Transcript
- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on Yo Gabble Gabble, if you hire a
- 0:14Speaker 2: social media influencer to help your hotel get business and
- 0:17Speaker 2: then you creep on her, does she owe you for
- 0:20Speaker 2: the contract she didn't fulfill?
- 0:22Speaker 1: Judge Ross is here with some semblance of dignity.
- 0:26Speaker 3: And if your snowball fight goes a little too far,
- 0:29Speaker 3: can you sue for it?
- 0:31Speaker 1: And Judge Press tells us real people, real cases, fake justice.
- 0:34Speaker 1: This is Yo Gabo Gabo! Wow, wow, wow. Man, a
- 0:40Speaker 1: snowball fight sounds so wonderful, man. Doesn't it? Sounds like
- 0:43Speaker 1: a better day than what I'm having. You know what
- 0:45Speaker 1: I mean? I love a snowball fight. Don't you? I
- 0:47Speaker 1: love snow. I love winter. You love winter. You love snow.
- 0:49Speaker 1: You love Christmas. You love all of it. I also
- 0:52Speaker 1: love this show, Yo Gavel Gavel. It's a pretty simple show, Brandon.
- 0:54Speaker 1: It is. What do we do? We watch TV, courtroom cases.
- 0:57Speaker 1: You know the ones.
- 0:58Speaker 2: On the YouTube where you can find them for free.
- 1:01Speaker 2: I watch one, tell Brant about it. He watches one,
- 1:04Speaker 2: tells me about it. We try to guess the verdict.
- 1:06Speaker 2: It's typically a fun time. We get a lot of
- 1:08Speaker 2: reviews that say it's a fun time and a pretty
- 1:10Speaker 2: high rating on the Apple podcast, Brant.
- 1:11Speaker 1: And I think what is important, Dan, is you say... Typically,
- 1:15Speaker 1: it's a fun time.
- 1:16Speaker 3: There are times... Where it is not. Where justice isn't fun.
- 1:19Speaker 2: I'm in a real... Somehow, the cases I'm catching lately...
- 1:23Speaker 2: I handed you the baton of sad cases. I'm in
- 1:26Speaker 2: a real, like, why don't we just believe women era
- 1:28Speaker 2: in my cases.
- 1:29Speaker 1: It's real bad out here. I went through a time
- 1:32Speaker 1: of just having sad cases. And then I handed you
- 1:34Speaker 1: the baton. And it's been worse. And I'm over here
- 1:36Speaker 1: just talking about snowball fights. I'm going to just look up, like, cases.
- 1:39Speaker 1: I'm going to be like, personal injury report clowns. I'm
- 1:42Speaker 1: going to, like.
- 1:43Speaker 3: Figure out a way to get out of this rut.
- 1:46Speaker 3: I'll go first this time, Dano. I want to introduce
- 1:48Speaker 3: you to Daniel Hassel.
- 1:50Speaker 1: Daniel Hassel.
- 1:51Speaker 3: I'm sorry. We're in Christina Perez's courtroom today. Who was
- 1:56Speaker 3: a longtime member of the Hot Bench.
- 1:57Speaker 1: That's right.
- 1:58Speaker 3: She was. Daniel Hassel. Again, the Hot Bench. This isn't
- 2:03Speaker 3: Hot Bench, but a reminder. This is not Hot Bench.
- 2:05Speaker 3: Hot Bench is not about the attractiveness of the judges.
- 2:07Speaker 3: Christina Perez was on Hot Bench, not because of how
- 2:10Speaker 3: she looked, but because she was a judge.
- 2:11Speaker 2: Bench is hot. the people aren't hot or not. We
- 2:16Speaker 2: don't have a comment on this. You don't watch Hot
- 2:20Speaker 2: Bench and go, oh, all those judges are ugly. They're
- 2:24Speaker 2: fine people, but that's not what the show's about. It's
- 2:27Speaker 2: not about the attractiveness of the judges.
- 2:29Speaker 3: If you go into Hot Bench expecting to see a
- 2:33Speaker 3: handful of 10 out of 10s.
- 2:35Speaker 2: We don't have a comment on that. We don't have
- 2:36Speaker 2: a comment on that. You could, or you couldn't. Depending
- 2:39Speaker 2: on your preference, absolutely. The point is that Hot Bench
- 2:42Speaker 2: isn't about how hot they are.
- 2:43Speaker 1: It's not about that.
- 2:44Speaker 3: That's the point. That's not what I'm watching today, though.
- 2:46Speaker 3: I'm watching Christina Perez solo act. Who used to be
- 2:49Speaker 3: on Hot Bench, not for her looks.
- 2:50Speaker 1: Yes. Daniel Hassel is suing Scott Happy. No. Scott Happy.
- 2:56Speaker 1: These are fake names. Daniel Hassel and Scott Happy. Daniel
- 2:59Speaker 1: Hassel's cooing. Scott Happy.
- 3:02Speaker 3: $ 1, 200 for medical bills. Both these boys are hockey players
- 3:09Speaker 3: in college. They go to a college in San Bernardino.
- 3:15Speaker 1: San Bernardino. San Bernardino. Different place altogether.
