- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on Yo Gabble Gabble, if your neighbor's pit
- 0:15Speaker 2: bull attacks your tiny toy dog, can.
- 0:17Speaker 1: You get them to pay for bills even if they've
- 0:19Speaker 1: already paid you cash? Judge Mathis has a terrible take
- 0:22Speaker 1: on pit bulls.
- 0:23Speaker 3: And if you accidentally get struck by lava on a
- 0:27Speaker 3: lava tour, can.
- 0:29Speaker 1: You sue the tour guide? Or is this case too
- 0:32Speaker 1: hot to handle? Judge Ross tells us real people, real cases,
- 0:35Speaker 1: fake justice. This is Yo Gabble Gabble.
- 0:39Speaker 3: Go, go, go, get it up, get it up, take
- 0:42Speaker 3: it down, take it down. Now bring it back up
- 0:46Speaker 3: and put it back down.
- 0:47Speaker 1: Hi, everybody. Welcome to Yo!
- 0:48Speaker 2: Gavel Gavel. Did you say struck by lava? Like it's
- 0:50Speaker 2: lightning coming out of the sky?
- 0:52Speaker 1: Yep. Struck by it.
- 0:54Speaker 2: Struck by it. Aren't you dead at that point if
- 0:56Speaker 2: you get struck by lava? I can see this case
- 0:58Speaker 2: has really piqued your interest. I'm very excited because I'm
- 1:00Speaker 2: not excited about mine. So, you know, there's that.
- 1:03Speaker 1: Well, there's that. Welcome to the gavel, everybody.
- 1:05Speaker 2: Hi, everybody. It's great to be here today. I gotta
- 1:09Speaker 2: be honest, I don't know if it's been... A couple weeks.
- 1:12Speaker 1: I have no idea. There's no way to really find out.
- 1:14Speaker 1: There really is no way. I know we don't have
- 1:16Speaker 1: any new reviews. Doggone it.
- 1:18Speaker 2: Doggone it. It's still, I like gavels. I really like gavels.
- 1:21Speaker 1: I like gavels. From K2Lew34. That's the last one we got.
- 1:24Speaker 1: Please leave us a review. Please do it. Please share
- 1:26Speaker 1: the podcast with a friend. I think they will like it.
- 1:29Speaker 2: This is one of those easy breezy ones you can
- 1:31Speaker 2: listen to on the way to work in the morning. Mindless.
- 1:34Speaker 1: Yes.
- 1:35Speaker 2: And typically... will make you forget about your worries in life.
- 1:39Speaker 2: Unless you get one of the real downers that we've
- 1:41Speaker 2: had recently. Like if you got a 20 to 25
- 1:44Speaker 2: minute commute to work, this is your podcast. Nothing's going
- 1:47Speaker 2: to get you in the work mood like this because
- 1:49Speaker 2: your life's better than typically what's going on here.
- 1:52Speaker 1: That's right. Dan, I have a Judge Ross case today.
- 1:56Speaker 1: That's clearly intriguing you.
- 1:57Speaker 2: Let me do mine first so I can really lock
- 2:00Speaker 2: in on Struck by Lava.
- 2:03Speaker 1: Where are we going today?
- 2:04Speaker 2: Mathis, Alicia Neal is suing her neighbor Cheryl DePriest for $ 1, 550
- 2:11Speaker 2: in vet bills and emotional distress.
- 2:14Speaker 1: Is there a reason why you slid into your Cosby there? What?
- 2:18Speaker 1: How dare you, first of all. I mean, you can
- 2:20Speaker 1: hear it. DePriest. All right, all right. What are you
- 2:23Speaker 1: talking about? Go ahead. Cheryl DePriest. Triple down.
- 2:31Speaker 2: Cheryl DePriest has brought her son. Alicia Neal has brought
- 2:36Speaker 2: her mom with her on this particular journey.
- 2:39Speaker 1: Big family affair. Let's get it drunk. It's on it, brown.
- 2:41Speaker 1: It's on it.
- 2:43Speaker 2: Alicia says, I'm here on behalf of Pebbles, Octavia Neal.
- 2:46Speaker 1: She gave her dog a middle name. Your dogs have
- 2:50Speaker 1: middle names?
- 2:52Speaker 2: I think that my youngest one does because my kids
- 2:57Speaker 2: named them. And then I don't think any of the
- 3:01Speaker 2: other ones ever had middle names.
- 3:02Speaker 1: Just that one. Your dogs?
- 3:05Speaker 2: No. No.
- 3:06Speaker 1: Okay. Good talk. Got it. Rufus did. Yeah. Rufus did.
- 3:12Speaker 1: What was it? You seem embarrassed. I don't remember why
- 3:17Speaker 1: this happened. Okay. But his name was Rufus Lamar James Gray.
- 3:21Speaker 1: And I don't know why. I don't love it. You
- 3:25Speaker 1: can see why I was hesitant. Yeah, I wouldn't have
- 3:27Speaker 1: said it. I'd have been like, I don't remember.
- 3:29Speaker 2: Not LeBron James.
- 3:31Speaker 1: Yeah. I think what happened is at one point... Cheryl Debris.
- 3:37Speaker 1: I think at one point... You were a racist. This
- 3:39Speaker 1: is me speaking out of turn.
