- 2:43Question and where were you living then? Answer in Delray Beach?
- 2:48Question and what was the address there? Answer? I can't
- 2:52remember the address offhand? Question okay. So Brent Moody was
- 2:56convicted in Palm Beach County for a robbery answer yes,
- 3:01question and sentenced as the habitual offender. Answer correct question okay.
- 3:07And I'm sorry if I asked you this already, But
- 3:09do you know when that took place? Answer about five
- 3:12years ago? Question okay, so you were not yet in
- 3:16custody on your trafficking case. Answer correct question okay. And
- 3:21you and mister Moody have a child? Is that correct?
- 3:25Answer yes? Question okay? And your child was born in prison?

- 3:59and a vetamines. Answer yes. Question okay? And do you
- 4:03know what drug in particular you were convicted of trafficking
- 4:07in answer methan fetamine amphetamines. Question what county were you
- 4:12convicted of trafficking and amphetamines? Answer Hillsborough? Question okay, answer Tampa, Florida.
- 4:21Question okay. And you were convicted of trafficking and more
- 4:24than twenty eight grams of methan fetamine. Answer no, Actually,
- 4:28it wasn't more than twenty eight grams. That's what I
- 4:31was booked on, but it was under twenty eight grams
- 4:33when I pled out. Question, but you pled to trafficking?
- 4:36Correct answer correct, that's correct. Question. What does trafficking mean?
- 4:42Answer selling drugs basically? Question okay? So you were convicted
- 4:45of selling drugs? Answer well, trafficking right. Question okay, But
- 4:50trafficking means selling drugs? Answer correct. Question You entered a
- 4:55guilty plea to something? Did you not answer? Correct question?
- 4:59And you stood in front of judge and told the
- 5:01judge that you were guilty? Did you not answer? I did? Question?
- 5:07And you told the judge that you were guilty of
- 5:09selling drugs? Is that correct? Answer? Yes, if that's how
- 5:12you want to word it. Yes. Question, Well, you tell
- 5:15me how you want to word it. You can word
- 5:17it any way you want to answer. Yes, I told
- 5:21him I was guilty of trafficking selling methin vetamine. Answer okay.
- 5:25And the trafficking in methin vetamine had a significance because
- 5:28it carried a minimum mandatory sentence with it, did it not? Answer? Right? Question?
- 5:34And do you know what I mean when I say
- 5:36mandatory minimum sentence? Answer yes, question okay, what does it mean?
- 5:42Answer that I had to do? It was three years
- 5:46that I had a minimum mandatory of three years. Question
- 5:49so the judge could think you were the nicest person
- 5:52in the world and he had to give you three
- 5:54years in prison? Answer correct question okay. And you negotiated
- 5:59a guilty plea to that trafficking case? Answer yes. Question
- 6:03you had a lawyer representing you? Did you not answer?
- 6:05I did? Question okay? Did you have a quart appointed
- 6:10lawyer or did you have a private paid lawyer? Answer no,
- 6:13I had a private attorney. Question okay. And that private
- 6:17attorney negotiated the plea for you correct answer correct question okay.
- 6:23And do you know that you could be facing up
- 6:25to thirty years on that trafficking case. Answer. I think
- 6:28it was like seven years I could have gotten was
- 6:31seven years? It went down to three. Question. Okay, your
- 6:36understanding is that the maximum you could have been sentenced
- 6:39to on the trafficking case that you played guilty to
- 6:41was seven years in prison. Answer correct question and your
- 6:45lawyer told you that, Brad Edwards. I object, Clodberger, you
- 6:51don't need to answer that question. That's fine, Okay. Your
- 6:54understanding was that you could only be sentenced to seven
- 6:57years in prison. Answer. When I first was booked on
- 7:00the charge and I went to the first appearance, the
- 7:03first judge you see, at first appearance told me it
- 7:06was a minimum mandatory of seven years. Question okay, answer,
- 7:10so that's what I was told. Question right. So I'm
- 7:13not talking about the minimum mandatory. I'm talking about the
- 7:16statutory maximum was for the offense for which you entered
- 7:20into a plea negotiation. Answer with trafficking charges, it's about
- 7:24the weight of the drug and because I had twenty
- 7:26eight grams, it was a seven year minimum mandatory. Now,
- 7:30when I sat in county and I fought it for
- 7:32ten months, when they went back and tested the drugs,
- 7:35it wasn't twenty eight grams. It was under twenty eight grams.
- 7:39So I took a guilty charge, pleaded guilty to trafficking
- 7:42selling drugs or methamphetamines, and took thirty six months. Okay,
