Speaker 1: What's up everyone, and welcome back to the program. One
• 0:03
Speaker 1: of the biggest issues when it comes to the Brian
• 0:05
Speaker 1: Colberger a plea deal was the fact that he was
• 0:08
Speaker 1: enforced to give an open confession in court. That should
• 0:13
Speaker 1: have been part of it, but instead the judge allowed
• 0:16
Speaker 1: Brian Colberger just to state as simple yes when asked
• 0:20
Speaker 1: if he murdered those four kids, and he said yes,
• 0:23
Speaker 1: he admitted to it. But that wasn't enough. He should
• 0:26
Speaker 1: have been enforced if he wanted the deal to give
• 0:29
Speaker 1: a statement in open court, and if he didn't want
• 0:32
Speaker 1: to do that, they should have taken it to trial.
• 0:33
Speaker 1: A guy like Brian Colberger should not be leading the dance,
• 0:36
Speaker 1: and he should have been forced if he wanted to
• 0:38
Speaker 1: get the death penalty off the table, to give a
• 0:41
Speaker 1: full accounting. But we know that never happened, and now
• 0:46
Speaker 1: it's opened the door for this appeal that we see
• 0:48
Speaker 1: Brian Colberger now making. So today we have an article
• 0:52
Speaker 1: from Fox News and the headline Brian Colberger's post conviction
• 0:55
Speaker 1: relief bid enabled by flawed plea deal, psychologist argues. This
• 1:01
Speaker 1: article was authored by Michael Ruiz and Ashley Papa, the
• 1:06
Speaker 1: forensic psychologist who publicly warned last year that Brian Colberger's
• 1:10
Speaker 1: plea agreement was part of the killer's calculated long game plan.
• 1:14
Speaker 1: Is arguing that prosecutor has miss critical opportunity by not
• 1:17
Speaker 1: requiring Brian Colberger to fully explain the Idaho student murders
• 1:21
Speaker 1: as part of the deal, leaving him room to reshape
• 1:24
Speaker 1: his story as he returns to court despite waiving his
• 1:28
Speaker 1: right to appeal. And that was always a big thing,
• 1:32
Speaker 1: because even though the judge dictated that he wasn't going
• 1:36
Speaker 1: to be able to appeal, we all know that that's
• 1:38
Speaker 1: not true. We all know that the way the system
• 1:41
Speaker 1: set up, there's always a workaround, and Brian Colberger has
• 1:44
Speaker 1: certainly found that workaround. And that's why I think that
• 1:47
Speaker 1: he should have been forced to admit, down to the
• 1:49
Speaker 1: gorious of details, what he did. I know that's not
• 1:53
Speaker 1: something that the families would have wanted to hear, and hell,
• 1:56
Speaker 1: I didn't want to hear it either, But I think
• 1:59
Speaker 1: it's important to have the record set straight, and I
• 2:02
Speaker 1: think it's important to make sure that when somebody is
• 2:05
Speaker 1: accepting a plea deal like this, that they tell the
• 2:08
Speaker 1: truth and the full truth. They shouldn't be given an
• 2:11
Speaker 1: out where they're like, Okay, yeah, I did that, Let's
• 2:14
Speaker 1: keep it moving. Is that closure for the families? I
• 2:18
Speaker 1: mean for some maybe, but me personally, I know that
• 2:21
Speaker 1: I'd want an explanation. Listen, bitch, ass, you're not getting
• 2:24
Speaker 1: the death penalty. The least you can do is tell
• 2:27
Speaker 1: the world why you did what you did. But now,
• 2:31
Speaker 1: according to this psychologist, mister Chris Mohandi, he feels like
• 2:35
Speaker 1: this is all just a big play by Colberger and
• 2:38
Speaker 1: was always part of the plan. It was a real
• 2:41
Speaker 1: mistake and series of heavy mistakes by the DA's office
• 2:44
Speaker 1: to enter into this deal. Because now we're here putting
• 2:48
Speaker 1: the victims through all this again with having gotten nothing,
• 2:52
Speaker 1: said doctor Chris Mohandy, a police and forensic psychologist, an
• 2:55
Speaker 1: expert on violent behavior. And it's frustrating, especially considering all
• 3:00
Speaker 1: of the accommodations that Brian Colberger got leading up to
• 3:03
Speaker 1: the trial. I mean, this man had the whole entire proceeding,
• 3:07
Speaker 1: moved to a different county, but sure he was getting railroaded. Colberger,
• 3:11
Speaker 1: who took a deal to escape the potential death penalty,
• 3:14
Speaker 1: is serving four consecutive sentences of life without the chance
• 3:18
Speaker 1: of parole, plus another ten years and look, the only
• 3:22
Speaker 1: good thing that could come of this, in my opinion,
• 3:25
Speaker 1: is that Brian Colberger ends up getting the death penalty.