- 3:40Speaker 2: No, no, no.
- 3:41Speaker 1: My wife was.
- 3:42Speaker 2: She, I believe, misspoke at one point and called LeBron
- 3:46Speaker 2: Lamar James.
- 3:47Speaker 1: Didn't know who he was. And I thought it was
- 3:50Speaker 1: so funny that I made... That's funny. That's funny. She
- 3:53Speaker 1: would probably remember better than I. Go ahead. Alicia says,
- 3:55Speaker 1: I'm here on behalf of Pebbles Octavia Neal. Yes.
- 3:58Speaker 2: I've never seen a dog in your courtroom, Your Honor,
- 4:00Speaker 2: so I brought this framed picture. She brought a framed...
- 4:02Speaker 2: picture of her. I like that she went back to
- 4:06Speaker 2: the tape. I don't want to do something that's unprecedented.
- 4:10Speaker 2: Your Honor, I've had Pebbles since she was three months old.
- 4:14Speaker 2: That's my baby. I take her everywhere with me. It
- 4:17Speaker 2: is a very little dog. It's a little toy, probably poodle.
- 4:21Speaker 2: Pound or two, maybe. Tiny little dog. Everybody knows her.
- 4:26Speaker 2: She's one of us. She's got clothes. She's got leg warmers.
- 4:29Speaker 2: I don't even have leg warmers, Your Honor, but my
- 4:30Speaker 2: dog has leg warmers. Dude, I saw a dog the
- 4:33Speaker 2: other day with Crocs on and it was... That dog
- 4:36Speaker 2: was in hell.
- 4:37Speaker 1: It was hilarious. Dogs don't like things on their feet. No.
- 4:40Speaker 1: Go ahead. I just had a dog die, right? Yep.
- 4:47Speaker 1: And towards the end of his life... had a hard
- 4:49Speaker 1: time walking.
- 4:50Speaker 2: And so anytime he had to walk, we had to
- 4:53Speaker 2: put little grips on it because he was.
- 4:57Speaker 1: A champ about it. He was a champ about it.
- 4:58Speaker 1: What a guy. Could have gotten Crocs, though. Shout out
- 5:01Speaker 1: to Joey. Shout out, Joey.
- 5:03Speaker 2: Cheryl says, Your Honor, I brought a picture of my dog, too.
- 5:06Speaker 2: My dog's Ginger. We call her Gigi. It's a framed photo.
- 5:09Speaker 1: Is Ginger a part of this case? Yes. Okay. There's
- 5:11Speaker 1: two dogs.
- 5:12Speaker 2: Okay.
- 5:12Speaker 1: I didn't know if we were just all bringing.
- 5:13Speaker 2: No. So this dog, Mathis is a bit where he's like,
- 5:17Speaker 2: let me see your sweet dog. And it's a pit bull.
- 5:19Speaker 2: And he like, oh, it's a pit bull. Like he
- 5:22Speaker 2: does a full bit. It's shocked like how this dog's
- 5:25Speaker 2: a pit bull. It's not some sweet dog. And his
- 5:28Speaker 2: reaction makes me realize that the last time I did Mathis,
- 5:31Speaker 2: I hated Judge Mathis. And I said I would never
- 5:33Speaker 2: do him again. And this case pretty much seals it
- 5:36Speaker 2: for me. The problem is, is he... Come on back
- 5:38Speaker 2: next week. The Judge Mathis YouTube is so organized and
- 5:42Speaker 2: it's easy and it's split up by case. So I
- 5:45Speaker 2: know the exact length of each case instead of... It's
- 5:48Speaker 2: so easy to find. A lot of the other ones
- 5:50Speaker 2: do a 19-minute full episode, so you never know how
- 5:53Speaker 2: long the first case is.
- 5:54Speaker 1: Judge Mathis makes it easy, but I hate him. I
- 5:57Speaker 1: hate this guy. Tell us why.
- 6:00Speaker 2: So many reasons. Anyway, so Cheryl's like, I want to
- 6:05Speaker 2: defend Gigi's honor. She's great with kids. She does tricks.
- 6:08Speaker 2: She's a part of my family.
- 6:09Speaker 1: She does tricks? I've never taught her to fight. I've never, like,
- 6:11Speaker 1: that's not something she does.
- 6:13Speaker 2: Does she get excited to see other dogs?
- 6:15Speaker 1: Does she get hyperactive?
- 6:16Speaker 2: Yes, of course. But she sleeps in my bed. She's
- 6:19Speaker 2: not a scary dog. She's around kids all the time.
- 6:22Speaker 2: I own pit bulls, pit shepherds. I own mixes.
- 6:25Speaker 1: Like, that's true. Like, dogs are what you train them
- 6:28Speaker 1: to be. Guys, come on. Alicia says, on September 10th,
- 6:32Speaker 1: Never forget, I was walking with Pebbles. Are you okay?
- 6:35Speaker 1: What the heck, brother? Cheryl DePriest.
- 6:39Speaker 2: You are out to lunch today. Can we air this?
- 6:46Speaker 2: I was walking with Pebbles to the mailbox, which is
- 6:49Speaker 2: across the street from our apartment.
