- 0:00This is Scott Becker with the Beckers HealthCare
- 0:03podcast.
- 0:04We're thrilled today to be joined by brilliant
- 0:06writer,
- 0:07journalist, editor,
- 0:09Jacob Emerson.
- 0:10Jacob helps us weekly untangle and and let
- 0:14us know
- 0:15what's going on in the payer space in
- 0:17in the country.
- 0:18Jacob, give us a sense what are the
- 0:21big issues that you're following currently.
- 0:24Yeah. Hey, Scott. It's good to talk with
- 0:25you.
- 0:27So I thought the story we should talk
- 0:29about today or one of is,
- 0:30CMS publishing its 2027
- 0:33Medicare Advantage and Part d proposed rule last
- 0:36week. It's the December
- 0:38now.
- 0:39Basically, you know, putting into place all the
- 0:42federal regulations that will oversee,
- 0:45Medicare Advantage Plans in in 2027.
- 0:48And then that'll also determine how much money
- 0:51they get from the federal government, in terms
- 0:53of quality bonus payments, which can really it
- 0:55can be really high in the in the,
- 0:57in the millions of dollars,
- 0:58in toward the end of the decade. So
- 1:01so basically, the federal government has put out
- 1:03some new rules,
- 1:04or a proposed rule around Medicare Advantage. And
- 1:06there's some really interesting tidbits,
- 1:09I thought we could talk about in term
- 1:10it's a 400 page over 400 page document.
- 1:13And there's there were some things in there
- 1:14that,
- 1:15really hearken back to a lot of the
- 1:17reporting we've done over the last few years
- 1:18here at Becker's.
- 1:19And and it seems like CMS is now
- 1:21responding to some of these issues that we've
- 1:23been picking up on.
- 1:25Fantastic. Tell us about a couple of the
- 1:27highlights that you see in there and and
- 1:29what impact those have.
- 1:31Yeah. And and I do wanna say, you
- 1:32know, I'm not correlating these two things at
- 1:34all. I'm not saying that CMS is putting
- 1:35out this policy
- 1:37based off of our reporting. But it's interesting
- 1:39that,
- 1:40you know, we've been reporting now for a
- 1:43few years about all the different health systems
- 1:46across the country that have told us explicitly
- 1:49in in one on one interviews that they
- 1:51they get fed up with certain Medicare Advantage
- 1:53Plans, certain carriers.
- 1:55It's the prior authorization denial rates. It's the
- 1:58administrative issues,
- 2:00the the slow reimbursements from these plans that
- 2:02they say they're experiencing.
- 2:04And then we've seen this trend where these
- 2:06health systems across the country, some of the
- 2:08largest ones,
- 2:09will either drop single carriers or on the
- 2:12smaller end, we've seen some systems even drop
- 2:15the entirety of the program, just not accepting
- 2:16Medicare Advantage at all
- 2:18anymore.
- 2:19Though it's it's usually the former of just
- 2:21dropping sing singular,
- 2:23plans that aren't working well with them. So
- 2:25that's been going on for a few years.
- 2:27And,
- 2:28as as it stands right now, basically,
- 2:31if if that happens, then the MA plan
- 2:33can go to CMS and say, hey, we've
- 2:35had a provider network disruption. CMS can evaluate
- 2:38that. And then if they determine that there
- 2:40has been a network disruption for that Medicare
- 2:42Advantage member that is now out of network
- 2:44with the hospital system, CMS then can then
- 2:47create a special enrollment period to,
- 2:49let that that let that senior pick another
- 2:51Medicare Advantage plan that is in network with
- 2:53them. So it's a whole convoluted process and
- 2:55administrative process basically to get back in in
- 2:58network with your local system if you're if
- 3:00you're in main plan goes out of network.
- 3:02That's that's how things currently stand. And now
- 3:04in this new 2027 rule, CMS is proposing,
- 3:08that for those who have providers that leave
- 3:11their plans network midyear,
- 3:13that then there can just be a a
- 3:15modified special enrollment period,
- 3:18so that, those members can can find covered
- 3:21care within their area. So, basically, CMS wants
- 3:23to remove all these roadblocks,
- 3:25that currently exist when when this situation happens,
- 3:29and make it much easier for these seniors
- 3:31that are now, you know, surprised out of
- 3:33network with their local hospital system. They can
- 3:35just now go and select a new plan,
- 3:38if if this rule, is is approved in
- 3:41in the new year.
- 3:43Fantastic. So we're watching that, the ability to
- 3:46select a different plan,
- 3:48which is fascinating because Yeah. Yeah. You've got
- 3:50both health systems
- 3:51increasingly
- 3:53disliking the Medicare Advantage plans in in the
- 3:56prior auths and the rules and the challenges
- 3:59versus seeing Medicare patients directly.