• 3:28
  Speaker 1: And I don't say that lightly. I'm not somebody that's
• 3:31
Speaker 1: a big fan of capital punishment, but when it comes
• 3:34
Speaker 1: to somebody like this, somebody as evil, somebody as heartless
• 3:39
Speaker 1: as Brian Colberger, yeah, I'm all for it. And I
• 3:42
Speaker 1: believe the evidence was sufficient to get across the goal line.
• 3:46
Speaker 1: And I understand why the prosecution did it. A lot
• 3:50
Speaker 1: of times, that's what you'll see, right. They want to
• 3:52
Speaker 1: avoid any kind of pain for the families if they can,
• 3:56
Speaker 1: while at the same time getting the result that they're
• 3:59
Speaker 1: looking for. But I think in this instance, when we're
• 4:03
Speaker 1: talking about something as disgusting as this murder or these murders,
• 4:09
Speaker 1: you got to go all the way. You have to
• 4:10
Speaker 1: send a message to people who might do this kind
• 4:13
Speaker 1: of shit. We're not playing no games here and if
• 4:17
Speaker 1: you do it and we catch your bitch ass helicopters Volcanoes.
• 4:24
Speaker 1: Last month, however, he filed a petition for a post
• 4:26
Speaker 1: conviction relief, claiming that he had ineffective counsel and that
• 4:30
Speaker 1: he'd been misled, while insisting that he's innocent of the murders.
• 4:34
Speaker 1: This dude was never ready to take responsibility. He didn't
• 4:39
Speaker 1: want to deal with the death penalty. That's what it
• 4:41
Speaker 1: came down to. The narcissist in him wanted nothing to
• 4:45
Speaker 1: do with it. And after all the shit they threw
• 4:49
Speaker 1: at the judge, all the things they tried, there was
• 4:53
Speaker 1: no way that Brian Coberger was wiggling off the hook.
• 4:57
Speaker 1: But for whatever reason, execution thought it would be a
• 5:01
Speaker 1: good idea to enter into this plea negotiation with the
• 5:03
Speaker 1: dude that they had by the short hairs. So I'll
• 5:06
Speaker 1: never understand it. Police found his DNA on a knife
• 5:14
Speaker 1: sheath recover from the crime scene in a bed with
• 5:17
Speaker 1: two of the four University of Idaho students. Colberger admitted
• 5:21
Speaker 1: to killing in a July twenty twenty five change of
• 5:24
Speaker 1: plea hearing, like how do you escape that? I want
• 5:28
Speaker 1: everybody to understand I don't have a bone to pick
• 5:31
Speaker 1: with Brian Colberger as a person. I don't care about
• 5:33
Speaker 1: that dude, but I think that the evidence is strong
• 5:37
Speaker 1: enough that he would have gotten the death penalty. So
• 5:41
Speaker 1: if anybody wants to try and convince me that he's innocent,
• 5:44
Speaker 1: it's going to be a long road. Now. I'm willing
• 5:48
Speaker 1: to look at the evidence, of course, because we might
• 5:50
Speaker 1: have missed something, and I don't just trust the government.
• 5:54
Speaker 1: What I do trust, though, is the evidence. And if
• 5:57
Speaker 1: the evidence is strong like we've seen here, and not
• 6:00
Speaker 1: only that, but backed up by testing done at Authrum,
• 6:04
Speaker 1: I'm gonna say they have the right guy. Now. If
• 6:07
Speaker 1: Brian Colberger wants to dispute that, the time to do
• 6:10
Speaker 1: that was at the trial, not now. But of course
• 6:13
Speaker 1: that would not have caused the maximum amount of pain
• 6:16
Speaker 1: that Brian Colberger wants to inflict on the families of
• 6:19
Speaker 1: his victims. And I think that's what it all comes
• 6:22
Speaker 1: down to. This dude wants to continue tormenting those families.
• 6:30
Speaker 1: Mahandi said that prosecutors should have required Colberger to provide
• 6:33
Speaker 1: a full account of the killings before accepting the plea,
• 6:37
Speaker 1: even if, as Leta County prosecutor Bill Thompson said after sentencing,
• 6:41
Speaker 1: they believed he would lie. Yeah. I don't care either.
• 6:44
Speaker 1: Get him on record, that's the whole point. Get this
• 6:46
Speaker 1: piece of shit on record, and let's see what he
• 6:49
Speaker 1: has to say. But what you're doing if you do
• 6:52
Speaker 1: that is you're avoiding this whole entire trip down a
• 6:55
Speaker 1: rabbit hole later on down the road. And the only
• 6:58
Speaker 1: reason that I was ok with the process taking so
• 7:01
Speaker 1: long is so that we'd avoid this when we got
• 7:04
Speaker 1: to the trial. Right, Brian Colberger wouldn't have a leg
• 7:08
Speaker 1: to stand on if he tried to challenge the process.
• 7:10
Speaker 1: Yet here we are, all these years later, and that's
• 7:13
Speaker 1: exactly what this dude's doing. Well, that's the lame excuse
• 7:18
Speaker 1: in my opinion, because at least you've got him admitting
• 7:20
Speaker 1: something Mohandi said. This way, he can pull back and
• 7:24
Speaker 1: say I didn't admit to doing anything. I said nothing.