- 6:51Speaker 1: Sure.
- 6:51Speaker 2: We're walking back. And this is when she gets very dramatic,
- 6:54Speaker 2: and it's hard for me to understand exactly what happens here.
- 6:57Speaker 2: I'm not sure I pieced it all together. But she says,
- 7:00Speaker 2: there's a dog on a leash that's going crazy, like
- 7:03Speaker 2: jumping up in the air, doing flips. There's a man
- 7:05Speaker 2: who has this dog on a leash. The man then
- 7:08Speaker 2: grabs Gigi, the pit bull, by the collar to keep
- 7:12Speaker 2: her still as I'm trying to hurry and get Pebbles home.
- 7:15Speaker 2: And my leash is retractable. I don't have one of those.
- 7:18Speaker 2: I've got a retractable leash. Pebbles is not very big.
- 7:21Speaker 2: I can just take her wherever I want to take her.
- 7:23Speaker 2: And so then I hear this man says, like, stand
- 7:28Speaker 2: still and pick up my dog.
- 7:30Speaker 1: Well, I.
- 7:32Speaker 2: That was scary to me. So instead, I start running
- 7:36Speaker 2: with the retractable leash. The man told her to stand
- 7:40Speaker 2: still and pick up his dog?
- 7:41Speaker 1: To pick up her dog. Her dog. Yes.
- 7:43Speaker 2: So basically what happened is that he grabbed Gigi by
- 7:47Speaker 2: the collar. She was getting excited. And then Gigi broke
- 7:50Speaker 2: out of her collar. Who is this guy? This guy
- 7:53Speaker 2: is going to be....
- 7:56Speaker 1: Cheryl DePriest's boyfriend. And is he going to be in
- 7:59Speaker 1: the course? No, he's not. We have a statement from him. Okay, great.
- 8:02Speaker 1: So basically the way, and this is me doing a
- 8:04Speaker 1: lot of the.
- 8:04Speaker 2: Legwork here because Alicia just gets very emotional here, but
- 8:07Speaker 2: basically he tries to steady the pit bull as this dog,
- 8:12Speaker 2: because Gigi's so excited. Gigi breaks out of her collar
- 8:16Speaker 2: and in a last ditch effort for Gigi to not
- 8:20Speaker 2: go over to play with this toy dog, which is
- 8:24Speaker 2: so much smaller. I mean, a pound versus probably 70 pounds.
- 8:29Speaker 2: This is a big dog. He says, please stay still
- 8:33Speaker 2: and pick up your dog. That would give, if Alicia
- 8:36Speaker 2: picks up her dog, then this gives this man time
- 8:39Speaker 2: to go over and wrangle Gigi and get it.
- 8:42Speaker 1: Yes. Her back is turned at this point. She hears it.
- 8:45Speaker 2: Doesn't quite know. And instead decides to pick up the pace.
- 8:48Speaker 2: I get that. I get both sides. A dog going
- 8:51Speaker 2: crazy and then you turn your back. Everyone's actions make
- 8:54Speaker 2: sense right now. So basically Alicia then says, this is
- 9:00Speaker 2: where I get confused. Alicia says, this man, uh, we
- 9:04Speaker 2: took off running. This man grabs pebbles leash and has
- 9:08Speaker 2: her dangling in the air like a yo-yo. That's what
- 9:11Speaker 2: she says, which would mean that at some point, Alicia
- 9:14Speaker 2: dropped the leash and just started running without her dog.
- 9:17Speaker 2: She never says that. But the next line she says,
- 9:20Speaker 2: after I was terrified, we took off. He told me
- 9:23Speaker 2: to stand still and pick up my dog.
- 9:24Speaker 1: I was terrified. I took off.
- 9:26Speaker 2: Is this man grabs Pebbles' leash and has her dangling
- 9:29Speaker 2: in the air. If she has a retractable leash, it
- 9:32Speaker 2: could be... Like, she never got around to picking up Pebbles.
- 9:35Speaker 1: Yes.
- 9:35Speaker 2: And Pebbles ran back towards that direction, you know, because
- 9:39Speaker 2: of the retractable leash.
- 9:39Speaker 1: So he didn't grab the handle, he grabbed just the
- 9:41Speaker 1: middle of the leash.
- 9:42Speaker 2: Right.
- 9:43Speaker 1: Which would also make sense if he's trying to keep
- 9:45Speaker 1: her out of danger of... Yes. Because here's the thing,
- 9:48Speaker 1: is the dog.
- 9:49Speaker 2: Gigi could be 100% playing with Pebbles, but because she's,
- 9:53Speaker 2: you know.
- 9:54Speaker 1: Three times the size, maybe two, three percent.
- 9:57Speaker 2: Of his weight yeah her weight that's playing could become
- 10:00Speaker 2: deadly pretty quickly yeah right so um alicia then says
- 10:04Speaker 2: your honor uh he grabbed a gg grab pepper pebbles
- 10:08Speaker 2: took her like took off with her in her mouth
- 10:12Speaker 2: basically running with the dog in her mouth.
- 10:14Speaker 1: She had punctures. She was bleeding. Cheryl says, that's not true.
- 10:17Speaker 1: She wasn't bleeding. Alicia says, you weren't out there. Stop talking.