- 4:01And then you've got Medicare patients all over
- 4:03the board in terms of their satisfaction with
- 4:05Medicare Advantage.
- 4:07Some very positive, some negative, a a real
- 4:09mix, but fascinating to see these kinds of
- 4:11changes.
- 4:12Yeah. What else are you watching closely there?
- 4:14Yeah. And and like you said, it's just
- 4:15interesting. The the the federal government is responding
- 4:18directly to this to this issue that we've
- 4:20been seeing play out for a few years
- 4:21now.
- 4:22But another interesting thing that I saw in
- 4:24this proposed rule where they're they're,
- 4:27requesting feedback
- 4:29from people across the industry,
- 4:31on, you know, issues that are affecting the
- 4:33entire industry. And they basically CMS wants feedback
- 4:36on,
- 4:37on their current risk adjustment system, their the
- 4:40coding practices some payers employ around Medicare Advantage
- 4:43that have made a lot of headlines, in
- 4:45the most recent decade,
- 4:47around, you know, fraud and upcoding and things
- 4:50like that. But CMS is basically now writing
- 4:52that they recognize that the current risk adjustment
- 4:54system might disadvantage smaller, newer,
- 4:57less well resourced Medicare Advantage Plans, and that
- 5:00their their current rules may encourage
- 5:03MA plans to prioritize investment in coding activities
- 5:06that could lead them, coding more intensely than
- 5:09original Medicare. So, basically, CMS
- 5:12is saying that we understand that regional smaller
- 5:15nonprofit Medicare Advantage Plans are struggling compared to
- 5:18the big guys right now. United, Humana, CVS,
- 5:21Aetna,
- 5:22and we also recognize that they're because of
- 5:24the how the current rules and system and
- 5:26coding exists that there is an incentive to
- 5:30code higher in Medicare Advantage, than there is
- 5:32in original Medicare. So CMS basically wants feedback
- 5:35about that. And I just think that that's
- 5:37interesting that the government is is recognizing
- 5:40that the biggest players in the industry need
- 5:42more oversight, but that some of the smaller
- 5:44players within Medicare Advantage need more help, to
- 5:46stay competitive against these these giants.
- 5:50No. Fascinating. And and the smart plans really
- 5:52are in
- 5:53really struggling on it. It seems like on
- 5:55a variety of different ways, specifically as reimbursement
- 5:57doesn't jump and health systems begin to hate
- 6:00the plans, the whole the whole combination becomes
- 6:02more and more challenging, I take it. Yeah.
- 6:03Yeah. Definitely. So, you know, we'll see what
- 6:06happens with that. CMS is always asking for
- 6:08for,
- 6:09you know, public feedback when it puts out
- 6:10these proposed rules, and it doesn't necessarily always
- 6:13put into place new policy based off of,
- 6:16you know, the the the feedback that it
- 6:17was wanting on a certain topic. So it
- 6:20it, you know, it's up in the air
- 6:21at this point, but it's just interesting that
- 6:22the government is acknowledging that that is a
- 6:24very real issue.
- 6:26And then the last thing I wanted to
- 6:27just note for you, Scott, in terms of
- 6:28some new data that we got in from
- 6:30a group that looks into how GLP one
- 6:33medications are being covered across the country. You
- 6:35know, it's a big another massive issue within
- 6:38the industry. It's driving up health care costs
- 6:40for everybody, because plans are having to cover
- 6:42the premiums for these very, very expensive medications.
- 6:46And specifically when it comes to the marketplace
- 6:48plans, so the Affordable Care Act, Obamacare, whatever
- 6:50you call it, that access to GLP ones
- 6:54for weight loss specifically, so not for diabetes
- 6:56treatment,
- 6:57that access is shrinking all over the country.
- 7:00And that it really is becoming almost a
- 7:02lottery of
- 7:03if you're lucky enough to live in a
- 7:05place, in a state that,
- 7:07has health plans that are offering GLP one
- 7:09coverage for obesity,
- 7:10then then you're one of the few in
- 7:12the country that can. It's a small percentage
- 7:14at this point.
- 7:15But it really that it's a lottery that
- 7:17it's it comes down to it seems almost
- 7:19like luck, that you live in a state
- 7:21that might offer this kind of thing. And
- 7:23and there's only two states, California and North
- 7:25Dakota, where all health plans on the on
- 7:27their marketplaces are offering coverage for GLP ones
- 7:30for obesity.
- 7:31And the list is only a little bit
- 7:33bigger,
- 7:34for for plans that are available on those
- 7:36state marketplaces.