- 7:48My question though, this is Goldberger again putting aside the
- 7:52minimum mandatory. Do you know what the statutory maximum is?
- 7:57Do you know what I mean when I say statutory maximum? Answer?
- 8:01No question. Okay. Now you say that you fought and
- 8:05contested that charge for ten months? Answer correct question. Okay,
- 8:09So you told the judge for ten months that you
- 8:11are not guilty of the offense? Correct objection by mister Scarola.
- 8:17Objection leading the witness. I don't know how do mister
- 8:21Scola objection pleading Goldberger? Did you tell the judge that
- 8:26you were guilty of the offense for ten months? Answer correct?
- 8:30Scrolla objection leading Goldberger question. And after ten months did
- 8:36you enter a guilty plea answer yes? Question okay, So
- 8:40after ten months of saying that you were not guilty,
- 8:43you stood in front of a judge. Was it the
- 8:45same judge? By the way? Answer yes, scrolla objection, compound
- 8:50and leading question. Okay, did you tell the judge that
- 8:55in fact, you were guilty of selling drugs. Answer, so
- 8:58when I was booked, if you could see the charges
- 9:00that I was booked to when I pled guilty, I
- 9:03was in charge with all those charges that I was
- 9:06first booked on. But yes, I pleaded guilty after ten months.
- 9:10Question okay, answer of seeing the same judge, Yes, I did.
- 9:15Question well. In addition to pleading guilty to trafficking in
- 9:18drugs and selling drugs, you also pled guilty to violation
- 9:21of probation. Answer correct. Question and in fact you were
- 9:26on probation for theft for stealing? Were you not? Answer correct?
- 9:31Mister scroll objection leading question? Were you on probation for theft? Answer? Yes,
- 9:37I was? Question okay? And were you on probation for
- 9:41felony theft? Answer there is a possibility? Yes, question okay,
- 9:47answer I'm sure I was. Question okay, you sure you were? Answer? Yes,
- 9:52I was. Question why are you sure you on probation
- 9:56for a felony theft? Answer? Let me go back, I
- 9:59was on probation for a felony theft. Question and the
- 10:02reason why you were on probation for a felony theft
- 10:05is that you had so many convictions of petty theft.
- 10:09Answer correct, scrolla objection leading Goldberger. Question, was there another
- 10:15charge that you were also charged with and pled guilty
- 10:18to when you were sentenced to three years in the
- 10:21State Florida Department of Corrections. Answer it was the trafficking,
- 10:25violation of probation and petty theft. Question and the petty
- 10:29theft answer correct. Question Okay did you plead guilty to
- 10:34that petty theft? Answer yes? Question was that a crime
- 10:38of dishonesty? Answer? Was it a crime of dishonesty? Question? Yeah?
- 10:45Answer I mean. She gets interrupted by scarrolla excuse me,
- 10:49I'm going to object to the extent in question, calls
- 10:52for legal conclusion. Goldberger, Okay, did you do something dishonest
- 10:56when you stole and got convicted of petty theft? Answer? Sure?
- 11:02Question okay, what was it? He gets interrupted by scrolla
- 11:06same objection. Goldberger goes on, what was it that you
- 11:10did that was dishonest when you stole and pled guilty
- 11:14to the petty theft? Answer? I took something that wasn't mine.
- 11:17Question and what did you take? Answer? I can't remember
- 11:21right now, question because there were so many of them.
- 11:24Answer no, I just can't remember exactly what I took.
- 11:28Question did you have a bond when you were arrested
- 11:30for selling, trafficking and amphetamines? Answer yes, I did. Question
- 11:35I don't remember how much of what? Answer I don't
- 11:37remember how much it was. Question did you try and
- 11:40post bond at all? Answer no? Question okay? Did you
- 11:44have the money to postpond? Answer no? Okay? And if
- 11:50I tell you that the bond was twenty five thousand dollars,
- 11:52did you have twenty five hundred dollars to post bond?
- 11:55Answer correct? Question Who is your lawyer on the k
- 12:00Answer Julian Hayes. Question I'm sorry, Julian. Answer Julian Hayes. Yes,
- 12:07question okay. Is that a man or a female? Answer
- 12:10a man? Question okay? And he was retained as a
- 12:14lawyer on your part? Answer yes. Question okay, did you
- 12:18hire a lawyer? Answer yes? Question did mister Edwards assist
- 12:22you in the matter? Answer no? All right. So we're
- 12:26going to wrap up right here, and in the next
- 12:28episode we're going to pick up where we left off.
- 12:30All of the information that goes with this episode can
- 12:33be found in the description box. What's up everyone, and