- 3:17Speaker 3: They played together beginning sophomore year of high school. They
- 3:21Speaker 3: go to the same college together now, but now they're
- 3:24Speaker 3: in court. Scott came over to Daniel's house one night
- 3:28Speaker 3: because it snowed. It doesn't snow very often in San Bernardino.
- 3:31Speaker 3: And so they were both very excited about this. Just
- 3:35Speaker 3: two bros enjoying the snow. They go outside. They make
- 3:40Speaker 3: snow angels together. They build snowmen together. And then Scott
- 3:46Speaker 3: throws a snowball at Daniel. And a fun, lighthearted snowball
- 3:52Speaker 3: fight breaks out. It's just a snowball fight betwixt friends.
- 3:58Speaker 3: That fun, lighthearted snowball fight ended with Daniel.
- 4:04Speaker 1: Getting quite hurt.
- 4:06Speaker 3: Scott began to hurt him with his snowballs because he
- 4:09Speaker 3: began to, there was some ice inside some of those snowballs.
- 4:13Speaker 3: And then Scott, as Daniel was on the ground, Scott
- 4:16Speaker 3: stood over Daniel and chucked a snowball right at his face,
- 4:21Speaker 3: hit his eye, and it had some ice in it.
- 4:24Speaker 1: Stood over him. Stood over him. Man, that's like hammer time.
- 4:27Speaker 2: Yeah.
- 4:28Speaker 1: Did he give like an action, like it's time to
- 4:30Speaker 1: chill out or something like that?
- 4:31Speaker 3: No, but he does describe it here in a minute
- 4:34Speaker 3: in a very interesting way.
- 4:35Speaker 1: Okay.
- 4:36Speaker 3: Right now, actually, Scott says, I don't remember it exactly
- 4:39Speaker 3: that way, but I will say this. Danny was laughing
- 4:41Speaker 3: the entire time.
- 4:42Speaker 1: What?
- 4:43Speaker 3: Even while he said stopped, he was laughing.
- 4:45Speaker 1: It's like, stop, stop. Stop it. Yeah.
- 4:48Speaker 3: And so I thought that it was fun. So yeah,
- 4:51Speaker 3: he's on the ground, and I went for the kill shot.
- 4:54Speaker 2: Yeah, you went for the kill shot. I don't know
- 4:55Speaker 2: if you should say that when you're getting sued. Maybe
- 4:57Speaker 2: the top 10 things you shouldn't say when you're getting sued.
- 5:00Speaker 2: I went for the kill shot. It's got to be
- 5:01Speaker 2: up there. Yeah, should say it.
- 5:03Speaker 1: 100%. So he goes for the kill shot.
- 5:05Speaker 3: He did this, though, fully anticipating Daniel to jump up
- 5:09Speaker 3: and come after him.
- 5:10Speaker 1: It's a snowball fight.
- 5:11Speaker 3: Yeah.
- 5:11Speaker 1: He could be, you know... baiting me or whatever. And
- 5:15Speaker 1: so it's just serious stuff.
- 5:17Speaker 3: So after getting hit in the eye, Daniel begins to
- 5:20Speaker 3: notice pain and the pain is lingering as he's upset
- 5:25Speaker 3: about this. So Scott left because he knew that Daniel
- 5:28Speaker 3: was mad. Daniel says, as hockey players, I'm used to pain.
- 5:31Speaker 3: I'm used to pain in my face. You know, that
- 5:34Speaker 3: happens sometimes. But the lingering pain in my eye, I
- 5:38Speaker 3: knew it wasn't good. I could tell that this was
- 5:40Speaker 3: not good. My eye was bloodshot. He has pictures of
- 5:43Speaker 3: this to prove that, as well as the bill that
- 5:46Speaker 3: he gets from the urgent care that his mom told
- 5:48Speaker 3: him to go to. He gets his eye fleshed out,
- 5:52Speaker 3: and he has to wear a bandage for a while,
- 5:53Speaker 3: and he has a bill.
- 5:56Speaker 2: Of $ 1, 200. If this case was personal injury court, he'd
- 5:58Speaker 2: have an eye patch.
- 5:59Speaker 1: Yes.
- 6:00Speaker 2: You know, and he'd be like, and he'd talk about
- 6:02Speaker 2: how he lost everything. Daniel looks great in this case.
- 6:05Speaker 2: He looks great.
- 6:06Speaker 1: He looks great. Fully healed. Just needs the 1200. That's
- 6:08Speaker 1: exactly right.
- 6:09Speaker 3: So he texts his buddy Scott and says, hey, this happened.
- 6:16Speaker 1: It was your fault. I need you to pay half. Wow.
- 6:21Speaker 3: He's only asking for half. No, he's asking for full
- 6:23Speaker 3: now because Scott refused. Scott said, I'm not going to
- 6:26Speaker 3: pay half. and Daniel's like, my mom wasn't going to
- 6:29Speaker 3: help me with this. She was like, you did this.
- 6:31Speaker 3: You got to pay for it yourself.
- 6:32Speaker 1: You're an adult. You're an adult. So now I owe $ 1, 200.
- 6:36Speaker 3: Scott says, Daniel knew that I didn't come from a
- 6:40Speaker 3: good financial situation. That's why sports is so important to me.
- 6:42Speaker 3: Without sports, I wouldn't be able to go to college
- 6:44Speaker 3: in the first place. I don't have any money.
