- 0:00Speaker 1: What's up everyone, and welcome back to the program. Brian
- 0:05Speaker 1: Kolberger pled guilty to murdering the Idaho four. Well, now
- 0:09Speaker 1: that same scumbag, Brian Colberger is claiming that he's innocent
- 0:14Speaker 1: and that the only reason that he pled guilty is
- 0:16Speaker 1: because he had ineffective counsel. And for anybody who followed
- 0:20Speaker 1: the story or the case, they know that that's not true.
- 0:24Speaker 1: They jumped through every single who trying to get Brian
- 0:28Speaker 1: Colberger off. You know what, Brian Colberger didn't have on
- 0:31Speaker 1: his side and still doesn't have on his side the truth.
- 0:36Speaker 1: And that's pretty hard to overcome, especially when there's as
- 0:38Speaker 1: much evidence as there was against Brian Colberger. But now
- 0:44Speaker 1: he's making this push to try and get an appeal,
- 0:47Speaker 1: to try and overturn his sentence and have a new trial,
- 0:51Speaker 1: and spoiler alert, I don't think he's going to be successful.
- 0:55Speaker 1: So today we have an article from the Idaho Statesman
- 0:58Speaker 1: and the headline there were no appeals, So how is
- 1:01Speaker 1: Coburger essentially appealing? Could it work? This article was authored
- 1:06Speaker 1: by Alex Breezy. When Brian Colberger admitted to stabbing for
- 1:11Speaker 1: University of Idaho students to death, he was asked by
- 1:14Speaker 1: the presiding judge question after question to make sure all
- 1:17Speaker 1: aspects of his plea were offered voluntarily, and they were.
- 1:22Speaker 1: Of course, the convicted murderer is now claiming that wasn't
- 1:26Speaker 1: the case, and despite the fact that his plea agreement
- 1:29Speaker 1: included waiving his right to appeal, he's taking another legal
- 1:33Speaker 1: avenue to try to get the same result, have his
- 1:36Speaker 1: guilty plea tossed out so he can pursue a trial.
- 1:39Speaker 1: My prediction, the Candice Owen's crowd is going to latch
- 1:43Speaker 1: onto this shit. This will be their next grift. Oh,
- 1:46Speaker 1: Brian Colberger's innocent. It's a big government cover up. Ninety
- 1:50Speaker 1: six FBI agents broke in there and they stabbed him
- 1:53Speaker 1: to death on the orders of Joe Biden. That's the
- 1:56Speaker 1: kind of bullshit you hear from these people, So I
- 1:58Speaker 1: wouldn't be shocked to hear it here, especially considering their
- 2:02Speaker 1: high priestess can Dune. Soewen has already tried to dip
- 2:06Speaker 1: her toes into the coburger water previously, so I expect
- 2:09Speaker 1: that griff machine to really pick up. A Boise based
- 2:14Speaker 1: defense attorney told The Idaho Statesman that Coberger's claim doesn't
- 2:17Speaker 1: make a lot of sense. But how is it that
- 2:20Speaker 1: Colberger is allowed to go down this path to begin with?
- 2:23Speaker 1: Here's how it breaks down. Judge Stephen Hipler of Idaho's
- 2:27Speaker 1: fourth Judicial District stressed during a hearing last summer that
- 2:30Speaker 1: he wanted to be sure that Colberger did not plead
- 2:33Speaker 1: guilty unless he actually was understood and agreed the deal
- 2:37Speaker 1: was not threatened or coerced, was satisfied with his attorney's representation,
- 2:42Speaker 1: and comprehended the consequences of cleating guilty. Colberger answered affirmatively
- 2:47Speaker 1: every time. So, look, we're gonna have to go through
- 2:49Speaker 1: this dog and pony show. But in my opinion, Brian
- 2:52Speaker 1: Colberger has no shot at getting this overturned. We're not
- 2:55Speaker 1: talking about a Becky Hill type situation where the court
- 2:58Speaker 1: clerk came in and he took a fat dump in
- 3:01Speaker 1: the middle of the jury room. Nothing like that. And
- 3:04Speaker 1: my guess is he's seen all this crap about Tyler
- 3:06Speaker 1: Robinson and wants to get in on it. Wants to
- 3:10Speaker 1: make sure there's some grifting going on for him. And
- 3:13Speaker 1: considering how many Lemmings are willing to follow can don
- 3:16Speaker 1: so Owen's off that cliff what you think that's not
- 3:19Speaker 1: going to be the case here, it most certainly will be.