- 7:37So the the bigger point here is basically
- 7:39that GLP one access, if you're on an
- 7:41Obamacare or ACA plan,
- 7:44going into next year, it's declining. And and
- 7:46this does seem to be a general theme
- 7:47we see around the country. And and, you
- 7:49know, you could argue that access is getting
- 7:51easier with some of the direct to consumer
- 7:52things we're seeing with with the manufacturers, the
- 7:55drug manufacturers. But, overall, if you want your
- 7:57health plan to cover GLP ones for obesity
- 7:59next year and you're shopping on an ACA
- 8:01marketplace, it's it's probably,
- 8:04low chances that you'll be able to have
- 8:05that happen.
- 8:08Literally, fascinating. And and what's happened in this
- 8:10GLP market and this is so crazy to
- 8:12me
- 8:13that you you could now buy them through
- 8:16the
- 8:16compounded pharmacies and so forth at prices that
- 8:19are not that different
- 8:21than European prices and other place prices, literally,
- 8:24you know, and and but if you get
- 8:26it through your insurance company,
- 8:28I mean, it's insane to me. It's still
- 8:29a thousand dollars a month or so. I
- 8:31mean, it seems to me just insane
- 8:33that bifurcated market and
- 8:36and and and and I don't know.
- 8:38Obviously, there's there's movement here because there's more
- 8:40price competition.
- 8:41Well, the GOP ones are still trying to
- 8:43get paid well by the medical establishment, but
- 8:46really seems insane to me.
- 8:48It it it's like going to college. Nobody
- 8:50pays the same price anymore. It's GLP one
- 8:52seem to be the same thing. It seems
- 8:53to be just insane how that's evolved. You
- 8:55know? I think what what you're basically pointing
- 8:57to, Scott, it's it's really you know, this
- 8:59is not a new issue, but I think
- 9:00what it's really the GLP one thing over
- 9:02the last few years has really
- 9:04exposed the issue of the fact that sometimes
- 9:06when you use your health insurance to cover
- 9:07a prescription medication, that it actually makes it
- 9:09more expensive than if you went for, than
- 9:12if you just paid out of pocket or
- 9:14if you went to the manufacturer directly, which
- 9:15you now can with some of these GLP
- 9:17ones,
- 9:18or or like you said, you do the
- 9:19compounding. You know, and it's a bit outside
- 9:21of my wheelhouse of understanding of how all
- 9:23the, you know, the contracts and the PBMs
- 9:25and all that works together. It's a very
- 9:27complicated issue,
- 9:28but, you know, it it does still stand
- 9:31that people, I think, are are seeing that
- 9:33a lot of the times when you use
- 9:34for some of these, especially specialty medications, it's
- 9:37often yeah. It's more expensive when you get
- 9:39your health plan involved.
- 9:40And now there's a lot more issues in
- 9:42terms of just the consumerism
- 9:44of it all to access these medications.
- 9:46And I think that's really, you know, playing
- 9:48a part in how insurers and and their
- 9:50PBM subsidiaries kind of navigate business strategies moving
- 9:54forward as well. At least that's something that
- 9:55we're definitely seeing. No. A 100%. It it
- 9:58is literally fascinating to watch how this is
- 10:00evolving.
- 10:02Just so interesting. I I can't even tell
- 10:04you. So CMS regulations,
- 10:06Medicare Advantage Plans, all over the board in
- 10:09terms of what's going on in those.
- 10:11GOP one pricing, whether a health plan or
- 10:14buying it directly through a compounder,
- 10:18a crazily
- 10:19evolving market, just insane literally.
- 10:22Anything else that's top of mind that you
- 10:24wanted to share with us today?
- 10:26No. I think that that covers it, Scott.
- 10:27I mean, we're really just, trying to stay
- 10:30on top of these last few minute issues,
- 10:31especially when ACA subsidies going into next year.
- 10:34Will they, won't they? It's looking like won't
- 10:37they,
- 10:38as of now in terms of where the
- 10:40president and and Republicans stand. So that's really
- 10:43the main issue we're gonna be tracking pretty
- 10:45much day by day at this point through
- 10:46the end of the year of what happens
- 10:47to these subsidies,
- 10:49because the hospital and the insurance executives that
- 10:52we're talking to daily are, are worried in
- 10:54terms of what it means for their businesses
- 10:56if these subs don't continue. So that's gonna
- 10:58be top of mind for us.
- 11:00A 100%.
- 11:01Jacob Emerson, the best in the business. Thank
- 11:04you so much for joining us today on
- 11:05the Bector's Health Care podcast. Thank you very,
- 11:07very much. Thank you, Scott.