- 6:46Speaker 1: He knew that.
- 6:47Speaker 3: Daniel says, but you always push it too far, bro.
- 6:51Speaker 3: Scott says, but you have to in sports. You have
- 6:54Speaker 3: to push it all the way. You have to go
- 6:55Speaker 3: for the kill shot. You have to push it as
- 6:57Speaker 3: far as it'll go or else you won't win. Daniel says,
- 7:00Speaker 3: but you hurt me. Scott says, am I competitive?
- 7:04Speaker 1: Yes. Kill shot. Kill shot speaks for itself.
- 7:07Speaker 3: But did I intentionally hurt my friend? Of course not.
- 7:10Speaker 3: Of course I did not. Judge says, why do you
- 7:14Speaker 3: get so competitive with your friends? And Daniel's like, he's
- 7:19Speaker 3: always like this. He's always getting competitive, even with girls.
- 7:22Speaker 3: Judge says, I'm not going to go there. Although I
- 7:25Speaker 3: wish that they would have. I thought that would have
- 7:26Speaker 3: been a fun part of this case, but it's not important.
- 7:28Speaker 3: So Judge says, we're not going there.
- 7:30Speaker 1: Hot bench. Judge says, if.
- 7:32Speaker 3: You see your friend saying, stop, stop, stop, why don't
- 7:38Speaker 3: you stop?
- 7:39Speaker 1: It's a snowball fight with a friend. It's not more
- 7:41Speaker 1: than that.
- 7:42Speaker 3: And Scott just says, I thought that we were still
- 7:44Speaker 3: having fun when he said, stop, stop, stop.
- 7:47Speaker 1: Judge is ready to rule. Yeah, so here's the thing.
- 7:51Speaker 2: Normally, if two people are in a snowball fight and
- 7:53Speaker 2: somebody gets injured, you're not going to get any money
- 7:55Speaker 2: because you entered into that snowball fight just as much
- 7:59Speaker 2: as they did.
- 8:00Speaker 3: Sure.
- 8:01Speaker 2: We have a lot of information here that suggests this
- 8:04Speaker 2: wasn't that. On top of this guy, the guy's saying stop,
- 8:09Speaker 2: even laughing, he's saying stop, and he said, I went
- 8:12Speaker 2: for the kill shot.
- 8:13Speaker 1: For what it's worth.
- 8:15Speaker 3: There is a disagreement about whether or not he was
- 8:18Speaker 3: standing over top of him when he went for that
- 8:20Speaker 3: kill shot.
- 8:20Speaker 2: Okay.
- 8:21Speaker 1: For what that's worth.
- 8:22Speaker 2: Had to go for the kill shot. I wouldn't be
- 8:24Speaker 2: inclined to give him the money. I'm going to say
- 8:27Speaker 2: Judge Perez, hot bench.
- 8:31Speaker 1: Okay, that's the program. Split it. 600 each.
- 8:35Speaker 3: A judge says, I think that you went over what
- 8:38Speaker 3: is reasonable for a snowball fight.
- 8:39Speaker 2: Yeah.
- 8:40Speaker 1: You did not act in the best duty of care
- 8:41Speaker 1: for your friend. Correct.
- 8:43Speaker 3: Your friend is asking for $ 1, 200, and I think that
- 8:45Speaker 3: the law shows that you owe that.
- 8:47Speaker 1: Great.
- 8:47Speaker 3: Daniel, is your offer to only pay half still on
- 8:50Speaker 3: the table? Daniel says no. Based on the evidence, Daniel
- 8:55Speaker 3: gets $ 1, 200.
- 8:56Speaker 1: Wow. Daniel could have gone back and said, sure, pay half.
- 9:01Speaker 1: He's like, no, we're here.
- 9:02Speaker 3: We're here.
- 9:02Speaker 1: We're not family.
- 9:03Speaker 3: This is a classic use it or lose it situation.
- 9:06Speaker 3: And you didn't use it.
- 9:08Speaker 1: And so now you lost it. And you lost more
- 9:11Speaker 1: than you could have. That's right. So there you go. Wow.
- 9:14Speaker 1: Good for Perez. That's what I would have ruled. Yeah.
- 9:17Speaker 3: Fine.
- 9:18Speaker 1: As all things considered, lighthearted. Thank God. Lighthearted case. Because
- 9:21Speaker 1: my case probably needs a content warning.
- 9:24Speaker 2: Oh, no.
- 9:25Speaker 1: Just from a standpoint of like, this could be triggering
- 9:28Speaker 1: to folks.
- 9:29Speaker 3: Okay.
- 9:30Speaker 1: Well, I guess you just did it. I did it.
- 9:32Speaker 2: But do it in like a serious podcasting voice. No,
- 9:33Speaker 2: but if you're listening, in all honesty, if you're listening and...
- 9:38Speaker 2: you know, this, like, this is sexual harassment is what
- 9:41Speaker 2: this is. Uh, and it's done. It's, it's described like
- 9:45Speaker 2: something that could give you some PTSD. Maybe, maybe you don't,
- 9:48Speaker 2: maybe you don't listen. Um, I will say at least,
- 9:53Speaker 2: at least it has a good ruling and, uh, we,
- 9:56Speaker 2: we get some, some good justice here. That is the
- 9:59Speaker 2: good news about this case. No trigger warning for the
- 10:01Speaker 2: kill shot. Judge Ross, no trigger warning there. Different thing.