- 12:43the Courtney wild deposition. Question, Now, have you been at
- 12:49this correctional institution? I say this correctional institution. I think
- 12:52it's called Gadsden. Is that what it's called? Answer? Uh
- 12:57huh question Gadsden Correctional Institution. Answer yes, question have you
- 13:02been there since your sentence? Answer? Yeah, Well, when I
- 13:05was first sentenced, they took me to RNO. Question what's that? Answer?
- 13:12R and O is where they bring everybody that gets
- 13:14sentenced to prison and they basically show you how to
- 13:16be a prisoner for about two months, and then they
- 13:19ship you to whatever compound you're going to. So I
- 13:21stayed at R and O, which is a compound in Ocala,
- 13:24for two months, and then I was shipped here. Question
- 13:29and you go to this rn O to learn how
- 13:30to be a prisoner? Answer yeah, Basically that's where they
- 13:33show you, like how to live in these conditions. Basically,

- 13:40leaving rn O? Answer yes? Question in Ocala? Answer yes.
- 13:44Question Okay, when is your projected release date? Miss Wilde?

- 22:16Palm Beach County. Question okay, and you served six months
- 22:19in jail for that Answer yes, question because it was

- 22:35you served six months in the Palm Beach County jail.
- 22:38Answer it was a total of three grand thefts that
- 22:40I served six months on, if that's what you're asking. Question,
- 22:45So you pled to three grand thefts? Answer correct question,
- 22:49three different time periods though? Answer yes, question okay, So
- 22:53you pled the three at one time? Answer correct question,
- 22:58entered into plea negotiation? Answer I can't. I mean it
- 23:02was I can't remember exactly the year, but yes, I
- 23:05believe so. Though question okay, who represented you on those cases?
- 23:09Answer public defender? Question okay, and you were looking at
- 23:13perhaps more than six months in jail for those three
- 23:16offenses for which you were charged. Answer I can't remember.
- 23:20Question you don't know? Answer right question, but you certainly
- 23:23know that you entered into plea negotiation right answer correct question.
- 23:28When you were deposed in May of twenty ten, you
- 23:31indicated that you had been convicted of crimes. Maybe four times,
- 23:34perhaps three times. SCROLLA object to the form of the
- 23:38question misleading in proper impeachment. Mister Goldberger, does that seem
- 23:42to be accurate? Scarola objects once again, same objections, Courtney Wilde.

- 24:06you want to put it here and I can go back.
- 24:08I mean, I don't know. Question okay. So let me
- 24:12first start by asking you to look at page two
- 24:14eighty six of the deposition and see if it refreshes
- 24:17your memory. SCROLLA. Do you have an extra copy? Goldburger?
- 24:21I don't. I'm sorry, Brewer, I think I've got one. SCROLLA.

- 24:29we'll just wait for a minute. Which page are you on?
- 24:32Goldberger to eighty six? Goldburger. So, what I'd like you
- 24:36to do is read page two eighty six and ask
- 24:39you if it refreshes your memory as to how many
- 24:42times that you've been convicted of a crime. Mister Scrola,
- 24:47I'm going to object this is in proper use of
- 24:49a deposition which indicates that there was no answer to
- 24:53that question at the time. How many times have you
- 24:55been convicted of a crime? Answer, I'm not sure, Goldburger.
- 24:59Just keep going on. Read the next page if you would, ma'am.
- 25:03Courney Wild to eighty seven. Goldberger, I want you to
- 25:06have all the context that you need, so read as
- 25:09much as you need to to see if it refreshes
- 25:11your recollection as to how many times you've been convicted
- 25:14of a crime Courtney Wild at this point in time,
- 25:19mister Goldberger, Yes, ma'am, but we know that there's been

- 25:29I'm going to object, argumentative Goldberger. Okay, scrolla, leading Corney
- 25:37wild It says either convicted or repleted guilty to a
- 25:39crime maybe four times. Scrolla read the entire answer, if
- 25:43you would, please, miss Wild and if you could read
- 25:47it out loud, please, since you've read a portion of
- 25:50it out loud. Page two ninety six, starting at line nineteen,
- 25:55Corney Wilde, it says what page is it to eighty six?
- 25:57SCROLLA to eighty six, beginning at line nineteen. Just read
- 26:01that into the record, and Corney Wilde begins, and so,
- 26:06how many times have you been convicted of a crime?
- 26:08My answer was I'm not sure, mister Goldberger. Keep going,
- 26:12SCROLLA and then the next question an answer, Corney Wilde.
- 26:16The next question, maybe you're either convicted or pled guilty
- 26:19to a crime. And I said maybe four, four times,
- 26:22three times, mister Goldberger. And your answer was maybe three
- 26:26or four times. Scarola, excuse me? Would you continue to read?
- 26:30Goldberger interrupts them. Well, I'm going to ask I'm going
- 26:34to ask her a question, Scrola. Would you continue to
- 26:37read the next Goldberger? Please don't interrupt me. It's my deposition. Scola. Well,
- 26:43the record's going to reflect that the witness has been
- 26:45caught off, mister Goldberger. Okay, scrolla not permitted to read Goldberger.
- 26:50You can answer the entire question, and you can read
- 26:53the entire matter. But as you read the question, I
- 26:55want to ask you questions about your answer. Just so
- 26:58you testified. Did you not that you had been convicted
- 27:01three times or four times? Now you can did you
- 27:05the witness that's what my answer was. Goldberger. Now your
- 27:09counsel wants you to read the rest of the record,
- 27:11and you can go ahead. Courtney Wilde, what crimes have
- 27:15you either been found guilty or pled guilty too? And
- 27:18my answer was I'm not really certain offhand exactly what