- 10:21Speaker 2: Judge Madeline says, we'll get to you in a second.
- 10:23Speaker 2: Now the security guard was there. There was a whole
- 10:25Speaker 2: time I'm screaming, help me. The security guard broke them up.
- 10:28Speaker 2: I had to take pebbles to the vet to get
- 10:30Speaker 2: her checked out. And she was fixed. Now, Uh, here's
- 10:33Speaker 2: what we know. I don't know if there was blood
- 10:34Speaker 2: or not. Here's what we know is the vet bill
- 10:36Speaker 2: for pebbles. The total vet bill was $ 550. Now, you know,
- 10:41Speaker 2: and I know if you go to an emergency vet,
- 10:44Speaker 2: what that costs and you know, if they have to
- 10:47Speaker 2: do any invasive procedure, what that costs, the total vet bill.
- 10:52Speaker 1: Brand, $ 550. That's the total. It's a good deal. It's
- 10:58Speaker 1: a good deal. The goodwill. Yeah.
- 11:00Speaker 2: That's like to walk in the door at the emergency vet. The,
- 11:04Speaker 2: the office visit is $ 200. Yeah.
- 11:06Speaker 1: How long ago is this though?
- 11:08Speaker 2: Uh, 15 years, but still I, I've taken a bit like,
- 11:12Speaker 2: you know, so, uh, you need to know that at
- 11:14Speaker 2: front she's doing 1550 total, uh, a thousand emotional distress, 500,
- 11:18Speaker 2: five 50 for the vet bill.
- 11:20Speaker 1: Okay.
- 11:21Speaker 2: Yeah. So Cheryl's like, Your Honor, there was no blood.
- 11:25Speaker 2: Mathis says, how do you know? She goes, well, I
- 11:27Speaker 2: wasn't out there. And she goes, so you don't know.
- 11:28Speaker 2: You just said you knew and you didn't know. He
- 11:30Speaker 2: starts reading her the write-out.
- 11:31Speaker 1: Uh-oh.
- 11:32Speaker 2: She's like, Your Honor, I have a statement from my
- 11:34Speaker 2: boyfriend who's not here who was walking the dog. He
- 11:37Speaker 2: hands her the statement. Why the heck is he not here?
- 11:39Speaker 1: I don't understand. Well, then her son is there. And
- 11:41Speaker 1: her son is.
- 11:42Speaker 2: Like, Your Honor, he didn't snatch the dog and hang
- 11:44Speaker 2: it up like a yo-yo. I saw him pick the
- 11:47Speaker 2: dog up. Mathis is like, how did you see that?
- 11:51Speaker 2: Donnie said, well, I was home.
- 11:52Speaker 1: Donnie.
- 11:53Speaker 2: Donnie. When I don't know this guy's name, the boyfriend
- 11:57Speaker 2: said he was going to take Gigi for a walk.
- 11:58Speaker 2: And then somebody came and knocked on my door and
- 12:00Speaker 2: said that Gigi was loose. So who's that person? We
- 12:06Speaker 2: don't have that person. He's like, but when I heard
- 12:08Speaker 2: Gigi was loose, I opened the door and I see
- 12:11Speaker 2: the boyfriend has picked up, has picked up this dog
- 12:14Speaker 2: with his hands.
- 12:16Speaker 1: And then Mathis says, well, why do you think you're
- 12:18Speaker 1: not liable for this?
- 12:20Speaker 2: Right. And Cheryl says, because whatever went wrong I paid
- 12:23Speaker 2: for already, I gave her $ 150. Fair enough. Alicia says,
- 12:29Speaker 2: she didn't give.
- 12:29Speaker 1: Me any money. Uh-oh. And then she does this. Nothing.
- 12:32Speaker 2: None.
- 12:33Speaker 1: Nothing. Like this. Uh, Mathis says, do you have any
- 12:37Speaker 1: evidence that you gave her money?
- 12:39Speaker 2: Sure. I was like, yeah, it's in the statement right there.
- 12:41Speaker 2: The statement says I gave $ 150 to cover any, uh, pet, uh, uh,
- 12:46Speaker 2: vet bills pebbles had, which didn't include any bleeding. The
- 12:49Speaker 2: dog wasn't bleeding. It didn't need an emergency vet visit.
- 12:52Speaker 2: Just needed to go to get checked out to make
- 12:54Speaker 2: sure everything was okay. We gave her $ 150 cash. What
- 12:56Speaker 2: is the, what's the statement? Is that a police statement?
- 13:00Speaker 2: This is a statement from the guy who was there.
- 13:02Speaker 2: Cause he's not in court. Alicia's mom starts speaking. Uh,
- 13:06Speaker 2: she wasn't there. She wasn't even out there. She just
- 13:09Speaker 2: starts speaking. She says, Cheryl was so distraught apparently about.
- 13:13Speaker 1: Her pit bull. This is the mom. Yes.
- 13:15Speaker 2: The mom is in the courtroom. Alicia's mom. Alicia's mom
- 13:18Speaker 2: also was also there.
- 13:20Speaker 1: She wasn't. Okay.
- 13:21Speaker 2: So that, I mean, yeah, I don't know why she's speaking.
