48:36Speaker 3: anybody who they're not gonna backstab him because they know
- 48:40Speaker 3: that he's where the power comes. It's much easier to work,
- 48:44Speaker 3: like exercise power through him, yeah, than it is to
- 48:47Speaker 3: try to take his power, because you can't. If you
- 48:51Speaker 3: backstab him, his followers are not gonna be on your side.
- 48:54Speaker 1: Oh no, definitely not. I mean it's I was just
- 48:57Speaker 1: offering it up as a possible solution. I don't think
- 49:01Speaker 1: it would actually happen, sure, But again, I also don't
- 49:05Speaker 1: think Trump is going to win an election fair and square,
- 49:09Speaker 1: even if he runs as a third party, because there
- 49:14Speaker 1: is a big cult of personality around Ron DeSantis too.
- 49:20Speaker 1: And Ron DeSantis is going to be offered up as
- 49:25Speaker 1: a moderate alternative to Trump, which is bullshit. He's not
- 49:30Speaker 1: moderate in the slightest like he is Trump. The only
- 49:34Speaker 1: difference is he doesn't dispute the results of the twenty
- 49:36Speaker 1: twenty election. The bar is so low now that like
- 49:40Speaker 1: that makes him moderate compared to Trump in a lot
- 49:43Speaker 1: of people's eyes. And I tell you where he will
- 49:47Speaker 1: also get secret votes is he'll get some votes from
- 49:53Speaker 1: people who maybe consider themselves like Democrats or more liberal leaning,
- 50:00Speaker 1: but who also feel like woke is getting a little
- 50:04Speaker 1: out of control. He'll get votes from them too, because
- 50:08Speaker 1: that's Ron DeSantis's whole thing is Florida is where woke
- 50:14Speaker 1: goes to die, and great, I'm telling you he will.
- 50:19Speaker 1: People won't be vocal about it. It'll be that like
- 50:22Speaker 1: silent majority type shit where people are like, yeah, man,
- 50:25Speaker 1: I'm not I'm not voting for Ron de Santis, and
- 50:28Speaker 1: those motherfuckers will secretly vote for Ron de Santis just
- 50:32Speaker 1: so like white dudes get more representation in movies going forward.
- 50:36Speaker 1: I don't know, but maybe DeSantis is he's he's going
- 50:40Speaker 1: to be a dangerous candidate in twenty twenty four.
- 50:44Speaker 3: I mean, obviously he's an evil piece of shit who
- 50:48Speaker 3: uh should be strung behind a horse and ridden through
- 50:52Speaker 3: the country. But like you know, yeah, I don't know
- 50:56Speaker 3: as for whether like Trump would take the election or
- 50:59Speaker 3: I don't know, do something to seize control. Maybe, but he,
- 51:04Speaker 3: I like with Trump, I could also just as easily
- 51:09Speaker 3: see him like being a lazy bitch about it because
- 51:13Speaker 3: he like those are the two wolves inside of him
- 51:16Speaker 3: are power hungry, egomaniac and a lazy bitch.
- 51:20Speaker 1: And so yeah, he just he hates to lose, that's
- 51:24Speaker 1: the problem. And yeah, I don't know, that's just his
- 51:28Speaker 1: base is so fucking unpredictable. That's it is. That's I agree,
- 51:32Speaker 1: the whole thing. And they're so committed to him as
- 51:36Speaker 1: a person that, like any like if it comes to
- 51:39Speaker 1: pass that he has charged and arrested, like that's gonna
- 51:42Speaker 1: be the thing. We won't have to wait until twenty
- 51:44Speaker 1: twenty four, Like, yeah, that will turn into that's where
- 51:48Speaker 1: the protests will come from. And then it's kind of like,
- 51:52Speaker 1: you know, the NFL playoffs, Like it doesn't matter how
- 51:55Speaker 1: bad a team is, once they get to the playoffs,
- 51:58Speaker 1: there's a decent chance they might win the super Bowl.
- 52:01Speaker 1: And if you get to the point where enough people
- 52:05Speaker 1: take to the streets because they're mad that Trump isn't
- 52:08Speaker 1: going to be allowed to run for office, it's kind
- 52:11Speaker 1: of up to the military at that point. You gotta
- 52:14Speaker 1: hope the military makes the right choice and sides with
- 52:19Speaker 1: the government and not the people. I feel weird saying that, but.