• 7:27
Speaker 1: There are no stories or statements related to me, and
• 7:30
Speaker 1: I was coerced into this. I had terrible counsel. It
• 7:33
Speaker 1: enables him to have a complete playing field for him
• 7:36
Speaker 1: to dance around with now an infinite array of lies.
• 7:40
Speaker 1: So pin them to a story is part of why
• 7:43
Speaker 1: you do this. And it's going to have people out
• 7:46
Speaker 1: here biting onto the bullshit and acting like Coburger's innocent.
• 7:51
Speaker 1: You see what's going on with Tyler Robinson. There are
• 7:53
Speaker 1: some really really demented people out there that don't care
• 7:56
Speaker 1: about the truth or the evidence. They look at this
• 7:59
Speaker 1: shit as the entertainment, and I find that to be
• 8:03
Speaker 1: just absolutely disgusting. We're talking about real people here, families, friends,
• 8:09
Speaker 1: loved ones. Their lives are shattered forever, and you want
• 8:13
Speaker 1: to get out here and play games and act like
• 8:16
Speaker 1: Brian Colberger's innocent even though there's a mountain of evidence
• 8:19
Speaker 1: pointing in the other direction. You better pack a fucking
• 8:22
Speaker 1: lunch because your bullshit is going to get called out too.
• 8:26
Speaker 1: Mahandi said the absence of any detailed confession now gives
• 8:29
Speaker 1: Coburger a room to challenge the case while forcing victims'
• 8:32
Speaker 1: families to relive the proceedings. And that was the goal. Man.
• 8:37
Speaker 1: This dude wants to have as much pain and suffering
• 8:40
Speaker 1: as possible. It was ill conceived, it was poorly designed,
• 8:43
Speaker 1: and at the end of the day, you know the
• 8:45
Speaker 1: victims are being retraumatized by all of this, he said.
• 8:50
Speaker 1: The psychologists also argued that Colburger's handwritten post conviction petition
• 8:54
Speaker 1: and attempts to regain the spotlight for himself are consistent
• 8:58
Speaker 1: with the personality traits he's long associated with the convicted killer. Oh,
• 9:03
Speaker 1: there is no doubt this man is a degenerate without
• 9:07
Speaker 1: a doubt, and it's just like I said about the
• 9:09
Speaker 1: timing of the killings. He wanted to murder these kids
• 9:13
Speaker 1: around the holidays. That's maximum impact, right, You murdered them
• 9:17
Speaker 1: around the holidays, and you room the holidays for the
• 9:19
Speaker 1: families forever. And that's what Brian Colberger's goal always was,
• 9:25
Speaker 1: at least in my opinion, first and foremost, his desire
• 9:29
Speaker 1: to get away with things and to outsmart the system.
• 9:32
Speaker 1: And I do believe that notoriety and fueling his notoriety,
• 9:36
Speaker 1: continuing to fuel that is a secondary gain as well.
• 9:39
Speaker 1: Mahandi said, that's a lot of these sick people. And
• 9:43
Speaker 1: I think that if Brian Kolberger wasn't caught, he would
• 9:46
Speaker 1: have killed again. I think he has all the elements
• 9:49
Speaker 1: of a serial killer. Illustrating that, Colberger's decision to call
• 9:55
Speaker 1: a reporter from prison before filing the petition, he said,
• 9:59
Speaker 1: he's a common archet type, if you will, Mahandi said,
• 10:01
Speaker 1: he's not special, but he believes he's special, which is
• 10:05
Speaker 1: a commonality among these people. The belief that you're special
• 10:08
Speaker 1: when you're not, the belief that you're smarter than other
• 10:11
Speaker 1: people and cannot with them. Oh, that's definitely a trait.
• 10:14
Speaker 1: He has. Brian Colberger thinks he's so smart that it's
• 10:17
Speaker 1: not even funny. Not smart enough to get away with it, though,
• 10:21
Speaker 1: is he Mahandi said, that's why he believes the public
• 10:25
Speaker 1: should resist looking at killers. That's fascinating figures. They're terrible
• 10:29
Speaker 1: people and monsters. He said, Well, in my opinion, that's
• 10:33
Speaker 1: certainly what Brian Colberger is. And I think that if
• 10:38
Speaker 1: by some miraculous reason he gets this overturned, then he's
• 10:41
Speaker 1: going to set himself up for a trip to the
• 10:45
Speaker 1: shooting gallery. And I mean that literally, Idaho has passed
• 10:50
Speaker 1: capital punishment by shooting. So if Brian Colberger goes back
• 10:55
Speaker 1: to trial and gets convicted, my man's gonna end up
• 10:59
Speaker 1: in front of a bunch of dudes with rifles. And
• 11:01
Speaker 1: as far as I'm concerned, if anybody has earned that fate,
• 11:05
Speaker 1: it's most certainly Brian Coohberger. All Right, folks, that's gonna
• 11:10
Speaker 1: do it for this one. All the information that goes
• 11:12
Speaker 1: with this episode can be found in the description box.