- 13:24Speaker 2: Cheryl was too distraught to even come out of her house.
- 13:27Speaker 2: The man did take money out of his pocket and
- 13:29Speaker 2: give to my daughter, but Cheryl didn't give us anything.
- 13:32Speaker 1: Okay.
- 13:32Speaker 2: And Mathis was like, so they did give you money.
- 13:36Speaker 2: She goes, not Cheryl. Her boyfriend gave her money. Matthews goes,
- 13:40Speaker 2: you said nothing. You did a full throat slash where
- 13:44Speaker 2: you said nothing. That's not true. You got money.
- 13:49Speaker 1: But your honor, it wasn't from Cheryl. It doesn't matter.
- 13:51Speaker 1: It was on her behalf. Who cares who the money
- 13:53Speaker 1: was from? I'm like, fine. And also, he's the one...
- 13:56Speaker 1: responsible for the dog in that moment. That's right. Like
- 13:59Speaker 1: you would think that that money would mean more coming
- 14:01Speaker 1: from him.
- 14:01Speaker 2: And then they said, your honor, it was 110, not 150.
- 14:04Speaker 2: And she, he goes, no, no, no. You said nothing.
- 14:07Speaker 2: I now believe her.
- 14:08Speaker 1: It was $ 150. Uh, he.
- 14:11Speaker 2: Goes, tell me about emotional distress. You said five 50
- 14:13Speaker 2: for vet. Tell me about 1,000 emotional distress. She goes,
- 14:16Speaker 2: Your Honor, we have a lot of children in our home,
- 14:17Speaker 2: and now Pebbles, since this event, has become snippy with
- 14:22Speaker 2: our kids, and the kids are scared.
- 14:24Speaker 1: So I don't know if I'm going to be able
- 14:25Speaker 1: to keep the dog anymore. Math is ready to roll.
- 14:27Speaker 2: 550 vet, 1,000 emotional distress.
- 14:34Speaker 1: This is a tough one because I am.
- 14:39Speaker 2: Probably I would have been inclined to give them the
- 14:42Speaker 2: entire vet bill, right? A five 50. I would probably
- 14:47Speaker 2: throw out the emotional distress.
- 14:50Speaker 1: Um, but.
- 14:53Speaker 2: She basically is now on the record lying about not
- 14:56Speaker 2: getting any money. And I think that, in my mind,
- 15:01Speaker 2: if you're lying under oath, you don't get any money.
- 15:04Speaker 2: That's call me crazy. Call me crazy.
- 15:06Speaker 1: Judge brand.
- 15:07Speaker 2: If you lie under oath about money, I'm not going
- 15:11Speaker 2: to give you more money. That's just me. But I
- 15:14Speaker 2: could see him giving her the, uh, the remaining, what
- 15:18Speaker 2: is that? $ 400, uh, for the, the medical bills.
- 15:20Speaker 1: Yeah.
- 15:23Speaker 2: This ruling is BS, and maybe it's because I tend
- 15:28Speaker 2: to side on the big dog side of things.
- 15:32Speaker 1: So you don't think that the big dog should have
- 15:33Speaker 1: to pay anything? No.
- 15:35Speaker 2: When I was a kid, I had a very small
- 15:38Speaker 2: outside dog who was a terrier mix, and Buster got loose.
- 15:43Speaker 2: Buster was his name. Buster got loose. There was a
- 15:46Speaker 2: dog next door, Damien, who was a Doberman Pinscher. The
- 15:49Speaker 2: Doberman Pinscher sees Buster, gets excited- And in playing with
- 15:54Speaker 2: Buster who maybe weighed eight pounds, grab Buster by the
- 15:57Speaker 2: neck and picked Buster up and slung him around. Now I,
- 16:01Speaker 2: as a kid, I was screaming. Like I thought that
- 16:04Speaker 2: Damien was the worst dog ever. Now I can look
- 16:07Speaker 2: back and go, everyone needs to do a better job
- 16:12Speaker 2: of understanding animals and dogs. If you want to own
- 16:15Speaker 2: a dog, you need to understand what that means. Look, did, 100%,
- 16:21Speaker 2: if Gigi gets off her leash in an apartment complex,
- 16:25Speaker 2: she should pay for the vet bills. Here's the thing
- 16:27Speaker 2: that I know.
- 16:27Speaker 1: Gigi personally. Gigi personally should reach into the back. Out
- 16:30Speaker 1: of her own satchel. Give me. That's just for the
- 16:37Speaker 1: folks at home. Yeah, that's good. She has to lick
- 16:39Speaker 1: her paw to get those bills up. The bills are sticky.
- 16:42Speaker 1: Give me some cabbage. Doesn't use the money often. She
- 16:45Speaker 1: calls it cabbage. She calls it cash cabbage. Weird. It's weird.
- 16:49Speaker 1: It's a weird thing she does. I like it.
- 16:53Speaker 2: My problem is that I don't believe that Pebbles was
- 16:58Speaker 2: injured in a way that needed an emergency vet visit.
- 17:02Speaker 2: I think that this was a....
- 17:06Speaker 1: Like, if there was bleeding... Here's what I know.
- 17:11Speaker 2: If your dog's attacked and there's bleeding, you're going to
- 17:13Speaker 2: pay $ 1, 000.