- 52:24Speaker 3: I don't know about any of that, but I.
- 52:27Speaker 1: Will say that's how KU's happened, Like it down to
- 52:31Speaker 1: who the military sides with.
- 52:33Speaker 3: I absolutely understand that. But I will say that it's
- 52:37Speaker 3: a good thing that we have such a strong incumbent
- 52:42Speaker 3: in uh a, wait, Joe Biden. Fuck well, Biden.
- 52:48Speaker 1: We also have that system of checks and balances that
- 52:51Speaker 1: will keep Trump from ever taking power.
- 52:53Speaker 3: Oh sure, yeah, and that's been really good at dealing
- 52:55Speaker 3: with him in the past.
- 52:56Speaker 1: Yeah, yeah, it's it's taken care of everything. So yeah,
- 53:00Speaker 1: I guess we'll see how this week unfolds. Uh, got
- 53:03Speaker 1: that anniversary coming up, and uh, yeah, this is this
- 53:06Speaker 1: is a story we'll keep following. Obviously, this is a
- 53:09Speaker 1: this is a big one. And if you've read the
- 53:12Speaker 1: eight hundred and forty five page January sixth Committee report,
- 53:16Speaker 1: please report back to me and Olivia with what's in it. Actually, don't,
- 53:20Speaker 1: because we'd have to just glorify it for ourselves at
- 53:23Speaker 1: that point. Might as well just read it. You know.
- 53:26Speaker 1: A bunch of lamees go to the library, push our
- 53:29Speaker 1: glasses up. Ooh, looks meeting books in the government.
- 53:34Speaker 3: Uh look, sometimes my glasses slip to the base of
- 53:38Speaker 3: my nose and I need to push them back up.
- 53:41Speaker 1: Can't help it while I'm correcting someone's point about Marvel.
- 53:45Speaker 3: Movements, I can't help the timing.
- 53:49Speaker 1: So I think that's our episode, right, I think so.
- 53:52Speaker 1: I think we did it. We're talking about some equally
- 53:56Speaker 1: heavy subject matter next week. On.
- 53:59Speaker 3: Oh yeah, absolutely.
- 54:01Speaker 1: A bonus episode about a documentary that we've covered one
- 54:07Speaker 1: of them. We covered the first documentary on the Pretty
- 54:10Speaker 1: Scary podcast. Me and Cindy Ravina covered it, and Olivia
- 54:15Speaker 1: and I are covering part two of the Sir No
- 54:18Speaker 1: Face documentary this one two Face the Gray and now.
- 54:23Speaker 3: If you can believe it, the name makes even less
- 54:27Speaker 3: sense than sir No Face.
- 54:29Speaker 1: So it sure does. So h be on the lookout
- 54:33Speaker 1: for that. That'll be a bonus episode coming out next week.
- 54:36Speaker 1: And do we have anything to plug before we get
- 54:39Speaker 1: out of here? I am doing comedy again for the
- 54:42Speaker 1: first time since COVID. I have a show February third
- 54:46Speaker 1: at the Sardine in San Pedro. It is a punk
- 54:51Speaker 1: rock club. There is a banging taco truck across the street,
- 54:56Speaker 1: very neat venue. Tickets are going to be cheap. They'll
- 54:59Speaker 1: be on sale soon. They're only five dollars. I'm gonna
- 55:02Speaker 1: be on it. Jeff May will be on it. A
- 55:04Speaker 1: Tiff Myers is hosting, and we're still booking more comics.
- 55:10Speaker 1: Danger and countless thousands are doing a set. So come
- 55:15Speaker 1: out comedy and music please, And uh, that's all I
- 55:20Speaker 1: want to plug? How about you. What do you got.
- 55:23Speaker 3: We've got going back, our lost rewatch podcasts, rounding third,
- 55:29Speaker 3: heading into home, finishing up the season pretty soon and
- 55:33Speaker 3: then that will be free for everybody. And if you
- 55:36Speaker 3: want to get a head start on it, check out
- 55:38Speaker 3: the Conspiracy the Show Patreon page.
- 55:41Speaker 1: Do that and uh, I think that's it. Let's get
- 55:44Speaker 1: out of here, Olivia say goodbye bye, goodbye, everybody. We
- 55:48Speaker 1: love you.
- 55:53Speaker 4: People, Instant Strut, Instant Station, and the Bats.
- 56:07Speaker 1: That is true.