- 3:23Speaker 1: And when asked whether he willfully, unlawfully, deliberately, with premeditation
- 3:27Speaker 1: and with malice a forethought, stab Madison Mogan, Kaylee Gunsalvis,
- 3:32Speaker 1: Xana Kernodle, and Ethan Chapin to death after breaking into
- 3:35Speaker 1: their off campus home on November thirteenth, twenty twenty two,
- 3:39Speaker 1: Coburger answered yes four times. So if he didn't do it,
- 3:43Speaker 1: if he didn't get good counsel, why would he agree
- 3:46Speaker 1: to all these different stipulations. Why would he even plea
- 3:50Speaker 1: in the first place. Why not go to the judge
- 3:52Speaker 1: and say, look, my council's ineffective, they're not doing the
- 3:55Speaker 1: right thing, and I can't go on with my trial
- 3:58Speaker 1: right now until I have better representation. Didn't even say that,
- 4:02Speaker 1: didn't even make a peep about Ann Taylor. And in fact,
- 4:09Speaker 1: I think Ann Taylor did more than any lawyer could have.
- 4:12Speaker 1: Basically she was on point. You see how frustrated everybody
- 4:18Speaker 1: on the other side was. That was because Ann Taylor.
- 4:21Speaker 1: She exhausted every avenue trying to get this scumbag off,
- 4:25Speaker 1: every last avenue, and there was nothing there but now
- 4:29Speaker 1: all of a sudden, he has a new narrative. Oh,
- 4:34Speaker 1: I'm innocent. I didn't do it. All of that was
- 4:36Speaker 1: just a big lie. Like what And to anybody out
- 4:41Speaker 1: there that believes this guy's bullshit, congratulations, you are dumb
- 4:45Speaker 1: as fuck. Despite that, the former Washington State graduate student
- 4:50Speaker 1: has now asserted that he's innocent and wants to be
- 4:53Speaker 1: let out of the plea agreement which took the death
- 4:55Speaker 1: penalty off the table. Coberger thirty one has filed a
- 4:58Speaker 1: petition for a postc relief, and the same judge who
- 5:02Speaker 1: sentenced them will decide whether his claims have merit. Oh
- 5:05Speaker 1: I highly doubt that Judge Hipler is not exactly the
- 5:08Speaker 1: kind of guy to play these games. Among the consequences
- 5:14Speaker 1: the judge asked Coburger about was that he agreed to
- 5:17Speaker 1: wave his right to appeal in the case, but that
- 5:20Speaker 1: does not include the right to ask the court for
- 5:23Speaker 1: postconviction relief, something any incarcerated person has the ability to
- 5:27Speaker 1: do regardless of their case's circumstances. The petition is a
- 5:31Speaker 1: civil remedy that allows someone convicted of a crime to
- 5:34Speaker 1: contend that their sentence was a violation of the law.
- 5:38Speaker 1: In fact, the US Supreme Court addressed the possibility of
- 5:40Speaker 1: challenging convictions even after a defendant signs away their rights
- 5:44Speaker 1: to appeal in Guarza verse Idaho. The fact that a
- 5:47Speaker 1: defendant waves the right to appeal doesn't mean they don't
- 5:50Speaker 1: have the right to appeal, Hipler explained in court, referring
- 5:54Speaker 1: to the twenty nineteen ruling. So it may affect the
- 5:56Speaker 1: outcome of that appeal, and it may affect the underlying
- 5:59Speaker 1: case and the place agreement, But nonetheless, the right to
- 6:01Speaker 1: appeal does not go away because of the waiver. Justice
- 6:05Speaker 1: Sonya Sodomyor wrote in the Supreme Court's majority opinion that
- 6:09Speaker 1: no appeal waiver serves as an absolute bar to all
- 6:12Speaker 1: appellate claims. Well, that's true, and good luck have at it.
- 6:17Speaker 1: Go ahead and waste everybody's time, waste everybody's resources, and
- 6:21Speaker 1: your bitch ass is gonna end up staying where you are,
- 6:25Speaker 1: exactly where you belong. In fact, if I had my way, helicopters, volcanoes,
- 6:31Speaker 1: and I'll do the pushing. Most fundamentally, Sodomyor wrote, courts
- 6:36Speaker 1: agree that defendants retain the right to challenge whether the
- 6:38Speaker 1: waiver itself is valid and enforceable, for example, on the
- 6:42Speaker 1: grounds that it was unknowing or involuntary. Consequently, while signing
- 6:46Speaker 1: an appeal waiver means giving up some, many, or even
- 6:49Speaker 1: most appellate claims, some claims. Nevertheless, remain cool, make the
- 6:54Speaker 1: claim and then watch it go up and smoke, because
- 6:57Speaker 1: that's what's gonna happen. And I can't wait to watch
- 7:00Speaker 1: all these idiots gas people up, acting like Colberger is
- 7:03Speaker 1: gonna get off only for that ought to happen. It's
- 7:06Speaker 1: gonna be joyful, very joyful. In a handwritten aff of
- 7:12Speaker 1: David that was filed with Idaho's court system, Coberger alleged
- 7:15Speaker 1: that he was convinced to falsely confess to the burglary
- 7:19Speaker 1: and for a murder charges by coercion, disinformation, false promises,
- 7:23Speaker 1: and the withholding of exculpatory discovery. He was convinced that
- 7:28Speaker 1: actual guilt was not an important factor in accepting his
- 7:31Speaker 1: plea deal, as he could have faced the death penalty.