- 10:05Speaker 2: Different trigger, different warning.
- 10:06Speaker 1: Hot bench. Judge Ross. Justice is not a foreign concept.
- 10:10Speaker 3: That means like an opposite trigger warning for Hopped Edge.
- 10:13Speaker 3: You're not watching what you think you might be watching.
- 10:15Speaker 3: Just disclaimer, this isn't about regular court. Judge Ross, that
- 10:20Speaker 3: would be a great funny thing to do. Judge Ross,
- 10:23Speaker 3: justice is not a foreign concept.
- 10:26Speaker 2: He wants you to understand it. Wilson Neville is suing
- 10:30Speaker 2: Sophia Kent. For $ 750. Wilson says, Your Honor, this is
- 10:36Speaker 2: plain and simple. She's in breach of contract. This guy's
- 10:39Speaker 2: probably 48 to 50. He's in a suit and tie.
- 10:42Speaker 2: We did a contract agreeing. She'd do three social media
- 10:45Speaker 2: posts in exchange for three nights in my hotel.
- 10:48Speaker 1: And to be clear, he is suing her. That's right. Okay.
- 10:51Speaker 2: Suing her for $ 750. for breach of contract.
- 10:54Speaker 1: Got it.
- 10:54Speaker 2: So she says, no, Sophia, it says, your honor, I'm
- 10:58Speaker 2: a social media influencer. And she does look like one
- 11:00Speaker 2: of those classic social media influencers. Uh, she's probably in
- 11:05Speaker 2: her late twenties, early thirties. She's like tall red hair, like,
- 11:08Speaker 2: you know, very expressive.
- 11:10Speaker 3: Yeah. is she like uh specific to like travel influencing
- 11:14Speaker 3: or she just said no and i i don't know
- 11:16Speaker 3: sometimes with ross it's a little squirrely i don't know
- 11:18Speaker 3: but she says uh i'm a social media influencer i
- 11:21Speaker 3: have over 300 000 followers on instagram my job how
- 11:23Speaker 3: i make a living is i exchange posts for money
- 11:25Speaker 3: monetary benefits or freebies and he's like so bartering and
- 11:28Speaker 3: she's like yeah sure although i don't know how you make.
- 11:31Speaker 2: A living off of exchanging posts for a free hotel
- 11:34Speaker 2: night i don't know how that would but I don't know.
- 11:36Speaker 2: I'm not a social media influencer. I have no plans
- 11:38Speaker 2: to be one, but you can check out polar seltzer
- 11:42Speaker 2: at your nearest, uh.
- 11:44Speaker 1: Uh, Sophia, the original today. Yeah.
- 11:47Speaker 3: Yeah.
- 11:47Speaker 1: That's right. Uh, Sophia is like, I've been doing this
- 11:49Speaker 1: for two years. I really love it. Wilson says, so
- 11:52Speaker 1: Sophia contacted me. I didn't reach out to her. She
- 11:55Speaker 1: contacted me. So if he was like, I'm based in
- 11:56Speaker 1: Los Angeles. So I looked for little spots, uh, close
- 11:59Speaker 1: to Los Angeles for like a little vacation. It would
- 12:01Speaker 1: be easy for me to get to that. I can highlight.
- 12:03Speaker 2: It seems to go well on my social media, social media,
- 12:05Speaker 2: social media page. And I found his hotel, which is in, he,
- 12:10Speaker 2: she told me the name. I remember it's just outside
- 12:11Speaker 2: of Los Angeles and I contacted him, Mr.
- 12:14Speaker 1: Neville.
- 12:14Speaker 3: I did.
- 12:14Speaker 2: Wilson says, your honor, I come from a generation where
- 12:17Speaker 2: we work long hours. This new generation thinks they can
- 12:20Speaker 2: get everything for free. That should be been the first
- 12:24Speaker 2: clue that this guy was not reputable.
- 12:27Speaker 3: Um, And also, you could have said no. If that
- 12:31Speaker 3: is your feelings towards the generation, you could have said no.
- 12:34Speaker 1: Ross says, that was your impression of her. And he says, yes.
- 12:37Speaker 1: And Ross says, why?
- 12:38Speaker 2: And he said, well, she didn't finish the contract, only
- 12:41Speaker 2: posted one initial post, and we agreed upon three. Ross says,
- 12:46Speaker 2: there were supposed to be three. Miss Kent, there were
- 12:48Speaker 2: supposed to be three. Sophie Kent says, I agreed to
- 12:50Speaker 2: three posts.
- 12:50Speaker 1: Yes, sir. Ross says, how many did you do? She says,
- 12:53Speaker 1: only one. He says, why?
- 12:55Speaker 2: She said, the first night went great. I checked in,
- 12:58Speaker 2: relaxed for a bit, went to bed, and I posted
- 13:00Speaker 2: the next morning. And everything went great that first day.
- 13:04Speaker 2: The second day that I was there, Mr. Neville brought
- 13:08Speaker 2: me breakfast to my room and came into my hotel room.
- 13:13Speaker 2: He was there for five or 10 minutes. We had
- 13:15Speaker 2: not met yet. That was why he brought me breakfast.