- 17:14Speaker 1: Period.
- 17:15Speaker 2: Because what happens is they have to check... vitals. They
- 17:19Speaker 2: have to hold overnight to see if there's internal bleeding.
- 17:22Speaker 2: And then they have to do a bunch of other
- 17:24Speaker 2: tests to see if this dog's got any sort of diseases.
- 17:27Speaker 1: There's no way if your.
- 17:30Speaker 2: Three pound dog is bleeding in their side, they have
- 17:33Speaker 2: to check to see if there's bleeding going on internally,
- 17:36Speaker 2: which takes imaging. You're just not getting out of there
- 17:40Speaker 2: for under a thousand dollars. And so I have a
- 17:43Speaker 2: problem believing that should they pay the vet bills? Yeah.
- 17:46Speaker 2: But when you take money, when you take cash, there
- 17:49Speaker 2: is an agreement that you've paid your debt. In my opinion,
- 17:52Speaker 2: like we're good here, right? The dog's clearly fine. The
- 17:56Speaker 2: dog's not on her, on their deathbed. The dog is
- 17:58Speaker 2: living a great life. So Mathis doesn't, Then, Mathis gives $ 400.
- 18:03Speaker 1: For the vet bill, so he does what you said,
- 18:06Speaker 1: and then gives $ 600 for emotional distress for $ 1, 000 total.
- 18:09Speaker 1: How do you get to that number? I don't know
- 18:11Speaker 1: how he got to that number.
- 18:12Speaker 2: But then he gives a speech about how we shouldn't
- 18:15Speaker 2: own pit bulls because they're bred to attack, and they
- 18:18Speaker 2: can be fine with kids one minute and then attack
- 18:20Speaker 2: them the next minute. That's what they're bred to do. Sir?
- 18:25Speaker 2: You're wrong. You're just wrong. And you should do a
- 18:30Speaker 2: little bit of reading and research. How dare you?
- 18:33Speaker 1: That's great. There you go. There's Mathis.
- 18:36Speaker 2: So can I go back to something you just said, though?
- 18:38Speaker 2: Because now I want to hear if you hold fast
- 18:40Speaker 2: to this. If something happens and you, in that moment,
- 18:45Speaker 2: hand somebody money. Yeah. You think that that's it? I
- 18:52Speaker 2: think if they take the money and say, okay, we're good,
- 18:55Speaker 2: that's it. So, like, it's one thing.
- 18:58Speaker 1: No, no, no. I don't think you can. But, like,
- 19:01Speaker 1: people do this all the time when they get in
- 19:02Speaker 1: car accidents. Sure. They go, listen, I don't want to
- 19:05Speaker 1: get the insurance involved.
- 19:06Speaker 2: 100%.
- 19:06Speaker 1: Would you take 500?
- 19:06Speaker 2: Yes. Would you take 1,000? That is, your dog's your property.
- 19:11Speaker 2: As much as we love to think that they're family,
- 19:13Speaker 2: I know that's big for us. Dogs sleep in my bed.
- 19:16Speaker 2: They pretty much run the roost at my house. The roost?
- 19:20Speaker 1: The roost.
- 19:20Speaker 2: They run the roost. The whole roost? The whole roost.
- 19:24Speaker 2: Dogs are pack animals. They need to know their place
- 19:27Speaker 2: in order in your family and your world. But at
- 19:32Speaker 2: some point, they are property. They don't have a social
- 19:34Speaker 2: security number, right? So, I know, if you can believe it.
- 19:38Speaker 2: I didn't get my dog's social security number, if you
- 19:39Speaker 2: can believe it. So, at some point, if you go, oh,
- 19:43Speaker 2: my God, I'm really sorry about this. Like, do you,
- 19:47Speaker 2: would you take. Yeah.
- 19:48Speaker 1: But you're also putting that person in a weird spot, right?
- 19:51Speaker 2: If they're like, Hey, I'm actually going to hold off
- 19:54Speaker 2: on this and I'm going to see how much it
- 19:55Speaker 2: is at the vet. Like that's a lot of forward
- 19:57Speaker 2: thinking for that person in that moment. I don't know
- 20:00Speaker 2: if that's my point is if this was an emergency,
- 20:03Speaker 2: the vet bill is bigger. That's my issue, is that
- 20:07Speaker 2: if this was an emergency, you're not getting out for 550.
- 20:11Speaker 1: Sure.
- 20:11Speaker 2: There's just no way. Yeah, and I'm assuming that the
- 20:14Speaker 2: bill wasn't itemized. She sent the bill up to the front.
- 20:18Speaker 2: She said she did, but that could have been one
- 20:21Speaker 2: page that just said you owe 550.
- 20:23Speaker 1: Yeah, interesting. It could have been an annual checkup. Literally
- 20:26Speaker 1: could have been anything.
- 20:27Speaker 2: She could have gone for an annual, gotten all of
- 20:28Speaker 2: her vaccines, gotten heartworm pills, and just turned into 550.
- 20:34Speaker 1: All right.
- 20:34Speaker 2: Fair enough.
- 20:36Speaker 1: Shall we head over to Judge Ross? Let's do it.
- 20:39Speaker 1: Boss Ross.