- 7:33Speaker 1: He wrote, and was advised to lie. Oh, I'm sure
- 7:37Speaker 1: that that's happened. I'm sure that Ann Taylor told him
- 7:39Speaker 1: to lie. Is this guy for real? Like, honestly, guess
- 7:43Speaker 1: what the meter was running? So Ann Taylor was gonna
- 7:47Speaker 1: get paid. From her perspective, at least financially speaking, it
- 7:51Speaker 1: would have been a good thing for this trial to continue.
- 7:54Speaker 1: But sure, I'm sure that Ann Taylor was just like
- 7:56Speaker 1: you know what, Brian lay, and we can just you know,
- 7:59Speaker 1: get on with our lives. Those claims, which mainly fall
- 8:04Speaker 1: under the umbrella of ineffective assistance of counsel, are hard
- 8:07Speaker 1: to prove Edwena L. Cox, a Boise based defense attorney,
- 8:11Speaker 1: told The Statesman Colberger had a team of well respected
- 8:14Speaker 1: attorneys who filed dozens of emotions covering many potential avenues,
- 8:19Speaker 1: and were able to get the death penalty taken off
- 8:21Speaker 1: the table, something she called an incredible defense victory for sure,
- 8:26Speaker 1: and I think the court's gonna see it that way. Now.
- 8:29Speaker 1: Colburger is entitled to make whatever argument he wants, but
- 8:32Speaker 1: I'm entitled to tell him I don't believe his argument.
- 8:36Speaker 1: And guess what, there's no alleged deer. This piece of
- 8:39Speaker 1: shit murdered them. So if you think I'm going to
- 8:41Speaker 1: say alleged when I'm talking about bitch ass Brian Colberger,
- 8:44Speaker 1: you got another thing coming. This rotten, dirty son of
- 8:48Speaker 1: a bitch is trying to cause more pain, more suffering,
- 8:51Speaker 1: and put himself back in the spotlight. That's what he's doing.
- 8:54Speaker 1: It just seems to me to be an incredulous claim,
- 8:57Speaker 1: she told The Statesman. Of Coburger's post conviction relief, we move.
- 9:01Speaker 1: El Cox particularly pointed to one of Coburger's claims in
- 9:04Speaker 1: the filing that his attorneys fail to inform him about
- 9:07Speaker 1: a supposed clump of unknown hair found in Ethan Chapin's hand,
- 9:11Speaker 1: something that seems unlikely to her. It was one of
- 9:14Speaker 1: dozens of samples that were examined by investigators microscopically. According
- 9:18Speaker 1: to a lab report from the FBI, none of the
- 9:21Speaker 1: samples matched Coburger's hair, but one of the defense own experts, Siree,
- 9:25Speaker 1: wrote in a report that the hair was morphologically consistent
- 9:29Speaker 1: with Japin's own hair. If there really was a bombshell
- 9:33Speaker 1: piece of evidence, Coberger's attorneys would have chased it down
- 9:36Speaker 1: and veted it. El Cox said. She noted that some
- 9:39Speaker 1: people might try to frame this as exculpatory evidence, but
- 9:42Speaker 1: she doesn't agree with that at all, and I don't either,
- 9:46Speaker 1: and I doubt the court's going to so now that
- 9:49Speaker 1: this is back in the news. Obviously we're going to
- 9:51Speaker 1: be talking about it, and we'll follow along wherever it goes,
- 9:56Speaker 1: and maybe we have to dive into some more core
- 9:58Speaker 1: documents and see what's what. But as far as Brian
- 10:02Speaker 1: Colberger is saying that he wasn't given a fair shake,
- 10:05Speaker 1: that things went in a direction that was unfairer, that
- 10:09Speaker 1: is just false and I wholly disagree with it. Now,
- 10:13Speaker 1: does that mean that he shouldn't get another crack here?
- 10:16Speaker 1: If that's what the system says he's allowed to do, No,
- 10:20Speaker 1: go for it. You want to waste your time, you
- 10:22Speaker 1: want to waste everybody else's time? Cool? But I think
- 10:25Speaker 1: when all is said and done, Brian Colberger's bitch ass
- 10:29Speaker 1: is going to remain exactly where he is, and in
- 10:32Speaker 1: my opinion, he should feel lucky about that, because if
- 10:35Speaker 1: this did go to trial, does anyone out there really
- 10:37Speaker 1: believe that a jury in Idaho wasn't convicting him and
- 10:41Speaker 1: sending him to the death chamber, because in my opinion,
- 10:44Speaker 1: that was the likeliest scenario. Oh, we'll follow along, we'll
- 10:47Speaker 1: see what Brian Colberger has to say. But I think
- 10:49Speaker 1: when all is said and done, this clown's on a
- 10:51Speaker 1: long road. To nowhere. All the information that goes with