- 13:18Speaker 2: And then he did leave.
- 13:20Speaker 1: Okay.
- 13:21Speaker 2: Ross says, did this happen? Wilson says, yes, it did.
- 13:23Speaker 2: I went up there to meet her in person to
- 13:25Speaker 2: make sure her stay was accommodating. We've never done anything
- 13:28Speaker 2: like this. I did bring her breakfast. I was in
- 13:30Speaker 2: the room for five minutes, thought nothing of it left immediately.
- 13:33Speaker 2: Did she invite him in? No.
- 13:35Speaker 1: Okay. She didn't say that. I would assume she would
- 13:38Speaker 1: have said it otherwise. She's very forthcoming.
- 13:40Speaker 3: Anytime I've ever done room service, it's one of those
- 13:42Speaker 3: things where they hand it, and.
- 13:44Speaker 1: You have to be the person to say, hey, come
- 13:45Speaker 1: on in.
- 13:46Speaker 2: He goes in. Sophie said, I actually had to ask
- 13:49Speaker 2: him to leave. He was lingering. He came to my hotel.
- 13:53Speaker 2: I'm a single young woman. I travel for a living.
- 13:55Speaker 2: He has a key to my room. It made me uncomfortable.
- 13:58Speaker 2: Ross said, did he do say anything to you that
- 14:01Speaker 2: made you uncomfortable? And she says, no, but the vibes
- 14:03Speaker 2: and Ross cuts her off and says, we're going to
- 14:06Speaker 2: get to the vibes in a minute. I need to
- 14:08Speaker 2: ask you these questions first. Did he say anything to you?
- 14:11Speaker 2: She says nothing specific in his verbal comments. Ross says,
- 14:14Speaker 2: did he put his hands on you?
- 14:15Speaker 1: She says, no.
- 14:17Speaker 2: Uh, Ross says, did he leer at you or you
- 14:20Speaker 2: know how men look at you and you know, when
- 14:22Speaker 2: it's wrong, did he do that?
- 14:23Speaker 1: She says, yes.
- 14:25Speaker 2: Uh, he said, And this was of a sexual nature,
- 14:28Speaker 2: in your opinion. She says, yes. He says, do you
- 14:32Speaker 2: agree with this, sir? Wilson says, no, your honor. It
- 14:34Speaker 2: was completely professional. Ross says, what did you say to
- 14:38Speaker 2: him at the time? Sophie says, I never want to
- 14:43Speaker 2: make a communication happen. This was the first time we
- 14:45Speaker 2: had met. I tried to give him the benefit of
- 14:48Speaker 2: the doubt, but I just told him, to please treat
- 14:51Speaker 2: me like any other guest. I didn't want any special
- 14:53Speaker 2: treatments and I didn't need to really see him again
- 14:56Speaker 2: or for him to come up here again. I was,
- 14:58Speaker 2: I was create the content. It was going to look great.
- 15:01Speaker 2: It's going to be awesome. And then I asked him
- 15:02Speaker 2: to leave. Do you know if there was any, um, like, uh,
- 15:06Speaker 2: formal approval process for what she was posting? Like, Hey,
- 15:09Speaker 2: here's what she, and we'll get to that later, but there,
- 15:11Speaker 2: she has, she does sign a contract three, three posts
- 15:13Speaker 2: and for three nights stay. But aside from that, she
- 15:15Speaker 2: gets pretty much free. So in theory, after he leaves
- 15:18Speaker 2: the room, they would never have to talk to each
- 15:21Speaker 2: other again. Correct.
- 15:22Speaker 1: Okay.
- 15:23Speaker 2: And she says the exact, I tried to write it
- 15:24Speaker 2: word for word. Uh, I don't, I don't want it
- 15:27Speaker 2: to be a miscommunication. I felt like the vibes were wrong.
- 15:30Speaker 2: I didn't want it to be a miscommunication. I want
- 15:32Speaker 2: to give him the benefit of the doubt is the
- 15:33Speaker 2: first time we had met, he wanted to introduce himself.
- 15:36Speaker 2: I just told him from now on, treat me like
- 15:38Speaker 2: any other guest. I don't need special treatment. I'll create
- 15:41Speaker 2: the content. It's going to look great on my Instagram.
- 15:43Speaker 2: It's going to be awesome. And then I asked him
- 15:45Speaker 2: to leave.
- 15:46Speaker 3: Okay.
- 15:46Speaker 1: Fair enough.
- 15:47Speaker 2: Right.
- 15:47Speaker 1: Nothing like get out of my room. Just like, All right.
- 15:50Speaker 2: Can you please leave? I'd like to eat my breakfast
- 15:51Speaker 2: or something along those lines. Ross says, did she do that?