- 20:40Speaker 2: Where a woman is going to sue another woman for
- 20:43Speaker 2: less money than this situation.
- 20:46Speaker 1: For getting struck by lava. For getting struck by lava. Okay.
- 20:50Speaker 2: Rachel Silverson is suing Tammy Hidalgo for $ 563.
- 20:55Speaker 1: Okay. $ 563.
- 20:57Speaker 2: Wow, that's cheap these days. Which is her deductible that
- 21:03Speaker 2: she had to pay. Interesting deductible, $ 563. It's very specific.
- 21:07Speaker 2: Rachel has been to Hawaii twice.
- 21:11Speaker 1: Humble brag. But has never been to the Big Islands.
- 21:14Speaker 2: And so she wanted to go to one of the
- 21:16Speaker 2: Big Islands because on the Big Islands, they offer.
- 21:20Speaker 1: Lava tours. Yeah, they do. Lava tours. You mean volcano tours?
- 21:24Speaker 1: Call them lava tours here.
- 21:25Speaker 2: Why?
- 21:26Speaker 1: I don't know.
- 21:26Speaker 2: I think because they go out onto a boat and
- 21:31Speaker 2: they go and they get close to a volcano that
- 21:33Speaker 2: is spewing lava.
- 21:34Speaker 1: An active volcano. An active volcano. Yes, got you.
- 21:37Speaker 2: You could call it a volcano tour. You could call
- 21:39Speaker 2: it a lava tour. They call it lava tour.
- 21:41Speaker 1: I don't know what to tell you.
- 21:42Speaker 2: Apparently it's a thing that I didn't know about, but
- 21:45Speaker 2: it's kind of intriguing to me. You go out really early.
- 21:48Speaker 2: You go out while it's still dark, so the lava
- 21:50Speaker 2: really pops. That color of the lava really pops, right?
- 21:53Speaker 2: So Tammy was driving the boat. She owns the company, remember?
- 21:58Speaker 2: Tammy Hidalgo.
- 22:01Speaker 1: Yep.
- 22:01Speaker 2: And while Mr. King, Doug King, is giving the tour,
- 22:08Speaker 2: and Doug right away... you can tell Doug is a
- 22:12Speaker 2: tour guide.
- 22:13Speaker 1: He's a talker. He's very animated. It's a lot.
- 22:16Speaker 2: So Doug says that Rachel's a wonderful person, but she's
- 22:20Speaker 2: a handful.
- 22:22Speaker 1: Of course. And he knows that for the little bit
- 22:25Speaker 1: of time that they spend together. She's been to Hawaii twice.
- 22:27Speaker 2: Occasionally, someone will stick their head out of the boat
- 22:30Speaker 2: to get a little closer, but will listen when we
- 22:32Speaker 2: say to get back in.
- 22:33Speaker 1: She did not.
- 22:36Speaker 2: As we approach the lava, Rachel was like a little
- 22:39Speaker 2: monk climbing over people, trying to get a better look.
- 22:43Speaker 2: Rachel speaks up and says, I am not a monkey.
- 22:45Speaker 1: I'm a woman.
- 22:46Speaker 2: Okay.
- 22:47Speaker 1: And you need to know that. Yeah. So there you go.
- 22:51Speaker 2: She says that she did reach her hands over the
- 22:56Speaker 2: side of the boat to get a picture. But a
- 22:59Speaker 2: lot of other people were doing that as well. And
- 23:01Speaker 2: that's not where the issue takes place.
- 23:03Speaker 1: Okay.
- 23:03Speaker 2: So she says that Doug says over the intercom, you know,
- 23:07Speaker 2: lava's doing her thing.
- 23:08Speaker 1: It's, you know, busting out. It's busting out. Belching is
- 23:12Speaker 1: what she says. Yes. And Doug says.
- 23:15Speaker 2: Over the intercom, we are, we're not supposed to get closer,
- 23:19Speaker 2: but for you, we're going to do it.
- 23:22Speaker 1: Right.
- 23:23Speaker 2: Doug says, listen, I said that every tour to make
- 23:25Speaker 2: guests feel special. The reality is personal injury court case.
- 23:29Speaker 1: It does, but it's too little amount. Yeah. The reality
- 23:33Speaker 1: is the Coast Guard.
- 23:34Speaker 2: $ 563, 000. Million dollars. That's right. The Coast Guard requires us
- 23:39Speaker 2: to stay 300 yards away from the volcano. We stay
- 23:43Speaker 2: 500 yards away. Wow.
- 23:45Speaker 1: Because safety is our number one priority. Of course.
- 23:48Speaker 2: As they begin to get closer, Rachel sees a flaming
- 23:53Speaker 2: ball of lava coming towards them in slow motion. Right?
- 23:57Speaker 1: Right.
- 23:58Speaker 2: And it comes over the edge of the boat into
- 24:02Speaker 2: the boat and lands on her leg.
- 24:05Speaker 1: And she kept her leg. She kept her leg. Okay.
- 24:08Speaker 2: Um, we'd see, uh, that actually we don't see the pictures.
- 24:11Speaker 2: Judge Ross sees the pictures and says, Wolf, like this
- 24:14Speaker 2: is some serious stuff. Um, So Doug runs at her,
- 24:19Speaker 2: hits the ball of lava off with some sort of stick,
- 24:23Speaker 2: a rod, a fishing pole, not sure, to send it
- 24:27Speaker 2: back over the boat. And she says that her leg
- 24:30Speaker 2: immediately began to blister all over.
- 24:32Speaker 1: Of course. Right?
- 24:33Speaker 2: Yeah. And so Doug sees that she's injured, runs over,
- 24:37Speaker 2: does the whole thing, and makes sure that she is
- 24:42Speaker 2: trying to check on her the best that he can
- 24:44Speaker 2: in that moment. She is suing for the deductible of
- 24:48Speaker 2: the hospital bill, which she has.
- 24:50Speaker 1: Proof of, of course.
- 24:51Speaker 2: That's very kind of her to only sue for $ 563. Sure.
- 24:57Speaker 2: Tammy says everybody who comes to a Lava Tour with
- 25:00Speaker 2: us has to sign a release form, which she has.
- 25:03Speaker 1: Standard waiver stuff. Can't sue us. Blah, blah, blah. You
- 25:06Speaker 1: know the deal with the waivers. Liability. Got it.
- 25:10Speaker 2: So she says, I did sign that, but I believe
- 25:13Speaker 2: that they acted with negligence getting too close to the volcano,
- 25:17Speaker 2: which would void the waiver, which, according to the waiver, it.
- 25:21Speaker 1: Would not, by the way.
- 25:22Speaker 2: The waiver is basically like, even with negligence, you can't sue.
- 25:26Speaker 2: Ross says, can you prove that they got closer than
- 25:30Speaker 2: the 500 yards that they claimed that they were, which
- 25:33Speaker 2: is 200 yards further than the Coast Guard requires? She says, no,
- 25:36Speaker 2: I can't. But he said out loud, we're getting closer
- 25:40Speaker 2: than we should be. And they didn't require us to
- 25:44Speaker 2: wear any protective gear. If lava flying into the boat
- 25:48Speaker 2: is even a possibility, I shouldn't have been wearing shorts.
- 25:51Speaker 1: They didn't say anything about it. That's exactly right.
- 25:57Speaker 2: Basically, her whole thing here is they didn't do enough
- 26:00Speaker 2: to protect us from the potential of lava flying into
- 26:04Speaker 2: the boat. And Doug is over there making a big
- 26:06Speaker 2: deal about the fact that she was hanging outside of
- 26:09Speaker 2: the boat, but Obviously, her feet weren't outside of the boat.
- 26:14Speaker 1: So that's the case.
- 26:16Speaker 2: Okay. Judge Ross is ready to rule. So this would
- 26:19Speaker 2: be a great personal injury court decision. because I feel
- 26:22Speaker 2: like judge Gina would take the one thing dude said,
- 26:25Speaker 2: which was we're getting you closer. And he'd give her
- 26:28Speaker 2: a bunch of money. Like he'd give her like thousands
- 26:30Speaker 2: of tens of thousands of dollars. Uh, the contract says
- 26:33Speaker 2: you can't sue him. Judge Ross knows the law. You
- 26:37Speaker 2: cannot get this money, even though I think she's being
- 26:39Speaker 2: relatively reasonable with just the deductible. And it probably would
- 26:43Speaker 2: be the right thing for this company to pay it.
- 26:46Speaker 2: Judge Ross is going to say no money. Judge Ross
- 26:49Speaker 2: is going to say no money. Judge Ross says you
- 26:51Speaker 2: have to prove the burden of proof is.
- 26:56Speaker 1: Up to you here. Not 50-50. No, no, no.
- 26:58Speaker 2: You have to prove that they were negligent in how
- 27:01Speaker 2: they handled their tour.
- 27:03Speaker 1: You did not do that.
- 27:05Speaker 2: You could have maybe brought someone else in that was injured,
- 27:07Speaker 2: showing that it wasn't a freak accident, that this happens
- 27:11Speaker 2: on a regular basis.
- 27:12Speaker 1: You didn't do that. And so, unfortunately... The gavel has
- 27:16Speaker 1: to fall in favor of the defendant. Yeah. And that
- 27:20Speaker 1: is Yo Gavel Gavel. We're going to be back next
- 27:22Speaker 1: week with another episode. Come on back for that. Until then,
- 27:24Speaker 1: all rise.
- 27:29Speaker 2: No gavel gavels, a Bramble jam podcast produced by Brandon
- 27:32Speaker 2: gray and the Bramble jam podcast network studios.
- 27:35Speaker 1: And yeah, that Greenville, South Carolina, leave us a rating
- 27:37Speaker 1: review on apple podcast.
- 27:39Speaker 2: You can get these episodes early and add free by
- 27:42Speaker 2: going to Bramble jam plus.com. You're about to hear some
- 27:52Speaker 2: ads that help keep the lights on here in the
- 27:54Speaker 2: old studio. Thanks for listening or don't listen. It's really
- 27:59Speaker 2: up to you at this point. It's at the end
- 28:01Speaker 2: of the show. I mean, you're listening to me. Hi,
- 28:05Speaker 2: but here they come. I promise they're coming.
- 28:06Speaker 1: Yep. Here they are. Happy day.