- 15:55Speaker 2: Wilson says, yes, she did. And Ross goes, okay. And
- 16:00Speaker 2: Sophie says, well, then he came back 45 minutes later
- 16:02Speaker 2: to retrieve the breakfast that he'd given me. Ross says,
- 16:06Speaker 2: is that true? Wilson says, yes, your honor. I wanted
- 16:08Speaker 2: to make sure that first off the breakfast was to
- 16:10Speaker 2: her liking. And second of all, that I cleared the
- 16:13Speaker 2: plates for Ross says, you couldn't send somebody else to
- 16:16Speaker 2: do that? Like, wouldn't you normally just send a staff
- 16:19Speaker 2: member to come up and get the stuff? Like, that's
- 16:22Speaker 2: not what you would normally do for guests. He said,
- 16:24Speaker 2: Your Honor, like, this is the first time we've ever
- 16:26Speaker 2: spent money on something like this. I just wanted it
- 16:29Speaker 2: to be perfect. It was very important to me. I'm
- 16:32Speaker 2: old school. I just don't know how to do this
- 16:34Speaker 2: kind of stuff. It was really important that it go well.
- 16:36Speaker 1: That makes sense. And Ross says, gotcha. Yeah. You're trying
- 16:40Speaker 1: to put your best foot forward.
- 16:41Speaker 3: Right.
- 16:41Speaker 1: Because you want her to be as glowing in her
- 16:43Speaker 1: review as possible. Wilson says, yes. Then this seems like
- 16:46Speaker 1: more of a boutique, like hotel thing, not like a big.
- 16:49Speaker 2: Ross says, what happened when you went back up there?
- 16:53Speaker 2: Wilson says, well, I clearly went back up just to
- 16:55Speaker 2: retrieve the breakfast. And then you did that and left.
- 16:57Speaker 2: He said, that's it. Wilson, uh, Ross says, Sophie, is
- 17:01Speaker 2: that true? And Sophie says, yes, but it's important because
- 17:03Speaker 2: 45 minutes earlier, I was direct in my communication with
- 17:06Speaker 2: him that I didn't want or need that. And I
- 17:08Speaker 2: had also asked him to leave and I do need,
- 17:11Speaker 2: He admitted that I'm admitting to you now. I literally
- 17:13Speaker 2: 45 minutes ago said, please do not do this. So
- 17:18Speaker 2: she's like, even with that happening, I'm still on board
- 17:23Speaker 2: with doing this job. Still, I'm on board with doing
- 17:26Speaker 2: the job. I've made one post. It's the second day.
- 17:29Speaker 2: I'm planning to make another post. I just need a
- 17:31Speaker 2: few hours. I just cool it.
- 17:33Speaker 1: I relax.
- 17:34Speaker 2: I go down to dinner at dinner that night. The
- 17:36Speaker 2: waiter comes over and delivers me an alcoholic beverage and
- 17:39Speaker 2: says to me, it's on the house. I said I
- 17:41Speaker 2: didn't order it. He says it's free. I look over,
- 17:45Speaker 2: and Mr. Neville is at the bar staring and smiling
- 17:48Speaker 2: at me. In my opinion, as a young woman, an
- 17:52Speaker 2: older gentleman who's in charge of the facility sending me
- 17:55Speaker 2: alcohol is absolutely inappropriate. I don't know what's in this drink.
- 18:00Speaker 2: You want to thank me, send me a basket of fries.
- 18:02Speaker 2: I have to look out for myself. That's what she says.
- 18:05Speaker 1: I do love a basket of fries. Who doesn't?
- 18:07Speaker 2: It's a win-win. I would take the basket of fries.
- 18:09Speaker 2: All you single dudes out there, float over some cheese sticks.
- 18:12Speaker 2: You know what I mean? You don't hear stories of
- 18:15Speaker 2: someone drugging fries.
- 18:16Speaker 1: That's right. Fries are safe. Fries are safe. Fries are safe.
- 18:18Speaker 1: We're going to make some shirts. Yeah. Put that on.
- 18:22Speaker 1: We're not going to make shirts. We're not going to
- 18:23Speaker 1: make shirts. We're not going to make the fries.
- 18:24Speaker 3: Are safe shirts.
- 18:25Speaker 2: Why are they wearing fries are safe shirts? See, there
- 18:27Speaker 2: was a really fun case. No guy will get a
- 18:28Speaker 2: logo on the front. On the back, it says, Fries
- 18:30Speaker 2: are safe. Yeah, there was a really fun case that
- 18:31Speaker 2: Dan did.
- 18:31Speaker 1: Yeah, that Dan did. It was hilarious.
- 18:33Speaker 2: And so we're going to mark it, the Fries are
- 18:34Speaker 2: safe tagline. Ross says, Mr. Neville, do you have any children?
- 18:37Speaker 2: Wilson says, yes, I do. I have an 18-year-old daughter,
- 18:39Speaker 2: 15-year-old son. He says, your daughter, in the situation just
- 18:44Speaker 2: described by Miss Kent.
- 18:48Speaker 2: And she comes home and says, I felt uncomfortable, and
- 18:51Speaker 2: an older gentleman who owns the establishment I was in
- 18:55Speaker 2: sent me an alcoholic beverage. Would that sit well with you?
- 18:59Speaker 2: And were you sitting at the bar smiling when this happened?
- 19:05Speaker 3: Mr.
- 19:05Speaker 2: Neville says, it would 100% not sit well with me
- 19:08Speaker 2: if that happened to my daughter. And yes, I was
- 19:10Speaker 2: in fact sitting at the bar smiling. But your honor,
- 19:14Speaker 2: she was a contracted employee. I was trying to provide
- 19:16Speaker 2: the best possible customer service.
- 19:18Speaker 1: That I could.
- 19:20Speaker 2: But she asked you not to. I had already noticed
- 19:22Speaker 2: she had not posted her second post for the day.
- 19:25Speaker 2: And I was starting to get worried that it wasn't
- 19:27Speaker 2: going to happen or it was going to be negative.
- 19:29Speaker 2: And so I thought this was a way to smooth
- 19:31Speaker 2: things over.
- 19:32Speaker 1: Okay.
- 19:35Speaker 2: Well, Ross goes, okay, had you posted your second post yet?
- 19:39Speaker 2: Sophie says, our contract says three posts for three days.
- 19:41Speaker 2: There is nothing specific about the type of post or
- 19:45Speaker 2: when these posts.
- 19:46Speaker 1: And this is still on day one. No, we're on
- 19:47Speaker 1: day two. Oh, we're on day two. Day one, pretty unathletic. Okay.
- 19:51Speaker 1: Day two, he brings the breakfast. Got it, got it,
- 19:53Speaker 1: got it.
- 19:53Speaker 2: This is the end of day two. She says, there
- 19:56Speaker 2: is nothing in the contract that says when the posts
- 19:58Speaker 2: are made. I could have actually made all of them
- 20:00Speaker 2: after I stayed.
- 20:01Speaker 1: Right.
- 20:01Speaker 2: Some influencers work like that. So there's nothing that says
- 20:05Speaker 2: I have to post while I'm here. This is a,
- 20:08Speaker 2: just an agreement that I post three times. Um, and,
- 20:11Speaker 2: but at this point, this is, she is like so
- 20:15Speaker 2: well-spoken and she is articulating this in a way everyone
- 20:19Speaker 2: should hear to just get the lesson, just beat over
- 20:21Speaker 2: your head. She goes at this point, I'm trying to
- 20:24Speaker 2: process if I want to post again at all. Like
- 20:27Speaker 2: I have 300,000 followers. Some of them are young women.
- 20:30Speaker 2: Do I want to post, uh, favorable content about a
- 20:35Speaker 2: place that could possibly be really skeevy or have men
- 20:40Speaker 2: leering at you or sending like, do I, is that
- 20:43Speaker 2: something I want to be involved in? And I know
- 20:45Speaker 2: I signed a contract, but I'm weighing that out. So
- 20:47Speaker 2: I didn't post anything that day, which is perfectly within
- 20:50Speaker 2: the realm of my contract. So on day three, uh,
- 20:55Speaker 2: she got up, she was like, I got up, I
- 20:56Speaker 2: ate breakfast. I went to the pool. While I'm at
- 20:59Speaker 2: the pool, Mr. Neville comes over, sits next to me,
- 21:03Speaker 2: puts his hand on my knee, which she says the word,
- 21:07Speaker 2: which Ross says, stop, stop right there. Stop talking to
- 21:13Speaker 2: Miss Kent. He then literally pivots his chair to Wilson Neville.
- 21:18Speaker 2: And he just glares for like, I don't know, seemed
- 21:22Speaker 2: like an hour. He's like, and then when he finally speaks,
- 21:26Speaker 2: he says, that true. Wilson Neville says, yes, your honor,
- 21:30Speaker 2: but it was only to reassure her after our previous interactions.
- 21:35Speaker 2: Ross says, once again, this been your daughter. How would
- 21:39Speaker 2: that make you feel? Wilson Neville says, it would have
- 21:41Speaker 2: made me feel uncomfortable. Ross says, you crossed the line.
- 21:46Speaker 2: You clearly crossed the line.
- 21:49Speaker 1: Mr.
- 21:49Speaker 2: Neville says, I don't think I did. I was merely
- 21:51Speaker 2: reassuring her. Ross says, I wasn't asking a question. I
- 21:58Speaker 2: was giving you a statement of what you did.
- 22:01Speaker 1: Got to overstand this brother. He's not overstating. No, he's not.
- 22:05Speaker 1: He's not even understanding. Sophie says I was terrified. Quickly
- 22:08Speaker 1: left the hotel. Didn't stay a third night. Didn't post
- 22:10Speaker 1: the last two posts. Judge Ross ready to rule.
- 22:16Speaker 3: Uh, just out of curiosity, uh, is he suing her?
- 22:23Speaker 3: For the total amount of money that three nights would be?
- 22:27Speaker 2: Yes, $ 250 per night in the hotel.
- 22:30Speaker 3: Even though she left after night two? She did leave
- 22:32Speaker 3: on the morning of day three, which I guess would
- 22:34Speaker 3: be after night two, yes. That's how I understand that.
- 22:37Speaker 3: I understand that.
- 22:38Speaker 1: But she was supposed to stay for a third night?
- 22:40Speaker 3: So in theory, if you really wanted to get into
- 22:44Speaker 3: the weeds of what he would be owed contractionally, it
- 22:50Speaker 3: would be minus one night.
- 22:52Speaker 2: You would say contractually, if you wanted to get in
- 22:54Speaker 2: the weeds, which I'd suggest you don't, but if you
- 22:56Speaker 2: wanted to get in the weeds, it would be.
- 22:58Speaker 1: One post, one night. Right. Figure out what.
- 23:01Speaker 2: Two more nights is what you would think he'd be owed,
- 23:05Speaker 2: not all three.
- 23:06Speaker 1: Correct. I have a feeling the weeds aren't going to
- 23:09Speaker 1: matter here, but that is for... If this ever happens.
- 23:12Speaker 2: If this was, say, Judge Mathis, who was yucking it
- 23:15Speaker 2: up with this guy the whole time.
- 23:16Speaker 3: Let's just say, if best case scenario, this isn't... Uh,
- 23:21Speaker 3: like someone just didn't fulfill the contract.
- 23:25Speaker 1: That would be how you.
- 23:26Speaker 3: Would handle that situation because they did post once. Uh,
- 23:31Speaker 3: but he's not going to get any, uh, any money
- 23:33Speaker 3: in this regard. He clearly acted inappropriately. And I think
- 23:36Speaker 3: I haven't seen the contract, uh, but if there's not
- 23:41Speaker 3: something in the contract that says that the contract is void,
- 23:43Speaker 3: it could be void if the influencer, uh, sees fit
- 23:48Speaker 3: or feels uncomfortable or whatever, I would assume that she
- 23:51Speaker 3: would probably put that into a contract moving forward.
- 23:53Speaker 1: It's not her first rodeo. I mean, she's clearly done
- 23:55Speaker 1: this before.
- 23:56Speaker 3: But if this is anybody out there, not everybody is
- 24:00Speaker 3: as nice as Judge Ross, and I think that that
- 24:03Speaker 3: would be good to put in your contract. Hey, this
- 24:06Speaker 3: contract could be void. For X, X, and X. He's
- 24:11Speaker 3: not getting any money, though. Clearly, he went over the line,
- 24:13Speaker 3: and clearly Judge Ross thinks he went over the line.
- 24:14Speaker 3: He does not deserve the money back, and so that's
- 24:16Speaker 3: what I'm going.
- 24:16Speaker 1: To go with.
- 24:16Speaker 2: Yeah, Judge Ross thinks, and I do, too, that this
- 24:18Speaker 2: guy should be thrown in jail. He doesn't speak to
- 24:22Speaker 2: Sophie Kent about her business at all. He literally just
- 24:25Speaker 2: throws the book as much as he can at her.
- 24:28Speaker 3: Mr.
- 24:28Speaker 1: Neville. He throws the book at the guy who is
- 24:31Speaker 1: suing the other person. Exactly.
- 24:32Speaker 2: He throws the book at him. Obviously, he doesn't get
- 24:37Speaker 2: any money, and you can tell if Ross could rule further,
- 24:40Speaker 2: he would, but he can't. It just seems like this
- 24:43Speaker 2: is all he can possibly do. The best we can
- 24:48Speaker 2: hope for is that this guy learned his lesson, which.
- 24:50Speaker 1: I don't think he did. What did he say to him?
- 24:54Speaker 2: It wasn't as firm as... He was before the ruling,
- 24:58Speaker 2: but he basically said, my best hope for you is
- 25:01Speaker 2: that this actually is a misunderstanding and you've learned just
- 25:05Speaker 2: what you did.
- 25:06Speaker 3: Right.
- 25:06Speaker 1: That's my best hope that you can treat people with respect. Yeah.
- 25:11Speaker 3: At the end of the day, best case scenario, this
- 25:14Speaker 3: guy wasn't trying to be creepy, right? That is the
- 25:18Speaker 3: most generous ruling read of this of all time. Your
- 25:21Speaker 3: concern over... your business doesn't make it okay for you
- 25:27Speaker 3: to touch anybody.
- 25:28Speaker 1: No. So like that, like you can't use that. Like, Oh,
- 25:30Speaker 1: I was just concerned about the contract getting fulfilled.
- 25:33Speaker 2: You can't, that can't be your, to show you just
- 25:36Speaker 2: the classic reason that this is, we're in a unfortunate patriarchy.
- 25:43Speaker 2: Like all of the steps before that only seem okay
- 25:46Speaker 2: because of the history of our country. Whereas if it
- 25:49Speaker 2: was a woman, if you reverse the roles, there would
- 25:51Speaker 2: just be no way. there would be no way they
- 25:52Speaker 2: would get away with it. There would be no way
- 25:54Speaker 2: they would just be like, like you, like you would
- 25:56Speaker 2: never even hear that story. You would never hear it.
- 26:00Speaker 2: But now this dude's like, well, I'm just trying to,
- 26:02Speaker 2: I'm just trying to make her feel comfortable, which is
- 26:04Speaker 2: just BS, like going into people's rooms and stuff.
- 26:06Speaker 1: So it was brutal. It was brutal out there. It's tough.
- 26:09Speaker 2: And you know, that's not what the gavel is really about. So,
- 26:11Speaker 2: you know, snowball fights next time. I think that's the key.
- 26:14Speaker 2: That's what we're trying to do. All cases matter. We
- 26:17Speaker 2: can learn from all cases.
- 26:18Speaker 1: All cases. Well, let's not. Yeah. I guess all cases
- 26:21Speaker 1: do matter. I don't know. I don't know how I
- 26:22Speaker 1: feel about what you just said. Well, hot bitch is
- 26:27Speaker 1: what you need to remember. We're back next time with
- 26:30Speaker 1: two more cases. Come on back for that. Until then,
- 26:32Speaker 1: we're the first to wish you an all right.
